Joliet wins evergreen terrace case

The city has won the right to condemn Evergreen Terrace, the troubled public housing project. The news emerged early Thursday afternoon when United States District Court Judge Charles R. Norgle released his 54-page ruling. “The court found that Joliet has two valid public purposes for which to take the property -- the elimination of blight and use as a public park. With three out of the four balancing factors weighing heavily in favor of Joliet, the court concludes that (the defendants) have failed to meet their burden,” Norgle wrote. “The court rules in favor of Joliet on all of its claims.” Joliet City Councilman Mike Turk seemed delighted by the news. “I’d like to congratulate the city staff, especially former Joliet City Manager Tom Thanas, Jeff Plyman, our city attorney, and current City Manger Jim Hock. They worked very hard on this case, and I think it is a victory for the city and its residents.” The next step in the case will be a jury trial where the price that the city will pay for the property will be determined.
