$3M bond for man accused of murdering mother in Downers Grove Kevin D. James, 23, is charged with one count of first degree murder Bond was set at $3 million for a Naperville man accused of murdering his mother in unincorporated Downers Grove, according to DuPage County State’s Attorney Robert B. Berlin. Kevin D. James, 23, is charged with one count of first degree murder in the stabbing death of Patricia James, 51, of unincorporated Downers Grove.

On January 9 at approximately 1:38 p.m., DuPage County Sheriff’s deputies responded to a 9-1-1 call from a woman, later identified as Kevin James’ sister, alleging that James had killed their mother, Patricia.

The call alleged that the murder took place in Patricia James’ home on the 2100 block of 63rd Street. Upon their arrival deputies found Kevin James in the doorway of the residence, covered in blood.

He was immediately taken into custody and transported to the DuPage County Jail in Wheaton.

Deputies found James’ mother on the floor of the front room covered in blood. Patricia James was transported to Good Samari-

tan Hospital by the Darien-Woodridge Fire Protection District where she was pronounced deceased. It is alleged that while in his mother’s home, James stabbed his mother multiple times with a kitchen knife.

“Patricia James was stabbed to death, allegedly by her own son, Kevin,” Berlin said. “To her surviving family and friends, I offer my sincere condolences on their loss. I would like to commend the DuPage County Sheriff’s Deputies who quickly responded to the scene of this tragedy and quickly apprehended the suspect before he could escape. Their quick actions perhaps kept an already tragic situation from becoming much worse. I would also like to thank Assistant State’s Attorneys Tim Diamond and Megan McGuire-Bachman for their tireless efforts these past few days.”

“I would like to commend the deputies who arrived on scene and captured the suspect before he could flee the area,” DuPage County Undersheriff Frank Bibbiano said. “I would like to thank DuPage County State’s Attorney Bob Berlin and his staff for their teamwork and assistance throughout this investigation.”

James’ next court appearance is January 26 in front of Judge Brennan for arraignment.

Tivoli seeks amended liquor license Management wants to sell liquor during regular movie screenings, not just special events

The Tivoli Theater is looking to amend its existing theater liquor license to make it more competitive with similar operations.

Currently, the theater has a Class “T” Theater liquor license enabling the venue to serve alcohol on a contractual basis with individual rentals of the facility, as well as during box office events and contracted theater rentals.

The Tivoli Theater is seeking an amendment, which would allow the sale of liquor during regularly scheduled movies, based on the condition that sales are limited to one drink per adult age 21 or

older.

Tivioli Theater manager Willis Johnson was on hand for the meeting to receive questions and comments from the Downers Grove Village Council.

Some council members questioned the premise for amending the theater liquor license and wanted reassurances that any violations of the law will continue to be subject to repercussions.

Johnson explained that the Tivoli aims to act in accordance with the law and later recalled that the facility has only incurred two violations of the liquor code over the years.

History shows the Tivoli Theater has held a Class “T” Theater liquor license since 2001.

The Downers Grove Liquor Commission came to a consensus recommending approval of the amendment.

Members of the Downers Grove Village Council get to have their say on the matter at their Jan. 16 meeting.

Ordinance regulating purchase and possession of alternative nicotine by minors Also at the meeting, Village Attorney Enza Petrarca presented information to the council outlining a proposed ordinance regulating the purchase and possession of alternative nicotine by minors.

This code mirrors the law adopted by the State of Illinois, and it stipulates that nicotine and alternative nicotine are to be treated the same by municipal officials.

The definition and restrictions, as presented, allow Downers Grove Police to issue citations in accordance with ordinance viola-

tions, as opposed to charging violators through state law.

Commissioners will consider adopting an ordinance regulating the purchase and possession of alternative nicotine at their Jan. 16 meeting.

St. Joseph’s School seeks variance for addition St. Joseph’s School is looking to expand its facility another 3,900 square feet by building an addition.

The measure, if approved at the council’s Jan. 16 meeting, will allow the building at 4832 Highland Avenue to match the existing setback line established along Franklin Street.

The new construction will

modernize the classroom spaces, enhance accessibility, add administrative space, and allow for the installation of a new fire suppression system.

Proposed changes to the building are not predicated on enrollment.

The petitioner’s plan is requesting a setback variance to permit a proposed 8.97-foot south setback instead of 25 feet.

Notice was provided to property owners within 250 feet or less from the property lines, informing them of the council’s intent to consider the request for a special use with a variance. Downers Grove staff has not received any neighborhood inquiries or comments regarding the project.

The Downers Grove Village Council is expected to consider granting a request for a special use with variance at its Jan. 16 meeting.

“For many visitors, seeing the labor required during the coldest time of the year to make sure foods remained chilled through the hottest is a real eye-opener,” said Forest Preserve District of DuPage County President Joe Cantore.

Registration is not needed for the free program, but visitors are encouraged to call the farm

in the morning at 630-876-5900 to ensure ice conditions will allow cutting that day. Regardless of whether ice is cut, staff and volunteers will be on hand to show some of the tools and equipment used and talk about ice cutting and the importance of ice on a farm in the 1890s.

In addition to “Ice Harvest,” Kline Creek Farm will offer smaller ice-cutting demonstrations Feb. 3, weather permitting, at the District’s free “Wonders of Winter” event from 10 a.m. to 1 p.m. at Mayslake Pea-

Enrique Hernandez was transported to Central DuPage Hospital where he was pronounced deceased with a gunshot wound to the head. An investigation led by the DuPage County Sheriff’s Office with assistance from the West

Chicago Police Department led authorities to James Hernandez. Through their investigation, authorities learned that Enrique and James were traveling together in a vehicle and that while in the vehicle, James shot Enrique in the head. After shooting Enrique in the head, James pushed his body out of the vehicle and drove away. Additionally, James stole Enrique’s cell

phone, wallet and money clip after shooting him.

“Just over two years ago, James Hernandez fatally shot his cousin Enrique Hernandez in the head,” Berlin said.

“Mr. Hernandez learned that his actions on the night of November 20, 2015 will cost him the next thirty-five years of his life. I would like to thank the DuPage County Sheriff’s Office for their

work which allowed us to bring a successful prosecution against Mr. Hernandez. I would also like to thank Assistant State’s Attorneys Mike fisher and Nick Catizone for their efforts in holding James Hernandez responsible for the murder of his cousin, Enrique.”

Hernandez will be required to serve 100 percent of his sentence before being eligible for parole.

Sears made modern retail

BY ERIC PETERSON OF THE DAILY HERALD As the home of Sears since the late 19th century, Illinois is the birthplace of modern retail.

Even today’s colossus, Amazon, can trace the roots of its business model to Sears’ original mail-order business that popularized the notion of buying products at home without first seeing and touching them in person.

“There were some small mailorder companies before, but Sears became the largest, the most successful, the giant,” said Libby Mahoney, senior curator of the Chicago History Museum.

And if it seems strange that such a retailer could grow strong enough to make its headquarters the tallest building in the world as Sears did in Chicago in 1973, consider today’s intense competition among cities to house Amazon’s second headquarters, she said.

It was Chicago’s central position in the nation’s railroad and highway networks that made it a better place for Richard Sears to operate the mail-order watch company he’d started in Minneapolis the previous year, 1886.

In Chicago, Sears partnered with watchmaker Alvah C. Roebuck, leading to the longtime name of the firm being Sears, Roebuck and Co. Its first catalog featuring only watches and jewelry was published in 1888, while its first large catalog of general merchandise came along in 1896. Sears wooed customers with promises of savings gained by eliminating the middleman. It popularized the money-back guarantee to build trust with the consumer, Mahoney said.

The gradual diversification of the company’s products seemed to know no bounds, perhaps best illustrated by the advent of Sears Modern Homes. Between 1908 and 1940, Sears sold about 75,000 such homes around the country by mail-order. Many of the homes, which came in 447 different designs, exist today.

Such a company at that time was largely dependent on the U.S. Post Office for its success and reliability, Mahoney said.

But eventually, Sears, Roebuck’s original mail-order business began to be threatened by the greater urbanization of the country after World War I. The solution — championed by then-vice president and future company President Robert E. Wood — was the introduction of brickand-mortar stores in the 1920s.

Many other innovations followed under Wood’s guidance, including getting into the insurance business during the Great Depression with the creation of Allstate Insurance. Like several other Sears-created brands, Allstate eventually would be spun off as an independent company, but not until 1993.

Although Sears has never been a manufacturer, its brands such as Craftsman tools, Kenmore appliances and DieHard batteries helped build the company’s reputation.

Even as the biggest of all, Sears didn’t take customer loyalty for granted, Mahoney said.

“They were really trying to improve the appearance of their products and make them stylish in the 1930s,” Mahoney said. “I think they were really savvy merchants.”

The nation’s economic recovery after World War II was what enabled such imitators as Kmart, Target and Kohl’s,

but probably not until the 1970s or 1980s did they start to have a significant impact on Sears’ business, Mahoney said.

Even in the mail-order years, the Chicago-based Montgomery Ward was the country’s distant second-place retailer, despite having started earlier.

“Sears always seemed to have the upper hand,” Mahoney said. Nevertheless, Montgomery Ward’s successfully carved a niche for itself by deliberately selling different products than Sears did, she added.

For the past 25 years, Sears has made its home at the 780-acre Prairie Stone Business Park it created on the west side of Hoffman Estates. Though the now-vanished Poplar Creek Music Theater was probably the first name that put Hoffman Estates on the regional map, Sears was an even bigger one, Mayor Bill McLeod said.

“When it was announced, it was a really big deal,” McLeod said. “Sears was an iconic retailer. It obviously brought a lot of attention to the village. Sears made a big difference.”

Among the other developments that have located around it are the Sears Centre Arena — now home to the NBA G League’s Windy City Bulls — and the Chicago region’s 185,000-square-foot Cabela’s store.

The westward expansion of the village’s commercial presence was followed by equivalent residential growth.

“There was very little housing on the west side of the village before Sears came,” McLeod said.

Though headlines today often chronicle the company’s present struggles, reminders of Sears’ heyday are all around. These include the call letters of Chicago radio station WLS — which stands for “World’s Largest Store” for the four years Sears owned the station in the 1920s — and the name of Schaumburg’s massive Woodfield Mall, which honors both Robert Wood and iconic Chicago merchant Marshall Field.

But for a business based in the greater Chicago area for more than 130 years, Sears’ longevity and influence are historic, Mahoney said.

“They’ve hung on longer than the stockyards,” she laughed.

Redwings win first three games of Wheaton Warrenville South MLK weekend tournament

After rolling past archrival Plainfield North (8-9, 2-5) in a Southwest Prairie Conference thriller, on Friday, the Plainfield South Cougars, were looking to surprise the high-powered Redwings of Benet on Saturday.

In a Wheaton Warrenville South Martin Luther King Basketball Tournament opener for both schools, the Cougars jumped out to a 7-2 lead, two minutes into the game. Time out Redwings.

The Redwings (11-4) responded, behind Jake Petrovic (11 points) and grabbed a 1510 lead after one quarter and would roll to a 72-46 first-round victory over Plainfield South (314).

A David Buh (19 points, four rebounds, three steals) personal 9-0 run, broke the game open and the Redwings would take a 37-25 halftime lead. In the second quarter the Redwing forced eight turnovers for a total of 13 in the first half.

“We really played great defense today,” Buh said. “We were able to play everyone and get

scoring from everyone.”

Using his entire roster, Benet head coach Gene Heidkamp, substituted frequently and was rewarded by a great team victory, by his Redwings.

“This was a great win for us,” Heidkamp said. “We were able to get everyone playing time and everyone scored. A great situation for us, having to play two games today.”

Jake Ronneberg, came off he bench to score seven for the Redwings. 6-foot-8 Colin Crothers, tallied six points and hauled down four rebounds. Will Engels chipped in with five points.

Plainfield South was led by junior Diamond Presniakovas, who scored 17 points and had four rebounds.

“Our shots weren’t falling for us today,” Presniakovas said.

“We have to take care of the ball better against Morton.”

Daughter may not be liable in failed business DEAR DAVE, My father-in-law started a business as an LLC few years ago. He named all his daughters owners, with him owning the majority share. The business failed, and now he is being sued by creditors.

He told the family these creditors can’t come after us and the other siblings, because he is the majority owner. Is this true, or should we get a lawyer?

CALEB DEAR CALEB, Your wife is probably not in danger, unless she signed paperwork making her liable for a loan or liable with a creditor. If she signed official, legal paperwork – like if she went down to the bank and signed on a loan – then she’s liable. It’s that simple. That would make her, or any of her siblings who did this, comakers on the loan.

Your wife, and any of her sisters, who signed on trade accounts taking supplies from a supplier and paying them could also be liable.

But they are not automatically liable simply because they were listed as minority owners in an LLC, or even a sub-S corporation. If it were a general partnership, there’s a possibility they could be liable. That’s one of the reasons I hate general partnerships. I hate partnerships in general, but I hate general partnerships, too! In other words, I think you’re okay. I would still advise speaking with an attorney, and giving him or her all the details of this situation, to be absolutely certain.

VERNON DEAR VERNON, You need to be honorable and pay your debts, but that may have to be put on hold for a while. Right now, it’s more important to have food in the house and keep the heat on. If you haven’t done so already, contact your creditors and explain the situation. Let them know you’ll make things right with them as soon as possible. I know this is a scary situation, especially around the holidays, so make sure you two pull together and keep the lines of communication wide open. A few extra hugs wouldn’t hurt, either.

The good news is it sounds like things may be looking up. Support your wife all you can in her new job, and make sure you continue looking for work, too. A little extra money is better than none, so take on something part-time while you’re looking for a permanent position.
