The censored arguments for Proposition 64

he sponsors of Colorado Proposition 64, the ballot proposal that would legalize marijuana and regulate it like alcohol, think these are three of the best arguments for voting yes: 1) Marijuana is objectively less harmful than alcohol.

2) The consequences of a marijuana offense are too severe.

3) Law enforcement resources would be better spent on more serious crimes.

The opponents of Proposition 64 evidently agree. How else can you explain why they deliberately cut them out of the State Ballot Information Booklet (aka The Blue Book), the voter guide to ballot issues that the State of Colorado sends to every registered voter in the state before every election? About 2 million will be sent out this year.

Members of the Legislative Council, the statutory committee of the state Legislature that made the cuts, said the three arguments were taken out mistakenly. That may or may not be true. But there is no question that after the “mistake” was uncovered the arguments were kept out deliberately — first by a vote in the committee not to restore them, and then by a decision by the Legislative Council’s research director, who had the authority to unilaterally restore them but chose not to do so. The truth is that the

arguments for Proposition 64 were deliberately censored.

When one side in a political discussion resorts to censorship to keep you from hearing the other side’s arguments, the censored arguments usually deserve serious consideration.

So is marijuana objectively less harmful than alcohol? Here are some metrics against which to compare the two drugs: How easy is it to get addicted?

Alcohol: Roughly one in 10 users of alcohol becomes physically addicted (turns into an alcoholic). That works out to somewhere between 10 and 15 million Americans.

Marijuana: Marijuana is not physically addictive. It does not cause cravings, users do not have to consume ever larger amounts to get high, and discontinuation of use doesn’t produce withdrawal symptoms — unlike alcohol. Marijuana is among the least addictive drugs known to man. Legal alcohol, tobacco and caffeine are all more addictive.

How easy is it to get un-addicted?

Alcohol: Kicking alcohol addiction requires major behavior changes that can take months to years to accomplish — usually with the aid of a 12-step program.

Not everyone succeeds, and those who do always feel they are in danger of backsliding.

Marijuana: Marijuana is probably the

single easiest recreational drug to stop using — far easier than alcohol or tobacco. Most marijuana users who want to quit using marijuana simply stop. Since no craving or withdrawal symptoms are involved, it’s generally not a big deal.

How easy is it to fatally overdose?

Alcohol: About 400 people a year die of alcohol poisoning.

Marijuana: There are no known cases of anyone dying of marijuana poisoning.

To consume a fatal dose of THC, the chemical in marijuana responsible for the high, a user would have to smoke 500 pounds of it.

How likely is use to result in violent behavior and crime?

Alcohol: Alcohol use figures in about 3 million violent crimes a year, including two-thirds of the episodes of domestic violence. When it comes to violent crime, alcohol is the drug of choice.

Marijuana: Marijuana use reduces the incidence of violent behavior, a point that is obvious to anyone who has been around pot users. The assertion in 1937 by the late Harry Anslinger, the director of the Bureau of Narcotics, that marijuana “is the most violence-causing drug in the history of mankind,” and that blacks and Hispanics were particularly likely to become violent from using it, was a brazen lie, and Anslinger knew it. Anslinger’s perjury was pivotal in convincing Congress to criminalize marijuana. The truth is that marijuana is one of the least violence-causing drugs in the pharmacopeia, and there is no known difference as to how different races or ethnic groups respond to it.

How likely is use to result in cancer?

Alcohol: According to the American Cancer Society, heavy alcohol use has been linked to cancers of the mouth, throat, voice box, esophagus, breast, liver, colon and rectum, and the risk increases with consumption.

Marijuana: There have been attempts for years to link marijuana to cancer, but

most of the studies attempting to do so have either failed to find a connection or have been debunked. Dr. Donald Tashkin of UCLA spent a lifetime trying to prove that marijuana causes lung cancer (because marijuana contains more cancer-causing tars than tobacco), but eventually announced that he could find no link. A number of studies in recent years have found evidence that marijuana may actually slow or prevent a number of types of cancer. (Google marijuana and cancer.)

And so on. There are a number of other similar comparisons — like the nature and extent of impairment associated with each drug, or harm to the unborn, for instance — that show marijuana to be the safer recreational drug.

I’ve been following this issue for more than 20 years; I can’t recall any cases in which alcohol comes out on top.

The opponents of Proposition 64 obviously don’t want people to know that.

Which brings us to the second and third censored arguments.

Are the consequences of a marijuana offense too severe? If marijuana is less harmful than alcohol, then obviously they are. The penalties for a marijuana offense should be no worse than those for an alcohol offense. That they are not — and that each year nearly 1 million Americans are arrested and often imprisoned for doing something that is no more harmful than drinking beer — is not only unjust and unfair, it is immoral and evil.

Would law enforcement resources be better spent on more serious crimes? Selfevidently yes.

The real lesson of the voter guide’s censoring is this: The opponents of Proposition 64 don’t believe they can win if the supporters of Proposition 64 are able to make their case to the voters.

That fact alone should prompt the voters to give the supporters’ arguments a lot of weight.

pril 10, 1967, was no ordinary day in Boulder County.

What started out like any other spring morning quickly became anything but, as buildings began to shake and the sound of broken glass filled the air. Firsthand accounts describe how people poured from buildings onto the streets looking bewildered by what they had just felt.

Children were sent home from area schools because brick walls had cracked and were feared unstable. Many suspected there had been some type of explosion, but in reality, Boulder and the rest of the Denver metro area had been hit by an even rarer event, an earthquake measuring 5.0 on the Richter scale.

Earthquakes are an oddity in Boulder, but the tremor would turn out to be the least bizarre part of the story.

The real kicker, which would not come to light until years later, was that the whole affair was self-inflicted. The shaking of the Front Range had been the result of a manmade, or at least mancaused, earthquake with implications that are profound for all of us today and future generations as well.

Like previous decades, the 1960s were a nightmare for the environment.

Toxic waste from chemical, pharmaceutical and other dirty manufacturing processes were still, for the most part, being dumped directly onto the land or into our waterways with both impunity and disastrous consequences. Fortunately, the ’60s also marked the awakening of the modern environmental movement, thanks to the likes of Ladybird Johnson with her focus on anti-littering and Silent Spring author Rachel Carson’s dire warnings, not to mention a few million hippies determined to reconnect with nature in one way or another. The bottom line from the decade of free love is that Americans woke up and got fed up with the toxic dumping that was taking place in full sight of anyone willing to look, and as a result of the backlash of this new movement, industry after industry started to get the message that “the times they were a-changin’.”

But what were polluters to do with all of that toxic waste? One part of the answer was obvious; it had to be gotten

out of sight and thereby out of mind.

The rest of the equation proved to be a little trickier to solve.

But in 1961, the federal government, by way of the U.S. Army, found a way to make its toxic waste seemingly vanish from the landscape and the public’s scrutiny. Many industries would subsequently follow the government’s lead. The Army decided to borrow a technique that the oil industry had been using since the 1930s to get rid of the excess water it produced as a byproduct of oil and gas extraction. It decided to inject the worst of its toxic chemical waste being stored at the Rocky Mountain Arsenal in Commerce City deep into the Earth as a means of permanent storage.

The Army drilled a 12,045-footdeep well and started pumping its waste liquids into the permeable rock layer at that depth. The toxic brew, which consisted of everything from pesticides to nerve gas to rocket fuel, was being injected into the new disposal well under great pressure.

Most folks think of rock as solid and impenetrable, but sandstones, shales and limestones are actually porous and contain fractures that allow for the entrapment and even the flow of liquids. With enough pressure behind it, that flow can be increased so that millions of gallons of liquid waste can be forced into such formations. In March of 1962 the Army started injecting toxic waste into the well. What happened next was unexpected.

On April 24, 1962, at the Cecil H. Green Geophysical Observatory at Bergen Park, an earthquake measuring 1.5 on the Richter scale was recorded with an epicenter in the area of the arsenal, where such events were unheard of previously, and it wouldn’t be the last such mysterious shaking in that area. By the end of that year, 190 earthquakes centered under or around the arsenal had been recorded. All of the quakes were very small until Dec. 4, 1962, when a moderate quake hit, causing structural damage to homes in Irondale, a small enclave located on the northwest edge of the arsenal.

By the time it was all said and done, more than 1,300 quakes would rock the area between 1963 and 1967, three large enough to cause damage to buildings.

The 5.0 earthquake that rocked Boulder in 1967 was followed a few weeks later by what is still the largest quake to ever hit the Front Range since at least the late 1800s, a 5.3 shaker that was felt from Goodland, Kan., all the way to Laramie, Wyo. While most people, even those at the U.S. Geological Survey, were puzzled by these earthquake phenomena, the Army was not. They had been tracking and studying the earthquakes in association with their waste disposal well, particularly the pressure and volumes being injected. The Army wasn’t sure how exactly it was causing the quakes, but it did understand that its disposal well was the source of the tremors. As a result, it stopped using the well for disposal to bring an end to the quakes. But while the earthquake activity slowed, it didn’t completely subside until the Army actually reduced the pressure in the well by pumping out some of its waste.

The Rocky Mountain Arsenal disposal well experiment laid the groundwork for how polluting corporations could get rid of their toxic waste going forward, and uncovered one of the problems that could eventually spell disaster for U.S. drinking water supplies. And it’s not the potential for earthquakes that poses the biggest risk for future water contamination. The tremors are only a symptom of a much larger problem: The rock formations that we are counting on to hold our most dangerous toxic waste forever are actually full of faults and fractures that have never been mapped and that could allow some of that waste to escape upward into our underground aquifers.

Like the arsenal well, other deep disposal wells, including one on Colorado’s Western Slope, located 110 miles southwest of Grand Junction and known as the Paradox Valley Unit (PVU), have now been studied by the federal government for more than 25 years for their ability to trigger earthquakes. The PVU has triggered more than 4,000 quakes since 1990 and scientists can, to at least some degree, control the quakes’ size and frequency, or eliminate them altogether by adjusting the liquid injection rate and pressure of the well. But the real breakthrough is in understanding how the Boulder Weekly

injection wells cause earthquakes.

Scientists believe that injection wells cause earthquakes by forcing apart and lubricating already existing faults in the underground rock formation being injected. It has been described as something similar to an air hockey table, where the puck doesn’t slide until the air creates a space between the table’s surface and the puck.

It has been assumed for decades that all of the deadly toxic waste that has been and continues to be injected into deep formations will never be able to migrate back up to the shallower groundwater aquifers that provide us with most of our drinking water. It has been assumed by everyone from polluting-industry representatives to the

Environmental Protection Agency (EPA) that the layer of rock being injected with waste and those layers above the injection zone form a perfect barrier that will always prevent upward migration into groundwater aquifers.

But as is often the case when humans do things with the expectation of “always and forever,” new information has a nasty habit of changing the equation. And using the inner earth as a giant toxic dump is starting to look like no exception to the rule, as new research is beginning to cast doubt on our longheld assumption that what goes down can’t come back up. This is bad news, considering the tens of trillions of gallons of deadly toxins that are already swimming around beneath our feet.

Out of sight, out of our minds According to an investigative report

released in June by Abrahm Lustgarten of ProPublica, “Over the past several decades, U.S. industries have injected more than 30 trillion gallons of toxic liquid deep into the earth, using broad expanses of the nation’s geology as an invisible dumping ground.”

So just how big of an operation is this inner earth toxic dump? There are now more than 680,000 disposal wells nationwide that are supposed to be regulated by the EPA. It is a daunting task to be sure, and one that the EPA has neither the manpower nor the funds to do properly.

During its investigation of the EPA’s oversight of the nation’s injection wells, ProPublica found that the agency was unable to provide basic information to its journalists, such as how many disposal wells fail and how often such failures occur. The investigative news organization also reported that the EPA “has not counted the number of cases of waste migration or contamination in more than 20 years,” and that “the agency often accepts reports from state injection regulators that are partly blank, contain conflicting figures or are missing key details.”

It also found that the new data gathering system the EPA launched in 2007 to create a central database for information on injection wells was being used by “less than half of the state and local regulatory agencies overseeing injection.” It’s shocking but not surprising to those who report on the often inefficient oversight of the EPA that few regulators were contributing to the database, and that as of last year, it still contained complete information on a very small number of the nation’s deep, toxic-waste injection wells.

The agency classifies disposal wells in five categories, I to V. Category V wells deal with non-hazardous waste and include common disposal systems like storm-water drainage wells, cesspools and septic system leach fields.

At the other end of the spectrum are class I disposal wells, which are deep wells used to inject many of the nastiest toxins known to man thousands of feet underground for the purposes of perpetual storage. Colorado has only six class I wells, with the nearest one to Boulder County located just a few miles east of Longmont on Weld County Road 19.

The EPA specifically created the class II category of disposal wells for the

oil and gas industry, which the agency estimates uses the wells to inject 2 billion gallons of drilling waste per day back into the ground. Class II wells are designed to pump produced water — usually a salty brine that includes low levels of radioactivity and hydrocarbon contaminants — back into the producing oil or gas formations to enhance secondary recovery or, in the case of produced water that contains toxic fracking fluids, to inject it deep underground where it is intended to be stored forever in the same fashion as class I toxic wastes. On average, eight barrels of produced water are generated for every barrel of oil because most oil-bearing zones hold more salt water than they do oil.

The only reason that the produced water containing toxic fracking fluid isn’t required to be disposed of in the more closely regulated Class I wells instead of class II is that then-Vice President Dick Cheney led the push to exempt fracking fluids from the Clean Water Act during the oil-friendly Bush years. He did this despite the fact that fracking fluid has more than 500 different chemicals, including known carcinogens like benzene. It was a wink and a nod to his friends in the industry that may come back to haunt all of us, including our children and grandchildren, if our decision to perpetually store trillions of gallons of deadly waste underground turns out to have been based on flawed geologic assumptions.

Different pathways to our water There are currently more than 150,000 class I and II disposal wells in the U.S., most of which are injecting industrial wastes into underground formations for the purpose of perpetual storage. But increasingly, some of that waste is finding its way back up and out into the groundwater and surface environment.

The best-documented escape route for toxic waste is by way of faulty disposal wells. Because many of the liquids being injected into the earth are highly corrosive, they wreak havoc on the metal pipes used to transport them downward.

And then, of course, there are human errors as well as sloppy drilling practices that fail to seal off the escape routes for the highly pressurized waste stream.

The multi-year investigation by ProPublica found a shocking number of documented releases of toxic waste from in and around injection wells. The investigation examined the case histories of more than 220,000 well inspections and found that structural failures within the injection wells were common. “From late 2007 to late 2010, one well integrity violation was issued for every six deep injection wells examined — more than See DUMPING Page 12

17,000 violations nationally. More than 7,000 wells showed signs that their walls were leaking. Records also show wells are frequently operated in violation of safety regulations and under conditions that greatly increase the risk of fluid leakage and the threat of water contamination.”

The EPA, often by way of state regulators authorized to assume the federal agency’s inspection and enforcement responsibilities, requires class I wells to be inspected annually, while class II wells only get inspected once every five years.

This means that when a leak is found, it may well have been allowing the escape of waste for several years prior to its discovery. That’s bad news, considering how many leaks are being identified.

ProPublica found that in just the year 2010, for example, the EPA’s testing of disposal wells “led to more than 7,500 violations nationally, with more than 2,300 wells failing. In Texas, one violation was issued for every three Class II wells examined in 2010 … Regulators say redundant layers of protection usually prevent waste from getting that far [into groundwater], but EPA data shows that in the three years analyzed by ProPublica, more than 7,500 well test failures involved what federal water protection regulations describe as ‘fluid migration’ and ‘significant leaks.’”

But well leaks are only one of the potential pathways that injected toxic waste travels on its way back to the surface and potentially into our water. With our nation’s long history of hydrocarbon exploration and the current explosion in gas drilling, there are now literally tens

of thousands of existing holes already drilled into deep rock formations, with thousands more being added every year.

The Earth has become a geological pincushion.

All of this drilling, and now hydrofracturing (fracking), which intentionally cracks deep rock formations to make the passage of oil and gas through the rock more rapid, has changed the inner earth landscape in ways that even our best geologists can only guess about. No one knows to what extent new pathways back to our groundwater aquifers may have been created by all this oil and gas exploration, particularly with its new technologies of horizontal drilling and fracking.

Stefan Finsterle, a hydrogeologist at Lawrence Berkeley National Laboratory who studies how fluids move through rock, told Lustgarten, “There is no certainty at all in any of this, and whoever tells you the opposite is not telling you the truth. You have changed the system with pressure and temperature and fracturing, so you don’t know how it will behave.”

Because many class I and II wells are located in oil and gas country, it is becoming increasingly common for toxic waste being injected into deep formations under pressure to migrate and find its way back up towards the surface and underground aquifers by way of old abandoned wells in the area. Such events have occurred from Texas to Pennsylvania, with one abandoned well spilling waste that had been injected into a disposal well more than five miles away.

Many of the old wells are particularly vulnerable to this type of leak because they were never plugged or cased properly when their operators abandoned them, often decades ago. In Boulder County, for instance, there are an estimated 183 abandoned wells, and 68 of them were never plugged at all. If a well — abandoned, plugged, unplugged or currently producing — isn’t cased and cemented properly to a depth at least below the deepest known groundwater aquifer, then any contamination coming back up the hole on the outside of the pipe due to the high-pressure injection of waste from a nearby disposal well will inadvertently get pumped directly into the aquifer without showing any evidence of such a leak on the surface. Such a pathway via old wells into a groundwater aquifer would likely go undetected until problems in drinking water supplies showed up many years later, and even then it would be impossible to trace the contamination back to its source, a bad reality for health officials but a convenient one for polluters, who more often than not these days see plausible deniability as a centerpiece of their business model.

So how often do oil and gas wells have inadequate cement and casing problems that could interact in this way with nearby disposal wells? No one knows. But as an example of a place where such research has actually been done, we can look at the numbers from Pavillion, Wyo. In Pavillion, the EPA believes that fracking fluid may have made its way into the area’s groundwater.

nti-fracking activists are planning a major demonstration in Longmont on Saturday, Sept. 22, as part of an international “Global Frackdown” aimed at protesting the practice of hydraulic fracturing.

The Global Frackdown, initiated by Food & Water Watch as a day of action against fracking, will be marked by more than 100 events around the world, as far away as South Africa, according to Sam Shabacker, Food & Water Watch’s mountain west director.

Saturday’s event in Longmont, dubbed “Rally ’Round Longmont,” will be held from 11 a.m. to 1 p.m. at Rogers Grove, at 220 Hover Road. It will feature a host of activist groups from around the state, including Our Longmont, Boulder County Citizens for Community Rights, Erie Rising, East Boulder County United, Commerce City Unite Now, Adams County Unite Now, What the Frack?! Shabacker, a Longmont area native, says that in addition to hearing speeches, those who attend will be asked to form a circle around the children in the audience as a symbolic way to “reassert our right to protect our state and our families against fracking.”

In addition, the event will serve as a rallying point to recruit volunteers to go door to door asking Longmont citizens to vote for the proposed ban on fracking and related waste disposal (including injection wells) within city limits. That measure, known as the “Public Health, Safety and Wellness Act,” will appear on the November ballot as Question 300.

On Wednesday, anti-fracking activists delivered a petition titled “Declaration of Solidarity against Fracking” with more than 6,000 signatures to Gov. John Hickenlooper’s office in Denver. That night, he

the pathway that would have made this contamination possible, the agency inspected the wells in the area. It found that out of the 169 wells examined, an unbelievable 167 had inadequate casing and cement to protect groundwater. An injection well anywhere near these 167 improperly cased and cemented would be disastrous. Unfortunately, new industry research confirms that bad drilling practices such as improper casing and cementing are all too common and can result in hydrocarbon and fracking fluid spills.

Another potential pathway that has been documented for waste from disposal wells to escape upwards from its rock trap is by over-pressuring the well. A recent report titled “Leakage Pathways from Potential CO2 Storage Sites in the Texas Gulf Coast and Implications for Permitting” found that over-pressuring disposal wells can damage nearby oil and gas wells, causing leaks even if those wells have been plugged to modern standards. The study also found that high pressure can crack rock formations and is a significant factor in how deep formations can become connected to shallower formations such as those that hold groundwater aquifers. This is why the EPA has strict requirements on how much pressure operators can use in their toxic waste disposal wells. So how careful are the companies to not use too much pressure? After all, the more waste they push into a well the more money they make. was scheduled to appear at an invitation-only meeting about oil and gas issues in Longmont. The event, sponsored by the Longmont Chamber of Commerce, was held at Guaranty Bank & Trust.

Schabacker criticized the governor for not holding a true public town hall in a larger forum, saying that Hickenlooper speaks at oil and gas industry conferences but has turned down requests to appear at anti-fracking events like the one being held Saturday. (The state is suing the city over its new oil and gas regulations, saying Longmont is encroaching on territory controlled by the Colorado Oil and Gas Conservation Commission.)

“Holding it at a bank and only inviting your oil and gas buddies doesn’t seem like a genuine attempt to hear what the people of Longmont want,” Schabacker says.

“He’s only too happy to keynote industry conferences, but he won’t talk to his constituents. … It doesn’t seem like he’s dealing in good faith with the people of Colorado on this issue.”

When asked for a response, Hickenlooper spokesperson Eric Brown told BW, “The governor can’t attend the Longmont event on Saturday because he will be at the long-planned Pedal The Plains event on the Eastern Plains. We are looking for other opportunities for the governor to meet with people in Longmont beyond the panel discussion on Wednesday night.”

on their disposal wells more than a thousand times in the last five years alone.

And finally there is the earthquakeevidenced, naturally occurring fault pathway. Disposal wells are now suspected as the source of literally thousands of small earthquakes that are now being recorded all across the country in areas where oil and gas production are prevalent. As a risk in and of itself, the earthquake danger is small, but the tremors could easily further crack and weaken the plugs and cement jobs on nearby oil and gas wells, which could potentially

cause leaks of toxic waste into groundwater aquifers.

The main threat exposed by the quakes is that there are unmapped, unknown faults and fissures in the very rock that we are counting on to protect us forever from the 30 trillion gallons of toxic waste we have pumped into the ground. The truth is, we have no idea when we drill a disposal well whether the rock we are pumping full of deadly toxins has faults that could release those toxins upward towards the surface.

Consider this assessment regarding unknown faults from the U.S. Geological

Survey. “At well-studied plate boundaries like the San Andreas fault system in California, often scientists can determine the name of the specific fault that is responsible for an earthquake. In contrast, east of the Rocky Mountains this is rarely the case. All parts of this vast region are far from the nearest plate boundaries. … The region is laced with known faults, but numerous smaller or deeply buried faults remain undetected.

Even most of the known faults are poorly located at earthquake depths.

Accordingly, few earthquakes east of the Rockies can be linked to named faults.

… In most areas east of the Rockies, the best guide to earthquake hazards is the earthquakes themselves.”

Translation: The best geologists in the world can’t know that a fault exists thousands of feet below the surface until there is an earthquake that tips them off.

This potential for unknown and unmapped faults and fractures in rock formations helps to explain the findings of two new studies that have discovered that salty brine water suspected of originating from the Marcellus shale formation at 15,000 feet is making its way upward and into groundwater aquifers.

This is happening even in areas where there has been no gas drilling, which indicates that the liquid is finding naturally occurring pathways from which to make its escape from the deep rock that, theoretically, according to the toxic waste disposal industry and the EPA, should have been inescapable.

The researchers can’t say how long this ongoing upward migration of liquid takes, but they guess it could be anywhere from a few years to more than a century to get from down there to up here.

In Pavillion and other parts of the country, there are groundwater aquifers in gas country that contain contaminants such as methane. So how did it get there?

Gas companies claim they are not responsible for this contamination, and that it is instead naturally occurring. But what are the implications if they are correct? You can’t have it both ways.

Polluters, particularly those from the oil and gas industry, cannot keep pumping billions of gallons of toxic waste into underground rock formations each day, either to frack the formation or to dispose of their fracking fluid permanently, all the while telling us that the practice is perfectly safe. They can’t make this argument at the same time they are claiming that gas from these same formations is naturally escaping into groundwater aquifers.

If the gas can escape naturally, so can the toxic fluids the companies are forcing into the formation to fracture the rock under pressure. It is an illogical argument that no state or federal regulators seem willing to take into account when considering the potential risks of using the inner earth as the world’s largest toxic waste dump. Even if it takes a century or more for the toxic stew we have been brewing beneath our feet for decades to begin to find its way through naturally occurring pathways and into our groundwater aquifers, that would mean that it could start showing up in the next 50 years or so. When considered along with all the manmade pathways that are already allowing the disposal wells to leak their waste, it is only a matter of time until we are all in real Boulder Weekly

trouble, which is exactly the sentiment expressed by at lest one expert in a position to know.

“In 10 to 100 years we are going to find out that most of our groundwater is polluted,” Mario Salazar, an engineer who worked for 25 years as a technical expert with the EPA’s underground injection program, told ProPublica. “A lot of people are going to get sick, and a lot of people may die.”

In a phone interview, Salazar told BW that theoretically, operators who pump fluids into the earth should be able to use pressure testing and other methods to detect whether any liquids are leaking out, but the system is not perfect and there is always room for error.

“People have thought about all of these things, and they have been put into regulations,” he says. “Whether in fact the people that are implementing the program have the resources or the energy or the knowledge to be able to analyze or interpret the remote sensing data is another thing.”

Salazar notes that the EPA’s underground injection program is funded at around $10 million a year, “and that amount hasn’t changed much since 1980, so we’re talking 30 years, and you can do the numbers and you can see that in fact it’s probably not adequate, when you’re dealing with a very large universe and probably a miniscule amount of people doing the oversight and enforcement of these wells. The other thing is, the regulated community is extremely powerful and rich.”

He says that even if contamination is detected, it’s difficult to assign blame and determine what caused the leak.

“If you look at cause and effect and the physics of this whole thing, there’s a pretty good chance that we’re going to find a significant number of contaminations that may be attributed to many other causes, that may be caused by many other things, but may also be caused by underground injections that were done improperly,” he says. “There are very few people looking, and even if they were looking, it’s almost impossible to, first, find a contamination plume and, second, to attribute that contamination plume to a very specific resource. A company can fight that forever, because there’s no way to determine if that [contamination] came directly from them or it came from somebody else, or it was present in the natural groundwater to start with. … When you’re about to lose maybe a billion dollars because you did something wrong, you’re going to fight it. Especially now that corporations are people.”

Salazar says there are simply too many variables to assume that no groundwater contamination will occur.

“If you add human nature, a lack of Boulder Weekly

resources, no oversight and, in a certain way, a monetary incentive to do it the wrong way, then you have to wonder if things are going OK,” he explains. “Even if it’s done under the best possible conditions, there’s a good possibility that there is a flaw somewhere in this process. … The best we can do is properly fund a program like this and to properly support, politically and monetarily, the people who are trying to make sure our groundwater, which is 60 percent of the potable water in the world, is properly protected.”

And Salazar says that when contami-

nation does occur, it will be the taxpayers who will be left paying the bill.

“Injection wells could be significant in possibly destroying a lot of potable water, or contaminating a lot of potable water,” he says. “Of course, you can always treat water, but it costs a lot of money. And guess who pays for that?

Do you think the industry is going to pay for that? No, it’s you and me.

“It could be that injection wells will be found to have contaminated a lot of water, but nobody will ever be able to tell who did it, so what they will do is they will go ahead and develop more

efficient ways of treating polluted groundwater so people can drink it.”

Indeed, there are other ways to deal with our nation’s toxic pollution than injecting it into the earth, but those other ways are more expensive. Perhaps it’s time to pay up.

Most people think that they live nowhere near a toxic dump. The truth is, nearly all of us live only a few thousand feet away from the largest, most dangerous toxic dump in the world.

We’ve just been looking in the wrong direction.

lthough 95 percent of consumers agree that country-of-origin labeling for products should always be available at point of purchase on products, meat processors and producers and members of the World Trade Organization are pushing back against a law that requires them to label where meat comes from, saying it is logistically difficult and expensive.

Melonhead LLC, operator of Boulder-based Mile High Organics, has joined the Made in the USA Foundation and the Ranchers-Cattlemen Action Legal Fund in a lawsuit against the World Trade Organization, Secretary of Agriculture Tom Vilsack and the United States of America in response to pending changes to the current Country of Origin Labeling Act (COOL), according to a press release from Mile High Organics. The suit was filed after a summer ruling by the WTO found COOL to be discriminatory to Canadian, Mexican and other foreign beef products.

Mark Dopp, senior vice president of regulatory affairs and general counsel at the American Meat Institute, describes the law as unnecessary and very expensive to implement due to the new obligation of segregating the livestock.

Since March 16, 2009, COOL has required retailers such as grocery stores, supermarkets and club warehouse stores to notify customers about the source of foods such as beef, pork and chicken, according to the Agricultural Marketing Service.

Michael Joseph, CEO of Mile High Organics, says he is focusing on how the law impacts consumers. Mile High Organics’ business model focuses primarily on what it feels its consumers deserve in regards to information about the food they buy.

“We just want consumers to have more information and don’t believe that really important things that go behind the decision-making should be hidden.

Period,” Joseph says. “The extension that we do of that is that we take that to a much deeper level and give as much detail as possible. Never force it in somebody’s face, but you make it available there so that they can make the best decision.”

COOL requires meats to be labeled with whichever country the livestock was born, raised and slaughtered in. This gives consumers the option of choosing whether they want to buy meat domestically or from whichever country they feel produces the best meat.

in one country receives a mixed label under the law. For example, livestock born and raised in Canada and slaughtered in the United States receive a mixed country of origin label that lists both Canada and the United States.

Officials in Canada, Mexico and Peru argue that this rule violates parts of the WTO agreement. Article 2.1 of the agreement states that for a violation to occur, it will involve any “law, regulation, or requirement affecting a country’s internal sale, offering for sale, purchase, transportation, distribution or use and that the imported products are accorded ‘less favorable’ treatment than that accorded to like domestic products.”

The other plaintiffs involved in the lawsuit, the Made in the USA Foundation and the Ranchers-Cattlemen Action Legal Fund (R-CALF), are major proponents of providing proper distinction among meat products to better inform consumers and emphasize the quality of meat made in the U.S. Bill Bullard, CEO of RanchersCattlemen Action Legal Fund, says that “the definition of a U.S.A. meat product is a meat product derived from animals that are exclusively born, raised and slaughtered in the United States, and that’s a key component of animal country of origin law.”

He goes on to say that “if consumers cannot distinguish between an imported product and a domestic product, then they cannot exercise choice based on where they want their food produced.”

Body created a panel of third party countries such as China, India, Japan, Korea and New Zealand to evaluate the potential violations to the WTO agreement. A panel report released Nov. 18 stated that the COOL measure violates Article 2.1 of the WTO agreement by treating Canadian cattle and hogs less favorably than domestic cattle and hogs, according a summary of the dispute on the WTO’s website.

An analysis by the International Agricultural Trade and Policy Center suggests that instead of requiring labels of origin for all meat products, the law can be modified so that all products are presumed to be of U.S. origin unless the label indicates that it is from another country.

According to Joseph, the main purpose of the law is “to just inform people that things are coming from different countries, which means there are different environmental laws and there are different social laws, and so what could have happened is that the product could be much different depending on where it comes from.”

The analysis also acknowledged the importance of providing information for consumers. The report states that “at a fundamental level, our society values information and choice for consumers. Markets cannot operate properly unless information valued by the purchaser is available. Similarly, without meaningful choice, consumers are unable to express their preferenc-

A poll conducted in 2007 by Food and Water Watch revealed that 82 percent of consumers support mandatory country of origin labeling of food. A similar survey conducted in 2008 by the Consumer Reports National Research Center shows that 95 percent of consumers agree that country-of-origin labeling for products should always be available at point of purchase.

On Aug. 21, the U.S. notified the Dispute Settlement Body that it intended to implement the recommendations of the panel in order to comply with WTO obligations, but would need a reasonable time to do so. It is unclear at this point exactly what amendments the U.S. intends to make to the Country of Origin Labeling Act. “If the U.S. decides to make some fixes, it can be done through the regulatory process rather than having to go through Congress to make a new law,” says Chris Waldrop, director of the Food Policy Institute at the Consumer Federation of America.

“This is something consumers want, this is something consumers see value in and should be something we should provide them.”

There is no clear solution for satisfying the requests of the plaintiffs in this case as well as addressing possible violations to WTO agreements. The United States and the WTO have yet to respond to the complaint, but are expected to do so by the end of this year.

rin and I are off itinerary. It’s after 1:30 p.m. when we look up at the clock in the WabiSabi thrift store in downtown Moab and realize we’ve missed our lunch reservation by an hour. After scoring a second-hand Arc’teryx jacket for $10, we arrive back at the Sorrel River Ranch, two hours behind schedule. Lunch is an $18 salad.

In honor of the reopening of the desert after a scorching summer, I said yes to an invitation from the Sorrel River Ranch to come stay for a weekend. They set up an itinerary that detailed mountain bike tours, horseback rides, a patio lunch and dinner near a baby grand piano. After Erin’s summer gut-to-the-rafters remodeling projects and my adventures with a new foster dog, we thought we could use a weekend away.

But from the moment we opened the door to our suite, we’ve been looking at a long shadow cast between where we are and where we usually spend our time.

In the four years Erin and I have been friends, the one other time we’ve stayed in a hotel, it was squeezed to the seams with fellow climbers who jockeyed for the shower around pots of pasta on the stove. More often, the accommodations are tents or, on occasion, her RV, which is wall-papered with covers of the Mountain Gazette and stripped of the bathroom facilities to

adventure use that space to store more gear. We think a well-inflated sleeping pad makes for a comfortable bed, and hospitality is a tent swept clean of the dirt.

And the only element of “on schedule” we ever seem to think about is when we need an alpine start.

While the ranch location boasts proximity to the Colorado River, red rock vistas and adjacent BLM land, what we see is easy access to the Porcupine Rim mountain bike trail and the climbing routes in Castle Valley. At the moments when other visitors might be talking about spaghetti Westerns, we’re revisiting memories of our Castleton and Ancient Art summits, the latter of which we started up at sunset and summitted in total darkness.

(So much for the credit card commercial-abused views.)

Our suite at the Sorrel River Ranch is certainly larger than my apartment and probably bigger than the house she just bought near Leadville.

The first night there, we inspect and admire the finishes — the hammered copper table, the faux copper lamp, the cowboy-esque touches of ropes and spurs in everything from the chandeliers to the coffee cups and paintings of boots and horses hung on the wall. The country twang of a welcoming slideshow plays on the television screens downstairs in the main room to a queen bed made up with white blankets and skirted in denim, as well as upstairs to the two full-size beds, also done in white. Had we known there would be so much open mattress space, we might have invited six or seven of our closest friends. We unpack by unzipping our bags and letting our clothes spill out the belly of them like the guts of a disemboweled insect.

Outside, the temperature hasn’t plunged the way it often does in the desert at night. I sit for a few minutes in one of the Adirondack rocking chairs on the porch, listening to the breeze

rattling in the trees and the sound of the Colorado River ruffling over stones, and looking up at the stars visible just above canyon walls. We’ve got an early morning to prepare for, and a full schedule someone else has mapped out.

The question — which almost defies asking as we curl up with white cotton sheets and plump pillows — is whether two go-it-alone types can ever get comfortable in the pre-ordered, roadmapped, helmet-required lap of luxury.

We’re up before dawn and headed to Moab for a guided biking tour with Rim Mountain Bike Tours at Moab Adventures, which Sorrel River contracts with for off-site adventures. Erin has never done a guided anything before. I have, but not mountain biking.

We’re both a bit skeptical. Our guide mixes a tour of the Intrepid Loop Trail with tips on mountain bike technique.

It’s slower than Erin and I would have gone on our own, but we agree that the technical advice is a healthy refresher course. We stop at overlooks for the Great Pyramid and Big Chief Canyon and follow our guide’s key piece of advice — go fast — up slickrock, down

jumbled sandstone and across sand pits.

The ride finishes with a brief stop at petroglyphs. We’re thoroughly inducted as tourists.

A post-lunch dip in the pool has us lounging in the sun, reading, talking.

There are few other swimmers in the pool. I take a dip in the saline water, pleasantly cool after so much desert heat, and float, listening to the heartbeat pulse of an older man swimming laps next to me — bump-BUMP, bump-BUMP, bump-BUMP. A shiny blue dragonfly lands on Erin’s calf as we talk through sunglasses about the books we’re reading, the boys we’re dating.

The whole thing feels like a Raymond Carver story, and I’m waiting for the martini glass to drop and signal a divorce is on the way. We’re only periphery characters in the plot, of course, the younger women at the pool who turn the heads of the older man who came here with the woman who was once his trophy wife but is older now, and spends her time in the pool gripped to the edge, flutter-kicking, hoping to revive her sagging glutes.

We rinse off and dress in time for

an evening horseback ride, which sets off from the ranch barn. I’m saddled on Hunny Buns, so-named, the wrangler says, because of her sweet temperament.

She can probably tell I’m as disappointed in her as she is in having to carry the weight of an adult. Every time I pat her, she pauses to excrete something else. We will not be friends. Erin’s on a horse that actually seems to want to get up and go. I’m on a horse I don’t even need to hold the reins for.

The guide leads our horse train on a meandering route between red hills so well coated in cryptobiotic crust that they look velvety. It hasn’t rained in a week and a trail of dust lingers in the air behind us, hovering low like fog and glowing gold in the late-day light.

I grew up in Western Colorado, I took riding lessons as a teenager and visited my cousin on her ranch every summer and rode horses there. I’ve ridden English saddles, Western saddles and bareback. I’m used to ponies. And these ponies are boring. But the sunset light on the mesas turns the rock a deeper and deeper red, and it looks like everything John Wayne’s movies ever promised the desert could be.

While Erin chats with the German couple on the ride with us, I talk to our guide, Emily.

She knows enough about biology (her backup college major in case the equestrian thing didn’t pan out) to explain details about the cryptobiotic crust and its life cycle. And she knows the local history of the early Moabsettling Parriot family and a Parriot son’s first ascent on what’s now Parriot Mesa — he climbed it in the early 1900s on God knows what gear. There’s a 5th Class scramble we can only hope was his path; the routes described on MountainProject.com don’t come easier than a 5.8 aid route.

ranch — training horses through the quiet winter months to keep from going totally crazy, and adjusting to the roommates she’s had to bunk up with — have that streak of the authentic struggle the West is known for. She’s the horse-wrangling equivalent of some of the climbers Erin and I know, the kind that determinedly sets out for various destinations to do what they love, even if it means being broke. The kind of person who puts such a high price on quality of life that it overshadows everything from the impossibilities of pioneer access to supplies to the inconvenience of water restrictions in a drought. Even if it means never being able to afford a stay at a small luxury hotel like the one we’re currently bedding down in.

As we head back toward the barn, we can just make out the strains of a Scott Joplin ragtime tune playing in a pavilion, where the ranch is hosting the Moab Music Festival, and the uproarious applause that follows.

That night at dinner, Keith Battaglia, director of sales and marketing for Sorrel River Ranch, stops by our table just before our cocktails are served. Almost before he’s said hello, the words out of his mouth are “Boulder moms.” Just, “Boulder moms.”

He backs up. It’s the target demographic, he explains, and May is the month they should come. It’s a lull between the more frantic tourist seasons, when people crowd to the ranch from places all over the world, and the rates are lower. The desert will be 22 September 20, 2012

warm, but not hot yet.

He’s probably onto something. The ranch has a well-situated capsule-like environment that feels like being in the great outdoors, but with a safety net.

The pool doesn’t run deeper than five feet, the slope to the river ramps off, there’s a playground and the horses are well trained for carrying children. Kids could set off on an adventure while Boulder moms soaked or had feet scrubbed in the on-site spa. A 24-hour sauna could provide some reprieve after kids are tucked in bed.

Plus, they’ve tapped in to the farmto-table movement, and are growing more produce on the ranch farm than can be served in its restaurants. They’re taking food downtown to the farmers’ market and were giving it away at the Moab Music Festival — along with cupcakes, lest you think this is all veggies and no fun.

He talks about a large table they set up in one of the gardens for a farm-toplate dinner they’re hosting at the end of September.

At check out, the concierge’s note is only clear that the bike ride was complimentary. She wants to put the rest of the bill on the credit card I handed over at check in. It’s more than my takehome pay in a month. I explain, politely, calmly. At no point am I really concerned that I’m going to be paying this weekend off for months to come.

ovies are a reflection of culture.

Be it comedy, survival or everyday angst, Americans find touchstones among the moving pictures we see. Yet looking beyond our own theaters can provide a glimpse of what is special to cultures on other parts of our planet.

From Sept. 23-26, the Japan Foundation, the Consulate-General of Japan at Denver and the International Film Series will team up to showcase four films culled from the vault of Nikkatsu Studios, a venerable Japanese film company celebrating 100 years in the business. From early silent films to big-budget productions and soul-searching indie flicks, Nikkatsu could be described as Japan’s version of Universal Studios.

“Films are a big part of Japanese culture nowadays,” says Hiromoto Oyama, deputy consul at the Consulate-General of Japan at Denver. “One of our missions here is to promote a good understanding of Japanese culture among the local community. So this presents [an opportunity] to show what Japan is like, what the Japanese people and Japanese society is like.”

Choosing four films from a catalogue of more than 1,000 titles is a daunting task. The Japan Foundation made selections that not only reflect

the mindset of a film institution such as Nikkatsu, but also serve as snapshots into a transitioning country. Each film is subtitled, so local audiences can follow the dialogue.

An amalgam of Nippon Katsudo Shashin, meaning the Japan Cinematograph Company, the Nikkatsu Corporation has paralleled the ups and downs of the entire country over the past century.

Through growth, stagnation, rebirth and survival, Nikkatsu has in its own way chronicled the opening of Japan to the West and the history of this densely populated island nation.

eerhoof concerts have always been uniquely fun, but lately more of a festive connection between band and audience has been on the quartet’s mind, according to singer/ bassist Satomi Matsuzaki, who lived in her native Japan until the mid-’90s.

“For Breakup Song [Deerhoof ’s 10th album, released Sept. 4], we tried to create a feeling of party dance music,” she says. “When we played shows in the past, I noticed that sometimes our music is not easy to dance to. Then, [when] I moved to New York this year, I went to dance parties and enjoyed it very much.

“Questlove [of the Roots] plays DJ every Thursday at Brooklyn Bowl. Once all the Deerhoof members went there for the after-party of the show, which we played with Questlove. We had so much fun. Questlove’s DJ style reminded me

of our music. He uses short clips of popular dance hits to make audiences keep dancing and just keep going. Kind of busy and mind-bogging in a way. I got a hint from that when we made this album.”

Deerhoof formed in San Francisco in 1994 and acquired its energetic and brilliant Japanese-born frontwoman Matsuzaki in 1996. The sweetly bombastic quartet juxtaposes explosions of dark indie madness with sincere Japanese cuteness and deft musicianship.

Drummer Greg Saunier, who has struggled with Tourette syndrome, spastically throws himself at a comically small drumkit like Keith Moon channeling Gene Krupa. urning back the clock would be a futile endeavor for most of us, but for Frank Nowell, it is a productive and creative activity.

Nowell is artistic director of the Baroque Chamber Orchestra of Colorado (BCOC), a professional period-instrument ensemble based in Denver. Devoted to the performance of music from the 17th and 18th centuries using the techniques and instruments of the times, Nowell and the BCOC have put their stamp on music as familiar as Vivaldi’s Four Seasons and composers as rare today as Henry Purcell and Dietrich Buxtehude.

on the classic King Crimson tune “Neal and Jack and Me” (sans soloing). And Matsuzaki, standing at around 5 feet tall, holds it all together with a tasteful, thumping bass that appears larger than she is. She defines the band with the creative, loveable and sometimes bizarre lyrics she sings in a babyish (yet deeply beautiful) voice.

Matsuzaki has bounced around from San Francisco to Tokyo to London and New York the past few years, and the rest of the band has lived apart as well.

Intra-band drama and ossification often make it difficult for any band to attain or sustain musical success, so it’s incredible that Deerhoof, which achieved some mainstream exposure in the past decade with the critically acclaimed album The Runners Four and by opening a few

The latter means sometimes recording synth-heavy experiments that would be impossible to recreate live with just two guitars, Matsuzaki’s bass and the aforementioned comically small acoustic drum kit.

“We don’t treat live shows and albums same,” Matsuzaki explains. “We make an album as if we create a sci-fi movie. There is no technical limit, like making Transformers! It’s a fairy tale and you can make it up as far as your imagination goes, but we don’t try to recreate those sounds for shows. We are trying to rearrange all the songs from scratch.

We even change the structure. The idea and bones remain.

“Why would audiences wanna listen to exact same music when they have already listened to [the recording]? That doesn’t sound fun to me. I expect thrilling liveliness and improvisations from live shows. We strip down the songs to leave spaces for us to be able to throw our current sparkle ideas on stage. Every show is different for us.”

Romantic tales like the sprightly “Flower” — with its “Let it go / leave it all behind” chorus — will surely show concertgoers at the Hi-Dive in Denver on Tuesday a different, more personal side of Deerhoof.

“Relationships matter is the simplest theme that everyone relates to,” Matsuzaki says. “I think about communication all the time. [Breakup Song] is not just about love relationships but also friendships. We all had breakups in the past and moved on. The album encourages you to move on, be happy and dance! It’s time to party. For many people, the sound of the period instruments is part of the discovery.

In the BCOC, all instruments are either originals from the Baroque period or copies by modern builders. Violins and cellos use gut strings and a bow that has less tension than the modern bow.

The sound is leaner, softer and more transparent than modern instruments. For people devoted to period instruments, that makes works from the 17th and 18th centuries sound bright and renewed, like Renaissance paintings with layers of clouded varnish removed.

“There’s a unique sound that comes from those gut strings, it’s organic and warm and suited to the music that was composed at that time” Nowell explains.

“I like to think that our instruments teach us, in a way. They provide us clues and cues to how to be expressive with the music.”

But Nowell is clear that it is not just about turning back the clock.

“The idea is not just to re-create something, but to communicate this music to a modern audience,” he says.

s the BolderLife Festival enters its second year on the scene, the film/theater festival will take on an array of taboo topics, giving audiences a platform to engage in indepth discussions.

Erin Kelly, artistic director for the festival, says showing films and featuring speakers will allow audience members to find answers to questions they may have after seeing a film.

“So often when people go to films and are left with all this emotion and/or questions, and say ‘Now what?’ they’re able to continue the conversation through BolderLife,” Kelly says.

irst things first: although she’s only eight years younger than he is, nobody will accept that Susan Sarandon would want to kiss Frank Langella on his mouth parts. That premise requires a bigger suspension of disbelief than the rest of Robot & Frank, which presumes the world now has robotic versions of Mr. Belvedere.

Writer Christopher D. Ford and director Jake Schreier have composed a quiet little symphony about dementia and caring for the elderly wrapped in a clever conceit. Of course, this means that while there are moments of sweet tenderness that will make you smile, you will ultimately leave feeling kind of like crap, knowing the sad reality of the struggle the aged have with retaining memory. This isn’t a shortcoming of the film so much as a shortcoming of life, but it’s a pretty big bummer to be reminded about nonetheless.

Langella stars as Frank, a former thief who now lives in a spacious house alone, while his daughter, Madison (Liv Tyler), is flitting about the globe and his son, Hunter ( James Marsden), is busy trying to give his children the father he never had. Frank’s only companion, if you want to call her that, is the stilllovely-after-all-these-years Sarandon, who plays a kindly librarian named Jennifer. With Frank’s mental health in decline and Madison nowhere to be found, Hunter buys his dad a robot caretaker as a substitute for putting him in a nursing home.

The surly Frank detests his cyber-nanny until he realizes that it has no legal parameters. In other words, after decades out of the game due to his old

age, Frank now has a burglar buddy, albeit one that runs on batteries. When rich yuppies move into town, the odd duo set their sights on a major theft, unprepared for the involvement of the authorities and the fact that the robot can’t turn off his recording device, providing nonstop evidence. This all culminates in low-speed chases and sentimental goodbyes, the kind that kick you right in your heart’s groin.

Langella’s performance has received much praise, but he’s basically just playing a sad-eyed curmudgeon that is virtually indistinguishable from much of his other work. He’s certainly compelling, but the emotional blows come from the audience’s personal experiences dealing with elderly loved ones. Ford does well to include clever character beats, like Madison’s political opposition to “robot slave labor” and Frank’s Cool Hand Luke-style reaction to law enforcement.

But since one of the two titular roles is played by a

monotone computer intentionally devoid of as much personality as possible, it never quite congeals. The result is a sometimes moving, sometimes mildly overstated character sketch that carries the emotional weight that the audience brought into the theater.

And given the increasing toll that the Baby Boomer generation will be placing on their children, due to advances in medical technology that allow for such longer life, there’s a good chance most people are carrying some of this with them. Robot & Frank is, at the very least, a reminder that we ought not pass off those we love onto a glorified Speak and Spell.

ther than offering a great celebutant joke based on its titular similarity to an infamous sex tape, 2 Days in Paris was stunningly forgettable and a remarkably unlikely target for a sequel. This is to say, there’s no good reason why 2 Days in New York even exists, let alone anything that would explain how it came to be pretty fantastic.

As she was the first time around, Julie Delpy is the writer, director and star here. Unlike the first time around, this Parisian brings it hard in all three facets, delivering hilarious dialogue and believably madcap situations at breakneck pace with a shockingly nuanced performance smack dab in the middle. Hell, she got Chris Rock to do something that marginally resembles acting here, which is just under the “passing a camel through the eye of a needle” difficulty setting.

Delpy again plays Marion, a spirited artist who is less Ai Weiwei and more Woody Allen. After having a child with and then splitting somewhat amicably from Jack, her love interest in 2 Days in Paris, she is now with Mingus (Rock), an Obama-obsessed NPR radio host and writer for The Village Voice. On the eve of the biggest show she’s ever had as an artist, her family arrives from France.

living room, rampant nudity, and an inside joke about how Mingus’ name rhymes with the act of oral sex, he begins to lose it. Meanwhile, Marion is trying to balance family dysfunction and career frustration, as her big performance art moment, legally selling her soul to the highest bidder, takes a riot-

ously funny turn thanks to perhaps the best cameo ever for fans of indie film.

Somehow, Delpy also manages to fully flesh out a complex relationship, explore inner neuroses and quietly deliver one of the funniest movies of the year. How? This isn’t to say everything is absolutely perfect, with Rock threatening to ruin multiple scenes and various characters’ subplots wholly abandoned. But that’s like dismissing a gorgeous painting because of a few stray brushstrokes, as the set-piece comedic moments, dynamic interactions and whimsical overtones all work so damn well.

Beyond the unparalleled genius of the spoiler-protected cameo, the film’s best attribute is its pace. When laughs are more minor, it becomes a quantity versus quality issue, so moving as quickly as possible is essential. Delpy stops when she needs to but, for the most part, keeps things rolling; the result is one of the more delightful surprises of the year thus far. 2 Days in New York is lithe, clever, spirited and sincere. That’s a lot of great adjectives for a movie with no reason to exist.

Wild Woods Brewery adds a bit of the outdoors to beer

Five years ago, the Evanses moved from the Midwest to Boulder for work, and fell in love with craft beer. Now, what started out as a hobby that they shared with their friends has turned into a full-scale operation.

After experiencing what Colorado had to offer in the way of craft beers, the pair took the next step and began brewing at home.

“We were literally on the stove top with pots and pans,” says Erin.

From there, they expanded with the purchase of a Sabco Brew-Magic allgrain brewing system that allowed the pair to experiment on a slightly larger scale, and begin crafting their own special recipes that would eventually

become some of the featured brews offered by Wild Woods today.

After some independent study, the Evanses took the next step by enrolling in Tom Hennessy’s Brewery Immersion Course, a sort of pub school designed to teach students how to not only brew beer on a larger scale, but also how to maintain the business side of a brewery.

The Evanses received hands-on training at Hennessey’s brewery, Colorado Boy. Wild Woods Brewery only has two barrels, making it smaller than even the majority of nanobreweries, which are classified as having three or fewer barrels. Though the operation is a bit of a baby next to some of the popular micro-

ith craft breweries popping up at every turn, finding a unique selling point is a necessity for each new hopeful. For Jake and Erin Evans, owners of Wild Woods Brewery, nature is not only their inspiration, but also their niche.

The pair has taken nature-inspired recipes that they’ve been developing for years and turned them into the foundation for Boulder’s newest nanobrewery, which is set to open soon. In just a year, the couple has perfected recipes, learned the ropes of the brewing industry and, in April, signed a lease on a small building at 5460 Conestoga Court, near the intersection of Arapahoe Avenue and 55th Street.

“The last year has been a blur,” Jake says. “The alcohol industry is one of the most regulated, so it’s been a lot of paperwork.”

Erin Evans still maintains a fulltime job as nurse, but Jake gave up his job as an engineer to help get Wild Woods off the ground. Though they were both comfortable with their jobs, they say that Wild Woods is truly a labor of love.

“It’s our American dream,” Erin says.

ndochinese, or Indian Chinese, fare traces its origins to Kolkata, formerly known as Calcutta. Chinese Hakka immigrants date back to the 1820s here, and by the early 1900s, a thriving Chinatown had emerged. Throughout the 20th century, restaurants combined the two cuisines, and dishes like Hakka noodles and Manchurian-style preparations became popular. The original Manchurian dish featured chicken in chile, garlic and ginger with soy standing in for the more traditional Indian spice blend known as garam masala. Meatless variants of the Manchurian feature paneer cheese, cauliflower (known as “gobi”) and vegetable patties, which are available at the Krishna Kafe.

category was the $6.99 Dry Manchurian, a meatless cross between a fritter and a dumpling. Most intriguing was the accompanying sauce, which some might find a distant cousin to sweet and sour.

But such a description doesn’t do it justice. This soy and chile concoction resembled that of the sophisticated and slightly tart red sauce that accompanies Chinese banquet steak slices, bringing forth zingy and earthy qualities.

Also enjoyable was the $5.99 Hakka noodles, which resembled thick chow mein in texture and appearance. Simply

garnished with ginger, garlic and spicy oil, I found this toothsome pasta a compelling complement to the more assertive Manchurian.

Krishna Kafe is one of those cool ethnic finds that foodies live for.

Inexpensive, satisfying and spicy, this Lafayette venue provides further evidence of the diversification of local Indian food. Although those fearing assertive spicing may shy away, the adventurous vegetarian diner will find much of the unique menu delightful.

Ted’s Montana Grill, which has a location on Pearl Street in Boulder, is beginning its final fundraising drive as part of its 10th anniversary year, to fulfill its $150,000 pledge to the Dine Out For No Kid Hungry program run by the organization Share Our Strength.

In the national program, thousands of restaurants make the commitment to support Share Our Strength’s No Kid Hungry campaign. Ted’s Montana Grill is among one of the various chains that have agreed to participate in the cause and reward its customers when they choose to donate. Ted’s Montana Grill has also taken its pledge to social media, providing $5 gift certificates to fans who donate $5 or more through their Facebook page.

Restaurant guests are able to directly donate to the cause by circling donation amounts of $1, $5 or $10 on their receipts. Guests who donate will receive the same offer, applicable when they make a future purchase of $20 or more.

The fundraising event at Ted’s Montana Grill will run through Sept. 22. Gift certificate offers through Facebook will last through Sept. 30. Donations are also being accepted online through the end of the year at www.strength.org/teds.

breweries nearby, Jake Evans says this works to their advantage.

“Being a nanobrewery sets us apart,” he says. “We only have two barrels, so we are always fresh. We’ve got our six year-round beers, but we’ve also got smaller seasonal beers that we can brew and rotate in.”

While the Evanses say they enjoy Wild Woods Brewery’s small size for now, further expansion is not out of the question.

“Of course everyone wants to grow,” Erin says. “But we have no plans to can our beer at this very moment. For now, we want people to come see us here at our tasting room and perhaps a few bars and restaurants.”

The couple’s six year-round brews are all inspired by and infused with nature, the element of their product that they deem most distinctive. Wild Woods’ beers include Wildflower Pale Ale, Treeline India Pale Ale, Campfire Red Ale, Ponderosa Porter, Smores Stout and Berry Wheat Patch.

As avid hikers and general enjoyers of Boulder’s nature-centric attitude, the couple looks to the outdoors for ingredients, ideas and inspiration.

“Our best ideas come when our minds are clear,” Erin says. “We don’t want it to be forced.”

“It’s all been pretty organic,” Jake adds.

Once they identify a smell or element they want to represent through beer, they figure out what style would work best and start brewing. Through trial and error, they have produced their signature six offerings and numerous small-batch recipes.

“We get a lot of our ideas while we are out hiking,” Erin says. “I went for a hike during wildflower season and thought about infusing a beer with flowers, and that’s how we came up with Wildflower Pale Ale. It’s getting these ideas from nature and figuring out Boulder Weekly

what we could pair them with and what style of beer would go well with that.”

Other than the six year-round options, the Evanses say they plan to mix in some seasonal small-batch brews.

The one Erin says she is most looking forward to is Tropical Paradise Imperial IPA, a flavor combination of ginger and mango hopped with Chinook, Citra and Amarillo.

Though Wild Woods Brewery takes its own special spin on craft brews, opening a brewery of any kind in Boulder can be both a blessing and a challenge. The audience for craft brews is certainly large, but that opens up the market for certain competition.

Though the competition may appear fierce, other local breweries say that’s not the case. According to Ted Whitney, Avery Brewing Company’s “National Sales Ninja,” each addition to the scene is a welcome and exciting one.

“I think the coolest thing about the craft brewery movement is that all 2,000 of us only make up about 8 percent of the beer people are drinking. So the more this expands, the more we can get people to start expecting more out of their beer,” he says. “We don’t want to fight over the crumbs, we want the pie.”

Wild Woods Brewery is set to open as soon as a few small details come together. Right now, Erin and Jake say they are on schedule to open their tasting room and brewery as soon as Tuesday, Sept. 25, and are excited about what the opening will bring.

“We want it to feel comfortable and not like a warehouse,” Erin says. “We are brewing beer here, but we want it to be a place where people can stop by after work for a beer.”
