Council sustains mayor’s veto of zoning variance BP gas station is located in B-2 commercial district, where the outdoor signs must be no more than 32 square feet

The Park Ridge City Council voted 2-5 against overriding Mayor Marty Maloney’s veto of a zoning variance for a sign in front of a BP gas station at 1220 W. Touhy Avenue.

As previously reported by the Bugle, the gas station owner asked for a variance allow them to build a sign with a larger surface area than the zoning code would normally allow. The city council

narrowly approved it on Oct. 2 by a 4-3 vote. On Oct. 16, Maloney officially vetoed it, explaining that allowing the sign would only make the problem of non-compliant signs worse.

Ald. Nicholas Milissis (2nd) and Ald. Roger Shubert (4th) argued that the zoning code was too restrictive. John Graham, one of the partners who owned the gas station, argued that without the larger sign would hurt his ability to compete and undermine the investment his company already put into renovating the station.

But the majority of the council remaining unconvinced that he couldn’t accomplish the same thing with a code-compliant sign, voted to sustain the veto.

The BP gas station is located in B-2 commercial district, where the outdoor signs must be no more than 32 square feet. Graham Enterprises, which owns the gas station, requested a variance to allow the sign to be up to 72 square feet. During past meetings on the issue, Graham indicated that it would allow the gas station to better compete with two nearby gas stations with signs that are larger than current codes.

The competitors’ signs are grandfathered in.

In his veto message, Maloney indicated that, while Graham was right about the competitors’

signs being larger, the city should be trying to bring non-compliant signs into compliance, and having a new non-compliant sign wouldn’t help.

The city council considered whether to override the veto during the start of Nov. 6 meeting.

Graham told the council that, as he saw it, gas stations have needs that may not be the same as the needs of other businesses with large outdoor poll signs.

“We’re asking something that’s hard to give, but usually the difference is something we try to, you know, advertise our pricing,” he said. “[Smaller signs] put us at a disadvantage communicating who we are as effectively as, for instance, the bank that’s just east of us.”

ed a sign that conveyed the fact that it’s a BP gas station as well as a family-owned business and its contributions to the community.

He also noted that the gas station collects motor fuel tax and sales tax on the city’s behalf, so Park Ridge should want to see it succeed.

Ald. Gail Wilkening (3rd) said that, after the original vote, she did research on both conforming and non-conforming signs and she wasn’t convinced that having a larger sign was really necessary.

“The one sign that was in compliance that made me decide to support the veto was the service station at Cumberland [Avenue] and Higgins [Road],” she said.”

PACE approves 1st major fare hike in 6 years Riders will have to pay more per ride and per transfer, passes remain same

The PACE suburban bus transit agency’s Board of Directors voted unanimously to approve a budget that included the first major fare hike since 2009.

Whether they’re using regular routes, premium routes, dial-aride services or paratransit services, riders will have to pay more per ride and per transfer. The cost of PACE and PACE /CTA passes remains the same. As previously reported by the Bugle, the fare increase is one of several steps the transit agency is taking to make up for funding shortfall.

Agency spokesperson Maggie Daly-Skogsbakken told this newspaper that, while PACE understood that fare increase could hurt riders, especially paratransit riders, it was important for the transit agency to maintain its services and keep its capital projects on track. Without it, she said, PACE’s ridership might suffer in the long run.

On Jan. 1, 2018, the cash fares for regular routes will go up from $2 to $2.25, while Ventra card fares will go up from $1.57 to $2. The increase will be more dramatic for premium routes, going up from $4 to $4.50. Premium routes include commuter shuttles, a summer shuttle service to Six Flags Great America, and routes that link riders to Wrigley Field, Soldier Field and Guaranteed Rate Field on game days. Express shuttle routes 755 and 855 serve Plainfield, while routes 850 and 851 serve Bolingbrook. Route 768 and Route 775 provide express service to Soldier Field and Guaranteed Rate Field from Bolingbrook.

For the first time in recent history, the cost of transferring between routes will increase as well.

The regular transfers will increase from $0.25 to $0.30. The transfers between buses serving Joliet will remain free.

Niles politicians, salaries & referendums State law mandates that salary increases can’t begin until the end of an elected official’s term, preventing current elected officials from benefiting financially from their actions.

In September of 2016 the board voted to increase their salaries in 2019 per State mandate.

But now Mayor Przybylo blames term limits for making the salary increase unfair as all the current board members may not be in office in 2019 while the newly elected trustees in 2017 will receive an increase now.

So the mayor and his trustees recently voted to override state law and voted the entire board a salary increase now.

The mayor talks about fairness in pay increases. How fair is it for our elected officials to change state law and raise their own salary without ask-

ing us, their employers?

The mayor and the trustees hold an office that is based on service to the public. The public is their boss. As such, we should have a say if our elected officials want to override state law for their personal financial benefit.

The Mayor of Niles is a big fan of referendums. He has filled the ballot until 2019 with issues of his liking.

Two of these issues could and should be decided by the current board, without a referendum vote. The Village has already published a RFQ for development of a senior housing facility but has a referendum question about doing this on the March 2018 ballot.

Another question is about modernizing emergency operations. The Board is “empowered…to regulate for the protection of the public health, safety, morals, and welfare… to serve the res-

idents (Ord.2016-54). They can and should act on it now, without waiting for a referendum.

Niles residents, call or email the trustees and demand that this salary issue be decided by referendum at the March 2018 election.

Tell them as a citizen you should have a say in this matter.

In defense of Cook County Assessor’s Office TO THE EDITOR Please allow the Cook County Assessor’s Office to address recent inaccuracies about property assessment.

The Civic Consulting Alliance (CCA) is studying the assessment and appeal processes, including Assessor’s Office procedures, assessment models, the Cook County Board Review and other aspects. Assessor Joseph Berrios welcomed the CCA study.

The study’s timing has been questioned, and Berrios was criticized for it. However, critics and media have ignored the fact that CCA does not report to the assessor. He has absolutely no authority over their timetable.

To be clear, the assessor’s only responsibility is to fully cooperate with the study. He continues to do that and provides study personnel with office space. Assessor Berrios respects the CCA study that, unlike others, includes assessment professionals.

When discussing taxes, please keep in mind that assessors don’t set tax rates. Also, the State Equalizer has gone down dramatically since Berrios became assessor, an indication of fair assessments.

The Cook County Assessor’s Office again states, unequivocally, that its estimated property values are fair and accurate. There is no rampant overassessment of lower-market homes or under-valuation of higher ones.

Previous administrations employed the same assessment model now in use, and they were not criticized. Berrios is criticized, and his improvements at the Assessor’s Office are dismissed.

Some observers without assessment experience say Cook County should use a recently developed assessment model. In fact, after initial enthusiasm for that new model, our staff found it did not work when full implementation was attempted.

Accomplishments of the Berrios administration were disregarded in the criticisms. For example, the administration has six straight years of on-time assessments leading to timely tax bills. Previously, bills were repeatedly late for 34 years.

On-time revenue for schools, etc. eliminates $5 to $6 million countywide in monthly interest on borrowing while awaiting revenue. In the

13 years before Berrios was elected, 39 late months were accumulated.

Berrios’ zero late months saved taxpayers tens of millions of dollars, and counting.

Past assessors left erroneous exemptions unchecked. Berrios designed the law that recovers this would-be lost money and returns it to school districts, communities and municipalities. To date, $47.2 million has been billed.

Berrios conceived and helped pass legislation, which went into affect in August, giving lower-income homeowners greater flat-rate, money-saving exemptions.

For appeals awareness, CCAO has raised annual community appearances to 238 - with 81 percent in areas with lower-market homes.

None of these things were acknowledged in recent reports.

With 47 years of public service, Joseph Berrios knows assessing Cook County’s 1.85 million properties is difficult. But he gets the job done, works to ensure fairness and to improve the system.

Graham was describing – nor was he convinced that lack of a larger sign would hurt it.

“And as far as any concern about it not being viable place for applicant’s business -[the gas station has] been a business for many years, and hasn’t shut down for many years, I think they will do just fine with 32 square feet,” he said. “If they choose to stop being a gas station, or sell the property, a Starbucks drive-through sounds pretty good.”

Ald. John Moran (1st) noted that he didn’t think motor fuel tax argument held much water.

Touhy Avenue and elsewhere in Park Ridge, he noted. If the residents need to buy gas, they can just go somewhere else – and the city would get its motor fuel tax revenue either way.

Milissis, on the other hand, strongly opposed the veto.

“We’ve always maintained that our sign ordinance is very antiquated and bad for business,” he said. “This is a prime example of that. It’s very inhospitable to businesses, it’s overly restrictive, and if it was up to [the officials] that crafted it, we would be using stone tablets and blackwood in this city.”

Shubert said that, while he didn’t feel as strongly about the issue as his collegue, he still thought vetoing a zoning variance approval set a bad precedent. He also argued that, if Park Ridge was going to try to address non-compliant signs, it should develop a proper strategy. Ald. Charlie Melidosian (5th) agreed with that, even if he supported the veto.

Ald. Marty Joyce (7th) said that while he originally supported the sign and wasn’t entirely comfortable with the veto, he wasn’t going to overturn it.

As the council prepared to vote, Maloney said that he agreed with

point about developing a strategy for treating non-compliant signs.

He also said that he hoped that the council’s vote will send a message.

“Hopefully, this is a signal of where the council sits on the issue, so, hopefully, [zoning variance applicants] will adjust what they send to us,” he said.

City attorney Adam Simon told the council that, with the veto sustained, Graham wouldn’t be able to fine the same or “substantially similar” application for at least 12 months. But if he makes “substantial changes,” he can apply for another variance.

When Naperville Central senior running back AJ Deinhart scored on a 53-yard carry to give the Redhawks a 28-13 lead on their opening possession of the second half, it looked like Maine South’s title defense chances were dim, at best. The Redhawks had controlled the tempo in the first half and had burned the Hawks’ defense and special teams on scores for 34, 93, 49, and 53 yards.

Hawks coach David Inserra couldn’t argue with that, but he remained optimistic.

“You look at the clock and see all this time left and we just needed one play to get us going,” he said.

The Hawks, who had struggled in the first half with mistakes and unforced errors—particularly on offense—took advantage of three Redhawks second-half turnovers and other lapses to score 26 unanswered points and rallied to a 3928 8A quarterfinal win.

“We didn’t panic when we were down,” Inserra said of the team’s turnaround. “We do what we do.

We didn’t play our best, but they showed a lot of resiliency.”

The Hawks (11-1) offense got them started in the second half with a solid drive that culminated in a 12-yard touchdown pass to senior running back Fotis Kokosioulis, his second of four scores, to cut the lead down to 28-19.

Even with the failed 2-point con-

version, it was a step in the right direction against the Redhawks (9-3).

Then the Hawks’ defense stepped up and forced the first of three turnovers with an interception by senior linebacker Andrew Masterson. The Hawks missed the field goal, but they kept the pressure on the Redhawks’ offense—particularly on Deinhart— and forced them into committing two more turnovers and adding six more points on a pair of field goals.

Inserra, though pleased with the turnaround, admitted the six points from three turnovers was a bit uncharacteristic for them. All the same, he saw the benefits.

“We fed off that energy,” he said. “And we told them to keep at it. Don’t get too fancy. Just keep fighting.”

The Hawks carried the momentum on offense and broke through with a 5-yard run by Kokosioulis to give the Hawks a 32-28 lead, their first of the game.

And it was Kokosioulis who delivered the final blow. On 3rd and 20 from the Redhawks’ 35, he found an open seam on the outside and charged right past them for his fourth touchdown of the game and put the game out of reach for good.

“I came up and I saw an opening on the outside. Got some good blocks and I was able to take advantage of my speed,” Kokosioulis said of the play.

rushing touchdown in the first half. He had strong command of the Hawks’ hurry-up offense and was able to keep the momentum going for them in the second half.

When asked about the plans for next week, O’Sullivan said, “Brushing up on a lot of things and making sure we’re ready.”

South now faces No. 1 seed Lincoln-Way East. The Hawks faced off against the Griffins in week 2 and was handed their only loss in a 28-26 defeat.

“They did a great job against us and it’s always a lot better the second time around,” Kokosioulis said. “We’ll be ready for it.”

Rental property not part of Baby Step 2 Pay off primary home before taking care of rental properties DEAR DAVE, I have a rental property that I still owe some money on, and I’ve just begun Baby Step 2 of your plan. Should rental property debt be included in the debt snowball?

MATT DEAR MATT, No, it shouldn’t. Baby Step 2 of my plan is where you use the debt snowball to pay off all debt — from smallest to largest — except for your home. This, of course, comes after Baby Step 1, in which you save up $1,000 for a beginner emergency fund. I would include rental properties in the “home” category, and I urge people to get serious about paying off their homes a little further down the road in Baby Step 6.

To fill in the gaps, Baby Step

3 is going back and fully funding your emergency fund with three to six months of expenses.

Baby Step 4 is investing 15 percent of your household income in Roth IRAs and other pre-tax retirement plans, and Baby Step 5 means setting aside college money for the kids. Baby Step 6 is where you pay off your home, including any rental properties that weren’t already paid for in

cash, and Baby Step 7 is when you relax, build wealth, and give.

If it were me, I would pay off my primary home before taking care of the rental properties.

That’s simply a risk management perspective. However, if you owe just $20,000 on your rental property but still have a $3 million mortgage on your residence, you might go ahead and quickly knock out the rental property first.
