Highroad Cargill’s GMO hypocrisy

an you have your hypocrisy and eat it, too?

I don’t think so, but Cargill Inc. is doing its damndest to get away with its version of the old admonition that eating your cake today means not having it tomorrow. Cargill, the $2.3 billion-a-year food conglomerate, is a huge producer and user of food ingredients that contain genetically manipulated organisms. But it has a

marketing problem — by huge margins, consumers here and around the world do not want to put those GMO Frankenfoods on their families’ tables.

Thus, Cargill has been a ferocious, deep-pocket opponent of every state law and ballot initiative that would mandate the labeling of any product containing GMOs. Better that families be kept in the dark about what they’re buying and eating, says Cargill — better for its profits, that is. Indeed, the chairman of the conglomerate’s board is also on the executive committee of the industry lobbying front that goes all out to kill every right-to-know provision for consumers. Any such label, he scolds, would be “misleading.”

But — whoa, what’s this? It’s a press release from Fortress Cargill, proclaiming that the diehard giant is now marketing a non-GMO soybean oil that — voila! — announces on its label that the product is GMO-free. Has the

Excuse me, but corporations don’t have hearts. They have bottom lines, period. And the bottom line is that Cargill’s terminally-hypocritical honchos see dollars laying on the ground that they’re not getting. So, weasels a company man with the cumbersome title of Food Ingredients Commercial Manager, “Despite the many merits of biotechnology, consumer interest in non-GMO ingredients is growing, creating opportunities... for food manufacturers.”

That is the clearest expression you’ll ever get of corporate integrity.

You predicted a dimmer future for the Camera than was the popular view, speculating on staff reductions, rate hikes, falling demand, even a sale, or the dissolution, of the Camera.

My recent renewal invoice, which I have included, seems a vindication of your judgment. I have subscribed to the Camera, formerly the Daily Camera — since 2005 or so, when it cost ten dollars per month, delivered, which seemed a good deal, and my current rate, thirteen dollars, is manageable for a senior owning my own condo.

My new rate, eighteen a month, I feel is excessive, and, like many readers, may surprise Prairie Mountain by calling their bluff — canceling, or allowing to lapse, my subscription.

Like many locally, I finally got fed up with Comcast, paying more each month for less and less. The Journal estimates Comcast loses 199,000 accounts annually, explaining the frantic war of cable and dish companies to sign up new accounts. Similar to cable, the demand for a paper is elastic, not inelastic, and consumers will reach a point when we cancel. I feel the Camera is both arrogant, as a local monopoly, as well as both provincial and overstaffed.

The sale of their building — now being dramatically razed — the bidding out of former printing, the demise of TV booklets, and moving to a smaller office would all reduce costs, not increase them. Moving to Boulder nearly 40 years ago, I recall the Camera and Post as evening papers, the Daily as independent, the Rocky — a better paper — still in print.

I feel Prairie Mountain — note the Denver, not Boulder, address — may have taken monopoly for granted, and may be surprised how many readers, like myself, will reject a 50 percent hike, cancel the Camera for the Post, or simply see a daily paper as no longer necessary. I feel I am not the only Camera reader to feel I am asked to pay more and more for less and less, and feel the Camera may have made a poor, if not fatal error in boosting rates so much so rapidly, and sense that Boulder Weekly may have accurately forecast the future.

Help needed behind bars

OK, so I wanted to write the forum the last time I was here (in jail) and [ask] when you also can [write] an article on the overcrowded conditions of Boulder

County Jail. I wanted to share with you why [the jail is crowded], from trumped up charges to petty offenses. Petty offenses trumped up to felonies to get more time out of each person. Now I would like to talk with you about the aftermath.

This is what happens when the jail is overcrowded. Let me just say the last time I was in jail I wrote my Public Defender numerous times. My point was always the same stating “I need help.” I voluntarily wanted to take a fairly new drug called

“Vivatrol.” This is for alcoholics or problem drinkers. It blocks the receptors similar to suboxone for opiate withdrawal or addition. I also pointed out that I have untreated C.P.T.S.D. on P.T.S.D. and need help. This comes with other mental health issues such as depression, anxiety etc. In every letter and phone call I stressed this matter. It was never brought up. her out and relapsed. The courts sought fit that I should not be allowed to go there. This despite many talks my mother had with the D.A., victims advocate, and directly to the judge. Everything I own is there. So in that moment I was made homeless. No treatment, no home, no help, just two years probation. Every word or plea asking for help went unnoticed.

So another reason for the overcrowding is the fact they plan on you failing. It keeps things moving and money coming in.

Hopefully this with bring some awareness to the public on what’s really going on.

Boulder’s dying treecover

Boulder is losing 10 percent of its tree cover this year, both from tree death and branch death. Through a broad range of species, many trees are dying branch by branch from the top down.

Conifer (pine) species are being hard hit perhaps because they have a lack of resources because they make the soil acid and impoverished, and because they do not lose their leaves. Last year I noticed the Thuja’s going first, now many species of conifers are in their death throws. Juniper is still holding out because its leaves are fatter and more waxy. The deciduous trees are fairing better because they get new leaves each year with a fresh resistance to radiation.

Even leguminous nitrogen fixing trees are suffering from branch dieback and truncated yellowing leaf growth.

The loss of atmospheric ozone and the radiation from Fukushima is killing the trees in Boulder and indeed in much of the USA exposed to rainfall/ snowfall, high altitude, high UV and drought. The trees most vulnerable are those whose roots are covered with concrete, those with little soil organic matter or humus, demineralized soil, with little mycorrhizae and soil biota and exposed to vehicle exhaust. There is a sense that the trees immune systems are collapsing from a broad range of environmental stressors including drought, loss of water table, pollution, EMF pollution, radiation, excess solar radiation, demineralization, loss of soil organic matter and compromised soil biota.

With the tree branch die off, I assume it is a dieback of the root mass, forcing the tree to do a self-pruning of the upper branches. This tree dieoff is definitely caused by a radiation reduction in the ozone layer, combined with radiation in precipitation destroying the microbial foundations of the tree roots starving certain more vulnerable trees.

Certain trees not in idea conditions or compromised by human structural interference such as concrete are dying first.

I estimate that within 10 years only the radiation resistant genres and those in ideal growing conditions will be alive. The city could save the trees by mulching with compost, inoculating with mycorrhizae and soil biota and remineralizing, compost tea and green cropping under trees with legume groundcovers. And reworking surface runoff into sinks to build up the water table throughout the city.

Ballot initiatives give the people a veto over corporate polluters

Who suffers from the consequences of fracking — the polluted water, air, and land? Who gets sick and dies?

Who should make the decisions about whether the oil and gas industry fracks in our towns, cities and counties?

In the last couple of years, the people of Longmont, Broomfield, Lafayette, Fort Collins and Boulder have voted to ban or place a moratorium on fracking in their communities.

They have sent a clear message that they have the inalienable right to stop corporate activities that will harm them.

The state and the oil and gas industry claim they have state preemption.

They tell local communities that they can drill for oil and gas 350 feet from school yards, playgrounds and the tender lungs of 3-year-olds.

The notion of our inalienable rights not to be poisoned by corporate pollution is at the heart of two ballot initiatives headed for the ballot. Ballot Initiative 75 is a statewide ballot initiative that says that “all political power is vested in and derived from the people” and that the people have “without limitation the power to enact local laws protecting health, safety, and welfare” (http://www.cocrn.org/colorado-community-rights-amendment-2/).

The second ballot initiative asks “Shall Boulder County establish a Home Rule Charter Commission?”

This petition is the first step to create a home rule county. The voters will also select twenty-one charter commission members, who will write and propose a charter. The proposed charter will be voted on in a future election.

Both of these initiatives will give “we the people” more power over fracking, the growing of GMOs and corporate polluters. see LETTERS Page 10

commentary Boulder County Democrats in conflict

A

recent Pew survey states that 50 percent of conservative voters and 35 percent of progressives say that it’s important to live where most people share their political views.

In Colorado, this political self-segregation is seen in the stark differences between Boulder and Colorado Springs.

This translates into nasty fights, particularly in a swing state such as ours.

There is another division. Among progressives, people hyperventilate about whether to vote for the Democrat or some third party candidate. People on both sides should know that political power doesn’t come from the voting booth, but from grassroots social movements that can hold politicians accountable. In the long run, the Keystone XL fight and the growing labor rebellions might be more important than this year’s election.

However, the people who are in office can matter a lot. This is crucial since progressive social movements aren’t strong enough to move the state or the country to the left at the moment. Remember the 2010 elections when batshit crazy Republicans with anti-environment and anti-worker agendas won big victories in the U.S.

Congress and captured the state legislatures and governorships of many states.

The Democrats are predicted to do badly in the November elections both in Colorado and around the country.

Obama is currently unpopular for various reasons which dampens enthusiasm for the party. Many who vote for Democrats only pay attention to presidential races and ignore mid-term elections. As a result, the Republicans might win control of the Colorado state legislature and the U.S. Senate. There are differing polls on Gov. Hickenlooper’s chances for re-election.

Hickenlooper’s love of fracking has enraged many fellow Democrats.

For some reason, people dislike a polluting industry next to their homes and schools. At the Executive Committee meeting of the Boulder County Democratic Party (BCDP) meeting in Longmont on July 9, Cliff Smedley — longtime party activist — introduced a motion to withhold candidate assistance to Hickenlooper for not “reflecting Democratic Party values” (a BCDP rule) due to his profracking stance and several other issues (such as how a firefighters’ collective bargaining bill was “watered see COMMENTARY Page 10

He was supported by several party veterans as well as Kenny Wilson, a 16-year-old Sierra Club member and Niwot High School student, who spoke about the urgency of stopping the looming climate doomsday. The motion was rejected by a vote of 25 to 10.

The meeting was nevertheless upbeat. A resolution to praise Boulder County Clerk Hillary Hall for issuing same-sex marriage licenses passed unanimously. Boulder County state legislators talked about many progressive bills that were passed because the Democrats controlled both houses of the legislature and the governorship.

The BCDP is important to the state party. Boulder County voters frequently provide the winning edge for Democrats in state races. Both the House Majority Leader, Dickie Lee Hullinghorst, and the Senate Majority Leader, Rollie Heath, are from Boulder County. The BCDP issue platform is left-leaning and comprehensive. Rebecca Browning, the head of the Platform Committee, has encouraged rank and file members to help write the platform by using online issues surveys, House District and precinct “Walk the Plank” issues discus-

sions and surveys, a Friday night at the movies (with progressive documentaries) and other special events.

Nevertheless, Smedley is concerned about a growing number of disillusioned BCDP activists. One of them is Harry Hempy, who has become the Green Party candidate for governor. He says many Democrats have quietly told him they will vote for him. Check out www.hempy4governor.org for his thoughtful policy proposals. Hempy was a lifelong Democrat who became a full-time activist when he retired from a 40-year career at IBM in 2008. He was involved with the BCDP’s Grassroots Action Team which played a leading role in passing a Boulder ballot measure in 2011 calling for a constitutional amendment stating that corporations are not people and money is not speech.

Greens and progressive Democrats need to work together. We need a prodemocracy movement to defeat the plutocrats who dominate both major parties. But our rigid two-party system keeps third parties off to the margins.

Any significant social change will require a strong insurgency inside the Democratic Party.

Community rights initiatives to give local control over fracking

You really have to wonder why a national organization is sticking their noses in Jared Polis’ business in a Boulder publication. A full-page ad appeared in the June 30, 2014 Daily Camera that insults Polis by insinuating he is a whining cry baby, and then it shows a photo of a tiny fracking “Christmas Tree” (a natural gas piping apparatus), but, it does not show photos of the giant fortresses and fracking towers with their 24/7 lights, and noxious vapors that are more typical of a heavy industrial fracking operation.

Where are the photos of the tanks used for the produced water? The VOC burners? (aka Volatile Organic Compounds — “poisonous”). Where are the photos of hundreds of large

semi trucks toting water and fracking chemicals and the destruction of the roadbeds? Is it true Erie’s air has more propane and ethane than Houston or Pasadena? (Yes.) The real issue is the degradation of the quality of our lives including: poisoning of the air we breath; the waste and “destruction” of water necessary for all life; the devastating impacts to our health, especially to the young and the elderly; and turning our beautiful Colorado into a sacrifice zone. Did you know that Wunderkind, Congressman Cory Gardner voted to allow the natural gas floodgates to open to Asia and beyond?

(By the way, he is running for Udall’s seat.) Get ready, Coloradans, to be fracked to hell.

But you do have a choice! COLORADO COMMUNITY RIGHTS AMENDMENT PULLED After assessing the odds of obtaining their target of 125,000 signatures on the petition for Ballot Initiative 75 by the Aug. 4 deadline, the Colorado Community Rights Network has called off its efforts to get the initiative known as the Colorado Community rights Amendment on this November’s ballot.

The amendment, if it had passed, would have given Colorado communities the right to local self-government that would have extended to enacting laws to protect the fundamental rights of individuals, communities and nature, regardless of the rights and powers of corporations or business entities and without being pre-empted by federal, state or international law.

After the initiative was filed in January, it boomeranged in and out of legislative review before a court challenge and appeal by the Colorado Chamber of Commerce, among others.Such legal ploys prevented organizers from collecting signatures for the amendment until after the May 23 ruling by the Colorado Supreme Court that the initiative was a singleissue amendment, as required in the state of Colorado. Only at that point could proponents begin gathering the required 86,105 valid signatures. The Colorado Community Rights Network was using an all-volunteer team to try to collect 125,000 signatures — a target that would allow some leeway for signatures that might be invalidated during the verification process — during the nine-week period between the May ruling and the August deadline. Generally, initiatives have six months to collect signatures.

Efforts to collect signatures also lagged, according to Cliff Willmeng of the Colorado Community Rights Network, after the Protect our Colorado Coalition formed and drew in many of the anti-fracking groups statewide and tried to start its own initiative.

“There was a whole lot of distraction in that that also factored into the component of getting enough volunteers,” Willmeng says.

The Denver Post editorial board called the measure “easily the most extreme of possible ballot measures that targeted the oil and gas industry” in its efforts to circumvent international, federal and state laws in the name of preserving the “fundamental rights” of nature.

“Money talks, and it’s telling us that the industry is very afraid,” the CCRN board said in their announcement that they’d be putting an end to their effort to collect signatures, after citing a figure that the oil and gas industry has spent $9.2 million to oppose local control initiatives and support their own.

The Colorado Community Rights

Network is now focusing on assisting local communities in passing local control initiatives, Willmeng says, and will plan to resubmit the Colorado Community Rights Amendment for an upcoming election when they would expect to be able to avoid holdups in the court system and have a full six months to collect signatures.

Editor’s Note: When regular Boulder Weekly freelancer Haley Gray — who speaks fluent Arabic — told us she was going to be spending a few months in the West Bank and Gaza Strip, we made arrangements for her to write a few stories on subjects that we felt our readers would enjoy. We had no idea that tensions between Israelis and Palestinians in the region would escalate to the extraordinary levels we are now seeing.

As a result of what is unfolding on the ground, we changed directions and asked Gray to report on the conflict as it is unfolds. We believe that with her being positioned in the Palestinian Territories and speaking the native tongue, we have the opportunity to provide a unique perspective on this important news story. The following is Gray’s report on all that has happened since three Israeli teenagers were kidnapped and murdered.

Drumbeat of war grows louder

An examination of the escalating violence in Gaza from inside the Palestinian territories

n Sunday, July 6, Israeli attacks on the Gaza Strip killed nine people and injured at least 20 more. It was the single bloodiest day for Gaza since Operation Pillar of Defense, an eight-day campaign carried out by Israeli forces in 2012 in which 180 Palestinians and four Israelis were killed.

News of the attack spread through the Strip the following day, as did the expectant whispers of another war on the horizon.

“They’re waiting for the war,” said Gaza local Muhammed Rajab that day.

“And on another side, they do their normal life, they go out, they drink coffee, it’s Ramadan. ... But they’re sure there is a war coming for Gaza.”

Eleven days have passed since Israel began its offensive on the Gaza Strip.

Dubbed “Operation Protective Edge,” the stated purpose of the campaign is to dismantle the military capability of Hamas, the political party and Islamist movement governing the besieged Strip and which has been firing rockets into Israeli communities. As of press time Wednesday, July 16, 214 Palestinians have been killed — approximately 80 percent of whom were civilians, according to a United Nations report — and Boulder Weekly

1,489 have been injured, many severely.

Ten Israelis have been injured and one Israeli was killed when a rocket hit the Erez Gaza border crossing.

The current offensive has been nervously anticipated for the last three weeks. Tensions in Israel and the occupied Palestinian territories have been festering under mounting Israeli actions in the West Bank and the Gaza Strip.

Gaza has endured nightly air strikes since three settler teens, Naftali Fraenkel, Gilad Shaer and Eyal Yifrah, went missing in mid-June, while the occupied West Bank saw a brutal crackdown associated with Israel’s two-week manhunt for the missing teens and campaign against Hamas, whom Israel blamed for the kidnapping.

Unlike the last two bloody conflicts, Pillar of Defense in 2012 and Operation Cast Lead in 2009, the West Bank and Palestinian citizens in Israel were on edge even before the bloodletting began and observers believe that they may be prepared to show solidarity with Gazans under siege this time around.

Growing Frustrations When the three teens went missing June 12, Israeli officials placed blame

swiftly and squarely on Hamas. No evidence has been presented to the public connecting Hamas to the kidnapping at this time, although Israeli officials have vehemently insisted they have definitive proof. Hamas denies responsibility for the three teens, dismissing the accusations of its involvement as “stupid.”

Israeli forces carried out a massive ground campaign in the occupied West Bank, calling their efforts “Operation Brother’s Keeper.” The Israeli military raided more than a thousand homes, demolished 17 homes, arrested 628 individuals and fatally shot five Palestinians, two of whom were children, in the ensuing clashes. The express purpose of the operation was to punish Hamas, in addition to finding the teens, who were abducted while hitch-hiking near a settlement in the West Bank.

Six more Palestinians were killed by Israeli air strikes on Gaza in the week after the teens went missing.

“We’re turning Hamas membership into a one-way ticket to hell,” Israeli Economic Minister Naftali Bennett told Israeli Army Radio in the first week of the crackdown.

The teens had gone missing near a settlement outside of the Palestinian

city Hebron, in the south of the occupied West Bank. Brother’s Keeper began with the shutting down of entry and exit to Hebron and heavy raids of the city. Raiding spread to Nablus, Ramallah and other cities in the West Bank, and even as far north as Jenin, 65 miles away.

“What happened, and it’s still ongoing in Halil [Hebron] specifically, I can highly define it as a collective punishment on the whole city there,” said Amany Khalifa of Grass Roots Jerusalem. “People were not able to leave Hebron, people could not come in, clashes took place. ... We know Hamas by now. If they’re going to do anything, they would declare a statement and announce it clearly and they would not hide. So all of this accusing Hamas and punishing all of the people and arrests and closing different organizations that they claim belong to Hamas, it does not make sense.”

The boy’s bodies were eventually found in Haloul, a village just south of Hebron on June 30. All three had apparently been murdered shortly after they were abducted.

After arresting 628 people in the weeks prior, Israeli officials finally identified two suspected kidnappers, Marwan Kawasmeh and Amar Abu-Eisha, and demolished their homes. The two still have not been apprehended.

“Hamas will pay,” vowed Prime Minister Benjamin Netanyahu in his statement concerning the murder of the boys.

That night, racial tensions in Jerusalem skyrocketed. Israeli extremists marched through the streets chanting “death to Arabs.” An oncoming wave of Jewish extremist violence gathered momentum.

Two days later, 16 year-old Palistinian Muhammad Abu Khdeir was abducted in the Shu’fat neighborhood of East Jerusalem. He was burned alive by adolescent Israeli extremists.

An autopsy carried out by Israeli officials and confirmed by Palestinian personnel found gasoline had been poured down his throat. His charred body was found in a nearby forest.

Casualties continue to grow as the bombing campaign, mostly carried out late at night, progresses. An estimated 80 per cent of casualties in Gaza are civilians, according to a United Nations report. Mosques, hospitals and parks have reportedly been targeted.

Israeli officials claim the reason for this is Hamas’ use of these facilities for weapons storage or other operational purposes.

At press time on Wednesday, a proposed Egyptian-brokered ceasefire had been agreed to by Israel and rejected by Hamas, who claimed they were not consulted in the process. Hamas has continued to fire rockets into Israel, which has returned fire with numerous air strikes on the Gaza Strip.

The Israeli military reportedly contacted residents in East Gaza City via telephone Monday night, instructing them to leave.

“It was like a voice recording [telling people to leave], ‘for your safety, for your home, for your family, don’t support Hamas,’” said Rajab.

That night Israeli forces struck 12 homes of Hamas members in East Gaza city and targeted the previously evacuated Beit Lahiya. No injuries or fatalities have been reported from these attacks.

While it remains unclear how much longer the military offensive will continue, the end will not likely be anytime soon.

“We will continue with [Operation Protective Edge] as long as we feel like we are carrying out the mission and acheiving the goals that we have set,” Weiss told Boulder Weekly. Weiss noted that a ground invasion of the impoverished coastal strip is still “on the table,” though the decision is ultimately up to the Israeli cabinet.

Hamas has shown no intention to stop their nearly futile rocket fire at Israel.

Growing unity Unlike in 2009 and 2012, when the bloodshed in Gaza failed to inspire significant protests in the West Bank and Israel, Palestinians are acting out in solidarity this time around. There are protests around the West Bank and the Triangle every night.

“People were killed in 2012 and 2008 in Gaza but we really did not have a powerful resistance movement reacting in different ways. Now people are going out to the streets, people are demanding an end to this whole thing, an end to the occupation,” said Khalifa.

After weeks of clashing with Israeli forces in protest of the crackdown on the West Bank and surging anti-Arab racism in Israel, emotions are running high.

“I can link it to the rage we saw in Jerusalem streets, I can link it to the rage we saw in occupied areas in 48 [the Triangle] and the West Bank,” said Khalifa.

The fire is being further stoked by the speedy access to news of the carnage in Gaza. Social media-based news agencies like Shehab News and Al-Quds Network are providing up-tothe-second news on the latest strikes, casualties and fatalities.

“In 2012 we had to really dig hard in order to know how many people fell in Gaza. Now the moment a raid strikes we know how many people died,” said youth activist Mohammad Abu Toameh.

Abu Toameh says he believes the shocking gruesomeness of the news, in particular, is galvanizing the protests.

Images and videos of strikes, gutted buildings and bloody bodies are updated an average of every two minutes.

Enormous protests broke out throughout Hebron and surrounding villages and Bethlehem Sunday night.

The protests, and ensuing clashes with Israeli soldiers, are continuing nightly throughout the West Bank.

News of the failure to reach a ceasefire has had virutally no effect on the solidarity demonstartions, according to local activist Issa Amro of Youth Against Settlements.

“The ceasefire was not discussed by the Palestinian people because it’s not official, it was just a media initiative,” Boulder Weekly

said Amro.

Widespread solidarity demonstrations have been called for Friday afternoon, after the mid-day call to prayer, according to Amro.

“We are not watching Israel killing us, we have a resistance movement reacting to all of the Israeli violations and oppression over Palestinian residents in all occupied Palestine,” said

Khalifa.

Update: As Boulder Weekly went to press on July 17, news of yet another tragedy in the Gaza Strip was breaking.

According to Gray and other media sources, it appears that an Israeli Naval ship shelled a beach near the port area of Gaza City. Four Palestinian boys from a single family who were playing football at the time were killed. At least three other chil-

dren were injured, with one of those being in critical condition.

Following the beach shelling which was witnessed by several foreign journalists who attempted to save some of the injured children by administering CPR, Israeli Foreign Minister Avigdor Lieberman renewed his call for a ground offensive against Gaza.

Immediately following last September’s devastating flood, Craig Ferguson vowed to have his Planet Bluegrass festival grounds rebuilt better than ever in time for RockyGrass.

Truth be told, a lot of folks thought that was impossible.

hen talking about Planet Bluegrass, it’s hard to separate the company from its founder and festival director Craig Ferguson. It’s as if each is the heart of the other, their fates twisted together in pretty much everything … including floods.

It’s what happens when your life, your family, your job and your home are all located smack in the middle of a festival venue that’s half surrounded by a river. Such is Ferguson’s circumstance at the Planet Bluegrass Ranch in Lyons.

On September 12, 2013, the historic 500-year flood that hit the town of Lyons along with most of the rest of Boulder County also devastated the Planet Bluegrass Ranch, which plays host each year to RockyGrass, the Rocky Mountain Folks Festival and any number of other events.

On the day of the flood, Ferguson and his family watched helplessly from the red- and yellow-

streaked sandstone cliffs that rise above the ranch and the St. Vrain. They looked on as the swollen river swept through the festival grounds, leaving every structure on the property at least partially submerged. At the height of the flood, the river extended from the cliffs on the north side of the property to the wall at the base of Highway 36 on the south.

Water covered everything known as Planet Bluegrass, including Ferguson’s home, which had four feet of water flowing through the ground floor.

“I was just in shock,” says Ferguson. “I thought, ‘Oh my God, how do we fix this?’ Not do we fix it, but how.”

Within days of being hit by the flood, despite all the carnage he had witnessed, Ferguson announced to the world that his Planet Bluegrass Ranch would be ready for festivalgoers by the time RockyGrass See PLANET Page 20

arrived a short 10 months later on July 25, 2014.

Was it a promise born of confidence or merely a gesture of hope and faith?

At the time, it seemed more likely a product of shock, something akin to denial. But the inspiration for Ferguson’s bold proclamation doesn’t really matter now. Whatever sparked that promise, it was clear from the very beginning that Ferguson and the rest of the Planet Bluegrass staff believed it was possible and they committed themselves to making it a reality at all costs … of which there would be plenty.

When the water finally receded, it became clear that restoring the festival grounds in such a short time frame would be a tall order. There was no time to waste.

With so much of the property buried under tens of thousands of tons of sand, gravel, mud and debris, the first order of business was to buy a backhoe and a dump truck and to start rearranging the flood’s handiwork one shovelfull at a time. It was the first bite of the elephant.

The purchase of the truck and backhoe turned out to be only the first in a long line of expenditures that would eventually top out somewhere north of $1.2 million to date. And that price tag to restore Planet Bluegrass Ranch seems even bigger when you consider that only about $100,000 came in by way of insurance reimbursements.

Despite the herculean nature of the task, the resurrecting of the festival grounds in time for the summer music events proved the easier part of the

ordeal for Ferguson, at least emotionally.

“Inside my house I had two feet of mud,” he says.

“I just took an X-Acto knife and cut away all the drywall and insulation below four feet. That’s not the most expensive part. Everything that touches the ground, every piece of furniture, some guitars, kitchen cabinets, the whole inside of my house four feet and down had to be redone.

“But my biggest loss has been three or four crates of kids’ artwork that I had under the stairs, that was the hardest thing. That was the hardest moment by far going through those pictures. They were all stuck together. I spent two days trying to unpeel them. That was the worst emotional part.” Ten months later, the pain can still be heard in his voice.

But Ferguson is an optimist, albeit a tired one these days, and he quickly shifts to a more upbeat recollection.

“I remember thinking that as long as we didn’t lose the stage, we’d be able to keep it all going. And it’s still there.”

It was touch and go for a while after the flood. Ferguson’s beloved main stage was being threatened by a new branch of the St. Vrain, one that ran in front of the stage instead of behind it where the water had always been, and it was beginning to erode the ground at the stage’s edge. A reroute of the water saved the day and when a structural engineer declared the stage solid as a rock, all eyes returned to the July 25 deadline.

Pavilion next to Ferguson’s home was virtually a complete loss. A wooden add-on that had been attached to one of the rock buildings was washed far downstream. And as if to illustrate just how powerful the flood had been, a fullsized refrigerator from the property wound up near The Stone Cup coffee shop in downtown Lyons, photos and notes still sticking to its door. Every structure was a reclamation project in waiting.

“Everything was wet. Everything was flooded, but it could have been much worse,” says Ferguson.

Since the day the backhoe arrived, the Planet Bluegrass rebuilding project has been going nonstop. Some days only a handful of workers are on site while at other times as many as 50 or more heavy equipment operators, electricians, sod installers, IT experts, landscapers, concrete workers, tree trimmers, truck drivers and, of course, actual Planet Bluegrass staffers could be found hammering away on one problem after another.

Staff members were able to get back to work in the main office on the grounds last November, albeit without a bathroom or any heat. While difficult working conditions to be sure, the timing allowed them to string a line and carry out December 6th’s scheduled ticket sales for that other little event that Planet Bluegrass puts on off site: the Telluride Bluegrass Festival.

December’s cash flow was a godsend.

It is an understatement to say that the response by festivalgoers was heartening to a crew, including Ferguson, Boulder Weekly

which had been through so much.

Telluride’s 10,000 tickets sold out in just 16 minutes. It was a great reminder of just how important the relationship is between Planet Bluegrass and its loyal base of festavarians.

Work crews were also able to help Ferguson meet another of his shorterterm goals just three months after the flood. This one concerned Christmas.

“It was my daughter’s last year at home, so my big priority was to try to be home for Christmas in at least some sense,” says Ferguson. “It went pretty well; family stayed the night, Santa still came, the governor showed up and wished me well.

“The [Wildflower] pavilion has housed a Christmas Eve service for years now. So we went and rented a tent and put it out there and most of those people who had been coming for years came and John Hickenlooper came out and joined us.”

But that was then. With the promised deadline for reopening looming only a week away as this article goes to press, there is still a blur of construction activity at the Ranch. The new stage lights need hanging and more importantly the stage still needs power. The IT folks are still trying to get the grounds into the Internet age. Dirt is still being pushed around backstage. A fence or two are missing. Tons of specially ordered (it’s really soft) mulch is still sitting in small mountains waiting to be spread backstage and over a bit of the main campground where the grass seed has been slow to take.

property during the cleanup, some of that material was used to reshape the seating area. It now has a gentle downward slope from the silo to the stage. It’s an improvement that should benefit both line of sight and sound for the audience.

Another change is that the beach has been moved from its location on the north side of the property near the stage, back to the rear of the Wildflower Pavillion. The old beach is now a twotiered retaining wall set up that still offers easy access to the water. The new beach is sand and has been positioned closer to the family area.

Speaking of the Wildflower Pavillion, its 2.0 version has the original roof but its sides are new and have been bolted onto a bombproof concrete foundation that now composes the bottom three feet of the walls. Ferguson says if there is another 500-year flood, the safest place in the county will be on top of the pavilion. “It’s not going anywhere,” he assures.

Those familiar with the venue will also notice the grounds have a more open feel. This is due to a couple of missing trees and also the lack of vegetation along the riverbank.

Aside from that, it’s pretty much just as it has always been. The grass is even lusher than in past years thanks to seven acres of sod purchased after Yonder Mountain String Band donated $60,000 from a Planet Bluegrass benefit concert to pay for it. Which brings up another point.

involved, including the musicians who have rallied around Ferguson and his company in their time of need.

“There’s a sense of responsibility to make the festivals special this year to help get past this disaster,” says Ferguson.

“Hornsby, Bela Fleck, Noam Pikelny and a lot of others wanted to make sure they were going to be here. It’s a homecoming for a lot of bluegrass artists.”

Ferguson says that he looks forward to some point in the future when he can slow down and reflect on all the amazing acts of kindness, encouragement and support that he and Planet Bluegrass have received since the flood. But for now he says, “I’m just worn out.”

For today anyway, there is nothing he can do but make another trip to the electrical supplier, grab a hammer and finish making his promise to rebuild Planet Bluegrass Ranch better than ever a reality.

Well, that’s not all he can do, he does occasionally trade his hammer for his festival director’s hat so he, too, can make this summer’s events at the Ranch special. Best example? He added superstar Alison Krauss to the RockyGrass lineup after the festival was already sold out. Who does that kind of thing?

Barry traded her work as a personal trainer for leather-laced hands and countless bells to signal a succession of exhausting rounds, all in a vigorous effort to beat the odds and become the first American to compete in the first ever Olympic women’s matches.

When women’s boxing made its debut at the 2012 Summer Games in London, a heartbroken Barry watched her training partner Queen Underwood become the first American woman to box at the Olympics, completing an aspiration she had diligently hunted. Weeks before in trials, she had stepped back and torn her ACL, a moment that caused Barry’s trajectory to unravel.

maybe people out there thought they were tears of joy, but it was heartbreaking because I had hoped it was me,” says Barry glancing around the walls of Boulder’s newest training facility, The Corner Boxing Club, owned by Carrie Barry and Kirsten Barry, her wife and an aspiring competitive boxer.

“I look around at the posters here and think, ‘That should be me.’ Then I come back to the thought, I wouldn’t have those posters up in my gym if that was me. I wouldn’t be here, doing what I’m doing,” Barry says. “London would have been one Olympics and then five years later, it fades out. This way, I’ll get to touch more lives

and have more of an impact.”

The fade out Barry refers to is coined “athletes’ death.” It encapsulates the sudden shock and confusion after bringing an end to years of physical routine that have become an identity. When injury occurs or physical prime passes, many elite athletes find themselves at a loss for meaning with no clear transitions in mind after a life aimed solely at competition. Barry didn’t fall victim to this mental slump. She immediately redefined her purpose to supporting Underwood and, soon afterwards, toward pursuing another ambition she had tucked away all this time.

“Carrie has talked about opening a gym since

the day that I met her,” says Pauline Macias, a USA Judo National Team Member, who first encountered Barry at the Olympic Training Center in Colorado Springs in 2006. “At that time, she had already carried this vision for a long time. To see the support she has now is fantastic — I don’t think I’ve been to a gym where, when it first opens, so many people are coming in.”

Fossil Free CU attempts to get CU to divest from fossil fuels after student body and student leadership support.

t the most recent University of Colorado open Board of Regents meeting, Katie Raitz took the opportunity during open comments to talk fossil fuels, fossil fuel companies and why the University of Colorado should divest from them.

“After demonstrated student support, will you divest CU’s endowment from fossil fuels?” Ritz asked the Regents.

While several regents did ask followup questions, there was no definitive answer given as it was asked during an open comment session.

The University of Colorado Foundation, as of their June 30, 2013 report, has more than $26 million invested in gas and oil companies, down more than a million dollars in value from the year before.

Raitz says the focus of the current campaign by Fossil Free CU is to show how the divestment would benefit the campus by bringing in talented leadership and students in the environmental and social entrepreneurial fields. It could also improve the university’s public image, says Raitz, something that CU has been working hard at in the past several years.

“We really want to be looking at it as a positive,” says Raitz, who has been

working with the school’s treasurer about the logistics of moving investments out of the fossil fuel industry.

Speaking with the Board of Regents came after a two-year attempt by Fossil Free CU to get the measure supported on the Boulder campus by CU’s leadership.

In the spring of 2013, Fossil Free CU got more than 1,000 student signatures to get a referendum question on that spring’s student government elections. The question asked students: “Do you support a decision by CU and the CU Foundation to remove all university endowment investments from the fossil fuel industry?” 65 percent of voting students said yes.

The success of the ballot question led to a resolution being passed in April 2013 by the CU Student Government urging the University of Colorado and University of Colorado Foundation to reinvest their fossil fuel holdings.

One week later the student body and student leadership indirectly got a response from the administration. CU President Bruce Benson was asked at a town hall meeting if he would support divesting from fossil fuels.

“I’m not going to do that,” replied Benson, who notably got his career started in the gas and oil industry and is

the founder and owner of Benson Mineral Group.

“When the leadership said ‘no,’ we had to further our tactics,” says Raitz.

The goal of talking to the Board of Regents during the open comment session is to put the issue on the regents’ radar, says Fossil Free CU member P.D. Gantert. The group intends to bring it back up to the regents until it becomes an agenda issue.

“The next step is to make it a public hot topic thing,” says Gantert.

Simón Mostafa, a member of Fossil Free CU, says the group has found latent and passive support of divestment within the student population, but it’s not an issue that is in the front of students’ minds. Many students the group talked with were surprised that CU was invested in fossil fuels due to its environmentally friendly values.

Mostafa says the administration is not yet feeling the pressure for divestment, so the pressure needs to be increased to the point it cannot be ignored. In the upcoming semester, the group plans to work to increase visibility and recruitment of students, faculty and alumni.

The group also plans to work with fossil fuel divestment groups from the other CU campuses to bring more peo-

ple to the table with the regents.

Raitz says that CU should divest from fossil fuels as the chancellors of the three CU campuses are signatories on the 2007 American College & University Presidents’ Climate Commitment, calling for institutions to reduce greenhouse gas emissions and strive toward becoming climate neutral.

The CU administration has become hypocritical in their actions, signing the Climate Commitment but ignore their investments, Mostafa says. He argues that the university is no longer reflecting the values that they themselves promote.

The Fossil Free CU movement is not just about the divestment from fossil fuels, says Raitz, it is also about environmental impacts, social justice and having the administration represent their students.

“It’s reminding the administration that they do have accountability to the students,” says Gantert. That component was what originally sparked his interest in the issue.

Though there has been no definitive response to the student body and leadership’s disapproval of CU’s investments in fossil fuels, as for the Board of Regents, Gantert says, “At least they were paying attention.”

‘The Great Flood’ makes a case for one of rock and roll’s most unsung events

Despite the scope of its impacts, the great flood has been overshadowed in American conciousness by more recent hurricanes.

T

he great Mississippi River flood of 1927 began when more than 100 levees broke early in the year. It resulted in more than 27,000 square miles of land being flooded, lasted for almost eight months, and is the most destructive flood in the history of the United States. More than $400 million in damages occurred, and at least 600,000 people were displaced. The subsequent exodus spread black culture and music away from the flood-ravaged South and into the country at large, a movement which reshaped America’s geographic, economic and cultural landscapes.

And yet, the flood is relatively undiscussed in the history books, and its impacts never reached the level of the public awareness of natural disasters like Hurricane Katrina or Sandy, or the San Francisco earthquakes of 1906 or 1989.

But New York-based filmmaker Bill Morrison and Seattle jazz guitarist Bill Frisell are trying to change that with Morrison’s latest film, The Great Flood, which will screen at the Boulder Theater this Saturday with a live score from Frisell and his band.

The wordless documentary is something to behold. It unfolds as a series of vignettes that look at everything from the people who were impacted by the flood to the crushing footage of the flood itself and its aftermath, and makes for compelling viewing. The old Boulder Weekly

adage that a picture is worth a thousand words is incredibly apt here, as the images play across the screen with profound power and gravitas. Morrison was actually working on another film when he first came into contact with some of the footage that would eventually make it into Flood.

“I was involved in a project around 2005 called Shelter, and I was looking for aerials of flooded landscapes,” Morrison says. “There was some incredible footage. I came across a number of aerials of flooded

landscapes from 1926 and 1927, and most of them were from the Mississippi River Valley.”

After this, the seeds of an idea began to form.

When Shelter premiered in late 2005, audiences were struck by the flood footage, especially in the wake of Katrina, and Morrison felt how transcendent a flood’s power is. And then he was introduced, roughly a year later, to a John Barry book called Rising Tide, which talks about the dramatic impact the flood had on American culture. At this point, Morrison decided to bring this event into the consciousness of 21st century America, in part because he was one of the few who could actually do so.

“The lion’s share of the footage comes from the Fox Movietone newsreel outtakes at the University of South Carolina, and I knew I could probably recreate as much newsreel footage to create a record of the flood as anyone else,” he says. “As far as I knew, no one had used those outtakes from 1927 that were in the Fox Movietone collection, so I knew where the bodies were buried, if you will.”

But it was not enough for Morrison to unearth these reels and string them together into a cohesive narrative. He wanted to make sure the music that would accompany the story would be fitting. And that is where Frisell comes in. see DELTA BLUES Page 32

Ironically, it took a natural disaster for AfricanAmerican music to come alive outside of the Southern United States, and Frisell is one of today’s most vivid examples of how that initial diaspora has continued throughout the country. But when it came time to make music for the film, Frisell didn’t want to recreate what the music of the time would have sounded like because it did not feel right to him.

“The flood caused all these people to migrate north to the cities, and — this is way oversimplifying it — the music changed from some guy sitting on his porch or in a field playing an acoustic guitar, to getting up to the city and being confronted by all the noise, the density, the electricity,” says Frisell. “It’s a reflection of how the music changed, how it turned into rock and roll. But I didn’t want to try to mimic that because there’s no way I could ever come close to the power of what Robert Johnson was playing, or Muddy Waters, or the people who were affected by all this.”

But this is not to say that people today cannot be moved by this event, even if they were not alive to experience it. When you watch the film and see the footage of despondent people trapped on rooftops or rowing boats down streets whose buildings are almost completely underwater, you feel for them. And despite how light and airy segments like the cheeky “Politicians” and the especially clever “The 1927 Sears Roebuck Catalog” look and sound, they paint a subversive portrait of the disconnect between the elite and poorer classes, which only augments the sense of loss that these people felt. This is a tragic event which has shaped countless millions of lives over the decades, and its weight is not lost on Morrison.

“Hurricane Sandy introduced 12 feet of water into my own home,” he says.

“My life was upended, and to a certain degree our neighborhood is still putting things back together. So I guess I chose a topic that eventually became a reality in my life.”

choices that could earn you a sucker punch in a bar, calling him a namedropper and a weed-stealer and a string of other words the FCC would require bleeping out.

“I read that book and I was here when he wrote it, and I thought it was funny. But I know he did it for money,” Pledge says of I Never Met a Story I Didn’t Like.

He calls Snider’s notorious 20-minute song intros a “grift” but says he was there when those stories caught the attention of a “book person, you know like a person who makes books like a record company makes records,” who then asked Snider if he could write them down.

“He couldn’t, but his neighbor, Peter Cooper, who was the music writer for The Tennessean and they were both two drunks and they sat around and fucking never shut up anyway,” Pledge recounts. “So that guy Snider sat and talked about himself for about four days, which wasn’t very much different than just living with him.”

In the dedication, Snider thanks Cooper for listening to him and typing up all 90,000 words he said, which only took him an hour or so. Metaphors of that nature thread through his storytelling — the kind of metaphors with a truth at their core that makes them more crystalline than the facts would be.

almost impossible not to hear his voice ambling through the sentences of I Never Met a Story I Didn’t Like. And like most of his tall tales, it’s almost impossible not to find yourself sucked in to a good story that has a way of unexpectedly blowing through half an hour before you know it. It’s just so damn easy to want to spend more time with a guy who’s mastered the art of self-deprecating humor, to know exactly what he means when he talks about being in his “sunglasses at night” phase or says that Garth Brooks ruined country music for a while by being so good and so successful at it.

Snider’s been a quiet powerhouse in American folk music for a couple decades. The name-dropping is quite impressive — he mentions Garth Brooks’ jealousy-inducing success by way of introducing a story about Brooks recording one of his songs, but also talks about the time he made Jimmy Buffet throw fruit at him, and yes, the time he saw Jerry Jeff Walker’s balls.

They’re true stories, he insists — well, mostly true.

After recently being kicked out by his wife, Pledge tells me he’s found a penthouse by a lake to live in and isn’t telling anyone where it is. (That may not be true.)

“I had to get out of, because everybody knew where that fuckface lived so and then I was there all the time, and people say I look like him, so I’d be going out to get the mail and somebody’d be yelling ‘Beer Run!’ I’d be like ‘He’s inside, readin’ about himself,’” Pledge says.

Snider “died of botherations and complications, to save time,” according to Pledge, who adds that he won’t be missed. Not by anyone who lived with him, especially, says Pledge — and that has that funny ring of truth to it if you add Snider’s rebounding trips to rehab to the balance and, with it, the bitter reality of that, sometimes, for an artist, the toughest person to live with is yourself.

“What was that thing he sang about beer?” Pledge ponders. “Jesus Christ, if I never hear that again. He loved that song though, I’ll tell you, sang it when he’d wake up.”

But, ask nicely, and he’ll still sing it.

“I sing any song someone likes,” Pledge says. “I’ve never walked away from anything in my life, except for everything that I’ve ever done, so then it’s almost like never leaving.”

But maybe all of this is the nice way of saying he’s got a newer story he’d like to be telling, rather than revisit what’s out there in print already.

Asked about his summer tour, off he goes into talking about a recent Hard Working Americans show at the High Sierra Music Festival.

“The other night, I’m telling you, when we got done, as soon as the last downbeat of the last song ended, I opened my eyes and noticed two separate people that were crying and I thought, ‘I’m not the only one. I knew this was special,’” he says. “I would rather sing with the Hard Working Americans than anything, really.”

Turns out, he gets to for a while.

The bulk of Snider’s summer tour dates are with the Hard Working Americans, a band Snider says in an open letter that he formed of friends because he “wanted to be in a band that wanted to be great, whatever that meant.” The group draws together Snider on vocals, Dave Schools of Widespread Panic, Neal Casal of the Chris Robinson Brotherhood, and Chad Staehly and Duane Trucks of Great American Taxi.

Pledge (Snider) downplays his own participation, particularly in this recent transcendent performance, in which the jam took off and, he says, he stepped to the side.

“I don’t do anything but memorize words,” Pledge says. “Sometimes I just sit and watch, because we jam for a while. … I don’t know enough about the jam thing to know what it really is that’s happening, but that day was the first day that I felt like, ‘Wow, the crowd is doing this.’ I don’t know how to describe it, but it’s like this audience is doing this somehow.”

Schools and Casal, he says, “really understand what it means to flip that switch. I’m like a guy they just throw in a car and I’m like ‘What the fuck is happening?!’ But by the end of the summer, I’m hoping that I’ll understand what’s happening so I can do it more readily instead of having to wait for it. Well, I feel like there’s a thing I can do that helps, which is sort of to disappear or get out of the way. I think I stayed out of the gig on the other night well.”

The band’s self-titled debut album was released in January to critical acclaim and a top spot on the Americana radio chart.

“I would say that our group for real will really play our hearts out, you know. That’s all we do. I don’t even know if we’re good,” Pledge says. “But I say that and tomorrow night, maybe we won’t do that, so I don’t know if I can really predict what’s going to happen with our group, but I hope people come to see whatever happens.”

Nine Inch Nails

Monday and Tuesday, July 21-22: Nine Inch Nails Live at Red Rocks Amphitheater. 7 p.m. 18300 W. Alameda Parkway, Morrison.

After a hiatus from 2009-2013, industrial rock pioneers Nine Inch Nails came back in the fall of last year with its eighth album release, Hesitation Marks. Reznor described the visually-lush art and lighting design of The Tension Tour that followed as an art project where he wanted the audience “holding their pee” so as to not miss anything. It worked. The tour sold out arenas and wowed critics nationwide. The show at Red Rocks is the third date on the follow-up to Tension, and it’s sure to be a worthy successor.

Also on the bill are grunge-heroes Soundgarden, and Oneohtrix Point Never, who replaced the originally-scheduled opener, Death Grips, who posted a note on Facebook saying they had broken up on July 2.

‘Go West’ with the timeless appeal of Buster Keaton

T

he 1925 Buster Keaton classic Go West opens, “Some people travel through life making friends wherever they go, while others — just travel through life.”

When Keaton traveled, he sauntered, adorned by his flattened pork-pie hat and too-short tie. Dubbed “The Great Stone Face,” Keaton played his expressions close to the chest and let his magnificently rubber body carry the work. His aloof nature sometimes works for him, sometimes against him, but Keaton, for better or for worse, never changes. He keeps chugging along, and eventually things work out.

Then he takes another header into the dirt. Sometimes he goes down hard, sometimes he falls in sections.

Sometimes he falls like rubber, other times, stiff as a board. No matter how, always that same stone face.

Go West, screening Wednesday, July 23 as part of The Chautauqua Silent Film Series, is a magnificent display of

Keaton and his acrobatic qualities.

Seeking money and work, Keaton’s character, Friendless, sells off all his earthly possessions and heads west to a ranch in Arizona. Unfortunately, Friendless makes for a pretty lousy cowboy. He doesn’t know how to milk a cow, can’t secure a saddle to a horse and uses a lady’s garter gun as his weapon of choice. His only friend is “Brown Eyes,” a cow that loyally follows him around after he removes a rock from her hoof.

The cowboys are tasked with moving the cattle from the ranch to the stockyards of Los Angeles. While in

‘Closing Doors’ shows there’s more than one way to look at life

W

e don’t take enough time to stop and look around. That’s clear.

We’re missing a lot of the good stuff — the artistic patterning in our architecture, the glint of airplanes in sunlight, the blur of a seagull’s wings against a gray sky, the flicker and shine of our own street lights. And while the situation is admittedly dire for a 13-year-old boy with Asperger’s Syndrome lost on the subway, he’s catching the good stuff.

He’s watching the shoes of passers-by and openly staring at the break dancers taking over the central aisle of his train instead of deliberately turning away in hopes of sparing a dollar or two.

That’s just one among the many points of social commentary — among them, jabs at public education, socioeconomic splits, the American immigration system — laced into the quietly unfolding Stand Clear of the Closing Doors. The film tells the story of Ricky, a teenage boy on the autism spectrum who can’t remember to lift the toilet seat or eat without someone there to remind him, who gets lost in the bowels of New York City’s train system after his sister fails to pick him up after school. His mother, Mariana, hesitates to go to the police for help with her missing son out of concern that they’ll ask her or her husband for immigration papers they don’t have. Instead, she searches for him, mostly by herself, in his favorite places — Rockaway Beach near their apartment in Queens and the shoe store where he gets enthralled in the study of the fabric and stitching and shape of various shoes for sale.

Exploring the world through the Boulder Weekly

eyes of someone on the autism spectrum lets the film’s director, Sam Fleischner, delve into those overlooked moments of artistry in our daily lives.

He works with natural lighting, which colors the film in the gritty, gray palette of New York City at the tail end of autumn, and then, when it intrudes three-quarters of the way through shooting, Hurricane Sandy becomes a part of the film as well. The storm adds a layer of dread that the film would otherwise have missed. Even if Ricky doesn’t fall victim to some form of violence in his prolonged travels through New York’s boroughs and manages to remember to drink enough water and eat enough in the days he’s missing to keep himself alive, there’s worry over what might befall him if he’s not home by the time the storm hits and floods both streets and subway tunnels.

Ricky, played by Jesus SanchezVelez, an untrained actor with Asperger’s, sets the artistic tone for the story. It’s a rare glimpse into worlds so many of us miss — those of a person on the autistic spectrum, of the mother of an autistic child, and of an undocumented immigrant desperate to do the best for her son.

Ricky spends most of the film blankly observing the tangle of city life as seen from one of its main modes of transport, leaving his mother, Mariana, played beautifully by Andrea Suarez Paz, to put a face on the emotions that run through the film. Paz’s portrayal would be compelling among any ensemble, but against the backdrop of a sulky teenage daughter and a mostly absent husband, she’s wholly consuming.

JUL-IPA FESTIVAL BENEFITS SAFEHOUSE WITH BREWERS AND BBQ

Summer in all its glory will be taking place at the Millennium Harvest House gardens this Saturday, July 19 from 1-5 p.m. when music, barbecue smoke in the air, and tipsy patrons converge at the second annual JulIPA Festival.

Put on by the West End Tavern, 35 national breweries (mostly from Colorado) will pitch tents to serve their “best and baddest” India Pale Ales. The West End Tavern will be serving smoked chicken, pork, brisket, ribs, beans and more. There will be live music, a Wing King Challenge — featured on Man v. Food where participants try to eat 50 wings in 30 minutes — and a $5 raffle to win tickets for the Great American Beer Festival, a Phish concert and a condo stay in Utah among others.

Tickets are $35 (includes a commemorative glass and samples from all breweries) and 100 percent of the proceeds go to Safehouse Progressive Alliance for Nonviolence, a human rights organization committed to ending interpersonal violence.

Afternoon tea at The Huckleberry is a nice way to simmer down

ust one thing I want to know: how come I have to be Mr. Pink?” my co-worker Caitlin Rockett asked on our way to The Huckleberry in old town Louisville.

But we weren’t headed there to pull a Reservoir Dogs; we were going to have a tea party.

Any good Boulder County bruncher should know The Huckleberry. Its small-town charm and bevy The Huckleberry of baked goods 700 Main St., are just what the Louisville heart-doctor 303-666-8020 ordered you to avoid. But for all the quaintness of its converted house location and café menu, there’s a touch of old world aristocracy mixed in. The Huckleberry offers a specially made afternoon tea course served all fancy-like, provided you give them 24-hours notice and pony up the princely sum of $18.95 per person. Discovering it on the menu is how my co-workers and I ended up skipping out of the office to have a delightful afternoon away from the bleeps and bloops of the office and the “20 Pictures of Cats Eating Donuts That Will Immediately Bring on World

Peace” headlines of the Internet. Originally we had planned Kentucky Derby hats and white suits for a photo op, but the forces of laundry conspired against us.

Things weren’t quite ready when we arrived, but after several minutes we were led to a semi-private walled off area in the middle of the restaurant, where we were quickly given a dipping tray of marmalade, lemon curd and Devonshire Cream.

“That stuff is amazing,” the server said, pointing at the Devonshire Cream.

For the afternoon tea, The Huckleberry prepares a three-tiered platter of delights, including cucumber sandwiches, puff pastries, chocolate-covered strawberries, mini-scones and more.

Also, obviously, tea.

The Huckleberry has several dozen teas to choose from, most being topshelf blends, and each coming in their own pot with a removable basket so the tea doesn’t oversteep and become bitter.

We were also given raw sugar cubes and honey.

The sandwiches that comprised the bottom level of the tea-tower, were good, light snacks, but nothing special.

The pastries and sweets were another matter altogether.

A savory puff had a wonderfully flaky texture, and the scones were every

bit as fantastic dipped in the Devonshire Cream as our server had alleged.

But the cake was taken by a flourless torte — dense chocolate balls of it. Rich and sweet, and oddly well balanced with the subtleties of the various teas.

But as tasty as the spread was, the real bonus actually had very little to do with the food. It would have been easy enough to scarf down the chow and scribble something about “subtle blackberry notes.” But taking an afternoon casually, and enjoying the excess of the presentation was, as corny as it may sound, the rare opportunity to slow the fudge down, parlay with your team and drink some mufuggin’ tea.

That alone is worth the high sticker price. And maybe even being called Mr. Pink.

Dear Dan: I have two questions.

1. Recently, I went to a bar with my brother and encountered a friend from high school. My brother told me that, toward the end of the night, my friend followed him into the bathroom and made a drunken pass at him (which apparently involved a clumsy grab at his penis). My brother has no reason to lie about the incident. My inclination is to ignore the issue. If my friend is closeted or bi-curious, I feel like it isn’t my place to force the issue and I should respect his privacy. Advice?

2. My bisexual girlfriend wants to take me to a gay bar. I’m not worried about being hit on, but I feel like hanging out at a gay club would be somewhat dishonest and touristy. Is my apprehension warranted?

Considering his rocky track record with other human females — married and divorced three times — it’s understandable that he might be less self-conscious about showing affection for his dependable old dog than for his brand-new girlfriend. Washington takes a different path to cannabis

T

he state of Washington started selling recreational cannabis last week, producing many of the same headlines that dominated the first few weeks of January sales here in Colorado. There are certainly similarities in the way the two states have approached legalization, but each has staked out its own direction, and it will be interesting to see how each fares as times goes by.

Both states allow adults over 21 years of age to purchase and possess an ounce of cannabis for personal use subject to regulation, licensing and taxation. Washington doesn’t allow residential cultivation, while Colorado allows adults to grow up to six unlicensed plants, although medical patients can grow their own in both states. Washington, unlike Colorado, doesn’t allow adults to “gift” or transfer up to an ounce of cannabis to any other adult as long as no money changes hands.

Both have adopted the same DUI law standard, that anyone with a blood limit of five nanograms of THC shall be considered impaired. Although the Colorado version allows a defense that the person wasn’t impaired at that level.

Both states had medical cannabis laws in place before the 2012 elections that legalized it, and each built upon its own medical framework. Tax structures are similar. Washington levies a 25 percent excise tax on producers when they sell to retailers and another 25 percent on retail consumers, plus sales and local taxes. Colorado imposed a 15 percent excise tax and 10 percent sales tax on top of the state’s sales tax, and allows cities and counties to impose their own taxes over that. (Boulder voters, for instance, approved a 5 percent excise tax and 3.5 percent sales tax on top of state taxes.)

Retail sales in Colorado are supervised by the Marijuana Enforcement Division of the Department of Revenue. Washington’s market is overseen by the Washington State Liquor Control Board.

Colorado began with a vertical integration market approach based around its medical marijuana rules, with the entire supply chain — production, processing and retail — operated by the same entity. That ended on June 30, the same day the state began accepting applications from new businesses beyond the original medical licenseholders who were allowed to apply beginning last year. Those applications will begin being processed within 90 days, and competition should become even more intense as those businesses open.

Perhaps the biggest difference is that Washington is trying to control the amount of cannabis that can be grown and produced each year, the rationale being that it will help keep extra product from being moved to other states or sold on the black market.

Colorado basically began its retail market by offering retail licenses to existing medical businesses, while, in essence, Washington started over. Currently, Washington’s production is capped at 80 tons of product, 40 tons for usable marijuana and 40 tons for other products like tinctures, edibles and oil. The state also limits the amount of space that can be used to grow recreational cannabis.

We should see soon if that number holds for Washington’s 6.9 million residents. A new study, “Market Size and Demand for Marijuana in Colorado,” conducted by the Marijuana Policy Group for the Marijuana Enforcement Division, suggests that those numbers might fall short of Washington users.

The study is a collaborative effort between the

University of Colorado Boulder Business Research Division and BBC Research & Consulting in Denver. It relied on surveys, state demographics and estimated marijuana usage patterns in order to determine the estimated market size in Colorado, so the researchers admit up front that the true size of Colorado’s market may be smaller or larger than their estimates. But they mark the potential range for total adult marijuana demand, including visitors, at between 104.2 and 157.9 metric tons this year. That’s a pretty wide gap, but even at the low end is much higher than the Washington numbers.

The Marijuana Policy Group Report includes some other fascinating stats. It estimates there are about 485,000 regular adult users in Colorado, which represents 13 percent of the 2014 adult population in Colorado. Another 201,000 adults (3.8 percent of the state population) reported using marijuana within the past year. And though this report only considers adults, it notes that another 184,000 residents under 21 reported past-year use, of which 59,000 reported past-month use.

The product estimates are 31 percent higher than a recent Department of Revenue assessment, 89 percent higher than a study by the Colorado Futures Center and 111 percent higher than an older study by the Colorado Center for Law and Policy. “The main difference is caused by much heavier dosage amounts consumed by the state’s ‘heavy user’ population — those who consume marijuana on a daily basis,” the report says. Those daily users drive almost 70 percent of total marijuana demand, and the prevalence of daily users in Colorado is higher than the national average.

The tourist market is strong, accounting for about 20 percent of the total sales. However, most of those tourist sales are taking place in two areas. Outof-state visitors currently represent about 44 percent of Denver metro-area retail sales and, not surprisingly, about 90 percent of retail sales in mountain communities reporting, which includes Summit, San Miguel, Clear Creek and Gilpin counties. Maybe those numbers will begin to attract the tourist industry’s attention.
