Mobility fee decision expected at council meeting

The Cape Coral City Council will vote on a repeal and replacement of the road impact fees with the mobility fee system today.

According to a staff report, the mobility fee ordinance will establish a modernized, legally defensible framework for funding multimodal transportation infrastructure needs.

The ordinance includes the Cape Coral Mobility Fee Extraordinary Circumstance Study prepared by NUE Urban Concepts, LLC in July 2025, which the City Council

“The city shall establish a special revenue fund for each mobility fee benefit district. Collected mobility fees shall be deposited into the applicated special revenue fund,” the ordinance states. The ordinance further states that the mobility fees are for project expenses, such as planning, design and construction.

The Cape Coral City Council will vote on the settlement agreement and concessionaire agreement between the city and Boathouse Tiki Bar & Grill during today’s meeting.

The Boathouse Tiki Bar & Grill entered into a lease agreement on Sept. 25, 2013, for operation of the waterfront restaurant, marine fuel sales and bait shop on the city owned property. A catastrophic fire in October 2024 took place where “an electrical fire could not be excluded.”

According to the resolution, “a dispute arose between the city and Boathouse as to the extent of the damage for the purposes of a substantial damage determination under the FEMA 50% rule.”

To resolve the dispute and facilitate the rebuilding, “the parties intend to execute

Cape man charged with multiple hit-and-run crashes in one day

A Cape Coral man was arrested after police say he was involved in multiple hit-andrun crashes in one day, including one with a child in his vehicle.

Zachary Michael Gray Kelly, 28, has been charged with three counts of hit-and-run, two counts of driving while license suspended or revoked, and probation violation.

According to Cape Coral Police Department officials, officers responded to a crash on Del Prado Boulevard North and Northeast 6th Street on Sept. 12 around 5:15 p.m.

Police stated the crash involved three vehicles, including an unmarked CCPD vehicle, but that no one was injured.

“A black Toyota Tundra fled the scene of the crash eastbound on NE 6th St.,” a release from CCPD stated. “A search of the Tundra’s tag number revealed the truck had been pulled over on August 25, 2025. The truck was located at its registered address on NE 2nd Place with visible front-end damage consistent with the crash.”

Police officials stated that CCPD officers made contact with Gray Kelly, who was inside the residence.

“Gray Kelly initially denied knowledge of the crash before becoming uncooperative,” the release stated. “Officers observed signs of impairment, including bloodshot eyes,

slurred speech, and unsteady balance. Gray Kelly admitted to smoking marijuana.”

Police officials stated the investigation revealed that Gray Kelly was involved in two hit-and-run crashes that day. Police state that around 2 to 3 p.m., officers learned he was driving toward Orange Grove in Lee County when he rear-ended a light-colored van, and did not stop to talk to the other driver.

“Later, after picking up a child, Gray Kelly was driving back in Cape Coral when he approached traffic stopped at a red light, but was going too fast and couldn’t stop, causing another crash,” CCPD’s release stated. “He then fled the scene.”

Officials stated that a records check showed that Gray Kelly’s driver’s license had been canceled in January 2025, and that his history included 13 suspensions and three prior revocations.

Police state that Gray Kelly was also cited for careless driving. The Department of Children and Families (DCF) was notified regarding the child passenger.

“The Cape Coral Police Department remains committed to keeping roadways safe and holding accountable those who choose to drive recklessly or flee crash scenes,” officials stated.

As of Tuesday morning, Gray Kelly was still in custody at Lee County Jail, with a bond set at $8,000. There are two additional charges still pending bail amounts.

Two arrested after vehicles burglarized

Two males, including a juvenile, were arrested after Cape Coral police said they burglarized vehicles and stole items including a firearm.

Jeffrey Gabriel Prestol, 18, has been charged with loitering and prowling. A 16-year-old juvenile male has been charged with four counts burglary of an unoccupied conveyance, grand theft of a firearm, petit theft, criminal mischief and unlawful possession of a firearm under 18 years of age.

Cape Coral Police Department officials stated that on Sept. 14 just before midnight, officers responded to a vehicle burglary in progress in a neighborhood near Hancock Bridge Parkway and Cultural Park Boulevard.

“A resident reported seeing two males on his Ring Doorbell video attempting to pull on his truck door handle before running toward a neighbor’s home,” a CCPD release stated. “He immediately contacted the Cape Coral Police Department.”

Police state that after reviewing the Ring footage and collecting a description of the suspects, additional canvassing uncovered more video of the suspects pulling on

car door handles.

“One victim reported $200 in damage to their vehicle,” the release stated. “A perimeter was established, a UAV was launched, and on-call K9 responded. Officers soon located two males matching the description in the 100 block of Cultural Park Boulevard S.”

Both males were detained by police. Officials stated a CCPD Property Crimes Detective assumed the investigation, which determined the 16-year-old and Prestol were involved in burglarizing several vehicles. Police state a firearm, a backpack and a JBL speaker were stolen.

“A search of (the 16-year-old) revealed a loaded pistol in his waistband, and the stolen speaker was recovered and returned to the victim,” CCPD’s release stated.

This case is still under investigation.

“The Cape Coral Police Department reminds you to always lock your vehicles, remove valuables, and report suspicious activity immediately. In this case, the quick actions of an alert resident and the rapid response of officers led to a quick arrest of the two suspects,” CCPD officials stated.

As of Tuesday morning, Prestol was still in custody at Lee County Jail with bond not yet set.

The Boathouse: Vote on agreement expected

this settlement agreement and proceed forward with negotiations of a new concessionaire agreement, the terms of which will be finalized within 30 days.”

Both the city and Boathouse management have agreed to waive any claims related to the dispute and determined it’s in their best interest to enter into a settlement agreement.

One of the highlights of the agreement includes the Boathouse being responsible for all costs associated with the demolition of the structure, which shall be done within 30 days from the issuance of the permit.

The concessionaire agreement – the exclusive right to construct, manage, and operate food/beverage, fuel, retail and beach operations – is for a 30-year term.

As far as the construction and improvements – the concessionaire commitment is for the responsibility for all costs for planning, design, construction, and maintenance of all improvements.

There is a minimum guarantee of $7,000 a month paid in 12 equal monthly installments. There is a 5% of gross receipts for years one through 10, 6% for years 11 to 20

and 7% for years 21 to 30. During the interim operations of construction, there is a $3,500 a month base rent and 5% of all gross receipts above rent.

The city contribution is $1 million reimbursement towards restaurant construction, applied as a monthly PG credit for the first 10 years and the city will pay for the installation for the fuel facility cost and the concessionaire reimburses 50% over the agreement term.

As far as insurance, the commercial general liability is not less than $10 million per occurrence, with the city named as the additional insured and the property insurance is all risk insurance for full replacement value.

The operations include food and beverages, including alcohol for the restaurant, and for retail – apparel, art, beach, sundries, bat, tackle and fuel. The beach operations includes equipment rental with a city residential pass at 20% discount.

The hours are from 8 a.m. to 10 p.m. daily for the restaurant and retail, and beach and fuel is from sunrise to sunset.

The City Council meeting will be held at 4 p.m., today, Sept. 17, in City Council chambers, 1015 Cultural Park Blvd. The meeting is open to the public.

Cape High football team rolls over Island Coast, 60-6; now 4-0 on year

The Cape Coral Seahawks football team remained undefeated via a 60-6 dismantling of Island Coast in its first game without head coach Tyler Murphy.

The Seahawks (4-0) scored nine total touchdowns on Senior Night, with five soon-to-be graduates finding the end zone.

The atmosphere at Dave Warkentin Field was intense to start following the news of Murphy resigning from his post earlier in the week. An impassioned Cape Coral team came out firing in the first quarter and showed why they can be considered one of, if not the best football program in the West Zone.

Of the team’s dominant performance, Watkins said, “That’s the culture that we talk about, right? One man down, the show still goes on. The standard has been set in this program, and nothing is going to change.”

The Seahawks received the ball to start and marched down the field on the Gators (0-4), capping things off with a 12yard touchdown when quarterback Derek Hooker found TJ Schley in the left corner of the end zone.

Cape Coral scored just 15 ticks of the clock later, as Island Coast fumbled the ensuing kickoff back to the Seahawks, setting them up on the Gator 3-yard line.

After an encroachment penalty, senior back Jermaine Skinner plunged in from 1-yard out for the score.

Before the first quarter came to an end, a gorgeous punt from Hooker put Island Coast on its own 2-yard line, and on the first snap of the drive, Seahawk Jayden Reyes picked off Terrance Taylor Jr. and returned it 10 yards for a pick-six. Reyes would have another interception before all was said and done.

“Jayden is one of the better players on this football team,” Watkins said. “He’s selfless. He plays both ways. He works on his technique and he’s always performing at the highest level for his teammates. For it to be Senior Night…his family is here — his dad is in town from New York. To get two picks, you can’t draw that up any better. I love it for him.”

It was sophomore running back Caleb Cobb who opened the scoring in the second quarter for Cape Coral, as the quick back took the ball down to the 1-yard line following a 45-yard scamper, and finished off the drive one play later.

On Cape Coral’s next possession, it took just one play for senior Vinny Miranda to add to the offensive output, as Hooker hit him for a 27-yard pass after the Seahawks took over deep in Island Coast territory following a punt.

Watkins, Seahawks ‘fight for coach Murphy’

Cape Coral High School announced last Thursday that head football coach Tyler Watkins was resigning, and that former NFL talent and Cape High grad Jaylen Watkins is taking over.

In a letter to parents, Cape Coral High School officials said Murphy was stepping away for “personal reasons.” Murphy will also be stepping away as a physical education teacher.

Murphy took over as head coach last season, leading the Seahawks to a successful 8-2 record and district championship. This year, the Cape Coral is off to a 4-0 start, most recently defeating Island Coast High School 60-6 in its first game without

Murphy at the helm this year.

Prior to last Friday night’s game, Watkins spoke to the message the team gave the student-athletes.

“Just fight for coach Murphy,” Watkins said. “He’s instilled so much into these kids. To see the tears and everything that was going on this past week, it shows that we have something more here. It’s not just the grass. A lot of guys felt like they lost a father figure. That was the hardest part. The Xs and Os we do so well…that’s the part that’s easy for us. The hard part is losing a brother. We’re trying to come out and win and think about coach Murphy.”

South Seas to host Triathlon Sept. 28

South Seas resort on Captiva Island will host a Triathlon event Sunday, Sept. 28. Participants will swim in the Gulf waters, bike on a closed course and enjoy a scenic island run at the resort.

Sanctioned by USA Triathlon, the beginner-friendly event will feature a Super Sprint Triathlon, which includes a 200-yard swim, 5-mile bike ride and 1.5-mile run.

But, we’re going to find a way to turn that into success, and winnings exactly what coach Murphy has instilled in all of us.

Cape senior Jayden Boyd also added a rushing touchdown late in the fourth.

The Seahawk defense allowed less than 120 yards of offense and forced four turnovers, while the offense put up more than 300 yards on the other side of the ball.

“It just goes to show the standard that has been set from an offensive standpoint,” Watkins said. “Coach Murphy has done a great job at getting the rest of the coaches prepared to handle something like this. I have full confidence and let (the offensive coaches) call the plays, and they called the game like he would have been there. I think that’s what we need the next few weeks so

that we can continue to perform the way that we’ve been performing each week.”

Watkins said he just tried to be himself in a new role as head coach.

“I just stayed under the defensive tent — if they needed my advice I went over there,” he said. “But just continue to be me, be loud and aggressive, and the same guy and not change who I am so the guys can know that everything has been the same.”

Next week, Island Coast travels to take on Mariner (1-3) Friday night, while Cape Coral travels to Estero (3-1) Friday as well.

Watkins is a University of Florida alum and spent parts of six seasons in the National Football League as a defensive back. He and Murphy were roommates

at Florida and have remained very close friends since.

“I met Tyler Murphy my first few weeks in college. He’s the best person I’ve ever met, that’s why I asked him to run the school that I went to. I care about this school so much,” Watkins said. “He’s still the best person for this job. He’s still the best person for those kids. I think every kid over here would tell you the same. I think every parent in the stands would probably tell you the same as well. Whatever the issue is — we don’t have information — we just want to know he’s OK and that at

some point he’s back on that sideline with us, because we have a mission together, and we don’t want to complete it without him.

“We’re going to do what we got to do, and let things fall how they’re supposed to fall, but we’re going to support him, and we love him, and that’s the message we want to send to him.”

There has also been an outpouring of support from the community when it comes to Murphy, with a change.org petition created by “parents and supporters of Cape Coral High School Football” currently with

over 1,100 signatures to have Murphy return as head coach.

“You can’t make that up. You can’t ask people to do that,” Watkins said. “That’s a true impact on a community, and that’s what we want people to see. We didn’t ask for that. Those people want to see him here, just like these players want to see him here.”

Watkins final message? An emphatic, “Free Murph. Free my guy.”

Agreement: Council to discuss police collective bargaining decision

a level 10 officer. For sergeants at a level one the rate is $63.01, from $43.59 to a level five of $70.51, from $53.74.

The council will also vote on the bargaining agreement between the city and Fraternal Order of the Police Lodge #33 for the lieutenants bargaining unit. The three-year agreement has a total agreement amount of $7,099.379, base wage rates increase by 16% for the first year, $3,476,693, 4% for the second year and $3,441,236, 4% for the third year.

The first full pay period of October 2025 for a level one sergeant is $68.75, an increase from $48.01 to a level five of $79.46, an increase from $60.61. For 2027, that amount goes from $48.73 to $71.50 for level one to $82.64 from $61.52 to a level five. For 2028, the

amount goes to $74.36 from $49.46 for a level one to $85.95 from $62.44 for a level five.

Another part of the contract deals with accepting compensatory time off for overtime worked. Employees are allowed to “accrue up to a maximum of 250 hours of compensatory time.” They may carry over a maximum of 50 hours into the new fiscal year. “As of Sept. 30 of each year, an employee shall be paid for all compensatory time in excess of 50 hours at the employees hourly rate.”

In addition, employees assigned as detectives, school resource officers, field training officers, motorcycle unit, special response team and K-9 officers will receive an assigned pay of $75, an increase from $60 biweekly to their regular rate of pay.

According to a memo from FOP Lodge 33 President Rob Goff, the officers and

sergeants had 215 of 272 members cast ballots with a unanimous vote of yes to approve the contract, while the lieutenants had all 10 members cast a ballot for a unanimous yes.

The council will also vote on the longterm and short-term residential rental property registration fees.

The registration fee for long-term residential rental property is $35, and $350 for short-term.

A long-term residential rental property is one that is leased or rented for a consecutive period that is greater than six months. The registration is to be submitted with the City Clerk’s Department and include such information as contact information for the legal name of the owner, direct mailing address, email address and telephone number. Any changes to the registration information

must be done within 30 days.

There is a penalty if the property is rented as a short-term residential rental property with a $1,000 civil penalty for the first offense. The second offense, or any subsequent violation the proceeding 36 months shall receive a civil penalty of $2,000.

The failure to renew the registration within 30 days of the anniversary of the registration shall have a $250 civil penalty and the second penalty of $500. The short-term residential penalty is $500 and the second and any subsequent penalty is $1,000.

The meeting is at 4 p.m. today in City Council chambers, 1015 Cultural Park Blvd. The meeting is open to the public.
