Bianco & Hestrin Two More Years-The Good, The Bad & The Ugly

W

hen former Oath Keeper Chad Bianco and combined death penalty enthusiast and low-level prosecutor Mike Hestrin rolled to easy victories in the June primary election it was a clarion call for change.

And that change has come, at least for some counties in California including Riverside, thanks to the signing of AB 759 by Governor Newsom on September 29. The bill now requires elections for county sheriffs and district attorneys to be held during the presidential primary. As a result, the bill further notes that DAs and sheriffs elected in 2022 will serve sixyear terms.

It is a well known secret that key elections for key positions like these are scheduled and held in off year election cycles because incumbents in these highly influential positions are almost guaranteed to maintain the status quo due to

voters by moving elections for these positions to align with presidential elections thus helping to ensure higher voter turnout and in the process giving voters a greater opportunity to truly have their say.

Just consider the facts. In the June 2022 primary the turnout in Riverside County was only 33%. Although both Bianco and Hestrin

For their part Bianco and Hestrin, besides sharing a county and a political party as these two Riverside criminal justice leaders do, for many of us their use of power as as leaders is considered mediocre at best when it comes to doing the right thing for the community but when it comes to leveraging their power in support of Maga political leanings to further the objectives of their political party and/or to boost their own electoral sustainability–they are unmatched.

The Good Some, including the Riverside Sheriff’s Department see this as a victory for the county.

They may try to spin it as such but in the long term it will level the playing field for all county

The pageant is a premier pageant that offers Black girls and young women, ages 5-20, the opportunity to work with established instructors across the Inland Empire.

The Concerned Citizens For The Development of North Fontana is the Oldest Africian-American community based nonprofit organization in North Fontana. The objective of their pageant and parade is to offer a young woman a chance to represent the organization and the City of Fontana, as well as to support young women in gaining confidence and experience in public speaking.

The Vibrant Yet Underrepresented Afro Latino Community Breanna Reeves | Staff

oughly six million adults in the U.S. identify as Afro-Latino, which means they are people who are of African descent with roots in Mexico, Central and South America and the Caribbean — and the U.S. by extension. “...The reality is that the term is not universally accepted and there is no consensus about what it means. The difficulties surrounding what we call ourselves reflect the complex histories of Africans and their descendants in the Americas,” reads an excerpt from “The Afro-Latin@ Reader: History and Culture in the United States” by Miriam Jiménez Román.

As education surrounding Latino identity grows and expands, specifically recognizing the presence of Black Latinos in the U.S., there have been calls for more expansive curriculums that address such histories throughout the Americas, including the colonial origins of Latino and Hispanic ethnic labels. In recent years, museums have hosted exhibits that examine Afrolatinidad and cultural experiences of Afro-Latinx communities.

Contributing to the growing number of exhibitions is an upcoming exhibit called Afróntalo that will be hosted by the California State University, San Bernardino (CSUSB) Anthropology Museum. The exhibit is expected to launch in September 2023 and will “explore the history, heritage and experiences of Afrolatine communities, with a focus on AfroMexico.”

Arianna Huhn, sociocultural anthropologist professor at CSUSB and the director of the Anthropology Museum, explained that the term “Afrolatine” — pronounced Afro-latinay — is used to refer to Afro-descendants who have heritage ties in Latin America and/or the Caribbean. The phrase is used in lieu of AfroLatino, which emphasizes gender binaries, and Afrolatin@, which is historically associated with “cisgendered 1990s feminism.” Across the U.S., Afro-Latinx has been recognized as a more inclusive term that removes gender pronouns, but some surveys have found that the term is

used infrequently.

“Some people really prefer just to be called Black Hispanic. Some people prefer to be called a term or identify themselves with a term that is more specific to their national origins like Black Panamanian. Some people just didn’t identify with the term Latinx,” Huhn said as she described the feedback from interviews she conducted for the exhibit.

The idea behind the Afróntalo exhibit started with Huhn participating in the Fulbright-Hays Seminar abroad program called “The Third Root: Exploring African Heritage in Mexico” in 2021. With her background in African Studies and Museum Studies, Huhn worked alongside local organizations based in southern California such as the International Society of Black Latinos and the Afro-Latinx Connections Club, a student club at the University of California, Los Angeles to plan, design and develop the components of the exhibit.

“The project really has these two main dimensions within the exhibition itself. One is really a focus on Afro descendants in Mexico, and the other is a focus on [Afrolatines],”

Huhn explained. “In California, when we first started the project, we were really focused on the Inland Empire, but it’s grown to kind of mainly southern California, but also California as a whole and thinking about the Afrolatines in our states.”

Initially proposed as a small exhibit, Huhn said she was “taken aback” by everything she learned, how rich the cultures were in Mexico and inspired by the activists in Mexico who were adamant about telling their own stories.

Huhn decided to create a broader exhibition that will support communities telling their own stories about their experiences and cultural practices in the U.S. Utilizing social media and word of mouth, Huhn worked with three undergraduate students to conduct interviews with people who identify as Afrolatine. The team recruited 20 individuals across roughly 10 Latin American countries, including the Caribbean, who will be featured in the exhibit as narrators.

Ignite Leadership Academy for Girls: All We Need is An Opportunity

ll it takes is one person to invest in your dreams to significantly impact your life.

President/CEO of the Society of Extraordinary Women, Shirley Coates, created the Ignite Leadership and STEM Academy to do just that.

Coates grew up in a small Texas city named Mount Pleasant. At a young age, she was tutored before she was in kindergarten. A woman tutored her and a few other students in her neighborhood.

A group of kids whose ages ranged from three to five years participated in these tutoring sessions.

According to Coates, the tutor first taught them to count, “Then before we knew it, we're multiplying, dividing, you know, doing complicated math skills at four and five. And then she taught us to read, and she loved Shakespeare,” Coates said. “The way she taught us was through actually acting out all of the scenes. So by us acting out all the scenes, it meant that most of us memorized a whole play.”

Coates said when she moved to California at five, she was reading at an

eighth-grade level.

“I don't have some outstanding IQ. I was just an average student, but because I was exposed to all of that, I was able to be really great at math.”

Coates struggled with self-esteem a little while growing up because she was bullied because of her dark skin tone.

Family support was a significant factor in Coates's early successes. She said her parents always instilled that confidence in her as a little girl and told her she could do anything she put her mind to.

She took that to heart, and later in life, Coates built a successful Aerospace electronics company in Irvine, California.

The company grew and she became a partner in an international real estate corporation, where she also had opportunities to travel and become a mentor and coach to others.

Behind San Bernardino County’s $7.5M+ Foster Care Abuse Settlement: Part 1

A year later C.T. began physically and sexually abusing his younger brother. For years the San Bernardino County Department of Children and Family Services appears to have covered up the abuse.

n August 29, facing a federal trial in a lawsuit brought by foster/ adoptive parents William and Michelle Mueller, San Bernardino County agreed to a court approved settlement of $7.5 million plus attorney fees rather than have a jury decide whether it and/or its social worker, Deborah Kay, knew of sexual abuse, were negligent, and failed to protect a boy known as E.M. from being sexually abused by his older brother when placed together in foster care.

The recent $7.5 million settlement resulted from a case filed over four and a half years ago on January 23, 2018, when adoptive parents William

and Michelle Mueller alongside adoptive grandfather Michael Dobie, sued San Bernardino County in federal court for multiple civil rights violations, violations of the Federal Adoption and Assistance Act & Child Welfare Act, direct and derivative negligence, and negligent concealment on behalf of a minor child, referred to only as E.M. Court documents state that on September 13, 2013, two brothers known as C.T. (born in 2003) then ten years old, and his younger brother E.M. (born in 2009) then four years old, were placed in foster care due to mental health, substance abuse, and domestic violence issues in their home.

As revealed in court records, on or about 2014, prior to placement with adoptive parents William and Michelle Mueller and grandparent Michael Dobie, the younger of the two brothers, E.M. was sexually and physically assaulted while living at a foster home by his older brother C.T. The Muellers detail that in late 2015 and 2016, E.M. reported his physical and sexual assaults by C.T. to San Bernardino County Department of Children

F E A T U R E & Family Services (CFS) Social Worker Kay. This was not the first time C.T. had been reported for inappropriate behavior. The Muellers claim that prior to 2014, C.T. was removed from a foster home for engaging in inappropriate behavior with a female foster child. C.T. was then placed in a male only foster home.

As a result of this incident, the Muellers assert San Bernardino County, CFS, Kay and other social workers were put on notice of E.M.’s history of being physically and sexually abused. The Muellers further claimed the county et. al. were negligent, had knowledge and, under the color of state law, Kay concealed this information from them and grandparent Michael Dobie, prior to the brothers’ placement as foster children in their home in 2016.

The Muellers claim that before adoption, social worker Kay had monthly visits with C.T. and E.M., and during a visit, Kay warned E.M. not to tell about “their secrets” because he would be removed from the Mueller’s home. This was confirmed by their attorney Eric Rossman in an interview with the Black Voice News and IE Voice.

The Muellers’ expectations When they applied to become foster parents with the goal of adopting, the Muellers claim they informed San Bernardino County they were unwilling to consider children with sexual abuse or behavioral/emotional issues.

As confirmed by Rossman, on or about March 20, 2017, the Muellers finalized the adoptions of E.M. and C.T. without knowledge of C.T.’s violent and sexually abusive conduct towards E.M. By March 26, 2017, E.M. reported to the Muellers that C.T. was threatening to kill him with a knife and had held it to his neck, reporting that this had happened at prior foster homes. C.T. admitted these actions to the Muellers.

The Muellers reported the incident to CFS Social Worker Kay. Kay told the Muellers she did not want to report the incident and instead recommended therapy for C.T. When the Muellers took action to protect E.M., C.T. attempted to intimidate Michelle Mueller when she corrected

him, and twice tried to get into Michelle Mueller’s bedroom where E.M. was being sheltered.

Next, E.M. told the Muellers that C.T. was hitting him, causing bruising. He subsequently reported sexual abuse, confirmed by the Muellers in C.T.’s journal. C.T. was removed from the home on or about May 11, 2017.

System Failure The Muellers allege that San Bernardino County, CFS, and social worker Deborah Kay failed to record, report, and place into the case file documentation of E.T.’s sexual abuse of his brother E.M. As a result C.T. was able to continue abusing E.M. According to the Muellers, such failure to document, report and file E.T.'s abuse; allowed C.T., a dangerous child, to be placed in their home, damaging them.

The Muellers accuse the County of San Bernardino of failing in their obligation to ensure the safety of E.M. while he was involuntarily in the foster care system as well as the right not to be raped, sexually, and physically abused.

Additionally, the Muellers advised how Kay suppressed and destroyed evidence of the physical and sexual abuse suffered by E.M and failed to report or prevent the abuse by allowing E.M. to be in close proximity to his brother/abuser, C.T. As a result, E.M. suffered severe physical and psychological injury and damages.

Court documents show E.M. drew pictures of C.T. holding a knife and cutting him, and these pictures were allegedly shown to Kay who, according to the Muellers, removed them from the foster home.

After reporting his abuse to Kay, E.M. was put on an additional psychotropic medication, Depakote, and Kay purportedly told the boy that he was psychologically unstable, and a bad person.

The Muellers describe a pattern of San Bernardino County knowingly covering up foster children known to abuse other foster children, creating a danger, identifying a dependent foster child, Rickie F., who sexually abused a younger male foster child, with CFS failing to document or report it, resulted in two other boys being sexually abused.

They described the conduct by San Bernardino County as showing a wreckless or callous indifference to the federally protected rights of the Muellers and E.M., asking the court to award punitive damages.

The county responds In answer to Mueller’s complaint, the County of San Bernardino admitted E.M. and C.T. were placed in foster care in 2013 and that it is required to protect children it places into foster care.

It also admitted that children in foster care have the right to live in a safe, healthy and comfortable home and be free from physical and sexual abuse, and that they did not inform the Muellers of E.M.’s history of unreported alleged physical and sexual abuse by C.T. The county also admitted Kay had monthly visits with E.M. and C.T. while they were in foster care with the Muellers.

However, the County claimed its employees’ actions were reasonable, done in good faith and without malice or deliberate indifference, giving rise to qualified immunity and/or absolute immunity from suit.

The County further asserted insufficient knowledge, vaguely worded questions, that other third parties had liability, and that the County is immune from liability for its employees’ misrepresentations among other defenses and

denials.

In preparing for trial, the County of San Bernardino claimed negligence is not enough to prove a due process violation when causing unintended loss of or injury to life, liberty, or property, and the county does not have a duty to protect individuals from third parties, that the state has some responsibility, and social worker Kay had no knowledge of E.M.’s abuse by his older brother C.T. until he was removed from the Muellers’ home.

The county further claimed none of E.M.’s service providers or any of the dozens of mandated reporters advised Kay, or anyone else at the County, of any suspicion that E.M. was being abused, or that E.M. disclosed he was being abused.

The County of San Bernardino denied depriving Muellers or E.M. of rights, privileges, and/or immunities secured by the United States Constitution and other laws that caused them damage.

The county claimed it has a policy or practice of documenting, reporting, and preventing physical and sexual abuse, did not fail to train or supervise its employees – Kay or others – and has a policy of keeping siblings together, with no reason not to do so in this case.

The Muellers and Dobie were represented by lead Attorney Eric S. Rossman and co-counsel

attorney John Kristensen.

An August 30, press release from one of the Muellers and E.M.’s attorneys, Eric S. Rossman, announced the $7.5 million settlement reached with San Bernardino County. "[T]he settlement brings closure and justice to the child and his family from this extremely difficult time of their lives,” Attorney Rossman affirmed regarding the settlement.

“Hopefully, from this settlement and other cases, San Bernardino County will begin taking appropriate steps to correct systemic failures and will better protect children who are placed into its foster care program from physical and sexual abuse," said Rossman.

“The County agreed to resolve litigation filed by the child and the adoptive parents,” related San Bernardino County Public Information Officer David Wert, reasoning, “While the County has not admitted any liability in this matter, when deciding to resolve litigation the County considers the effects of protracted litigation on children and families.” The County considers the resolution to be consistent with the well-being of all parties,” Wert concluded.

In an interview with the Black Voice News, and IE Voice, Rossman opined that the San Bernardino County Department of Children and Family Services is a poorly run department, children are not protected, and the program is not safe for children.

“In much of Latin America, Blackness has been erased — has been degraded. And not only there, but of course, we’re living in a world where there’s dominant, predominant, anti-Blackness in so many different spaces,” Huhn stated. “I think this exhibition is really important in order to kind of place a discussion about Blackness in Latin America within these broader discussions about anti-Blackness and demands for monoethnicity in association with authenticity.”

The museum recently received a grant from the Institute of Museum and Library Services (IMLS) that will fund the search for Afrolatine artists in California to create portraits of participants interviewed for the exhibit.

Inland Empire Officials Meet with Former LA Mayor and State Infrastructure Advisor Antonio Villaraigosa Prince James Story | Staff

s California moves to spend big dollars on infrastructure, Gov. Gavin Newsom appointed former Los Angeles Mayor Antonio Villaraigosa to serve as the state infrastructure advisor.

“With this influx of federal dollars, we have an incredible opportunity to rebuild California while creating quality jobs, modernizing crucial infrastructure, and accelerating our clean transportation progress, benefiting communities up and down the state,” Governor Newsom said. “Antonio has the extensive experience and relationships to deliver on this promise and bring together the many partners who will be key to our success. I look forward to his collaboration with the Administration as we build up communities across California.”

Villaraigosa, who served as Los Angeles's 41st mayor from 2005-2013, met with local officials at the Riverside Chamber of Commerce last month to discuss the city’s needs. He pledged to ensure both Riverside and San Bernardino Counties get their rightful share of the infrastructure funding.

“I'm here because this is one of the parts of the state in my mind that hasn't gotten its fair share,” Villaraigosa said. “I want to do everything possible to work with the leadership here, to identify the best projects that have the most economic impact.”

The Inland Empire received a C on its infrastructure report card from The American Society of Civil Engineers (ASCE).

The grade is the average of eight categories which include: aviation, drinking water, flood control, local streets, parks, recreation and open space, solid waste, urban runoff and wastewater.

The inland region received its lowest grade, a C- , in the Local Streets category.

Seventy-eight (78)% of major local and statemaintained roads in the Inland Empire were classified as being in poor or mediocre condition, costing the average motorist an additional $795 each year in extra vehicle operating costs,” the report states.

Villaraigosa gave a hypothetical example of how infrastructure funding can be maximized:

“If we cut the time in building a $1.2 billion project by 20%, it turns into a $1 billion project.

Now the state has 200 million dollars for other essential projects.”

“If you could do it for a football and basketball facility? Why not for high-speed rail?

Why not for water projects, clean drinking water projects? Why not for, you know, recharging above ground and below ground storage for our farming community,” said Villaraigosa.

“Why can't we fast-track these projects in a way that gives us a bigger pool of money.”

California has allocated $120 million in federal RAISE grants designated for planning and capital investments to local governments, transit and other agencies around the state for a variety of transportation initiatives including $15 million to the City of Fontana for multimodal complete street improvements.

Breanna Reeves, a Report for America fellow and investigative reporter for Black Voice News, is one of Ignite’s volunteer staff members who teaches the girls how the GIS system is used in journalism.

Reeves commented on how rewarding it is to nourish and stimulate the students’ growth and interest in STEM and science. “The program is free too, which is a big deal because free STEM programs are far and few in between,” said Reeves. Her project with Ignite was recently selected the best service project for the national Report for America program.

Reeves said she didn’t have access to any pre-stem programs that were free while she was growing up.

Last year, because of the pandemic, the program was via zoom, but the girls will be back in person this year, which is one of the reasons she is excited to start again.

“I really want them to get into interviewing one another. That's a big part of our job,” Reeves said. “[And] how to tell a great story both with words and with visuals, mapping, and multimedia.”

Kennedy Schneider helps the girls learn the GIS system and has been working at the Ignite Leadership Academy since she was a sophomore in high school. She is also Shirley Coates's granddaughter.

N E W S or has an effect on them. Then, I give them the tools to map it in the story maps, and they set up a whole presentation for the end of the program.”

Schneider said she has enjoyed seeing the program evolve and how the stories grow as they come back year after year.

“GIS is a really big part of this class. We also have guest speakers talking about self-esteem building, financial literacy, and leadership,” Schneider said. “My favorite thing is seeing everyone get so excited about the information they're receiving.”

Coates said they try to bring weekly speakers to provide their expertise on a specific topic.

They also go on trips locally; in the past, they have gone to Washington, D.C, New York, and also Dubai.

This year the classes will be held at the Cal Baptist University Aviation Center. They are in a bigger space, so the goal is to bring in even more girls to the program.

The Ugly In my May 16 Keeping it Real I encouraged readers not to sit the June 7, 2022 primary election out. I should have screamed louder.

There are more than 19,000 cities, towns, villages and counties in the nation with a variety of government structures. Riverside for example, is a general law county.

The California Constitution recognizes two types of counties, general law and charter counties. General law counties like Riverside must adhere to state law as to the number and

duties of county elected officials and elections.

Charter counties like San Bernardino on the other hand, have a limited degree of “home rule” authority as it relates to elections. As a result, the mandates of AB759 does not apply to San Bernardino County.

Now, consider San Bernardino County Sheriff Shannon Dicus. Like his two immediate predecessors, Dicus was appointed to his position and also like them, he sailed to victory during an off year election with low voter turn out.

Dicus was hand selected by his predecessor former Sheriff John McMahon, anointed by the San Bernardino County Board of Supervisors and took office in July 2021. Less than a year later he sailed to victory with more than 50% of the vote during the June 2022 Primary–the turn out was worse than it was in Riverside County, a mere 22.63%. In other words Dicus successfully sailed to victory with the support of a little more than 10% of eligible voters in the county.

As noted above, as a charter county San Bernardino County appears exempt from the new law because its charter has elections for sheriff and district attorney (in addition to the County Assessor) set for non presidential election years when turnout as noted, is certain to be low.

The good news in this is that Dicus does not get the two year bonus that comes with compliance to AB 759, however this process of effectively cutting voters out of a fair chance to select the county’s sheriff is destined to continue…unless however… voters demand change.

San Bernardino County residents can advocate to change the Charter by electing Board Supervisors who support citizens having a strong voice in electing the county sheriff, district attorney and assessor and who are willing to revise the San Bernardino County Charter to make this possible by scheduling these elections during presidential election years. It would also be more cost effective for taxpayers.

Of course, this is just my opinion. I’m keeping it real.
