W

hen a societal and institutional reckoning on policing was called to the fore in the wake of George Floyd’s unconscionable murder a year ago, few, if any, communities across the nation had clean hands when it came to the all too frequent use of excessive force by police against Blacks and other people of color, including right here in the inland region.

Calls for changes in policing is a long simmering issue, refueled each time another Black body lies in the street of some “baseball and apple pie” American city.

After each single event that manages to garner national attention—among the thousands that occur across the country every year, the push for change burns bright and then fades to a simmer before turning to ash like traditional fireworks on the 4th of July, that is, until another, highly publicized occurrence ignites another call to action.

What should not be forgotten however is outside the media spotlight, when the nation moves on to the next thing, the push for change in communities like the inland region never completely falls away, people continue working to transform the process.

Meanwhile, whenever the pressure for change gets too intense—as it did in the wake of Floyd’s murder, elected officials and others in power contrive to say the right things, offer just enough nuance to forestall any meaningful action. All the while, aggressively pushing against any meaningful,

substantive changes. Their resistance is bolstered by police unions with deep pockets.

Even in those breakthrough moments when changes do occur around the edges, like with body worn cameras for example, the rules are nebulous, and police agencies freely opt out.

The bottom line of my argument is, everyone knows that from the time of “slave catchers” and “paddy rollers” to the birth of the Ku Klux Klan where police wore badges by day and robes by night; to today where some members of police agencies are accused of trading uniforms for MAGA hats when not on duty—those sworn to protect us too often place their hatred and desire for total control above all else, including Black lives or any life for that matter, that threatens their “will to power.” Nothing changes, not even their badges—what a legacy!

I criticize the actions of these individuals without equivocation and to those who would say, “It is only a few bad apples, and I should qualify my criticism by saying something like, ‘Of course, this is not true of all police.’ I respond, “That, of course, is a given. Just as clearly as it should be a given, that not all Black people are criminals. So, why do police and deputies so often treat us like we are?”

Blacks are stopped more, injured by police more, killed more, arrested more, charged with more crimes, charged higher bail, convicted more, sentenced longer, given the death penalty more continued on page 14

Black Voice News Recognized During Ethnic Media Awards Event for 2020 Reporting Staff | thnic Media Services (EMS) in partnership with the California Black Media (CBM) sponsored the multilingual California Ethnic Media Awards presentation on Thursday, June 3 for outstanding reporting in 2020.

Event organizers reported there were 230 entries, and more than half were in languages other than English. From this pool, judges with “in-language” and “in-culture” fluency selected 20 winners in seven categories.

“The pandemic made 2020 the most challenging year for ethnic media and the awards are an opportunity to recognize the entire sector for its dedication to informing audiences against the odds,” said Regina Brown Wilson, California Black Media’s Executive Director.

The awards’ categories highlighted a wide range of 2020 news developments encompassing everything from COVID-19 and the economic downturn to the epic movements for racial justice, the 2020 election, and immigration reform.

Stressing the significance of contributions made by ethnic media, EMS Director Sandy Close declared, “The ethnic media awards spotlight the people who produce a parallel universe of news largely invisible to general market media but indispensable for communicating with our diverse society.”

Congratulations to all California Ethnic Media 2020 Award winners including members of the 2020 Black Voice News team, Mariah Brown, Chuck Bibbs, and Stephanie Williams.

Omnitrans Board Elects New Leadership

T

he Omnitrans Board of Directors has elected current Vice Chair and Mayor of Montclair Javier “John” Dutrey to serve as the agency’s Chair, and current Board Member and Mayor of Grand Terrace Darcy McNaboe to the position of Vice Chair. They will assume their new roles for two years beginning July 1.

Omnitrans provides public transportation to 15 cities and parts of the unincorporated areas of San Bernardino County.

After the Omnitrans Board reached its appointment decisions this week, CEO/General Manager Erin Rogers stated, “Both John and Darcy have a lengthy history of dedication to and support of Omnitrans. As we emerge from a challenging year, I look forward to partnering with the Board under their leadership to provide innovative mobility solutions to connect our region.”

Dutrey, who has served as an Omnitrans Board alternate since 2003 and has been an active member since 2017. He was first elected to the Montclair City Council in 1996. His professional career included public and private sector work in real estate, urban planning, economic development and affordable housing.

McNaboe also has an impressive record of public service having served on the Grand Terrace City Council since 2010. A nearly three-year veteran of the Omnitrans Board, she is also principal and founder of Village Enterprises, a local business and marketing firm.

In addition, McNaboe represents the Inland Empire Community Foundation as a Charitable Giving Officer, is Director of the California Joint Powers Insurance Authority, is an SBCTA Board Member, and is past president of the La Sierra Business Council of the Greater Riverside Chamber of Commerce.

Commenting on her election McNaboe said, “Omnitrans has ambitious goals for the year ahead, and I look forward to working with its team to achieve success and enhance the quality of life in our region.”

New Faces Enter Fray as California Recall Slowly Takes Shape

ix weeks after California officials announced that Democratic Gov. Gavin Newsom would face an almost certain recall election that could drive him from office, the contest continues to be roiled by uncertainty and questions – even the date when it might take place remains unclear.

The list of Republican challengers who have signaled an intention to enter the race is about to top 20, though no consensus front-runner has emerged. State Assemblyman Kevin Kiley this week became the latest to announce he is considering stepping in.

Newsom, meanwhile, has regained his footing after seeing his popularity fall at the start of the year amid the worst of the pandemic and criticism over his COVID restrictions for the public and businesses.

The first-term governor has since benefited from a sharp decline in cases during the spring and a record-breaking surplus that allows him to bestow billions on favored projects and issues.

Still, just last week he faced another round of criticism for saying he

planned to keep an emergency declaration in place even after the state fully reopens its economy next Tuesday. “There’s uncertainty in the future,” he warned.

Why Keep the Emergency Declaration in Place The declaration means California can be reimbursed from the federal government for many of its pandemic-related expenses. But it also gives Newsom the authority to suspend state laws and impose new rules. Since declaring this emergency, Newsom has issued at least 58 executive orders to alter or suspend hundreds of laws because of the virus.

Recent polling suggests Newsom would beat back the recall; a Republican hasn’t won a statewide race in heavily Democratic California since 2006. But those same surveys reveal signs of an unsettled public: independent voters, for example, tend to view his job performance

On the Frontline: How Gig Workers Struggled and Survived the Pandemic

mid the coronavirus pandemic, gig work became increasingly crucial to the various facets of the economic systems of America and the world.

Gig workers were an important lifeline to many vulnerable residents and high risk individuals who were confined to their homes and depended on these frontline workers to deliver meals, groceries and other items throughout the pandemic.

Chinasa Agu, a Black 23-year-old Riverside resident, who worked as a gig worker or “tasker” for both Instacart and Postmates said surviving economically as a gig worker full-time during the pandemic was almost impossible.

“You could work for hours on end for days in a row but if you’re consistently getting low paying jobs you might walk away with significantly less than what a consistent job would pay,” she stated.

A fifth year student at UC Riverside, Agu turned to gig working after being laid off from her job as a student assistant on UCR’s campus.

“It’s something I never expected, obviously,” stated Agu. “It [was]

definitely a pay cut from what I was making because the work is less consistent. Even if I put in the same hours, the dollar amount I end up with fluctuates.”

Once used in reference to musicians’ booking shows, the definition of gig work has been rewritten by tech startups offering quick money per task completed rather than on an hourly or annual basis. In 2019, gig work generated about $1.4 trillion in the U.S., according to Craig J. Lewis, Founder and CEO of Gig Wage. But, for workers like Agu, that revenue does not trickle down.

Beyond the risk of the virus they exposed themselves to as essential workers, some, like Agu, had other searing concerns about their safety in general--she explained.

“There’s an inherent fear to go into predominantly White neighborhoods to deliver.” Agu referenced the murder of Ahmaud Arbery, saying he was “murdered because White people with supremacist ideals didn’t want to see Black people in their ‘untouched’ neighborhood.” continued on page 13

Advancement Initiative Launched in Support of STEM at HBCUs

T

he Silicon Valley Community Foundation announced that it has invested two million dollars in the new “Advancement Initiative,” a fund that invests in pre-initial public offering (IPO) startups and donates 50 percent of its carried interest directly to Historically Black Colleges and Universities (HBCUs) to create student scholarships and support university endowments.

The Advancement Initiative was created by venture firm Base10 Partners to align the success of technology companies with wealth creation for underrepresented communities.

The initiative starts with a Base10 Growth Fund and leads to Base10 investing in pre-IPO companies and then donating 50 percent of those returns to HBCUs. The expected outcomes are to fund scholarships for minority students, deepen tech diversity and find the next generation of $1B founders, according to Base10.

“We have been thinking about where to focus Base10’s efforts to do more good through strategic investments, and we believe supporting HBCUs is the most effective way for us to augment underrepresented minority talent in Silicon Valley,” said Ade Ajao, co-founder and Managing Partner of Base10.

As the Silicon Valley Community Foundation contributes to the initiative, they join efforts to develop a more diverse workforce among the tech world, and that endeavor begins with supporting HBCUs who historically award nearly half of all science, technology, engineering and mathematics (STEM) degrees to Black students. Yet, all 107 HBCU endowments combined are equal to just seven percent of Stanford University’s endowment. Notably, about one-third of the student population at HBCUs comes from households below the poverty line.

According to an analysis of the 2015-16 School Year by the U.S. Government Accountability Office, HBCUs have $15,000 on average in

endowment per student. Comparable, non-HBCUs have $410,000 on average in endowment per student.

“Base10’s unique approach to improving workforce diversity and inclusion through its Advancement Initiative will bolster the endowments of HBCUs and provide more opportunity to deserving students. That, in turn, will build a more diverse workforce over the long term, and give more people equitable opportunities to thrive,” said Nicole Taylor, President and CEO of Silicon Valley Community Foundation. “We are proud to partner with Base10 to help realize that goal.”

The Silicon Valley Community Foundation was established in 2007 and is the largest community foundation in the U.S. Taylor earned the role of CEO in 2018 and has since worked to restore the organization’s focus on how to serve the communities of San Mateo and Santa Clara counties.

Silicon Valley Community Foundation’s investment is being made from its own endowment, which currently commits $132 million to diverse managers. This investment reinforces the community foundation’s work prioritizing racial equity, which includes other initiatives committed to diversity and inclusion—such as the California Black Freedom Fund, a $100 million initiative to support capacity building for Black-led organizations in the state over the next five years.

“In Silicon Valley, workforce diversity, equity and inclusion are serious structural challenges that must be addressed. At Silicon Valley Community Foundation, we believe that we build stronger communities by investing in leaders of color and their organizations,” said Taylor.

San Bernardino District Attorney Disputes with Newsom’s Order

he grave doubts about Mr. Cooper’s guilt have only worsened over time, with a federal judge who reviewed his case in 2009 concluding that ‘he is probably innocent,’ and more recently, DNA testing on a towel connected to the crime pointing to another person. Additionally, multiple witnesses have come forward who argue that another man has confessed to the crime and implicated two accomplices,” wrote the National Association of Colored People Legal Defense Fund (NAACP LDF) in an Innocence Appeal to California Governor Gavin Newsom in March.

In response on Monday, May 28, California Governor Gavin Newsom signed a long-awaited executive order launching an independent investigation into the case involving death row inmate Kevin Cooper, The action was taken as part of the governor’s evaluation process as he considers Cooper’s application for clemency.

As explained by the governor’s office, the investigation will review trial and appellate

records in the case, the facts underlying the conviction, and all available evidence, including the results of the recently conducted DNA tests previously ordered by the governor to examine additional evidence using the latest, most scientifically reliable forensic testing.

Kevin Cooper was convicted and sentenced to death for a triple murder that resulted in the deaths of Doug, Peggy, and Jessica Ryen, Christopher Hughes, and the attempted murder of Josh Ryen in their Chino Hills home in June 1983.

The San Bernardino County District Attorney Jason Anderson adamantly disagrees with the governor’s decision to further investigate the Kevin Cooper conviction by referring it to a special counsel. He claims, “We are not aware of any authority that allows for a review outside of the judicial branch of a capital case wherein every judicial actor with decision making authority for the past 38 years has determined that Kevin Cooper is guilty of the murders.”

Anderson added, “The Executive Branch is not free to ignore the outcomes of numerous prior judicial reviews.”

Well before the governor’s recent decision to proceed with the special investigation, In a letter to Newsom in March, Anderson in painstaking detail, provided his own qualifications and experience as a former defense attorney who has represented clients charged with heinous crimes expressed his belief, the case is settled. He offered his reasons for dismissing the innocence claims regarding Cooper, declared the new DNA results do not exonerate Cooper, disputed assertions made by the NAACP in defense of Cooper, and aligned himself with previous decisions in every step of Cooper’s criminal justice process who have agreed again and over again in the long years since the murders and conviction that Cooper is guilty of the murders as charged and convicted.

These clemency grants are intended to recognize the applicants’ subsequent efforts in self-development or the existence of a medical necessity. They do not forgive or minimize the harm caused.

When Newsom announced his decision to move forward with an independent investigation, his office said the governor, “Regards clemency as an important part of the criminal justice system that can incentivize accountability and rehabilitation, increase public safety by removing counterproductive barriers to successful reentry, correct unjust results in the legal system and address the health needs of incarcerated people with high medical risks.”

There are distinctions between the three executive clemency options available to the governor as follows: Pardons A pardon may remove counterproductive barriers to employment and public service, restore civic rights and responsibilities and prevent unjust collateral consequences of conviction, such as deportation and permanent family separation. A pardon does not expunge or erase a conviction.

Commutations A commutation modifies a sentence, making an incarcerated person eligible for an earlier release or allowing them to go before the Board of Parole Hearings for a hearing at which parole commissioners determine whether the individual is suitable for release.

Reprieve A reprieve allows individuals classified by the California Department of Corrections and Rehabilitation as high medical risk to serve their sentences in appropriate alternative placements in the community consistent with public health and public safety.

Officials further stressed how the governor weighs a variety of factors in his review of clemency applications including an applicant’s self-development and conduct since the offense.

He also considers whether the grant is consistent with public safety and in the interest of justice.

In addition, he considers the impact a grant can have on the community, crime victims and survivors.

NAACP Weighs In “Mr. Cooper is a Black man who has served over 35 years on death row, notwithstanding serious concerns about the integrity of the state’s case and the risk that it was marred by racial discrimination,” stated the NAACP LDF. In a letter dated March 11, 2021, the NAACP encouraged the governor to authorize the “innocence investigation,” based on what it called increasing evidence about Cooper’s guilt and questioned the possible impartiality of the investigation and prosecution of the case.

Cooper has never faltered in his declaration of innocence and has accused law enforcement of not only planting evidence but also selectively ignoring witness statements that might cast doubt on his guilt.

He has lost more than a dozen appeals and was scheduled to be executed in 2004 but received a last-minute stay by the 9th Circuit Court of Appeals.

Cooper’s attorneys insist the San Bernardino County Sheriff’s Department destroyed and/ or suppressed evidence which suggested the attackers were three White men.

The Witness The surviving witness in the case Joshua Ryen, who was only eight years old at the time, initially said the killers were three White men, but an hour or so later he purportedly said maybe the three men were Hispanic.

skeptically and most say the state is going in the wrong direction.

Meanwhile, many voters say they are not paying much attention to the unfolding race, leaving open questions about which way they might turn. The slow push to reopen public schools, an emerging drought that is drying up reservoirs and streams, and the looming wildfire season all pose risks for the incumbent, who was elected in a 2018 landslide.

No Clear Republican Challenger With Kiley’s potential entry into the race, it signals that many Republicans remain underwhelmed with the field so far, which includes businessman John Cox, who Newsom defeated in 2018, former San Diego Mayor Kevin Faulconer and reality TV personality and 1976 Olympic decathlon champion Caitlyn Jenner.

Kiley, who is 36 and represents suburbs east of Sacramento, has been one of Newsom’s chief critics in the state capital during the pandemic.

Though little known to a broad swath of voters, he is a hero of sorts among the recall’s most fervent organizers and volunteers.

He sued to stop Newsom’s use of broad emergency powers during the pandemic. A state Superior Court ruled in favor of Kiley, but an appeals court overturned that ruling in May. Kiley and fellow Republican Assemblyman James Gallagher plan to appeal to the state Supreme Court.

Earlier this year he released a book called “Recall Newsom: The Case Against America’s Most Corrupt Governor,” and he spoke at dozens of recall rallies and events during the signature-gathering process.

The recall’s chief organizer, Orrin Heatlie, is informally advising Kiley as he ponders a candidacy and said he’s hearing a lot of frustration about the current field, but declined to give specifics.

Heatlie said his assistance to Kiley is being done outside of his role with the recall committee, which is barred from coordinating with a candidate.

“With the lawsuit that he had against the governor, he’s gained a lot of notoriety and he’s gotten a lot of attention,” said Heatlie, a former sheriff’s sergeant who filed the recall petition and led the volunteer signaturecollection drive.

Kiley said he has no timeline for deciding when to run and declined to criticize any of the Republican candidates, saying they all share the goal of getting a majority of Californians to support recalling Newsom.

He said he sees opportunity to appeal to many voters by pointing out California’s failures in dealing with the homeless crisis and poverty, high taxes and that under Newsom public school classrooms remained closed through most of the pandemic — all familiar themes for the leading GOP candidates.

Some Say Recall Process Burdensome Part of the unsettled landscape around the expected election is the result of the state’s time-consuming rules for placing a recall on the ballot.

State officials announced in late April that recall organizers had gathered more than the necessary 1.6 million petition signatures to place the election on the ballot, following a preliminary count. That kicked off a lengthy review process.

Even now, it’s possible it could take another two months before the recall is certified for the ballot, following various required state financial reviews. Under that scenario, it would push the election into at least October. But given wiggle room in the law, and the potential for more quickly concluding those reviews, that date could come sooner.

In February 2020, Arbery, a 25-year-old Black man was shot to death by three White men as he jogged through their neighborhood--they thought he looked suspicious.

For many taskers of color, like Agu, this fear is real; yet, they face it because they need to work. They need the income to survive.

The flexibility of gig work is attractive Gig positions are attractive for the flexibility and “self-management” aspects inherent to the position. Perhaps, this is partly why many Blacks turned to gig work during the pandemic. Data cited by the Bureau of Labor Statistics offered some additional insight regarding why.

Black Americans were more likely to lose jobs or income as a result of the Coronavirus’ hold on the economy. Economists call the Black employment experience “last hired, first fired” to showcase how Black people are likely to lose work earlier than their peers, in the process, this probably resulted in a higher percentage of Black workers joining the gig economy.

Black Americans also worried more about the financial toll from the pandemic than their White counterparts. Those worries were justified.

In 2019, the wealth of White households was 7.8 times that of the typical Black household and by the end of the second quarter 2020 as the virus raged, its disparate impact on the economic viability of Black households was evident.

White households accounted for 60 percent of the U.S. population and held 84 percent of total household wealth in the nation, compared to Blacks who were 13.4 percent of the population yet accounted for barely four percent of America’s household wealth.

“We need to recognize that unless we are okay with Black and Brown families always bearing the burden of these sorts of things, we need to address the underlying disparities,” declared Valerie Wilson, an economist at the Economic Policy Institute told the New York Times.

A 2018 research poll showed 44 percent of Black American “taskers” relied on gig work as their primary source of income, compared to 31 percent of White “taskers.”

People of color in this field are also more often victims of tip-baiting, or being promised a

higher tip than what they actually receive, most commonly a problem on Instacart.

Agu says though she has never experienced tip-baiting it is a common problem and she is weary of it. “If the initial tip is high when the job is pending then I won’t even accept it. It sucks because the promised tip could be real but that is unlikely, so I don’t even take the risk.”

This is even more detrimental to her income because she relies more on tips than on the payment she gets directly from the company.

During 2020 there were many instances when Agu recalled her car needed servicing but in order to pay for any maintenance she had to drive it in an unsafe condition to make the money she needed for repairs.

“I’ve had it happen with oil changes but it most commonly happens when my [gas] tank is on ‘E,’” she shared. “I have to roll it like that for a couple jobs so that I am in a position to put gas in my car.”

She also commented on the stigma associated with gig working. It’s widely known that gig pay is not great, she admitted, “A lot of people are embarrassed to do the work.” Society has placed

a burden on workforce participants to steer clear of gig work because it is widely viewed as “bottom of the barrel” work.

“This is a different opportunity for me,” Agu advised. Because she is a student, her more serious bills are covered by her parents and/ or her federal disbursements. She does not feel that supporting herself solely from gig work would be possible and commended the people that do. “They’d have to work hours on end to make anything substantial.”

Even before the onset of the pandemic, a 2018 report by the Federal Reserve highlighted workers who supported themselves solely from gig work struggled far more than workers who did not. The report also found 58 percent of fulltime gig workers said they would have difficulty coming up with $400 to cover an unexpected bill -- compared to 38 percent of non-gig workers.

More than 10 years after the gig economy was amplified with the introduction of Uber in 2009, California introduced Assembly Bill 5 to classify gig workers as employees rather than contract workers, so they may receive similar benefits to traditional employees.

California is one of the world’s top economic playgrounds with an economic status falling right behind that of Germany’s and according to Gig Wage, a payroll company aimed at providing the technology to pay independent contractors more efficiently, the state is its second largest market.

Uber and Postmates attempted to sue the state over AB5 but were unsuccessful. However, additional gig companies like DoorDash, Lyft, Instacart, etc. pushed Proposition 22 to reverse AB5. The prop passed with 59 percent in the November 2019 election. Proposition 22 allows certain gig companies to be exempt from AB5.

“I don’t think this is a political issue. I think this is an issue of people needing to have access to work, having access to earned capital, and having the freedom and flexibility to choose how and when they do that,” Lewis, told CNBC. He called Prop 22, “a step in the right direction to allow workers to maintain their freedom and flexibility,” while allowing them to receive benefits they need and deserve. continued on page 17

often, and serve longer periods of probation than any other group and yet, we use drugs at a similar rate, resist less, are least likely to be stopped for traffic violations and more likely to be stopped for what is called “reasonable suspicion.” We are also searched more, even though we are far less likely than Whites to be found with contraband.

So, it is an insult to hear police say, we should not lump all officers together when it is clearly true that is exactly what they do regarding Blacks.

For these reasons and others, I continue to be incredulous regarding the inaction of those who “currently” have power to make change and their pretense of shock and dismay over calls to defund the police especially when they know full well the intent is to redirect funding from local police to local community groups more focused on healing a community than traumatizing it.

I applaud those across the inland region and across the country who continue to show up at board or council meetings to make their voices heard and demand change—those who recognize much of the heavy lifting must happen at the local level.

On Juneteeth as the nation marks the delayed end to slavery in the State of Texas it is important to remind ourselves that although chattel slavery ended, involuntary servitude did not, begging the

question, “How free are we?”

The U.S. Constitution under the Thirteenth Amendment and 48 states including California, still have involuntary servitude as punishment for crimes, enshrined in their constitutions.

As such, a nation that built its wealth on the commodity of slavery--a nation that built a fail-safe into its Constitution to preserve vestiges of slavery as “involuntary servitude,” a nation that then set about criminalizing and imprisoning the descendants of those chattel slaves to make them involuntary servants, a nation whose wealth and world renown is partly rooted in its ability to manipulate the pricing of commodities by leveraging involuntary servitude-would be willing to deconstruct a system of policing that helps fuel this economic engine is incongruous, making it difficult to dismantle.

This reality is what makes putting pressure on local elected officials and working with police agencies and sheriff departments to reimagine policing so critical—they are the “tip of the spear” so to speak, holding the line against change.

It begins with city councils and county boards that have the power to enforce change because they control budget allocations. It includes police chiefs who are appointed by mayors and approved by city councils, county sheriffs who also serve as coroners

(and determine the cause of death in use of force cases}; district attorneys who ultimately determine who is charged with what; judges who reign like lords in their respective court rooms, and of course, police officers and deputies who interact with the public and make the arrests that fuel the system.

Most elected officials tied in one way or another to criminal justice from city councils to board supervisors to county sheriffs/coroners, to district attorneys and judges, are elected with the help of police unions, and those who are not elected—like local police chiefs—are appointed and approved by those who are. Why? Job security for police and deputies? To influence policy?

The struggle for change continues to be long and arduous and it is important to understand what is happening to Black people in America today is a continuation of the nation’s second greatest sin of chattel slavery, the first being the near annihilation of this land’s native people.

Policing in America, however, is destined to change. Policing in America must change--things always seem impossible . . . until they are not.

Of course, this is just my opinion. I’m keeping it real.
