Battle continues over water rates Judge upholds ruling that Bolingbrook residents were overcharged By laura katauskas staff reporter

As the village of Bolingbrook continues on its path to take control of its own water system, a recent lawsuit regarding rates looks to be in residents’ favor.

In what has been considered a wage war over rates, mayors from Bolingbrook, Homer Glen, Lemont, Romeoville and Woodridge formed the Northern Will County Water Agency and have been meeting since 2008 in an effort to take over the Bedford Park water pipeline owned by American Lake Water Company, a subsidiary of Illinois American Water.

The group has since filed an eminent domain case in the matter. As part of the process, the agency had requested information regarding the cost of delivering water to communities in the pipeline. It was upon receiving those documents, that Bolingbrook discovered the village of Plainfield’s rate structure was different, said Bolingbrook Village Attorney Jim Boan.

The village then looked to a clause in an agreement between Bolingbrook and the Illinois American Water Company that, according to Boan, basically stated that no other town’s rates should be less than what Bolingbrook residents pay. Bolingbrook had been granted a “favored nation” clause in its 2002 Asset Exchange Agreement, which brought Lake Michigan water to the village. At the

time, having Bolingbrook on board to accept Lake Michigan water was the impetus for the water company to build a pipeline and essentially be able to pass through to other communities, explained Boan. In essence, the agreement guaranteed that no other community that purchased Lake Michigan water from Illinois American, would get a better rate than Bolingbrook.

The village decided to take its case to court, and in January 2010 the village of Bolingbrook filed a lawsuit alleging that the Illinois American Water Company had overcharged its residents after it entered into a water agreement delivery with the village of Plainfield.

On Jan. 7, a judge granted the village’s motion for a summary judgement. This means, according to Boan, that the court agreed that Bolingbrook residents were overcharged for Lake Michigan water. In March, Illinois American filed an appeal asking the court to reconsider its decision. On May 7, the court denied Illinois American’s request, filing the written opinion May 19.

However, Michael Smyth, senior manager of field services and production for Illinois American Water - Chicago Metro, released the following statement regarding the lawsuit: “On May 19, 2015, the court changed its January ruling at the urging of Illinois American Water.

The court said that the case should be sent to the Illinois Commerce Commission to determine whether there should be any refund amount to Bolingbrook. Regarding other

aspects of the ruling, Illinois American Water is considering its options, including whether to file an immediate appeal.”

The Will County court document filed May 19, states: “The court finds that it has jurisdiction to decide this issue as to whether a breach has occurred and the Court finds in favor of Plaintiff (Bolingbrook) on this issue. However, the question of damages remains….whether or not relief should be fashioned in the form of a rebate or discount going forward on future charges as well as how this should be divided between the two Defendants, Illinois American Water and American Water Company is a matter which calls into consideration the infrastructure involved and the apportionment of charges….

“Accordingly, the Court rules that the issue of a rebate, refund or lump sum payment of damages should be presented by the parties to Illinois Commerce Commission for further determination,” the document stated.

Boan said because the residents paid the fees, it has to be determined how to give it back to the residents, be it a rebate or a discount on future bills and that the Illinois Commerce Commission is the best agency to regulate the procedure.

The village of Bolingbrook contends that unless Illinois American files an appeal, the case will move on to the damages phase to assess how much is owed to Bolingbrook residents. No figures were given as to exactly how much residents were overcharged.

However, the village believes the refund amount could be substantial for its 23,000 customers of Illinois American Water.

The public is becoming more skeptical and starting to question both prices and drug company marketing practices. “A year ago there was little discussion,” says John Rother, who heads a group called the National Coalition on Health Care.

“Today that is 100 percent reversed,” and the group’s Campaign for Sustainable Rx Pricing may be catching on. “But I think we’re still a long way from agreement about what to do,” he said.

Increasingly all consumers will bear the costs of high-priced medicines through higher deductibles and more cost-sharing.

Sovaldi and similar drugs added $4.5 billion to Medicare spending last year, more than 15 times what Medicare paid for older hepatitis C drugs the year before. Only as Medicare beneficiaries and everyone else with prescription drug coverage feels the pinch, will there be any serious chance that people’s voices will be loud enough to effect any changes. That will happen, as Express Scripts pointed out, when the prices become unsustainable.

CHARLESTON – Mission accomplished.

The Bolingbrook 4x100-meter relay team came into the state meet at Eastern Illinois University with one goal – winning the state championship.

Thanks to a lean across the finish line by senior Jessica Watkins, they did just that, edging Lincoln-Way East by one hundredth of a second, finishing with a time of 47.58.

“I was waiting for the scoreboard,” Watkins said after the finish. “I gave it all I had. I was confident we had a good time and I finished the race as strong as I could. I had a really good lean. I knew she was coming, so I just got the lean in. I just gave it all I had.”

“It feels amazing to get our goal,” Bolingbrook junior Charlyncia Stennis said. “It is incredible. Our

handoffs were really good.”

The veteran unit overcame adversity of the years to win the title, making everything pay off in the end.

“This makes it all worth it,” senior Asha Wallace said. “This is such a blessing. We worked so hard to get to this point. This was my main goal. I always have to watch from the back, so I was just hoping for the best.”

“It feels good,” senior Alexis Brooks said. “This feels like home.

It feels good to redeem ourselves.

I just knew I had to get a good block start and catch the girls ahead of me in lanes eight and nine. It feels good to end senior year like this.”

Watkins closed her career in style, finishing with a fourthplace finish in the 100 (12.11) and a seventh-place showing in the 200 (25.52).

She concluded her career with an impressive eight state medals,

Raiders win first sectional team title in 8 years By mike sandrolini sports reporter

Bolingbrook got contributions across the board en route to winning its first sectional track team title since 2007 at Downers South last Friday.

The Raiders edged out Lockport, 96-88, for the top spot. Meanwhile, Romeoville, behind sectional champion discus thrower Kelvin Jones and second-place 800-meter runner Luis Loza, finished eighth out of 16 teams with 26 points.

Bolingbrook cruised to victory in both the 4x100- and 4x200-meter relays, and qualified its 4x400 relay squad for this weekend’s Class 3A state meet at Eastern Illinois as well.

Individually, junior Jaylan McConico grabbed sectional championships in both the 110 and 300 hurdles, senior Damare Portis captured the long jump crown, and the Raiders went 1-2 in the high jump with junior Justin Rivers and sophomore Zyon Bell both clearing 6 feet, 3 inches.

McConico, who this season has

already set a new school record in the 110 lows (14.24 seconds; the previous record was 14.51), continues to get better and better.

He clocked in at 14.67 seconds in the 110 and 39.33 the 300 hurdles.

“I’m surprised,” said McConico, whose PR in the 300 is 39.09. “I really just wanted to run my times (at sectional) and see if I PR’d or not, but I’m thankful. I just really want to try and make it to (the state) finals and do my best.”

“Jaylen has had a fantastic season,” said Bolingbrook coach Art Pahl. “The amount of improvement he’s had this year has just been amazing. He’s definitely a contender for a (state) medal.”

Portis leaped 22-6 to win the long jump, and the two-time state qualifier said he believes he’s capable of going 23 feet at state.

“I feel like I have more to go,” Portis said. “It’s not easy going in (to state), but I’m going in with the same confidence and the same mindset.”

“It’s tough on a school day when you’re sitting in class all day and you have to come to the meet,” Pahl said. “He didn’t use as much water as he should have and he didn’t eat as much as he should have earlier in the day, so it’s just one of those things that happens.”

Chapman, though, rebounded and helped the 4x400 relay team of himself, Tyler Elmore, Jake Perakis and Gordon Martin take second place in 3:27.10. Chapman ran the anchor leg and overtook a Downers South runner down the stretch.

Had the 4x400 team finished third, it would not have advanced to state because the state qualifying

standard is 3:23.74.

“Our goal was to get all three relays down, so we knew we could win the 4x1(00) and 4x2(00),” Pahl said. “Lemont has an excellent quarter-miler at the end. Peyton ran excellent to catch that Downers South kid.”

Both the 4x100 and 4x200 relay teams feature Portis, returning state qualifier Josh Collins, Tyler Elmore and Elante Ingram. The quartet, which won the Southwest Suburban Blue championship in both events a week earlier, continued their dominance at sectionals, posting winning times of 42.44 seconds in the 4x100, and 1:28.32 in the 4x200.

Although Collins anchored both relay squads and advanced to the sectional finals in the 100 and 200 dashes, the only thing that could give the Raiders cause for concern going into the state meet is that his left Achilles continues to hamper

him.

Collins qualified for state in the 100 last year, but he took third last Friday in 10.97 seconds, which left him just 3/10ths of a second short of the state qualifying time of 10.94. He decided not to run in the 200 final.

The sectional was only the third outdoor meet in which Collins has participated this year. He suffered the injury during the indoor season, and said he is eventually going to need surgery on it.

“Honestly, there’s really nothing much (to do for it) but resting and stretching it and icing it,” Collins said. “I didn’t want to be selfish. I had my team in mind when I scratched the 2(00), even though I made finals today.

“The inflammation is slowly causing it to rupture a little bit. It’s really frustrating, but as long as I can support my team, that’s what really matters at this point.”

“My main goal was to PR,” Stennis said. “Whatever place I get, I’m happy with.”

ROMEOVILLE Last year Cierra Pulliam put herself on the track scene with a third-place showing in the triple jump at the state meet.

This year, she topped that performance.

The Romeoville senior finished in second place Saturday at Eastern Illinois University with a distance of 39-feet, 7.75-inches.

“I think I did put on a good show and I’m excited with how I did,” Pulliam said. “I moved up another place from last year, so that was really exciting. I’m a little upset I didn’t make my goal, but I’m still excited.”

Her experience last year helped her out this year.

“I knew what was going to be happening and I knew the entire setup,” Pulliam said. “I knew what I had to do and how everything was going to be. Being a two-time medalist means a lot to me. The opportunity was great for me.”

Next up for Pulliam is college, where she will be staying in town at Lewis University. “I’m really excited to go to the college level now,” Pulliam said. “My goal is still to get 42 feet. It is nice to stay close to home.

The 4x200 meter relay of Pulliam and freshmen Idara Anyang, Jahnetta Jones and Kaniyah Rush set had a PR and finished third in their heat, but the time of 1:43.28 wasn’t quite enough to make finals.

“We had a good PR,” Anyang

said. “We really got the technique that the coaches gave to us. What we learned all season went into this race. Our handoffs were perfect. We did everything really well. It was exciting hearing the noise and the cheering. It is nice to have the support.”

“I’m really happy,” Jones said.

“We all did what we were looking to do. I’m so proud of everyone.

This motivates me a lot and we want to do better next year. It was different coming out here as freshmen at the state meet. I learned from everyone else.”

“We’re motivated,” Rush said.

“I feel we did pretty good. I was nervous, but once I got the baton I stopped being nervous. It was fun.”

Pulliam missed out on finals in

the 200, finishing with a time of 26.09.

“I felt pretty good about my races,” she said. “I didn’t come out of the blocks as fast as I should have in the 200. I’m still excited I had the opportunity to run it.”
