PROPOSED ORDINANCE: “DOMESTIC WORKERS AND HOUSEHOLD SERVICE PROVIDERS REGISTRATION”
PROPOSED BARANGAY ORDINANCE NO. 3 - 1, S-2024
“A BARANGAY ORDINANCE REQUIRING ALL DOMESTIC HOUSEHOLD HELPERS AND HOUSEHOLD SERVICE PROVIDERS TO BE REGISTERED IN THE BARANGAY REGISTRY OF DOMESTIC WORKERS AND TO SECURE BARANGAY ID UPON EMPLOYMENT AND RENEW THE SAME ANNUALLY.”

WHEREAS, Sec 390, Section 1 of the Local Government Code of 1991 states that “The Sangguniang Barangay, as the legislative body of the barangay, shall enact ordinances as may be necessary to discharge the responsibilities conferred upon it by law or ordinance and to promote the general welfare of the inhabitants therein”;
WHEREAS, for efficient, effective and economical governance, the purpose of which is the general welfare of the barangay and its inhabitants pursuant to Section 16 of this Code, the punong barangay shall enforce all laws and ordinances which are applicable within the barangay;
WHEREAS, Art III, Sec 17 of RA No 10361 or the Batas Kasambahay states “that employers shall register all domestic workers under their employment in the Registry of Domestic Workers in the Barangay where the employer’s residence is located”;
WHEREAS, in the maintenance of security, peace and order employers should require their kasambahay including drivers, cooks, gardeners and other service-oriented employees or similar to be registered in the Barangay and to secure Barangay ID;
WHEREAS, this barangay had many cases wherein an employed domestic worker transfers from one household to another within the Barangay and fails to renew their Barangay ID to state that they are now working for a new employer;
WHEREAS, this Barangay would be able to keep the necessary information of all those who secured Barangay ID for security and census purposes;
WHEREAS, employers would be able to retrieve their employee’s records from the barangay if necessary or when any instance arises;
NOW THEREFORE,
BE IT ORDAINED, BY THE BARANGAY COUNCIL OF BARANGAY SAINT IGNATIUS, DISTRICT III, QUEZON CITY, IN THE REGULAR SESSION ASSEMBLED:
SECTION 1. This Ordinance shall be known as the “Domestic Workers and Household Service Providers Registration”.
SECTION 2. Objective - This Ordinance is created for the following reasons:
a For the security and protection of every Domestic Employer in this barangay;
b To establish legal identity;
c To have quick access to information of a domestic employee;
d For the domestic employees to be able to avail of the programs and benefits from the barangay;
e To be able to identify and plan easily the programs and activities that are applicable to domestic employees of this barangay;
f To be able to address issues related to domestic employees;
g. To be able to provide targeted and effective social and health services.

SECTION 3. Coverage - Each household shall have their Domestic Worker including general househelp, "yaya" or caregiver, cook, gardener, laundry person, and Household Service Providers including family drivers, secure a Barangay ID and register in the Barangay Registry of Domestic Employees
SECTION 4. Definition of Terms - As used in this Ordinance, the term:
a. Barangay Identification Card or Barangay ID refers to proof of identification and information of a person residing in this barangay, whether permanent or transient.
b Domestic worker refers to any person engaged in domestic work within an employment relationship such as, but not limited to, the following: general househelp, nursemaid or “yaya”, cook, gardener, or laundry person, but shall exclude any person who performs domestic work only occasionally or sporadically and not on an occupational basis
c Employer refers to any person who engages and controls the services of a domestic worker and is party to the employment contract
d Household refers to the immediate members of the family or the occupants of the house that are directly provided services by the domestic worker
e Household service provider refers to persons who provide service in the employer’s home which is usually necessary or desirable for the maintenance and enjoyment thereof and includes ministering to the personal comfort and convenience of the members of the employer’s household, including services of family drivers.
SECTION 5. Requirement for Applicants of the Barangay ID - All Domestic Workers and Household Service Providers applying for registration and for issuance of the Barangay ID, whether for the first time or reapplying, shall submit a Duly accomplished ID application form issued by the Barangay
SECTION 6. Charges for the Issuance of a Barangay ID – The Barangay shall levy Php 50 00 for the issuance of each Barangay ID Card
SECTION 7. Surrender of Barangay ID – Domestic workers shall be required to surrender their Barangay ID to the Barangay in the following instances:
a. Upon expiry of the validity of the issued Barangay ID;
b. Upon termination from his/her employment;
c. Upon retiring from his/her employment; or
d Upon switching to a new employer who is likewise a resident of this Barangay
SECTION 8. Replacement of Lost Barangay ID – All persons applying for replacement of their lost Barangay ID shall submit and affidavit of loss together with an accomplished ID form An amount of Php 50 00 shall be charged for the replacement of the ID
SECTION 9. Validity – A Barangay ID issued by the barangay shall be valid for a period of one (1) year from the date of issue
SECTION 10. Penal Clause - All those who will be found or apprehended not to be complying with this Ordinance shall be penalized with a fine of One Thousand Pesos (P1,000.00) and non-issuance of Barangay Certification for whatever purpose they may need them.
SECTION 11. Repealing Clause - All Ordinances, Resolutions, Executive Orders, Memorandum Circulars and Administrative Orders or parts thereof which are inconsistent with any provisions of this Ordinance are hereby repealed or modified accordingly
SECTION 12. Separability Clause - If any provision of this Ordinance is declared void or unconstitutional, the remaining portions shall not be affected and shall remain in full force and effect
SECTION 13. Effectivity - This Ordinance shall take effect immediately upon review and confirmation by the City Council of Quezon City
