Cape Coral man sentenced to life in prison in Barry Schmalbach’s murder

A Cape Coral man has been sentenced to life in prison after being found guilty of second-degree murder.

Christopher Gregory Davis, 37, was sentenced Thursday in the death of Barry Schmalbach, 56.

Davis was also sentenced to five years in prison for tampering with physical evidence, and five years on each of eight counts of fraudulent use of, or possession with intent to fraudulently use personal identification information concerning a deceased individual.

Friends of Cape Library to discuss ‘Books

We’ve Read’ July 26

Everyone is invited to the Friends of the Cape Coral Library General Meeting Saturday, July 26. The topic of discussion will be “Books We’ve Read.”

The morning will begin at 9:30 a.m. with coffee, tea, light snacks and social time. The business portion will start at 10 a.m., and the program.

The Friends’ traditional July meeting program has been one of its most popular. Attendees sit in a big round table set up and take turns talking about books they’ve recently read and would recommend.

Each person may describe a couple of books, or more if there’s time.

FOCCL General Meetings, which take place in the large meeting room of the Cape Coral Library at 921 S.W. 39th Terrace, are free and open to the public. You are welcome to bring a guest or two.

Local ham radio operators hold summer field day

Gone are the days when ham radio operators operated out of their basement on old-time equipment that looked like it came from the 1930s.

Today, ham radio is state of the art. It uses computers and modern equipment to hear from people all over the world. This is a good thing, since during an emergency such as a hurricane when all the power and cell phone towers are out, it often can be the only way to communicate.

On Saturday, under the concession stand near the football field at North Fort Myers Community Park, dozens of radio operators

gathered to test their skills in the event of an emergency.

Lee County Property Appraiser Matt Caldwell released the final tax roll values Tuesday with taxable valuations up county wide.

According to Caldwell’s office, the release starts the process that allows jurisdictions and other taxing authorities to hold public hearings and set proposed ad valorem tax rates that will apply to properties within their respective jurisdictions.

In Lee County, the total just tax roll values in 2025 come in at $219,991,886,433, which is an increase of .24% from 2024. The total assessed tax roll value is up 7.96% throughout the county from last year, with the total taxable values seeing a 8.17% increase.

In Cape Coral, the total just tax roll values are at $46,891,828,971, which is a .40% decease. The total assessed tax roll value is up 7.58% from 2024, with the total taxable values seeing a 7.40% increase.

New construction just tax roll values in 2025 in Cape Coral comes in at $1,588,865,557, which is down from $2,114,727,819 in 2024.

The taxable value for new construction in 2025 came in at $1,579,597,916 as compared to $1,621,436,698 in 2024.

The Property Appraiser’s Office will send out individual Notices of Proposed Property Taxes (TRIM Notices) in mid-August once the proposed tax rates are set.

Cape resident charged with aggravated assault and DUI

A Cape Coral man was arrested shortly after midnight Saturday after police officials said he pulled a gun and waved it at individuals who attempted to stop him from driving because they feared he was impaired.

Louis Falocco, 63, has been charged with three counts of aggravated assault with a deadly weapon, and driving under the influence with a blood alcohol content over .15.

According to Cape Coral Police Department officials, officers were called to a business near Surfside Boulevard and Veterans Boulevard for a disturbance involving a weapon, where the caller stated an “intoxicated male pulled out a handgun and pointed it at multiple people.”

CCPD officials state when officers arrived, they identified a man matching the description from the caller, which was determined to be Falocco, who was in the driver’s seat of his car with the ignition on.

“Officers commanded Falocco to exit his car with his hands up, and he was detained,” a CCPD release states. “Falocco told officers he had a firearm in his pocket. Officers secured the weapon.”

CCPD officials stated that when officers spoke to witnesses, they said they noticed Falocco appeared to be heavily intoxicated walking toward his vehicle.

“The witness said he doesn’t tolerate drunk driving and went to stop Falocco from driving away,” the CCPD release states. “The three witnesses, all young adults, asked Falocco if he could walk in a straight line, and he was

unsuccessful. The witness reported that when he told Falocco he was calling the police, Falocco became upset, reached into his pocket, pulled out a small black handgun, and waved it at them. The witness said Falocco pulled the trigger multiple times, and he could hear the clicking. The witness said he was in fear for his life, so they ran to a nearby business to call police.”

CCPD officials state that two other witnesses provided a similar account of the events, and also ran away as Falocco continued to point the gun at them. An employee of the business also told officers he witnessed Falocco with a handgun in his hand and the witnesses running away, according to CCPD officials.

“During the investigation, it was clear to officers that Falocco showed signs of impairment,” the release states. “Falocco was slurring his words and losing his balance. There was a strong odor of alcohol coming from his mouth. Falocco agreed to perform Standard Field Sobriety Tests. Based on the investigation, Falocco was arrested for DUI.” Falocco agreed to provide samples of his breath, which police state had a BAC of .214% and .223%.

In Florida, the blood alcohol content limit at which drivers 21 and older are considered legally impaired is .08% or higher.

Falocco was taken to the Lee County Jail and has since been released on a $31,000 bond.

Teen facing multiple charges after crashing into Cape Coral Walgreens

A Cape Coral teen was arrested last Friday after police say he fled from police while driving intoxicated, ultimately crashing the car into a Walgreens.

The 15-year-old was charged with driving under the influence with property damage, driving under the influence with a person under 18 in the vehicle, fleeing/eluding law enforcement, grand theft of a motor vehicle and driving without a valid driver’s license.

According to Cape Coral Police Department officials, on June 17 around 5:40 a.m., officers responded to a report of a runaway juvenile at the McDonald’s on northeast Pine Island Road. The youth was believed to be in a vehicle registered to his father, police stated in a release.

“Upon arrival, officers observed the vehicle in the McDonald’s parking lot,” a release from CCPD states. “When officers attempted a traffic stop, the vehicle fled into the adjacent Walgreens parking lot, accelerated away from officers, and ultimately crashed into the south side of the Walgreens building. No damage was sustained by the

business.”

CCPD officials said five juveniles were detained at the scene, and that the 15-year-old driver was “found to be under the influence of alcohol.”

“Officers observed multiple indicators of impairment, including bloodshot eyes, slurred speech, and the odor of alcohol,” the release states. “Numerous alcoholic beverage containers were located inside the vehicle, including one in the driver’s seat.”

Police officials state that field sobriety exercises were conducted, and the juvenile subsequently provided a breath sample of .131 BAC.

Police said a juvenile passenger sustained a minor ankle injury and was transported to a local hospital by Lee County EMS.

According to CCPD, its investigation revealed that the vehicle had been taken without the owner’s consent. The registered owner confirmed he wished to pursue charges for motor vehicle theft, police stated.

The Florida Fish and Wildlife Conservation Commission has implemented a new law aimed at strengthening vessel accountability and enhancing protections for Florida’s waterways. Senate Bill 164, signed into law by Governor Ron DeSantis on June 19, went into effect Tuesday, July 1.

This legislation is designed to help reduce the number of at-risk and derelict vessels across the state and improve enforcement tools for FWC officers and partner agencies. Key provisions of the new law include:

n Clarified Ownership Standards: The definition of “vessel owner” is clarified, and a valid vessel title will now serve as prima facie (presumed) evidence of ownership.

n Stronger Requirements for At-Risk Vessels: Vessel owners must now complete an Effective Means of Propulsion (EMP) evaluation upon request by law enforcement. If an officer has reason to believe the vessel lacks an effective means of propulsion and the owner is present, the evaluation must be conducted immediately or within 48 hours if notified otherwise.

n Public Nuisance Vessel Designation: A vessel may now be declared a public nuisance — subject to removal like a derelict vessel — if the owner receives three citations related to any at-risk conditions within a 24-month period, including unpaid citations or failures to appear in court.

n Expanded Noncriminal Infractions: Violations such as expired registration and long-term anchoring may now be addressed through mailed noncriminal citations from law enforcement.

n More Flexible Use of Removal Funds: Derelict Vessel removal funding may now be used not only for removing DVs but also for preventive removals under the Vessel Turn-In Program and for public nuisance vessels.

n Harsher Penalties for Repeat DV Offenders:

l First offense: First-degree misdemeanor

l Second offense: Third-degree felony

l Third offense: Second-degree felony

n No Liveaboard on Derelict Vessels: It is now a first-degree misdemeanor to live aboard a vessel that has been declared derelict by the court or the owner has not requested an administrative hearing.

Additional requirements, including an annual electronic permit issued by FWC for vessels anchoring long-term, will go into effect on July 1, 2026. The penalty for unauthorized long-term anchoring will consist of fines ranging from $100 for the first offense, $250 for the second offense, and $500 for the third or subsequent offense. If a vessel owner receives three violations within a 2-year period, the vessel may be declared a public nuisance and removed as if it were derelict. Some exemptions apply and include vessels that

are government-operated, construction vessels, actively engaged in commercial or recreational fishing, docked at a public or private facility, or moored at permitted moorings.

“We have seen increasing success in our efforts to combat the ongoing derelict vessel problem in Florida’s waters,” said Capt. Travis Franklin, leader of the FWC Derelict Vessel Removal and Prevention Program. “This new legislation enhances our efforts to not only remove derelict vessels but also prevent at-risk vessels from becoming derelict.”

Derelict vessels remain a priority for the FWC, and the multi-year initiative to reduce the number of derelict vessels on Florida’s waterways is ongoing. These vessels pose serious risks to seagrass beds, marine life, navigation, public safety and property. The Boating and Waterways Section is leading this statewide effort in partnership with local governments and law enforcement.

Leaving a vessel in a derelict condition is a crime. Derelict vessels, including those that are sinking, grounded, stripped or lacking vital systems, threaten both people and Florida’s natural resources.

Keylime Bistro reopens on Captiva Island

Restaurant had been closed for 971 days due to damage from Hurricane Ian

Nearly three years after Hurricane Ian, the Keylime Bistro on Captiva has reopened for business.

Located on Andy Rosse Lane, the award-winning restaurant reopened its doors on May 24, following 971 days of closure after being battered by the storm in September 2022. Stilwell Enterprises & Restaurant Group owner and Chief Executive Officer Sandy Stilwell Youngquist, who operates other eateries on and off the island and the Captiva Island Inn, shared her and her staffers’ excitement.

“We are all very grateful and excited to be open once again,” she said.

“I couldn’t have done it without a great team,” Youngquist added.

While her Cantina Captiva, RC Otter’s Island Eats, and Sunshine Seafood Cafe and Wine Bar have been open and operating, the Keylime Bistro took longer to get to this point because of the historical preservation of the building. She explained that the permitting and requirements are more involved.

“It’s just been quite the ordeal, getting all the permits and getting everything done,” Youngquist said. “There were some people that wanted me to tear it down, but I was committed to keeping it.”

The restaurant had to be taken down to the studs because of the damage and storm surge from Ian.

“We put the roof on and had it done first so it wouldn’t sustain any future damage,” she said, adding that mold remediation was also done early on. “Every toilet, every single sink, every bit of wiring was pulled out. Every bit of plumbing was pulled out.”

Ham radio:

They finally had all the permits and were progressing along, then Hurricane Milton hit last year.

“We had a lot of the issues all over again, so we had to start over again,” Youngquist said. “But at least we had the permits in hand, so we didn’t have to go through more permits.”

She noted that the toilets had not been installed yet.

“The sludge and all the muck went into all of the pipes, so we had to jackhammer out all the pipes. It was really a mess,” Youngquist said, adding that they thought they could save the bar following Ian, but it was no longer an option after Milton. “So that was done.”

“In the process, we lost another whole season, so financially that was difficult,” she said.

The repairs and renovations cost almost $2 million. Combined with 971 days of lost revenue — which totaled over $10 million — Youngquist sustained a loss of more than $12 million due to the storms.

She noted that she was able to maintain her management staff, including Chef Rodolfo Palacios, who has been with her for over 20 years and is back serving up dishes at the Keylime Bistro. Many of her servers were helping to do other things and were cross trained at her other eateries to assist as needed.

“We work together as a team,” Youngquist said.

Right after Ian, her staff were riding boats to the island with her daily to preserve what they could.

“They all chipped in and helped me,” she said. “That was a big help.”

As far as the renovations, Youngquist explained that they used the extra time that they were closed to redesign the kitchen for better flow and efficiency and open up the dining room for more flexibility.

“When the weather is beautiful, people want to sit outside. When it’s not, it is inside,” she said. “We can now move our seating based upon the needs.”

While the Keylime Bistro has a new refreshed look, the beloved appeal remains the same.

“I still wanted to keep the charm of the island and the Andy Rosse vibe,” Youngquist said.

Assist2Build, MHK Architecture, Bob DeSantis and Mike Mechachonis were involved in the project.

Youngquist purchased the Captiva Island Inn in 1999 and was the landlord for the restaurant. She bought the Terrace Tropical Grille in 2001 and reopened as the Keylime Bistro later in June.

Open daily from 8 a.m. to 10 a.m., the restaurant offers breakfast, lunch and dinner.

There is also live entertainment during lunch and dinner.

The public is invited to enjoy a meal.

“I’m hoping the locals will come out and support me and all of my staff,” Youngquist said. “And we’re in hurricane season right now, so I’m keeping my fingers crossed that we don’t get another hit.”

The last of her Captiva eateries, Latte Da Coffee & Ice Cream, is expected to open this summer. The Captiva Island Inn is scheduled to break ground next year. In addition, there is a Keylime Bistro on Boca Grande and a third slated to open at the Southwest Florida International Airport by November.

Local group holds summer field day in North Fort Myers

A record number of operators came to participate in the event as numerous antennas were erected near the football field and portable generators gave power to the equipment.

Carmine Petrano, president of FMARC, said they wanted to exercise their equipment and speak with other operators to make sure they can reach everybody they need to reach.

“It’s preparation for an emergency and it’s also a contest. Lee County is blessed to have 1,500 operators,” Petrano said. “Not all of them are very active but we’re getting more activity from more ham operators, which would be very beneficial to the county.”

When traditional communication infrastructure fails, amateur radio becomes an indispensable lifeline. This event highlights the resilience and resourcefulness of amateur radio operators and their ability to provide vital communication services during emergencies and disaster recovery efforts.

The 24-hour event showcased how amateur radio can function under emergency-like conditions, utilizing emer-

gency power and deployable antennas. Visitors had the opportunity to observe operations, ask questions, and even get on the air under supervision.

FMARC, a volunteer group of licensed ham radio operators affiliated with the ARRL, the national association for amateur radio. Members of the Amateur Radio Emergency Service, who provide backup communication systems during emergencies, also participated.

Jeff Kennedy, spokesperson for Lee County AREAS, said they are independent of any other service. They can run on emergency power and can communicate anywhere.

“The reason Lee County likes having ham operators around is because we’re a great backup. Here, we have an outdoor location where we won’t get rained on,” Kennedy said. “We have expensive equipment that all belongs to these individuals.”

The amateur operators simulated emergency conditions and worked remotely from a location in an attempt to reach fellow operators nationwide. The group is awarded points for each operator they reach in a certain area.

It also serves as an educational opportunity for the public to understand the importance of amateur radio preparedness.

Many of these operators have been deployed during emergencies. During Hurricane Ian, operators were located at emergency shelters and at Lee County Emergency Management, relaying important information after power and the cell towers went down.

Radio operators were also in their communities, relaying information to emergency crews in the event someone had a health condition and needed to get to the hospital.

Tom and Kathy Provenzano came to put their skills to the test. Kathy is a relative novice, having worked ham radios for a year. Tom had started ham radio in 1960 and stopped for a while before coming back to it.

“We went to the winter field day in January and nearly froze to death. We love getting out with our club and I’m new at this,” Kathy said. “I like that you can talk to people all over the world. I contacted China, Russia, Japan, Australia…”

“What I like about this event is it allows us to practice our emergency activation skills. We’ve activated two hurricane stations over the past several years at shelters,” Tom said. “When all else fails, ham radio will always be there.”

p.m., Schmalbach texted a friend that he did not want to continue being with Davis, but that the pair walked back to the victim’s condo.

“The last image of the victim alive is on a surveillance camera from an area business they walked past,” a release from the State Attorney’s Office states. “That night, a neighbor at the condo complex reported hearing banging noises like someone was being slammed around and the sound of someone moaning twice. (Davis) was seen on store surveillance video soon after, purchasing two rolls of duct tape and a tarp. He had (Schmalbach’s) wallet and was wearing the (Schmalbach’s) watch. A neighbor later heard something being dragged in the condo hallway, but the light was out in the hall so could not see what was going on. When the light was turned back on, (Davis) was standing there.”

The SAO stated that Davis, driving the Schmalbach’s Jeep, then rented an Airbnb in a remote area, using a false identity. He purchased a pickax and shovel at a hardware store using cash. The rented home was left with furniture

askew and sand and dirt on the floor and in the bathtub.

Schmalbach was not reported missing for several days and, during that time, Davis called Schmalbach’s bank, pretending to be him, to make sure the debit card worked, officials state.

“The bank call was played in court as evidence,” the SAO stated. “(Davis) then used the card to get cash out of local ATMs at multiple locations. (Davis) also got a cosmetic procedure with Botox filler and shopped at multiple businesses, using Schmalbach’s credit cards. He also purchased an air freshener which was found in Schmalbach’s vehicle. Cadaver dogs alerted to the scent of human remains in the vehicle.”

The Cape Coral Police Department led the investigation in this case.

Cape Coral Police Chief Anthony Sizemore issued the following statement Thursday following the guilty verdict:

“Today, I had the honor of sitting alongside the family of Barry Schmalbach in the courtroom as the jury delivered its verdict: Christopher Davis was found guilty of second-degree murder and fraud.

“This case has weighed heavily on all of us, and while no verdict can erase the pain of such a loss, today’s decision delivers long-awaited justice for Barry and his loved ones.

“I am incredibly proud of the dedicated work by our detectives, forensics personnel, and the entire Investigative Services Bureau. Their relentless pursuit of the truth, combined with a strong prosecution by the State Attorney’s Office, ensured that the facts were heard clearly and convincingly in court.

“Being with Barry’s family today as the verdict was read was a powerful reminder of why we do this work. Their strength, resilience, and gratitude meant more than words can express.

“Christopher Davis was sentenced to life in prison. We stand with the Schmalbach family and remain committed to seeking justice for all victims.”

Assistant State Attorney Andreas Gardiner of the Homicide Unit and Assistant State Attorney Jennifer Justham prosecuted the case.

This project includes the installation and integration of a Rain Bird IVM two-wire control system capable of managing approximately 2,100 electric valves via 9 Rain Bird LXIVM Pro field controllers. The proposed scope covers labor, equipment, materials, and project management necessary to provide a fully functional system upgrade in accordance with the provided design documents. The general scope of the project is as follows: Candidate contractors will need to supply materials pricing for the installation of the new Rainbird IVM control system, including two-wire decoder control cable (in conduit with grounding and surge protection), new decoder modules, and solenoids.

The system will connect and control approximately 2,100 electric valves using over 103,000 linear feet of maxi wire cable and (9) LXIVM Pro field controllers.
