ReIgnite Hope Mobile Welding Training Program

H

arbor Hills Public Housing Authority has partnered with the Los Angeles County Development Authority, (LACDA) and Reignite Hope, a local nonprofit to provide job training for public housing residents. The sixteen week program teaches students welding skills in order to prepare them for high paying jobs--at the end of the course they receive welding certification.

Beginnings in Community Service The program began as a way to serve the community and to give assistance to those in need. It developed organically from the outreach provided by Steve Bunyard who is the Outreach Pastor for Rolling Hills Covenant Church who partnered with the Fred Jordan Missions to help the homeless population in the community.

During his work with the unhoused he saw that a need existed to close the skills’ gap that created circumstances which would prevent those in need from overcoming the obstacles to self sufficiency. Bunyard, who had welding skills as the previous owner of a business which sold high performance transmission products, decided to teach welding to five

unhoused men; the program has changed and expanded that initial work.

Reignite Hope From those beginnings, ReIgnite Hope has developed a mobile school to teach welding to those in the community who can’t attend the thirty seat school with state of the art equipment in Gardena, California.

The current partnership with the staff at Harbor Hills Public Housing Authority and LACDA is a natural outgrowth of that work.

According to Supervisor Janice Hahn of the Los Angeles County Board of Supervisors, “The kinds of jobs that require a welding certificate are good, well-paying careers, but they aren’t always easy to access. This is an innovative program that connects our public housing residents directly with in-demand job training.”

Emilio Salas, LACDA Executive Director, said, “We strive to go beyond providing housing, by offering opportunities to empower our residents to reach their full potential. Thanks to the partnership with ReIgnite Hope, our public housing residents can learn a new trade and make a career change, especially after the economic impact left on many families by the COVID-19 pandemic.”

High Court Backs Businesses Challenging California Labor Law Jessica Gresko | Associated Press

T

he Supreme Court on Wednesday sided with California agriculture businesses that objected to a state regulation giving unions access to farm property in order to organize workers.

As a result of the ruling, the businesses’ attorney said California will have to modify or abandon the regulation put in place in 1975 after the efforts of labor leader Cesar Chavez.

The justices ruled 6-3 along ideological lines for the agriculture businesses. It’s another potential setback for unions as a result of a high court decision.

“The access regulation amounts to simple appropriation of private property,” Chief Justice John Roberts wrote for the conservative members of the court. Roberts said the regulation “grants labor organizations a right to invade the growers’ property.”

What Was Lost At issue was a California regulation that allows unions access to farms and other agriculture businesses for up to three hours per day, 120 days per year, in order to organize workers. Businesses are supposed to be notified before organizers arrive, and organizers are supposed to come during nonwork times such as lunch and before and after work.

Two agriculture businesses had challenged the regulation saying it had the effect of taking their property without compensation in violation of the Constitution. The businesses also said the regulation was outdated and unnecessary given that unions can now reach workers in many ways, including via smartphone and radio.

Writing for the majority, Roberts rejected the suggestion that the ruling would “endanger a host of state and federal government activities involving entry onto private property.”

But writing for the three-justice liberal minority, Justice Stephen Breyer said “the majority’s conclusion threatens to make many ordinary forms of regulation unusually complex or impractical.”

Breyer wrote that he would have concluded that California’s regulation did not take anything

but instead “regulates the employers’ right to exclude others.”

Breyer noted the “large numbers of ordinary regulations” that permit the temporary entry onto a property owner’s land. That includes entry for inspections ranging from food product safety like meat and dairy facility inspections to the inspections of nursing homes, preschools and foster care facilities.

“I suspect that the majority has substituted a new, complex legal scheme for a comparatively simpler old one,” he wrote.

Another Setback for Unions The ruling is the latest hit to unions by the court under Roberts. In 2018, the court’s conservative majority overturned a 41-year-old pro-union decision that had allowed states to require that public employees pay some fees to unions that represent them, even if the workers choose not to join.

Still, it’s unclear how much will change as a result of the court’s ruling.

The access regulation in particular is unique to California. And the state had said that union organizers use the regulation “sparingly” — only five times in the 2019-2020 budget year and 24 times in 2018-2019. Still, the United Farmworkers of America told the justices that the regulation is more necessary now than ever.

The union said farmworkers are increasingly indigenous workers from Mexico and the only effective way to communicate with them is in person at their job sites.

In court documents filed before President Joe Biden took office, the Trump administration had urged the justices to side with the businesses.

The Biden administration later changed the government’s position.

The case the justices ruled involved Fowler Packing Company in Fresno, which ships grapes and citrus, and Cedar Point Nursery in Dorris, which grows strawberry plants for commercial growers.

San Bernardino Welcomes Omnitrans’ First All ElectricPowered Buses

mnitrans introduced its first four 100 percent electric-powered buses into service last week.

The buses were partly funded by Volkswagen Environmental Mitigation Trust and Carl Moyer Program grants.

As the largest transit operator in San Bernardino County, Omnitrans’ efforts to reduce emissions are expected to significantly improve air quality in the region.

Over the past 10 years, there has been a slight worsening in air quality in San Bernardino, according to the 2019 Environmental Indicators Report released by San Bernardino County. The emissions from cars and buses contribute to the increasing poor air quality in the county.

Additionally, diesel trucks travelling to and from a disproportionately high number of distribution centers in San Bernardino and Riverside Counties are also main sources of air pollution, according to a report written by the People’s Collective for Environmental Justice.

According to the American Lung Association, San Bernardino is ranked first on its list of the most polluted counties for ozone pollution and sixth for year-round particle pollution.

Omnitrans began their plan to reduce emissions in 2002 when they

introduced the nation’s first gasoline electric-hybrid transit buses. By 2009, Omnitrans’ fleet was 100% alternatively-fueled by compressed natural gas, an eco-friendly alternative to gasoline. The agency’s goal is to have a fleet that is entirely composed of 100 percent zero-emissions buses by 2040, as required by the California Air Resources Board (CARB) regulations.

“Since we introduced the nation’s first hybrid-electric transit bus in 2002, Omnitrans has prioritized enhancing air quality in our region,” said CEO/General Manager Erin Rogers. “Operating our first zero-emissions vehicles is an exciting step toward meeting our state’s clean air goals.”

CARB instituted the clean air goals for buses in 2018 under the Innovative Clean Transit regulation in an effort to reduce emissions by the transportation division. According to CARB, the transportation sector accounts for 40 percent of climate-changing gas emissions and between 80 and 90 percent of smog-forming pollutants.

Omnitrans’ fleet of buses has operated on compressed natural gas for more than a decade, which produces .2 grams of ozone-producing nitrogen oxide emissions (NOx) per brake horsepower hour (bhp). Currently, more continued on page 13

Watchdog: Nursing Home Deaths Up 32 Percent in 2020 Amid Pandemic Ricardo Alonso-Zaldivar | Associated Press

eaths among Medicare patients in nursing homes soared by 32 percent last year, with two devastating spikes eight months apart, a government watchdog reported Tuesday in the most comprehensive look yet at the ravages of COVID-19 among its most vulnerable victims.

The report from the inspector general of the Department of Health and Human Services found that about 4 in 10 Medicare recipients in nursing homes had or likely had COVID-19 in 2020, and that deaths overall jumped by 169,291 from the previous year, before the coronavirus appeared.

“We knew this was going to be bad, but I don’t think even those of us who work in this area thought it was going to be this bad,” said Harvard health policy professor David Grabowski, a nationally recognized expert on long-term care, who reviewed the report for The Associated Press.

“This was not individuals who were going to die anyway,” Grabowski added. “We are talking about a really big number of excess deaths.”

Investigators used a generally accepted method of estimating “excess” deaths in a group of people after a calamitous event. It did not involve examining individual death certificates of Medicare patients but comparing overall deaths among those in nursing homes to levels recorded the previous year. The technique was used to estimate deaths in Puerto Rico after Hurricane Maria in 2017 and in New York City after the first coronavirus surge last spring. It does not attribute a cause of death but is seen as a barometer of impact.

Death rates were higher in every month last year when compared with 2019. The report documented two spikes with particular implications for government policy and for protecting the most vulnerable in future outbreaks of life-threatening illnesses. In April of last year, a total of 81,484 Medicare patients in nursing homes died. Then eight months later, after lockdowns and frantic efforts to expand testing — but before vaccines became widely

available — nursing home patients accounted for a staggering 74,299 deaths in December.

“This is happening long after it was clear that nursing homes were particularly vulnerable,” said Nancy Harrison, a deputy regional inspector general who worked on the report.

“We really have to look at that. Why did they remain so vulnerable?” Federal investigators are still drilling down to try to document the chain of causes and effects.

Centers for Medicare and Medicaid Services Respond Responding to the report, the Centers for Medicare and Medicaid Services said that nearly 80% of nursing home residents and more than 55% of staff are now vaccinated, and the agency is working to protect health and safety. CMS sets standards for nursing homes.

The two main nursing industry groups, the American Health Care Association and LeadingAge, said the grim statistics reflect the consequences of society and government not placing a high enough priority on the needs of frail elders. That “showed once again how ageism can result in policies that treat older people as expendable,” said Katie Smith Sloan, president of LeadingAge, which represents nonprofit homes.

Tuesday’s report was the most comprehensive yet from the government because it included statistics for the early part of last year, during the initial coronavirus surge. Medicare did not require nursing homes to report COVID-19 cases and deaths occurring before May 8, more than four months into the pandemic year.

overnor Newsom and legislators announced an extension proposal on Friday, with a final vote taking place on June 28. The proposal, AB 832, will extend the current eviction moratorium until September 30, 2021. The extension is supposed to ensure that California uses the $5.2 billion in rental assistance to cover past due rent and overdue utility costs.

AB 832 increases rental assistance payments to give 100 percent of rent owed for eligible landlords and tenants. Under the current SB 91 framework, landlords received 80 percent of rent owed and were required to forgive 20 percent; if a landlord did not want to forgive the 20 percent, only 25 percent of the past due rent was paid for tenants who applied. Under AB 832, applicants who already applied/received funds will automatically get the additional funds to cover 100 percent of rent owed, including tenants who previously paid 25 percent.

The previous agreement under the initial rental moratorium offered 80 percent of back rent being paid in exchange for 20 percent forgiveness if landlords agreed. If not, tenants only receive 25 percent if landlords do not participate in the program.

“Now that Governor Newsom has pledged to cover 100 percent of debt, this glaring imbalance can hopefully improve, but we remain concerned that landlords will still be allowed to harass and evict tenants while still claiming 100 percent of that compensation,” said Shanti Singh, Communications & Legislative Director of Tenants Together, California’s statewide organization for renters’ rights. “The protections in place have not been a true ‘moratorium’ and many Californians are still being evicted formally and informally (locked out, harassed, or intimidated into leaving).”

The announcement of the new proposed eviction extension comes just days before the previous deadline of June 30 was set to lapse. Renters and home-owners have accrued large amounts of debt due to the consequences of the pandemic. According to data from the Census Household Pulse Survey, an estimated 5,757,000 households are behind on rent and rent debt is estimated at $19,285,700,000 across the U.S. Although California officially reopened on June 15, many renters and homeowners are still behind on both rent and utility payments.

“Even though our state has reopened, hundreds of thousands of Californians are grappling with rental debt and the threat of eviction.

Removing eviction protections now, while billions of rent relief dollars are still available, would be a disaster and exacerbate our homelessness crisis,” said Assemblymember David Chiu (D-San Francisco), Chair of the Assembly Housing and Community Development Committee. “This proposal avoids a massive eviction cliff, allowing us to keep tenants in their homes and get landlords the financial support they need.”

In addition to the eviction moratorium extension, the Emergency

Customer Protections implemented by the California Public Utilities Commission (CPUC) have also been extended until September 30, 2021.

“This provides time for energy utilities to notify customers of a new CPUC solution to resolving COVID-19 era utility bill debt, which provides residential customers two years over which to pay off deferred energy bills, with help anticipated to become available in the California state budget. Similar relief was ordered for small businesses,” according to a CPUC press release.

Tenant’s rights associations such as Tenants Together believed that an extension was forthcoming, but not likely that it would be extended for the necessary period of time. Landlord associations oppose a longterm extension. Rather, they demand that the current funds that have been earmarked for rental assistance be disbursed quicker to reduce the burden on landlords.

“We are disappointed that the CDC extended a nationwide eviction moratorium through July, and the state of California has extended an eviction moratorium through September,” said Tom Bannon, chief executive officer of the California Apartment Association. “Both the federal and state eviction moratoriums would not be necessary if state and local governments were disbursing rental assistance funds to tenants and housing providers in an expedited manner.”

No Apology: Tavis Smiley Makes Comeback Bid After PBS Firing Lynn Elber | Associated Press

T

hree years after workplace misconduct allegations cost veteran TV and radio talk-show host Tavis Smiley his job and a national forum, he’s ending his silence.

Smiley, who continues to deny the claims of unwanted sexual behavior that led PBS to drop his long-running show, is attempting to rebound with the purchase of a Los Angeles radio station that will offer a Black and progressive perspective on the city and nation.

Sidelined during a period of landmark racial upheaval, Smiley decided to make his own opportunity with reformatted station KBLA 1580 Los Angeles. It debuted with a preview on Saturday, the Juneteenth holiday commemorating when the last enslaved African Americans learned they were free.

“While I was watching this racial reckoning last summer, it was so clear to me that people were being heard to some degree, but there were no African American-owned platforms where people had their voice on a regular basis,” Smiley said. The media can lose interest when protests stop, he said, but the issues “that matter to us don’t go away.”

He was also chafing at the isolation “It’s frustrating when you’re used to being on the air every day somewhere, (and) people are hearing your voice in this country, seeing your face, for as many years I’ve been doing this,” he told The Associated Press. But there was an upside: introspection, and “a lot” of it, as he put it.

“It allows for growth. It allows for strengthening relationships with family and friends,” Smiley said.

“So in some ways, I think I’m probably a different person than I was four years ago.”

He did not reevaluate his workplace behavior because there was no cause to, he said, and again rejected any allegations of misconduct. After losing in court last year in a breach-of-contract suit over his firing, he’s appealing the verdict that required about a $1.5 million payment from Smiley to PBS, which countersued him.

“I have no idea why what happened to me happened,” he said. “This Me Too moment happened at a time and in a way where it was very difficult, almost impossible, to put forth any other narrative, no matter how truthful that narrative was.”

Accusations of harassment While acknowledging what he called “consensual” dates with co-workers before he joined PBS, “I have never harassed anyone,” Smiley said. He alleged that the public TV service reached back into his work past to find claims of misbehavior that he called false, and

labeled the investigation sloppy and biased.

In its court filings, PBS cited witnesses’ allegations that Smiley subjected subordinates to lewd language and unwanted sexual advances and encounters, with six women describing misconduct claims in court testimony. The women have not been publicly identified.

“Let me be very clear: I support the Me Too movement” and covered women’s rights issues for years on his shows, he said. “I will not let you falsely accuse me of anything, and win, lose or draw, my name and my integrity is all I have.”

Asked for comment, PBS referred to its statement last year following the jury’s verdict, which said in part that “PBS expects our producing partners to provide a workplace where people feel safe and are treated with dignity and respect.”

The allegations were made about a groundbreaking radio and TV host, the first African American to get his own talk show on PBS. He said he’s received offers of work since his firing, but decided to amplify Black voices in America through a path that his late friend, Prince, touted: Controlling content and its distribution.

Black-owned and -operated talk radio station Smiley is the majority owner of KBLA, which he and investment partners bought from New Yorkbased Multicultural Radio Broadcasting in a deal valued at $7.5 million. The station will fill a void that he said shouldn’t exist in one of the most, if not the most, ethnically and culturally diverse city in the country.

“The opportunity to have a Black-owned and Black-operated talk radio station in this city, where talk radio for too long has been all day, all night, all white, is an opportunity that is begging for someone to take advantage of it. So I’m dumb enough to try,” Smiley said.

Asked if anyone has expressed reservations about

working with him and the station, he said it was the contrary and that bookings for celebrities, authors and newsmakers are “lining up fast and furious.”

Among the hosts: DL Hughley, whose nationally syndicated radio show is part of the KBLA afternoon lineup, and Alonzo Bodden, a winner of NBC’s “Last Comic Standing” and regular guest on NPR’s “Wait Wait…Don’t Tell Me.” The Mississippi-born, Indiana-raised broadcaster said KBLA, with a signal reaching nearly 12 million Southern California listeners, could be the flagship for an eventual nationwide network. “The station doesn’t have an agenda except to be unapologetically progressive,” he said. “We just want to be a voice for those who have been voiceless for too long in this city, speak a truth that is otherwise not being considered if we don’t speak it, and give people a chance literally just to be heard.”

Smiley’s definition of “progressive” His definition of a progressive: Someone whose life and behavior “underscores that you want the same thing for everybody else’s child that you want for your own child.”

He’s in charge of the radio enterprise but not its star, said Smiley, who headlined shows on BET and National Public Radio before hosting “Tavis Smiley” on PBS from 2004 until his December 2017 firing.

“This is not about Tavis Smiley. I’m only on (weekdays) three hours a day,” he said. “We are live 24 hours a day, seven days a week. ... So there are a lot of other voices on the station that will be talking about a lot” of local, national and international issues.

Nitrogen Dioxide (NO2) is one of a group of highly reactive gases known as oxides of nitrogen or nitrogen oxides (NOx). NO2 primarily gets in the air from the burning of fuel. NO2 forms from emissions from cars, trucks and buses, power plants and off-road equipment, according to the Environmental Protection Agency (EPA).

NO2 along with other NOx reacts with other chemicals in the air to form both particulate matter and ozone. Both of these are also harmful when inhaled due to effects on the respiratory system and can lead to asthma and other respiratory conditions.

Omnitrans’ new buses are a step forward in mitigating health risks related to poor air quality in San Bernardino County. To monitor air quality across different cities, the EPA developed the Air Quality Index, or AQI, to make information available about the health effects of the five most common air pollutants. The public can view the air quality in their community by visiting airnow.gov and entering their zip code, city or state to check the air quality for a day, week or month and to follow the air quality trends in their area. .

Air quality is measured across five Air Quality Index categories–from “good” to “very unhealthy.” The AQI noted for 2019 that the median Air Quality Index value, which accounts for all daily AQI readings in a given year, was higher in San Bernardino County in 2019 compared to Riverside County, Los Angeles County and San Diego County to name a few.

that cases and deaths among Asian American patients tracked with the more severe impacts seen among Blacks and Latinos. Indeed, Asian Medicare enrollees in nursing homes saw the highest increase in death rates, with 27% dying in 2020 compared to 17% the previous year. For whites, the death rate grew to 24% in 2020 from 18% in 2019, a significant increase but not as pronounced.

Death rates for Hispanic and Black patients were 23% last year, up from 15% in 2019.

The inspector general’s office based its analysis on Medicare billing data. It also included patients in Medicare Advantage plans sold by private insurers. Although Medicare does not cover long-term care, the vast majority of nursing home patients are elderly, and Medicare does cover their medical needs. The report included both patients who live in nursing homes as well as those temporarily at a facility for rehabilitation.

Health Economist Comments Health economist Tamara Konetzka of the University of Chicago, who also reviewed the report for AP, said building an estimate from individual death certificates would have faced another set of challenges. Especially in the first wave of the pandemic, many who died would not necessarily have been tested for COVID-19, for example.

“By looking at excess deaths you can get away from some of the measurement issues and say how much worse things were in 2020 than in 2019,” explained Konetzka, who has testified before Congress on the impact of COVID-19 in nursing homes.

The inspector general’s findings about Asians highlight a riddle for researchers, said Konetzka. The reasons for higher cases and deaths among Blacks, Hispanics and Asians may not necessarily be tied to race and ethnicity.

Instead, minority patients may be clustered in

homes located in communities with more severe outbreaks.

Low Income Nursing Homes Experienced Greatest COVID-19 Impacts The report also found that low-income nursing home patients covered by Medicare and Medicaid together were much more likely to have gotten COVID-19. The infection rate for that group reached 56%, and 26% died.

Some states suffered worse impacts. By the end of December more than half of the Medicare patients in nursing homes in Connecticut, Illinois, Louisiana and New Jersey had or likely had COVID-19.

has been normalized and in each instance, the initial decision about a replacement was taken out of the hands of the voters and made by the county supervisors.

This provides a great advantage for those favored with such appointments. The appointees garner media attention, name recognition and opportunities for fundraising, all of which make them a shoe in by the time the first official election rolls around for them to earn the seat competitively at the ballot. By then of course, they have a definite advantage over any competitor.

This worked like a charm when former Sheriff Rod Hoops ran for re-election and then suddenly decided to retire mid-term and recommended McMahon to replace him. The very same strategy had worked like a charm when former Sheriff Gary Penrod retired in the middle of his term after being reelected. He, of course, recommended Hoops to replace him.

What a scheme! Or is it merely a convenient series of fortunate circumstances for those involved?

I think not...

As discomforting as this is for many, it is well within the clearly defined menu of options available to the Board of Supervisors. As explained by county spokesperson David Wert, “Due to the requirements of the County Charter and State law, the only

available date for a special election in this case would be June 7, 2022, which as you pointed out is also the date of the next regularly scheduled election for sheriff. Under the charter, if the board does not call a special election or appoint someone to serve out the unexpired term within 60 days of the vacancy, the default is the special election option, again taking it to June 7, 2022.”

Wert further explained why the date ‘June 7, 2022.’ As he highlighted, “Plans for an election could not be made until July 16 at the earliest because that’s when the vacancy is expected to occur.

According to the charter and the State Elections Code, the special election would be held on the next established election date—a random date is not an option—that is no less than 130 days from the date that the election is called.

The charter also states if the date of a special election would be less than 180 days from the statewide primary election—which is also Election Day for county offices—the county must proceed with the regularly scheduled election.

As further explained by Wert, the next three established election dates are August, 31, 2021; November 2, 2021; and April 12, 2022. August 31, 2021, and November 2, 2021. All would be less than 130 days from the date the election could be called.

In addition, April 12, 2022, is greater than 130 days from the vacancy but less than 180 days from the Statewide Primary election. This takes us to June 7, 2022, as the first possible date for a special election, which is the regularly scheduled date for the sheriff election. As you can see, the table is legally set for this to occur in perpetuity unless the charter is revised.

When it comes to replacing sheriffs in San Bernardino County, timing is truly everything.

Unless the public rallies for change White men may continue to ride roughshod over a county where most residents are people of color.

In the final analysis however, it is less about the color of the sheriff than it is about the mindset of those given the advantage of being appointed to the office. If it is true that weak leaders breed weak leaders, I believe the same holds true for sheriffs.

Those who allow disparate and abhorrent treatment of segments of the county’s population are certain to breed replacements who are prone to do the same.

Now that we know the rules of the game, it is time for the citizens to change them.

Of course, this is just my opinion. I’m keeping it real.

Rolling Hills Covenant Church has been providing services to the residents at Harbor Hills for decades, including food and tutoring programs.
