The Murder of Tyre Nichols by Modern Day “Men in the Middle”

Implicit bias in the psyche of America undergirds the correlation of Black maleness with crime and it is this bias that often robs Black men of their lives. So when news of the Tyre Nichols murder became public, the heartbreaking conditions surrounding his death seemed even more bitter for the African American community when we learned of the five Black, Memphis, TN, police officers implicated in his death.

Yet, it's hard not to admit that in some ways, the shocking revelation of Nichols’ death by these “Blacks” who stood along the “Thin Blue Line” jaggedly complicates the ongoing struggle for justice in policing during an era when white nationalism is on the rise.

Nichols’ brutal murder has forced many Blacks to call up a painful truth from the annals of our history, something that lies just beneath the surface of our consciousness. That is, throughout our sojourn in America, and recently applicable to some Blacks along the Thin Blue Line, there are some who behave with the same “us against them” mindset as their white racist counterparts once they pin the badge of police

The tragedy offered ready fodder for racists who, ignoring the objective data on police use of force in relation to Black people, proclaimed that the incident supported their long held views that such deadly use of force by police is not about race. Proposed Legislation Seeks Mandatory Training for Federally Licensed Gun Dealers

SB 241, if passed by the legislature and signed into law, will require all federally licensed firearm dealers in California, and their employees, to complete annual training provided by the California Department of Justice. (source: gunsafety.ny.gov).

On Wednesday, January 25, 2023, CA Senator Dave Min (D-Irvine) introduced Senate Bill (SB) 241 requiring all federally licensed firearm dealers in California, and their employees, to complete annual training provided by the California Department of Justice (CA DOJ).

CA DOJ training will cover federal and state laws governing the sales and transfers of firearms and ammunition; how to recognize indicators an individual intends to use a firearm for fraudulent

activity, unlawful purposes, or self-harm; theft and burglary prevention. The training will also focus on the rules of safe firearm handling and storage and other reasonable business practices that will deter gun trafficking or the unlawful use of firearms.

SB 241 builds on Senator Min’s SB 1384 (Chapter 995, Statutes of 2022) which requires firearms dealers to carry liability insurance and install onsite surveillance, signed by the Governor last year.

Mandatory training and gun dealer certification intends to prevent theft, straw purchases, and other nefarious crimes that are too often a result of the free flow of guns in our communities. The Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) reports 1,903 federally licensed dealers or pawnbrokers of firearms in California.

“We have got to do something to reduce the gun violence in this country. While this bill will not end gun violence, it will help to reduce it, by requiring gun dealers to undergo training to prevent theft, fraud, and illegal purchases,” Min continued on page 19

It is the first fully integrated demonstration project with solar panels, a battery and an electrolyser to convert solar energy into hydrogen, as well as a fuel cell to supply electricity to the home.

Among the dignitaries in attendance at the event was former Los Angeles Mayor Antonio Villaraigosa, who now serves as Infrastructure Advisor for the State of California.

The home, at 2,000 square feet, was built in 20 weeks. The construction included six modules that were built off-site, brought over, and put together in six hours, creating the house.

The micro-grid draws its power from solar panels and converts excess energy into renewable hydrogen energy.

SoCalGas explained that the micro-grid could deliver clean and renewable energy to a neighborhood composed of an estimated 100 homes and industrial buildings.

“California is home to 40 million people. Yes, California is also an idea. It is a vision of the future. It is a gateway to progress,” Southern

California Gas Co. President Marayam Brown said.

“It is very much the case that innovation and technology for the last half-century has flowed in this country from west to east. That is because of the incredible work of many of the people in this room.”

The 2023 tax filing season officially began on Jan. 23. The IRS is now accepting and processing 2022 returns.

The IRS projects over 168 million individual tax returns will be filed, most coming before the April 18 tax deadline.

In August 2022, the Inflation Reduction Act was passed, providing funds to the IRS to allow for an addition of 5,000 new telephone assistants and increased in-person staff to help support taxpayers.

"This filing season is the first to benefit the IRS and our nation's tax system from multiyear funding in the Inflation Reduction Act," said Acting IRS Commissioner Doug O'Donnell. "With these new additional resources, taxpayers and tax professionals will see improvements in many areas of the agency this year.”

O’Donnell said that while much work remains to be done after several difficult years, the IRS expects taxpayers to experience improvements while they develop new long-term efforts.

The law requires that federal holidays as well as Washington, D.C. holidays impact tax deadlines for the entire nation. As a result, the deadline to submit 2022 tax returns is April 18, instead of April 15, giving taxpayers three extra days because of the District of Columbia's Emancipation Day holiday.

Taxpayers requesting an extension will have until Monday, October 16, 2023 to file.

Tax Extension for Californians Affected by Winter Storms

Californians impacted by winter storms are now eligible to claim a deduction for a disaster loss and will have more time to file their taxes. The California Franchise Tax Board (FTB) has extended the filing and payment deadlines for individuals and businesses in California impacted by the storms until May 15, 2023.

“Whether it’s more time to file your taxes or get a deduction, this tax relief will support Californians who have been impacted by the ongoing storms battering the state,” said Governor Newsom. “California is working swiftly to get people back on their feet and help communities recover.”

authority on their chests. It’s as if when they put on the uniform, their Black skin falls away and they lock into a mindset of “superiority” versus a mindset of “service”.

Lost in such a “superiority” mindset, the five Black officers who murdered Nichols didn’t see a reflection of themselves in his eyes as they brutally beat him. They did not see the likeness of their own pigmentation as they brutalized and bloodied him. They did not hear the voices of their own brothers, sons, nephews and friends as Nichols cried out to the one person he knew loved him unconditionally, his mother. It was as if, in that uniform, they’d taken on the magic shield of white privilege and protection.

They somehow forgot that in reality, the opposite is true. A 2020 Brookings report states, “Black officers are sanctioned more harshly than white officers for similar misconduct.” We witnessed that in this incident with their immediate termination.

They also seemed to forget that out of uniform, they themselves can be viewed and treated by other officers with the same disregard they afforded Nichols. Consider this quote from a December 2014 Reuters report:

“Reuters interviewed 25 African American male officers on the NYPD, 15 of whom are retired and 10 of whom are still serving. All but one said that, when off duty and out of uniform, they had been victims of racial profiling, which refers to using race or ethnicity as grounds for suspecting someone of having committed a crime.

The officers said this included being pulled over for no reason, having their heads slammed against their cars, getting guns brandished in their faces, being thrown into prison vans and experiencing stop and frisks while shopping. The majority of the officers said they had been pulled over multiple times while driving. Five had guns pulled on them.”

It is difficult to believe the Black officers involved in this killing felt their uniforms placed them above their young brother. Did they forget who they are?

It reminds me of a Black folktale about a slave named Dave who saved his master’s two young children from drowning. The master was

so grateful that he gave Dave his freedom.

As the slave master, the mistress and their children, stood and watched Dave walk away from the plantation a free man, the master shouted out to his former slave, ‘Dave, the children love ya’. Dave, I love ya’. And Dave, the missus, she likes ya’. But remember Dave, you’re still a N****r.”

Whether these Black officers knew the tale of Dave or not, their hateful and unwarranted violence against another Black man, against another human being, under the color of authority, was unwarranted and sadly, not new.

The many facets of our complicated and painful history, tell us their behavior may be somewhat predictive, giving testimony to the potentiality of their actions. It is as deeply ensconced in our history as is the pain and suffering inflicted by slave masters, their white overseers, the pattyrollers that roamed the south looking for freedom seekers or the trackers/ slave catchers that trolled northern states in search of runaways.

Those unaware of this history caught a brutal glimpse of it in the movie Harriet that premiered in 2019, when the Black slave catcher, Bigger Long, made a vicious and murderous appearance in the film – his character, loosely

based on history. These Black trackers or slave catchers, according to Historian Kate Clifford Larson, were fewer in number than their white counterparts, reminiscent of the undercount of Blacks working as police today. In 2020, Blacks were only 11.4% of local police forces, compared to being about 13% of the population

However, free Black slave catchers were not the only ones who brutalized their own. While some, like free Blacks, did so for money, others did so for favor and . . . survival.

There were slaves who served as “intermediaries” the men in the middle between the slave master and his slaves. Among them were slave drivers, and history tells us they exercised considerable power.

Slave narratives speak of how their positions of trust and power with the masters enabled them to protect those in their charge. However, these slave narratives are also filled with accounts of the dispassion of many Black slave drivers and include accounts of brutality, including mutilations, lacerations, burnings, and whippings.

Looking back, it is easy to be critical of the role slave drivers played, but the miserable condition of slavery made unyielding demands on Black people. Unlike today, where there are choices, slave drivers had few.

The Black policemen who murdered Nichols chose to be policemen. They held their positions because Blacks advocated for equal representation especially in police agencies that patrol areas where Blacks reside and where Black officers were/are underrepresented. Blacks have and continue to advocate for officers who look like them to protect and serve our communities.

Unlike many of the Black slave drivers of the past, the officers who killed Nichols chose to brutalize and murder one of their own. Metaphorically speaking, they are the extreme of Blacks like Clarence Thomas, Ward Connelly and others who use their positions of power to kill the hopes and dreams of their fellow Black Americans. It leaves one to wonder, what manner of men are these?

In closing, I admit this was a difficult piece to write but as always, I did my best to keep it real.

Baby Aspirin May be the Key to Preventing

High Blood Pressure during Pregnancy

Iam a preeclampsia survivor. My son was in the neonatal intensive care unit,” shared Dr. Amanda P. Williams, clinical innovation advisor at the California Maternal Quality Care Collaborative (CMQCC).

Preeclampsia is a condition that typically begins after 20 weeks of pregnancy. The condition is characterized by high blood pressure and protein found in the urine. Preeclampsia can result in serious or fatal outcomes for both the birthing person and the baby, such as preterm birth or low birth weight.

More than a decade ago, Dr. Williams had preeclampsia while giving birth to her son, an experience that fuels her work today as an obstetrician/gynecologist, medical director and maternal health advocate.

“This is not just my work. This is also my story. We didn’t have this research when my son was born, and so it is personally very important to me as a Black woman, as a Black mother to get this word out in the community,” Dr. Williams said.

In an effort to prevent preeclampsia and address communities that have a high risk of developing preeclampsia, Riverside University Health System (RUHS) – Medical Center joined a state-wide pilot program, led by the CMQCC and sponsored by the March of Dimes, to promote the use of low-dose aspirin (sometimes referred to as “baby aspirin”) as a

way to prevent preeclampsia. The program will run throughout 2023.

RUHS pilot program

RUHS was chosen to take part in the pilot program because of their previous joint

partnerships with the CMQCC on other initiatives and “because of the high rate of poverty and the high rate of comorbidities that we have in our patients,” according to Dr. Bryan Oshiro, chief of Maternal-Fetal Medicine at RUHS.

Dr. Oshiro explained that while a majority of patients treated across RUHS identify as Hispanic, preeclampsia disproportionately impacts Black patients, who account for roughly 5% of the population in Riverside County.

“In our practice, we find that we don’t treat everybody equally because the risk is not equal,” Dr. Oshiro said. “And so we actually spend more time explaining [preeclampsia] to African American women and making sure that they have even closer scrutiny and follow up and so forth.”

Any pregnant person is at risk of developing

preeclampsia, however, research from the U.S. Preventive Services Task Force reported that Black women are at a greater risk for developing preeclampsia than other women and experience higher rates of maternal and infant morbidity.

Particular people who are at high risk of developing preeclampsia include those who already have high blood pressure (hypertension); have family history of preeclampsia; are pregnant for the first time; had previously had preeclampsia; are older than 35 years of age; have high blood pressure, diabetes or an autoimmune disease; and are pregnant with multiple babies.

“It started with a vision and didn't end with the vision. It ended with the practice of putting it out there,” Slevin said. “What you have here today, you don't see it across this country. You don't see people talking about cleaning the environment. I have to applaud the team here at So Cal Gas for that.”

Clean Energy Sources

He addressed those concerned about the transition to clean energy sources and the workers worried about their jobs being taken away.

He spoke about the importance of “making sure workers are included, communities are included, as the state transitions to a cleaner environment” and explained how accomplishing that is an important part of the effort when it comes to reducing emissions. “What you have here is growth in California. Projects like this will expand and continue to grow and continue to bring economic growth as it reduces emissions,” Slevin said.

Blanca Pacheco, Assemblymember for the 64th District, announced that she would be introducing new legislation, Assembly Bill 324 that will jumpstart production to decarbonize the existing natural gas system and lower the cost of the fuel for a potential dedicated hydrogen system in the future.

Carbon Neutrality

“Diversifying the utilities' renewable procurement portfolios to include hydrogen reduces risks, improves California's chances of reaching its ambitious carbon neutrality goals, increases competition between decarbonization pathways, and provides Californians access to a decarbonization pathway that may provide lower long-term costs,” Pacheco said.

According to SoCalGas, hydrogen homes provide reliability for families and businesses.

Although clean energy will reduce the number of union jobs, it will also help create new jobs for the future.

The FTB provided instructions for this process which state, “When filing their return, taxpayers should write the name of the disaster in blue or black ink at the top of their tax return to alert FTB. If filing electronically, taxpayers should follow the software instructions to enter disaster information. If a taxpayer receives a late filing or payment penalty notice related to the postponement period, they should call the number on the notice to have the penalty abated.”

Disaster victims are eligible to receive free

copies of their state returns to replace those lost or damaged. To do so, they should use form FTB 3516 and write the name of the disaster in blue or black ink at the top of the request.

Most refunds are issued in less than 21 days; EITC refunds for many available starting February 28

The IRS anticipates most taxpayers will receive their refund within 21 days of when they file electronically, provided they choose direct deposit and there are no issues with their tax return. Taxpayers can check Where's My Refund? on IRS.gov for their personalized refund status.

However, the IRS cannot issue a refund that includes the Earned Income Tax Credit (EITC) or Additional Child Tax Credit (ACTC) before mid-February. This is due to the 2015 PATH Act law which Congress passed to provide additional time to allow the IRS to stop fraudulent refunds from being issued.

Low-dose aspirin as prevention

Under the pilot program, doctors will recommend the use of low-dose aspirin at 14 weeks gestation, but Dr. Oshiro explained that the conversation regarding preeclampsia and low dose aspirin should be addressed early on in the pregnancy.

“I will say it’s very encouraging that many are seeing that aspirin has great benefits of helping to prevent preeclampsia,” said Dr. Jasmaine Coleman, an Obstetrician and Maternal Fetal Medicine Fellow.

Dr. Coleman explained that the use of lowdose aspirin for patients at risk for preeclampsia is protocol at Arrowhead Regional Medical

Center and the NAEBOR medical clinic where she works.

“The thing about aspirin is that [it’s] one of the only things in terms of prevention, at this point, that is more accepted to be able to prevent preeclampsia. So, that is probably one of the only tools we have in terms of preventing preeclampsia,” Dr. Coleman explained.

If low-dose aspirin is not administered or recommended to prevent preeclampsia, patients are monitored for symptoms and signs through lab work to ensure that they are not developing preeclampsia.

One key aspect of the pilot program is to work with and within the community to educate them on preeclampsia and prevention through aspirin. Dr. Oshiro said that the pilot program will allow the Riverside health system to establish a standard of care and develop a

model for administering low-dose aspirin as a preventative measure that can work in the community.

“So by doing that, we hope to decrease the incidence of preterm birth, decrease the incidence of small babies and maternal morbidity and death,” Dr. Oshiro stated. He explained that it will be important to promote the use of low-dose aspirin beyond physicians because a lot of patients are not familiar with preeclampsia.

Gaps in research

The recommendation issued by the task force concluded “with moderate certainty that there is a substantial net benefit of daily low-dose aspirin use to reduce the risk for preeclampsia, preterm birth…in pregnant persons at high risk for preeclampsia.”

The guidance is based on the research of 18 randomized clinical trials that examined maternal and perinatal health outcomes and 16 randomized clinical trials to assess the prevention of preeclampsia. The participants in the trial were mostly White individuals, with three trials that included a majority of Black participants.

While the trials demonstrated that the use of low-dose aspirin was beneficial, the recommendation noted research gaps and recognized that “Further research is needed in populations that have the highest rates of preeclampsia, including Black persons. Future trials should recruit adequate numbers of persons from varying racial and ethnic populations, such as Black persons, to have sufficient power to determine the effectiveness of different aspirin dosages…”

“Of course, the long term goals are to prevent preeclampsia. But what this pilot is really focused on is the work with the community, making sure we’re talking to people in the community, developing messages that resonate [and] partnering with other organizations to help get the word out,” Dr. Williams stated.

Holly J. Mitchell and the Department of Economic Opportunity (DEO) announced the goal to secure 200 local businesses committed to hiring system-impacted individuals this year.

Mitchell and the DEO joined business and community leaders to launch the Fair Chance Hiring Program, encouraging the county’s business community to adopt Fair Chance hiring practices.

The program launch was held at Earvin "Magic" Johnson Recreation Center and featured endorsements and speeches from Mitchell and

county department heads, as well as remarks from Fair Chance employers Clark Construction and Everytable.

Business leaders who have adopted Fair Chance hiring practices had the opportunity to speak with employers who have not yet hired system-impacted individuals, dialoguing on the proven benefits and breaking down misconceptions surrounding previously incarcerated individuals reentering the workforce.

DEO has partnered with organizations Root & Rebound and LeadersUp to assist in providing resources and connections for the program.

System-impacted unemployment

The nationwide unemployment rate across system-impacted individuals is over 27%, with more than 650,000 individuals returning from incarceration annually. The Fair Chance hiring program aims to increase awareness of the 2018 California Fair Chance Act, a “Ban the Box” law that prohibits employers with more than five employees from asking about the conviction history of an applicant.

Highlighting Fair Chance success stories

The launch event featured an art installation by photographer Brandon Tauszik, who took portraits of several Los Angeles system-impacted individuals who have successfully gained employment through Fair Chance hiring, as well as each individual's employer. Each portrait featured a statement from the individual, sharing the experiences of those returning to their communities and the workforce and the managers who gave them a fair chance.

securing employment,” said Carmen Garcia, Executive Director of Root & Rebound. “With a livable income, system-impacted people can financially support themselves and their loved ones, lowering the risk of recidivism, creating safer communities, and reducing racial disparities in economic outcomes. Root & Rebound is excited to partner with LA County in this Fair Chance Hiring Program to elevate and create more job opportunities for our systemimpacted incarcerated community members.”

The Fair Chance program will continue to host information sessions for businesses and systemimpacted individuals until June.
