Board to decide fate of 2 referenda Niles resident and business owner Jack Drexler filed objections to both

The Niles Municipal Officers Electoral Board will reconvene on Jan. 26, at 2 p.m. to decide whether to keep two referenda launched by local activist Joe Makula on the ballot.

Makula launched a referendum that would require voter approval for the creation of new “tax districts” and expansion of existing ones. He also filed a referendum to reserve two out of the three slots for referenda questions for referenda launched by members of the public. Under the current law, a member of the public or the village board can file a referendum, and only three referenda may go on the ballot.

Niles resident and business owner Jack Drexler filed objections to both referenda. His attorney, James Nally, argued before the board that the referenda were too confusing and, in case of the latter, would violate state law. He also objected to both referendum petitions, saying that not only were there issues with many signatures, but none of the petition sheets were properly notarized. If the board upholds these objections, that would effectively throw out the referenda.

The taxing district referendum would apply to all “tax districts.”

While the term isn’t defined in the referendum question, Makula told the Bugle that he meant for it to include Tax Increment Financing districts, property tax based Cook County incentives and other designations that would affect property taxes. He argued that, because any changes in property tax levy would affect voters, they should have the final say over whether they get approved.

According to the copy of the referendum petitions provided to the Bugle, it got total of 804 voter signatures – more than the 637 signatures required by law; 706 of them were collected by Makula himself, nine were collected by his wife, Mary Makula, 10 were collected by former Niles trustee Rosemary Palicki and 79 were collected by Niles resident Robert Cieszykowski.

The referendum drew opposition from the Niles Chamber of Commerce and Industry, as well as current village trustees Dean Strzeleckiand and Denise McCreery, who previously served as the chamber’s board president and director, respectively. They argued that it would hurt Niles economically, since it would limit the board’s ability to offer incentives, and the delay between the busi-

ness’ application for tax incentives and the vote would drive them to municipalities that would have a quicker process.

The second referendum would reserve at least two out of three referenda slots on the ballot for referenda submitted by members of the public. Under the state law, both the voters and the municipal legislative bodies can put referenda on the ballot, which gets filled on firstcome, first-serve basis.

During the March 2016 primary election, the Village of Niles Board of Trustees submitted referenda for all three slots. Two were advisory and nature, and the third, binding referenda would have undone Makula’s November 2014 referendum, which took away village mayors’ power to fill trustee vacancies.

That referendum got 759 signatures, 660 of which were collected

by Makula, 10 by his wife, 10 by Palicki and the remaining 79 by Cieszykowski.

leged that none of the petition sheets had the “circulator’s signature” field black. And, indeed, most petitions had the circulator’s signature in the “Name of Circulator” field. There were some sheets where the circulator’s name was printed, and the signature was placed right above it, directly to the right of the “circulator’s signature” field. And the two referenda had a total of three sheets where other fields were left blank.

The objections also alleged that, even if the notarization wasn’t an issue, there were enough invalid signatures to put the petitions below the legal minimum. They allege that a total of 215 signatures were invalid on the tax district referendum, while the ballot petition had 178 signatures were invalid on the referenda spots referendum. That would mean that total of eligible signatures would drop to 589 and 582, respectively, less than the legal minimum.

The Niles Electoral Board convened on Jan. 16 to hear the objections. Normally, the board would be made up of the mayor, the village clerk and the longest-serving trustees. But during this meeting, trustee Joe LoVerde was absent, while village clerk Marlene Victorine recused herself because Makula is currently suing her after she rejected his objections to Mayor Andrew Przybylo nomination for the upcoming mayoral elections, on the ground that he didn’t file the

legally required number of copies.

As the board prepared to hear the petitions, Makula’s attorney Brian Wojcicki filed motions for the rest of the board to recuse themselves, arguing that, as a mayor and the trustee, Przybylo and Alpogianis have an interest in outcome of both referenda. Nally countered that this argument was too vague and speculative, and that there were no legal conflicts.

Keri-Lyn Krafthefer, the Electoral Board attorney, said that, under state law, board members had to recuse themselves if the issue before the board dealt with a position they were running for, if it directly impacted their existing positions or if they were involved in litigation with the one of parties in the issue, if they would need to testify before the board. She advised the board to rule against the objection, and they unanimously voted to agree.

As always in cases where petition eligibility is an issue, the board moved to do a record check, the Cook County Clerk’s office would check them against its voter records, and determine which contested signatures should be stuck.

Once the record check is complete, the board would reconvene the review the findings and rule on this and other objections.

To give enough time for the record check, the next meeting was scheduled for Jan. 26, at 2 p.m.

Village of Niles mayor Andrew Przybylo gave his annual State of the Village address during the Niles Chamber of Commerce and Industry’s Jan. 19 luncheon.

The address comes three months before the April 2017 municipal election, where he will be facing off against freelance photographer Steven Yasell.

The mayor said that the village was on solid economic footing, and that various property tax related incentives haven’t hurt residents’ property taxes. His priorities would include continuing stormwater mitigation projects, creating a credit program for home remodeling and finalizing the new water supply agreement.

Przybylo began by touting the results of one of the two advisory referenda the Village of Niles Board of Trustees put on the March 2016 primary ballot – a referendum asking whether the village should continue to fund the Niles Teen Center, Niles Department of Family Services, Niles Senior Center and the Niles Fitness Center.

The village board’s ability to put advisory refernda on the ballot recently became contentious, as Niles activist Joe Makula launched a referendum that would limit it to just one out of three possible reverenda slots, leaving the rest for citizen-launched referda. During the

aforementioned March 2016 primary election, the board used up all three slots, only one of which – a referendum that would undo the results of Makula’s trustee vacancy referendum – was binding.

In his address, Przybylo argued that he had a good reason to put the social services referendum on the ballot. “ I was unclear whether taxpayers were ever consulted or given the opportunity to weigh in on these services and the costs to provide them,” he said. “Being a proponent of transparent government and the SEE GROWTH PAGE 5

Hospitals penalized for harming patients Government has penalized hospitals in an effort to prevent avoidable patient deaths in hospitals Anyone facing a hospital stay for themselves or a family member should look at new data the government released right before Christmas showing that it http://khn.org/news/769-hospitals-penalized-for-patient-safety-in2017-data-table/ penalized 769 of the nation’s hospitals for having high rates of patient injuries. The monetary penalties – a reduction for the year in their reimbursement for treating Medicare patients – do bite. Larger teaching hospitals could lose as much as $1 million or more.

This is the third year the government has penalized hospitals in an effort to prevent avoidable patient deaths in hospitals, which emerged as a big issue about 18 years ago. This year the government added injuries caused by MRSA and C diff infections to their list of other harmful conditions patients contract in a hospital such as urinary tract and surgical site infections resulting from hysterectomies and colon procedures. MRSA – a staphylococcus bacterium - can cause pneumonia and bloodstream infections. C diff is a germ that can multiply in the gut when patients are taking other antibiotics to kill other germs.

While some facilities like those serving children and psychiatric patients and critical care hospitals are exempt from penalties, this year’s data show that more than 200 facilities, including some of the nation’s most well-known hospitals, have the dubious distinction of being on the government’s penalty list for all three years. They include the Cleveland Clinic, Ronald Reagan UCLA Medical Center in Los Angeles, Northwestern Memorial Hospital in Chicago and Boston’s Brigham and Women’s

Hospital. The message for patients: A hospital’s TV advertising campaign for its great cancer care may obscure significant safety issues.

Have penalties and other harm reduction initiatives made hospital care safer?

This time 347 hospitals penalized last year are not on the bad-guy list, which shows that some are paying attention.

But hospital injuries have not vanished.

The federal Agency for Healthcare Research and Quality says there were 3.8 million hospital injuries last year. That translates to 115 injuries per 1,000 patient stays.

Antibiotic-resistant bacteria infect some two million people annually. One quarter of a million cases occur in hospitals.

I wanted to know why more progress hasn’t been made. While the new government data reflect improvements at many hospitals, why is there still such a long way to go? I rang up Lisa McGiffert, the head of Consumers Union’s Safe Patient Project who has been a leading voice since 2004 to bring attention to infections and medical errors. She told me there’s been a significant shift in the way hospitals view infections. Twelve years ago they used to say they were not preventable. “Now, most people in healthcare believe most infections are.”

In the early days of her campaign, government agencies like the Centers for Disease Control and Prevention were reluctant to back public reporting of hospital mistakes and other data to help patients. Now they support it. Still,

she says, “what I am most frustrated about is the lack of urgency in the country and at the agencies for eliminating these infections. They are aware of them, but there’s not a sense of urgency to stop them.”

The financial penalties levied by the Medicare agency have made a significant difference because they get the hospital CEO’s attention. Unless the CEO is involved, change is not going to happen.

But the penalties along with the entire program to eliminate hospital-acquired conditions were authorized under the Affordable Care Act. They could be in jeopardy if the law is repealed. Some hospitals probably would be happy if they disappeared.

Patients need to make use of the data that is available and study it to inform their decisions about where to go for care when they have a choice. McGiffert advises looking at how your hospital compares to similar facilities. Look for improvement. If a hospital was penalized the first or second year of the program but not this year, that indicates it could be serious about safety. Also look to see if a facility’s scores are moving in the right direction. If the numbers show they are not performing as well on some dimension as they previously were, patients need to ask why.

Some states and some hospitals are using other strategies. Illinois and California, for example, have passed legislation that requires hospitals to screen for MRSA when patients are admitted.

Some hospitals have stewardship programs to address the overuse of antibiotics, which contributes to drug resistance.

To start learning about your hospital, consult the government’s Hospital Compare website https://www.medicare.gov/hospitalcompare/search. html. Follow the prompts to find the hospital you are looking for and then search the tabs for “complications.” This will let you look at actual numbers to help you see how your hospital is doing.

Battery Emmanuel Leon Mays, 18, of the 7500 block of Waukegan Road, was charged with aggravated battery, resisting a police officer, obstruction and violating an order of protection on Dec. 24 after police were called to his apartment. According to police, a 17-year-old girl, described as Mays’ girlfriend, was present in the apartment even through there was an active order of protection prohibiting Mays from having contact with her. Police said Mays attempted to barricade the door to his bedroom and became combative with officers, kicking one of them.

The 17-year-old girl, a resident of Morton Grove, was also charged with resisting a police officer, police said.

Pryzylo added that he was “very proud” that 88 percent of the voters cast their ballots in favor of it.

Turning to the Niles economy, he said that he had many reasons to be happy with the state of the village.

“Revenues are both stable and to some extent increasing,” Przybylo said. “Sales tax revenue is .036 percent higher than the prior year. All sales tax funds in fiscal year ending April 30, 2016 were $26,952,901.

Niles ranks in the top 15 sales tax revenue producers in the State of Illinois.”

He touched on the most recent village tax increase, saying that it was necessary to shore up municipal pension funds for police officers and firefighters. He added that revenue from video gambling machines will help over the pension liability as well. The village board repealed the ban on the machines in May 24, 2016.

“Video Gaming revenue for fiscal year 2018 is expected to be $141,800 for our pension funds,” Przybylo said.

Drug Possession A 19-year-old man from Park Ridge was ticketed for possession of marijuana and drug paraphernalia and a 19-yearold woman from Park Ridge was ticketed for possession of marijuana Dec. 23 after police began investigating a suspicious car parked in the 8200 block of Washington Street. A total of five people were found inside the car, police said.

DUI Tatiana Olaru, 26, of the 3400 block of Hollywood, Chicago, was charged with driving under the influence on Dec. 23 after police said her car was involved in a crash at Oakton Street and Prospect Avenue. Olaru is

scheduled to appear in court Feb. 8.

Carlos Delgadillo, 27, of the 4900 block of West George Street, Chicago, was charged with driving under the influence on Dec. 24 following a traffic stop at Milwaukee Avenue and Dempster Street, police said. Delgadillo was scheduled to appear in court Jan. 13.

Mary Timones, 37, of the 9000 block of Capitol Drive, unincorporated Maine Township, was charged with driving under the influence on Dec. 28 following a traffic stop at Ballard Road and Joey Drive, police said. Timones is scheduled to appear in court Feb. 6.

Property Damage A 40-year-old Chicago man told police he discovered scratches on his car after having an altercation with another driver on Dec. 24 in a parking lot in the 9500 block of Milwaukee Avenue.

Joseph Brewster, 24, of the 300 block of South Crescent Avenue, Park Ridge, was charged with criminal damage to property on Dec. 26 after he was accused of slashing a tire on a car belonging

to a share ride driver. According to police, the driver reported that his tire was slashed after he dropped Brewster and four other occupants off at a gas station in the 8100 block of Oakton Street because they were becoming belligerent over the ride fare. A woman who was interviewed by police reportedly told officers that it was Brewster who cut the car’s tire because he was upset. Brewster was scheduled to appear in court Jan. 13.

sharing agreements, where the village temporarily allowed certain retailers to keep a portion of their tax revenue in order to encourage development, has been good for Niles. Niles currently has three – one for the Costco gas station pumps, one for the Fresh Farms grocery store chain’s Golf Road location and one for the Golf Mill Ford dealership. He also said that Niles’ two Tax Increment Financing districts – the Milwaukee/Touhy TIF and the Gross Point Touhy TIF – were “operating successfully,” as did all of the companies that received Cook County property tax incentives.

“Pointedly, the gap between residential and commercial property tax paid is less today than in 2011,” Przybylo said. “I stress this point to all those who claim that economic incentives raise property taxes on residents – that’s not true at all.”

This was a reference to another referendum that Makula is trying to put on April 2017 ballot – a referendum that would require voters to approve any new “taxing districts,” as well as any expansion of the existing ones. Supporters of the referedum argued that, because tax intentives affect residents’ property taxes, they should have the ultimate say over whether the incentives are approved.

The mayor also touted the progress the village made on addressing flooding issues, reporting on the status of the last of the Tier 1 projects – the Cleveland Avenue relief sewer, which is designed to relieve flooding in eastern Niles.

“The Cleveland Avenue storm sewer is 95 percent complete,” Przybylo said, adding that the Tier 1 projects that have already been completed were working smoothly.

He said that, this year, he’s looking forward to starting Tier 2 flood relief projects.

“We are moving onto Tier 2 Stormwater Control, designing water retention at what we hope will be the new park at Golf Mill,” Przybylo said.

Encouraging community pride and doing more community events has long been a priority for the mayor. This year, Niles will see the Holiday Inn Express Niles Cycling Classic with Community Block Party – a professional bike race through the village’s Oak Park area.

The name, Przybylo explained, reflects sponsorship by Lakhani Hospitality, which is expected to open the new Holiday Inn Express at the former Travelers Inn site later this year.

The mayor also took the opportunity to promote Farm on Franks community garden, touting it as a

way for residents who live in multiunit buildings to grow their own vegetables.

Turning to new economic development, Przybylo said that the Niles Commission for Economic Development and Neighborhood Renewal will be working on three major initiatives this year.

“Their new charge is threefold - market Niles through marketing our schools, to create a Home Design District along south Milwaukee Avenue, and finally to work with local lenders, creating a program to extend credit for home remodeling and expansion,” he said.

Przybylo said that the village officially assumes ownership of the Leaning Tower of Niles on the fourth week of January.

“Niles will take ownership of the Leaning Tower and the land which it graces,” he said. “Taking title will allow us to first, have the Tower placed on the National Historic Registry and, secondly, to create a not for profit foundation that will raise funds through donations with the ultimate goal of acquiring land for which we can build a community center with entertainment parkland.”

Two large, flat-screen TVs were reported stolen Dec. 23 from a store in the 5600 block of Touhy Avenue.

Tires and rims were reported stolen from a car belonging to a car dealership in the 5700 block of Touhy Avenue on Dec. 24. The driver’s side window of a second car was broken and the hood was raised, though nothing was missing, police said.

A new smartphone was reported stolen Dec. 26 from behind the cash register of a store in the 5700 block of Touhy Avenue, police said.

A leather bag containing phones, credit cards, identification and a passport was reported stolen Dec. 26 from a sports facility in the 6400 block of Howard Street.

be replaced by a park with a dining area. The plan also suggested an alternative site for the YMCA – an area south of where Gross Point Road and Lehigh Avenue intersect.

At the time, Niles Economic Development Coordinator Ross Klicker indicated that he wasn’t aware of YMCA’s plans to move, and that this was simply the village preparing for the possibility that it will.

Finally, Przybylo said that he hoped that the alternative water supply agreement will be finalized this year. While the village has long been getting its water from the City of Chicago, in the last few years, it has been working with several nearby municipalities to find an alternative, cheaper source of water.

Most recently, Niles and Morton Grove agreed to work together to get water from Evanston.

“I’m pleased to announce that in the next quarter Niles with its partner of Morton Grove will hopefully sign agreements to purchase water from the City of Evanston,” Przyblon said. “This massive project, costing approximately $100 million , will provide savings from the very day that the spigot is turned on.

With those savings we will better be able to rebuild our water distribution system.”

Hamwi drops 23 points as Hawks stop Niles West in CSL South league contest

With key players such as 6-6 junior forward Tommy Gardiner (ACL injury) and senior guard Nick Foldvary (torn labrum) not in the lineup for Maine South, sophomores such as guards Essam Hamwi and Fillip Bulatovic, and forward Dan Crane, are seeing more action.

Hamwi, in particular, has stepped it up.

Since breaking into the starting lineup during the Hinsdale Central Holiday Classic, Hamwi has become one of the Hawks’ most reliable scorers.

He’s averaged 11.2 points per game over the past 10 games for the Hawks, including a careerhigh 23 points — a total he rang up last Friday night in their 5441 CSL South victory at home over Niles West.

Hamwi netted 20 in the first half alone — including a threepointer towards the end of the

half that put the Hawks (12-9, 3-2) ahead, 22-16.

“I’ve just been attacking from the wing a lot and he (Maine South coach Tony Lavorato Jr.) said keep on attacking in transition and that’s where I’m getting most of my points from,” said Hamwi, who shot a scorching 75 percent from the field (9 of 12) for the evening. “I think offensively I’ve been stepping up in the past few games, especially since the (holiday) tournament.

I just need to keep working on my defense.”

Maine South’s signature matchup zone defense was effective against Niles West, which went 8 of 23 from the floor during the second half.

Dons headed to state Notre Dame placed sixth at the Glenbard East Bowling Sectional and advanced to the state tournament as a team with a score of 5,695.

The Dons were paced by junior Connell Kelleher with a total pinfall of 1,233.

Senior Max Sloan added an 1.161, while senior Robert Van Houghton rolled a 1,013.

Senior Brandon Garcia (722), junior Martin Munoz (701) and junior Liam Miller (700) also contributed to the Dons’ success.

The state berth is Notre Dame’s sixth appearence in seven years at the state meet.

OAKTON Oakton Community College freshman guard Pat Hamilton (Northbrook, Glenbrook North High School) was named men’s basketball District 4 player of the week according to the latest Region IV National Junior College Athletic Association report.

Oakton, which competes in Division II, went 2-0 last week over Illinois Skyway Collegiate Conference rivals.

On Tuesday, Jan. 10, Oakton posted a 94-58 home win over McHenry County College and the Owls notched a thrilling 10296 overtime road victory against Elgin Community College on Thursday, Jan. 12.

Hamilton was the scoring leader, averaging 27.5 points for the week. He dialed it up from long distance connecting on 14 3-pointers in the two contests.

We did a lot of driving (during the game), but it wasn’t intelligent driving because you can beat a guy and you’ve got those big guys (inside for Maine South) waiting for you. If you do beat that one guy, you have to make that next pass and we didn’t do that sometimes.”

The Hawks led 29-21 at the break and 42-29 after three quarters. Although Niles West crept back into the game for a stretch during the second quarter — trimming Maine South’s lead to 17-13 following a 5-0 run — they never really recovered after Hamwi capped a 10-0 run in the first quarter with an inside bucket to put the Hawks ahead, 17-8.

“He (Hamwi) hasn’t grown into his body yet, and that allows him to fatigue quickly and teams are going to know that and be really physical with him,” Lavorato said. “But I just love what he’s doing and how he’s developing his game.

“You’ve got the young guys who are starting to get real experience,” Lavorato said. “Every game is different and that’s the thing with youth. It’s really, really good or sometimes it’s inconsistent. But we’re seeing more and more consistency and we’re really excited about that.”

Niles West was led in scoring by 6-4 senior forward Aaron Flowers, whose nine points included a dunk off a steal in the third quarter.

Senior forward Matt Metz contributed eight points with two treys.

“We didn’t do a good job on (number) 10 (Hamwi) and he took care of business,” Wil-

liams said. “It’s a bunch of little things. We’re certainly there to compete, but we just didn’t take care of little things and they did.

There were times we fell asleep just a little bit and they were ready to take advantage of it.

“We have good individuals; the problem really is, and the challenge for us, is to develop more consistency. I think that’s a strength of Maine South; they play their game for 32 minutes.

We play on a little bit and off a little bit. It’s frustrating.”

The Hawks went 3-2 during their annual trip to western Illinois for the Galesburg MLK Tournament.

Hamwi tallied 18 points in one of those contests — a 59-56 loss to Peoria on Jan. 14.

“We’re a big team chemistry type of program,” Lavorato said, “and our guys get away from home, they handle themselves very professionally and represent our school, our community and themselves.

“But then they come out on the back end of it and they have a great togetherness. We love it when it shows in their play.”

Being direct and upfront is not being mean DEAR DAVE, My friend and I are roommates, and we’ve always had an agreement that we split each of the bills 50-50. We both work and have decent jobs, but for the last couple of months she’s been really late in paying her half of the bills. She says she’s broke. I don’t want to be mean, but how can I approach her about this situation?

ALICE DEAR ALICE, I understand that you don’t want to be mean to a friend, but situations like this should be addressed quickly and directly. No mat-

ter whether you’re talking about friendships or business dealings, to be unclear is to be unkind.

Turn off the television, sit down with her, and have a kind but firm conversation. Let her know that the

roommate agreement is no longer working because she isn’t paying her bills on time. Make sure she understands that the two of you are not going to be able to stay there together anymore unless she starts paying on time. You might also ask if she needs help budgeting her money. I mean, if she’s got a good job her money has to be going somewhere, right? The problem is that it’s not going to the proper places.

I know you think that by being subtle or avoiding the situation you’re being nice, but you’re not.

You’re being passive-aggressive.

You just have to smile and say,

“This isn’t going to happen anymore. You’re going to get your act together, and I’ll help you all I can, but you need to start paying on time or the roommate situation is over.”

Is that tough love? No, it’s just love.

—DAVE DEAR DAVE, My wife and I owe $90,000 on our mortgage, and we have no other debt. We are able to save about $20,000 a year, so we could have the house paid off in just over four years. She likes the idea of having lots of money saved up, but I would love to be completely debt-

free. Should we pay off the house or hang on to the savings?

JASON DEAR JASON, Let’s pretend your house is already paid for in full. Would you borrow on your home so that you had enough cash that your wife liked it? You say you wouldn’t, so what’s the difference? If you had a paid-for house and you wouldn’t borrow on it to have cash laying around to feel better, why wouldn’t you use the cash laying around to pay off the house? It’s the same thing.

The first thing you want to consider is having an emergency fund of three to six months of expenses.

You also need to make sure you’re putting aside 15 percent of your income for retirement. Other than that, if you have enough cash laying around to pay off your home and you don’t, it’s the same thing as having borrowed on your home in order to have cash laying around.

If I’m in your shoes, as soon as the emergency fund is in place — six months of expenses since your wife likes the security factor — and 15 percent is being put away for retirement, I’d take the other money and throw it at the house. Get that thing paid off as fast as you can!

Volunteers are trained to assist in filing tax forms and certain schedules, including the Form 1040. Taxpayers with complex returns, or in instances where the counselor feels they do not have adequate training or knowledge, will be advised to seek paid tax assistance. Under the Volunteer Protection Act, AARP Foundation Tax-Aide volunteers must stay in the scope of the program and do those returns for which they have received training.
