Traffic Tickets that Need to Be Paid

San Bernardino Traffic Court also advises that it is not necessary to request a payment extension for payments due during the closure, as these payment due dates are being extended. Also, due to limited staffing, please be aware that you may see some delays in posting of your payment.

Probate Trials Suspended

On Friday, Jan. 8 the San Bernardino County Superior Court announced probate trials are being temporarily suspended effective Feb. 1 through Feb. 28, 2021 in order to provide appropriate notice to all parties due to the recent surge in COVID-19 cases within the county and the current regional stay-athome order. The announcement came a day after the court announced suspension of In-Person Family Centered Case Resolution Status conferences.

Can Employers Legally Discriminate Against Members of the LGBTQ+ Community?

he California Fair Employment and Housing Act (FEHA) and Title VII of the federal Civil Rights Act (Title VII) make it illegal for any employer to fire, demote, fail to hire, fail to promote, harass, or otherwise discriminate against anyone because of their sexual orientation, gender identity, and/or gender expression.

These laws are clear and although most California employees are covered under these laws, there are a few exemptions. The exemptions include certain employees of religious entities like churches, mosques and those who work for very small employers. The state protections described here apply to employers with at least five employees and federal discrimination protections apply to entities with at least 15 employees. It is important to note however, the California “harassment provisions” apply to every entity, even if there is only one employee.

Harassment is considered a form of discrimination that occurs when an employer or a coworker, with the employer’s knowledge, subjects an employee to a hostile, offensive, or intimidating work environment because of his/her sexual orientation, gender identity, and/or gender expression.

For such behavior to be considered illegal, it must be unwelcoming, and so harmful that it interferes with an individual’s ability to do his/her job. The law protects LGBTQ+ individuals from harassment by supervisors, coworkers, or even customers and third parties.

Employers in California are also required to recognize and respect an individual’s gender nonconforming and non-binary identities and requires that employers respect all gender identities and expressions.

In addition, if an individual who is not already out decides to come out, their employer is prohibited from discriminating against or mistreating them because of it.

The same protections hold true for individuals who transition while employed. Both state and federal law cover an employee’s transgender and transitioning status. An employee has a right to tell his/her employer they are transitioning, and the employer cannot discriminate against or mistreat the individual because of it.

Honoring an Icon, Waudieur “Woodie” Rucker-Hughes S.E. Williams | Executive Editor “ am thrilled that my bill to rename the Riverside Post Office after the irreplaceable and unforgettable Woodie Rucker-Hughes was signed into law,” said U.S. Representative Mark Takano (D-Riverside).

“Woodie was an icon in our community, and I was lucky enough to call her a dear friend.

She was committed to working on the issues that impact all our lives, and her tireless efforts truly made our community a better place.”

Takano stressed how naming a local post office after an iconic leader of Riverside’s Black community is a small gesture to ensure that her legacy is never forgotten. “And, that our district is always inspired by the life she led.”

Takano made these comments Tuesday after legislation he authored, H.R. 5983, was signed into law by the president. The legislation called for naming the post office facility located at 4150 Chicago Avenue in Riverside, CA, the “Woodie Rucker-Hughes Post Office Building.”

Rucker-Hughes, who died in 2018, was a history teacher at John W. North High School in Riverside and an administrator for the Riverside Unified School District (RUSD) and that was only the beginning of her service to the community.

She served as president of the NAACP for nearly 20 years. In her role as an administrator for (RUSD) she served as Child Welfare Attendance Manager and District Coordinator for Homeless Education.

A Majadi, President San Bernardino Branch of the NAACP once described RuckerHughes as “Knowledgeable, dependable and steadfast in her commitment to Civil Rights and community organizing.”

In 2018, California Senator Richard Roth who knew Rucker-Hughes for more than 40 years said. “Our world is a better place because of Woodie.”

Renaming the post office is another public, well-earned acknowledgement and recognition for the lifetime of service Rucker-Hughes gave to her community.

In November, a street in Riverside was named in her honor. On that occasion, then

candidate, now Mayor of Riverside Patricia Lock Dawson declared, “Woodie Rucker Hughes is a Riverside icon—our own North Star. Her wisdom, perseverance, and influence is sorely missed. But her impact lives on in innumerable aspects of our community. Today we honored Woodie with a street in her name. Woodie Way is a memorial to a woman who dedicated her life to equity and access for all of Riverside. A grateful community thanks Ms. Woodie Rucker Hughes.“ Takano’s perseverance and commitment to pass legislation re-naming the post office in honor of Rucker-Hughes did not go unnoticed.

Perhaps the Women’s March Inland Empire expressed the sentiments of the community when it posted an acknowledgement of his efforts. It reads, “Thank you, Rep Mark Takano for your hard work to rename the post office for Woodie.”

Inland Area Hospitals Receive Military Support, Resources Arrive in Riverside S.E. Williams | Excutive Editor

edical resources at hospitals in both Riverside and San Bernardino Counties are strained, and the military has dispatched resources to both counties to offer assistance.

Resources began arriving on Dec. 29 in San Bernardino County and this week Riverside also received military help. The U.S. Army and U.S. Airforce are providing both personnel as well as solutions for limited oxygen supplies.

On Thursday Jan. 7 a team of U.S. military personnel arrived in Riverside County.

“Riverside County hospitals have been stretched well beyond their licensed capacities to treat record numbers of patients.” Bruce Barton, Director of the county’s Emergency Management Department said. As a result, he explained further, the military resources are critical to help the region treat more of our residents and get through this hospital surge.

A core team of nearly 20 active-duty physician assistants, nurses and respiratory care practitioners from the U.S. Army and U.S. Air Force have arrived at the Riverside University Health System Medical Center in Moreno Valley. Officials confirmed the resources will support hospitals across the county.

o ensure COVID-19 vaccinations meet safety requirements, California formed a Scientific Safety Review Workgroup of experts, which has confirmed that the COVID-19 vaccines authorized by FDA are safe and effective.

The experts identified as the Western States Scientific Safety Review Workgroup have since recommended both Pfizer (on Dec. 13) and Moderna (on Dec. 20) Vaccines. The Workgroup confirmed to the governors of California, Nevada, Oregon, and Washington both vaccines are safe and effective for public use.

Now that a limited supply of vaccines is available and being administered to healthcare and long-term care residents, inland area residents are eager to understand how the vaccines will be administered to the public.

According to the California Department of Health, the next to be vaccinated will be individuals who have higher risk for severe disease or death due to age or other factors; are unable to work at home; live or work in geographic areas that have been highly impacted; and/or are most likely to spread disease to other workers or to the public. These individuals will be prioritized in phases.

ach year there are more than 20,000 cases of Human Trafficking reported in the United States and California, New York and Texas are the top three states in the nation for human trafficking activity according to the State Department.

San Bernardino County’s Human Trafficking Task Force is dedicated to eliminating this horrible exploitation of vulnerable human beings and last year participation in Operation Reclaim and Rebuild.

A weeklong collaborative operation took place in cities within the county including Hesperia and Victorville and the effort resulted in the rescue of 20 human trafficking victims and the arrest of 106 suspects.

In recognition of National Human Trafficking Prevention Month 2021, the San Bernardino County Sheriff’s Department, in collaboration with the Coalition Against Sexual Exploitation (C.A.S.E.), is hosting a series of webinars about the risks of youth exploitation and human trafficking.

Program Launched to Fast Track Backlogged Criminal Cases

n late December 2020, California Chief Justice Tani G. Cantil-Sakauye announced plans to launch a program aimed at fast tracking the resolution of criminal cases by making retired judges available through the Temporary Assigned Judges Program.

The temporary, fact track initiative will help ease significant criminal case backlogs that have accrued in counties around the state due to the COVID-19 pandemic and steps taken by trial courts to protect the health and safety of court users and staff. “Courts, prosecutors and defense attorneys will face a substantial number of cases as we emerge from shelter in place orders and the COVID-19 pandemic unless the justice community makes a concerted effort to take action now,� said Cantil-Sakauye.

partners, victims, and defendants.

Prosecutors may have witnesses who become unavailable over time or find that evidence in the case has become stale. Defendants and their counsel must continue to develop the defense case with counsel having only limited access to in-custody defendants.

In addition, defendants who are out of custody are often severely hampered in their ability to steady their lives through employment, obtaining a driver’s license, moving to lower cost housing, etc. and victims find themselves without timely resolution or restitution.

To help address these issues the proposed program will assist the courts in establishing readiness conferences for the early disposition of criminal cases.

However, a contract was awarded to the company after a woman Kirk was dating who purportedly knew Fogerty, spoke to him. Allegedly, Fogerty pulled strings and made a backroom deal to give Statewide a contract.

The company’s attorney, Stephen Larson, told the San Gabriel Valley Tribune, “We certainly hoped that a lawsuit would be unnecessary, but now that we have been forced to vindicate our rights through litigation believe that we have a strong case and will succeed at exposing the city’s improper conduct with respect to the towing contracts through discovery and at trial.”

Remarkably, the company recently won a similar lawsuit against the City of San Bernardino. In September 2020, the city settled with Pepe’s Towing for $1.3 million.

A court date is yet to be determined.

The success of this program according to Cantil-Sakauye, will likely hinge on judges who understand the local court culture and are highly regarded by both the defense and the prosecution.

restroom at work that corresponds with his/her gender identity. Employers are prohibited from telling a transgender individual which restroom to use. Employers with single-stall restroom must label them as “All Gender,” “Unisex,” “Gender Neutral,” or something similar.

For individuals being interviewed for a job, it is illegal in California for a prospective employer to ask about one’s sexual orientation, gender identity, or gender expression either directly or indirectly (by asking about one’s spouse for example). It is also illegal for a potential employer to ask you to disclose your gender on a job application or to make one’s gender identity a condition of employment.

In a situation where an individual who is not a member of the LGBTQ+ community is being mistreated by an employer who mistakenly thinks he or she is, and the employer mistreats them because of it; it is important to know California law prohibits discrimination based on both actual or perceived sexual orientation, gender identity, and/ or gender expression. This means an employee is protected even if their employer is mistaken about his/her sexual identity. It is also illegal in California to discriminate against someone because they associate with an individual who is a member of the LGBTQ+ community.

It is also illegal in California for an employerprovided health insurance plan to exclude genderaffirming care. These plans, as well as government provided Medi-Cal, must cover medically necessary gender-affirming care just like they cover other medically necessary treatments.

If you or someone you know has been denied treatment by an HMO or other managed health care plan, contact the Department of Managed Health Care to appeal. Or, if you or someone you know encounter an exclusion under a different kind of health plan, contact a legal organization for help understanding your options.

In addition, under California law same-sex spouses and registered domestic partners are entitled to the same health care coverage as different-sex spouses.

Finally, it is illegal for any employer to retaliate against an employee who has complained about discrimination or harassment in the workplace.

Unfortunately, however, this type of response is common. If you are being retaliated against because you complained about discrimination and/or harassment, it is suggested you document what is happening; speak up and try to solve the problem provided you feel safe to do so; and/or reach out to a civil rights organization for assistance.

You can also file a complaint with the Department of Fair Employment and Housing (DFEH), the state agency responsible for enforcing these laws. Filing a DFEH complaint is free and you are not required to have an attorney to do so.

DFEH has published a Frequently Asked Questions resource that explains employment discrimination law generally, as well as a fact sheet for employers that details transgender people’s rights in the workplace.

COVID-19 hospitalizations continue to surge in Riverside. On Thursday, Jan. 7 records were set for both COVID-19 hospitalizations with 1,644 people and COVID-19 ICU patients which totaled 364.

The arrival of military medical resources came a day after Riverside County received oxygen generators from the state to help mitigate the region’s critical need for oxygen.

According to Barton, the need for oxygen is not limited to just one hospital as oxygen suppliers are having difficulty keeping up with the high demand. The state’ Emergency Medical Services Authority established an oxygen depot to supply Riverside and surrounding counties with oxygen.

The new oxygen depot consists of two large generators that will produce oxygen to fill the large tanks used by hospitals. The depot provides a critically needed expansion of the county’s local oxygen supply.

stood down, opened the barriers, took selfies, appeared to almost welcome the insurrectionists who were somehow able to navigate the halls of Congress to places those who have served there for years still have difficulty finding their way—raising legitimate questions about who was in on this in advance.

It also placed, on display for the world to see, the noticeably clear difference in the application of law and order when viewed in Black and White. This has been called out repeatedly especially regarding the massive show of police force during the peaceful Black Lives Matter protests over the summer compared to the casual police attitude toward the insurrectionists who gleefully waived confederate flags in the halls of Congress.

As I watched the event unfold, I noticed a White Supremacist in what appeared to be a hoodie overlooking the Senate floor as if he did not have a care in the world after breaking the law in broad daylight. I could not help but recall the hoodie worn by 17-year-old African American Trayvon Martin who was shot and killed in Florida in 2012 by “want-to-be-cop”, George Zimmerman. “[He looks] real suspicious. [He’s wearing] a dark hoodie, like a gray hoodie,” Zimmerman told the 911 dispatcher as he stalked Martin through the neighborhood before killing him.

On January 6, in my mind there were several blinding-flashes-of-theobvious about the White Supremacists nature of the insurrection but the one searing image that remains with me is that of the White man in a hoodie clearly breaking the law and who most assuredly slept in his own bed that night juxtaposed with a Black teenager in a hoodie walking home with a bag of rainbow-colored Skittles in his pocket and a can of AriZona Iced Tea who now sleeps forever because he was Black and “looked suspicious”. He had not committed any crime—the irony is breathtaking.

This is the reality of what Black people bear witness to and endure, a burden of callous injustice they have carried for more than 400 years.

And then there were the nooses and the Confederate flags on full display at the capitol that day—clear indications of the mindset of those

involved in the insurrection. For any who doubt their intentions, consider the words of Texas Senator Ted Cruz who despite the events of the day, stood boldly on the Senate floor the same night and without blinking an eye but with certain malice and forethought, opined about using the Compromise of 1877 as a way forward. Even as he spoke, he knew full well the claims of voter fraud were untethered to reality and his reference to this historical marker as a way forward was shocking but in alignment with everything else on display that day.

The 1877 compromise effectively ended the protections of Reconstruction. It gave rise to the Ku Klux Klan, Jim Crow, the lynching years, and other, unmitigated horrors for Black Americans. This is the country Cruz, five other senators, 60 percent of the U.S. House of Representatives, the hyped-up and deranged insurrectionists who stormed Congress, and the naked, incompetent emperor is working overtime to bring about.

"This president should not hold office one day longer," said Democratic Senate Minority Leader, Chuck Schumer who called the attack on the Capitol, “an insurrection against the United States, incited by the president." I could not agree more.

The attack in D.C. was not the only act of insurrection on January 6, it was a coordinated effort that saw Trump supporters assailing government centers in several cities across the country.

Trump and his sycophants encouraged the insurrectionists in a wild rally before they marched to the Capitol and called on them to “Fight like hell!” “Fight for Trump!”

This week I can only close with the rhetorical question once asked by my Civil Rights heroine Fannie Lou Hammer, “Is this America?” I know the answer, just as she knew it when she asked the question those long years ago. Yes! This is America.

Of course, this is just my opinion. I’m keeping it real.
