Notice is hereby given that the City Council of the City of Brentwood will, at 7:00 p.m. or as soon thereafter as the normal course of business permits on January 12, 2021, hold a public hearing to consider:
A rezone (RZ 20-006) to amend Section 17.030.030 (Definitions) and Section 17.100.005 (Accessory Dwelling Units), Section 17.100.005 (Accessory Dwelling Units), and Section 17.620.007 (Off-Street Parking Spaces Required - Residential Zones) of the Brentwood Municipal Code related to accessory dwelling units, updating the City’s ordinance to comply with recent changes in State legislation and implement Government Code Section 65852.2. Zoning ordinance amendments to conform to Government Code Section 65852.2 are statutorily exempt from CEQA under Public Resources Code Section 21080.17. In addition, amendments to conform to Section 65852.22 are exempt under the common sense exemption, found at CEQA Guidelines Section 15061(b)(3), in that it can be seen with certainty that there is no possibility that adoption of the amendments will have a significant effect on the environment, in that junior accessory dwelling units under Section 65852.22 will have no greater impact on the environment than those associated with the residence to which such units will added. On December 1, 2020, the Planning Commission held a public hearing to consider the draft ordinance and unanimously adopted Resolution No. 20-044, recommending the City Council approve the draft ordinance. Consistent with Contra Costa County Health orders, and in accordance with California Government Code Section 54953(b) and Governor Newsom’s Executive Order N-29-20 concerning teleconference meetings, this City Council meeting will be held exclusively via teleconference, using the WebEx video conferencing system. Newly elected District 3 Councilmember Susannah Meyer and District 1 Councilmember Jovita Mendoza pushed for Rarey’s appointment, but a council consensus didn’t materialize until Vice Mayor Johnny Rodriguez broke a stalemate by agreeing to appoint Rarey, minutes after he voted against the idea and in favor of an application/appointment process.
Rodriguez said that his reversal was to avoid a costly special election, which state law dictates had to occur if the council had not come to a consensus by early February.
“I don’t feel comfortable spending $200,000 to $280,000 on a special election,” he said. “We have businesses, we have families that are suffering, we have other things that we can do with that type of money … I do want to say, though, that I am not comfortable with taking the second mayor votegetter, but I am also not comfortable taking money from the people.”
Mayor Joel Bryant, who also initially favored an application/appointment process, flipped to favor Rarey’s appointment, noting that his vote in favor of Rarey was an effort to move forward in unity and do what was best for the community.
There have been an estimated 18 council vacancies in the city, dating back to 1949, with 16 filled by appointments. At least two of those 16 appointments went to the nexthighest vote-getter, city officials said.
Rarey’s appointment appears to align with a city-initiated community survey that found that 66% of 2,956 participants favored appointing the second-highest-voted mayoral candidate in the November election. About 20% of respondents favored an interview/appointment process at a public meeting, and 14% an all-mail-ballot special election.
Mendoza, an analytics manager, said those results spoke for themselves.
Meyer said the mass amount of resident support for Rarey sealed her decision. “I think the fact that our residents have spoken out as many times as they have, and the amount of numbers that they have, I could not live with myself, I could not go to sleep at night if I didn’t respect their voices,” she said.
Residents continued to speak out in support of Rarey this week.
“Karen has always exhibited a keen sense of objectivity; does her research; benchmarks against best practices and other cities and often changes council action for the better,” said resident Kathy Griffin.
Fellow resident Sandra Myers agreed.
Rarey said she was overwhelmed with the community’s support, and she looks forward to getting back to work.

As the Bay Area’s ICU capacity has not yet recovered, it is likely that the order will be extended into the foreseeable future.
Hospitalizations in the county remain near peak levels. As of Dec. 29, 247 patients are hospitalized with confirmed COVID-19 infections. The peak to date occurred Dec. 27 at 257 patients.
There have been 39,376 confirmed COVID-19 infections in the county with 331 related deaths. Nearly half of those deaths were residents of a long-term care facility.
As an indicator of how quickly the pandemic has grown recently, the City of Brentwood has reported 1,944 cases since the start of the pandemic in March. Of those, 23% of the cases have been reported in just the last two weeks. Similar patterns of infection rates have been observed in Oakley where 26% of the total cases have occurred in the last 14 days, and Discovery Bay where 27% of its cases have been recorded in the same period.
Newsom announced Monday that California has opted in to the federal COVID-19 Pharmacy Partnership. Under this partnership, CVS and Walgreens will administer the Pfizer vaccine to residents and staff in long-term care facilities. Those pharmacies will start with nursing homes, which will take an estimated three to four weeks, and then vaccinate staff and residents in assisted living, residential care and other long-term care facilities. Pharmacists, pharmacy technicians and nurses will administer the vaccines. Pharmacy technicians are participating under a recent waiver by the Board of Pharmacy that requires appropriate supervision under California law and specialized training.
“Vaccinating those most vulnerable among us is critical to fighting this virus,” Newsom said. “By leveraging CVS and Walgreens resources, we can effectively deploy vaccines to residents and staff at our long-term care facilities, which are at higher risk of COVID transmission — and do it at no cost to the state or local government.”

Now that Williams is fully involved in the city’s direction after nabbing one of three up-for-grab council seats, she believes a better Oakley is one in which residents don’t need to commute to San Francisco or San Jose for work; the city does its part to support the fire district; the council fully evaluates every proposed development project; unique small businesses open, drawing visitors from near and far; and children have as many resources as the city can provide.
She believes all that can materialize as the city continues to run its required lean budget, with employees often juggling multiple jobs out of necessity.
“I appreciate a city that can run a nice lean budget and people will step out of their regular role just to get something done, and I think now as a city council, we need to make sure that is happening across the board with everything,” Williams said.
New Oakley Mayor Sue Higgins said she welcomes Williams and fellow newcomers Aaron Meadows and George Fuller, applauding their eagerness to learn early on.
Williams said she expects the trio of new councilmembers to bring a fresh perspective to the city’s future, something residents clearly wanted.
She encourages all residents to speak up early and often to help the council serve its constituents. The first council meeting of the new year is set for Jan. 12, at 6:30 p.m.
