Residents sound off on sanctuary ordinance Ordinance would prohibit police from retaining suspects based solely on immigration status

Morton Grove residents and a few non-residents testified for almost two-and-a-half hours at a standing room only April 24 town hall meeting about the proposed sanctuary village ordinance.

If approved, the ordinance would prohibit Morton Grove Police Department from detaining suspects or honoring federal warrants to detain suspects, based

solely on their immigration status.

It would also ban all village employees from investigating residents’ immigration status, and it preemptively requires the village not to participate in a Muslim registry, or any other federal registry based on ethnic, racial or religious status. The ordinance emphasizes that nothing there prevents detention of individuals based on something other than violation of immigration laws.

The supporters of the ordinance argued that it would affirm village

values and provide the force of the law behind what has been a less formal procedure. The opponents argued that there was no need for the law, and that all it would do is restrict the police. Through it all, village trustees and Mayor Dan DiMaria remained carefully neural, saying that they would take all feedback under consideration before deciding how to proceed.

As previously reported by the Bugle, the ordinance was proposed by Americans In SolidaryChicago, a group founded by Morton Grove attorney Johnathan Lahn in the wake of President Donald Trump’s inauguration. The group originally sent the proposal in Jan. 27, and, after it failed to get traction, they attended several village board meetings to press the issue. The village ultimately decided to hold a town hall meeting at the American Legion Civic Center to get resident feedback.

In Jan. 25, Trump issued an executive order ordering the Justice Department and the Department of Homeland Security to block sanctuary cities from receiving federal funds. Since being appointed U.S. Attorney General, Jeff Sessions made a number of statements insisting that sanctuary cities will be penalized. On April 21, he sent a letters to Chicago and several other large sanctuary cities, warning them that they must show proof that they’re complying with federal laws or risk losing access to Justice Department grants.

On April 26, two days after the town hall meeting, federal judge William Orrick blocked key parts of Trump’s executive order, ruling that they were more likely to be found unconstitutional. He did rule that the Justice Department could enforce conditions of the federal grants. The Justice Department subsequently announced that it would appeal.

The Bugle estimates that about 160 people attended the town hall. As the meeting got underway, Morton Grove Village Administrator Ralph Czerwinski explained that Morton Grove residents would get to speak first, and each speaker would get two minutes.

Non-residents were allowed to speak afterwards, and they only got one minute each.

Lahn spoke first, summarizing the ordinance. Responding to concerns about loss of federal grants, he argued that nothing in

the proposal actually violates Justice Department guidelines.

Michael Simo, the Morton Grove Chief of Police, spoke next, explaining that the department focuses on going after criminal offenses. But, he explained, violations of immigration laws don’t necessarily fall into this category If someone snuck across the border, or entered the country using forged documents, it was a criminal a offense, but if someone entered the country legally and overstayed their visa, that’s a civil offense.

“We do not arrest people for federal civil violations,” he said. “We don’t stop people to ask for their immigration status. We don’t hold people on ICE [detainer requests], unless that person is [accused of] a federal crime.”

When asked by the village board what Morton Grove would stand to lose if its federal funding is cut off, Czerwinski explained that it could be anywhere between $100,000 - $500,000 a year. However, that figure includes all federal grants, not just the ones issued by the Department of Homeland Security and the Justice Department.

Most of the supporters of the ordinance argued that, even if it wouldn’t change much in practice, it would be an important gesture that would reflect village values.

Fr. Dennis O’Neill, of Morton Grove’s St. Martha Catholic parish, said that he had experience dealing with Orthodox and Catholic Christian refugees from Iraq. Two weeks ago, he tried to broach the topic of their immigration status.

Even though they were in United States legally, their experience in their home country made them afraid of dealing with the police.

“When I brought up the subject, I scared them off,” O’Neill said.

“They’re coming from a different political situation, and they afraid.”

The ordinance, he argued, would help assuage those fears.

Psychologist Jon Cole supported residents from the mental health perspective, saying that undocumented immigrant families already experience stress, especially in families where some members are either U.S. citizens or legal residents.

“Our kind words are not enough – we need to pass something with real [legal authority],” he said.

Habeeb Quadri, the principal at Morton Grove’s Muslim Education Center, recalled how, 13-14 years earlier, he attended an equally contentious town hall when his employer was trying to open in the village – noting that, since then, whatever concerns there may have been have died down. He said he supports the ordinance. “[The ordinance] is not here to harbor criminals – I myself have kids here, I’m a principal of a school” Quadri said.

Chuck Felsoni argued for the ordinance from financial perspective, noting that detaining suspects on ICE detainer requests costs the village money that the federal government doesn’t reimburse.

Early during the town hall, Naushira Rahman, whose father came to United States on a work visa and who had to wait 9 years to be reunited with him in United States, said that she often gets told that, as someone who immigrated legally, she shouldn’t support people who “cut in line.” She said she had no patience for that argument.

“There are a number of reasons that will be give in opposing to the sanctuary city ordinance, and it boils down to one thing – bigotry,” she said.

Most of the opponents who spoke during the town hall took pains to emphasize that they appreciated Morton Grove’s diversity and had no issue with immigrants per se. Rather, they felt that the ordinance was unnecessary and that the only thing it would do is tie police officers’ hands. “[The ordinance] does say ‘It limits the police department from doing its job,’” Steven Yasell, a 2017 Niles mayoral candidate, said.

Pam Lundsberg said she was worried about legal consequences to Morton Grove.

“To say that [undocumented immigrants] haven’t broke our laws is incorrect, because they’re illegal,” she said. “Just because you can sneak into our country doesn’t give you the right to sidestep [our laws]. And I’m concerned about the village liability because we shield illegal aliens.”

John Listin emphasized that it was undocumented immigrants that he was worried about.

“Illegal aliens, when we got them in the community, property values go down,’ he said.

Trustee proposes opting out of ordinances Niles trustee proposes opting out of minimum wage, paid sick leave ordinances

In a rare break from the usual protocol, Village of Niles Trustee George Alpogianis placed three ordinances on the agenda for the village board’s May 23 meting.

The move came during the end of the April 25 board meeting.

The first ordinance would use the village’s home rule powers to opt out of Cook County’s upcoming minimum wage increase.

The second ordinance would do the same for a county ordinance requiring companies to pay sick leave for their workers. And the third ordinance would give the village HR software to Minneapolisbased Ceridian HCM Inc. While the power to set the agenda falls to Niles mayors, the village

municipal code allows trustees to add their own items, so long as the super-majority of the trustees approve it.

Mayor Andrew Przybylo made it clear that he would oppose the minimum wage ordinance, arguing that it would hurt residents’ earning power and put Niles businesses at a competitive disadvantage. But the board was willing to at least consider the proposals, voted unanimously to place the first two on the agenda and 6-1 to do the same to the third.

In October 2016, the Cook County Board of Commissioners approved an ordinance that would gradually increase the minimum wage over the next three years from the current Illinois minimum wage of $8.25 an hour.

On July 1, 2017, it will increase to $10 an hour. It will then increase

to $11 an hour in July 2018, $12 an hour in July 2019 and $13 an hour in July 2020. The Chicago City Council approved its own multiyear minimum wage increase on Dec. 2, 2014. It went up to $10 on July 1, 2015 and $10.50 on July 1, 2016. It will go up to $11 on July 2017 and continue to increase by a dollar until 2019. From 2020 onward, it would increase by 2.5 percent or by the increase in the Consumer Price Index – whichever is greater, though there would be no increase if the unemployment rate grows about 8.5 percent.

Several Cook County municipalities already used their home rule power to opt out. Park Ridge City Council is currently weighing the issue, while the Village of Morton Grove Board of Trustees hasn’t taken a position one way or another.

The county paid sick leave ordinance, which the county board approved on Oct. 5, 2016, requires employers to give any employees that worked at least 80 hours

within a 120 day period one hour of paid sick leave for every 40 hours worked. They may not earn more than 40 hours per year. Like the minimum wage ordinance, it will take effect on July 1, 2017 – the same date as a similar City of Chicago ordinance takes effect.

The final ordinance would simply give a contract to Ceridian. As Alpogianis explained to the Bugle, the ordinance would eventually make it to the village board for a vote even if he didn’t do anything – he simply wanted the board to consider the contract as soon as possible.

Both Alpogianis and Przybylo have restaurant backgrounds. The trustee owns Kappy’s American Grill in Morton Grove, while the mayor previously co-owned the White Eagle Banquet Hall in Niles.

While Alpogianis has occasionally voted against the mayor, he voted with Przybylo the vast majority of the time, and he ran on the same slate as the mayor in the last two municipal elections.

Przybylo said he disagreed with opting out of the ordinance.

“If you think that you’re helping your community by holding back [residents’] earning power, you’re wrong,” he said.

The mayor also argued that it would put the village businesses at a competitive disadvantage from businesses in Chicago and other nearby municipalities, where businesses would be able to pay their employees more.

“It’s just something that businessmen can dream up because it saves money,” Przybylo said.

While the board voted unanimously to put the first two items on the May agenda, by the time the third resolution came up for the vote, trustee John Jekot said he was having second thoughts, casting the sole ‘no’ vote.

College opportunities key for special needs students

BY DANIEL SMROKOWSKI My friend Chloe Young, 18, of Warrenville, stands in the middle of an ice rink at Seven Bridges Ice Arena in Woodridge as her figure skating lesson takes place this past week. She sports a brown headband with sparkles, a blue skirt, ice skates, and a light blue fleece jacket with the words “U.S. Figure Skating” embroidered on the upper left of the jacket.

Chloe was diagnosed with Williams syndrome at three weeks of age; doctors said that she was not going to make it.

Williams syndrome is a deletion of the first copy of the gene #7. Chloe defied her doctors’ expectations by rising to become a figure skating champion, soonto-be high school graduate firmly on the road to a higher education. To her proud parents, Jennifer and Marcus Farmer, Chloe is their “little miracle and star,” her mom proclaimed.

This is the time to celebrate the accomplishments of those with Williams syndrome and other intellectual disabilities.

It is time to educate our communities about how to accept and include those of us with special needs in college and in career planning.

Families of students with special needs have a passion for their child to be included and accepted by their peers without disabilities. Often times, those of us with special needs are excluded from certain activities within the community or in a regular education classroom.

“Our passion for inclusion was that Chloe wasn’t always included, so that’s where it started for us,” said Jennifer.

Chloe’s parents had always given her all the extracurricular opportunities that any other child could receive such as competing in figure skating or cheerleading.

One afternoon in the eighth grade, Chloe came home and sat her parents down for “the talk.”

“I want to go to college,” said Chloe.

And, that dream then became her mother Jennifer’s new research project.

Jennifer searched for the various programs that offered support for students with special needs in college. Thankfully there were many programs that are now available. Jennifer had to research the cost, where they were located, and what Chloe would need to accomplish in high school. Many students with disabilities have an Individual Education Plan (I.E.P.) that helps special education teachers, school, and parents to know how to best help the student in school and for the future. There are many special education

By Daniel Smrokowski teachers that care and want the best for their students but they may not always know what the student wants for their future.

“I don’t think that in an I.E.P. situation it’s always what the school wants,” said Jennifer. “I think it’s what the student wants and that’s what should drive everything.”

Similar to Chloe, my special education teachers did not necessarily believe that college was the right choice for me.

When I was in high school, my parents and I spent lots of time in I.E.P. meetings encouraging my case managers to include me on the education track for college. In 2012, I earned my degree in journalism from Roosevelt University.

Even now that 10 years have passed since I was a high school senior, as Chloe is today, there might still be special education teachers unconvinced to put our college dreams first.

Today, more and more special education teachers take into account what the student wants. In doing so, this gives those of us with disabilities equal opportunity to achieve a higher education.

During Chloe’s college visits, there was one university that she very quickly chose as her No. 1 school of choice— Vanderbilt University. Located in Nashville, Tennessee, Vanderbilt is rated as #15 in the nation and, according to Chloe’s mom, Jennifer, has a history of inclusion within the “Next Steps” program that Chloe will be a part of. “Next Steps” is a program for students with intellectual disabilities providing them with an individual program of study in the areas of academics, social skills, and vocational training.

“I wanted [Chloe to] go somewhere they’ve done inclusion and they’ve done it well,” said Jennifer. “What Vanderbilt offers people with Williams [syndrome] is amazing.”

Chloe and her parents looked at other university campuses, including South Carolina and the University of Tennessee but the high quality level of inclusion that Vanderbilt brings to their students with intellectual differences was the perfect

match for Chloe. During a “trial day” at Vanderbilt, Chloe had an opportunity to sit in on classes to see what a typical college day was like. It was then that Chloe and her parents saw an amazing poster in front of the Vanderbilt Kennedy Center. It was a poster showcasing a little boy with a cowboy hat who had Williams syndrome. Jennifer explained how the university does a tremendous amount of research and even offers a music camp.

Come fall 2017, Chloe will be a pioneer as Vanderbilt’s newest freshman. She will be the first person with Williams syndrome to be a student at Vanderbilt and actually be living on campus. Chloe loves studying science and hopes to have a career in this field. Jennifer says Chloe’s love for studying science has made college a default option for furthering her education.

“Training in college will lend itself to a career as opposed to a job,” said Jennifer.

One of the reasons why Chloe chose Vanderbilt was she wanted a school that had a study abroad program and also football so that she could hangout with friends and “tailgate,” as Chloe excitedly told me. According to the Williams Syndrome Association, people with Williams syndrome are extremely social and friendly. Chloe will have no problem making friends when she begins her collegiate studies.

Many of us with special needs, like Chloe and myself, want to be included in college. The number of universities today that have disability programs is on the rise. Today, many higher-level institutions are able to bring inclusion into their college classrooms. We want to have the same pathway to have a career as our peers without disabilities.

Many students with special needs want “to be included in classes instead of rejected from classes,” said Chloe.

When Antoine Kelly came into Maine East three years ago, varsity baseball coach Ron Clark knew the lanky left hander could be special – even if Kelly didn’t know it yet.

Over the last three seasons, Kelly has taken the game more serious and is starting to reach the heights Clark knew he could.

Before my freshman year, I really didn’t care for it and then during freshman year I started to take baseball more seriously and working at it,” Kelly said about his abilities. I have been trying to lift during the off season and practice pitching and batting and I guess it helped. I put in work, but maybe not as much as I could be, so I could probably do better with that.”

Clark saw the potential early on in Kelly.

“He was 6-3 or 6-4 as a freshman, now he is a 6-6 lefty and the ball just flies off his arm. He has something you just can’t teach,” he said. “He is so impressive to watch. He has gotten better and better every year. He started around 80 as a freshman and has added every year and now he is in the upper 80s consistently.”

Now a junior, Kelly consistently tops the radar gun at 8889 miles per hour with his fast ball, all coming out of a 6-foot, 6-inch, sub-200 pound Chris

Although his velocity has improved, there are still parts of his game he needs to improve on.

“He needs to limit his walks still, but the other areas of his game have improved like holing runners on,” Clark said. “He was very raw as a freshman and I have to give a lot of credit to our pitching coach Matt Kudlik.

He really does a great job with our pitchers. He played at Notre Dame High School on the 2004 state championship team and he was their No. 1 pitcher and he really does a great job. “(Antoine) has a higher ceiling to go and he is going to keep improving every year. He is a talent and we are happy to have him.

Anytime he is on the mound, we have a chance.”

With his rising talent comes more eyes on his game with scouts out several times to see Kelly throw.

“It is fun, but it is overwhelming, but I guess I have to live with it,” he said of the attention. “I have to keep working and I hope I can get better.”

Having a player of Kelly’s caliber on the roster not only helps him, it helps bring excitement to the dugout and may get other players noticed by a scout or two.

“It has brought some attention to the program because of him and we have some other good players and not they get attention because of him,” Clark said.

Excessive giving can become debt DEAR DAVE, My wife and I are debt-free except for our home, and we’re on Baby Steps 4 and 5. Recently, we were asked to make a large donation to a charity we already support.

We don’t have the full cash amount they asked for on hand, and after hearing that, they said we could make monthly installment payments until the donation amount was paid in full. We’re hesitant to do this because it seems a bit like debt to us. What do you think?

BEN DEAR BEN, Well, it’s not debt. There would be no repercussions, other than guilt,

if you couldn’t make the full donation. So, it’s not debt. To be honest though, I don’t engage in that kind of stuff when it comes to giving.

My wife and I do all our giving — except for our tithe to our local

church — through our family foundation. Sometimes we’ll do this giving in a couple of installments, but it’s not because we don’t have the money. It’s generally a situation where we’re walking with the charity or ministry throughout the year, and we’re observing and assessing the need.

I’d be hesitant to give a gift when I don’t have the money. Most of the time, approaches like this fall under the heading of manipulation.

You’re being pushed beyond your means. Most giving of this type, biblically speaking, would be from surplus. And right now, you don’t have the surplus.

I’m kind of uncomfortable with this, Ben. I don’t engage in making gift promises beyond what I have.

It’s not debt, but it kind of starts to feel like it, and it’s not so much living beyond your means as it is giving beyond your means.
