Council to discuss UEP contract method, fees

Discussions concerning the city of Cape Coral’s utilities expansion project dominates this week’s Cape Coral City Council workshop agenda.

The first is how the city will handle the next phase of the expansion with Council to discuss contracting with a “program manager at risk.” This involves hiring a “firm who manages the complete scope of the project on behalf of the city including planning, design, permitting, bidding and construction administration.”

City to host 2025 Flag Day Celebration

The city of Cape Coral invites residents and visitors to honor our nation’s flag at the 2025 Flag Day Celebration. City leaders will commemorate this patriotic occasion with a special ceremony recognizing the enduring symbol of our country’s unity and freedom.

The event will take place on Saturday, June 14, at 9 a.m., at the Veterans Memorial Area in Four Mile Cove Ecological Preserve, 2500 S.E. 24th St.

As part of the ceremony, city of Cape Coral Presiding Officer Jennifer Nelson-Lastra, accompanied by Marines from U.S. Marine Corps Recruiting Station Cape Coral, will respectfully retire the American flag currently posted at the park and raise a new one in its place.

Flag Day commemorates the adoption of the United States flag by the Continental Congress on June 14, 1777. In 1916, President Woodrow Wilson officially established June 14 as Flag Day, a tradition that continues to inspire pride and patriotism across the nation.

According to the presentation, this type of contract would provide a significant time savings and guarantee maximum price.

In 1970, when the city was incorporated, the new municipality purchased and assumed ownership of all existing utilities installed by the Gulf American Corporation. In 1980, a Water Independence for Cape Coral study was done showing the benefit of a dual-water system that uses reclaimed water for irrigation.

From 1999 through 2008, the UEP was managed by a Program Manager at Risk delivery method with KBR/MWH

Americas. From 2008 through 2012 UEP was paused by City Council. In 2013, the UEP was started again as a design-bidbuild delivery method.

Also on Council’s workshop agenda is a proposal that would allow some homeowners whose wells have become problematic or gone dry to connect to city water only if nearby.

The Contribution in Aid of Construction potable water extension program would allow property owners to apply for a line extension in lieu of redrilling a well within 1,000 linear feet of a potable waterline.

The proposal includes city crew performing the work and a CIAC fee of $7,246 and a capital expansion charge (CAC) of $2,789 to be charged to the property owners within 200 feet of the water line extensions. The CIAC fee is available to finance over a 15-year period, while the CEC is able to be financed over six years. Both would be collected through the annual tax bill.

Agenda documents touch upon data that was presented in February, including 2024 AIR DNA data, occupancy rate sensitivity analysis and average daily revenue sensitivity analysis.

As proposed and based on an estimated 10,000 units citywide, the fee would generate $6 million per year, which the city says it would use for a new tourism-driven efforts and infrastructure, less the cost of enforcement, which the city estimates at about 20% of the fee, or about $120 per unit.

According to the Tourist Development Fund financial cycle, an owner would collect more room night fees, as the city would use the fee money to construct tourist-related amenities.

Residents also would see a benefit, proponents maintain.

“It is the city’s further intent to specifically establish a residential rental property registration as a mechanism to protect neighborhoods from becoming blighted through the lack of maintenance of residential rental properties,” according to the ordinance as proposed.

Brotherhood of Heroes holds USS Nimitz tribute on Memorial Day

The Brotherhood of Heroes Military Museum & Library in Cape Coral held a special tribute to those who served aboard the USS Nimitz, honoring those who perished and veterans who were aboard the ship on May 26, 1981, when a Marine Corps EA-6B Prowler crashed on the carrier’s flight deck. Fourteen sailors died and 49 were injured in the accident. Above is a display of the USS Nimitz at the museum. Woman accused of attacking child with knife; attempting to hide injured girl under brush

A North Fort Myers woman is in the Charlotte County Jail, accused of stabbing a 12-year-old girl in the face and neck and attempting to hide her body, though still alive, the Charlotte County Sheriff’s Office reported this morning.

Gwendolyn Girard, 35, was arrested by the Lee County Sheriff’s Office after the Charlotte County Sheriff’s Office Major Crimes Unit secured a warrant for her arrest on charges of aggravated battery and aggravated child abuse.

Girard is being held on a $750,000 bond, according to the Charlotte County Sheriff’s Office.

The victim has been treated for her wounds and is in stable condition, officials said.

The investigation began Monday afternoon after Charlotte County deputies responded to the Cecil Webb Wildlife Management Area in reference to a child found by bystanders with cuts to the face and neck.

The girl, whose name has not been released, was weak and in need of immediate medical attention, officials said.

“The victim was only able to tell deputies that the suspect, identified as Gwendolyn Girard... had attacked her with a knife and left her under the brush before leaving in a gold-colored van,” officials stated in a release related to

the incident.

“Through investigative means, the van was located in North Fort Myers by members of the Lee County Sheriff’s Office, with Girard at the same location. The van was towed to impound, and Girard was transported for questioning,” the release states. “During this time, the Charlotte County Sheriff’s Office Major Crimes Unit secured a warrant for her arrest on charges of Aggravated Battery and Aggravated Child Abuse.”

Girard confessed to the incident and told investigators where to find the knife, officials said.

“The Major Crimes detectives interviewed Girard and obtained a full confession to include the location of the knife used in the attack,” the release states.

“In my 33-year career, there are only a handful of times that I have been left speechless,” Charlotte County Sheriff Bill Prummell said. “This is one of those times. To attack a child with a knife… I can’t understand it. It is only by God’s grace that she is still with us today, and I pray for her as she heals from this horrific incident. Unfortunately, the mental trauma inflicted on her may never heal.”

The investigation remains open at this time.

Cape Coral led with its defense, holding Oasis scoreless and scoring its first touchdown on Samuel Dugarte’s fumble recovery in the Bayshore end zone. The Seahawks made three takeaways and had three quarterback sacks. Cape also recovered an Oasis fumble at the Seahawks’ 1-yard-line. Coach Tyler Murphy’s offense didn’t show up until late, with Tyler Bloom running 39 yards for a touchdown. A 49yard Jermaine Skinner was wasted when the Seahawks were stopped on fourth and goal.

For Oasis, the loss to Bayshore is deceiving. The Sharks gave up all 16 points during a quarter playing its junior varsity. As for the lack of scoring, turnovers and penalties, not unusual in a spring game, kept Oasis off the scoreboard. The Sharks

fumbled on the Cape 1, and penalties hampered other offensive drives. Bayshore stopped Oasis at the 1 during that game. Quarterback Gavin Whittner and running backs Dallas Scott and Kevin Cisneros gained valuable experience for coach Brice Bearman’s team seeking to replace its graduated starting quarterback and running back.

Contract for Punta Rassa Boat Ramp work OK’d

Lee County Commissioners voted recently to award a contract for the next phase of repairs to the Punta Rassa Boat Ramp in Fort Myers, which includes the repair of three boat docks, a fish cleaning station, landscaping and more.

The ramp has been closed since Hurricane Ian while being used as a staging area for the Florida Department of Transportation’s Sanibel Causeway Emergency Restoration project.

work, was approved by the board on March 4. The next phase will begin once the FDOT completes the pavement operations in the area.

The $906,000 contract with marine contractor Sully’s also includes a shade structure over the fish cleaning station, facility signs and other improvements to the grounds.

Work is expected to take 5 months, weather permitting, with plans for Lee County Parks & Recreation to reopen the boat ramp site in the fall. Progress of the project can be found at www.leegov.com/parks.

Lee County, Matlacha/Pine Island Fire Control District negotiating lease for land to serve as station for ambulance

At the Board of Lee County Commissioners meeting last Tuesday, May 20, Public Safety Director Benjamin Abes told commissioners that an agreement had not been reached in the negotiations for the lease of property near Matlacha/Pine Island Fire Control District’s Station 1, located at the corner of Stringfellow Road and Pine Island Road in Pine Island Center.

“We’ve been in negotiations with the Fire Department for some time — those

negotiations between their legal counsel now — the County Attorney’s office and County Lands have continued. We continue to be, however, at a point where we’re not getting to mutually agreeable terms and conditions,” Abes said.

Because of this, he said, the concern is that there won’t be a place for an ambulance on Pine Island. In this case, he said, they are trying to address the issue proactively instead of having to wait until they find a location needs ambulance service.

The lease amount on the property in

consideration is very similar, he said, to the lease amount that the Fire Department is wishing to charge. In addition, the property has other benefits to consider.

“This property would allow us dedicated space, so our crew of an EMT and paramedic would have the entire facility as dedicated space for their own use … our intention would be to lease a location near Pine Island Center for a period of time and within the next two to three years, have a capital improvement project to have a fixed station at Pine Island Center, “Abes said.

Matlacha/Pine Island Fire Control District Chief Ben Mickuleit said the district found the situation where they are negotiating the lease agreement with the county very upsetting.

“The district was not aware that there’s any intent of Lee County EMS moving out of Station 1, so it’s kind of a shock to us that we’re currently negotiating with the county and not being made aware of any intent of EMS moving out of the station,” Mickuleit said.

County’s annual fertilizer ban to go into effect June 1

With the arrival of the rainy season, residents and landscapers in unincorporated Lee County — including Captiva — are reminded of the seasonal blackout period for certain fertilizers.

From June 1 through Sept. 30, the county’s annual ordinance will be in effect.

“It bans the use of any fertilizers containing nitrogen or phosphorous during that period,” Lee County Natural Resources Department Operations Manager Lisa Kreiger said.

During this time of year when Southwest Florida sees the most rain, improper and unnecessary fertilization can result in runoff that sends the nutrients meant to feed lawns into local waterways.

She explained that the ordinance was originally put into place in 2009 to minimize the negative environmental effects of fertilizer runoff by curbing excess nutrients from entering the waterbodies.

“It can lead to Harmful Algal Blooms in our waterways. It can lead to overgrowth of vegetation in canals,” Kreiger said of the excess. “It can, basically, create impairments to our waterways.”

She noted that the county is under a severe drought, so people may think they

can apply fertilizer because there is no rain. However, we will see that first heavy rain — also known as the “first flush.”

“When the rain comes, it can really wash everything off the landscape,” Kreiger said. “It can wash a lot of stuff into our waterways, which then ends up in our canals and our lakes and the Gulf.”

While fertilizers containing nitrogen or phosphorous are banned, alternative blends that contain macronutrients or micronutrients, like potassium, magnesium, iron and calcium, can be used.

Rather than cleaning up grass clippings, let them sit to break down and provide nutrients.

“There’s the use of organic matter, such as compost, composted coffee grounds or vegetative matter,” she said of additional ways to keep turf grass healthy. “You can use your recycled yard waste.”

Kreiger noted that lawns typically, though, do not need as much fertilizer as people think that they do.

“Plus with our summer rains, it does a really good job of keeping things green,” she said.

By skipping the turf grass altogether, people can reduce or eliminate their reliance on fertilizer.

“We, definitely, are fans of less lawns.

Less lawns are less work and less lawns are less maintenance,” Kreiger said, pointing to native plants and Florida-Friendly landscaping as alternatives to consider.

“They require significantly less fertilizer or none at all and less irrigation, which means less water,” she added.

In addition to the seasonal blackout period, the county ordinance states:

∫ Fertilizer may not be applied within 10 feet of a water body, seawall or wetland.

∫ Fertilizer is not allowed on impervious surfaces such as roads, driveways and sidewalks.

∫ Deflector shields are required on spreaders to prevent fertilizer from being

spread into water body buffers and impervious surfaces.

∫ Grass clippings and vegetative trimmings may not be swept or blown into ditches, drains and water bodies and onto roads or sidewalks.

Additional best practices that are recommended for year-round include:

∫ Do not fertilize your lawn if rain is forecasted. Rainfall may wash away fertilizer or cause it to leach through the soil and into waterways.

∫ Sweep up spills. Never use a hose to wash away spilled granules. It can lead to unwanted nutrients in storm drains and waterways.

∫ Create a 6-foot low-maintenance zone using a native planting bed or vegetative buffer that does not need to be mowed. It can minimize grass clippings from entering the water.

∫ Pick up your pet’s waste.

“We can all play a part in protecting our waterways,” Kreiger said. “These are things that individuals can do to help the cause, to help the waterways. Collectively, it does make a difference.”

More than 4,900 pounds of food collected in annual Donated

Donated not Wasted, Lee County’s eighth annual food-rescue campaign, successfully diverted 4,903 pounds of food from potential disposal. That’s almost 2.5 tons of food that did not end up in the waste stream and will help feed Lee County families.

This annual effort, in partnership with Harry Chapin Food Bank, encourages seasonal residents to donate unopened pantry items to divert as much food as possible from final disposal. This serves to not only prevent good food from going to waste but also helps to provide meals to those in need in the community.

Since the program’s inception, more than 37,911 pounds of food has been diverted from potential disposal and sent to the Harry Chapin Food Bank – enough food to provide more than 31,593 meals to residents.

If there is substantial change to the ordinance, or ordinances, made at the workshop, the proposal intended to fund tourism-related initiatives will go back to a
