Thanks to Dodge and Dyer for their excellent story on the misconduct of certain individuals at the top of the city’s food chain. (“Foxes in the henhouse,” cover story, July 12.) This latest impropriety over employee evaluations is indicative of a systemic problem within Boulder City government.

I speak from experience, as I have been waging my own battle against the city robots for well over 18 months.

At the very least, City Council

should begin to rethink the necessity of even retaining a city manager. Most cities the size of Boulder have never had a manager, or have discontinued this office altogether at a great savings to taxpayers. Shuttering the city manager’s office would force the city attorney’s hand to be more responsive to the very entity that hired him.

And how about this for a low-cost approach to employee evaluations: Citizen evaluations of every non-elected government official that is answer-

able to the public. For me, I would start with the office of the risk manager.

Danish’s latest frack job

In his article “Fracking out of the recession” (Danish Plan, July 12), Paul Danish attempts to debunk the legitimate concerns over hydraulic fracturing, or “fracking,” for shale gas.

He terms the criticism of the process’s copious water use as “hogwash,” forgetting about the highly

toxic chemicals injected into the 3 to 8 million gallons of water used per well each day in his gushing praise for what he considers a “stable cheap supply of gas.” Sure, there’s a load of money to be made in this latest bonanza of last-ditch resource extraction, but “stable”?! ... or “cheap”?! nity enjoyed by an unaccountable, obscenely subsidized industry that uses its astronomical profits to try to mislead the public as its lobbies corrupt our government so that the development of “unconventional” fuels like shale gas and tar sands are favored over the development of intelligent, long-term strategies to localize our economies, preserve the integrity of our ecosystems and develop renewable energy alternatives. ... This is not, as he puts it, some “pathological vendetta against the oil and gas industry” being perpetrated by “greens” or “Democrats” or “progressives.” Sorry, Mr. Danish, we are just human beings trying to assure that our children’s children can escape the fate of living in a nightmarish desert or bog of toxic sludge.

It should be obvious, even to climate change deniers and gung-ho capitalists, that it is damaging to the environment, society and human health to continue with the “drill, baby, drill” agenda, with its ever-increasing need for heavy inputs of water and, ironically, fossil-fueled energy and infrastructure for increasingly diminished returns on investment.

“Fracking out of the recession” is all too in thrall to an economic model unable or unwilling to extrapolate and learn from the well-documented cases of serious contamination in Garfield County, Dimock, Pa., Pavillion, Wyo., and Parker City, Texas, and really get it, that there are limits ... not just to the coveted gas or oil, but to the citizenry’s willing-

ness to put up with the profit addictions running roughshod over our communities, turning them into “sacrificial zones” to maintain a status quo that is itself quite “pathological.”

Reactions to war realities

You did an all-important notification and reality check with your article about number of dead and those kept living (“A war of arms, legs and minds,” cover package, July 5).

Without that very heavy (45 lbs.) body armor, the number of dead would be two to five times as high. I hate to say this, but I only do because if I were injured the way some are (and I saw enough soldiers and Marines wounded) I would not have wanted to be revived. I am in my 60s, having gone into the Corps in ’68, and I know of guys who died/killed themselves within 10 years of devastating injuries — multiple missing limbs; destroyed genitalia, so their urine went into an intestinal bag that was on the belly; blindness; deafness; psychological hate; and constant irritability, with so many turning to licit and illicit drugs, and I don’t blame them.

uncensored City attorneys and politics

t’s time for Boulder voters to consider a fundamental change in how the People’s Republic is run.

Specifically, it’s time to look closely at transitioning the post of city attorney from an appointed position to an elected one.

Currently, Boulder’s city attorney is hired by Boulder City Council and is held accountable by them for his or her performance. The city attorney’s primary function is to serve as the legal advisor to City Council, the city manager and all city boards and commissions.

The city attorney also represents the city in civil litigation and acts as the city’s prosecutor in municipal court.

If you ask why Boulder doesn’t elect its city attorney you’ll be told the position is primarily a support position and isn’t political. A shift to an elected city attorney would politicize the job unnecessarily and strengthen the position, some say, giving the city attorney potentially more authority and independence than is desirable.

Certainly, the debate as to whether it’s better to have an elected or appointed city attorney is far from resolved, with cities across the nation choosing one or the other. But anyone who tells you that having an appointed city attorney keeps the position free from politics is either naïve or trying to deceive you.

An elected city manager has to please the people to keep his job. An appointed city manager, on the other hand, must please the majority of City Council members, who are themselves elected. Six of one, a half dozen of another?

Maybe not.

The problem with the latter is the potential it creates for conflicts of interest, cronyism and factionalism within the city government. Take a look at the troubling questions swirling around City Attorney Tom Carr and two council members — Ken Wilson and George Karakehian.

It started when Carr got a restraining order against local pain-in-the-ass prophet Seth Brigham that would prevent him from attending City Council meetings or sending emails to city officials. Brigham had most recently been agitating about council members’ financial disclosures.

Boulder Weekly looked at those disclosures and discovered that Wilson and Karakehian had provided incomplete or incorrect information. Wilson gave an incorrect name for a property that is part of a real estate trust in which he has a limited partnership, while Karakehian failed to list several limited liability companies (LLCs) in which he is a partner and which represent $6 million in Boulder real estate.

District Attorney Stan Garnett launched what was supposed to be a two-week investigation into Karakehian’s disclosures — but that investigation ended early. It was perhaps only coincidence that just before making that decision Garnett got a call from Carr, who has said that vague wording on the disclosure forms is to blame. see UNCENSORED Page 8

getting opium. Boredom is unbelievable in both Iraq and Afghanistan.

There are scenes that keep playing in my mind, and this old man was noncombatant in his late years — no way I could climb up and down with armor, packs, ammo, etc. That is a young man’s game.

I think of these guys every day.

I also realize that I have only so many years left, but at least I had a life where I could get around on my own. But because of certain things, my mind was wrecked.

My anger knows no bounds for those who planned these wars in the late 1990s, and then 9/11 gave them the excuse they needed.

Everyone should see the badly wounded.

In 1970, I remember the screaming going on in what we Marines and soldiers called the “nut ward,” which was in a large Naval hospital.

Dennis Sullivan/via Internet The stories on “the new realities of war” were a disappointment, particularly in contrast to the fine investigative journalism Boulder Weekly has recently produced regarding Valmont Butte, the city attorney, GMOs, etc. “The changing face of patriotism” section repeats the lie that anti-Vietnam protesters spit on soldiers when they returned from the conflict. This myth surfaced several years after the Vietnam War was over, and resurfaced when the Bush administration worked to discredit peace activism. The claims that antiwar protesters spat at Vietnam veterans have been thoroughly researched, and shown to be false: see The Spitting

Image — Myth, Memory, and the Legacy of Vietnam by Jerry Lembcke, New York University Press, 1998. Lembcke, a Vietnam vet, points out that “In reality, antiwar activists approached Vietnam returnees, if at all, with informational leaflets offering services and inviting them to join the movement.”

The stories share a narrow mindset that the Iraq/Afghanistan wars are justified and glorious, and the soldiers fighting them “were righteously sent into Afghanistan,” that they are fighting and dying to protect freedom, that soldiers are by definition brave (Michael Callahan), that they are making sacrifices for our country (Don Tartaglione), that “we” have thrown them into war(s) and “we” are thus the cause of the suicide epidemic ( Joel Dyer). I’m sure the Pentagon and military-industrial death machine supports that view, but the fact is Americans have less freedom now, thanks to the Patriot Act and the National Defense Authorization Act. The suicide epidemic is a tragic statement about the military and its inability and unwillingness to take care of soldiers. Perhaps it’s also a statement about unnecessary, unjustified, illegal and immoral wars and their effect on soldiers. I don’t question the courage of most soldiers and their willingness to make sacrifices, but I do question whether the sacrifices being made in these wars are helping Americans or indeed helping anybody. There are many brave patriots making sacrifices to try and stop the madness that is the reality of war.

Now it gets really complicated, because Wilson and Karakehian are tasked with evaluating Carr’s job performance — along with that of City Manager Jane Brautigam, the very official whose job it is to demand corrected disclosure forms from them.

Meanwhile, Wilson and Karakehian have decided on their own to scrap the procedure City Council has used for staff evaluations in the past and cut out the independent human resources consultant in favor of using city staff.

So we have an employee — Carr — intervening with a restraining order at a time when someone is asking rude questions about financial disclosures, two of which contain incorrect information. And now the two councilmembers whose financial disclosures contain incorrect information are creating a process to evaluate Carr (that will perhaps give him a raise) in a way that disregards prior City Council

practice and which might put city staff in the position of evaluating their bosses without the buffer of an independent consultant.

None of this proves anything, of course, but it certainly feels hinky.

If our city attorney were elected, however, the employee-boss relationship would not exist between him and members of City Council, eliminating a host of potential conflicts of interest.

Instead, the city attorney would be answerable only to the voters, who could toss him out of office if his actions caused concern.

Which is, incidentally, what happened to Tom Carr in Seattle. He was voted in — and then voted out by a hefty margin.

When problems arise in a democracy, the answer is usually more democracy.

City Council should put the issue of an elected city attorney before the voters.

COSTLY PERCEPTIONS We have to weigh in on what George Will said about Republican presidential candidate Mitt Romney’s unwillingness to release additional tax returns.

Will said, “The costs of not releasing the returns are clear, therefore he must have calculated that there are higher costs to releasing them.”

Amen, brother. We are seeing similar resistance among certain Boulder City Council members in releasing accurate financial disclosure information that was not included on their forms.

And now, for some reason, 2011 financial disclosure forms for candidates appear to have been removed from the city’s election website, in favor of blank pages prepared for the November 2012 election. At least we can’t find them anymore, and neither can gagged political gadfly Seth Brigham.

Again, it just looks bad, especially during a time when our city government’s transparency is being called into question.

CHINESE CLOTHES So the U.S. Olympians’ uniforms were made in China, and Senate Majority Leader Harry Reid (D-Nev.) is calling for them to be burned and replaced with American-made apparel.

Burned? Like books?

Well, it’s these kinds of things on which politicians should make up their minds. Either we’re going to circle the wagons and keep jobs in this country, or we’re going to answer the other familiar call and produce college graduates (workers) who can compete in the realities of a global marketplace.

You can’t have it both ways.

Sure, it would be nice to say that the threads our Olympians will be wearing in the London Games were made in the good old U.S. of A., but at the same time, isn’t a basic tenet of our American free-market capitalist system to reward those who can find ways to make cheap goods? Would it be intrusive government intervention, which many reportedly detest, to mandate that our athletes’ uniforms be made in a more patriotic (and expensive) manner?

Granted, it was a major faux pas to have these outfits made outside the country, but can’t we set aside petty, unsportsmanlike nationalism in the spirit of the Games?

NO SCOUTING BOYS On to the Boy Scouts. Scout leaders have reportedly held a secret meeting and decided to uphold their ban against gays.

Um, what century are we living in? Luckily, some enlightened individuals, including Boy Scout board members Randall Stephenson of AT&T and James Turley of Ernst & Young, are working to reverse this ridiculous policy.

Really, how do they police this kind of thing? Teach how to tie a knot, but avoid the part about the rabbit going around the tree and down the hole? Start scrutinizing how scouts whittle sticks?

For the record, here’s the BSA’s policy: “While the BSA does not proactively inquire about the sexual orientation of employees, volunteers, or members, we do not grant membership to individuals who are open or avowed homosexuals or who engage in behavior that would become a distraction to the mission of the BSA.” Nope, sure wouldn’t want any “distractions” from important work like tying neckerchiefs and sewing on badges.

It’s time to teach our kids — whether they are in Scouts or not — that one’s sexual orientation has nothing to do with their ability to succeed.

news Activists: Mysterious land scars may be caused by oil/gas waste

hey kind of look like alien-made crop circles, but the jury is still out on whether mysterious linear shapes in Weld County are the work of frackers or ranchers feeding their cattle.

Colorado activists have raised concerns about satellite imagery of what appears to be scarred earth caused by the dumping of oil/gas drilling waste, but state officials maintain that most of the strange patterns are simply areas where livestock feed was deposited.

Shane Davis, chair of the Poudre Canyon Group of the Sierra Club, and Gary Wockner, Colorado program director of Clean Water Action, submitted the aerial photos to Gov. John Hickenlooper on March 5.

In an accompanying letter, Davis and Wockner wrote that the images seem to support rumors that have been circulating about the illegal disposal of drilling and hydraulic fracturing (fracking) fluids and other wastes.

“These images appear to support the rumored allegations and may suggest that drillers and frackers may have been driving tanker trucks off-road, opening the valve on the tanks while driving, and spraying drilling and fracking fluids and wastes across the landscape,” they wrote. “The images suggest that the chemicals sprayed out may have killed the vegetation on the landscape — green areas are turned orange/brown or completely white. Two-track wheel tracks can be seen trailing some of the alleged possible dumping sites.”

Davis and Wockner asked Hickenlooper to direct state officials to investigate, which they did over the following 11 weeks. Davis says the state requested two extensions due to the difficulty of the research involved.

In a May 22 letter, Thomas Kerr, acting director of the Colorado Oil and Gas Conservation Commission (COGCC), dismissed the claims.

aerial photos and conducted on-site inspections at a “subset” of the locations in question on May 5 and May 10. The state’s investigation appears to focus solely on the Guttersen Ranch, where Kerr said “many” of the wells identified by Davis and Wockner are located.

The Guttersen Ranch is an active cattle ranch that also has numerous oil and gas wells, and the fenced property is strictly monitored to prevent dumping and trash disposal, Kerr wrote. He attributed the strange land scars to two things: the permissible spread of drilling mud and the feeding of cattle.

Kerr acknowledged that “in a few cases, fresh waterbased bentonitic drilling mud was land applied to well sites as a beneficial soil amendment,” which is allowed under COGCC rules. Bentonitic mud, which is produced as the drill bores through the earth and sends rock “cuttings” material up the well shaft, “have effectively been used to stabilize areas of blow sand throughout Northeastern Colorado,” Kerr wrote, and “areas where it was applied have been re-seeded and re-vegetation is occurring. The land application of this material only occurs with the consent of the landowner.”

He noted that other byproducts such as oily wastes and fracking “flow-back” fluids “cannot be land applied and require proper handling and disposal” according to state and federal rules.

Kerr said that interviews with one of the landowners indicate that the linear features identified by Davis and Wockner “were likely temporary livestock feeding areas with the ‘orange/brown’ features depicted in the photo likely comprising hay or other livestock feed for 1,000 head of cattle.”

He concluded that “we have not been able to corroborate the allegations. No evidence of illegal dump-

ing of drilling fluids, drill cuttings, fluids or other wastes was identified.”

But Davis still has his doubts.

He notes that the COGCC did not address the aerial photo that features what appears to be gray, delta-shaped flow areas. And since most of the wells in question are operated by Noble Energy, he questions whether the outcome of the state’s investigation was affected by the fact that it was released just as Hickenlooper was joining Noble officials to announce the opening of the company’s new operations center in Greeley and its plans to invest $8 billion in the area over the next five years.

Davis dismisses the idea that the drilling mud is beneficial to croplands, given that it contains radioactive isotopes. He also disputes the notion that the land scars were simply areas where cattle were being fed, and he says he plans to collect soil samples on public lands where the patterns have been made.

A Boulder Weekly examination of satellite images and aerial photos taken of the Guttersen Ranch over time failed to uncover other examples of the patterns found by Davis and Wockner, even though the outline of the shapes that the pair discovered in photos taken in 2006 have remained for years and are still visible today.

The lack of similar lines in other areas of the property during other periods raises several questions. Was that the only time the ranchers fed their cattle in that manner? Why are the lines only found emanating from See FRACK TRACKS? Page 12

oil/gas wells? Why aren’t there similar scar patterns elsewhere on the ranch and in other years, assuming the ranch has fed its cattle at other times and locations?

When reached by phone, Guttersen Ranch coowner Art Guttersen declined to answer questions about their cattle-feeding patterns or processes.

“I’d rather not say anything, just because we don’t want to draw any more publicity to our name or our ranch,” he said. “I thought it was a closed case. If you’re going to do a story on it, it’s just going to open the whole thing back up.”

When advised of Davis’ continuing doubts about the explanation offered for the strange lines, Guttersen said, “I don’t give a shit about the guy, to be honest with you.”

The 12 site reports of the inspections contain virtually identical narratives written by COGCC inspector Jim Precup. Precup writes that he found no cuttings, and that he called Guttersen about the claims. “[Guttersen] said that he had also received a letter from the Sierra Club and was highly offended by the letter. He said I could check all I wanted and that he was willing to open the property to anyone to check for cuttings. He said they would find none. He told me that he had over a thousand head of cattle and what the satellite views represented were feeding stations, nothing more.

“I also called Mr. Ryan Litfin from Noble and asked him if he knew of any drill cuttings being placed on the Guttersen property? He said why would anyone think that they would place cuttings right next to their wells?

He also said Noble had their own sights [sic] to dispose of drill cuttings.”

When reached by phone, Precup referred questions to Kerr. When asked about the cattle-feeding explanation — and why the patterns don’t appear in other ranch locations and time periods — Kerr told BW, “because the cattle might not be there at other times, and he might not be feeding them. It’s just a periodic thing. They don’t always hay their cattle, only in certain times when they need to have additional feed that the land’s not providing. And I’m not a rancher, I’m not an expert on it.”

He added that it’s “a matter of circumstance where aerial photos managed to capture it, and then the cows eat it up, so then it disappears. It’s a time-sensitive thing.”

Kerr acknowledged that his staff did not address the fact that the scars lasted for years and seemed to be an isolated case. But he says his staff did take a few soil samples “where the site looked like there was something that was questionable,” and those samples turned up nothing untoward.

Kerr clarified that any bentonitic mud would have been spread on and around the well pad, which is 12 July 19, 2012

allowed, but it wouldn’t have been dumped in lines.

Drill mud that is used for cropland is tilled into the soil with the permission of the landowner and under a permit obtained by the oil/gas operator, he explained, so the patterns identified by Davis and Wockner are being attributed solely to cattle feedings.

When asked about the image showing gray, deltalike flows that Davis says was left out of the investigation, Kerr looked at the photo and acknowledged, “I see the gray spots coming off the pads, and the one that’s circled, it looks like it’s actually running off the pad. I’d have to ask [staff ] what they found on those specific locations.”

When asked whether any of the areas identified by Davis and Wockner were not located on the Guttersen Ranch, Kerr said he didn’t know. Similarly, he couldn’t say why the purported cattle-feeding lines only appear next to oil/gas wells.

“It was difficult for us to figure out what actually happened until we talked to Mr. Guttersen about it,”

Kerr said. “It was the best thing we could find, and it took us a while to try to figure out exactly what it was.”

He claims that Davis and Wockner are barking up the wrong tree.

“I understand Mr. Davis and Mr. Wockner’s concerns, I think they have great concerns and it’s good, but I just think they’re trying desperately to find something to use, and I’m just not sure that this is exactly the smoking gun they’re looking for.”

He acknowledged that the COGCC does periodically hear rumors of trucks illegally dumping wastewater, but it’s usually described as being done on streets.

“Typically, when those claims are made, they generally dump it on the road so that it’s hidden,” Kerr said. “In other words, if they dump brine water on a field, it could easily result in salt kill, and so they don’t do that. The accusation is typically that they dump it on the road.”

And it would be foolish to dump illegally on a piece of property where you have hundreds of wells, he adds.

“The last thing you want to do is get caught doing something like that, because the surface owner is going to take action against you,” Kerr said.

Tisha Schuller, president and chief executive officer of the Colorado Oil and Gas Association, showed one of the aerial photos in question at a June 12 Loveland City Council meeting and explained the scars away as the application of beneficial drill cuttings and mud on cropland.

“One of the things companies do is they can use drill cuttings for agricultural purposes,” she told the council.

When Boulder Weekly asked Schuller for further comment, Doug Flanders, COGA director of policy and external affairs, sent the following to BW via email: “While COGA has not seen nor been privy to the follow-up correspondence between the COGCC and the Sierra Club, our understanding is that the Sierra Club’s accusation was unfounded and unrelated to any oil and gas operations.”

t was another nasty, council-bashing, marathon session in Longmont on Tuesday night. But when the name-calling, finger-pointing and flip-flopping finally came to an end and the vote was taken, the Longmont City Council had passed a new set of oil and gas regulations that represent the first real test of local government versus state government when it comes to regulating the oil and gas industry.

As a result of passing its own rules, which in some instances differ from and are more restrictive than the state’s existing regulations, the state is now expected to sue the city.

The final vote on the oil and gas ordinance was 5-2, with council members Bonnie Finley and Katie Witt voting against the new regs, while their counterparts Brian Bagley, Sarah Levison, Alex Sammoury and Gabe Santos joined Mayor Dennis Coombs in supporting the measure.

Both Witt and Finley, as well as Mayor Pro Tem Santos, spent much of Tuesday evening arguing against the portion of the new regulations that prohibits drilling in zoned residential areas.

All three expressed their belief that it was likely the residential language that would lead to the city being sued by the state. Councilman Bagley countered by describing the residential drilling restrictions as the very “heart and soul” of the ordinance.

Even though he seemed to have been siding with Witt and Finley on Tuesday, as well as in recent meetings, at the very last minute Santos voted in favor of the regulations, stating that he had only just

then made up his mind on how he would vote on the new regulations — despite the fact that the controversial issue had been before council for months. His move came after the other four council members had already assured the ordinance’s passage by stating their intention to vote in favor of the measure.

The actual vote on the new regulations had originally been scheduled to occur back in May, but after state officials raised the specter that the city would likely be sued if it tried to limit drilling in residential areas, several council members, including Santos and Sammoury, voted to shelve the ordinance and extend a moratorium on drilling permits while the city tried to work out the legal issues with state officials. In the end, the majority on council went forward with the regulations, stating that they hoped the state would not sue the city but acknowledging that it is likely the price that Longmont must be willing to pay to maintain control over its landuse rules, which directly affect Longmont residents’ quality of life, health and property values.

In what can only be described as an effort that backfired, the Colorado Oil and Gas Association (COGA), an industry trade group, apparently attempted to pressure councilmember Sammoury, who was considered to be on the fence regarding the ordinance, by making phone calls to Longmont residents that reportedly stated, among other misleading things, that Sammoury had ties to out-of-state anti-fracking organizations. Several of the calls went to personal friends of Longmont’s goal is to prevent scenes such as this one in nearby Frederick, where homes and wells are often very close together.

Longmont City Council passed its new oil and gas regulations on Tuesday, July 17.

Sammoury who tipped him off to the industry’s ploy, he said, and one of the calls actually made it to his wife.

It was clear from Sammoury’s comments Tuesday night regarding the phone calls that he was not amused by the group’s efforts. While only he knows for sure, it seems likely that the attack by COGA may well have nudged Sammoury toward supporting the new regulations, as opposed to creating the intended pressure that would push him into voting against the ordinance.

In addition to supposedly preventing drilling in residential areas within city limits — “supposedly” because a company can ask for an exemption from the residential ban if such ban would prevent the development of the minerals beneath the residential property — the new oil and gas rules also provide for 750-foot setbacks from occupied homes or structures such as schools and churches (more than twice the distance of current state laws), and 350-foot setbacks from activity areas such as playgrounds and soccer fields. It is the city’s contention that in all but the rarest instances, modern technology such as horizontal drilling will make it possible to develop the minerals under zoned residential areas without actually siting a well within 750 feet of those residential areas, thus avoiding the need for any lawsuits pertaining to denying development to mineral rights holders. The ordinance also requires water testing as well as protections for potential cultural assets such as historically significant sites and/or artifacts.

Also on the agenda Tuesday night, and perhaps the evening’s most controversial item, was the development agreement between the city and Colorado-based oil and gas developer TOP Operating Co. Last fall, TOP Operating had sought several drilling permits from the city that would have allowed the company to drill at several sites around Union Reservoir and Sandstone Ranch, both very popular recreation areas controlled by the city. It was TOP’s intention to drill these sites Boulder Weekly

that led to the drilling moratorium and the city council’s decision to attempt to strengthen its oil and gas regulations in the first place. It was also the thought of having well heads and production platforms near these popular family attractions that inspired local activists to form the group “Our Health, Our Future, Our Longmont,” which has been approved to gather signatures on a petition that would put a measure to ban fracking in Longmont on November’s ballot. On Tuesday night, following the approval of the new oil and gas regulations, city council voted 6 -1 (Levison was the lone vote against) to approve an agreement with TOP that allows the company to develop eight wells around Union Reservoir and another three wells in proximity to the baseball and soccer fields at Sandstone Ranch, hence the current controversy.

It is quite likely that by this Friday, July 20, Our Health, Our Future, Our Longmont will have gathered enough signatures to allow for the general population of Longmont to decide if all fracking should be completely banned within the areas of city jurisdiction.

However, the ban will not be retroactive, which means that the city’s approval of the TOP agreement means that the two recreational areas will be home to drilling rigs, fracking fluids, wellheads, production platforms and all the associated contaminants and emissions, regardless of whether the majority of Longmont residents vote for the ballot measure.

For the first two hours of Tuesday’s meeting, most of those speaking were angry at and/or pleading with council to postpone the vote on the TOP agreement, to allow the voters of Longmont to decide their own fate.

But in the end, most likely because those on council recognize that it is extremely unlikely that a full ban on fracking will ever stand up to the scrutiny of the courts, the TOP agreement passed, and now Longmont residents

will never know if the drilling at Union Reservoir and Sandstone Ranch could have been prevented. But by negotiating the contract with TOP, city council was able to guarantee that TOP will abide by the city’s new oil and gas regulations, and TOP has agreed to not sue the city for creating regulations that are stricter than those required by the state. As Sammoury put it, “they [TOP] didn’t get everything they wanted, and we didn’t get everything we wanted, but it was the best we could do.”

Longmont has taken the first bold step for all of Boulder County and its cities. As the advancing drilling rigs make their way west, ever deeper into unincorporated Boulder County and onto the outskirts of Lafayette, Louisville and Broomfield, what happens to Longmont as it takes a stand against the state should matter to all of

the county’s residents.

How much does it matter? Take the short 10-minute drive from Longmont east to Frederick, Firestone and Dacono, and you will have your answer.

Wells are less than 50 feet from homes, your throat burns and your eyes water after five minutes in a public park, churches and schools have wellheads and production platforms in their parking lots or the fields right next door, and a public library surrounded by brown tanks in every direction looks like it’s making its last stand.

What happens to Longmont matters.

Unfortunately, due to a newly discovered loophole in our state’s oil and gas regulations, even Longmont’s best efforts to prevent oil and gas development even in its residential areas may not work. (See story below.)

n July 17, Longmont City Council finally took the bold step of passing new oil and gas regulations that are actually stricter than current state laws.

The Longmont ordinance requires a minimum of 750-foot setbacks from occupied structures, compared with the state’s 350-foot requirement, and Longmont’s new regs also prohibit drilling in residential areas of the city.

It all sounds good, but a recently discovered loophole in state laws may severely hinder any benefits that might

have come from the city’s new rules.

During Tuesday’s spirited debate among the members of council, those opposed to the section of the ordinance that prevents drilling in residential areas — more particularly councilmembers Bonnie Finley, Katie Witt and Gabe Santos — repeatedly expressed their belief that the residential prohibition section of the ordinance was unnecessary because no company was ever going to be drilling in residential areas in Longmont. This view stemmed from the belief that the

It makes sense, except for one thing. It’s completely wrong, because the Colorado Oil and Gas Conservation Commission (COGCC) has a loophole that trumps all setback requirements.

This loophole was recently unearthed by the research of Shane Davis, at large executive committee member and information and research manager for the Colorado chapter of Sierra Club, and was presented before a joint city council study session in Loveland on June 12.

Over the course of a year-long investigation into why some wells were seemingly drilled in violation of state law — more than 4,000 active wells in Colorado are closer to a structure than the state’s required 350-foot setback — Davis found that the COGCC’s setback laws don’t apply to previously existing wells, including those that have been abandoned over time.

This is a very significant discovery, considering that in Boulder County alone there are 245 active wells and 528 inactive wells. As shown on a well history map on the opposite page, there are 72 active and inactive wells just in and around Longmont. Some are located right in the heart of subdivisions, while others are in the middle of golf courses.

Ironic, considering that councilmember Finley repeatedly, and apparently incorrectly, assured concerned citizens on Tuesday night that no one would ever be drilling on the city’s golf courses. They can if they want.

As this loophole currently exists, drilling could literally and legally take place in the backyards of Longmont residents. In Firestone, just a stone’s throw from Longmont to the east, production platforms currently exist as close as 48 feet to some homes.

The only way to control this

loophole, outside of eliminating it by way of legislation at the state or national level, is for cities and counties to create setbacks from abandoned and producing wells for developers. This does not require approval from the state.

Unfortunately, in many instances, development has already run its course over the tops of the old wells, and for now, it’s up to the oil and gas industry to decide if it wants to drill in residential areas.

Sprayed trespass Injunction in Delta County sets precedent for other counties

A

recent decision from a district court in Delta County could affect the view of trespassing, aerial spraying and the restitution available to farmers who lose crops due to drift.

Judge Charles Greenacre ruled in the case of a pesticide drifting onto an organic farmer’s property that the plaintiffs, and the public in general, have an interest in not having their property invaded by third persons or things. In this case, the invader was a pesticide, used to spray for mosquitoes, that crossed into a neighbor’s organic farm, compromising that farm’s organic certification and the health of the farmer, who had chosen to grow organically on the recommendation of his doctor.

The judge granted a permanent injunction, ordering the defendants only to spray with proper licensing, in accordance with label directions, with properly calibrated instruments, not within 150 feet of the plaintiffs’ property and only when the wind direction and speed would not cause drift onto the plaintiffs’ property.

Every week, the defendants, James and Georgia Hopper, had been spraying Fyfanon ULV Mosquito Insecticide, which contains malathion. At high doses, malathion, an organophosphate, can overstimulate the nervous system and cause nausea, dizziness or confusion and, in extreme cases, convulsions, respiratory paralysis and death, according to the Environmental Protection Agency.

The defendant used a fogger to spray Fyfanon mosquito insecticide over a 300-foot swath of ground.

Under certain wind conditions Fyfanon can drift as far as 1,000 feet, according to the lawsuit.

Plaintiff Gordon MacAlpine has registered as a pesticide-sensitive person with the Colorado Department of Agriculture, and posted notices to his neighbor about his health condition and the status of his organic farm.

“Its our hope that all sprayers around the state of

Colorado will look more seriously at whether their activities caused the spray to drift onto other properties, which our case makes clear is a trespass,” says Boulder attorney Randall Weiner, who represented the plaintiffs.

Weiner says he believes that this case will go a long way toward making aerial applications of pesticides or herbicides a liability for collateral contamination.

“I also think that any agency or individual who aerially applies pesticides or herbicides, by airplane or helicopter, is being reckless and is opening themselves to liability for trespass because of the high potential for collateral contamination, especially if such contamination impacts organic farms,” Weiner said in an email.

Weiner argues that this case changes the notion of who, and what, can trespass. It’s no longer only a person walking onto private property — it’s tiny droplets, a mist.

The ruling could, he says, have implications in other venues — like questions around genetically modified seeds spreading or groundwater contamination — but county officials hesitate to speculate on that.

The focus in Boulder County, according to Adrian Card, Boulder County’s extension agent from Colorado State University, is on cutting these issues off before they sprout by keeping communication open.

“In the agricultural community, we’re doing a pretty good job of neighbors knowing each other as much as possible and understanding each others’ needs, trying to foster more of a proactive, communicative, considerate interaction,” Card says.

Colorado Department of Agriculture pesticide division staff echo that — farmers do what they can to cooperate.

There are instances where communication breaks down, Card says, or products are applied off label, or something in the application goes wrong, and the

problems can go both ways.

“There’s instances where organic farms can contribute to weed population in the area, so it’s not always a one-way perception of harm,” Card says.

The Colorado Department of Agriculture fields about 50 complaints a year about improper use of pesticides, perhaps half from alleged pesticide drift, says John Scott, pesticide program manager for the CDA. The CDA’s enforcement centers on the rules for the pesticide outlined on the federally approved label on the pesticide. Its review of the situation with MacAlpine and the Hoppers showed no label violations.

“That particular product is designed to actually drift for mosquito control,” Scott says. “Adulticide products for mosquito control, they are inherently designed to actually drift in the air column and come in contact with the mosquitoes.”

In situations of misuse, unsafe use or a label violation, the CDA can issue cease and desist orders for firsttime offenders and, in the case of commercial users, levy civil and monetary penalties. But they don’t pass on restitution to the farmer who filed the complaint.

“The department’s role is specifically to determine if there is a violation of the Pesticide Applicators’ Act,” Scott says. “We don’t have the ability or the authority to pass on any type of damages to the complainant.”

Though complainants have always had the option to go to court, the lawsuit sets a precedent for an injunction to prohibit pesticide spraying, even when not a label violation, that interferes with a neighbors’ use of the property.

Federal pesticide laws already prohibit spraying on other peoples’ property, says Conrad Lattes, a Boulder County assistant attorney, and the county doesn’t view the case as remarkable.

boulderganic “It shouldn’t be different than any other nuisance or trespass case, that you can’t interfere with your neighbors’ enjoyment of their property,” Lattes says.

“The county’s right, the label already protects folks,” Weiner says. But “practically speaking, to really protect farmers and organic farmers you’re going to need strong court protection, and as far as I know this is the first time in the state of Colorado the court has stepped in and provided that protection.”

Weiner has dealt with a client whose farm was inundated and the label didn’t offer protection. The case also sets precedent for getting an injunction, and the use of trespass laws, rather than referring to labeling laws on pesticides, allows for plaintiffs to receive damages.

The burden of proof will still fall to the plaintiffs.

In this case, plaintiffs MacAlpine and Rosemary Bilchak had evidence that included photographs of the defendant spraying and test results from the Colorado Department of Agriculture, which had taken samples from both the plaintiffs’ and the defendants’ properties.

Tests came back positive for malathion, even in the plaintiffs’ home.

“That didn’t stop the defendants from trying to make us prove that it was their product; even in our slam dunk case the defendants were trying to say the chemical wasn’t from their property,” Weiner says. No one else had been spraying for mosquitoes, and the defendant admitted to spraying.

“Everybody’s going to have to prove where the pesticides came from,” Weiner says.

In the ’90s, Weiner represented Colorado Citizens Against Toxics in a suit against Boulder County for spraying the herbicide tordon from helicopters and won increased buffer zones around the water sources for the town of Superior. The judge didn’t award an injunction that year, but shortly thereafter, the county stopped aerial spraying, a move that Weiner says felt like a political victory.

As a district court decision, the case is only a precedent, not a controlling decision, but it echoes similar decisions from judges in other states.

In 2011, a judge in the Minnesota Court of Appeals came to the same conclusion and found pesticide drift to be a trespass.

Sen. Michael Bennet and Rep. Scott Tipton have introduced legislation to protect Chimney Rock, and Colorado State Rep. Dickey Lee Hullinghorst has argued that Chimney Rock and Browns Canyon are in need of national monument status.

The campaign was run in coordination with local branches of the advocacy organization Progress Now.

Chief Niwot’s spirit lives on

T

New community project draws from historic Arapaho tribe leader to inspire change

he story of the city of Boulder has a sordid side.

It starts with the first white men settling onto the land, a Native American Arapaho peace chief seeking coexistence with the new inhabitants, and his eventual death during the Sand Creek Massacre at the hands of the white men he had hoped to make peace with.

Now, a new community effort, One Action-One Boulder (OAOB), hopes to remind Boulder residents of its past while working to build stronger equity within the city. The year-long educational effort is being called “Niwot’s Arrow,” for Chief Niwot, and it includes, among other events, a multimedia performance, Rocks Karma Arrows, created by Kirsten Wilson, and an exhibit at the Boulder History Museum, curated by Julie Schumaker.

Before Boulder was ever Boulder, the valley where the city now sits was nothing but healthy grassland, where elk roamed freely and ancient tribes lived off the land. In the mid-1800s, Chief Niwot — whose name means “left hand” in English — was peace chief of an Arapaho band who worked tirelessly to create mutual respect at a time when what had been Native American land was being claimed by white settlers. Schumaker says Niwot’s tribe would often trek from Boulder Valley to Denver to trade with the settlers. Being one of the few Native Americans who spoke English — a skill Schumaker attributes to trapper John Poisal, a 24-year-old Kentuckian who married Niwot’s sister and taught him to speak English at a young age — Niwot established amicable relations with the white men.

But with a rush for land and the Colorado Gold Rush in 1858, more settlers flooded the plains, causing relations between the ancient tribes and settlers to tense.

What was at first tension soon turned into a tumultuous relationship between Native American tribes and the Caucasian colonizers. White settlers soon invoked the Doctrine of Discovery, a law Schumaker says allowed them to stake a claim to any land they found, regardless of any tribes already present. Native American tribes were raided often as hostilities grew, yet despite many young warriors — both Arapaho and Cheyenne — urging war, Schumaker says elders like Chief Niwot, Black Kettle, White Antelope and Little Robert Troup Raven argued that fighting would only destroy their way of life faster. Even as Native Studio Tectonic Americans were being attacked by the oncoming hordes of settlers and their food sources depleted as city expansions continued, Niwot and his band stayed on course, hoping to rally support from the few whites sympathetic to their cause, Wilson says.

But their efforts ended in tragedy. On Nov. 29, 1864, the peace chiefs assembled with their tribes at Fort Lyon. the Sand Creek Massacre. And though the U.S. government would soon apologize, shortly after the massacre Col. Chivington paraded through the streets of Denver on his horse, displaying the scalps of Native Americans he and his men had killed.

This is part of Boulder’s history that One Action-One Boulder is trying to distill. Schumaker says creating the Boulder History Museum exhibit at first proved difficult because there are no known photographs of Chief Niwot.

“There are no photos attributed to Niwot, no artifacts attributed to Niwot, but there are to the Arapaho,” Schumaker says. “So we knew that going in, but for me that was scary because exhibits are all about visuals.”

Luckily, the Boulder History Museum got help from Margaret Coel, author of Chief Left Hand and guest curator for the exhibit.

“Coel had done intensive research in the ’70s on Chief Left Hand, having lived here in Boulder and knowing somewhat about him,” Schumaker says. “But she realized his story had not been told. So she really delved into the history of Niwot and dug up many historical documents, as she had always liked the Arapaho culture.

Having her on board, having already done so much of the preliminary research, was a great help.”

Using documents and diary entries, the Boulder History Museum has managed to create an exhibit that showcases the impact Chief Niwot’s legacy has had on Boulder.

Wilson, production director for OAOB, says telling Chief Niwot’s story is about learning history to understand the present in a deeper way.

created the situation we had here and what we may want to do to answer those problems so they don’t manifest in the future.”

Issues like racial and economic injustice are what Wilson says she and OAOB hope to bring to the Boulder conversation through Chief Niwot’s story.

Part of telling that story involves Rocks Karma Arrows, which is currently playing at the Black Box Theater in the ATLAS building on the CU campus. Rocks Karma Arrows examines Boulder’s history through the lens of Chief Niwot’s quest for peace and eventual death. Using projection screens that span the length of the stage, Rocks Karma Arrows shows historical photographs of Boulder in the time of the Arapaho while using local Colorado historians to narrate the unfolding story of the Sand Creek Massacre.

With its small stage, few seats and isolation three floors underground, the Black Box Theater is an intimate room.

Live music brings a Western ambience to the production as interpretative dancers reenact the struggles of Native Americans. With Wilson leading the discussion, occasionally breaking the fourth wall to connect with both the actors and the audience, Rocks Karma Arrows becomes less about Boulder’s rocky history and more about what we can do to make our town a more equitaBoulder History Museum ble and welcoming place for all races and classes.

entral City’s 2012 season offers an emotionally varied program. With the final opening night of the season Saturday, the ghosts of Benjamin Britten’s Turn of the Screw joined the starving artists of Puccini’s La Bohème and the homespun Americans of Rodgers and Hammerstein’s Oklahoma! on the bill.

The contrast between the two fullscale operas is particularly intriguing. La Bohème offers a tragic love story told through gorgeous melodies and lush harmonies. In contrast, Turn of the Screw features a small orchestra whose spare sounds create an appropriately unsettling, if not exactly hummable, musical ambience for Henry James’ ambiguous tale of haunting and seduction. Both are the works of master dramatists, but they approach their audiences in very different ways.

As soon as the curtain goes up on La Bohème, Marcello’s abstract painting standing center stage shows that the production has been updated from the original Paris of the 1840s to the early 20th century — calling to mind the artists of America’s “Lost Generation” and Hemingway’s Moveable Feast. The effective production has numerous touches of the times, including costumes, electric lights and a typewriter.

The artists’ shabby garret was even more bare in the final act, both revealing the poverty of their hand-to-mouth existence and adding an extra touch of poignancy to Mimi’s death when she had no place to lie down but a bare mattress on the floor.

Ghosts haunt Central City’s ‘La Bohème’ and ‘Turn of the Screw’

by Peter Alexander coloration and strength of her voice to excellent effect. The male quartet of bohemian artists makes a first-rate ensemble.

Eric Margiore’s Rudolfo, looking anachronistically like a 1950’s Kerouac, has a pleasingly Italianate sound that was only occasionally strained. Troy Cook and Deborah Selig were well matched and effective as Marcello and Musetta.

The young cast looked their parts and acted effectively except in the third act, where the battle between Marcello and Musetta upstaged an awkwardly static Mimi-Rudolfo pair.

This took much of the steam out of their love duet and sent the opera into the final act on a suppressed emotional level. Elsewhere, director Kevin Newberry deserves credit for strongly delineating the emotional dynamics of the characters.

Conductor John Baril led a firm, convincing performance, even though Central City’s small pit, tucked under the stage, allowed the strong voices to almost overwhelm the orchestra.

Turn of the Screw presents two challenges to producers. The dramatic challenge is to duplicate the ambiguities of James’ story — are the ghosts real, or in the governess’ fevered imagination? — with live actors on stage.

Central City’s production only fitfully meets this challenge.

Particularly effective use is made of projections, including views of the country house and its grounds as seen through the governess’ camera — an inspired invention for this production that literally turns the view upside down and symbolizes the governess’ ungrounding from reality.

On the other hand, I thought the emphasis on the governess’ sexual fantasies — toward the children’s guardian and especially the boy Miles — was too explicit. You don’t have to be a prude to think that some things are more effective if implied, especially in a ghost story.

Also upsetting the balance between real and unreal was the physicality of the “ghosts” and their direct interaction with the other characters. The story is better served if the two groups of characters inhabit separate planes and the ghostly characters do not step physically into the real world of the governess and the children.

The second challenge is musical: there are no low voices, with even the one tenor singing in his upper register.

With all the parts colliding in a narrow range, individual voices too easily lose their identity. More dynamic nuance on the part of individual singers would have prevented portions of the score from sounding like a high-volume contest.

In the cast, Vale Rideout was an excellent Quint, creating the dangerous nature of his character through both gesture and voice. As the governess, Sinéad Mulhern powerfully portrayed her character’s increasingly unbalanced mind, aided by the excellent makeup of Dave Bova.

A special word must be given to the brave work of John Healy from the Colorado Children’s Chorale as Miles.

He handled one of the great challenges to boy singers with outstanding success.

The orchestra under conductor Steuart Bedford played the difficult score on the highest professional level, and well deserved the ovation at the end.

overtones Love’s labor Langhorne Slim returns to the road after giving love a chance

L

anghorne Slim had a good thing going.

The nomadic roots rocker spent almost his entire adult life peddling his scuffling folk-blues odes to wastrels, scoundrels and lovelorn wanderers. In all that time since college, he’d managed to avoid ever paying rent.

Then, two years ago, at the age of 29, Slim (born Sean Scolnick) met a girl and put down roots in Portland, Ore. Let’s just say they didn’t take, and Slim’s back to the only real home he’s known the last decade: the road. Like a longtime convict, there’s something comforting in the familiarity of lockup.

“I’ve been doing this traveling musician for all my adult life. You not only get used to it, but born for that kind of cage,” he concurs. “There’s a time and a place for stability, sitting still and enjoying things. I just haven’t found that exactly yet, and I don’t think that’s a bad thing. It’s just the case for some of us that we’re made to go from town to town, moving and shaking, as they say.”

That’s certainly been his way since his first national tour in 2003. He opened for Trachtenburg Family Slideshow Players after meeting Jason Trachtenburg at an open-mic night. The Family’s homey intimacy and ragtag charm matched Slim well, and he’s continued to build on it across four albums.

His delivery is artless, direct from the cuff of his heart to you. When not heartbroken or impassioned (sometimes one in the same), he has a smart ass’s gift for language, declaring that “the line’s been drawn, the land’s been led, but you can’t always eat what you’re

fed,” on political paean “The Great Divide.” It’s off his new album, The Way We Move.

Written before the break-up, it’s strangely prescient at times, in the way you sometimes subconsciously hear the train coming long before it becomes necessary to abandon the vehicle on the tracks. “When I listen back to [some tracks] I’m like, ‘Holy shit, we were still sleeping next to each other at the time,’” he says.

Just having anted up in a way he never had before, Slim felt the pain even more intensely.

“We broke up about a month before we got into the studio, and I was in a pretty raw emotional state,” he says.

“Thank goodness I have this thing in my life. I can put all of that energy into making this record with my band as opposed to laying on a couch watching Jerry Springer and feeling sorry for myself. I think it comes across more in the emotion of the record than it does lyrically.”

If he was feeling down, he did have a band to uplift him, and the album’s its most band-like to date, according to Slim. The lineup changed with the addi-

tion of bassist Jeff Ratner just prior to recording 2009’s Be Set Free. At the time, he was more like a session hand than member of the band, but in the intervening years Ratner and the band have grown tighter and contributed more this time. Indeed, the new lineup’s prompted Slim to change his backing band’s name from the War Eagles to the Law. While Slim lived in Portland, the band remained on the East Coast, and writing on tour’s difficult. They got around this with scheduled get-togethers and focused work sessions. But not only were the songs written in closer collaboration than ever before, they were recorded that way too, as the band trekked into the Catskills to work with producer Kenny Siegel (Wooden Wand, Graham Parker).

“We wanted to live together, eat together, and be around each other at all times, so for about three weeks or something like that were in this old historic house up by Kenny’s place,” Slim says.

“This time it was much more of a family affair, and we’ve been with each other long enough to kind of know how to act

with each other, know how to play with each other. I think it shows in the music.”

In fact, the album bubbles with a rollicking camaraderie, like locked-arm buddies with mugs raised to the ceiling amidst a lively front-porch hootenanny.

It runs from the groovy organ-driven roots-soul “Two Crooked Hearts” to the lonely, banjo-driven ache of “Salvation” and the bustling handclap alt-country of “Bad Luck,” where he declares, “I was born with a thorn in my soul, sometimes it hurts / Bad luck got in me, but I will survive.”

The funny thing is that for all Slim’s peripatetic travels, his heart’s a homebody. This was only his second relationship in 10 years.

“I’m a unique breed, in that though I am built for a rambling lifestyle, not so much in the relationship way,” he says.

“It’s my first time in kind of my adult life I’ve been single man. There’s perks to it, sure, but I enjoy having that partner in crime.”

Admittedly, survival is heartbreak’s consolation prize, but Slim’s not looking for pity, and he harbors no illusions. Nor will he blame his hard-touring life.

“Love is the most beautiful thing on this planet, but it’s a hard motherfucking thing to sustain, nurture, feed and make last. That’s true if you’re a touring musician, a doctor or a janitor,” Slim says. “It’s easy when it’s easy and it’s really, really hard when it’s hard. It definitely takes a certain kind of individual that would put up with [all the touring].

But you still have to learn the dance, and it’s a delicate ballet.”

High seas hijinks

he words “Thank Jerry Bruckheimer” are not often strung together, but without his inspired decision to turn a Disney theme park ride into a big-budget summer tent pole movie nearly 10 years ago, I’m guessing that pirates would not be enjoying their current entertainment industry renaissance. Though real-world pirates still ply the seas today, they have horrible PR departments. They are generally poverty-stricken, murderous thugs that lack the whimsical cachet of peg legs and sassy parrots.

But slather mascara on Johnny Depp and let him prance about doing his best Keith Richards impression, and you can reignite an entire genre. Kids once again pretend to be pirates — of course they all clamor to be Capt. Jack Sparrow rather than Blackbeard, but what can you do? And everyone from porn producers to the steady hands that guide the Colorado Shakespeare Festival (CSF) senses that these are the times to fly them bones. (That’s both a Jolly Roger and a Thomas Paine reference for anyone playing at home.)

Robert Louis Stevenson’s Treasure Island rounds out the CSF’s 2012 season.

It shares Mary Rippon outdoor theatre space with Twelfth Night and Richard III, so its set can sprawl and the action on it flow fast and furious. The deck of a ship, complete with a wooden ship’s wheel and all manner of ropes and rigging, dominates the center of the stage. Trap doors abound, giving the actors numerous points of ingress and egress, and the ship’s mast provides a dramatic height from which more than one character plummets to the unseen depths below.

Treasure Island tells the tale of young Jim Hawkins (Caroline Barry), a fatherless lad of good heart and mind who finds himself embroiled in pirate adventures. It is a coming of age story in

forced to bequeath to Jim the most classic of pirate plot devices, a treasure map.

Thus does Jim’s tale of derringdo begin in earnest. He finds a wealthy benefactor, Squire Trelawney (Gary Alan Wright), willing to finance a journey to find the treasure and becomes the cabin boy to the ship’s captain, Smollet (also played by Weitz). Jim is even instrumental in recruiting John Silver (Logan Ernstthal) to act as ship’s cook. If that name feels only an adjective short of familiar, it’s because it is. On the high seas, not everything is what it seems.

Buckles are swashed, mutinies occur, there are multiple fights to the death, and the word “lubber” is tossed around extravagantly. Jim learns that the world is more about the grey than black and white, and he discovers that there may have been more to his long-lost father than he previously thought.

While I wouldn’t take the really young ones to it — it features multiple murders, a beheading and many loud gunshots — Treasure Island is the most kid-friendly show at this year’s CSF. It’s a fast-paced, often silly, simple, fluffy fantasy, which makes it perfect for children or the child inside most adults.

Professional skydiver Nick Batsch jumps for many different reasons.

Whether he’s diving to break world records (which he’s done five times) or to commemorate fallen friends (who have accumulated over the years), Batsch says his motivation is always evolving.

The 30-year-old skydiver, a Longmont resident for six years, has toured the country and the world, collecting distance records and national and international championships at nearly every competition he attends.

And as if jumping out of a plane wasn’t exciting enough, as a canopy pilot, most of what Batsch does takes place just five feet off the ground.

miles per hour, canopy pilots, also known as “swoopers,” fly small, high-performance canopies — about 33 percent of the size of a normal parachute — to increase their speed and power. Swoopers jump from around 5,500 feet, spiral down toward the ground with their canopy deployed and take a sharp turn just before hitting the ground. They then fly horizontally through the air just a few feet from the ground, seeming to defy gravity. Their performance is measured in three categories: distance, speed and accuracy.

Since joining the sport in 2006, Batsch has not only tested his own limits, he has pioneered and pushed the limits of the sport itself, cementing him-

self as one of the best in the business, according to Nancy Koreen, the United States Parachuting Association’s (USPA) director of sport promotion.

“He’s definitely at the top of his field and has been for quite a few years,” Koreen says. “Some of the world records he’s set have far surpassed any of his competitors.”

Artificial ponds are used as safety measures to protect swoopers from small accidents after they’ve completed the initial turn near the ground.

“Instead of breaking their leg, they walk away from the injury and learn a lesson,” Batsch explains. However, he cautions, if a swooper miscalculates the initial turn, “Sometimes the impact is too great at too great of an angle, and even on water it can be as hard as concrete at those speeds.”

“It’s hard,” Batsch reflects. There have been “a lot of tragedies over the years.”

One of those tragedies occurred just last month, when 43-year-old Tagle, the Californian pilot who set a distance record in the 2011 competitions and one of the sport’s more influential canopy pilots, died after crashing while training in Norway. Tagle came in second place behind Batsch in the World Cup Championship in 2011 and had just earned a spot on this year’s U.S. Parachuting Team roster to compete again in the World Championships in Dubai in October.

“It never comes easier,” Batsch laments. “It’s just always different depending on how close someone is to you and how much they affected your life or how much you affected theirs.”

Barb Batsch Batsch also recently lost two other close friends within six months of each other. Teammates Emily Berkeley and Brady Kane, who had more than 500 and 5,000 jumps respectively, both died in swooping accidents.

“The more you’re in it, then the more people around the world you know who are … at higher risk because everyone is doing these new extreme things that have never been done before,” Batsch says.

But, he adds, “it’s hard to have regrets when you’re doing something you love so much and so much passion is involved.”

Although the threat of death or serious injury is around every turn, Batsch says it’s better than “living one of those safety lives where you work 9 to 5 every day and then you end up at home watching TV and seeing what everyone else is doing with their lives.”

“It’s worth the tradeoff,” he Batsch in a new world adds. “Someone in 30 years record distance run could live a more full life than someone [living a safe life] could fill in 100.”

Having a supportive family and a skydiving girlfriend who understand his passion in the face of such real risks certainly helps. Batsch’s family has made it to all of his national meets in the last three years.

“They actually are a great driving force behind what I do,” says Batsch. “I couldn’t do it without them.”

After an 11-year career and nearly 5,000 jumps, Batsch says his motivations have changed and continue to change based on his accomplishments and accumulated experiences.

“Originally,” Batsch says, “[I was] comparing myself to other people.”

He never expected to take his talent to the professional and ultimately global stage, he says.

“Then it became a motivational drive of wanting to become that world champion, beating that one guy who’s won so many times in a row,” he says. Eventually, that became a reality.

Over everything else, Batsch says his lost friends “were a big motivational force behind me winning the World Championships last year. They had been behind me the whole time anyway, so it was great to have that push and that extra motivation to get things done.

“I’m sure it’s greater than any other motivation,” Batsch says, “to want to do something for another person — in honor of somebody.”

sk former Friday Night Lights actor Taylor Kitsch what he did this summer, and if he’s honest, he will tell you he set his career on fire. Yes, let us weep for Kitsch and his Greek God physique, overflowing bank accounts and unquestionable green light to mate with whomever he wishes! In the span of two-plus months he has flopped (John Carter), floundered (Battleship) and flubbed (Savages) his way back to footnote status in the world of popular culture. The good news? It sure looks like he’ll have Blake Lively to keep him company as fame’s benchwarmer.

Savages, Kitsch’s last summer gasp and director Oliver Stone’s latest pulpy romp, is quite nearly good. Aside from its bloated meandering and terrible choice in leading lady, it was one solid landing away from respectable marks from the judges, even if the level of difficulty wasn’t all that high. Unfortunately, the ending wasn’t “stuck”; it just sucked. But that’s more on writers Shane Salerno and Don Winslow, along with Stone, than on the woeful, perfectly-buttocks-ed Kitsch.

For all its attempts to confuse and obfuscate, Savages is a really simple story of drug deals and kidnapping. It’s also one of those movies where almost everybody has a stupid name nobody would ever have in real life. Our narrator is O (Lively), which is short for Ophelia. She is in what some may consider a “reverse polygamist” relationship, in that she is shared by best friends Ben (Aaron Johnson) and Chon (Kitsch), who has arguably the single most ridiculous, non-science fiction name ever.

good weed. This catches the eye of a Mexican cartel, ran by Elena (Salma Hayek) and her enforcer, Lado (Benicio Del Toro). When Ben and Chon won’t play-agree to work with said cartel, Elena has O kidnapped. The boys leverage their relationship with DEA agent Dennis ( John Travolta) to attempt to get their mutual love toy back.

Savages has been described as a sort-of criminal fairy tale, something indicated by the inherent fantasy of two men finding the charisma-free Lively worth murdering over. In that sense, it almost works. With Del Toro given ample chance to prove why he’s the best at skeevy, strange bad guys and Stone playing with non-hyper but still stylized visuals, the noir-ish tale is nearly fun.

Even Kitsch, who plays a former soldier who served in Iraq and Afghanistan and thus drops awkward references to things like “going full Sunni,” finds his acting niche: He can play angry, violent dudes with a small sensitive side … and that’s all.

But then comes the ending. Whoa doggy, that ending or, actually, endings (plural). Both are wretched and largely serve to undo the goodwill towards what came before, but had they been in the reverse order, it maybe could have been mildly forgivable. Maybe. By and large, Savages works as engaging pulpy goodness. If nothing else, Kitsch can hang his head on the fact that he was not the worst lead in this one. He should send Ms. Lively a nice “thank you” card for that.

hen the Flagstaff Fire became a potential threat to the Flagstaff Restaurant the week of June 25, Boulder’s restaurant community and friends offered to help the co-owners, Don Monette and his sons Mark and Scott, relocate their award-winning wine collection.

Scott Monette says people were willing to lend their trucks and labor to help clear out Flagstaff House’s wine cellar, which contains around 15,000 bottles and 3,500 different selections.

“We got a lot of phone calls from people offering to come help, other

restaurants and the community and wine connoisseurs,” says Monette. “So it was really surprising and very nice to hear that.”

Mark Monette drove to work the day the Flagstaff Fire began and avoided the road closure that occurred later that day.

“The first night we did close because the fire was moving fast, and they didn’t know what direction it was going, and they were also trying to get vehicles up there to get behind the mountain,” says Monette. “So they closed the mountain roads for everybody.”

Even though there was a lot of smoke, the Flagstaff House was not

ordered to evacuate, and Mark Monette was able to stay on location the first night of the fire. He says he didn’t get the feeling that the fire was on the way because it was on the back side of the mountain.

But if evacuation is ever necessary, Flagstaff House’s wine cellar is divided into four different rooms, with one specific room that contains firstgrowth wines, or high-end wine selections that are the most important to save.

“So if we did need to pull out, everything is pretty much together,” says Monette. “We could probably

BOULDER’S ORIGINAL CLOSES ABRUPTLY

Longtime breakfast nook The Original Pancake House recently shut its doors after nearly 20 years serving flapjacks for Boulder residents.

The location adjacent to the Boulder Marriott hotel at 2600 Canyon Blvd. is empty and locked, phones have been disconnected, and signage has been obscured by blue tarps. Records indicate that the local franchisee of The Original Pancake House out of Oregon had been dogged recently by unpaid bills.

Court documents filed July 16 in Boulder County District Court show that Tyrus LLC, the company doing business as The Original Pancake House in Boulder, was served with a demand for payment of rent and possession of premises by Virginia Corporation Apple Six Hospitality Ownership, Inc. The plaintiff and property owner alleges that Tyrus LLC racked up unpaid rent and other lease charges totaling more than $30,500, which the owner says justifies the seizure of the premises, according to the filings.

hile Monterey Jack cheese takes its name from mid-1800s entrepreneur and foreclosure-happy landlord David Jack, this product actually originated with Franciscan clergy at the local mission.

Jack was the first to successfully commercialize this product, which was initially known as Queso Blanco. Contemporary variations include pepper jack and an aged variant called dry jack. Vella Cheese is the most well known producer of dry jack today, and this cheese is appreciably harder than its namesake. Initially favored by Italian families in California, dry jack is a viable alternative to European grating cheeses used to garnish pastas and salads.

’m not sure if this is more Pavlovian or Proustian, but for many normal folks, hearing a particular song transports them back to a particular time and place. For example, I’ll always associate the first day I set foot in Boulder in 1994 with Seal’s “Prayer for the Dying,” as that was playing on the then-local station. Unlike normal people, I’ll also associate restaurants with certain times in my life. For that mid-Clinton era, I’ll fondly recall long-defunct eateries like the LA Diner and Trios.

One survivor of that time is the Mountain Sun Pub and Brewery. Long before Boulder established its bona fides as a foodie town rife with artisan takes on comfort food, this inviting spot exemplified local dining for me. The funky, slightly counter-culture ambience, the offering of meatless courses alongside tasty burgers, and the then-novelty of being a brewpub made for an egalitarian locals’ experience.

An old favorite endures

by Clay Fong On a recent visit for lunch with friend Cyn, I was happy to see not much has changed, and judging from the size of the crowd, things are currently thriving.

The specialty brews are still available, as is my favorite house-brewed root beer. If memory serves me correctly, the menu isn’t all that different from the ’90s, with a selection of soup, salads and sandwiches.

Unlike most visits in the past, service was a touch slow out of the gate and towards the end. But in between, our server was attentive, and once we put in our orders, the food arrived swiftly. For starters, we went for the $5.25 hummus of the day, and on this day the chickpea puree was spiced up with green chile.

My main takeaway is that most hummus preparations should have this seasoning

in it from now on, as it rendered what could have been a merely pedestrian dip memorable. Plenty of crisp tortilla chips and slices of soft bread accompanied this meatless treat, and these quality accompaniments lived up to the high standard of this starter.

Speaking of chile, Cyn enjoyed her $8.25 Monterey chicken sandwich, although she felt the addition of a red pepper would have taken it to the next level. Hers was a simple preparation of clean and rich-tasting guacamole, namesake jack cheese and chicken breast. She was particularly enamored with the tender texture of the bird, which was demonstrably moist without any evidence of undercooking or use of overpowering marinades.

Burgers have always been a menu staple here, and I went back to that old standby, the $8 basil blue cheeseburger, with fries for a buck more. While some might find the default medium patty too cooked for their taste, the meat’s flavor still had a steak-like quality. A saucy condiment of basil and cheese give this sandwich its name, and a touch of fresh herb contributes a bright, fresh note absent from most other burgers.

Hot and hand-cut, the fries came with strips of potato skin still sticking to them, which tasted fine, although more crispness would have helped them achieve perfection.

While Boulder’s culinary landscape is almost unimaginably different from what it was in the ’90s, it’s comforting to know that the Mountain Sun can carry on with few changes. This no-credit-card establishment still follows the beat of its own drum.

oused in the former site of Juanita’s on West Pearl, the new Pastavino is a winning exercise in fairly priced Italian classicism. Featuring entrees like veal legs, New York steak and baked fish cioppino, this eatery also unsurprisingly features a plethora of noodle dishes.
