City to consider ordinance regulating infill Despite 1998 city actions, topic of resolution versus ordinance resurfaces, as some sort of enforcement is sought

Park Ridge aldermen agreed to move ahead with developing an ordinance that could regulate homeowners’ altering the shoreline of the lake that gave the Murphy Lake community its name – even as Ald. Marc Mazzuca (6th) remained unconvinced that it was a good idea.

The issue goes back to 1998, when the Murphy Lake Improvement Association asked the city to turn the association’s restrictions against filling in the lake into a city ordinance. The city council instead passed a resolution instructing the Park Ridge Director of Public Works to refuse to issue any permit for that kind of construction. But in 2016, when Murphy Lake homeowner Oscar Marquis asked the city to enforce the resolution, city attorneys advised the staff that a resolution can’t actually affect grading regulations – only an ordinance can.

When the improvement association asked the city council to create an ordinance, the aldermen wound up suggesting that the association try to resolve the issue by themselves before the city steps in. The efforts failed, the issue wound up before the Park Ridge Procedures and Regulations Committee of the Whole during its Jan. 22 meeting. While many aldermen expressed reservations about potentially interfering in an issue relating to a private lake,

they ultimately agreed that it was at least something worth considering.

In a memo issued on June 26, 2017 city attorneys Julie Tappendorf and Adam Simon laid out three options for how Park Ridge should handle the issue. One would be to do what the association asks and replace the resolution with an ordinance. That would require a zoning amendment, which would, in turn, need to go through a public hearing.

The Park Ridge Planning and Zoning Commission would then have to either approve or deny the amendment, with the city council making the final decision.

The attorneys warned that, if the aldermen decide to go with this option, there were several things they needed to keep in mind. Any restriction would have to be based on the city’s authority to use the zoning code to “protect and preserve the health, safety, and welfare of its residents.” Figuring out what violates the ordinance and what doesn’t, as well as enforcing those decisions, would require staff time and city funds.

The attorneys also warned that the city could potentially risk legal liability, as well as set precedent for other homeowner organizations who may want the city to enforce their restrictions. Finally, they recommended that the city makes sure that at least 75 percent of the residents are in favor of the ordinance.

Alternatively, the attorneys suggested that either the association

or the individual homeowners enforce the restrictions on infill activity. In the later case, they noted that anyone who lives near the lake has a stake in what happens to the lake, so they would have standing to bring legal action against anyone who would do something to affect it.

During the Jan. 22 meeting, association President Neal Salah told the aldermen that efforts to resolve the situation on their own failed because they couldn’t get all of the homeowners on board.

“The challenge we have is that there are [three to four] homes that are, for the lack of better word, estranged from the lake,” he said. “They don’t communicate with us, for whatever reason. We don’t know where those people are, what they’re doing, they don’t pay dues.”

Salah said that because his organization was formed by concerned homeowners rather than a full-fledged homeowner association that encompasses every single property, there is nothing they can do to compel those homeowners to respond.

In response to questions from Mazzuca, he said that 29 out of 33 property owners are in favor of restricting infill activity.

After Mazzuca suggested that those 29 homeowners form a legal covenant, Salah countered that it would be worthless if the remaining homeowners don’t get on board.

Ald. John Moran (1st) agreed.

“I see Ald. Mazucca making smirky faces, but that’s the truth,

the ecological truth is all it takes is one to fill in an important area of the lake and the entire ecology is thrown off and it could ruin the lake,” he said. “[Options] 2 and 3 also need unanimous decisions, neither of this worked out, and now Option 1 is now where we’re left. If we as a council feel it’s worth protecting the integrity of the lake, the only option to do it is for us to get involved.”

Mazzuca said he saw where his colleague was coming from, but he wasn’t convinced the city should get involved. He argued that it wasn’t in any property owner’s interest to do something that would ruin the lake, and neither is doing anything that would go against the wishes of the overwhelming majority of the homeowners.

“So far as the city role of spending thousands of dollars adjudicating this issue, or even getting anywhere near the middle of the issue, I don’t think it’s a useful errand for us to be running,” Mazzuca added. “I will not be in favor of moving this forward. Smirky face aside.”

Moran also argued that it was in the city’s best interests to help Murphy Lake homeowners: their properties were more valuable than other nearby homes because they were located by the lake. Preserving that lake helps the city in terms of tax revenue and reputation.

Ald. Marty Joyce (7th) said that he would be willing to consider the ordinance – but he wanted to make sure the city does its best to reach all homeowners.

“For me to go forward, I’d like to at least have some official communication from the city to those homeowners that may or may not agree with this,” he said. “Just so we have some official outreach we can document, just so we can show we tried to contact you.”

Ald. Charlie Melidosian (5th) said he was torn, but he was in favor of at least trying to come up with an ordinance and bringing it to a vote.

Long-time Park Ridge zoning advocate Judy Barclay said she didn’t see the problem with the city imposing zoning restrictions on private property.

“It is very valuable section of our community,” she said. “And I’m not sure why there’s this problem of dealing with private property when our zoning ordinance deals with it daily on every single property in this community.”

Park Ridge Community Preservation and Development Director Jim Brown explained that the city usually tries to balance property rights with the public good.

After Barclay noted that she was there when the city council passed the original resolution, Mazzuca asked whether she thought the aldermen deliberately passed something that would mollify the homeowners without doing something that would require more commitment and potentially put the city at risk.

“I think you’ve got it, because the council at the time wanted to placate, and they couldn’t figure out how to protect these properties or this lake, which is a nice wonder of Park Ridge,” Barclay replied.

After further discussion, the aldermen agreed to ask the staff to come up with an ordinance that would restrict infill activity. That way, they could work out the details, send it to Planning and Zoning and have a public hearing.

Mazzuca said that, while he still thought the ordinance was a bad idea, he wouldn’t object to the process.

“I think it’s a really bad idea, but if there is a consensus to move forward with said bad idea, lets see what it looks like on paper,” he said. “I’d like to see it as an action item, I’d like to see it drafted with the help of our city attorney so we can have an actual legal, enforceable thing.”

Niles mayor lays out transit-oriented style vision State of the Village address unites various previously discussed projects into one complete vision

During his state of the village address, Niles Mayor Andrew Przybylo laid out a vision for a more transitoriented, denser Niles that would do more to draw in young families and visitors.

As it is usually the case, the mayor made his address during the Niles Chamber of Commerce and Industry’s annual Leadership and Recognition Luncheon on Feb. 1.

While most aspects of his vision were things he discussed before, and many aspects of that vision are in various stages of completion, this marked the first time he put them all together in a single vision.

And Przybylo said that the village is making a renewed push to open a Niles Metra station – something that hasn’t been discussed since 2014.

In recent years, the NCCI lun-

cheon was when the chamber officially appoints new Board of Directors officials and, in some cases, new board members. Przybylo has used his speech to talk about the progress Niles government made over the past year and outline his priorities for next year.

This year, he began by outlining several major projects coming down the pipeline: Morton GroveNiles water supply switch; the beginning of Tier 2 flood mitigation projects; and the launch of Pace suburban bus system’s first Arterial Rapid Transit Line. The Tier 2 projects would kick off with a joint project between the village and the Niles Park District to build a water detention pond, a pavilion and a recreational area in Golf Park, south of Golf Mill Shopping Center. And the Pulse Milwaukee will create a bus service along the Chicago and Niles portions of Milwaukee Avenue between Jefferson Park Transit Center and Niles. Unlike regular

Route 270 Pace buses that currently serve this corridor, they will make fewer stops, the stops would have a more station-style design and the buses will get traffic signal priority under certain conditions.

Other, smaller project that Przybylo mentioned included new street lights near intersection of Oak Street and Waukegan Road, as well some street resurfacing. And he mentioned that the village is installing a new sign that would identify the local neighborhoods.

But the bulk of his speech was spent on the village development strategy. Przybylo echoed the argument he made several times over the past two years. The sales tax revenue doesn’t generate enough money to pay for village programs and social services, and because property tax increases would hurt residents, Niles needs to find some other way to make up for the lost funds.

“Unfortunately, sales tax revenue will be decreasing 2.5 percent [compared to] last year’s,” he said.

On the short term, the next fiscal year’s budget will be looking into ways to decrease labor costs with-

out hurting the quality of village services and programs. But on the long term, Przybylo said, the village needs to acknowledge economics realities – the big box stores will continue to struggle, so the village can no longer rely on them to provide the bulk of sales tax revenue.

The future, he argued, is in smaller “mom-and-pop” boutique stores located near public transit, as well as businesses that deal with “daily necessities.”

The village would also pursue several strategies to attract more visitors and new residents.

During an August 2014 NCCI breakfast, Przybylo first unveiled what he them described as a “vision” for the triangle-like section of southern Niles formed by Touhy Avenue on the south, Gross Point Road on the northwest and Lehigh Avenue on the east. The Leaning Tower of Niles would serve as the heart of a new arts and entertainment district. Since then, the village created the Gross Point-Touhy Tax Increment Financing District to help fund redevelopment in what was dubbed the Touhy Triangle, and its zoning was changed from

purely industrial to more flexible zoning that would allow the kind of uses the vision sought.

In his Feb. 1 speech, Przybylo described it as a Ravinia-like environment. He also said that the Triangle would include “artist live-work environments,” restaurants and multifamily housing. He also mentioned that the village is working on getting a national landmark status for the Leaning Tower of Niles – something that, as previously reported by the Bugle, could help obtain grants to cover renovation costs.

One issue that remains uncertain is the fate of the current Leaning Tower YMCA building. The original vision called for a new building closer to the Triangle’s northeast corner, but even then, village officials noted that it was something Niles had no control over.

During the Q&A following the speech, Niles Economic Development Coordinator Ross Klicker said he expected that, one way or another, the current building will be replaced “It’s no secret that there has been SEE MAYOR PAGE 8

1,000 years ago, Illinois had largest city in what would be U.S.

BY SUSAN SARKAUSKAS AND DIANE DUNGEY OF THE DAILY HERALD Centuries ago Illinois was home to the largest and most influential city in what would become the United States, rivaling the size of European cities at the time.

As many as 20,000 people — double that if surrounding communities are included — lived about 1,0000 years ago in the elaborate planned city that now lies within the Cahokia Mounds State Historic Site. Cahokia, east of St. Louis, includes woodhenges — large sun calendars that were built of red cedar posts — and at least 120 mounds and pyramids used to support important buildings and for burials.

Yet, Cahokia is only part of Illinois’ rich American Indian heritage.

Although 101,451 Illinoisans identify themselves as being fully or partly of American Indian descent, the tribes themselves are gone from Illinois, mostly moved west by the federal government in the 1800s, said Bill Iseminger, assistant manager of the Cahokia Mounds State Historic Site. What’s left are the remains of native cemeteries, villages, cities and mounds, onetime Indian routes that became the basis for many of our modern roads and highways and the names of many things, beginning with our state itself, named for a powerful American Indian group that once called Illinois home.

1,000 YEARS AGO, A CULTURAL CENTER Many different groups occupied Illinois in the centuries before Christopher Columbus set foot on North America.

Archaeologists estimate people came here about 12,000 years ago after migration from Asia over a land bridge began to populate the continent, according to the Illinois State Museum. Over thousands of years, people adapted to a changing climate and became less nomadic as the Ice Age came to a close.

Cahokia was built during the Mississippian Age, which began around 900 A.D. and lasted about 550 years. The city was the political and religious center of Mississippian life, but eventually its influence faded. It was largely abandoned by 1350 A.D., though no one knows precisely why.

Wood, game and other food sources might have been depleted, Iseminger said. There is evidence of long droughts and the climate was cooling.

Where did they go? Probably in many directions, joining other communities or establishing new ones, Iseminger said. The Osage, Ponca, Omaha and Quapaw people are believed to be descended from the city’s builders.

About 700 years ago, as Cahokia was fading, a people called the Oneota emerged in the Illinois River valley. Excavations in Fulton County show half of those buried in an Oneota cemetery died as a result of violence, though it’s not known why, according to the Illinois State Museum.

Were the two cultures at war? It’s hard to say, though there’s evidence of Oneota culture in the Cahokia area. And Cahokia had a large palisade enclosure, indicating a need for defense, Iseminger said.

“The Oneota, as they migrated south, may have been the final blow of the Mississippian culture,” he said.

STARVED ROCK TO BLACK HAWK By the time French traders and priests arrived in the 1600s, there were two main American Indian groups in the area: the Illiniwek, or Illinois, and the Miami. In the late 1700s and early 1800s, the Illiniwek territory shrank, the Miamis moved eastward, and other tribes moved in.

As Europeans and other outsiders arrived, the Indians traded with them. They allied with the French and the British, at different times. American Indian federations and tribes fought each other, with the Iroquois being notorious for battles against the Illiniwek.

Starved Rock State Park near Utica is named for a stone formation where, legend has it, members of the Illiniwek starved to death in 1769 during a siege by the Ottawa and Potawatomi, who sought to avenge the killing of the Ottawa chief, Pontiac.

By 1818, a War Department study estimated there were at least 10,860 native people living in this area, not counting the Peoria band of Miami Indians. Tribes had already ceded a strip of land at the mouth of the Chicago River to the U.S. government, as well as land near Kaskaskia.

In 1821, the tribes gave up more of northern Illinois.

In 1832, some members of the Sac and Fox nations agreed with a chief named Black Hawk that their land had been illegally taken from them. They tried moving back into northwestern Illinois and western Wisconsin, leading to the unsuccessful Black Hawk War. The 1833 Treaty of Chicago took care of the largest swath.

In exchange for handing over 5 million acres, tribes including the Potawatomi, Ojibwe, Odawa, Sac and Fox agreed to move west of the Mississippi River, according to an 1918 article about the treaty in the Wisconsin Magazine of History.

Many would eventually be pushed farther, which is why the Peoria Tribe of Miami Indians is now headquartered in Oklahoma.

TRIBAL HERITAGE When the French and other Europeans arrived, they learned the tribes’ languages and began naming places and landmarks using the natives’ words. French or English versions of the names stuck.

The settlers also might have been influenced by the Romantic movement of the late 1700s and early 1800s, which placed a high value on nature and folk legends, so the names might have been meant to memorialize the dwindling numbers of natives and their cultures.

Poet Walt Whitman extolled the practice, in “An American Primer:” “All aboriginal names sound good. I was asking for something savage and luxuriant, and behold, here are the aboriginal names. I see how they are being preserved.

They are honest words, — they give the true length, breadth, depth. They all fit. Mississippi! — the word winds with chutes — it rolls a stream three thousand miles long. Ohio, Connecticut, Ottawa, Monongahela, all fit.”

There are six counties in Illinois that have Indian-themed names, at least 60 towns, and scores of schools and other places, from Aptakisic Road in Lake County to the town of Wetaug in Union County.

Many other roads now have more prosaic names but trace the paths American Indians once used, from the eastwest U.S. Route 6, which generally follows the onetime Sauk Trail, to the North Shore’s Green Bay Road, thought to have been a Potawatomi trail.

Prior to his sophomore year in school, Dusan Mahorcic had a big decision to make – remain in Belgade, Serbia and play basketball or head to the states to continue to grow his game.

Mahorcic chose the latter, ending up playing for Notre Dame College Prep.

“I had offers to play here and I had an offer to play with Real Madrid, the biggest Serbian Club. I came here because my dad was here and I was looking around at schools and Ammar Becar was a senior then,” Mahorcic said of coming to Notre Dame. “I knew some guys and they knew my language, because when I came here, I only knew a couple words (of English). They helped me with my game, how to handle myself on the court.”

to learn basketball-wise was how to transform his 6-foot, 9-inch frame from a perimeter player to one that lived in the post.

“Anton Diamagia was a big impact with big man stuff. I can only say the best about that guy.

He helped me develop myself as a big guy. When I was over there, I was playing the three and four,” Mahorcic said. “It was hard the first year, I’ll be honest, because all the coaches were asking me to do was go inside.

But, during the summer, I was working hard. I was working like four times a day and I was calling my teammates for extra work.”

Basketball isn’t the only thing Mahorcic has had to work on while at Notre Dame.

“I am working on my academics because when I came here it was hard, I didn’t speak the language,” he said. “The first SEE MAHORCIC PAGE 6

But, now I am learning more and I am more comfortable on and off the court – just talking to people is easier and I am getting better every day.”

While he wants to better his academics and develop his personal game, Mahorcic says winning with the Dons is his top priority.

“The most important thing for me is for my team to win. My goal is to get myself ready for college and get my team ready for the state tournament,” he said. “I think we will surprise people when we get to the state tournament. We have got so much better all year and especially since the summer.”

That is something first-year Notre Dame coach Kevin Clancy likes out of his senior center.

“He has had to deal all year with defenses that try to plan around him. It is frustrating, but he handles himself well and is happy to get the wins,” Clancy said. “When we hit our shots more consistently, teams have to worry about everyone and that opens the floor for him.

“All the credit goes to him because he put the work in over the last year or two. In the summers he is getting in the weight room and working on his game and now he is reaping the rewards of his hard work and the future is even brighter.”

Mahorcic said his goals this season are for the team to win, but he also knows that he can help that by bettering his game.

“I am looking (to be versatile) when I go to college because I think they will have a hard time guarding me because I can shoot a little and go out on the perimeter. I just need to keep working hard,” he said. “If

I don’t do the extra work tomorrow, I won’t be on the same level the next game.”

This season, Mahorcic is averaging 16 points, 10 rebounds and 1.8 blocks per game.

Earlier in the season, he posted a 34-point, 22-rebound, 10-block triple-double performance over Carmel.

The ride at Notre Dame has been a lot of hard work for Mahorcic, who over his first three seasons played under coaching legend Tom Les. “There was no messing around with him. When I first came here, he was hard on me and I don’t regret that. He developed me mentally more than anything,” Mahorcic said.

“I don’t regret any second of it and I am very appreciative of all the people at Notre Dame, the teachers, the staff and especially the basketball staff. They have helped me not only be a better basketball player, but a man.”

‘No cash’ businesses losing Believe it or not, there are still tons of people out there who make purchases only with cash DEAR DAVE, What is your opinion of businesses that no longer accept cash?

HEATH DEAR HEATH, Honestly, I think the whole scenario is kind of silly. Busi-

nesses that are suddenly into the “no cash” thing lose out on a lot of transactions. Believe it or not, there are still tons of people out there who make purchases only with cash. So, from a business owner’s perspective this

philosophy can cut into your market share.

I really don’t spend a lot of time thinking or worrying about the situation, though. When it comes right down to it, most businesses are doing that kind of thing for one or two reasons.

Some of them just think cash is old school, and they want to give the impression they’re cutting edge and into technology.

Others do it — depending upon the space they’re in — because their sales using plastic are higher than with cash.

I’m a cash guy. There are some situations where I might walk away if someone wouldn’t accept hard, cold cash, but in most cases I don’t think anything about it. I’ll just use my debit card, and buy what I need.

a large amount of deferred maintenance,” he said. “The long-term [vision] of the village is we’d like them to be partner in new facility.”

Przybylo added that, whatever happens, he doesn’t expect the residential component to be preserved. “It will not have rooms – it’s not the mission of the YMCA any longer,” he said.

“That much we know.”

Another major component of the redevelopment process was to use Pulse Milwaukee line as a catalyst for transit-oriented development. Przybylo and Klicker explained that the village was taking a cue from transit-oriented development along the section of the Blue ‘L’ line that runs through Chicago’s Bucktown and Logan Square neighborhoods. In fact, the mayor referred to Pulse Milwaukee as “Surface Blue Express.”

As Klicker explained, denser mixed-use developments like these have shown to attract businesses that specialize in daily necessities. And Przybylo noted that these developments would bring in more property tax revenue.

The village already made some steps in that direction.

The most recent zoning code revamp established new zon-

ing for much of the Niles portion of Milwaukee Avenue, zoning that encouraged larger mixed-use developments.

However, it should be noted that the major catalyst behind the development along the Blue ‘L’ Line and other Chicago transit corridors was the 2013 Transit-Orientated Development ordinance, which, in addition to allowing higher buildings near transit, reduced the parking retirements.

The two officials also talked about two other recently unveiled initiatives: the recently created Niles Home Improvement District and a program to encourage new residents to buy and rehabilitate their homes. Klicker said that the village wanted to encourage larger homes that would have a similar footprint and wouldn’t stand out too much amidst other homes on the block.

Przybylo ended his speech by saying that, in the end, he will strive to do all of that while addressing the ongoing issues the village faces.

“In conclusion, the fiveyear plan is – control [spending] and expand the revenue stream from sales taxes and property taxes, protect and enhance Niles and rebuild infrastructure and pay down pension costs the best we can.”

FEBRUARY 13 Front Yard Design. 7 p.m. at the Chicago Botanical

Garden, 1000 Lake Cook Road, Glencoe. Learn the basics of front yard landscape design. A lecture and slides will demonstrate how proper planting design can change the way you use and view your property. Your front yard design should respond to your home’s architecture as well as be aesthetically pleasing. Topics will include proper plant types and spacing, focusing and screening views, and creating curb appeal.

NITTI Leonard J. Nitti, 94; beloved husband of Joan (Donnelly).

Beloved son of the late Michael J. and Catherine (Picerno) Nitti.

Loving father of Kathy Georgen, Mary Nitti, Michael (Sharon) Nitti, Patty (Corey) Fishman, and Laura (Scott) Lemajeur; grandfather of Beth (John) Geib, Michael (Annie) Nitti, Tom (fiancé Ali) Nitti, Amy Fishman, Kimberly (Joshua) Fouke, Kelly (Michael) Westwood, Emily Fishman, Ryan Fishman, John and Katie Lemajeur; great-grandfather of Wesley, Lyla and Sam; fond uncle of many nieces and nephews.

During WWII Leonard (Ned) enlisted in the Army Air Corps and became a radio gunner.

He flew 30 missions over Germany in a B17 Flying Fortress with the 8th Air Force’s 92nd Bombardment Group, 326th Bomber Squadron. On a routine

mission flying from one base to another in England, his plane met with severe weather and crashed on the grounds of Highclere Castle. Ned was the only survivor.

Ned was a mechanical engineer for Teletype Corporation for 35 years. He was a very creative and artistic man who loved to work with his hands; re-modeling his home, helping his kids with art projects, creating landscapes for model trains and slot cars, adding his personal touch to the family Christmas village just to name a few.

Visitation was January 24 at Skaja Terrace Funeral Home 7812 N. Milwaukee Avenue, Niles. Funeral Mass was January 25 at St. John Brebeuf Church.
