When it Comes to Promises Made, It’s time for Transparency

W

hen Jeff Bezos, founder, chairman, president and CEO of Amazon abruptly announced plans to withdraw from his agreement to build a new corporate headquarters in New York late last month, it reverberated around the nation—after all, there was stiff competition among municipalities across the country for the privilege of having the warehouse giant locate its second headquarters in one of their cities.

The announcement was greeted with exhaustive debates over whether the left wing of the democratic party had scored a victory against big business by raising awareness over the amount of corporate welfare—or, as the politically correct call it, tax incentives—that Amazon was promised in the deal. Those incentives totaled at least three billion dollars.

Some who opposed the warehouse incentives were criticized as naïve. In other words, it was said they failed to understand the complex and sophisticated economic structure of the agreement. Really? I think most people understand enough to know that if a corporation is not paying its fair share of taxes whether today or stretched out over years—something goes un- or underfunded.

It was a reminder that communities must look beyond the quality and quantity of jobs being offered when a big corporation like Amazon competes to put down stakes in your region.

Citizens must also examine what the community is giving up in exchange for those jobs—jobs that at times, fall short of what was initially promised.

Recently, Assemblymember Jose Medina (D-Riverside) introduced Assembly Bill (AB) 485 to provide increased public transparency of warehouse development projects funded using tax payer dollars.

Medina noted how warehouses have grown tremendously in the Inland Empire in recent years. For example, in 2018 nearly 65,000 individuals in the region worked in warehouse jobs.

He stressed however, that although “warehouses can be seen as a great job creator and tax revenue generator,” data collected over time paints a different picture about the long-term impact warehouses can have on a community including challenging working conditions, poor benefits, and automation. Also, there is the issue of tax incentives.

Often when cities enter bidding wars to assure a warehouse is built in their community, the tax incentives and other benefits offered a warehouse builder like Amazon, receive little public attention. That must change.

I believe Medina summed it up best when he stated, “If cities are going to spend millions in taxpayer dollars to bring these jobs to their communities, at the very least there should be some assurances that workers will be paid a living wage and have adequate safety protections.”

Medina’s legislation AB 485 will increase transparency so that when such decisions are made, tax payers will be more aware of the promises being made regarding their tax dollars and the long-term implications of those promises.

Medina’s legislation will help us understand and as a result, better control how our current tax dollars are spent, and future tax revenue is assigned. Of course, this is just my opinion. I’m keeping it real.

Supervisor Chuck Washington Receives Inaugural Family Justice Award Temecula

R

iverside County District Attorney Mike Hestrin recently presented Riverside County Supervisor Chuck Washington with the first-ever Michael A. Hestrin Family Justice Award in recognition of his dedication to protecting the county’s families.

The presentation was made earlier this month during an annual meeting of the Safe Alternatives for Everyone (S.A.F.E.), a nonprofit that provides services for children, youth and families who have experienced or are at risk of abuse and violence.

of the organization’s board member and has supported S.A.F.E. for many years.

New Lab Expands Access to Advanced Care at RUHS Medical Center Moreno Valley

A

new Heart, Neuro and Vascular Cath Lab at the Riverside University Health System— Medical Center will expand services for heart and neurovascular patients in the region.

The fully integrated $4.3 million GE lab includes imaging equipment to visualize the heart and other cerebrovascular structures, and a special system to monitor blood flow throughout the body.

Officials stressed how having a cath lab opens the door for RUHS Medical Center to become a receiving center for patients experiencing one of the deadliest forms of heart attack—an STElevated Myocardial Infarction (STEMI).

This condition requires rapid intervention.

Riverside Prepares for Another Energy Farm

I

n his recent State of the State address California Governor Gavin Newsom called on the cities and counties to address the state’s housing crisis.

Newsom followed those comments with a meeting of mayors in Long Beach last week where he highlighted how cities and counties can be important partners with the state in addressing this important issue.

Part of the day’s session included a tour of an affordable housing development in Long Beach, one of the cities he identified as working hard to help address the housing needs in the region.

The 27-acre supportive housing community provides temporary, transitional and permanent affordable housing for veterans, families, youth and children. According to city officials, it serves more than 1,000 individuals on any given day.

During the State of the State address the governor celebrated municipal leaders he

perceives as doing their part to meet housing demands. Newsom also highlighted the $1.7 billion he’s budgeted to provide assistance and incentives to municipalities that plan and zone for housing production.

Using a “carrot and stick” approach to leadership on this issue, the governor also noted the probability of state assistance to cities whose continued on page 17

Mecca – Riverside County recently announced preparations to begin construction on another energy farm, this one located in the Lower Coachella Valley community of Mecca.

The project which officially broke ground last week is expected to provide more than 400 jobs and upon completion will generate nearly 97 megawatts from 300,000 solar panels that will be spread across nearly 500 acres.

The Sunpin Solar’s North Shore Solar Project will be counted among the county’s solar energy plants, many of which are situated in the Palo Verde Valley and the eastern desert region.

Most of the county’s prime wind energy farms are spread across the lower San Gorgonio Pass into Palm Springs.

Got arthritis? Keep moving

O

steoarthritis is something nearly all of us can expect to face if we live long enough.

A quarter of the population has it, and the percentage is expected to rise significantly in the years ahead. Two-thirds of people with arthritis are younger than 65, the Centers for Disease Control and Prevention report.

Arthritis affects more than 52 million adults in the United States and is the most common cause of disability, the CDC states. Yet it often takes a back seat to other chronic ailments in treatment and public awareness.

When the pain of arthritis results in a decline in physical activity, as it commonly does, the risk of developing a chronic health problem like heart disease and Type 2 diabetes rises and performing the tasks of daily living becomes increasingly difficult.

Research shows that regular physical activity is essential to slowing arthritis progression

and maintaining mobility as you age. Although several commonly affected joints — hips, shoulders, ankles, wrists and elbows as well as knees — can be replaced by artificial ones, not everyone affected is a candidate for surgery, and the operation itself leaves some people with activity limitations.

Arthritic pain and disability often force people to abandon activities they love. Some stop moving altogether, brood over what they had to give up and become depressed.

The trick to not losing quality of life is to find a substitute for the activities limited by arthritis. Can’t play golf? Can’t garden?

What can you do? Walk, swim, walk in water — anything that gets you moving. The bottom line: As we get older, if we don’t get up and

move around as much as we can, then we soon won’t be able to move at all.

Establish a routine of light weight bearing exercise, daily waking, swimming, yoga, dancing, Pilates or other movements for a minimum of 150 minutes a week.

The key is to just keep moving. Lack of mobility as you age is detrimental to your health, your independence, and your quality of life.

Mayor Warren Goes to Washington Washington D.C.

F

ontana Mayor Acquanetta Warren recently spent time in Washington D.C. where she participated as a panelist in a National Association of Workforce Boards’ roundtable discussion of workforce development issues at the local level. Another example of Warren’s commitment to change the perception of manufacturing and connecting businesses to a labor pool that is job ready.

The panel discussion was not the only meeting she attended in D.C. She also met with the controversial Secretary of Education Betsy DeVos, to discuss how business and education can collaborate to better prepare students for future careers.

Just before her trip to Washington, Warren held a local business, manufacturing and education roundtable in partnership with the Fontana Chamber of Commerce as part of the Mayor’s Manufacturing Council.

At the session Warren told the group of attendees that she was heading to D.C. to advocate for resources to establish apprenticeships and internships for youth.

“It is an honor to work on behalf of the people of Fontana and share our challenges and workforce needs with our nation’s decision makers,” she said. “Our work is only beginning, but I’m confident that together with our businesses and educators, we will bring results.”

Warren was recently appointed Chair of the Manufacturing and Career and Technical Education Task Force by the U.S. Conference of Mayors. She will continue working with her Mayor’s Manufacturing Council and the Fontana Chamber of Commerce to bridge the gap between the business community and educators to ensure students are prepared for today’s workforce.

Mayor Warren was elected as the City of Fontana’s first female and African-American Mayor in December 2010.

Hillside Elementary School Holds Third Annual Mini Black History Bee

n Monday, February 25th, Hillside Elementary School in San Bernardino held their third annual Mini Black History Bee. Gayle Henry, third grade teacher, and Martie Goss, fifth grade teacher, have been partnering for the past couple of years to create an event for students across the elementary school to feel supported.

The San Bernardino School District holds a large, annual event called the Black History Bee, which is starkly more competitive. Henry was putoff by the nature of this Black History Bee and decided to carve out a lane for her students. “We call it the Mini Black History Bee,” Henry explained.

“That way, for all of our kids, there’s no loser so to speak.

“At the district, you get out, you’re out. The kids have studied all these names and I’m like, I don’t want to do it like that. So, we decided to come up with the Mini Black History Bee and we’ve been doing it for a couple of years.” At the district level, the students are expected to know 200 names, while with the Mini Bee the teacher’s tried to make it more manageable by creating categories with five to six names per section.

up. They practice two to three times a week, with Henry’s group meeting after school and Goss’ meeting before school. The teachers enjoyed the process leading up to the Bee. “[Ms. Henry and I] both worked together to coordinate the event, but we both came together with how we were going to study. I made quizzes, Kahoot!’s, jeopardy games to make it more fun.

Then once that was done, I got to sit back and watch them play games while they learn the material.”

To Henry and Goss, the most rewarding part is how the students come back for more. “The students keep coming back!” highlighted Henry.

“They want to be participants.” One parent chimed in that her seventh grader, who had graduated from Hillside, was whispering the answers to her from the audience because she still remembered the curriculum.

The program was structured with the first round of competition, during which the Ms. Henry would randomly draw a question from the bowl and the judges (parent volunteers) would confirm if the student’s answers were correct or not.

Independent Contractor or Employee?

2018 Dynamex Ruling Continues to Roil CA Businesses - Part 2 “We Don’t Want to Be Employees!”

ver the years, beauty salons and barber shops have come to provide a unique social function. . . Scholars often cite these sites as “sanctuaries . . . locations where Black people could be vulnerable and talk about issues of importance in the community.” With these few words, the Smithsonian captured the essence of these institutions.

Beyond the primary position of Black churches in the African-American community, barbershops and beauty salons hold a key place as a hub where community, culture and commerce intersect; where young Black people see the promise and possibility of entrepreneurship, where issues related to the health and wellbeing of Black people are weighed in the balance of society at-large, and where political fortunes can rise or fall.

Now, however, there is growing concern this may all be about to change—at least here in California. A ruling by the state supreme court in “Dynamex Operations West, Inc. v. Los Angeles,” last April, called for the reclassification of many independent contractors—a group considered the backbone of the Black haircare and other industries. This could push many individuals out of business and/or change the significant role barbershops and beauty salons play in Black culture and politics.

With its ruling, the court abandoned a standard used for years to determine a worker’s status as employee versus independent contractor.

The ruling seemed perfect for the Dallas-based truck drivers who filed the claim against Dynamex because the company had wrongfully reclassified its drivers as independent contractors, possibly to avoid the associated overhead costs associated with employees which can cost businesses an additional 20 to 30 percent. Although the ruling may be perfect for Dynamex drivers, it delivered a major blow to the Black Hair Care industry among others.

In considering the Dynamex case, the court found there was no specific definition of what an independent contractor was in California, nor were there clear guidelines regarding who should qualify as an independent contractor. The supreme court attempted to create clarity on this issue with the Dynamex ruling.

Now, several segments of the economy are left wondering whether the court’s strict “ABC” requirements for classification as an independent contractor, will now disqualify them as such in industries like construction, transportation, manufacturing, retail, agriculture, professional/business services, etc.

F E A T U R E Although difficult to quantify, by some estimates there are as many as 100,000 practitioners in the beauty business in California which includes barbers, beauticians, manicurists, etc. that might be impacted by the Dynamex ruling.

Black barber/beauty shops owners and operators are working to understand what the Dynamex ruling means to their business models, and whether complying with the new “ABC” test for independent contractors will be too cost prohibitive for them to continue in business.

One industry entrepreneur is committed to educating the members of the hair care community about this issue and advocating for legislative relief in relation to the Dynamex standard.

Lorenzo Griffin has been in the hair industry for nearly 33 years. “I started out working for Dudley’s Q® Hair Care Products, a wonderful company, for twenty years,” he began. “My wife [Wanda] and I started Laran Hair Care Products for Salon Professionals and we now market our products exclusively in beauty shops, barbershops, and beauty schools.”

Because of their business, the Griffins are in the unique position of seeing the hair industry from all angles. “The beauty salons and barbershops are retail centers for our products,” he explained. The Griffins have made a business choice to market only to Black salons and barbershops versus beauty supply stores (most of which are not Black owned) as a way to help ensure their Black dollars are recirculated within the Black community.

Recycling Black dollars is important to strengthening the African-American community.

The NAACP reported last year, “African-American buying power is at $1.1 trillion; and yet, only two cents of every dollar an African-American spends in this country goes to Black owned businesses.”

The organization further stressed—a dollar circulates in Asian communities for a month, in Jewish communities for about 20 days, White communities for 17 days, but in the Black community—a dollar circulates for only 6 hours.

This limited circulation coupled with the reality that African-Americans are about 14 percent of the nation’s population but are only responsible for 7 percent of the nation’s small businesses— presents one more reason to be concerned about any ruling that will erode the entrepreneurial base of this community—a very real possibility for barbershops and beauty salons with the Dynamex mandate.

Griffin learned about the Dynamex decision as

a member of the Professional Beauty Association (PBA), a multi-cultural organization with nearly 100,000 members focused on issues of importance to the beauty industry. He also got news of the decision from a Northern California hairstylists and friend, Carmen Richardson, who posted information about the ruling on Facebook.

Griffin immediately thought about the impact the court’s ruling could have on Blacks in the industry and got busy spreading the word. His efforts have taken two tracks. First, he remains in close contact with PBA and the organization’s lobbying efforts in Sacramento. Secondly, he has worked with clients like Menifee-based hairstylists, April Furnace, who connected Griffin with a human resources expert who has supported Griffin’s efforts to help strengthen the barber/ beauty community’s understanding of the court ruling.

“I’ve had a total of four meetings on this topic,” Griffin shared as he acknowledged the meetings were so well attended, there was standing room only. “I’ve met in Ontario twice, Hawthorne once, and San Diego,” he added.

Some of the meetings featured Human Resources Specialist, Marcel Furnace. “He gave a lot of really good information.”

PBA Attorney Daniel Muller also participated in one of the sessions. “He also gave a lot of good information as well as a sense of hope that we can persevere if we modify our businesses adequately.”

The modifications recommended Muller included the importance of having a Cosmetology license, “Most already do,” Griffin stated.

According to Muller, the stylist should also have a business license in the city where they work, liability insurance for their business and importantly—a contractual agreement between the salon owner and the hair stylist confirming that the stylist is totally independent.

According to Griffin the language might also include something to the effect that the stylist comes and goes as he/she wants, collects his/her own money, and that the stylist is not mandated to attend any meetings—that he/she operates totally independent.

It is these four points, Griffin proclaimed that keep the stylist from being classified as an employee.

The Dynamex ruling established what is referred to as the ABC’s for qualifying as an independent contractor: (A) that the worker is free from the control and direction of the hirer in connection with the performance of the work, (B)

that the worker performs work that is outside the usual course of the hiring entity’s business, (C) that the worker is customarily engaged in an independently established trade, occupation, or business of the same nature as the work performed for the hiring entity.

Griffin noted how Muller, as a labor law attorney, stressed that under Dynamex ruling (B), “You cannot provide the same services that the owner provides unless you are an owner of that business.”

Griffin added, “99 percent of stylists do not want to be an employee; and 99 percent of salon owners do not want the responsibility of having them as employees.”

He added adamantly, “In our industry, you can’t just sit down at your styling chair and expect to get paid a salary. That’s just not how the system works.”

The fact that the Dynamex decision was a ruling that came down regarding a transportation company where the truck drivers wanted to be employees is just the opposite in the beauty business, Griffin explained. “Most don’t want to be an employee, that’s why they chose the beauty industry—they can make more money as an independent operator,” he pointed out noting that one professional told him, “’Hair stylists would go home and do hair in their garage before they become an employee.’”

Griffin acknowledged the Dynamex decision affects all ethnic groups in the beauty industry but stressed, “it [the beauty industry] is the last economic stronghold in the Black community.”

“You can go into any city across America and most of the Black-owned businesses will be beauty salons and barber shops,” he highlighted. “That’s a fact. The beauty industry is the second largest social institution in Black

America—the first social institution is the church—the second largest is the beauty salons and barbershops.”

The importance and impact of this institution within the Black community can not be overstated. “When Obama ran for president, we had all of our salons and barbershops and beauty schools promoting for him and getting the word out,” Griffin confided. “Right now, we need Kamala Harris in our corner,” he said noting the important role legislators can play regarding this issue.

Currently there are at least two pieces of Dynamex related legislation being considered in Sacramento.

Neither of which addresses what Griffin believe is most important.

One measure being considered, AB 5, calls for the

Dynamex decision to be codified into law, while the other, AB 71, seeks to overturn the Dynamex decision and reinstate the old rules.

Griffin on the other hand believes, “If the trucking industry wants it, that’s fine. They can be employees. But,” he continued, “the beauty industry does not want it. They do not want to be employees.” Griffin instead supports legislation that will exempt the beauty industry from the mandates of Dynamex.

He also focused on another danger wrought by the Dynamex decision. “Another reason its going to hurt the Black beauty salons more severely than any other group is because there are chains of salons called Sola or Phenix with private suites.” According to Griffin these suites provide everything needed for a stylist to meet the mandates of Dynamex.

Griffin wonders how these companies got ahead of the game as it relates to the independent contractor requirements of Dynamex. He also expressed concern that some Black stylists are now leaving Black owned salons, going into these White owned establishments and renting their private suites instead. “Some of them have between 25 and 50 private suites in each location,” he declared adding, “A week doesn’t go by that I don’t learn of a Black stylist that has left a Black owned salon and gone into one of these White owned establishments to rent one of those private suites.

“A lot of the Black own salons do not have the resources handy to convert their salons to private suites and/or they and may not have the room.” Although Griffin and others are working to educate stylists on how to meet the letter of the law as independent contractors, Dynamex still presents roadblocks.

“If you go word for word with the Dynamex decision,” Griffin explained, “it has to be a suite; but the attorney says if you have those four points

[cosmetology license, business license, insurance, and rental contract as an independent operator], he can defend it in a court of law.”

Griffin quickly noted however—most stylists do not want to go to court. “They want whoever is policing the industry to be able to come into their business and say, ’this person is in compliance— period.’ When you are an entrepreneur, time wasted in the court system is equal to wasting money.”

Griffin is dedicated to seeking a solution to the challenges presented by Dynamex. “You’ve got to take a stand for a cause you believe in,” he stressed, “something that will be fair to the people in the industry and to the state.”

He and his wife plan to continue their efforts of informing as many as they can using social media outlets, etc. They also hope to get someone in the legislature to sponsor a bill to exclude the hair industry from the Dynamex ruling.

“We do not want to be employees,” he stated again. He also strongly encouraged every state politician, “because they all get their hair done—to speak with their stylists. They should talk to their beauty professionals. See what their thoughts are. Question them. Ask, would you like to be an employee or a contractor? Why?” Dynamex is already in effect, he noted. “[The state] just doesn’t have all the resources needed to police the industry; but, no one wants to have someone looking over their shoulder every day wondering—when the other shoe is going to drop!”

Hairstylists choose the industry because they want to be their own boss. “We are job makers and not job takers. Nobody can lay you off in the beauty industry, but you. Skills pay the bills,” he said, “Once you’ve developed your skills, you won’t have any problem paying the bills.”

Hispanic Access Foundation Hosts First Community Roundtable

n Monday, February 25th, the Hispanic Access Foundation held its first community roundtable at the Ayres Hotel in Redlands.

The Hispanic Access Foundation connects Latinos with partners and opportunities to improve lives and create an equitable society.

The organization’s vision is that one day every Hispanic individual in America will enjoy good physical health and a healthy natural environment, a quality education, economic success and civic engagement in their communities with the sum of improving the future of America.

The event was curated by Christine Tamara, San Bernardino County Coordinator for the Hispanic Access Foundation, and Jennifer Brandt Deputy Director of Conservation Programs at Hispanic Access Foundation.

The evening consisted of several panels to allow the community to hear from and connect with experts about the benefits of public land.

The panelists represented the following fields: health professionals, veterans, business interests, educational leaders, leaders of energy companies, and parks and environmental justice groups from around the Inland Empire. “We’re having folks from St. Joseph Health, Vet Voice Foundation, from the Nurses Union, the 29 Palms Tourism Development and Improvement District, Mojave Desert Land Trust, Nature For All, The Wildlands Conservancy, Spanish Town Heritage Foundation, Old Spanish Trail Association and Blu Education Foundation,” highlighted Brandt.

The opening statements were from the invited elected officials and For La Creación Faith-based Alliance Pastor Rolando Morelli.

The four panel topics included discussion on how public lands benefit physical and mental health, help local economies, help child development and bring communities together, and protect water, people and environment. “This is the first time we’re doing this kind of event,” commented Jennifer Brandt.

“We really want to celebrate the public lands and broaden the circle that’s talking about this, we’ve worked on protecting the California desert for years now and worked with a lot of the same partners,” Brandt continued. “We really want to have this conversation with the health continued on page 17

Smart City Initiative Receives a Financial Boost Ontario

T

he City of Ontario’s quest to one day establish a smart city corridor in its historic downtown received a financial boost recently when the city was awarded a $418,000 grant through the Southern California Association of Governments’ (SCAG) Future Communities Pilot Program.

The funding will support a series of integrated pilot projects designed to bring smart city applications to the downtown area. The design includes a physical space/hub, where community members, local companies and government agencies will have access to technology and data to better address issues and needs in the city and explore innovation opportunities.

The hub will be located within a city-owned building on historic Euclid Avenue and will bring together innovators, entrepreneurs and community stakeholders to explore ways to leverage the city’s extensive broadband networks and infrastructure under a smart city model.

The hub will offer co-working spaces, small business support and other features to help promote and incubate innovative and scalable new ideas and solutions. One area of emphasis will be technology development in the commerce and logistics industries.

Specific projects being developed and evaluated

using a rapid validation approach includes the use of technology, sensors and data analytics to study multimodal transportation patterns, create affordable bikeshare docking systems and intelligently collect commercial refuse.

“We’re excited to be selected for this important pilot program and to put into motion our smart city vision for the downtown area,” said Ontario

Mayor Paul S. Leon. “Ontario is fast becoming a technology and innovation hub for the region, and this plan opens up a whole new world of opportunities for us. Following a tour of the Long Beach housing facility the governor met with mayors of cities whose housing plans are currently out of compliance with state law where he offered the state’s support in helping each of the cities come into compliance.

The governor demonstrated his serious commitment to affordable housing when the state filed suit against the coastal city of Huntington Beach late last month for what he described as the city’s failure to cooperate with the state’s push for affordable housing. The city council has continued to defer action in this regard. For example, in 2016 the council voted to reduce affordable housing in the area after many of its citizens expressed opposition to high-density and low-income developments.

The lawsuit against the city reads in part, “The time for empty promises has come to an end. The city should not be allowed to avoid its statutory obligations any longer.”
