The city of Cape Coral has sent a notice of termination for the concessionaire agreement for Jaycee Park citing the “failure to remit the committed investment upfront payment.”
The letter to the principals of The Reef Cape Coral LLC, Stephan Soloway and Michael Amato is dated Monday, March 31, and signed by City Attorney Aleksandr Boksner.

“Dear Mr. Soloway and Mr. Amato: This correspondence shall serve as formal notification that the City of Cape Coral, Florida (‘City’) is exercising its right to TERMINATE the ‘Concessionaire Agreement Between City of Cape Coral, Florida and The Reef Cape Coral ’Concessionaire Agreement’, pursuant to Section 19.4 of Concessionaire Agreement, for the failure of The Reef Cape Coral LLC to remit the Committed Investment Upfront Payment (‘Upfront Payment’) of
$1,370,488.00, plus late charges and interest, within the time period provided to cure The Reef Cape Coral LLC’s monetary default,” the letter states.
The letter outlines a number of deadlines the city says the firm with which it contracted to provide concession-related services as part of the city’s redevelopment of the riverfront park off Beach Parkway, including the final deadline provided in the city’s March 18 letter of default.

Council vote expected on Oasis Sports Complex proposal

Cape Coral City Council’s vote on a proposed $12 million sports complex on the campus of its municipal high school charter school is expected today.
A joint workshop was held Feb. 19 between Council and the Cape Coral Charter School Authority Governing Board at which Avalon Engineering presented designs for the Oasis Sports Complex.
The item on Council’s consent agenda, Resolution 112-25, is to approve direction given to the city administration that the charter school “shall have exclusive use of the Oasis Sports Complex, and to move forward with the base concept plan in the estimated amount of $11,093,788, plus alternate area one in the approximate amount of $777,266 and alternative area two in the approximate amount of $184,011.”
The project has a total estimated cost of $12,055,066, and the resolution states that
“the city will issue the debt to construct the Oasis Sports Complex” and the “charter school receives local capital improvement funds on annual basis, and those funds will be utilized to pay the city for the debt issued to construct the Oasis Sports Complex.”
The annual lease payments will be increased to cover the debt service for the project. In other business:
n Resolution 108-25, which is for approval of the first amendment to Tourist Development Tax Grant Funding Agreement between Lee County Board of County Commissioners and the city for Yacht Club Shoreline expansion. Employees will receive up to a 10% wage increase if Cape Coral City Council approves proposed collective bargaining agreements today.
Council’s consent agenda includes Resolution 85-25, a proposed agreement between the city and the International Union of Painters and Allied Trades, Local 2301 – general union representing blue collar, white collar, professional and supervisory units.
The contract would compensate employees at minimum at the 75th percentile of wages paid in comparable positions in comparable cities.
The section that pertains to pay and reallocation states that “increases within pay range or lump sum payments shall only take place if employee has achieved a minimum overall ‘operational standard’ rating on their annual performance evaluation. The most current evaluation in the employee’s personnel fill shall be utilized.”
The effective date is Jan. 4, 2025, and the agreement also states that “general employee step plan shall be adjusted upward by 10%. All employees may advance one step within their pay range pursuant to this section, provided it does not exceed the maximum step in their pay range. Employees who do not receive a step advancement because they are at the maximum step in their pay range shall receive a one-time lump sum amount equal to 3.25% of their base pay, this payment shall be made within six weeks from contract ratification.”
The general employee step up plan is also addressed, as it “shall be adjusted upward by 4% and all bargaining employees

Cape hosting free vendor information event

City receives budgeting, financial reporting awards
The city of Cape Coral’s Financial Services Department earned two awards from the Government Finance Officers Association for excellence in budgeting and financial reporting. These achievements underscore the city’s commitment to transparency, accountability and high standards in financial management, according to the city.
Financial Services earned the GFOA Distinguished Budget Presentation Award for the 26th time for its Fiscal Year 2024 Adopted Budget, the highest honor in governmental budgeting.
The budget also received special recognition for the highest possible score in the following categories:

The city reported that the award reflects the dedication of the City Council, city manager and budget staff to pro-

Bohanon to coach football for Canterbury Cougars
North High School grad and former NFL fullback returning to the gridiron

Since retiring from the NFL after the 2020 season, Tommy Bohanon has mostly concentrated on his foundation to help young athletes reach their potential on and off the field.
As far as football goes, the North Fort Myers High graduate and former pro fullback and special teamer has limited himself to his annual summer youth football camp and preparing running backs for the NFL combine at a local training facility in Fort Myers.
Until now, with Bohanon back in the game with a new role.
Bohanon has agreed to become the running backs coach and offensive coordinator at Canterbury, a private school in Fort Myers. The Cougars are looking to improve upon a 4-7 season in 2024.
Bohanon said he has always wanted to coach kids and be a positive influence on them, even though he wasn’t really looking

“It happened to be a perfect situation to walk in and mentor these young men,” Bohanon said. “Talking to the administration and staff, it seemed to be a good situation for me and my family.”
Bohanon said he discussed it with his wife and decided it would be the “right time to take that step to jump into the coaching world.”
Bohanon said the team has some good athletes to build around. His job will be to install an offense that can put points on the board and win games. He believes the team will be competitive this coming year
As far as the foundation, Bohanon believes the new gig won’t impact it at all. The foundation has strong support from his wife, Katie, and many volunteers. Though it will make his life much busier than it already is.

Everything the Tommy Bohanon Foundation — which strives to mentor and support at-risk youths in Southwest Florida — offers isn’t going to change, though.
The annual Playmakers Tailgate Party at The Ranch is set for April 11, which funds all the programs the foundation runs throughout the year.
Bohanon will begin coaching at Canterbury during spring practice later this month.
Bohanon was a star running back at North Fort Myers High School and played in college at Wake Forest.
He was drafted by the New York Jets in 2013 and spent three season there before being cut before the 2016 season.
A year later, he signed with the Jacksonville Jaguars and played two seasons there. In 2019 he signed with the Green Bay Packers but was waived. In 2020 he was briefly on the Baltimore Ravens practice squad but was released.

Jaycee Park: Contract with concessionaire terminated by the city

The LLC’s response letter cites issues related to its ability to obtaining upfront financing for the agreed-to public-private partnership between The Reef Cape Coral and the city.
“We have a preapproval from a lender, but they don’t want to release the funds until 30 days of opening. Since we are not going to own the building, they can’t give it to us as a construction loan because they can’t lien the building,” Soloway said in an earlier interview. “More than anything, it’s a timing issue.”
“Quite simply, it is very difficult to get a business loan without a building for the business,” the LLC’s response letter to the city states.
Soloway said the letter they wrote to the city offers to give the city its deposit – the owner equity for the bank as an amendment to the contract.
According to the letter, “we are proposing the city accept a non-refundable earnest deposit in the minimum amount of $425,000. The deposit includes late fees and penalties we agreed to pay in return for the 90-day extension totaling $68,264.06 as of today, March 20. The remainder
$356,735.94 will be credited to the total investment bringing the balance due down about 25% to $1,013,264.06. As part of the pay plan, we also would agree to pay interest costs on this outstanding balance as determined by the city. Once we close on the loan, the balance and interest will be paid to the city.”
The city’s notice of termination to The Reef does not affect the other elements of the city’s redevelopment plans for the park, which also include walking paths, a riverfront boardwalk, band shell and inclusive playground.
The city issued a release concerning the
letter Monday afternoon.
“Please note that despite this termination, construction of the park will continue as planned,” the release from the city’s Communications Office states.
“At this time, next steps regarding the concession area have not been determined. While the park’s construction will move forward under the existing comprehensive agreement, any decisions concerning food and beverage operations will require council approval.”
The Reef Cape Coral LLC could not be reached for comment.

The consent agenda also includes Resolution 99-25, “which approved and ratified the Collective Bargaining Agreement between the city and the Blue Collar, White Collar, Non-Supervisory Professional, and Supervisory units of the International Union of Painters and Allied Trades, which includes 10% pay range adjustments and wage increases effective Jan. 4.”
Councilmember Jennifer Nelson-Lastra said she is very supportive of the labor
union and first responders because they are the city’s frontline people. She said the council strives to keep them at the 75th percentile, something discussed at the last negotiations.
It all fell on how the council can be proactive, instead of reactive.
“We need to stay above that, so it stays in our budget,” Nelson-Lastra said, adding that every three years the city falls behind the 75th percentile.
IUPAT Local 2301 President David Jimenez said their contract was up last October and they have been going back and forth with the city making several proposals.
“Ultimately it came down to data,” he
said, adding that the reason it took so long is each side looked at comparable cities.
“Inflation hit and because of our old contract, we just fell behind. This is getting us back to where we should have been,” he said.
The 10% is for current employees – in the four different bargaining units – and it is retroactive to Jan. 4.
“The city did a compensation study back in ’23, which at the time showed 6% behind. The 10% is inflation that has happened since then to get to the correct number,” Jimenez said.
There were some other highlights — tuition reimbursement went from $3,500 to $4,500. He said it now includes reim-
bursement for GI bills, as well.
“The veterans are taken care of and get that full benefit,” Jimenez said.
The grievance provision also was highlighted which includes possibly resolving a grievance in two weeks, he said.
The new contract had overwhelming approval from members.
“When we do a contract, our members have to vote on it before going to council. The members voted, over 500 votes – only two no,” Jimenez said.
The City Council meeting will take place at 5 p.m., today, April 2, in City Council chambers, 1015 Cultural Park Blvd.
The meeting is open to the public.

Persons seeking a hearing on a SFWMD decision which affects or may affect their substantial interests shall file a petition for hearing with the Office of the District Clerk of the SFWMD, in accordance with the filing instructions set forth herein, within 21 days of receipt of written notice of the decision, unless one of the following shorter time periods apply: (1) within 14 days of the notice of consolidated intent to grant or deny concurrently reviewed applications for environmental resource permits and use of sovereign submerged lands pursuant to Section 373.427, Fla. Stat.; or (2) within 14 days of service of an Administrative Order pursuant to Section 373.119(1), Fla. Stat. “Receipt of written notice of agency decision” means receipt of written notice through mail, electronic mail, or posting that the SFWMD has or intends to take final agency action, or publication of notice that the SFWMD has or intends to take final agency action.
Any person who receives written notice of a SFWMD decision and fails to file a written request for hearing within the timeframe described above waives the right to request a hearing on that decision.
If the District takes final agency action which materially differs from the noticed intended agency decision, persons who may be substantially affected shall, unless otherwise provided
by law, have an additional Rule 28-106.111, Fla. Admin. Code, point of entry.
Any person to whom an emergency order is directed pursuant to Section 373.119(2), Fla. Stat., shall comply therewith immediately, but on petition to the board shall be afforded a hearing as soon as possible.
A person may file a request for an extension of time for filing a petition. The SFWMD may, for good cause, grant the request. Requests for extension of time must be filed with the SFWMD prior to the deadline for filing a petition for hearing. Such requests for extension shall contain a certificate that the moving party has consulted with all other parties concerning the extension and that the SFWMD and any other parties agree to or oppose the extension. A timely request for an extension of time shall toll the running of the time period for filing a petition until the request is acted upon.
FILING INSTRUCTIONS
A petition for administrative hearing must be filed with the Office of the District Clerk of the SFWMD. Filings with the Office of the District Clerk may be made by mail, hand- delivery, or e-mail. Filings by facsimile will not be accepted. A petition for administrative hearing or other document is deemed filed upon receipt during normal business hours by the Office of the District Clerk at SFWMD headquarters in West Palm Beach, Florida. The District’s normal business hours are 8:00 a.m. - 5:00 p.m., excluding weekends and District holidays. Any document received by the Office of the District Clerk after 5:00 p.m. shall be deemed filed as of 8:00 a.m. on the next regular business day. Additional filing instructions are as follows:
Filings by mail must be addressed to the Office of the District Clerk, 3301 Gun Club Road, West Palm Beach, Florida 33406. The filing date for a document transmitted by electronic mail shall be the date the Office of the District Clerk receives the complete document. A party who files a document by e-mail shall (1) represent that the original physically signed document will be retained by that party for the duration of the proceeding and of any subsequent appeal or subsequent proceeding in that cause and that the party shall produce it upon the request of other parties; and (2) be responsible for any delay, disruption, or interruption of the electronic signals and accepts the full risk that the document may not be properly filed.
INITIATION OF AN ADMINISTRATIVE HEARING
Pursuant to Sections 120.54(5) (b)4. and 120.569(2)(c), Fla. Stat., and Rules 28-106.201 and 28-106.301, Fla. Admin. Code, initiation of an administrative hearing shall be made by written petition to the SFWMD in legible form and on 8 1/2 by 11 - inch white paper. All petitions shall contain:
1. Identification of the action being contested, including the permit number, application number, SFWMD file number or any other SFWMD identification number, if known.
2. The name, address, any email address, any facsimile number, and telephone number of the petitioner and petitioner’s representative, if any.
3. An explanation of how the petitioner’s substantial interests will be affected by the agency determination.
4. A statement of when and how the petitioner received notice of the SFWMD’s decision.
5. A statement of all disputed
issues of material fact. If there are none, the petition must so indicate.
6. A concise statement of the ultimate facts alleged, including the specific facts the petitioner contends warrant reversal or modification of the SFWMD’s proposed action.
7. A statement of the specific rules or statutes the petitioner contends require reversal or modification of the SFWMD’s proposed action.
8. If disputed issues of material fact exist, the statement must also include an explanation of how the alleged facts relate to the specific rules or statutes.
9. A statement of the relief sought by the petitioner, stating precisely the action the petitioner wishes the SFWMD to take with respect to the SFWMD’s proposed action.
