ongratulations to the Malinauskas Government on being re-elected with an increased majority at the March State election.

The AHA has enjoyed a strong relationship with the Labor Government over the past four years and we look forward to building upon that.

The new Government has seen Ministerial changes to key portfolios we engage in.

Michael Brown is the new Minister for Liquor and Gaming, while Emily Bourke is now Tourism Minister.

AHA|SA CEO Anna Moeller and I were able to secure meetings with both ministers in their first week in office.

From the President

Discussions with Minister Brown were primarily around the closing out of the more than three-year review into the Liquor Licensing Act. A review of the Act is a significant moment in time for our members and Minister Brown understood our concerns over the still-to-be-resolved issues.

As Minister Brown is also Police Minister, we were also able to express our concerns over the impact crime is having on our membership, offering solutions we have previously raised and are reiterated on page 25 of this issue.

Of particular importance to our members is the appointment of Nadia Clancy as Small Business Minister, and the AHA|SA looks forward to working closely with her.

Cutting Migration: Be Careful What You Wish For Migration has become a massive political issue. Hotels rely on a mix of domestic labour and migration pathways to fill a range of operational roles. Tightening migration settings, visa processing delays and income thresholds for employer-sponsored visas can make it extremely difficult and highly inefficient for employers - particularly small business - to fill critical roles in a timely manner.

As different political parties engage in an arms race to see who can look toughest on immigration, our members risk getting caught in the crossfire.

Migrants – whether they are international students, working holidaymakers or

skilled visa employees - make up a huge proportion of our dwindling pool of potential employees.

Any cuts will have a devastating impact on our members.

The AHA refuses to join the hysteria around what Australia’s migration number should be. We simply need enough people to fill hospitality roles our local workforce can’t meet.

Already, we are seeing existing staff being sent home the moment their visas lapse.

Given the shortage of chefs and the extraordinary diversity of international cuisines Australians enjoy, increased migration opportunities for chefs are essential.

Migration Cuts Worsen Unemployment So many hotel jobs revolve around the skills of the chef. If venues can not find cooks and chefs, how many other jobs in the business would be threatened?

How many fewer service staff would be needed on a Saturday night?

But it is not just chefs. What about hotel managers, restaurant managers, housekeepers and kitchen hands? We simply can not fill those and many other roles without migration.

My question to those wishing to significantly reduce our migrant intake is this: if you want to slash migrant numbers, which workers are you happy to have fewer of?

Is it chefs? Kitchen hands? Or maybe it is housekeepers… and rooms will go unfilled because they haven’t been cleaned.

“Are All These Migrants Really Needed?”

There is continual questioning about whether nor not ‘all these migrants are really needed’.

The old adage of needing the right skills, in the right place, at the right time exactly describes our industry’s workforce challenge – and migration is necessary to fill the gaps.

There are more than 30,000 vacancies in the Accommodation and Food Service sector and it is predicted to grow by 33,400 jobs (3.5%) over the five years to May 2030, and 92,400 additional jobs in the ten years to May 2035.

Key occupations such as chef, cook and hotel and restaurant managers are proving hardest to find. Right now, across the country, SEEK alone has 6,000 chef vacancies.

Local training alone won’t solve the challenges and without these skills, all other jobs are at risk.

“Do these migrants share our values?”

There is a great advantage in prioritising “employer-sponsored” visa applicants over “independent” visa applicants Hotels are part of the Australian community and hotels want employees that share their values.

Employer-sponsored visa holders are supported by local owners, managers and supervisors and in

return, they add vibrancy to the Australian communities they live and work in.

Employer-sponsored migration can help ensure community values are part of the migration application process.

“Where can we fit them in Australia?”

Almost one third of hospitality jobs are outside of the capital cities – and the labour shortage in the regions is dire!

As I have often said, not every migration setting needs to be developed to satisfy Parramatta.

The Federal Government must understand that hotels play a particularly important role in regional Australia. Many tourism destinations depend heavily on accommodation providers to support local visitor economies.

An Issue Beyond Hospitality The visa system needs to be responsive to the needs of the business - and the Australian people.

It is not just hospitality that is at stake. Occupations such as nurses, aged care workers, mechanics and abattoir workers are all in need.

We accept the rate of migration needs to be sustainable.

But to those looking to slash migration intakes, I say this: be careful what you wish for.

Retirements Earlier this year long standing Councillors Simone Douglas and Guy Matthews announced they would be retiring from the Council. Their terms ended at the AGM. I thank both for the valuable contribution they have made.

Simone is a staunch industry advocate who for many years has brought a unique insight onto the Council, both with her specialised social media skills knowledge and her understanding of the issues confronting the independent owner/ operator.

Guy’s contribution to our industry has been immense.

He is a member of the Johnnie Walker Hall of Fame - one of only four South Australians to be recognised that way, and is also a life member of the AHA. I have expanded on these comments in a story dedicated to Guy on page 48.

On behalf of the State Council, we thank both Simone and Guy for their service and lasting contribution.

T

he 2026 AFL Gather Round was staged against a backdrop of soaring petrol prices - and while the sun deserted us

this year, the fans didn’t.

270,018 scarf-wrapped people pushed through the turnstiles to create a new record.

Think about it - that’s ten times the population of Mount Gambier!

And it was achieved despite the local fallout from global challenges caused by the Iran War. Only time will tell how severe supply chain disruptions get and the consequences for our regions, where it is possible that flight cancellations and the soaring price of fuel will curtail travel to our country areas and escalate freight costs.

In many ways, the current situation has undertones of the challenges we faced in the Covid era.

This time, however, we aren’t flying blind. We have the playbook we developed during the pandemic.

Let’s hope that peace prevails and life returns to normal. In the meantime, the AHA both in SA and nationally is in open communications with government and key stakeholders to ensure we are prepared.

Economic Impact On a brighter note, everywhere we look, the numbers for Gather Round are impressive.

A year ago, the 2025 event generated more than $113 million for the South Australian economy (the 2026 economic figure has not yet been officially released).

That number has been going up each year – by 36% and 24% after years one and two.

An average of 9,676 rooms were booked per night, up from 9,550 in 2025. This represents an average hotel occupancy rate of 84%.

The Barossa Park venue alone generated $4.87 million in direct expenditure for the

region in 2025 (this year’s figures aren’t out yet). This year, the Barossa Council reported a record crowd in Tanunda’s main street for the post-match party.

Yes, another record!

It’s also great advertising for South Australia. When matches are televised nationally, they include vision that showcases the beauty of the area, which entices people who didn’t attend to think about making SA a holiday destination in the future.

AFL chief executive Andrew Dillon said TV ratings for Friday night’s Collingwood–Fremantle clash were the highest of the season so far. That’s a lot of people listening to commentators raving about the magic of Adelaide and our regions.

If we aren’t actively working on that conversion, we’re treating Gather Round as a one-off sugar hit, rather than the long-term tourism pipeline it should be.

The way Premier Peter Malinauskas has been talking, I believe the government is focused on the latter. So, too, is the AHA|SA and its members.

Let’s keep this magnificent momentum rolling.

North Star Lights Autism Path Finding quality staff is never harder than for a remote watering hole, which is what new publicans Emma and Keith Ramke, and their daughter Thea, quickly discovered when they took over the North Star Hotel in Melrose.

But Autism SA has helped the pub address this challenge – and with stunning success.

The entrepreneurial family started their employee search with Community Bridging Services in Port Pirie but a call from Autism SA changed everything.

Now, the Ramkes believe they have struck gold after employing two young autistic people.

“An Absolute Gun”

rayden Pirie and Darien Bravington joined the North Star early in the new year.

Darien was already studying his Certificate III in Hospitality and has settled in the kitchen where he works a flexible eight hours a week with those hours expected to rise ahead of the pub’s busy season.

Brayden, who had never before been employed, now works up to 35 hours, five days a week as the hotel’s cleaner.

“He’s been taught from the ground up about his role,” Emma said.

“He is an absolute gun.”

The Ramkes’ confidence in giving the pair an opportunity was galvanised by Emma’s experience in working with people with disabilities.

Some minor adjustments were made around the hotel to improve the likelihood of a successful outcome for all.

“Being an inclusive educator, I’ve developed visual schedules, checklists and lots of prompts for Brayden if he needs them.

“We have a lot of structures in place for him, we have a communication diary if he needs to check what he needs to do. We have a lot of non-verbal cues, so when the chairs are up, he knows he’s got to sweep and mop there.

“And we developed an easy read handbook. All of our policies and procedures have been adapted in an easy read format and that doesn’t just help autistic people, it helps all staff.”

Autism SA Autism SA also provided a training package for the Ramkes and their employees.

The “Unlocking Workforce Potential: Utilising Autistic Talent to Address Staff Shortages in South Australia’s Venues’ Project” aims to support venues to increase their knowledge and capacity to hire people on the autism spectrum and create inclusive workplaces.

Hotels can also access government-funded subsidies for hiring eligible employees.

“But they still get exactly the same as all of our staff,” Emma said.

“They are paid award wages, we don’t do any supportive employment wages.”

Brayden has already expanded his duties at the North Star, pursuing his special interest in gardening.

“Keith has taught him how to use the lawnmower and hedger so he’s started to pick up some more hours doing some general gardening and maintenance around the property as well.”

Emma said allowing autistic people to gravitate towards their strengths and find roles that best suit their abilities is the key.

“Brayden just started cleaning the front bar and the toilets.

Now he’s doing all of that plus the rooms. We’ve created a job specific to his strengths and he is shining.”

Loyalty In an industry where the tenure of employees can be fleeting, the message from the Ramkes to any publicans needing more help is crystal clear.

“We firmly believe with Brayden in particular we have an employee for life,” Emma said.

“He’s there well before he has to start.

He checks in to see if there is anything we need before he finishes. He is the model employee.

“I would encourage people within this industry to connect with Autism SA and really explore filling gaps in employment with some of the most talented and underrated people.

“There needs to be a few adjustments but they are all easy fixes.

“It’s a value add to your business, it’s a value add to your staff.

“And it has untapped potential.”

Neurodiversity In The Workplace Autism SA is delighted with the success of the 12-month project supported by a state government grant.

“It is fantastic that the North Star Hotel have recognised the value of neurodiversity in the workplace,” said Hannah Badenhop, Community Engagement and Branding Officer at Autism SA. “We hope many more pubs, hotels and restaurants will feel inspired to hire more autistic people.

“They have many strengths that they can bring to the hospitality sector.

“Focus, reliability and attention to detail are just some of the many benefits.”

Keith said giving Brayden and Darien a chance at the North Star has also been a feel good initiative recognised by the local community.

“It’s a good morale booster for the whole company,” he said.

“We sponsor a lot of community clubs and when they see us taking the lead in Melrose too, that goes a long way for the company’s reputation too.

“It builds up your brand. You actually give a damn about the people. And you get loyalty back from these people as well.”

Keith said it was about getting them involved when they wouldn’t normally have an opportunity.

“Don’t be scared or intimidated by the fact you’ve got the word disability attached to it.

“They’re not people with a disability, they’re people with a different ability.

“They are bloody fantastic.”

Accommodation Industry Gathers To Test Market Outlook

T

he 2026 Accommodation Australia (SA) Economic Workshop brought together industry leaders, operators and policymakers for a candid look at the road ahead.

The first of two major events that AA|SA will host this year, it was held at the Adelaide Entertainment Centre on 22 April, with strong representation from small operators to the major international chains.

The event was opened by Andrew Bullock, Chair of AA|SA, Treasurer of the Accommodation Australia Board and Executive Chairman of 1834 Hotels. He set the tone, saying the aim was to move beyond headlines and “pressure test” what accommodation operators are actually seeing and thinking on the ground.

Gave a detailed breakdown of South Australia’s accommodation market, drawing on CoStar data to assess performance trends, supply pipelines through to 2027, and the impact of major events on future demand.

The day also included a conversation with the new Minister for Tourism, Emily Bourke, which will be covered in the next issue of Hotel SA.

Economist Warns of Slowdown Ahead Economist Besa Deda warned hotel and pub operators to prepare for a tougher trading environment, as global shocks, rising costs and interest rates begin to bite. However, she stopped short of predicting a downturn.

and reduce discretionary spending. This will be particularly apparent for travel, dining and accommodation.

Besa said inflation is expected to rise further, potentially exceeding 5 per cent, with underlying inflation also remaining elevated.

That will likely force the Reserve Bank of Australia to deliver at least two more rate rises.

The combined effect will be a slowdown in economic activity.

As inflation outpaces income growth, Besa forecast that households will eventually cut spending.

It was clear to attendees that pressure is building.

A Resilient Economy - For Now Despite the warnings, the current picture is not weak.

South Australia, in particular, is performing strongly, supported by government investment, housing activity and steady employment.

The labour market remains resilient. Besa noted low unemployment and ongoing demand for workers, but made the point that skills mismatches persist.

In the tourism sector, employment has held up and spending has remained solid. This has been supported by events and domestic travel.

esa said the Australian economy is entering a more uncertain phase, shaped by what she described as a “fifth shock” following years of disruption.

Global conflict, particularly in the Middle East, is pushing up oil, fuel and input costs. This has flow-on effects for food, transport and operating expenses.

Crucially, she warned markets may be underestimating the impact.

Cost Pressures To Hit Discretionary Spend For pubs and hotels, the message is clear.

Higher fuel and food prices, combined with rising interest rates, will squeeze household budgets

But Deda cautioned that this strength is fragile.

Housing affordability is stretched, supply is likely to slow, and cost pressures are building across the economy.

What Happens Next Deda expects economic growth to slow to around 1.4 per cent nationally, with some states hit harder than others.

For the hotel and pub sector, that points to softer demand ahead, particularly in discretionary areas like leisure travel and dining.

There are also risks on the supply side.

Higher urea prices (fertiliser), linked to global supply disruptions, could lift food costs further, while fuel prices will continue to flow through to freight and operating expenses.

Accommodation

A Narrow Path Forward While the outlook is challenging, Deda did not predict a collapse.

Instead, she outlined a narrow path through the current conditions.

Interest rate rises are expected to be limited, and combined with higher costs, this should be enough to bring inflation back toward the Reserve Bank’s target over time.

The labour market’s strength should also cushion the slowdown, with any deterioration likely to be gradual rather than sudden.

South Australia’s relative economic strength provides an additional buffer.

The message was clear: hotels will need to navigate a period of slower growth, higher costs and ongoing uncertainty.

That means tightening operations and watching costs closely. It also means preparing for a more cautious customer in the second half of the year.

A Resilient Global And National Market

M

atthew began with a global view, reinforcing the strength of the travel sector despite geopolitical volatility.

“I think what we’ve seen over a long period of time now is that the travel industry at large is very resilient.”

Even amid conflict in the Middle East, demand has continued to grow globally, with only limited pockets of decline.

Australia has mirrored that trend.

“We are a country that was one of the first to recover… and we’re still posting out much of these gains.”

Occupancy and average room rates have both strengthened, supported by consistent demand across leisure, corporate and event segments.

Supply Slowdown Driving Performance A key driver of this performance has been a slowdown in new hotel supply.

After a development boom through COVID, new room growth has fallen below one per cent annually, allowing demand to outpace supply.

“That means… demand continues to grow… therefore

you get occupancy growth,” said Matthew.

That imbalance has also enabled operators to push rates higher, with confidence returning to pricing strategies.

Adelaide Hitting Record Demand At a local level, Adelaide is performing strongly.

“March was still the highest demand we’ve ever seen in the Adelaide market… by a few thousand room nights.”

Growth is broad-based, with occupancy and average rate increasing across all seven days of the week.

Major events remain a key driver, particularly AFL Gather Round, which continues to lift both occupancy and pricing. Since its introduction, the event has significantly boosted April performance, transforming what was once a softer month.

Group business has also provided a reliable base.

“Group occupancy has been a very consistent theme… around 10% of the market,” he said.

A Changing Market Dynamic

More Rooms, More Competition

However, Matthew noted that current strength is only part of the story.

At the same time, a new wave of supply is about to enter the Adelaide market, said Matthew.

The gap between luxury and mid-tier hotels is widening rapidly, with premium properties achieving significantly higher rates.

At the same time, new hotels are entering the market at higher price points and quickly matching incumbents on occupancy, while outperforming on rate.

That trend is reshaping competitive dynamics across the sector.

Peter Malinauskas is the 47th Premier of South Australia.

A local at the Alberton Hotel, he has a willingness to listen and understand hotel issues and has dedicated his working life to raising the standard of living for everyday South Australians.

Adelaide born-and-bred, Peter attended Mercedes College where he was school captain and later studied commerce at the University of Adelaide.

Peter was elected to State Parliament in 2015, became Labor Leader in 2018 and was elected Premier of South Australia in 2022.

He is leading a government which is getting things done for South Australia with a strong focus on the state’s prosperity for today and for the long term.

Beyond his official duties, the Premier’s greatest loves are his wife Annabel, their four young children, the Port Adelaide Football Club and Adelaide Uni Blacks.

According to his own profile, he is “a pretty average football player”.

Ashton became a member of the House of Assembly in March, 2022 where she served as Shadow Minister for Health.

She rose to the leadership of the South Australian Liberal Party in December, 2025.

Ashton’s profile describes her as passionate, hardworking and will always put her community first.

Born, raised and educated in the Barossa Valley, Ashton’s family has proudly called the regions within Schubert home for more than 170 years.

She graduated from Nuriootpa High School and studied Social Science at the University of Adelaide.

A hands-on upbringing on her family farm, playing local sport and being involved in the community has made Ashton acutely aware of the challenges facing regional businesses, families and individuals across Schubert.

She is married to Adam Howard and mum to Rupert.

Cory led the emerging power in Australian politics to its biggest electoral win outside of Queensland, helping One Nation secure four seats in the House of Assembly in March, 2026.

He is a former Liberal Senator who filled a casual vacancy in 2006 and was re-elected three times, in 2007, 2013 and 2016, before moving to form the now defunct Australian Conservatives.

Cory graduated from Prince Alfred College, studied business and management at the South Australian Institute of Technology and represented Australia at the 1989 World Rowing Championships.

He managed his family’s hotel Bernardi’s in the 1990s and later worked as both a stockbroker and financial adviser before entering politics.

He remains invested in the industry, having purchased Oyster HQ at Coffin Bay in 2025.

Michael’s career began as an administrative services officer for the Australian Government and he spent two years as a computer programmer, before becoming an advisor in economic development at both state and federal level.

Born and raised on a farm at Pine Point near Maitland on the Yorke Peninsula, Emily understands the value of working together to achieve the best outcome for a community.

According to her official bio, family, community service and helping others are a huge part of who Nadia is.

Lucy Hood MP was elected as the State Member for Adelaide in 2022, after a two-year campaign of community engagement.

Michael was elected as the Member for Playford in March, 2018 and following an electoral redistribution was elected in March, 2022 as the Member for Florey in Adelaide’s northeast.

He has been a strong advocate for the government’s approach to emerging technologies and chaired the parliamentary Select Committee on Artificial Intelligence in 2023.

He also served as Assistant Minister for AI, Digital Economy, Defence and Space Industries where he led strategic initiatives to advance and strengthen Australia’s capabilities in those sectors which are critical for innovation, security, and economic growth.

After completing her schooling at Maitland, Emily moved to Adelaide to study, before returning to the Yorke Peninsula to work at the local newspaper for three years.

She has been a member of the South Australian Legislative Council since first elected in 2018.

Emily has committed most of her working life listening and acting to support individuals, community groups and the South Australian business community through her roles in both state and federal government.

She is married to Yorke Peninsula local Aemon Bourke.

They now reside in Adelaide and have three daughters.

By opening up their home to people of varying cultures, abilities and life circumstances, her parents Tony and Rosemary showed their children the importance of looking out for one another.

Nadia grew up conscious of those around her and their needs, knowing not all of us have the same opportunities.

After finishing her studies at the University of South Australia Nadia knew she wanted to work in a role that helped others. It is why she has worked in the notfor-profit sector (including in the areas of mental health and domestic violence), why she became a foster carer and why she chose to stand for Parliament.

She was elected as the Member for Elder in 2022.

In her downtime you’ll find her at a playground with Miss, 8, at a gig with her partner or curled up with a book and a cup of tea.

She was appointed to the portfolio of Education, Training & Skills in March, 2026.

Lucy was raised in the state’s southeast, on a sheep farm at Bool Lagoon and in the regional township of Naracoorte.

She was the first in her family to go to university, moving to Adelaide to study journalism and began her career as a cadet journalist at The Advertiser, rising to become Education Editor.

Before entering politics, Lucy was an adviser to former Premier Jay Weatherill and Director of Policy for SA Labor Leader and now Premier, Peter Malinauskas.

Lucy lives in the suburb of Prospect with her two children, Audrey and Ned, her partner David, and his three boys Tom, Oscar and Charlie.

She is also an authorised marriage celebrant.

hile petrol prices had some impact on occupancy levels for this year’s AFL Gather Round, the result were still – in a single word – “outstanding”.

The agenda is tightly focused on performance, pipeline growth and investment strategy. Key discussions cover hotel development, capital flows, brand expansion, operating costs, technology, staffing and market outlook.

2025 Annual Report: Standing Strong in a Year of Challenge

The AHA|SA’s 155th Annual General Meeting combined a celebration of the year’s achievements with a clear-eyed assessment of the challenges confronting the hotel sector.

After official proceedings concluded, a range of senior politicians, government advisors, industry partners and members #36

were invited to lunch at member venue the National Wine Centre.

This enabled the AHA|SA to communicate the current issues affecting the industry – as well as demonstrating our hospitality to those we work with.

The following is the President’s Report, written by David Basheer, for the Annual Report.

It is my honour to present the AHA|SA President’s Report for 2025.

D

uring the year, our key pillars of advocacy were dominated by:

» Tourism and accommodation » Liquor and Gaming » A detailed submission to all key political players on our 2026 State election ambitions.

The review into the Liquor Licensing Act has been a marathon three-year process that is yet to be finalised. It will now be presented to the new Parliament.

What has been paramount throughout the process is that members’ interests are protected and, where possible, enhanced.

SA Premier Peter Malinauskas has already announced one important reform for our industry by placing limits on residents making vexatious noise complaints when they move into the area long after the hotel was built.

This change has been on the AHAISA wish list for decades.

As we await the final legislation, I must acknowledge the exhaustive body of work undertaken by our CEO Anna Moeller, with expert assistance from Owen Webb, Gary Coppola and Sarah Legoe.

Gaming South Australia has the strongest harm minimisation protocols in Australia.

Nevertheless, the AHAISA was forced to successfully advocate against a bill introduced by SA Best in August which sought to: 1. Insert new pre-commitment requirements into the operations of our gaming machines.

2. Have gaming operations closed throughout the State between 2am and 8am; and an additional 6 hours (may be 6 hours, or 2 separate periods of 3 hours, or 3 separate periods of 2 hours) during which gaming operations cannot be conducted.

3. Impose draconian restrictions on external and internal gaming signage.

4. Remove the operation of CRTs between 2am and 8am.

5. Gambling advertising banned on radio or television (including subscription television and streaming services) between 6am to 8.30am and 4pm to 7.30pm on any day.

The AHA successfully argued its case and the first four proposals were prevented from passing the Upper House. The fifth proposal around extending existing times allowed for gaming advertising on radio and television by one hour did pass the

Upper House but failed to clear the lower house before Parliament was prorogued before the election, meaning the Bill lapses.

We thank the overwhelming majority of Upper House members who opposed this Bill.

State Election Throughout the year, the AHA|SA’s State Council and management team developed a powerful 13-page submission ahead of the State election.

The submission focused on areas members highlight as their greatest concerns, namely: » Crime and anti-social behaviour

However, business events remain critical to our members, particularly our accommodation members and we were delighted that, after direct representation to the Premier, he announced an additional $10 million funding for the Business Events Bid Fund, taking it from $28 million to $38 million.

That he chose to make the announcement at last December’s AHA Presidents’ Lunch speaks volumes about the positive relationship we enjoy with the current government.

Financial Results Our 2025 surplus was $710,582. The organisation remains fiscally sound and well managed.

We have rebuilt our war chest, knowing that the next battle may be just around the corner. Rest assured that we are financially prepared to fight off any threat to member livelihoods.

This excellent result is a credit to our entire team but particularly Secretary/Treasurer Sam McInnes, Anna Moeller and Alisa Wenzel.

for many years, providing both employers and employees with an opportunity to assess suitability before making a longer-term commitment. For employers, this period allows time to evaluate a new employee’s performance, skills, and cultural fit within the business, while also identifying any training or support needs early on.

For employees, it offers a chance

But in the modern workplace context are probationary periods still important to have as a term in an employment contract, how do they interact with the minimum employment period, can they be extended and what happens to probationary periods when someone changes roles? In this article we explore these questions and more.

Workplace Relations

Probationary Period V Minimum Employment Period The term probationary period and minimum employment period are often used interchangeably, but they have different meanings and legal implications.

A probationary period is an employer-defined timeframe at the start of employment used to assess a new employee’s suitability for the role. In years gone by probationary periods in the hotel industry would typically be 3 months in duration, however since the introduction of the Fair Work Act 2009 (Cth) (FW Act) in 2009, 6 months is commonly used as the timeframe for a probationary period.

In contrast, the minimum employment period under section 383 of the FW Act, refers to the length of service an employee must complete before they are eligible to bring an unfair dismissal claim (which is 6 months for a non-small business or 12 months for a small business). A small business under the FW Act is defined as a business, and any associated entities of that business, that employs fewer than 15 employees at the time, which includes full-time, part-time and regular casual employees.

Probationary Period Terms In Employment Contracts For an employee within the hotel industry, the minimum employment period under the FW Act applies irrespective of whether or not they have a probationary period in their employment contract. Additionally, the minimum employment period will still be applicable if the employment contract stipulates a probationary period that is shorter in length than the minimum employment period. For example, a hotel employee employed by a non-small business employer, with a 3 month probationary period, who completes their probationary period but are subsequently terminated prior to 6 months of employment, is still ineligible to make an unfair dismissal claim.

So the question that arises is whether there is any benefit for an employer of having a probationary period in their employment contracts?

Technically, for employees whose employment is governed by the FW Act, there is no advantage for employers from a risk management perspective in having a probationary period

term in an employment contract. The employer already has the safeguard in place of the minimum employment period under the FW Act. However, conversely there is also no risks associated with an employer deciding to put a probationary period clause in an employment contract as it provides a mechanism and set timeframe through which to allow both the employer and the employee to review whether they are a right fit for the position or the business.

We still recommend to AHA|SA members that it is best practice for an employment contract for a full-time or parttime employee to contain a probationary period clause or a clause that reflects wording such as a probationary / minimum employment period. Our recommendations are based on the following reasons: » There is a general understanding in the Australian employment context of the term “probation”. By having a probationary period clause, it reinforces to the employee from the outset that their performance and cultural fit in the organisation is being assessed before a decision is made on their permanency. » It helps the employer with having a structured timeframe around assessing and evaluating an employee’s performance. » It encourages the employer to have open dialogue with the employee prior to the end of the probationary period by ensuring that the employer meets with the employee prior to making a decision on their permanency. » It can help with an employee’s training and development, because the probation encourages the employer to ensure that the employee receives as much training and development as possible before they make an assessment as to their suitability to become a permanent employee.

Probationary Periods and Casual Employees Casual employment is characterised by unpredictable and irregular hours and an employment status where there is no guarantee or firm commitment to ongoing work. As a result, we do not recommend that casual employees be subject to a probationary period because the nature of the probationary period is one where the completion of the probation results in the employee being offered permanency. This permanency contradicts the very nature of casual employment.

Casual employees, like full time and part time employees, are required to satisfy the minimum employment period under the FW Act to be eligible to make an unfair dismissal claim.

Accordingly, the template contracts of employment for casual employees developed for members by the AHA|SA do not contain a probationary period clause.

Extending A Probationary Period One of the questions that we often get asked from members is whether an employee’s probationary period can be extended. For example, could an employee employed by a non-small business have their probationary period of 6 months extended for a further period of 3 months due to concerns over the employee’s performance.

The answer is yes, the probationary period could be extended by written agreement between both employee and employer; however, it would not provide any further protections for the employer from an unfair dismissal perspective. Regardless of any agreement to extend the probation, if the employee has already served their minimum employment period the employee will be eligible to make an unfair dismissal claim if terminated.

Our recommendation is that there is no benefit to extending a probationary period because it provides no additional safeguard to the employer, and in any event, it would be reasonable that a period of 6 months is sufficient time in the hotel industry to assess whether an employee is suitable to perform the role or not.

Probationary Periods For Existing Employees Who Change Position Where an existing employee is promoted to a new position or where they change position, it is tempting for the employer to provide a new contract of employment with a fresh probationary period, that resets the period of probation. However, offering an existing employee a new or varied role with a new probationary period does not offer any further protections for the employer.

If the employee has served the minimum employment period, they will be eligible to make an unfair dismissal claim if terminated, regardless of whether they sign a new contract with a new probationary period.

Probationary Periods and Time Off Work What happens in a scenario where a full time or part time

employee is off work due to a non-work related illness or injury during their probationary period?

The FW Act specifically refers to certain periods that are not counted towards an employee’s service, including any periods of unauthorised absences and any periods of unpaid leave or unpaid authorised absences.

Any period of unpaid leave due to a non-work related injury or illness would not be included as service under the FW Act. Therefore, if an employee of a non-small business was off work for example for a period of 2 months on unpaid leave in their first 6 months of employment, they would need to serve an additional 2 months of service beyond the 6 month mark, to satisfy the minimum employment period and be eligible to access the unfair dismissal provisions.

As the probationary period is generally aligned to the minimum employment period, the probationary period would extend in this example above by a further 2 months.

Managing Performance and Conduct During The Probationary Period It is extremely important that an employer closely manages an employee’s performance and conduct during their probationary period. This includes counselling an employee if they are not performing to the required standards of the role and documenting any discussions or concerns that have been raised with the employee.

Whilst an employee cannot access the unfair dismissal provisions under the FW Act without serving the minimum employment period, they can still access the general protections provisions in the FW Act from the start of their employment. An employee can for example make a claim that an employer took adverse action against them such as termination of employment as a result of an employee exercising a workplace right or on the basis of a discriminatory reason. It is therefore extremely important that an employer documents any performance concerns that were raised with the employee during the probationary period, as this documentary evidence will be used in the defence of any adverse action claim.

Probationary periods are a well established practice in an employment context and whilst they are not a legal requirement, we would still recommend their inclusion as a best practice process when employing new staff members. Members should contact the AHA|SA if they need any further advice on probationary periods.

A Lifetime Of Service After 47 years, Life Member Guy Matthews has stepped down from the AHA|SA State Council, having made a substantial contribution to the industry over many years.

uy has been a steady and respected voice on the AHA|SA State Council over many decades,” said AHA|SA President, David Basheer.

“He represented the South East with distinction. A region, with strong Matthews family ties, he has always been passionate about.

“From ground-breaking innovations in the Matthews pubs, through to his long tenure at the boardroom table on behalf of the industry as a whole, he has consistently demonstrated a willingness to lead.

“Guy’s approach has always been grounded in real experience.

“On behalf of the Council, we thank him for his extraordinary service and lasting contribution.

“His legacy will continue to influence the industry for many years to come.”

In 2021, Guy and his late brother Tony, were both recognised with Life Membership, which is the AHA|SA’s highest honour.

The Matthews family has had a multi-generational impact on the State’s hotel industry.

Seymour and Doris Matthews established the beginnings of the family enterprise during World War Two when they moved to Whyalla to take

over the lease of the Bayview Hotel, owned at the time by the South Australian Brewing Company.

Guy joined the business in 1956.

Some of their innovations included their battle to introduce counter meals into front bars in the early 1960s, the first smorgasbord in South Australia at the Buckingham Arms Hotel and the first drive-through bottleshop.

Podcast In 2021, the AHA|SA captured Guy’s rich memories in a Behind The Bar podcast, with the description: AHA|SA Life Member Guy Matthews takes us back to the days of timber kegs, steamship deliveries and hotels doubling as prisons and morgues. He tells stories of beer rationing during WWII - and the contrast of having 60 pints of beer ready on a bar for thirsty workers in the generation that followed.

We hear about police stings and being prosecuted by the AHA, the whirlwind first day of the world’s first drive-in bottle shop and Guy answers the burning question: is he the only person in the world to have lost money on an AC/ DC gig?
