City Council removes cap on code violation amounts

Board establishes special master process for requests for reduction of fines or liens

The city of Cape Coral has removed its cap on fines for violating city codes while establishing an appeal process for those who would like to get fines and liens reduced or eliminated.

Cape Coral City Council added a section to code compliance last Wednesday that would allow an individual to go before a special magistrate with their request.

City offices closed for Independence Day

Cape Coral City Hall will be closed Friday, July 4, in observance of Independence Day. City offices will reopen Monday, July 7, for regular operating hours.

Trash collection services will be delayed by one day for Friday pickups.

Parks & Recreation:

n On Friday, July 4, boat ramps, parks and preserves will be open.

n Coral Oaks Golf Course will remain open for the holiday.

n Parks administrative offices, recreation facilities, and the Skate Park are closed Friday, July 4.

The city’s 311 Call Center and Water Account Services are closed Friday, July 4, and will reopen Monday, July 7.

City Manager Mike Ilczyszyn said there has been an administrative cap for liens that are placed for code enforcement issues for some time.

“I would like to remove the cap for the bad actors in the community, but I don’t want to do that without having a relief mechanism that doesn’t dump a workload on the agenda,” he said.

Ilczyszyn said if an individual is involved in a code case and they do not rec-

tify the issue under the land development code, and then go through a code hearing and are found guilty with the running daily fine, the city has a process now that caps the penalty amount to a fixed number.

Todd Hoagland, code compliance manager, said the ordinance proposed adds a section, a procedure through which someone can request a fine, or lien to be reduced.

Music festival this weekend on Captiva

‘Tween Waters Inn & Marina on Captiva will present its seventh annual Captivaville Songwriters Weekend on June 13-15, featuring live musical entertainment, coastal fun and summer energy.

The festival will open with the Friday Night Kick-off Party on June 13 from 5:15 to 8 p.m. Hosted by Sheena Brook, it will include individual music sets by the participating artists and a jam session. Saturday Poolside will take place on June 14 from 12:30 to 5:30 p.m., followed by Sunday Brunch by the Pool on June 15 from 11 a.m. to 1 p.m.

“It’s Captiva’s largest music festival, featuring local singer-songwriters for 72 hours of sun, fun, outstanding live music and the biggest party of the summer,” Sanibel Captiva Beach Resorts (SCBR) shared.

The lineup of artists for this year’s event will include Brian Sutherland, Sheena Brook, Bridgette Tatum, Caleb Neff, Gable Bradley and Paige King Johnson.

The SCBR provided the following bios for each:

∫ Sutherland: Part Americana singer-songwriter with a clever left hand on the guitar, part classical cellist, sideman musician, storyteller, father and husband who happens to love billiards, bourbon and a new song. Raised on the Southwest Florida beaches and brought up in bars packed with tourists and passerby’s, Sutherland honed his craft for storytelling. He

knew if he could keep a crowd of parrotheads and pirates, he could do it anywhere. As a sideman, Sutherland played with a slew of marquee acts like The Beach Boys, Michael Ray, Clemons Road and Blessing Offor. After moving to Nashville in 2017, he has penned hundreds of songs and showcased on every major stage the city has to offer. His most recent album, “Sounds Like Love,” was celebrated with a performance at the famed Bluebird Cafe.

∫ Brook: Singer-songwriter and recording artist who has entertained audiences for decades throughout the United States. Her music and live performances are captivating, as she shares her personal journeys through life, love and loss. Brook is a favorite at song festivals across the country and has brought her interview show, “Golf Kart Karaoke,” along with her. She has curated her own festivals and events as well that include: women empowerment group the F.E.M., LGBTQ+ Pride rounds, and other themed and featured shows. Brook was selected for NBC’s season 12 of “The Voice,” where she was hand-picked by Adam Levine. She has moved on to partner with several multi-platinum songwriters and artists who have evolved her unique songwriting style with tracks such as “Piece Of Me,” “Tongues Of Angels” and her latest single, “Bad Bitches Like Me.”

A Cape Coral man was arrested in the early hours of Monday morning for alleged grand theft auto and other crimes.

Billie Michael Dyson, 20, has been charged with two counts of burglary of an unoccupied conveyance, one count of grand theft of a motor vehicle, one count of petit theft, one count of operating a motor vehicle with a suspended license, one count of leaving the scene of a crash, one count of fleeing or attempting to elude law enforcement, and one count of resisting an officer without violence.

According to Cape Coral Police Department officials, officers were called to a home on Southwest 44th Terrace at 2:03 a.m. Monday for a vehicle burglary in progress.

Officials stated that officers at the scene reviewed home surveillance footage showing an individual unlawfully entering a vehicle parked in the driveway, later identified as Dyson.

Police officials stated that shortly after the initial call, patrol units saw a male matching Dyson’s description entering a white BMW near Southwest 46th Terrace and Southwest 18th Avenue and driving away in the car.

Registration open for Lee County Parks & Recreation Summer Camps

Program starts Monday

Lee County Parks & Recreation Summer Camp registration is open for programs, outings, and activities at the department’s traditional camps, middle school camps and specialty camps.

Traditional camps are for children who have completed kindergarten through fifth grade. Middle school camps are for sixth through eighth grades. Specialty and special needs camps’ ages vary. Check locations for specific ages.

Summer camp will run for seven weeks from June 16 through Aug. 1. The cost is $85 per week per child, an increase from the previous rate of $75. The adjustment will allow for enhancements of the camp experience by adding more program opportunities, such as an additional field trip at most sites.

Camp sites will participate in countywide initiatives, such as service-learning projects, fitness and wellness programs, and National Park and Recreation Month.

Commission to consider prohibiting smoking and vaping at county sites

On June 3, the Lee County Board of County Commissioners voted to schedule a public hearing to consider an ordinance amending Chapter 20 of the Lee County Code of Ordinances, Parks and Recreation to prohibit smoking and vaping at county parks and public beaches.

The hearing will take place on June 17 at 9:30 a.m. in the Commission Chambers at the Old Lee County Courthouse, at 2120 Main St., Fort Myers.

The county reported that Florida Statutes Section 386.209 has generally preempted the regulation of smoking to the state, with certain exceptions, including the ability for local governments to prohibit smoking at schools and indoor park facilities.

The statute was amended in 2019 to further allow local governments to prohibit smoking and vaping at all county parks and public beaches. Unfiltered cigars are exempt

under the statute.

If the board approves the amendment at the hearing, the ordinance will continue to be enforced by Lee County Parks & Recreation. It would take effect upon being filed with the Florida Department of State.

The county reported that Parks & Recreation rangers’ primary focus is to ensure the safety of park visitors and protect the natural resources of the county’s complex ecosystems and parklands. They are considered “ambassadors of the park” and provide visitors with information regarding park activities and offer various educational programs. However, the rangers can cite individuals who do not comply with the ordinance.

The fine schedule will continue to be $100 for a first offense, $200 for a second offense and $300 for a third.

CCPD’s Property Crimes Detectives determined that Dyson burglarized “multiple” vehicles in the neighborhood “with the intent to steal items or the vehicles themselves.”

Stolen items, including a key fob, were returned to victims, police stated.

“Dyson also stole the BMW from a nearby driveway, crashed it, and acknowledged that he was aware his driver’s license was suspended,” CCPD officials stated.

As of Tuesday afternoon, Dyson was still in custody at Lee County Jail being held on a bond of $26,000.

These best fishing practices were developed to help anglers quickly reel in tarpon and be set up for a successful release.

From gear selection and handling techniques to proper release and shark awareness, here are the key practices every angler should know.

Gear

Set up for success with these gear recommendations to catch tarpon quickly and minimize fight time.

Spin or Conventional

n Use tackle heavy enough by matching tackle to conditions and targeted fish size.

l Example: If targeting large tarpon, consider using medium to extra heavy spinning rods with 5,000 to 10,000 series spinner reels and at least 12 pounds of drag, 50- to 60-pound braid, and at least 60- to 80-pound monofilament or fluorocarbon leader, depending upon the selected crimp or knot system. Use 6/010/0 circle hooks depending on brand and bait type.

n When using bait, use non-stainless, non-offset, barbless circle hooks.

n Use single-hook rigs.

n Have a fighting belt or chair available for additional support during the fight.

n Have a long-handled dehooking tool to quickly and easily remove hooks.

Fly

n Use tackle heavy enough by matching tackle to conditions and targeted fish size.

l Example: If targeting large tarpon, use 10- to 12-weight class rods and line with a break section of 15- to 25-pound test in the leader.

n Use a break section in your leader in case sharks show up. The break section is a portion of your leader that is weaker than the rest of your leader and the core of the fly line.

Cardinals blank Mussels, 4-0, in series finale

Fort Myers club now visiting Dunedin to take on Blue Jays

FORT MYERS - The Fort Myers Mighty Mussels dropped the series finale 4-0 to the Palm Beach Cardinals at Hammond Stadium Sunday afternoon.

Fort Myers (26-31) got a strong start from Twins No. 10 prospect CJ Culpepper in his first appearance on a rehab assignment with the Mussels.

Culpepper, who pitched part of the 2023 season with Fort Myers, tossed three scoreless innings and allowed a single base hit, while striking out four.

Michael Carpenter (0-3) the originally scheduled starter for Sunday’s series finale, and pitched in a piggyback role after Culpepper exited.

The Twins No. 30 prospect, Carpenter spun 3.2 innings, allowing one run on a pair of hits while punching out three Cardinal batters.

Palm Beach (25-30) got their first run of the game in the top of the seventh inning after Carpenter exited. He was charged with one run after a wild pitch from Jakob Hall allowed an inherited runner to score and gave Palm Beach a 1-0 lead.

The Lee Building Industry Association’s 18th Annual Bricks & Sticks Fishing Tournament will be held June 12–14, in Southwest Florida.

Tarpon fishing: FWC offers some tips for catching the ‘silver king’

toward the fish and drop the rod tip down while reeling in so that the tarpon does not throw the hook.

n Counter the tarpon’s run by using the backbone of the rod to pull low and hard in the opposite direction the fish is swimming and use short turns of the reel to bring line in.

n Put the butt end of the rod into your hip or use a fighting belt or chair to get leverage for the fight.

n Make sure your drag is tight enough to sufficiently wear down the tarpon as quickly as possible.

n If the fish tries to go under or around the boat, move to the front of the boat to prevent the line from breaking or becoming entangled.

n If you need to break the line, point your rod at the tarpon and hold the spool or reel. Pull straight back to break the leader and free the tarpon.

Handling

Keep handling to a minimum and be sure to work quickly to allow for a successful release.

n Tarpon over 40 inches MUST remain in the water by rule, unless in pursuit of a state or world record using a tarpon tag purchased before fishing begins.

n Tarpon smaller than 40 inches should only be handled with wet hands and be

supported horizontally under the belly, if removed from the water.

n Keep the gills of tarpon in the water to minimize air exposure.

n Keep fingers away from the gills and eyes.

n Avoid dragging tarpon over the gunnel of a boat or over rocks or railings.

n Avoid delaying release by having a camera ready if you’re planning to take a quick picture.

Release

Catch and release tarpon as quickly as possible to reduce stress on the fish.

n Aim for a no-touch release by either using a long-handled dehooking tool to remove the hook or cut the line as close as possible to the hook.

n If the tarpon is gut hooked or the hook is lodged in the throat, cut the line as close to the hook as possible.

n Revive a lethargic tarpon by holding it horizontally in the water to allow it to pump water through its gills.

n Shorten future fight times if tarpon appear lethargic during release.

Sharks

Help give tarpon the chance to escape predators when released.

n Sharks are known to prey upon tarpon during the fight. If a shark shows up, help the tarpon survive by quickly bringing the fish to the boat and cutting the line as close to the hook as possible.

n Move to another fishing location if sharks are in the area.

Additionally, it is also recommended to avoid fishing for tarpon from bridges or piers. Only tarpon under 40 inches may be removed from the water, so if you did hook up to a large tarpon from a bridge or pier, you would have to cut the line and leave a long line trailing behind the fish, leading to entanglements and reducing survivability. Be sure to review the regulations spe-

cific to this area. Bottom-weighted jigs are prohibited year-round. This includes fishing with gear that has a weight attached to a hook, artificial fly or lure in such a way that the weight hangs lower than the hook when the line or leader is suspended vertically from the rod. Any jig that allows the attached weight to slip down the shank so that it hangs lower than the hook while the line or leader is suspended vertically from the rod is also prohibited. Any gear or jig that can be described as such, may not be attached to any rod, line or leader and must be stowed when traveling through the Pass. Additionally, from April 1 through June 30, no more than three fishing lines may be deployed from a vessel and breakaway gear is prohibited.

It is important to remember that these restrictions apply to fishing for all species within the Pass.

Hoagland said for the hearing process, the appealing party will be given the opportunity to present any mitigation factors to a special magistrate, such as hardships, considerations, improvements.

“The special magistrate will consider all the evidence and testimony,” he said.

The special magistrate can either deny or grant the request for reduction, as well as assess the city’s administrative costs for the hearing, which will be paid by the requesting party.

Any hard costs that the city has taken to remedy the violation, such as lot clearing, grass mowing, junk removal, board-up,

will be paid and will not forgiven.

If the applicant fails to pay the reduced fine, or lien amount, it will revert back to the original amount.

The council also approved a resolution that would increase the established administrative costs charged to a violator if the city prevails in prosecuting a case before the special magistrate.

The city set the monetary amount of $94

for the recovery of administrative costs, a total that was established for several years.

The amounts include:

n Stipulated agreements and agreed orders: $100

n Day of hearing costs of prosecution in a special magistrate case: $305

n Full or partial reduction of code enforcement lien: $305
