The city of Cape Coral is reminding boaters of the upcoming closure of the Chiquita Lock.

On April 1, the lock will close for removal, and construction will begin. The city is urging boaters to take action now, and secure alternative docking arrangements. The lock, which provided access in and out of the South Spreader Waterway for boats, has had long-term maintenance

The Gulf Coast Writers Association has announced that its annual writing contest began March 15, and is accepting entries through June 30.

“The lock will temporarily close to boating access as part of the South Spreader Waterway Enhancement Project, which aims to improve water quality and waterway flow,” city officials said in a release. “Boaters should relocate their vessels as soon as possible to avoid last-minute challenges.”

City officials said the lock is expected

to be completed by June.

In a previous interview with The Breeze, Wright Construction Group Vice President of Civil Operations Andrew Powell said the scope of work that began (in October) was to install the stop blocks and dewater the lock for FEMA inspection. That shut-

down started on Oct. 21 with the water control device reopening days later.

Work performed included the construction of a new seawall, excavating the site to the mean high-water line and removing the south seawall panels. A Cape Coral man was arrested Monday after police say he threatened a woman with a BB gun because he thought she parked too close to his car.

Louis Mazzaro, 40, was arrested and charged with one count of aggravated assault with a deadly weapon without intent to kill.

Cape Coral Police Department officers responded to a disturbance at 315 S.W. Pine Island Road just before 11 p.m., where they met with a woman who said she was threatened by a male.

According to CCPD officials, the woman told police she parked her car at an apartment complex, and as soon as she exited her vehicle, a man from a third-floor balcony began yelling at her.

Police said the woman said the male raised his voice saying, “I’ll pop your jaw. Don’t make me come down there. I don’t care if you’re a girl. I will send my daughter.”

The reporting party told police that the male, later identified as Mazzaro, left the balcony and came back a few seconds later with what appeared to be a long-barrel gun and demanded she move her vehicle.

CCPD officials reported that she told officers the man said, “I’ll pop you right now {expletive}. Move your car.” When she asked him if it was a gun, he said it was a BB and said, “This is not a threat. It’s a promise.”

Fort Myers man accused of threatening Cape police officer

A Fort Myers man was arrested Saturday for allegedly driving under the influence and after, threatening law enforcement officers.

Claude Gose Jr., 30, was arrested by the Cape Coral Police Department and charged with one count of DUI, and one count of threat of death or serious bodily harm to a public official.

According to CCPD officials, Gose was pulled over after police say he swerved across lanes of traffic in the 3600-block of Del Prado Boulevard to the 4400-block just after 1 a.m.

Police officials stated the Gose did not pull over right away after an officer turned on their sirens, and eventually turned into a parking lot, accelerated abruptly, and come to a hard stop in a parking spot.

CCPD officials said Gose did not initially roll down his window, and was playing loud music.

“When he did (roll down the window), the officer could immediately see his eyes were bloodshot and glassy, and his pupils were dilated,” CCPD officials stated in a release. “The officer could smell a strong odor of an alcoholic beverage and noticed a beer bottle in the center console within reach of the driver. There was also a spilled clear plastic cup on the passenger floorboard that contained an alcoholic beverage.”

Gose first stated to the officer he didn’t have his license, but the officer saw his wallet on the passenger side floorboard, which Gose then grabbed and retrieved his license, police officials said.

“Gose was unsteady on his feet and had difficulty listening to instructions to stand in one place and stop moving,” CCPD’s release states. “The officer attempted Standard Field Sobriety Exercises, which Gose agreed to participate in, but Gose then became uncooperative, yelling at officers and arguing. This continued for several minutes until Gose was placed under arrest for Driving Under the Influence.”

Police said Gose wouldn’t answer officers when asked if he would submit to a breath test at first, but then agreed. CCPD officials said as officers were gathering his belongings to put into the patrol car, he began making threatening statements, saying he would find where the officer lived after he got out of jail, that officers were messing with the wrong person, and that he could “find out anything in 15 minutes.”

Gose was taken to the Lee County Jail and continued to threaten the officer on the drive, CCPD officials said. Police state that once at the jail, Gose jerked away from LCSO Deputies, looked directly at the arresting officer, and continued yelling obscenities and “I’m going to find you.”

Gose was released on Sunday afternoon on a $2,000 bond.

Lee Board of County Commissioners approves several roadway improvement projects

The Lee Board of County Commissioners continued its commitment to improving local roads and sidewalks with votes for several projects Tuesday, including a roundabout at the intersection of Buckingham and Gunnery roads and improvements on the western end of Colonial Boulevard.

Buckingham

Commissioners awarded a low-bid, $4.8 million contract to V & H Construction, Inc. to construct a new roundabout at the intersection of Buckingham Road and Gunnery Road. The project is partially funded with almost $4.6 million in federal funding. The grant agreement was approved by Commissioners this past September.

The Lee County Metropolitan Planning Organization commissioned an intersection safety study to identify locations at which roundabouts could be used to address safety and congestion in Lee County. The Buckingham Road/ Gunnery Road intersection ranked as the No. 2 intersection appropriate for a new roundabout due to accident history and geometrical constraints. Placement of a roundabout at this intersection will improve safety and create a more conventional intersection design while also calming traffic through the curve on Buckingham Road.

The project includes pedestrian facilities, lighting, landscaping and drainage/storm water improvements. Construction is expected to start in April and take a year to complete.

Colonial Boulevard

Commissioners awarded a $1.3 million low-bid contract to OHLA USA, Inc. to complete intersection improvements for Colonial Boulevard at Summerlin Road and McGregor Boulevard. The project will add a third left turn lane on northbound Summerlin Road to westbound Colonial Boulevard, including ADA upgrades and modifications to the signal. Also included are modifications to the signal at McGregor and Colonial boulevards. Funding is available in the current adopted budget.

This project includes concrete curbing, asphalt mill-

ing, asphalt paving, striping, ADA upgrades to pedestrian crosswalks, landings, signalization improvements and signage. This project is a top board priority as interim improvements to safety and capacity enhancements along Colonial Boulevard at the Summerlin Road and McGregor Boulevard intersections.

Lee Boulevard/Sunniland Boulevard

Commissioners voted to acquire a 12,197-square-foot parcel for future intersection improvements for $127,000 plus closing costs. The property is located in Lehigh Acres on the south side of Lee Boulevard at the intersection of Sunniland Boulevard. Lee County DOT anticipates the need for a future signal and pedestrian improvements at this location.

Tice Street

The board voted to accept donation of a drainage easement from The School Board of Lee County at the intersection of Tice Street and Lynneda Avenue in east Fort Myers.

The Department of Transportation is planning to construct a sidewalk facility with drainage improvements along Tice Street, between Palm Beach Boulevard and Ortiz Avenue. The project design necessitates the acquisition of a 50-square-foot drainage easement at the intersection of Tice Street and Lynneda Avenue. The school board has agreed to donate the easement for this project.

Construction of the sidewalk improvements is anticipated to begin this spring.

Orange River Boulevard

The board approved a Supplemental Task Authorization of about $748,000 to the contract with AECOM Technical Services, Inc. to provide Construction Engineering and Inspection (CEI) services for the Orange River Boulevard sidewalk and water main replacement project. The project will add a sidewalk along Orange River Boulevard from Palm Beach Boulevard to beyond Palm Lane. Construction is expected to begin late this year.

moved her vehicle to the other side of the apartment, went into her home, and called 9-1-1, police said. She was able to describe the male to police, saying he was wearing some type of jacket and what seemed to be sweatpants, and said she wanted to press charges.

CCPD officials said the investigation revealed that the incident was centered around Mazzaro feeling the reporting

party parked too close to his car.

“He grabbed the BB gun and started pretending to load it,” CCPD officials stated in a release. “Mazzaro led officers to a long-barrel rifle in one of the rooms of the home. The reporting party identified Mazzaro as the offender in a show-up. There were children present in the home at the time of the altercation.”

As of Tuesday afternoon, Mazzaro was still in custody at Lee County Jail, being held on a $75,000 bond.

Bobby Holloway Jr. Fishing Tournament set for April 5

This year’s Bobby Holloway Jr. Fishing Tournament will be held Saturday, April 5, from 7 a.m. to 3 p.m., at Jug Creek Marina on Pine Island. The captain’s meeting will be the Friday night just before the tournament where captains will receive their bags and rulers and hear the official tournament rules. According to Ernestine Holloway Squires, the heart of the tournament is the Lil’ Bobbers division, which includes grades 3 through 7 or 9 through 13 years. The ‘Lil Bobbers captains meeting will be Tuesday, April 1, at First Baptist Church, where they will receive their captain’s bags and some goodies.

Lil’ Bobbers will finish the tournament at 1:30 p.m. and then have dinner followed by their awards ceremony at 2:30 p.m., she said.

“There are local guides who volunteer their time, which is a big deal. A lot of the kids haven’t been on a boat before and some don’t know how to fish, so they’re getting expert advice and also the experience of a lifetime. We’re really proud of that division,” Squires said.

Dinner for adult contestants will be at 3 p.m. after the tournament. Anyone is welcome to come to the dinner and tickets are available at the event. Awards will be presented at 4:30 p.m. Raffles start at 5 p.m. and live auctions will go on all through the day.

“We like to say that we have the biggest raffle in Pine Island. We want everybody to come, eat, drink and buy raffle tickets,” Squires said.

Scholarships from the Bobby Holloway Memorial Fund are for graduating seniors who live on Pine Island. Applications will be accepted starting April 14 and the ending date is May 9.

“We have sponsors who have sponsored us for 27 years and I would say most of them are over 20-year sponsors. Come out and support us and check out Jug Creek, it’s such a beautiful venue with the island vibe. It will be a nice day, with Big Mama entertaining us and the fun of our tournament—our tournaments are always like family reunions—there are folks we see this time of year at the tourney and we can’t wait to see them,” Squires said.

RIGHT TO REQUEST

ADMINISTRATIVE HEARING

A person whose substantial interests are or may be affected by the South Florida Water Management District’s (SFWMD or District) action has the right to request an administrative hearing on that action pursuant to Sections 120.569 and 120.57, Fla. Stat. Persons seeking a hearing on a SFWMD decision which affects or may affect their substantial interests shall file a petition for hearing with the Office of the District Clerk of the SFWMD, in accordance with the filing instructions set forth herein, within 21 days of receipt of written notice of the decision, unless one of the following shorter time periods apply: (1) within 14 days of the notice of consolidated intent to grant or deny concurrently reviewed applications for environmental resource permits and use of sovereign submerged lands pursuant to Section 373.427, Fla. Stat.; or (2) within 14 days of service of an Administrative Order pursu-

ant to Section 373.119(1), Fla. Stat. “Receipt of written notice of agency decision” means receipt of written notice through mail, electronic mail, or posting that the SFWMD has or intends to take final agency action, or publication of notice that the SFWMD has or intends to take final agency action.

Any person who receives written notice of a SFWMD decision and fails to file a written request for hearing within the timeframe described above waives the right to request a hearing on that decision.

If the District takes final agency action which materially differs from the noticed intended agency decision, persons who may be substantially affected shall, unless otherwise provided by law, have an additional Rule 28-106.111, Fla. Admin. Code, point of entry.

Any person to whom an emergency order is directed pursuant to Section 373.119(2), Fla. Stat., shall comply therewith immediately, but on petition to the board shall be afforded a hearing as soon as possible.

A person may file a request for an extension of time for filing a petition. The SFWMD may, for good cause, grant the request. Requests for extension of time must be filed with the SFWMD prior to the deadline for filing a petition for hearing. Such requests for extension shall contain a certificate that the moving party has consulted with all other parties concerning the extension and that the SFWMD and any other parties agree to or oppose the extension. A timely request for an extension of time shall toll the running of the time period for filing a petition until the request is acted upon.

FILING INSTRUCTIONS

A petition for administrative hearing must be filed with the Office of the District Clerk of the SFWMD. Filings with the Office of the District Clerk may be made by mail, hand- delivery, or e-mail. Filings by facsimile will not be accepted. A petition for administrative hearing or other document is deemed filed upon receipt during normal business hours by the Office of the District Clerk at SFWMD headquarters in West Palm Beach, Florida. The District’s normal business hours are 8:00 a.m. - 5:00 p.m., excluding weekends and District holidays. Any document received by the Office of the District Clerk after 5:00 p.m. shall be deemed filed as of 8:00 a.m. on the next regular business day. Additional filing instructions are as follows:

Filings by mail must be addressed to the Office of the District Clerk, 3301 Gun Club Road, West Palm Beach, Florida 33406. Filings by hand-delivery must be delivered to the Office of the District Clerk. Delivery of a petition to the SFWMD’s security desk does not constitute filing. It will be necessary to request that the SFWMD’s security officer contact the Office of the District Clerk. An employee of the SFWMD’s Clerk’s office will receive and file the petition. Filings by e-mail must be transmitted to the Office of the District Clerk at clerk@ sfwmd.gov . The filing date for a document transmitted by electronic mail shall be the date the Office of the District Clerk receives the complete document. A party who files a document by e-mail shall (1) represent that the original physically signed document will be retained by that party for the duration of the proceeding and of any subsequent appeal or subsequent proceeding in that cause and that the party shall produce it upon the request of other parties; and (2) be responsible for any delay, disruption, or interruption of the electronic signals and accepts the full risk that the document may not be properly filed.

INITIATION OF AN ADMINISTRATIVE HEARING Pursuant to Sections 120.54(5) (b)4. and 120.569(2)(c), Fla. Stat., and Rules 28-106.201 and 28-106.301, Fla. Admin.

Code, initiation of an administrative hearing shall be made by written petition to the SFWMD in legible form and on 8 1/2 by 11 - inch white paper. All petitions shall contain:

1. Identification of the action being contested, including the permit number, application number, SFWMD file number or any other SFWMD identification number, if known.

2. The name, address, any email address, any facsimile number, and telephone number of the petitioner and petitioner’s representative, if any.

3. An explanation of how the petitioner’s substantial interests will be affected by the agency determination.

4. A statement of when and how the petitioner received notice of the SFWMD’s decision.
