Riverside County Sheriff’s Dept., Local Agencies Seek an End to Its “Age of Impunity”

ate last week we learned members of the community are pushing for accountability of the Riverside County Sheriff’s Department.

Three of the area’s nonprofit organizations, the ACLU Foundation of Southern California, Starting Over Inc., and Riverside All of Us or None, coalesced to request in writing, that California Attorney General Rob Bonta launch an investigation into the department. These groups were supported in their action by more than 20 other local organizations that signed the request in concurrence.

The letter highlighted how the Riverside County Sheriff’s Department, “has demonstrated a pattern of racist policing practices, rampant patrol and jail deaths, and a refusal to comply with recommendations from oversight agencies and a court-mandated consent decree.”

The list of egregious actions or inactions (depending on the issue) range from a blatant failure to respond to civil grand jury recommendations; to a failure to comply with mandates of a consent

Office, to no avail.

It’s been clear since Sheriff Bianco took office in 2019, he is unfit for the job and appears to lack the skills or willingness to lead the Riverside County Sheriff’s Department in the direction needed for the community and the department to work in partnership.

As reported by Black Voice News in December 2020, Bianco fancies himself a Constitutional

- Naomi Klein decree; to the requirement for an emergency motion to protect inmates from the impacts of COVID-19; to concerns over the increase in in-custody deaths, as well as ongoing concerns related to the police use of force, among other considerations.

The correspondence also focused a laser on the failures of the one agency available for communities to hold Sheriffs Departments in California accountable, the Board of State and Community Corrections or BSCC. They noted how, in addition to the agency’s refusal to conduct jail inspections during the first ten months of the COVID-19 outbreak and despite community complaints about the conditions in local jail facilities, the inmates were left vulnerable until Sheriff Chad Bianco was compelled to implement mitigation measures.

The complaint further stressed how the BSCC consists largely of former law enforcement and that this was not the first time the board has proven impotent despite having been called to account by the media in addition to the Legislative Analyst’s

Sheriff. In other words, the ultimate authority in the county—he believes no one tells him what to do or how to do it.

When you believe, like Bianco, that you possess all the power and all the authority, you freely disregard a civil grand jury report, you ignore the requirements of a federal consent decree, you overlook the suffering of those in your jails, and you turn a blind eye or rush to justify the questionable use of force by your deputies. You rule with impunity because you see yourself exempt from accountability.

And that is not all. You feel you can say anything, regardless of how ignorant it may sound because— you are the sheriff, you wear the badge.

So, you find yourself saying things during the peak of the pandemic last year like, “[You won’t be] blackmailed, bullied or used as muscle against Riverside County residents in the enforcement of the governor's orders." continued on page 18

Danelle Harrison Appointed Forest Supervisor, San Bernardino National Forest

n August 16, Danelle Harrison was appointed Forest Supervisor with the San Bernardino National Forest (SBNF).

Previous to Harrison’s appointment the management job was in the hands of two temporary supervisors.

With the appointment Harrison replaced Tom Hall who returned to his position in Washington D.C. as a legislative affairs specialist after leading the SBNF for the past four months.

As supervisor, Harrison will continue her career with the U.S. Forest Service which began in 1999 as a member of a seasonal trail crew in the Mt. Baker-Snoqualmie National Forest outside Seattle, WA. In recent years, she served as the post-fire recovery coordinator in the Pacific Southwest Region.

research at the Forest Service's Southern Research Station in Louisiana, serving as a pre-sale forester on the Green Mountain National Forest in Vermont, and leading an integrated resource restoration pilot program for the agency out of its Washington D.C. headquarters.

Her education includes a Bachelor of Science degree in Forest Resource Management from Tuskegee University and a Master of Science degree in Urban Forestry from Southern University and A&M College.

Harrison, a 22-year veteran of The Forest Service, now serves a 811,571-acre forest that includes the San Bernardino, San Jacinto and a small portion of the San Gabriel mountain ranges.

COVID: Inland Officials Resist Mandates, Cases Rise, and Molina Healthcare Offers Free Vaccines S.E. Williams | Executive Editor

Like elsewhere in the country, both Riverside and San Bernardino Counties continue in their efforts to curtail the impact of COVID-19. But, are they doing all they can?

While experts are in overdrive, working to convince the unvaccinated to take the vaccine, President Joe Biden had put a stake in the ground and last week issued a series of mandates requiring employees in certain jobs to be vaccinated or take a COVID-19 test weekly.

In the meantime, Moderna seeks approval for a third (booster) shot for its vaccine recipients to keep current with Pfizer, even as experts are divided on the need for a booster for anyone who is not a senior or immunocompromised.

Pfizer and Moderna are also working aggressively to bring a vaccine to market for children between the ages of five- and twelve years, especially now that schools have reopened, the virus is spreading in many classrooms and children are filling ICU wards in some states.

In addition, despite the COVID-19 vaccines are proven extremely effective at preventing serious COVID illness and death, nay-sayers, anti-vaxxers, and those sincerely vaccine hesitant--either knowingly or unknowingly-continue to spread false information about the vaccines and in the process, are muddling conversations regarding the efficacy of the vaccines and according to some, further fueling the hesitancy among many.

The sense of urgency to convince those who remain hesitant to take vaccines is real, and the mandates implemented by the president are designed to highlight that urgency. Most experts concur the more the virus circulates, it is more likely to mutate and the possibility exists--like with the Delta variant--that a future mutation might evolve that could be more contagious and virulent.

Despite this risk, about 80 million Americans-including many in the Inland Empire, remain unvaccinated.

Local officials resist mandates

Included among the president’s mandates is the requirement that all federal employees, federal contractors and health-care workers at facilities receiving federal funds must show proof of vaccination, with no testing option.

Another mandate calls on businesses with 100 or more employees to ensure their employees are vaccinated and those who are not, must be tested weekly.

These are just a couple of the mandates instituted by the president, however officials in both Riverside and San Bernardino Counties have expressed their reluctance in recent days to adopt similar mandates for municipal workspaces.

Riverside County Riverside County Department of Public Health, Senior Public Information Specialist Jose Arballo Jr. claimed the county will continue to follow state guidelines and recommendations advising the Southern California News Group

(SCNG), “If something changes with the state guidelines, we might consider revisiting these issues at that point.”

Not surprisingly and in addition, Riverside County Sheriff Chad Bianco once again seized the opportunity to speak out about COVID-19.

Speaking about mandates during a recent podcast he explained how it is not his job to keep people healthy, “Part of government is not keeping you healthy. It’s not the role of [the] government,” he declared, adding, ''It's not my role.”

San Bernardino County Meanwhile, COVID hospitalizations continue climbing in San Bernardino County, no less than 93 patients were in intensive care at hospitals across the county on Sunday. Even with 420 hospitalizations in San Bernardino this weekend, the county has not changed its position about mandates. continued on page 8

After Winning Recall Election, Newsom Says “Let’s Get Back to Work”

t looks like Gov. Gavin Newsom will remain in the office he won in 2018 after he secured an insurmountable lead in votes counted so far in Tuesday’s gubernatorial recall election.

Several media outlets projected shortly before midnight Tuesday that the attempt to remove Newsom from office, failed.

About an hour after thanking Californians for keeping him in office, Newsom tweeted, “Now, let’s get back to work.”

Larry Elder Concedes Larry Elder, a conservative Republican Los Angeles-based talk show host, who was the leading candidate vying to remove Newsom from office, conceded the race. A total of 46 candidates were on the ballot to replace Newsom.

“Let’s be gracious in defeat,” Elder said after the results started pouring in and it was obvious he had no chance of winning. “We may have lost the battle, but we are going to win the war.”

According to preliminary results, just under 65 percent of the voters have said “no” to recalling Newsom in the special election that is estimated to have cost California taxpayers $276 million. With about 67 percent all votes counted so far, only a little over 35 percent voted yes on the recall.

Social media Reactions on social media included the following: Kevin Mullin (D-San Mateo), Assembly Speaker pro Tem tweeted, “A $276 million waste just to reaffirm 2018’s results with an election coming in 2022. The CA recall process must be reformed including elevating the Lt. Guv in the event of a recall. But to avoid partisan power grabs the Governor/LG should be a ticket of the same party (like NY).”

Lt. Gov. Eleni Kounalakis wrote, “Thank you California for recognizing that @ GavinNewsom is exactly where he needs to be, in the Governor’s office! His commitment to the people of California is unwavering and I look forward to his continued leadership of our great state!”

Rep. Karen Bass (D-CA 37) tweeted, “Proud of our governor. Proud of our people. Proud of California.”

What voters said “yes” to Newsom told supporters, although Californians voted “no” to the recall, he wants to focus on all the things they were saying yes to by their votes. “‘No’ is not the only thing that was expressed tonight,” Newsom said. “I want to focus on what we said ‘yes’ to as a state. We said yes to science. We said yes to vaccines. We said yes to ending this pandemic. We said yes to people’s right to vote without fear of fake fraud or voter suppression.”

No evidence of fraud or miscounting The gubernatorial recall was the fifth statewide vote Dr. Shirley Weber has overseen since she was appointed Secretary of State

on Jan. 19. Throughout the process, Weber, a former Assemblymember who represented the 79th District in San Diego County, says she worked hard to make sure that voter fraud or the talk of fraud, would not interfere in the results of this election.

“We worked hard to secure our elections.

There’s no evidence of fraud or miscounting,” Weber said on CNN. “As Secretary of State, we’ve been even-handed in how we’ve handled every issue. I was sued by the governor as well as by others because of some of the decisions we made that were fair and just.”

Weber’s office has 30 days to certify the recall election once all of the votes have been counted.

If there are any discrepancies, Weber said those issues will be addressed.

“I like to say to those that continue to challenge this issue of fairness and so forth, I always say, ‘where’s the evidence?’” Weber said. continued on page 18

Although local mandates were discussed by the board according to county spokesperson David Wert, not adopting local COVID-19 health orders helps to, “avoid confusion and ensure consistency.”

Fifty-seven percent of California’s population is fully vaccinated compared to only 53.8 percent of residents in San Bernardino County over the age of 12. Yet, even lagging behind the state in this important measure, does not appear to be a strong enough impetus for county leaders to create local health orders or mandates.

Commenting on mandates, 4th District Supervisor and San Bernardino County Board Chair Curt Hagman declared, “I think it’s pretty intrusive.” He qualified his statement by saying he would like everyone to get vaccinated but expressed this sentiment, “I’m just uncomfortable forcing them to do it. Some people just don’t want to get vaccinated. Our job is to put all the information out there and let people make their own decisions.”

Surprise Decision Regarding COVID-19 Vaccine Booster Shots

n Friday, September 17, many Americans were surprised to learn approval for dissemination of COVID-19 booster shots for the general population did not receive the authorization the White House had led many to believe was imminent.

The public believed the approval was imminent in part due to comments

by President Joe Biden and also due to a press release in mid-August, where Public health and medical experts from the U.S. Department of Health and Human Services released a joint statement attributed to officials with the Centers for Disease Control and Prevention (CDC); Food and Drug Administration (FDA); National Institutes of Health (NIH); Dr. Anthony Fauci; Chief Medical Advisor to President Joe Biden and Director of the National Institute of Allergy and Infectious Diseases; Dr. Rachel Levine, Assistant Secretary for Health; Dr. David Kessler, Chief Science Officer for the COVID-19 Response; and Dr. Marcella Nunez-Smith, Chair of the COVID-19 Health Equity Task Force.

associated with a reduction in protection over time and acknowledging that additional vaccine doses could be needed to provide long lasting protection, we have been analyzing the scientific data closely from the United States and around the world to understand how long this protection will last and how we might maximize this protection.”

The statement further explained how the available data make it very clear that protection against COVID-19 infection begins to decrease over time following the initial doses of vaccination and with the dominance of the Delta variant, they are starting to see evidence of reduced protection against mild and moderate disease.

Ending the Great Cost Shift: How California’s Poor Subsidize the State’s Solar Lifestyle, Part 1

alifornia’s poorest communities are subsidizing the state’s solar movement through a little known and even less understood subsidy called Net Energy Metering (NEM).

Research shows solar-adopters are principally those with higher incomes who tend to live in neighborhoods with comparatively high White and Asian populations and relatively low Hispanic and Black populations.

Even the poorest electricity consumers— those who qualify for low-income assistance— pay extra in their electric bills to cover costs incurred by wealthier customers who have solar systems.

Meredith Fowlie, professor, and faculty director for the Energy Institute at Berkeley, stated, “What Californians pay is much higher

than the true marginal cost of using electricity.”

According to Fowlie, “This puts an unnecessary cost burden on low- and middle-income households as we transition to using clean electricity.”

A study she co-authored, points to the way utilities bundle their fixed costs which include subsidies for rooftop solar, in addition to the continuously increasing costs of wildfire mitigation into kilowatt-hour prices paid by their customers. Surprisingly, according to the study, about 77 percent of what customers pay for their electric service goes toward such fixed costs. These costs are baked in and do not change whether customers use more, or less electricity.

joined by the state’s leading investor owned energy companies like Southern California Edison, Pacific Gas and Electric, San Diego Gas & Electric, a host of consumer protection agencies and advocacy groups ranging from the Natural Resources Defense Council to the American Association of Retired Persons (AARP) to The Utility Reform Network (TURN), and other interested parties, all pressing the California Public Utilities Commission and the State Legislature for change. Though their recommended solutions are different, they all agree the current process is shifting costs, and unless there are changes, the inequities can only exacerbate.

Net Energy Metering

E

S T O R Y More than 25 years ago, conversations about clean energy were interesting but not imminent for most, and rooftop solar panels, despite their projected benefit for the environment, seemed a futuristic benefit for those who could afford it.

As a result, NEM subsidies did not have much resonance with most energy consumers beyond those who installed and directly reaped the benefits of solar rooftop technology.

It was then, NEM subsidies were designed and implemented in part, to “encourage private investment in renewable energy resources, stimulate in-state economic growth, [and] enhance the continued diversification of California's energy resource mix.”

Although the subsidy has worked well for those who installed solar and are now benefiting from it, for low-income households, renters, and seniors—it is not as they are stuck paying a lion’s share of the subsidies without the benefit of clean energy technology.

Today, economically stressed households in the inland region and across the state work to stay current with their utility bills while catching up on millions of dollars in past due utility charges due to the 2020 impacts of COVID-19, many may be unaware of the rising cost of their electric bills are the result of increasing subsides as more and more residents in the state install solar.

How Net Energy Metering Works When a customer’s rooftop solar system generates excess energy, they receive a credit on their electric bill. The credit is set at nearly full retail rate. Part of the problem is utilities are required to credit rooftop customers for this excess energy at a rate that is about eight times higher than the cost of solar on the open market.

This results in solar customers paying minimal bills and not paying their fair share toward what it costs to operate and maintain the electric grid or any other required public policy programs that support low-income customers, wildfire mitigation, energy efficiency, etc.

Instead, those costs are “shifted” to customers without solar including those least able to afford it. As more and more customers install solar, few and fewer customers will be left to pay for these mandated policy programs.

In February, a report by the Brookings Institute shows the amount of energy solar customers sell back to the grid (as noted above) represents a relatively small amount.

The bigger issue, the issue that concerns customers without solar technology, is that NEM customers do not pay fully for energy they consume while—just like non solar customers— they are connected to the grid 24-hours a day, seven days a week. Solar customers are constantly connected to the grid to either receive energy or sell energy back to the grid.

NEM’s Impact on the Poor On any given day, customers must constantly use the grid to balance supply and demand and the cost of grid services can be sizeable, Brookings reports. “[F]or a typical residential customer in the United States with an average electricity bill of $100 per month, the actual cost of grid service can range from $45 to $70 per month—however, the customer does not see that charge.”

In the extreme example provided, if a solar customer’s energy usage in a month nets to zero

because their solar system produced the exact amount of energy they consumed, the customer would pay $0 that month even though they were connected to the local electric company’s distribution grid and continuously using its services the entire time.

This of course, is an extreme example and most NEM customers do pay some portion of the grid services they use. The problem is however, NEM customers pay for only a fraction of the grid services they use because of the NEM subsidies that “shift” those costs to non-solar customers.

California’s Deserts Face Threats But We Have a New Chance to Protect Them

bill to establish a California Desert Conservation Program won final approval in the state Legislature this week and is now headed to the governor’s desk for his signature. AB 1183 would provide badly needed, dedicated conservation funding to the Mojave and Colorado deserts.

Possessing vast and dramatic landscapes, spectacular geology, dark night skies and a diverse array of plants and animals — many of which exist nowhere else on earth — our California deserts are a national treasure.

Emblematic species such as the desert bighorn sheep, desert tortoise, and western Joshua tree are known throughout the world.

The California deserts are also a vast carbon sink, helping to address the effects of climate change.

California’s deserts have become an increasingly popular tourist destination. Visitation has skyrocketed in recent years. It’s understandable.

They are places of wonder and discovery where one can find respite from the frenetic pace of modern life, and they are within a short distance of nearly half the state’s population. Our deserts have also become an increasingly popular destination for out-of-state and foreign visitors.

But, although they were long thought to be immutable, our deserts face many threats.

They include climate change and its effects, including increased fire risk due to higher average annual temperatures and longer droughts; infestations of non-native plants, which make deserts more flammable, crowd out native wildflowers, and reduce forage for wildlife; increased development, which reduces and fragments habitat; unmanaged offhighway vehicle use; and more recently, illegal marijuana grows.

California can no longer afford to ignore these threats.

Given the increased public interest in and use of our deserts, there is also a need for greater public access, visitor information, education, and inclusion in outdoor opportunities.

Despite the tremendous need for desert conservation, to date, little state conservation funding has been directed to our deserts. AB 1183 would remedy this, providing a mechanism to dedicate funding specifically to desert conservation. Another Look at Hesitancy As campaigns to inform residents of the benefits of vaccines continue, many still refuse to be vaccinated. A survey conducted at the request of researchers at the Massachusetts General Hospital, the Johns Hopkins Hospital, and the University of California and published in March, sought to understand the most common reasons why Americans are hesitant to get vaccinated for COVID-19.

The team undertook the effort because as it suggested, public health interventions to target vaccine-hesitant populations should include messaging that addresses their concerns about the vaccines' efficacy and safety.

Participants in the study cited several reasons for vaccine hesitancy including potential side effects, the need for more information about the vaccine, and doubts about vaccine effectiveness.

The study highlighted additional pertinent findings including that vaccine hesitancy was also tied to not receiving the influenza vaccine in the past five years. Also, females and Blacks, having a high school education or less, and

having a Republican party affiliation were more likely to be vaccine-hesitant.

Stressing further, "The government has no ability and no authority to mandate your health choices. As your sheriff, I have an obligation to guard your liberty and freedom."

Wow, I guess he picks and chooses whose liberty and freedom he guards, certainly not the inmates in his jails; certainly not those injured or killed by his deputies on the streets; certainly not the lives of Riverside County residents his unvaccinated officers interact with daily—who, because they remain unvaccinated, may unknowingly spread COVID-19 to others possibly causing serious illness or death.

It is past time for the Riverside County Sheriff’s Department to be accountable to the community it serves. The action of the ACLU, Starting Over Inc., Riverside, All of Us or None and the 20 plus groups that joined this action to hold Bianco and his band accountable, should be applauded.

Now, it is up to Attorney General Bonta to act.

In the meantime, I will remind you all that regardless of what happens with this complaint, Bianco is up for reelection in 2022. Once again, we will have an opportunity to choose. We do not have to settle for leadership in the Riverside County Sheriff’s Department that does not serve the community’s greater good. We do not have to settle for the least capable candidate just because he is well funded.

Money can buy a lot of things, maybe even elections at times, but it cannot buy character, credibility, fairness, competence, compassion or effective leadership capability for those who do not have them.

Of course, this is just my opinion. I’m keeping it real.

A sudden change of direction Those plans changed late Friday, September 17, when after meeting late into the day, the CDC Advisory Committee issued a very narrow booster shot recommendation.

It ruled against a booster dose of a COVID-19 vaccine for most Americans—at least for now but did recommend the booster shot for adults over the age of 65 and those who are high risk though it has yet to define who falls into the high-risk category.

In the wake of this decision, White House chief medical adviser, Dr Anthony Fauci insisted on Sunday, this is not the end of the story.

Although the FDA is not required to follow the committee’s recommendation, it usually does.

protect, and restore desert lands, and to provide for public access.

AB 1183 would also contribute to the state’s goal of conserving 30% of its land by 2030; there are many affordable opportunities to acquire and conserve natural areas in the desert.

We urge Gov. Gavin Newsom to sign AB 1183 into law. The passage of this legislation would give this wild, unique and very important part of our state’s natural and cultural heritage the much-deserved support it needs, benefitting this and future generations.
