spent the Independence Day weekend helping my son’s friend find a place to live to keep him from living on the streets. He is 22 years old, and for most of those years he lived in transition. I once asked him how many places he has lived in for as far back as he could remember, and I believe the last count was 17. Well, that’s before the last two and the one we looked at over the weekend. The total now is 20. If we were unable to secure lodging for him, he would have joined the over 115,000 living on the streets of some of the state’s most prosperous communities. His story is similar to many young people who have made their way into my life over the years, and similar to so many who have no safety net, who are just one bad decision, or in his case, a moment of bad luck away from homelessness. Some were from broken homes, others were scarred after years in the foster care system, and then there were those who, like this young man, were forced to fend for themselves as teenagers, moving from couch to couch relying on the kindness of strangers or distant relatives. For them the American Dream consists of basics that most us may take for granted – a place to call home with a roof and a door. For many, our national holiday is a bit ephemeral, a haunting promise that eludes them simply by the unlucky circumstances of their birth. California has the largest homeless population of any state in the union – - even our largest college system recently announced that 1 in 10 of their students are homeless -- a situation that has become so dire that large cities, our largest county, and our state legislature are now taking bold steps towards its elimination. Just last week the Los Angeles City Council approved language for a $1.2 billion bond measure to combat homelessness in the city, something Mayor Eric Garcetti says, “stifles economic prosperity” for everyone. 10 MAJOR Affirmative Action
Cases and Orders
For nearly 75 years the United States of America has grappled with the issue of Affirmative Action. Although the nation’s first formal engagement with the issue occurred in 1941, the term “Affirmative Action” was not actually introduced until twenty years later. In 1961, President John F. Kennedy saw it as a way to amend the discrimination that persisted despite the mandates of civil rights legislation and the basic rights of citizenship guaranteed in the nation’s constitution. This timeline reflects ten of the most significant Affirmative Action Cases and Orders in the last 75 years.
1941
Executive Order 8802 President Franklin D. Roosevelt outlawed discrimination based on race, color, creed, and national origin in the federal government and defense industries as the nation prepares for World War II.

Executive Order 10925 President John F. Kennedy required that government contractors “take affirmative action to ensure that applicants are employed, and employees are treated during employment, without regard to their race, creed, color, or national origin.”

The Philadelphia Order
Executive Order 11246
The revised Philadelphia Plan was an initiative from President Richard M. Nixon under the powers established by Johnson’s Executive Order 11246. Assistant Labor Secretary Arthur Fletcher acted to “require that bidders on any federal or federally assisted construction contracts for projects in a five-county area around Philadelphia … submit an acceptable affirmative action program which includes specific goals for the utilization of minority manpower in six skilled crafts.” The plan was extended to other cities, and the Supreme Court decided to not hear an appeals case to overturn the plan.
President Lyndon B. Johnson prohibited employment discrimination based on race, color, religion, and national origin by organizations receiving federal contracts and subcontracts. Provisions that ban employment discrimination based on gender were added shortly after.

$171 Million in Student Debt Forgiveness Washington, DC—The Obama administration recently announced plans to forgive $171 million in federal loans for students who attended Corinthian Colleges, the Santa Ana-based, for-profit chain that allegedly inflated the value of its degrees. At least three of the company’s campuses were located in the Inland Empire. In total the U. S. Department of Education received more than 23K claims from students who attended Everest College, Everest Institute, Heald College or WyoTech. Nearly 10K of the claims were filed against the company came from California. To date, the government has forgiven student loan debt to more than 11K Corinthian students. That number, however is expected to grow as the DOE continues its effort to contact more than 300k former Corinthian students.

Proposition 209
Californian’s vote to amend the state’s constitution to bar public institutions from discriminating on the basis of race, sex, or ethnicity. Proposition 209 has survived various legal challenges, and Michigan enacted a similar law in 2006.

Regents of the University of California v. Bakke One of the true landmark cases in Supreme Court history, the Bakke decision found a way to uphold some parts of affirmative action while rejecting other parts. Allan Bakke, a White man, had twice applied for admission to the University of California Medical School at Davis. He was rejected both times, despite having the required academic achievements, while minority applicants were given preference. The court decided the University of California had to admit Bakke, arguing the rigid use of racial quotas at the school violated the Equal Protection Clause of the 14th Amendment. But the court also found that race as part of admissions decisions was constitutional, as long as it was one of several admission criteria.
In a 5-4 U.S. Supreme Court opinion delivered by Justice Sandra Day O’Connor, the court said that the Equal Protection Clause of the 14th Amendment didn’t prohibit the University of Michigan’s Law School from using race in admissions decisions. The court said that the law school’s detailed review of each applicant ensured that all factors were considered along with race and that the program didn’t harm non-minority applicants.

High Heeled Shoes: Sexy, but at What Price? Dear Dr. Levister: I’m tethered to my stiletto high heeled shoes but ouch, they hurt my feet. How can I combine looking sexy and feeling comfortable? G.S. Dear G.S.: High heel shoes give the optical illusion of a longer, slimmer leg, a smaller foot, and a greater overall height. They also alter the wearer's posture and gait, flexing the calf muscles, and making the bust and buttocks more prominent. All high heels counter the natural functionality of the foot, which can create skeletal and muscular problems if they are worn excessively. Despite their impracticality, however, their popularity remains undiminished – as Terry DeHavilland (UK shoe designer) has said, “people say they're bad for the feet but they're good for the mind. What's more important?” Women may not realize that, wearing high heeled shoes everyday might do grave damage to the body. Wearers may feel uncomfortable after standing for long periods in high heeled shoes
and experience pain and discomfort at the time of taking them off at the end of the day. Not to mention that their feet often become painful after a few hours of wearing high heels and need to be removed due to rubbing on the foot. As we know, high heeled shoes put a lot of pressure on the feet, and are the main culprit for foot problems like calluses, corns and bunions. Wearing high heeled shoes overtime can lead to ankle injuries, it also can damage or compromise the spine and knees. Wearers can take effective measures to protect their body when wearing high heeled shoes. Take a second pair of shoes wherever you go for use when sitting down, dancing or walking distances. Choose a low or wide heel for job interviews, worship service, meetings, weddings, dances and other social events. Also, try to minimize the amount of time you wear high heeled shoes. The market is flooded with products designed to cushion cuts and blisters. See a foot specialist if you experience prolonged foot pain.
In a word, wearing high heeled shoes does have its advantages and disadvantages, but if you can prevent health issues, and wear them in a correct way, wear high heeled shoes and be stylish with them.

Gun Control At The Local Level
G
un violence in our community must become a local issue and action must happen at the local and state level in the absence of national action. I am a great fan of western movies Hardy L. Brown especially the fast Photo by benoitmalphettes.com draw six-shooter of war heroes Audie Murphy and Glenn Ford and the Winchester 73 of Jimmy Stewart. Now while these men played fictional characters, historic figure Wyatt Earp and his brothers were real people who faced bad people with guns who came to town just to raise hell and kill. The second amendment was in the constitution then but they developed regulations that, in their minds, made their towns safe. As it was during those early days of the Wild West, I believe it is time for each city, town, or local government to take matters into their own hands and act to protect their citizens. If citizens want to object by filing lawsuits then let our courts try to separate out the citizen’s concerns from the right of citizens to own guns and regulate what kind of guns they can own in order to reduce the violence caused by automatic weapons.
“You will never truly understand the gun violence epidemic until it happens to you,” said Mandy Pifer, the fiancé of Shannon Johnson, who was killed in the San Bernardino shooting last December. “I strongly believe that to ignore the role that guns play in this public health epidemic — homicides, suicides and terrorism — is like throwing away the last piece of a puzzle you’ve been working on for a very long time. It’s frustrating and nonsensical,” she said in a CBM article. It is frustrating and makes no sense to know what types of weapons are being used to kill our people and then we do nothing about it. There is no one answer to solving this problem but to stand by and do nothing is even worse. To watch national elected officials do nothing but talk is even more frustrating. The state of California has decided to pass strict gun control legislation that has been signed into law by the governor. Governor Jerry Brown signed six bills Friday requiring gun owners to give up magazines holding more than ten rounds and for buyers to undergo background checks before they can purchase ammunition. Sam Paredes, executive director of the advocacy group Gun Owners of California said, "Independence and freedom and liberty in California has been chopped down at the knees and kicked between the legs." To that I
say the victims have been shot down like hogs in a slaughter pen, I know because that is the way we killed hogs during hog killing time in North Carolina. Governor Brown said his goal in signing these bills was to enhance public safety by tightening our existing laws in a responsible and focused manner, while protecting the rights of law-abiding gun owners." And as a lawabiding gun owner I agree. I want to commend the legislature and governor for taking some action just like Wyatt Earp did in his day. The Earps did not wait for congress to act; instead they said “you can own a gun you just can’t carry it within these city limits.” What if every city

works to assist the homeless citizens in our region. The organization has been working for over a decade to provide services for members of our community who find themselves impacted by the cycles of homelessness and poverty and work to assist the over 1,500 individuals and families who find themselves without shelter here in our community. They, like hundreds of other organizations throughout the state that provide services to the homeless, can increase their efforts with increased funding. I agree with Los Angeles Supervisor Mark Ridley-Thomas, who believes we need to “treat the issue like the humanitarian crisis that it is.” We need not only revolutionary thinking, we
need revolutionary action. We need to work collectively across city, county, and regional boundaries to restore and rebuild the lives of so many of our fellow Californians. As my good friend, Supervisor Ridley Thomas’ son, and patriot Assembly member Sebastian RidleyThomas said so eloquently in a recent essay, “to do nothing would be to undermine the narrative of an ascendant California,” and I would add, fall short of the triumph of liberty our democracy celebrates.
Chronicle, the editors called “the reduction of homelessness to the extent humanly possible… San Francisco’s No. 1 priority.” They joined more than 70 other media outlets in the Beyond Homelessness project, shining a bright light on the golden state’s shared civic shame. The county of Los Angeles is considering a potential parcel tax measure to raise money for homeless services. And before they adjourned for the summer recess last week, the state legislature approved a $2 billion plan to help alleviate the growing problem. Not too long ago I attended a Path of Life event, one of the organizations successfully

Another Legislative Attempt to Add Judges in Riverside and San Bernardino Counties Sacramento
L
ast week, Assembly Bill 2341 passed out of the Senate Judiciary Committee with broad bipartisan support. The legislation, sponsored by Assemblyman Jay Olbernolte, would provide Riverside and San Bernardino counties with additional judges to address the counties’ severely backlogged court systems. “I am grateful that my colleagues in the Senate recognize the need for improved access to justice in San Bernardino County,” Obernolte said in a written statement. “While we all agree that increased court funding would be the preferred solution, AB 2341 takes a necessary step in that direction to help address the immediate judicial shortfall in the Inland Empire.” In recent years, Governor Jerry Brown has been reluctant to fund new judgeships. In October, 2015, the Governor vetoed SB 229. That bill called for the state to spend $5 million on 12 superior court judges. In his veto message, Brown explained he was aware of the serious need for judges, especially in Riverside and San Bernardino counties. “However, before funding any new positions,” he stated, “I intend to work with the Judicial Council to balance the workload and distribution of judgeships around the state.” AB 2341 is the first attempt at addressing the Governor’s request and would provide multiple judges to Riverside and San Bernardino counties, which are both at the top of the list of under-resourced counties in California. Riverside and San Bernardino counties have the worst shortage of judges in the state. According to reports, the shortage is partly the result of rapid growth in
the inland region that has impacted the ability of local judges to hear civil and criminal cases in a timely manner. In the two-and-ahalf-year period between January 2007 to June 2009, hundreds of felony and misdemeanor cases were dismissed because there were not enough judges to hear the cases before the hearing dates expired.

Prop 209’s Legacy

Years Later
Ward Connerly Reflects, “I was True to My Convictions...” Ward Connerly
S. E. Williams Contributor
I
n the nearly 20 years since the passage of Proposition 209, former University of California Regent Ward Connerly remains confident in his belief that affirmative action is not necessary. The Cambridge Dictionary defines perception as, “someone’s ability to notice and understand things that are not obvious to other people.” This was the dilemma faced by former UC Regent Ward Connerly, an African American who attained a highly respected position of prominence and then used the bully-pulpit of his position to advocate for the dismantling of a signature achievement of the Civil Rights era— Affirmative Action and its use to help facilitate minority admissions to California’s University (UC) system. It 1996, it became clear Connerly was not alone in his perception. Fully 54 percent of California voters approved Proposition 209. It struck down race and gender-based affirmative action programs much to the dismay of African American and other minority communities who did not perceive affirmative Action in the same light as Connerly. Nearly twenty years later, the
chasm in perception persists. Having left an indelible mark on the history of California’s UC system, today Connerly is President of the American Civil Rights Institute, a national, not-for-profit organization he founded that is aimed at educating the public about the need to move beyond race and specifically, racial and gender preferences. As Proposition 209’s (209) twentieth anniversary rapidly approaches, Connerly recently agreed to an exclusive interview with Voice Media and spoke openly about his advocacy for the Proposition; whether it has met his expectations; what he hopes his legacy will be relative to it. “I was born in the deep south, in Leesville, Louisiana, in 1939,” he began. “Therefore, I have personal familiarity with racial discrimination— and, it’s wrong.” Over the years, Connerly shared, he came to realize that what is called affirmative action, especially at the university level, in his view is a system of discrimination. “I find that to be equally wrong,” he asserted. “As a UC Regent, who was a fiduciary, I took action to right what I saw as a wrong. I did
this a year and a half before 209 came along.” He continued, “I do not have to look past my own multi-racial children to see that when our government draws racial lines through the people, that line runs directly through my family, and no one has the right to do that.” According to Connerly, 209 has lived up to his expectations. He explained he never had any delusions about what 209 would accomplish and whether the attainment of its objectives would happen overnight or in a couple of decades. “I never imagined this road would be an easy one and it hasn’t [been], but it provided a platform that we can build upon. It has forced many government agencies to re-examine their policies and it has triggered court decisions challenging the constitutionality of race preferences. It has enabled us to underscore that affirmative action is not necessarily affirmative—thus, the term, preference. Preferences were well established by the 1990’s, and I wanted to start the process of going back to the days when America aspired to be a ‘colorblind society’. I had hopes that 209 would accomplish that.” Although 209 may have lived up to Connerly’s

featurestory expectations, there are untold numbers of African American and other minority students who come from disadvantaged backgrounds and strived for access to the UC system to no avail. To this he replied, “I was hoping that our society and especially Black students and their families, would understand that the crutch of race preferences was being removed and that substantially increased efforts would go into academic preparation.” He continued, “Being ‘disadvantaged’ is a convenient excuse that should be rejected. The outcome has been disappointing, because very little change in the paradigm has occurred. The presumption of [being] ‘disadvantaged’ still exists.” He pointed to other ethnic groups, including some Whites, who are also disadvantaged. When the playing field is even and they are given access, many minority students from disadvantaged backgrounds successfully compete academically. When Connerly was asked how he weighed this in the context of 209, he provided an example of how Chinese and Vietnamese kids who barely speak English and are very poor, attach great priority to learning and frequently excel; while, on the other

hand, he asserted, “Blacks and Hispanics are presumed to be disadvantaged, yet, some often have few of the obstacles of many immigrant groups. Something is dreadfully wrong with this line of thinking and the rationale highlighted by this question,” he concluded. Some wonder whether an improvement to the quality of education in low income areas could have minimized 209’s impact on minority groups. “The problem lies in the culture of the family.” Connerly insisted. “Until that culture is changed and Black/Hispanic families attach greater importance to academic learning instead of placing blame on high schools, little will change.” “In 1995, when the UC regents ended racebased affirmative action, an elaborate ‘outreach’ effort was initiated. This effort included partnerships between UC and ‘underperforming’ schools, greater mentorships, and a shift from race to socioeconomic factors. This outreach component has been beneficial; but again, the family unit and Black culture with respect to academic endeavors must be dramatically altered.” One example however, that conflicts with Connerly’s assessment is that it took a lawsuit by
minority students and their parents in Los Angeles to expand access to Advanced Placement courses. Such courses give students an opportunity to take high-level classes for college credit and provides an added advantage for college admissions. Much has been written about diminished diversity on UC campuses in the wake of 209. To which Connerly posited, “The claim of diminishing diversity is very debatable. Diversity is a term often used to suggest fewer Black students on campus than the user of that term desires. In reality, every UC campus is quite diverse.” “With respect to Black students, he continued. “First, it is important to understand that many Black students enroll at historically Black colleges and universities, a fact which impairs the ability of UC campuses to be diverse with respect to Black students. Second, the fact is that the pool of competitively admissible Black students is very small. In addition to those who graduate from high school and attend HBCU’s, many Black students attend more selective institutions with the inducement of very attractive financial packages.” Some may argue however, that HBCU’s account for only three percent of the country’s institutions of higher learning and graduate only 20 percent of Black students who earn college degrees—not all of the

ince passage of Proposition 209 in 1996, the rate of African-American students enrolled at UC campuses has declined by more than 10 percent. In the fall 2015, only 3.6 percent of the University of California’s 257,000 students were of African-American descent. In late April, a team of UC faculty members from campuses in San Diego, Riverside, Davis and Berkeley published a report aimed at better understanding priorities for African-American students when choosing which university to attend. According to the report, “California has suffered from a hyper-implementation of Proposition 209 over the past 20 years, where attempts to ensure diversity are under strict scrutiny and UC campuses have moved further away from its public mission, under the California Master Plan—to serve students in the top 12.5 percent of their graduating class. “ The report continued, “Despite the fact that the Supreme Court decision in Grutter (2003) provides campuses with a framework for utilizing race as one factor in a series of admissions variables and factors, Proposition 209 further complicates this possibility
and has remains of color.” The college a African A the Fall 2 Many even thou campuse because to attend the appli One report, h the surve admitted identified those sch in the to had earn positions commun

Earlier this year, a state audit revealed that since 2010, qualified and more competitive minority candidates were passed over for admission to the UC system and less competitive, international candidates with lower GPAs were admitted instead. Connerly explained this affront as merely a budget issue, “If the data is accurate, this phenomenon exists because of financing. To balance its budget, UC admits a number of out of state students who pay more in fees than California residents. This is a function of the budget.” This does not, however, explain why minorities were primarily impacted by this economic strategy. Connerly endured a lot of criticism for his advocacy of 209 including concerns about his motives. “I was sustained by my abiding belief that all Americans should be held to the same standard, regardless of race, color, ethnicity or sex when they seek admission to a publically supported university and my belief that racial discrimination by the government is wrong.” He continued, “The most inaccurate claim was that I didn’t care about the plight of Black kids or that I was seeking to visit harm upon them. This could not be further from the truth. My goal now, and has always been, continued on page 14

demonstrated a political will in California that hostile to historically underrepresented students ” report reflected a statewide examination of the admissions and choice process as experienced by American students admitted to the UC system for 2015 admissions cycle. y of the African American students surveyed said ugh they were admitted to University of California es, they chose to enroll at other universities of the UC system’s lack of diversity, its high costs d and the system’s poor outreach to them during ication process. of the most compelling realities revealed in the however, was the majority of the students in both ey and the interview samples stated they were not d to the UC campuses of their choice—campuses d as highly and moderately selective. Access to hools were denied even though the students were op 10th percentile of their high school classes, ned GPAs of a 4.0 or higher, held leadership s in high school, earned special school and nity recognition, were actively engaged in sports
or extracurricular activities, and/or worked throughout high school. “This elite group of students truly represents a very high achieving pool of high school graduates who are selfmotivated, engaged and committed to the betterment of the African American community and society,” the report confirmed. Fully 64 percent of respondents who turned down UC said they were denied admission to the UC’s most selective campuses like Berkeley, San Diego or Los Angeles; a third said they were only offered admission to UC’s least selective campus, Merced. 67 percent of respondents said diversity was a priority when choosing a campus. Some of these respondents said they didn’t want to be the “only black person.” Also, 84 percent of respondents said the cost to attend UC played a factor in their decision; and, only ten percent said their high school counselors were knowledgeable about UC academic programs and opportunities; provided enough guidance beyond the application preparation process; and encouraged them to apply to UC. Based on these facts, it is not surprising that some of these students who also received acceptance letters
from Ivy League universities, or to other highly selective schools such as Stanford University or MIT, decided to enroll there instead of say, UC Merced for example. It also helps explain why some may have opted for more diverse California State University campuses, private schools or historically black colleges; or chose less expensive universities where in some instances they were offered more generous financial aid packages or, which made them feel more wanted. The report also included a number of recommendations aimed at encouraging more African Americans to attend UC schools such as establishing a single application fee for multiple applications; increasing minority outreach; in addition to increasing financial aid and scholarships. However, little was offered in terms of how to reconcile the number of qualified African American and other minority students who are being locked of the UC’s most selective campuses. to return to the tenets of the 1964 Civil Rights Act—namely, that no American will be treated differently because of race or skin color.” “The rationale of using race-based affirmative action is not a constitutionally acceptable use of race according to the United States Supreme Court,” Connerly stated. (This interview was completed previous to last week’s Supreme Court ruling in the Fisher vs. University of Texas where the Court determined the university’s ‘race-conscious admissions program’ is constitutional). Connerly was asked as an African American, how he personally benefited from the nation’s focus on affirmative action. “This question prompts an explanation about affirmative action. As someone who lived during the days of Jim Crow, to the extent that affirmative action lessened racial discrimination was a benefit to me. I did not benefit, however, from the advanced stages of affirmative action. I received no preferences for university admission or in my business or in any job.” “Education is very important,” Connerly stressed when asked what message he would give African American students to prepare themselves to more successfully compete for admissions to the UC system. “To take advantage of this opportunity all students must be academically prepared. This means that all students must do three things: Study, study, and study,” he offered. According to Connerly his only disappointment with 209 was, “the failure of the Black ‘community’ to take the necessary steps to become academically self-sufficient. The desire to learn has to be instilled by the family. The family unit is our children’s first teachers. They have a great responsibility to start their children on the path to higher education, as a society we need to do whatever we can to help our families do that.” When asked what he would like his legacy to be Connerly responded, “That I was true to my convictions that no one should be discriminated against because of race, color or gender. I believed then, and still do believe, that we can achieve a colorblind society if the government stops discrimination on the false premise of leveling the playing field.”

Proposition 209’s Costly Impact on California’s MBWEs Oakland, CA—As California approaches the 20th anniversary of Proposition 209 most are keenly aware of the impact it continues to have on diversity in the state’s institutions of higher learning. Yet, few may be aware of the costly and distressing blow the Proposition delivered to the state’s minority and women owned business. In 2015, the nonprofit Equal Justice Society (EJS) published a groundbreaking report, “The Impact of Proposition 209 on California’s MWBEs.” The report, released during an informational hearing held by the California State Assembly Committee on Judiciary in February 2015, was presented along with other testimony related to Proposition 209’s impact on public contracting. According to the EJS report, MWBEs have lost the potential equivalent of one billion dollars in public contracts because of the initiative. Beyond putting an end to race conscious programs in the state, the Proposition had unintended consequences that included putting an end to the collection of procurement data related to race, ethnicity and gender in most jurisdictions of the state that had previously collected such information. As a result, the EJS report could only present the potential loss of contract dollars and not the actual dollars lost. When the report was presented, EJS President
Eva Paterson stated, “Taxes from women and people of color help fund public contracts, but are denied equal opportunities to obtain those contracts. She continued, “We often tout the great economic engine of California, and public contracting is a major part of fueling that engine. This report clearly shows that Proposition 209 denied Black, Latino, Asian American, and women-owned businesses equal opportunities to contribute to our state’s economic growth.” The report highlighted how MWBEs were successfully closing the gap between their availability and their utilization by participating in race and gender conscious programs previous to the implementation of Proposition 209. All of that changed however, when the law was implemented; and, some of the businesses never recovered. Although some MWBEs did gain back some of those contract dollars through race-neutral small business enterprise programs, many other procurement and sub-contracting processes remain basically closed to MWBEs as a result of the changes that came with the implementation of the Proposition. As might be expected, some of the biggest losses occurred with the state of California.

NOTICE TO POTENTIAL BIDDERS: If you are considering bidding on this property lien, you should understand that there are risks involved in bidding at a trustee auction. You will be bidding on a lien, not on the property itself. Placing the highest bid at a trustee auction does not automatically entitle you to free and clear ownership of the property. You should also be aware that the lien being auctioned off may be a junior lien. If you are the highest bidder at the auction, you are or may be responsible for paying off all liens senior to the lien being auctioned off, before you can receive clear title to the property. You are encouraged to investigate the existence, priority, and size of outstanding liens that may exist on this property by contacting the county recorder’s office or a title insurance company, either of which may charge you a fee for this information. If you consult either of these resources, you should be aware that the same lender may hold more than one mortgage or deed of trust on this property. NOTICE OF TRUSTEE’S SALE Note: Because the Beneficiary reserves the right to bid less than the total debt owed, it is possible that at the time of the sale the opening bid may be less than the total debt NOTICE TO PROPERTY OWNER: The sale date shown on this notice of sale may be postponed one or more times by the mortgagee, beneficiary, trustee, or a court, pursuant to Section 2924g of the California Civil Code. The law requires that information about trustee sale postponements be made available to you and to the public, as a courtesy to those not present at the sale. If you wish to learn whether your sale date has been postponed, and, if applicable, the rescheduled time and date for the sale of this property, you may call (866)-9608299 or visit this Internet Web site http:// www.altisource.com/MortgageServices/ DefaultManagement/TrusteeServices. aspx using the file number assigned to this case 2015-02237-CA. Fisher v. University of Texas The U.S. Supreme Court voted to uphold an Affirmative Action ruling in the Fisher v. UT Austin case. The court reaffirmed that the value of creating a diverse student body allows university officials to consider race in making admission decisions. The ruling upheld a University of Texas plan that has been the subject of years of legal battles.

Parents v. Seattle and Meredith v. Jefferson
Ricci v. DeStefano
The U. S. Supreme Court decided by a 5-4 margin that public school systems can’t seek to maintain integration through measures that take into account a student’s race, on constitutional grounds. The opinion from Chief Justice John Roberts invalidated moves in Seattle and Louisville that ensured racial diversity. “The way to stop discrimination on the basis of race is to stop discriminating on the basis of race,” Roberts said. Justice Anthony Kennedy didn’t join with Roberts and three other justices in parts of the opinion. “Diversity, depending on its meaning and definition, is a compelling educational goal a school district may pursue,” Kennedy said.
White and Hispanic candidates for promotion in the New Haven, Connecticut, fire department sued after their examinations were discarded because not enough candidates from other racial groups passed their tests. The court ruled 5-4 in favor of the firefighters, and Justice Kennedy wrote the majority opinion. The court decided that plaintiffs had their rights violated under Title VII of the Civil Rights Act of 1964 and the 14th Amendment.

U.C. Office of the President—Race Blind Admissions are Limited Oakland, CA - U.C. President Janet Napolitano has been forthright relative to her position on Proposition 209. In November, 2015, she along with Chancellors from each of the state’s ten UC campuses submitted a “Friend of the Court” brief and weighed-in on behalf of the University of Texas in the recently decided Supreme Court case, Abigal Noel Fisher v. University of Texas at Austin, et al. The University of California (UC) is the largest, highly selective institution of higher education in the nation with ten campuses located around the state. It provides undergraduate, graduate, and professional education to more than 246,000 students. In addition, California is the most diverse state in the nation. In 2012, the state’s high-school graduates were 30.5 percent white, 46.2 percent Latino, 13.6 percent Asian or Pacific Islander, 6.7 percent African American, and 0.7 percent American Indian. The state’s UC admissions policy seeks to enroll on each of its campuses, a student body that, beyond meeting the University’s eligibility requirements, demonstrates high academic achievement or exceptional personal talent; and, that encompasses the broad diversity of cultural, racial, geographic, and socioeconomic backgrounds characteristic of the state. According to Napolitano, as expressed in the ‘Friend of the Court’ brief, claimed “It is the policy of UC that there is a compelling interest in making sure that people from all backgrounds perceive that access to the University is possible for talented students, staff, and faculty from all groups.” The brief continued, “The knowledge that the University of California is open to qualified students from all groups, and thus serves all parts of the community equitably, helps sustain the social fabric of the State.” UC’s policies further recognize the educational importance, not just of having diverse students on campus, but of ensuring meaningful interactions among them. And UC provides a compelling illustration of the broader educational context in which race-neutral and race-conscious policies must be evaluated.
There is little question as expressed by Napolitano and others, “UC is central to the national debate over policies governing admission of underrepresented minority students to public universities.” Nearly twenty years ago in 1996, Californians passed Proposition 209 and amended its constitution to prohibit race conscious measures in college admissions. As a result, the UC experimented with a variety of alternative ways to promote diversity and ensure access for qualified under-represented minorities; but, those efforts have failed to produce a single effective alternative. “UC’s experience thus sheds light on the practical obstacles faced by universities that seek to promote diversity, while also furthering other crucial educational objectives, but are barred from any use of race as a factor in admission decisions,” Napolitano and the team surmised in the brief and continued, “The University of California belongs to the people of California and race-blind admissions have curbed our ability to fully engage the learning potential found among this state’s diverse population.” When the U.S. Supreme Court ruled recently in favor of the University of Texas in the case of Abigal Noel Fisher v. University of Texas at Austin, et al, the U.C. Office of the President stated, “[The] U.S. Supreme Court decision upholding the use of race-conscious measures in college admissions will contribute to greater equity and participation in public higher education for all American students.” “While it is good news on a critical issue for the country,” the statement continued. “The decision does not directly impact the University of California.” This is because Proposition 209 provides a blanket prohibition on preferences based on race, even if there is a compelling government interest to do so and the practice is narrowly defined. “Nonetheless, the University will continue to do everything possible within the constraints of state law to broaden educational opportunity and increase the diversity of the student populations at all 10 University of California campuses.”
