In San Bernardino County An Arrest Should Not Be a Death Sentence

n Monday, August 1, 2022 deputies at the West Valley Detention Center in Rancho Cucamonga responded to an unresponsive inmate.

Although deputies and the facilities medical staff purportedly performed CPR when the city’s fire department arrived on scene, the inmate was pronounced dead. The deceased was reportedly arrested July 27 for resisting an executive officer.

Resisting an officer should not result in a death sentence.

Neither, I venture to guess, did the alleged crime of another San Bernardino County jail inmate who died in custody at the High Desert Detention Center in Adelanto about 10 days before.

No further details about this inmate are available pending notification of family.

Both deaths are pending investigation.

intoxication, accidents, and homicides was second highest among Blacks at 25 per 100K inmates, second only to American Indian/Alaska Native at 33 per 100K There is something else interesting in the report that might serve as a red flag and that is the percent of local jail inmates by time served before death. The Bureau of Justice Statistics report for

“Imprisonment: It is a cruel and useless substitute for the elimination of those conditions--poverty, unemployment, homelessness, desperation, racism, greed--which are at the root of most punished crime.

The crimes of the rich and powerful go mostly unpunished.”

- Howard Zinn deaths in San Bernardino County in the last 12 months–at least ten other inmates have died in the care of the county’s Sheriff’s Department.

Yet, according to the Bureau of Justice Statistics among those confined to county jails nationwide, “About 65% of jail inmates were awaiting court action on a current charge, while the remaining 35% were serving a sentence or awaiting sentencing on a conviction.”

These people, most “still innocent because they have yet to be proven guilty,” according to the laws of this nation, do not deserve to die in county jails.

Not surprisingly Blacks are overrepresented in the number of in-custody deaths in key categories across the country according to the same 2019 report.

• The illness mortality rate per 100,000 was highest among Blacks at 83 deaths per 100K • The heart disease mortality rate was highest among Blacks at 50 per 100K • The mortality rate from drug or alcohol

2019 and 2020 shows the greatest number of in custody deaths in local jails occur within the first seven days of incarceration.

Whatever the reason for these deaths, San Bernardino County jail inmate deaths at least in the cases cited above, fit the paradigm.

The idea of so many people dying indiscriminately in our county’s jails should be concerning to us as a community and should warrant a serious investigation.

Some of you might argue that the deaths are being investigated by the Sheriff's Specialized Investigations Division. But I, for one, do not trust the Sheriff’s Department to conduct serious and impartial investigations into deaths that occur among those charged to their care, in their facilities and on their watch.

Nor am I convinced of the impartiality of the county’s coroner’s office to determine accurate causes of death when the coroner is also under the continued on page 17

Riverside County Declares Public Health Emergency as Monkeypox Cases Hit 70

ollowing state-wide and national public health emergency declarations by Governor Gavin Newsom and President Joe Biden regarding the spread of monkeypox, Riverside County proclaimed a public health emergency on August 8.

Riverside County Public Health officials reported the first probable/confirmed case of monkeypox in the region back in June and have reported 70 probable/ confirmed cases to date. The cases have been detected in men between the ages of 20 and 70 who live in the Coachella Valley.

“We have seen the devastating physical effects of Monkeypox on those who have been infected, as well as the emotional toll on partners, family and loved ones,” said Riverside County Public Health Officer Geoffrey Riverside County Public Health Officer Geoffrey Leung in a statement. “Now is the time for Public Leung signed a proclamation declaring the spread Health, our community partners and local leadership to of monkeypox a public health emergency in Riverside County on August 8, 2022 (via Twitter).

The county has been allocated a limited supply of the JYNNEOS vaccine used to treat monkeypox.

JYNNEOS is licensed for adults 18 years and over. It is administered as a two dose injection series in the upper arm at least four weeks apart. Vaccination helps to protect against monkeypox when given before or shortly after being exposed. continued on page 13

The Push for Equity in Solar Panel Subsidies Continues

eforming the state’s Solar Panel subsidy and the Net Energy Metering (NEM) program was the main topic of discussion during the State Senate Energy, Utilities and Communications Committee hearing and meeting on Aug. 3.

California’s NEM Program was passed in 1996 to incentivize California homeowners to buy solar panels and other renewable energy sources.

Through the years, NEM has been adjusted and reformed to make this program more equitable, and in January 2016, California passed NEM 2.0.

The program worked as planned because it led to California leading the way in renewable energy in households across the country.

In 2019, however, discussions began to find more inclusive subsidies to remedy the hike in electric bills affecting low-income communities.

Part of the problem is that households with solar power energy panels do not pay their fair share for using the grid and public policy programs

that support low-income residents in California.

“The NEM subsidy benefits 1.1 million customers compared to the 2.8 million low-income customers that receive CARE assistance. That $3.4 billion annual NEM subsidy will continue to increase each year as more customers install solar and fewer and fewer customers are paying to maintain the grid and to fund state-mandated public policy programs such as energy efficiency and CARE,” According to an Affordable Clean Energy For All report.

“Our coalition absolutely supports rooftop solar,” Kathy Fairbanks, spokeswoman for the nonprofit Affordable Clean Energy for All, said.

“We'd like to see a reform of NEM, the Net Energy Metering program in California, so that everyone, solar homeowners and non-solar, are paying their fair share for all these shared costs.”

Renowned Real Estate Developer’s Entry into Carousel Mall Redevelopment Sparks More Interest in Downtown San Bernardino Staff s progress continues in the redevelopment of the 43-acre Carousel Mall site, a project envisioned to revitalize San Bernardino’s downtown, two recent high-profile actions by the city council on the site have spiked interest in other properties in the area.

On August 3, the San Bernardino City Council approved adding national real estate developer Lincoln Property Company (LPC West) to the development team as the project’s principal partner, joining RD-ICO. The Council had on July 20, approved seeking bids to demolish and clear the Mall property.

LPC West is the second largest apartment operator in the United States and has developed over 130 million square feet of mixed-use space throughout the country.

It finances, constructs, and operates large projects that bring together housing, office, and commercial space in one location.

“With their proven track record of developing large successful projects across the country, many inland cities have wanted to do business with Lincoln,” said San Bernardino City Manager Robert Field. “Having them committed to the Carousel Mall project speaks volumes about downtown San Bernardino’s potential.”

The addition of LPC West to the development team is part of a third amendment to an exclusive negotiating agreement (ENA) with the current development group, RD-ICO, a partnership between Renaissance Downtowns USA and ICO Real Estate Group.

The amended agreement establishes LPC West as the new project lead in partnership with RD-ICO and allows continued negotiations on a development agreement that will include the sale of the property, financial terms, and additional project details. The ENA, which runs through September of 2023, also includes timeframes and milestones that must be met to ensure the project continues to

proceed in a timely manner.

The City will seek proposals to demolish the mall in the coming months as it works with LPC West to finalize a sale agreement to redevelop the Carousel Mall property. Last week, representatives from several demolition firms toured the property with City officials in anticipation of an upcoming Request for Proposal (RFP) seeking bids to demolish and clear the site. The cost to demolish the mall will be factored into the purchase price of the property.

“Having the City move ahead with the demolition and clearing of the mall property while we work with LPC West on the terms of the sale and the development plan helps

expedite the process tremendously,” said San Bernardino Director of Community, Housing, and Economic Development Nathan Freeman.

With news of the addition of LPC West spreading, there has been an immediate heightened interest in other downtown San Bernardino properties as well.

“We know the redevelopment of the Carousel Mall will serve as a catalyst to transform the entire downtown area,” said Freeman. “The number of phone calls we have received from additional developers has increased. Things may be happening faster than we envisioned.”

Interracial Marriage In a Polarized America An Ethnic Media Services National News Briefing

Ethnic Media Services held an “Interracial Marriage In a Polarized America” national news briefing on Friday August 5, 2022 as part of the California State Library Ethnic Media Outreach Grants initiative.

t this briefing, journalists across the nation heard from experts and researchers who discussed data and ideas on the subject. A multiracial family also shared insight on their lived experience and what it takes to make it and thrive in an increasingly polarized society.

Ethnic Media Services is currently working on a collaborative reporting project, profiling mixed race households. The Black Voice News will be contributing a report.

Taking a solutions-oriented approach at the briefing, Ethnic Media Services opened the floor to experts to discuss how mixed race families are a part of overcoming racism in the long-term.

Allison Skinner Dorkenoo, Assistant Professor of Behavioral and Brain Sciences, Social Psychology at the University of Georgia, provided context to understanding attitudes toward interracial marriage in the U.S. She shared data that indicated almost a third of the study’s non-Black participants were okay with interracial relations but would not partake themselves.

Another dataset she presented indicated that all groups besides the multiracial sample held a bias against Black-White interracial couples.

Sonia and Richard, a multiculturalmultiracial couple that, together, encapsulate Black, Latino and Korean origins also spoke.

The couple is raising four children in Los Angeles. They provided insight into challenges and perceptions they’ve encountered, how they’ve “culture-proofed” their home, and larger changes they feel are necessary to cultivate more inclusive spaces for multiracial children.

Richard, who is Korean-American, said his family did not initially accept Sonia, who is Black and Latino. The two met at a Los Angeles hospital where they both worked.

“At the moment it felt like you probably lost your parents,” Richard said. “I didn't realize that it didn't have to be a choice but I chose Sonia,” he said.

Richard’s parents eventually came to understand and accept their son’s choice. But the couple has encountered other challenges in the way in which they are perceived.

“I don't think they see Richard and I as a couple at times,” Sonia said. “When they realize it's us together you see their faces trying to make sense of the group.”

Richard says when people often hear Sonia’s name, Sonia Kang, “[T]hey expect a Korean lady, but then they see Sonia. It's amusing but hopefully it becomes the norm.”

Within their home, Richard and Sonia have

defined their norms. Sonia says just like they child-proof their home to protect their children from injury, they also “culture-proof” it to “help uphold the home we wanted and what we wanted our children to see and hear.”

She says they buy the products that look like their family in an authentic way and model what they want their children to see and hear.

But in raising a multicultural family, the couple said the challenge does not manifest within the home but rather outside, such as filling out forms in school. “It’s still a very antiquated system of federal forms that still have them pick one (race), there’s not necessarily a box that gives them who they are – that's been continued on page 17

Oleander Incident: Interstate 215 Reopens and Evacuation Mandate Lifted Prince James Story | Staff

n Thursday, Aug. 11, firefighters responded to a report of a chemical leak from a railcar in the city of Perris.

That night, Interstate 215 was shut down going both directions from South of Van Buren and North of Ramona Expressway.

All homes and businesses within a half-mile radius of the leak were evacuated.

The liquid in the rail car was identified as styrene, according to Oscar Torres, Riverside County Fire Department Hazardous Materials Response team member.

Styrene is a resin used to make latex and synthetic rubber.

The Occupational Safety and Health Administration lists some of the health effects of styrene exposure: "Irritation of the skin, eyes, and the upper respiratory tract. Acute exposure may also result in gastrointestinal effects.

Chronic exposure affects the central nervous system showing symptoms such as depression, headache, fatigue, and weakness, and may cause minor effects on kidney function.”

On Friday morning, approximately 170 residents within ½ mile of the leak were evacuated.

John Crater, Riverside County Fire Department Division Chief, said he had contacted experts from other states to find ways to resolve this issue.

“This can resolve itself in two days. It could get worse before it gets better. They've also said due to the heat building in the car that builds pressure, and it could have a release, meaning some sort of violent explosion, so that's why we're taking an abundance of caution with this,” Crater said Friday at a press conference.

Also, on Friday, Crater advised it was too dangerous for them to get close to the tank car and start any mitigation to cool it down. Instead, they flew the department’s drone over the car, looking at the Infrared footage to get an estimate of its temperature.

According to public health officials, Riverside County is also working with community partners to provide Tecovirimat (TPOXX) for infected patients who are at higher risk of severe disease from monkeypox. So far, most patients have not required TPOXX and symptoms have resolved on their own with “symptom management strategies.” No deaths have been reported as a result of monkeypox, but some patients who have tested positive have been hospitalized.

The California Department of Public Health reported 1,310 probable and confirmed cases of monkeypox, with about 3% of cases requiring hospitalization. The first probable case of monkeypox was first detected in California on May 21.

Prior to the recent outbreaks, monkeypox was classified as a rare disease that is caused by infection with the monkeypox virus which is related to the smallpox virus. Monkeypox is spread through direct contact with someone who sores, rashes or by sharing bodily fluids through activities like sex, kissing and hugging. Monkeypox can also spread through touching unwashed clothing or bedding used by a person who has monkeypox.

According to Affordable Clean Energy For All (ACEFA), the price of solar panels has dropped over 70% in the last 20 years since the NEM program was established, but the subsidies they receive continue to rise.

They estimate that customers pay an average of $240 more in electric bills annually than those with solar panels. By 2030, they will pay $540 annually for their electric bills.

Mark Toney, Executive Director of The Utility Reform Network (TURN), shares the same sentiment as the Affordable Clean Energy For All organization.

“What would lower the bills for low-income families, who don't have solar panels is to reduce the subsidy amount for people who do have solar panels,” Toney said.

“Require people who have solar panels to pay their fair share for operating the grid, their fair share for low-income programs, their fair share for wildfire safety, their fair share for just the cost of providing electricity to them at night.”

Toney also discussed finding ways to incentivize people to invest in battery storage.

There is a new recyclable battery made of lithium iron phosphate, and it lasts longer than previous batteries and is cleaner and safer.

Just like the Riverside County Sheriff, Chad Bianco, was ushered into another term by a small percentage of voters in the June primary. The same holds true for San Bernardino County Sheriff Shannon Dicus with one exception.

Riverside County Sheriff Chad Bianco initially came to office as the result of an election–and although I disagreed with the selection, he was chosen by the voters in 2018. Sheriff Dicus however was selected by the county’s previous sheriff and anointed by the San Bernardino County Board of Supervisors–the people did not have a say and he held on to his position as the result of low voter turnout in a non-presidential election year when voter turnout is traditionally abysmal.

Despite popular belief, County Sheriffs are not all powerful. There should be calls for an independent body to investigate in custody deaths in San Bernardino County. This is especially warranted in light of the Sheriff Department’s history of inmate abuse as evidenced by the Torture, Civil Rights violations that led to the department being placed under a Consent Decree in December 2018.

Of course this is just my opinion. I’m keeping it real.

Postscript: Inmates are also dying in Riverside County jails. On Wednesday, August 10, the 8th inmate in recent months was found dead at the Cois Byrd Detention Center in Murrieta.
