Observing the restaurant, grocery and “farmers’ market” offerings, as well as advertisements, I have a sense that many believe (or by their actions show) that purchasing and consuming animalderived products (the flesh of a slaughtered cow, pig, chicken, etc.; the milk of

Like a hurricane, a new pontiff — and a new ethic — hit the Catholic hierarchy.

Pope Francis lives a spartan life and goes openly and gladly among the masses, while stressing simplicity and personal humility as the proper demeanor for the clergy. The Church’s moral emphasis, Francis says by word and deed, must be on service to the poor and disadvantaged, and the existence of economic inequality must be a top priority, addressed as a social evil.

It appears to me that the focus on “local, sustainable and organic” is held in higher esteem than avoiding the products and enterprises that engage in the exploitation, suffering, and death of living, feeling individuals — the nonhuman animals “raised”

mazing! Some people who’ve long enjoyed a lifestyle of oldmoney elegance, are suddenly trying to downscale their lives and show a bit more of the common touch.

They’re not corporate chieftains, but they do run multimillion-dollar operations and consider themselves role models for the masses. They are the Catholic Bishops of the United States — and it’s that role model thing that has them a bit flum-

Bishops scrambling to cut extravagances, allocating more resources to the down and out, focusing on economic justice, becoming more available to ordinary parishioners, and... well, appearing more like Francis.

Actually, though, they’re not aligning their lifestyles and work with the Pope — but with the life and teaching of Jesus, the founder of their Church.

Wow, that’s a most impressive conversion! So here’s an idea: If Francis can have this affect on the elites of the Church, what say we turn him loose on the hubris of Wall Street and the extravagances of the corporate elites?

I find it totally disconcerting that an article by Joel Dyer in the June 5th edition of the Boulder Weekly talks about a quake in Greeley on June 7 [Re: “Greeley quake may be related to nearby disposal wells,” News, June 5], Unless Mr. Dyer has a time travel machine, how did he write about a future event?

Even if it was an error, it discredits his article.

A note on word choice for ‘carbon tax’

Thank you for Steven Kreimendal’s fine article dealing with the different reactions the public tends to have when hearing the term “climate change” versus the term “global warming.” But it is not too surprising that simple word choices can trigger positive or negative reactions.

For example, the phrase “carbon tax” is typically met with anger about government overreach, or fear about rising energy prices. However, imagine if instead it were called a “carbon stimulus package.” The public, businesses, and the unemployed would probably listen to a carbon stimulus proposal, and support it. Whereas if we call it a carbon tax, they would reject it without listening to the details.

How can a carbon tax be a stimulus package? Because a study released this week by REMI (Regional Economic Models Inc) indicates that a national carbon tax that is paid by fossil fuel companies and fully rebated to the public via pro rata checks to households would stimulate the economy. It would create more than 2 million jobs within 10 years. To top it off, it would improve our health and stabilize the climate.

Readers should please urge Senators Mark Udall and Michael Bennet and Rep. Jared Polis to review REMI’s study and support a carbon stimulus package.

— but the study’s figure does not seem implausible. A single well that produces 500,000 barrels of crude oil would yield roughly $50 million in revenue, assuming a price of $100 a barrel. Horizontal wells with multi-stage fracking that have estimated ultimate recoveries of 500,000 barrels or more are not uncommon in the Wattenberg Field, nor is it unusual to find half a dozen wells to a section.

But while the amount of compensation Boulder County could be on the hook for in the event it imposes a permanent ban on oil and gas production might be debatable, it is a near certainty that it would be on the hook for at least some compensation.

Mineral rights are a long-recognized property right, and in Colorado they can be bought, sold, and owned separately from surface property rights.

Both the United States Constitution and the Colorado Constitution provide that private property can’t be taken without compensation.

If Boulder County or some of the cities in the county choose to ban oil and gas production, it is hard to see how they could avoid having to pay compensation to the people who own the mineral rights and have a legal right to produce those minerals — any more than the county could avoid paying compensation to the owners of surface property rights who might be banned from building on their land.

Boulder County and the major cities of Boulder County have spent hundreds of millions of dollars to buy and preserve open space — precisely because they cannot prevent all development on land unless a) they pay compensation to the owner for doing som or b) they own it. It is a near certainty that it will be the same with mineral rights. And given the current value of oil and gas, it is reasonable to assume that compensation for a county-wide ban on oil and gas production would cost the taxpayers at least as much as half a century of open space purchases have — and quite possibly more.

More than 95 percent of the oil and natural gas wells drilled in the United States are fracked. Without fracking, domestic oil and gas production would collapse within a few years. Voters who choose to vote to ban fracking are really voting to stop oil and gas production.

There are a lot of Boulder County residents who may be cool with that, but they should realize going in that if they succeed in doing so, it is going to cost government and the taxpayers a bundle.

A costly inconvenient truth ere’s an inconvenient little truth that keeps getting lost in the shuffle when local activists start hyper-ventillating about fracking: If you want to ban fracking, you may end up paying through the nose.

According to a story in the Denver Business Journal, a ban on fracking could cost Boulder County a bundle — a bundle of as much as $1 billion.

The $1 billion figure is not what the county would lose by foregoing taxes, royalties and the boost the local economy would get from oil and gas production. It is what Boulder County taxpayers would owe the holders of oil and gas mineral rights and oil and gas lease-holders in compensation for being denied access to their property.

The $1 billion figure is contained in a study done for the National Association of Royalty Owners by Netherland, Sewell and Associates, an international petroleum engineering firm, according to the Journal.

“The study looked at the money royalty owners might be missing out on due to a moratorium on drilling new oil and gas wells in Boulder County’s portion of the Wattenberg Field, one of the one of the richest oil and gas fields in the United States,” the paper said.

Boulder County currently has an 18-month moratorium in place on accepting new applications for oil and gas development, which will expire on January 1, 2015. If the moratorium turns into a permanent ban, the county mineral rights owners could sue on grounds that it constituted a “taking” of their property and demand compensation.

The study estimated that the moratorium is preventing the development of dozens of “sections” (one-square mile parcels of land) within Boulder County’s part of the Wattenberg Field.

It claims that a royalty owner with a one-eighth interest in a single section could receive as much as $40 million in royalty payments over the productive life of a new well. Royalty owners with a one-fifth interest could receive as much as $64 million in royalty payments over the life of a new well.

“Figuring that there are at least 50 sections in the county that could be drilled and produced, the county could be on the hook for $1 billion in compensation for owners who want to develop their oil and gas minerals, but can’t,” the Journal said, citing the study.

Learning from Iraq

Iraq is now reaping the horrible results of our rush to war there, instead of turning to diplomacy. More bombing there will only cause more misery. A political settlement is the only road to Iraqi stability.

It’s also time to absorb the lessons from Iraq. Before the 2003 invasion, U.N. inspectors had unprecedented access there. Now, thanks to diplomatic efforts, U.N. inspectors monitor Iran’s nuclear sites daily.

As our diplomats work to conclude a nuclear deal with Iran by July 20, I hope that Representative Jared Polis and Senators Mark Udall and Michael Bennet will speak out to support diplomacy as the way to prevent war and a nuclear-armed Iran.

Congress: Act now

Congress must act now for our veterans. The recent Veterans Affairs scandal has excited veterans organizations all across the country, demanding resolve of the atrocities noted in that scandal for poor leadership and mismanagement of VA medical centers nationwide.

Investigative reports continue to show there is more then meets the eye.

Deaths of veterans waiting for medical attention for months on end. Illnesses that that have worsened due to lack of attention. Our Congress and Senate and President Obama are on the bandwagon wanting answers.

Why did they not take action many years ago when they received complaints from veterans? It was known well over a decade ago about mistreatment.

Those complaints fell upon unhearing ears, now we have needless deaths that could have been prevented and illnesses that could have been better treated. America has some of the finest medical resources in the world, but to put those resources to work for our veterans cost dollars. Is it cheaper to bury a veteran then to provide proper medical care for those who fought for our freedom?

There is an active House Bill HR-543, The Blue Water Navy Vietnam Agent Orange Act. There are 210 co-sponsors, we need 218 co-sponsors to get this bill out of committee to the House floor. This bill will become a milestone toward providing equitable VA benefits for thousands of veterans, saving lives and provide better quality of life. I urge all Americans contact their mem-

bers of Congress, those who have not done so to become co-sponsors of this important legislation, it will also lead to other legislation for veterans.

Gross Reservoir expansion should be stopped

“Dawn on the delta was whistled in

The above words were written by Aldo Leopold in 1922 about the Colorado Delta. If he returned today; he would have to carry his canoe over a barren salt flat. The Delta is dead. The majority of the water in the Colorado River is diverted before it reaches the Delta. Water is siphoned for humans to have, for example: bluegrass lawns in the Front Range; or glittering fountains in Los Angeles. The proposed expansion of Gross Reservoir will divert even more water from the Colorado River. When does a river die? When does it become a diversion ditch? Does the Colorado River, under Colorado law, have the right to prevent the proposed expansion of Gross Reservoir? No, because it does not own a water right. It is ironic that a corporation can own a water right but not a river. If Boulder County has the authority to prevent this expansion, then let’s do so.

The Colorado River, in Leopold’s glowing description, might remind the reader of someone on a summer vacation.

He (the river) “could not decide which of the hundred green lagoons offered the most pleasant and least speedy path to the gulf.” Rivers, lakes, aquifers, springs, glaciers, oceans and seas should all have the right to a happy and healthy life. Our survival depends on it.

Losing the war on drugs

Heroin has made a comeback — oddly enough that has happened since we have been in Afghanistan. Why? Is our law enforcement that ineffective? Are our legislators paying more attention to reelections, pay raises and lobbyists? Is there no enforceable plan to stop the terrible destruction caused by the use of this drug? Where is the “War on Drugs”? Do more “people of power” need to lose loved ones to this?

Where does heroin come from?

How is it that the media never tells us that 90 percent or more of the heroin found on our streets and in the arms of our dead young people comes from Afghanistan! The very place where our soldiers are dying to keep Afghanis free! No wonder the tribal leaders of Afghanistan want us to stay there and die there while they continue to profit from the export of this deadly drug.

To believe the federal government doesn’t know about heroin coming from Afghanistan is ludicrous. They’ve had boots on the ground and eyes in the sky for over 10 years. This tells me that the American people — soldiers and civilians — are collateral damage — again — to a foreign policy gone astray.

A reckoning on gun control

There must be a reckoning regarding gun control in this Country. On December 14, 2012, Adam Lanza slaughtered 20 children between 5 and 10 years old and four teachers at Sandy Hook Elementary School in Newton, Connecticut; as well as, killing his mother and himself. He used two handguns (a Sig Sauer and a Glock), and a Bushmaster .223 assault rifle. Before the rampage, Lanza shot his mother four times in the head with a .22-caliber Savage MK II-F bolt action rifle.

All the weapons used in this atrocity were legally purchased by his Lanza’s mother. In the March 17, 2014, edition Boulder Weekly

of The New Yorker, there is an article “The Reckoning” about the tragedy and analyzing it and how Adam Lanza’s father Peter has coped with it. The article quotes a psychiatrist, Park Dietz, who in 1986 coined the term “pseudocommando.” A pseudocommando is defined as a person, almost always a male, who has a preoccupation with weapons and war regalia in order to compensate for a sense of impotence and failure. There must be a better way to work out a sense of impotence and failure than owning guns.

Recently, a 71 year old ex-cop Curtis Reeves shot and killed a man a Florida movie theatre in an altercation over thrown popcorn and texting; the ex-cop is claiming self-defense. Also, in the Sunshine State, Michael Dunn was convicted of attempted murder after he killed a teenager over loud music; Dunn clamed self-defense. Possessing a gun gives people a deadly option that they would not otherwise have during an argument or altercation. The gun owner always gets the last word, so to say. The NRA argues against any regulation

and/or gun control in order not to interrupt their profits in this deadly commerce. Isn’t it time for a reckoning in America about gun control? Isn’t it time that the majority of Americans stand up to the NRA and psuedocommandos and take away this deadly option? Editors note: It’s a shame that funerals have to be wasted on the dead. That’s to say that it’s a shame that we tend to wait until someone is lying in a coffin and well past the point of caring before we reflect on how much they meant to us, all the things they accomplished and the degree to which they will be missed.

With that in mind, we didn’t want to make that same mistake this time around so we decided to go ahead and write our obit for the Fraser River before it’s officially dead. It seemed a reasonable thing to do for something so profoundly beautiful, natural, important and severely threatened.

While we are well aware that the fight to stop the Denver Water Board’s Gross Reservoir dam/expansion project — and as as a result, the Fraser River diversion — is going strong, we felt that giving folks a taste of what will be lost should Denver Water prevail was in order.

That said, it’s not really accurate to say that the Fraser is dying. The truth is, it’s being killed. The river has been dying a slow death since 1936, the first year that the Denver Water Board started diverting the Fraser’s spring runoff east to the Front Range in order to meet the needs of an exploding Denver population. Since that time the Water Board has been continuously buying the rights to more and more of the Fraser’s water, as if such a thing can be bought and sold like a car or a cheeseburger.

Did the eagles or the fish or the elk or moose get a say? Were the residents of Fraser or Tabernash or Winter Park or Granby asked if they think it’s a good idea to send the river that sustains their communities through a tube of rock to the other side of the mountains? Did the citizens of Colorado get a vote? The answer is no on all accounts.

There is apparently only one law in this land and that’s Colorado water law, which says if you hold the right piece of paper in your hand, the river is yours to do with as you please, no matter how misguided, environmentally irresponsible or insignificant your intention.

With the U.S. Army Corp of Engineers, the Environmental Protection Agency and the state basically giving their blessing to the Denver Water Board’s badly flawed plan to divert most of the river’s remaining water into a significantly enlarged Gross Reservoir in Boulder County — it seems as inevitable as it is ludicrous that we are about to sound the death knell for a mountain river that should either belong to no one or everyone.

And all for no greater reason than to meet the growing lawn-care needs of our sprawling urban landscape .

Do not go gentle Fraser River. Do not go gentle.

Obituary for a river

I

t’s hard to say when the Fraser River was born. As far as anyone can remember it has always been there.

The first inhabitants on its banks were the Utes. When spring snowmelt flowed down the west side of the Continental Divide, the water spirits weren’t quiet here.

In the early 1800s, French fur trappers passed through the valley.

Eventually, the first settlers arrived, ranchers who used flood irrigation on their pastures. It was a cycle. The water soaked down into the fields until it reached the ground water and then slowly made its way back into the river. It was sustainable. But things change.

In 1928, the Moffat Tunnel was completed, and the first railroad passed through the Continental Divide. It shipped timber to the booming Front Range cities, where the Denver Water Board had been tasked with acquiring enough water for this exploding population.

“David Moffat was both a railroad man and a water man,” says Kirk Klancke, the conservationist and retired water manager who is widely credited with the “Save the Fraser River” movement. As soon as Moffat started building a smaller survey tunnel parallel to the railroad tunnel, Denver Water began buying water rights on the western side of the Divide. Klancke speculates that Denver Water already knew the survey tunnel would become a water tunnel.

“It was the only water tunnel built like this in Colorado history,” he says. And the cheapest: it was taxpayer-funded.

enlarged and lined. The following year, Denver Water delivered their first shipment of the Fraser River through the mountains. They didn’t actually buy the tunnel until 1976, Klancke says.

“Until then, Denver Water rented it for a song,” he says. “And they bought the ranches, bought the water, for a song.

These ranchers were so poor, just trying to eke out a living up here.”

The railroad had also brought some skiers to town. In 1937, the first rope tow was installed on Berthoud Pass and Colorado’s first T-Bar appeared at Winter Park a few years later.

When the Klancke family moved to Fraser in 1971, there were only a couple hundred residents. The river was the most beloved feature in town, and the old-timers loved to tell Kirk about how it was President Eisenhower’s favorite fishing spot, how it had earned the moniker “The White House of the West.”

Between fighting communism abroad and McCarthyism at home, Eisenhower allegedly remarked that he was most relaxed while fishing on the Fraser.

Meanwhile, Denver Water kept buying more of the river.

“The old-timers didn’t think much of it, just to make a buck and get out of ranching,” explains Donny Thompson, who has spent much of his life working on the Fraser as a ditch runner and data collector.

“It wasn’t until later that the ranchers realized, ‘We’ve sold off our water rights, what have we done?’” says local historian Tim Nicklas.

Today, over half the Fraser parts from its former path. Instead of joining the

Colorado River to flow to the Sea of Cortez, these waters travel the one-way tunnel to the Front Range. Today, 60 percent of the Fraser’s flow is diverted — on average.

“Sometimes, it’s 70 percent,” says Grand County Commissioner James Newberry. Sometimes, it’s less. Today, the river is roaring, thanks to the ample snowpack that accumulated on the peaks around Berthoud Pass this winter.

“This spring, it’s almost like it used to be,” says attorney Jill Klancke (Kirk Klancke’s sister). “Even growing up in the ’70s, Denver Water was already taking a lot, but the spring runoff was still so wild and beautiful.”

Jill was 15 when her family moved here. The river was so turbulent that the ice cubes in their refrigerator had dirt on the bottom, stirred up from the riverbed before a new water sanitation plant was built.

“Back then, the river was running so fast, it would flood the wetlands all around every spring,” she says.

The wetlands are a major concern now that the river is facing a final diversion plan.

“The wetlands are needed by about 90 percent of the wildlife in Colorado, and take up only about 2 percent of the land area,” says Paul Rollrah, a retiree who has lived in close proximity of the Fraser River for over 15 years. “If the river dries up, the wetlands dry up. This isn’t just about fishing. It’s about moose and elk and coyotes and everything else.”

The wildlife is part of why fly-fishing on the Fraser is special to river conservation advocate Erica Stock.

“When you’re fishing, and you turn around to find a moose at your back, you know there aren’t many places like this,” she says.

Seeing the river tumble uninhibited northward through Winter Park, Fraser, and then Tabernash, it’s hard to imagine this flow as fleeting, a brief high before the end.

“The river has been dying a slow death,” says Scott Linn, who has been fly-fishing the river for 25 years and serves on the local chapter of Trout Unlimited. “You don’t have a to be a scientist to look at the river and know it’s not right.”

Linn noticed the first symptoms about 10 years ago, when he started catching fewer fish. Paul Rollrah, who recently moved to Tabernash after many years in Winter Park, noticed the river’s declining health around the same time.

“We’ve had sad times, when flows got so low and you could see distressed fish,” he says. “Anytime the water got around 70 degrees, they’d be dead.”

And temperatures have changed dramatically.

“We’d take the kids on picnics when they were young, in the ’70s,” Kirk Klancke says. “They’d jump in the river, and they’d be running out screaming a few minutes later, with their lips all blue.”

These days, when he takes his grandkids to the same spot, they’ll swim for hours — the water is that warm. Which sounds great, unless you’re a trout.

Inside Mo Henry’s Trout Shop in Winter Park, owner Mitch Kirwan is standing on a ladder in Chacos, affixing a sculpted trout on a piece of driftwood to the wall. Temperature is crucial, he explains. When spring flows aren’t high enough to scour out the channel, the river gets wider and shallower. The cooler depths are lost, and the trout die.

“There are not nearly the numbers and quality of fish that there used to be,” he says.

After 25 years of fishing the Fraser, Kirwan has plenty of memories of the “good old days.” In 2004, he and his brother started their guiding business.

“But sometimes the flows are almost shut off. I’ve got guides out there, and there’s almost no water in the river — suddenly.”

Of the 37 or more streams that run down the west side of Berthoud Pass to the Fraser headwaters, Denver Water now has diversions on all of them, Kirwan explains. Without the rushing spring flows, the river never gets flushed out.

Sediment builds up. Kirwan has seen cutthroat trout (the trout species native to the Fraser) struggle the hardest with the rising temperatures and sediment levels.

It wasn’t all Denver Water’s fault, as Boulder Weekly

Grand County Commissioner Newberry points out. As more cars drove over Berthoud Pass, more sand had to be applied to the road. The sand made its way into the river.

“The poor Fraser was hit with a double whammy,” recalls Jill Klanke.

The combination of more sand and lower flows was wreaking havoc. In 2002, Kirk Klancke started a project to trap the sediment coming off Berthoud Pass. In 2013, he finally saw the new pond trap its first load: 680 tons of sand that was headed for the river. Still, today, the fish are struggling.

“You notice it when you handle them,” Kirwan says. “They’re like us.

When they’re not eating so well, they get softer, slower.”

The fish depend on aquatic insects for food, he explains. Division of Wildlife researcher Barry Nehring has found insect species that have disappeared below the confluence of the Fraser and the Colorado Rivers. It would be hard to blame this disappearance on anything but diversions like the Moffat Tunnel, he says.

For now, the Colorado River seems to be outliving the Fraser. But it’s unknown how the death of the Fraser will affect the Colorado.

Kirwan has been lobbying to make “catch and release” mandatory on the Fraser. But the river runs through private lands, and locals recall how abundantly it once fed their families. One day in the ’80s, while Tim Nicklas’s family was living on the Fraser, they lit up the grill.

“Hang on,” Nicklas’ young son said.

“I’ve got to catch a fish to cook.”

Less than five minutes later, he strolled back from the river with a freshcaught trout. Maybe the river was in his blood: Nicklas’s great-great grandfather was a Colorado water commissioner who carried a gun to enforce water law. Today, his son is studying water law.

“It makes me proud,” Nicklas says, “because he’s kept the values I’ve taught him.”

And sharing values, Kirwan says, is one of the best things about time on the river. Halley Cook, Jill Klankes’ daughter, learned to fish on the streams that bordered their land. She watched the water levels drop, but she also watched her Uncle Kirk’s crusade to save the river.

“When it was all starting, he made these blue bumper stickers,” Halley recalls. “You started seeing them on every car in town. And you’d go into the restaurant, and there was the sticker: SAVE THE FRASER RIVER.” Grand County Commissioner James Newberry has seen plenty of these stickers.

“To me, it’s like putting a sticker on your car that says ‘Save Tibet,’” he says.

“It makes people feel good, but how are you actually going to save Tibet?”

But Halley grew up watching her community band together for the river.

She remembers the Denver Water Board’s campaign to encourage water conservation.

“It has a whole new meaning when you see the damage they’re doing to your hometown’s water,” she says.

Denver Water is currently planning to divert another 20 percent of the river to the Front Range. If the permits are passed, they’ll expand Gross Reservoir in Boulder County to store the additional water. Trout Unlimited fought this proposal for years, led by President Kirk Klancke. They recently stopped fighting.

“They own the water,” Kirk Klancke says.

The community seems to have accepted the reality as well.

“Absolutely, they’re already taking too much out,” Kirwan sighs. “But, simple fact is, Denver owns that water.”

As we sit in the shop’s camping chairs, a young father and son walk in.

An employee fits the kid in waders. A hanging sign reads, Good Things Come to Those Who Wade. Kirwan especially loves guiding kids who’ve grown up playing video games. He remembers fishing with one when a bald eagle flew overhead.

“I saw it in his face,” he recalls. “It really affected him. You notice it in people who don’t get out here much. They’re suddenly absorbed in what they’re doing.

Daily life just fades away.”

Sometimes, you need a river for that.

Roger Hedlund has lived in Fraser for 32 years, and he attributes his best times to the river.

“One of those bluebird Colorado days, out fishing, I got to see the river at its best, back when it was really flowing,” he recalls. “That was probably one of the

best days of my life.”

Like everyone else interviewed for this story, Hedlund explains that the effect of the river goes beyond fishing.

You could just be watching it, or listening to it. Today, it cascades with certainty, like nothing could ever pull it from its path. But tomorrow will be different.

Without the river, the local economy will collapse, Kirwan says. But the river is dying without fanfare.

“Even when we take out Front Range folks, only about 10 percent of them seem to know about what Denver Water is doing,” Kirwan says. “The Front Range is thirsty, but not necessarily for drinking.”

He blames lawn maintenance for a large portion of the Fraser River’s diversion.

With or without lawns, Front Range cities keep sprawling. Some of us come here looking for a better kind of life, the kind fed by snows and wildness and rushing mountain streams, he says.

“The things that draw people to this state are the things that are being destroyed,” says Commissioner Newberry. “We’re sacrificing one part of Colorado for another.”

Newberry doesn’t think the next diversion can be stopped, so he is hopeful that the Gross Reservoir expansion will ensure Denver Water’s commitment to mitigation work on the Fraser. He’s not alone.

“With Denver’s money, we can probably afford it,” Klancke says, but it will still take community effort. Denver has pledged about $4 million to mitigation projects like the sand reclamation project that took 11 years to realize, he says.

Trout Unlimited has already estimated that a similar-sized project would require about $7.1 million.

There are several other mitigation projects under discussion, like mechanical shaping to deepen the channel so the river might live on, albeit in another form.

“Honestly, the river will never be the same,” says Trout Unlimited Treasurer Scott Linn.

It seems the swift current of Colorado’s urban sprawl rushed faster than the Fraser.

At the end of the tunnel, on the Front Range side, the growing population’s need, or perhaps more accurately put, desire, for water is unquenchable.

“If we had a time machine,” Commissioner Newberry says, “maybe we could go back to when there were no diversions coming out of the Fraser.”

But we have no time machines and rivers don’t flow in reverse. Rest in peace Fraser River. Only a miracle can save you now. We’ll see.

his house will stun. A 1,634-square-foot home with decorative entryway trusses, stucco and stone siding, solar panels affixed just so, a large patio for summer evenings.

Nestled under the cold shadow of Eldorado Mountain, set as a downy cub onto what was a meadow (mama nearby), the loony babbling of South Boulder Creek, rare butterflies humbly batting false eyes. No public road leads here. You’d almost think it was protected by the City of Boulder.

Well, it was. But after seven years of litigation, board hearings, applications and angry neighbors, a conservation easement has been lifted, property lines have been redrawn and building exemptions have been made for that house to be built in that meadow.

Here’s how it happened. In 2006, the City of Boulder bought 40 acres of conservation easement land from sisters Jenna and Traven Rice (third-generation owners) near the westerly edge of Eldorado Canyon State Park. A conservation easement is a tract of land that is dedicated by the landowner for conservation by the governing city or county. It is bought with taxpayer money. The landowners own the land and can sell it at will, but the conservation easement is perpetual and remains in effect even after the sale.

In 2008, Charles Myers and his wife Barbara bought an empty halfacre parcel of land from Denise Koenig right beside the Rice property

and the conservation easement. As it was, the parcel of land was “very small” and “it may not be able to meet setbacks” for building, county Planner Denise Grimm wrote to Koenig in 1996. It was also potentially in a floodplain and may not have legal access, Grimm wrote. The parcel was shaped like a fat boomerang, causing logistical building and access problems. It was also part of a Habitat Conservation Area as designated by the city of Boulder, which is meant to protect land and wildlife from human interference — and in this instance, meant to prohibit road access, according to the Open Space Board of Trustees.

With this knowledge available, the Myers bought the lot anyway. They then filed lawsuits directed at all their new neighbors, the City of Boulder, the City and County of Denver (which has a right of way water easement on the property), and others, claiming that the original boundary lines of the property were different and that there wasn’t adequate access to the property. Myers showed extensive lines of deed transfers and claimed that the lawsuits would also help sculpt vague property lines.

“I contend that such boundary clarification is not an enlargement of our lot but an agreement as to what the lot lines of all affected properties (not just ours) actually are,” Charles Myers later wrote to the County Commissioners in 2013.

Myers added that “a transcription error” in the previous chain of ownership created confusion about whose land was whose and referenced a 1991 letter

between two previous land owners — the Rice and the Koenig forbearers — saying they needed their “mutual boundaries cleared up” for title reasons.

(Myers did not respond to multiple emails or calls from Boulder Weekly for this article.)

At last, the lawsuits continued and focused sharply on the Rice sisters.

Eventually, they settled and sold a third of an acre to the Myers — that parcel essentially filled in the fat boomerang shape of the original Myers property to create a wonky trapezoid of land.

“He sued us because there was some access issues with the parcel,” Jenna Rice says. “It didn’t already come with access to it and we didn’t think it was the best area to develop, so we were hesitant to give access. It’s a floodplain and not an ideal location, so we settled in a mediated settlement.”

However, the Myers’ new land was still under the conservation easement owned by the City of Boulder. In order to build on their new trapezoid, the Myers would need to get that easement lifted.

In May 2011, the Boulder Open Space Board of Trustees decided to do just that. Property Agent John D’Amico presented the issue to the board saying, “everyone would go back to litigation and a judge would make the decisions” if they did not decide on the issue in a very timely manner (as mandated by the Rice-Myers settlement). City Attorney Deb Kalish said, “Other property owners in the area would be drawn into litigation and would acquire additional attorney’s fees” if the board did not approve the disposition (or relinquishment) of the conservation easement on Myers’ property.

The board was particularly sensitive to any further litigation costs the Rice sisters would incur.

news “We’d already been over two or three years in this kind of litigation and it was definitely costing us a lot of money, and we thought if we went to court he would gain access of some sort [regardless],” Rice says. “We were hoping the city was still going to keep the conservation easement on it. At the last minute they decided not to.”

Ultimately, the board lamented that there were time constraints on making the decision. Board President Pat Billig asked if the disposition would set a precedent. The board members agreed that it wouldn’t and the conservation easement disposition was unanimously approved.

Then last week, the Board of County Commissioners was presented with the site plan and a subdivision exemption for the Myers lot. The subdivision exemption request was brought forward by the Myers to enable them to build on the totality of their land — the original parcel and the addition that had had the conservation easement lifted.

D’Amico wrote to the county attorney in March 2013 that the city had tried numerous times to settle the case with Myers and offered access to the property while keeping the conservation easement in place. Myers denied these offers because, D’Amico says, “[Myers’] intent was to increase the building lot in order to build a larger house.”

D’Amico added, “The city feels the approximately 0.36 acres should be used to determine the appropriate development” and not the additional land the Myers bought.

The Board “reluctantly” approved the exemption. Commissioner Elise Jones spoke at length about how the commissioners could only approve what was in front of them — no matter how it got there — and that they had to act in accordance with the law. The subdivision exemption increased the buildable land from 0.39 acres to 0.88 acres.

(Myers did downsize some house aspects to meet county requirements.)

Lastly, county code dictates, “A boundary line adjustment shall not be approved solely for the convenience of construction.” But county planner Hannah Hippely judged that the boundary line adjustment was not solely for construction because the original lot was suitable for construction and that the “development proposed here has not changed significantly from the 2007 Site Plan Review application.” This is despite the fact that it wasn’t until 2009 that Myers bought the additional land from the Rice sisters on which the new Boulder Weekly

house will be built — the 2007 application was based on land the Myers did not yet own and thus was not approved.

Hippely also argued the new boundary will help set the house away from the river nearby and that it will help the property gain access to the road — neither of which, according to Hippely, are for the sole purpose of aiding construction.

Now with building poised to begin, neighbor Neil Blank — who was the target of Myers’ previous litigation — said the whole easement is compromised.

“In wildfire, it’s a mitigation across boundaries,” Blank, a lifelong member of the fire department, says. “It doesn’t matter if you’re Boulder County or Jefferson County, one landowner or another. You work geographically across

areas and ultimately, that’s how conservation easements work, too. Moving this little conservation easement has a domino effect.”

Rice resolves, “We’re still happy there’s a conservation easement on the rest of our property. I still think it’s important to support the conservation easements in Boulder.”

n 2008, Hurricane Ike ripped through Houston, Texas, destroying thousands of homes and businesses in Harris County, including the orthopedic implant sales company Campbell Hayden ran alongside his long-time partner Hugh Gouthro. Unable to pick up the pieces, Hayden and Gouthro moved to Denver to try to find a fresh start — Hayden had been born in Boulder, after all.

But things only got harder. They couldn’t seem to carve out a place for themselves in orthopedic implant sales in Denver, and soon they’d gone through all their savings. They lost their apartment and had to stay with friends. Then, around four years ago, Hayden got a letter through FedEx that changed his life forever.

“Right after we had lost our apartment in Denver, we started selling plasma for extra money,” says Hayden. “I had donated plasma three times [already] and one morning I got a knock on the door and it was a letter from the Colorado Department of Health and Human Services telling me I needed to contact them immediately. So I called and they were like, ‘You tested positive.’ And I was like, ‘Wait. They ran all these tests before I even started donating.’”

But the virus hadn’t shown up then, and now the antibodies were there in numbers large enough to count. At 36 years old, Hayden had been diagnosed with HIV. Hayden is one of approximately 600 HIV positive people living in Boulder County. In addition to those 600 people, the Colorado Department of Public Health and Environment estimates that there are about 126 people in the county who are unaware they are infected. Those 700-odd people account for 6 percent of the total number of people (11,750) living with HIV in the state of Colorado.

“A lot of people who were around in the early days [of the HIV/AIDS epidemic] will say, ‘HIV — is that still an issue?’ Yes indeed, it is still an issue,” says Ana Hopperstad, executive director of the Boulder County AIDS Project. “I think it’s not as visible anymore. You can’t go into a grocery store and see someone in the line next to you who has wasting syndrome. People with HIV aren’t as easy to identify in

the public venue anymore. I think even though that’s true, I think the people I know who are HIV positive are very careful about who they reveal their status to.

Taking all of this into account, the BCAP study showed that their services helped 75 percent of clients reach or maintain an undetectable viral load, compared to 59 percent of people receiving medical care for HIV, but not BCAP services. Nationally, only 28 percent of HIV positive people who are receiving care reach or maintain an undetectable viral load, according to the Centers for Disease Control.

Granted, Hopperstad says, BCAP has pretty high standards.

“Our definition of undetectable is less than the current standard used by state,” she admits, adding that the

state defines undetectable as 200 copies of HIV or less, while BCAP says 40 or less copies of the virus.

“What excites me about this study is I think organizations like BCAP can have a positive impact on communities, and community level intervention can have a positive impact on the HIV community,” says Hopperstad. “One of the greatest indicators of success in case management is the establishment of relationships. Ask clients questions in a space [where] they know they will get accurate medical support and resources and information that will help them, and people succeed.”

ple of BCAP’s ability to help HIV positive individuals succeed — but it took time and more heartache.

After Hayden found out he was HIV positive, he pushed his partner to get tested. When Gouthro got tested the result was irrefutable — he too had HIV, and his disease had progressed further than Hayden’s.

There they were, homeless and both newly diagnosed as HIV positive.

Hayden sums the situation up as best anyone could: “It was just devastating.”

The couple eventually made their way from Denver to Boulder, where they found BCAP to be a source of positivity and consistent assistance in their difficult situation. Over the course of a year, Hayden and Gouthro were in and out of the hospital as Gouthro’s health declined — he suffered three strokes, and while Hayden says that Gouthro had his mind, he simply wasn’t able to take care of himself, making Hayden’s ability to secure a job that much harder. Hayden freely admits he dealt with alcohol addiction. And then in December of last year, Gouthro passed away.

“We were together for 18 years and I think the only thing that saved him for as long as it did, and saved me, was that we had each other to balance off of,” says Hayden.

Hayden made the push to get sober, and it’s been three months since he had a drink.

“BCAP has been amazing.

Celeste [LaBlanc] was my partner’s case manager, and Christina Lopez is my case manager. They both have done whatever they could. I mean, after my partner had his second stroke they were able to get him a walker so he could get around easier.

A little over three months ago I got out of alcohol treatment and they’ve been there for me. Anything I’ve needed, they’ve been there.”

Hayden’s working now, helping other homeless men and women in Boulder change their situation through paid work with Bridge House’s Ready to Work program.

And BCAP is still there for him.

“Not only do they track my medical doctor appointments, now that I’m on Medicaid they helped set up vision care and dental care, and when there were added costs they were able to get funding for things that weren’t covered, like my eye exam was covered, but my glasses weren’t” says Hayden. “It takes worry off of myself. One month’s worth of prescriptions is around $5,000. If I Boulder Weekly

didn’t have help from BCAP, I couldn’t dream of paying for it.

“I’ve been through a lot in the last six months, losing [my partner] and getting sober,” says Hayden, but through state funding, he’s going to school to be a certified addiction counselor. “Hopefully in the next couple of years I’ll be able to jump in and help out.

“I’ve been given so many opportunities through BCAP, and now I’m getting

back on my feet,” Hayden says. “I’m actually starting to volunteer with BCAP. It’s my way of trying to repay what they’ve given me. Without them who knows where I’d be.”

Right to Know Colorado

arry Cooper describes he and his wife Tryna simply as “concerned citizens” — proud grandparents seven times over, owners of a meeting and event company. Their concern over the safety of American food became so great, however, that the couple placed themselves at the helm of a citizen-led movement in Colorado to require labeling products that contain genetically engineered ingredients.

“I didn’t even know what a GMO was two and a half years ago,” says Larry Cooper, co-chair for Right To Know Colorado, a campaign that’s been working to get a GMO labeling measure on this November’s statewide ballot since 2012. When a documentary keyed them into the pervasiveness of GMOs, Larry says he and Tryna were “completely shocked and couldn’t walk away.”

“I was like, ‘It’s not even possible our government wouldn’t already have things in place to protect us and have done long-term testing to validate whether this is safe or not.’ And no testing of that sort has been done.

And I’m serving that to my little grandkids? That’s crazy,” Cooper says.

The notion is so crazy to so many people that this year 20 states have introduced 35 new GMO food-labeling bills, according to the Center for Food Safety.

Colorado joins three other states — Oregon, Nevada and Washington — in gathering signatures for ballot

initiatives. While Connecticut and Maine were first to place GMO labeling laws on the books, those won’t take effect until other states pass similar legislation. Vermont, however, took the plunge on May 8 and became the first state to create a mandatory GMO labeling law with no stipulations, set to take effect in July 2016.

While the Coopers have experience in politics and community organization — Larry has served as a city councilman and county commissioner and Tryna’s served on numerous nonprofit boards — much of the recent activism against GMOs in the U.S. has come from those who could most aptly be called impassioned: mothers, grandmothers and health advocates without backgrounds in politics or campaigning.

Each state has its own story, but one belief unites them all: Americans have a right to know what’s in their food.

But the biotech industry — GMO producers like Monsanto, hiding behind trade groups such as the Grocery Manufactures Association — is already on the defensive, taking Vermont to court over its newly penned law, and seeking federal legislation that would preempt states from requiring labeling of GMOs. So can a patchwork collection of activist Davids defeat the money and influence of the food industry Goliath? Many feel that Vermont has thrown the stone.

The national scene

Estimates about the percentage of processed foods that contain GMOs vary, but most place the number between 75 percent and 90 percent, primarily from genetically engineered corn, soybean, alfalfa, canola, cotton and sugar beets.

Oregon was the first state to place a GMO labeling measure on their statewide ballot in 2002. The measure was ultimately defeated. Then, as now, opponents poured money into campaigns against the measure, $5.5 million to be exact, tying the record for the most money ever spent on an initiative campaign in Oregon.

Proponents spent around $200,000.

It was a decade before another state attempted to mandate labeling of GMOs, with California stepping up to the plate in 2012. The measure failed narrowly, as did Washington state’s measure the next year — both, once again, fought tens of millions of dollars had by the food industry.

But 2013 saw some victories for labeling proponents. Connecticut and Maine passed genetically engineered food labeling laws within days of one another, but the laws contain “trigger clause” provisions, which prevent their laws from going into effect See FIGHT FOR YOUR RIGHT Page 22

until certain conditions are met (namely that a number of surrounding states pass similar legislation). Ultimately, a trigger clause shields a state from the burden of legal fees when the food industry inevitably sues.

Now there’s trigger clause-free Vermont.

Despite the tiny state’s big victory, Vermont’s battle to secure its labeling law kicks into high gear as it prepares to challenge a lawsuit filed by four national food industry organizations.

Leading the plaintiffs is the Grocery Manufacturers Association, which counts among its 300-plus members Monsanto, Dow and Coca-Cola.

Vermont was prepared for the backlash, so the law itself creates a $1.5 million legal defense fund, to be paid for with settlements won by the state.

But so far, nothing’s stopping the mighty Goliath.

“Vermont’s mandatory GMO labeling law — Act 120 — is a costly and misguided measure that will set the nation on a path toward a 50-state patchwork of GMO labeling policies that do nothing to advance the health and safety of consumers,” the Grocery Manufacturers Association said in a press release. The statement goes on to say that the Vermont labeling law violates the First Amendment by creating “burdensome new speech requirements” that will affect “eight out of every 10 foods at the grocery store.” As it did to combat labeling measures of the past, the food industry has argued that labeling would lead to higher food prices for consumers.

“First of all, with the patchwork of policies concern, there isn’t a patchwork.

All we have is one law. Any idea that there would be a patchwork is speculative,” says Laura Murphy, associate director of the Environmental and Natural Resources Law Clinic at the Vermont Law School. Murphy and the clinic were instrumental in crafting the labeling law with their client, Vermont’s Public Interest Research Group.

are a couple of studies that have been done on how much it costs to change the label.

It’s really not that much,” if anything, says Murphy, who cites a 2013 study by independent consultant Kai Robertson for GMO-labeling campaign group Just Label It, which found “no evidence that changes to a food processor’s product labels affect the prices paid by shoppers.”

“This idea that mandatory labeling is somehow going to cause an increase in food prices just doesn’t hold water,” agrees Colin O’Neil, director of government affairs for the Center for Food Safety.

“We know companies change food labeling all the time to reflect regulatory changes, consumer preferences or just to rebrand.”

As for violations of First Amendment rights, the Supreme Court has two tests that determine whether corporate speech has been infringed, and legal analysis memos from both the Environmental and Natural Resources Law Clinic and food and drug law firm Emord & Associates agree that labeling laws should stand up to the tests.

“The way we look at the issue is when the government is requiring a company or person to disclose something, which is what the GMO label would be, then the government needs to have a legitimate interest,” explains Murphy. “So the labeling requirement needs to be reasonably related to a legitimate governmental interest. When we look at the issue, our analysis is that Vermont has several legiti-

mate interests in this bill and labeling would advance those interests.”

What federal oversight?

And while legal experts believe that Vermont’s law will hold up against Big Food’s lawsuit, that doesn’t mean the food industry will stop there.

“I think they’ve already started working on their other strategy, which is to get a law or policy at the federal level that meets their desires, which is voluntary labeling, allowing the word ‘natural’ to be used on any and everything,” says Andrea Stander, a registered lobbyist and director of Rural Vermont, a grassroots orgaRight to Know Colorado nization that supports family farms, local foods and environmentally conscious farming practices.

“Mike Pompeo introduced a bill that would essentially pull the rug out from under the states,” Stander says, referring to the Safe and Accurate Food Labeling Act introduced in the U.S. House by Rep. Mike Pompeo (R-Kan.) this April — a measure backed by the Grocery Manufacturers Association.

“They are also going at [state labeling laws] from their well-entrenched tentacles in the regulatory scheme in the [U.S. Department of Agriculture and Food and Drug Administration] to get them to come out with rule-making to give them what they want,” says Stander.

O’Neil of the Center for Food Safety agrees, saying that the Grocery

Manufacturers Association and other opponents of labeling have made it clear, through massive funding against state labeling efforts, that they want to “keep Americans in the dark.”

“We are now seeing their ultimate wish come to fruition in the introduction of the DARK Act, which is what we’ve called it: Deny Americans the Right to Know Act,” O’Neil says of Pompeo’s act, adding that since companies can already voluntarily label whether or not their products contain GMOs, the federal act will do nothing to change that behavior.

Precious little federal oversight is in place to influence the behavior of GMO producers. The FDA regulates genetically engineered food through a coordinated network of federal agencies including the Environmental Protection Agency and the USDA. The FDA’s policy on “Foods Derived from New Plant Varieties” hasn’t changed since it was introduced in May of 1992.

“Producers of new foods have an obligation under the act to ensure that the foods they offer consumers are safe and in compliance with applicable legal requirements,” reads the 22-year-old guideline. “Because in some cases the regulatory jurisdiction of a new food product, including those produced using innovative methods, may not be clear, producers can informally consult with FDA prior to marketing new foods to ensure that the safety and regulatory status of a new food is properly resolved.”

Ultimately, the FDA guideline granted genetically engineered foods “generally regarded as safe” status, and created no obligations for conducting long-term safety studies.

As a result, a quick search for studies on human health or environmental impacts from genetically engineered foods shows that most research comes from outside of the U.S., or American scientists publishing in foreign journals — equally unsurprising considering more than 64 countries restrict, label or outright ban GMOs.

boulderganic “Monsanto is U.S. based and they are very powerful,” says Stephanie Seneff, a research scientist at the Massachusetts Institute of Technology whose research over the past seven years has focused on the impact glycosphate — the herbicide in Monsanto’s Roundup product — has on a number of diseases. “[Monsanto] funds all these agricultural universities where the research would logically happen and I think the people at the universities have their hands tied.”

As for labeling, Seneff is behind the movement. While she admits that science hasn’t proven whether GMOs themselves are toxic, she firmly believes the insecticides and herbicides used to treat genetically engineered crops are noxious.

“The GMO stuff is so original that we don’t really understand it. I think it’s shocking that we put this out in our food system without understanding it,” she says.

Colorado demands its right to know

For Larry and Tryna Cooper, their time leading Colorado’s labeling initiative has been “a heck of a learning experience,” according to Larry.

“My wife and I are donating most of our time to the campaign. My wife’s putting in 100 to 120 hours a week. I’m putting in between 70 and 80 a week,” he pauses to laugh. “I’m feeling that way today.”

The hours they commit are necessary. To secure the labeling measure, known as Initiative 48, on this November’s ballot, Right To Know Colorado must petition 86,105 signatures — that’s 5 percent of the total number of votes cast for the Secretary of State in the last election.

Larry Cooper says the campaign has collected more than half the needed signatures, nearly 50 thousand at this point, but their goal is 150,000 by the August 4 deadline to ensure enough valid signatures to place the measure on the ballot.

Things are going well, but it hasn’t been smooth sailing. After ballot language was approved and a legislative council set a title for the measure, the Grocery Manufacturers Association appealed and asked for a second hearing, appealing to the Supreme Court after the second state hearing still didn’t result in the GMA’s desired outcome.

“They brought forth two pages of their own [ballot measure] language that I did not understand, and I don’t think other voters in the state of Colorado would understand,” Larry says. “The Supreme Court ruled completely in our favor. But in the meantime, it cost us a number of months. And it cost us tens of thousands in legal fees.”

“We’re not asking to ban GMOs, we’re simply asking that people have a right to know what’s in their food by a simple label,” says Cooper, “And then people could decide for themselves whether they want to purchase GMOs.” Cooper adds that Colorado’s GMO labeling law would work with current labeling laws, regulations and regulating bodies, allowing the Department of Health to more easily implement GMO labeling.

The measure won’t allow private citizens to sue grocery stores, restaurants or other food sellers for serving GMO food.

“In other words, we put this back to the producer and manufacturer, not to local restaurants or local grocers that may or may not know their products contain GMOs,” says Cooper. “It’s up to the manufacturer to disclose that information.”

There will be no trigger clause in Colorado’s legislation if it comes to pass in November, and Cooper says he doesn’t expect the food industry to sue Colorado, “but it doesn’t mean it won’t happen.”

Beyond freedom of choice, Cooper says he believes that GMO labeling will help bolster the economy.

“We’re an agricultural state,” Cooper says of Colorado. “All major countries outside of the U.S. have banned GMOs or require labeling, including China and Russia. The U.S. recently sent 640 million pounds of corn to China and it was rejected because it tested as being GMO. So what did it cost? What if the Colorado farmers decided to grow nonGMO corn? It would be a huge bonus to our economy and to our farm community to provide those as exports to other countries.”

Everyone loves a hike on the Mesa Trail, which is why you’ll see everyone from long-lost friends to aunts and uncles to that ex who done you wrong hiking on the Mesa Trail. Avoiding that ex as well as the chatty neighbor who just won’t shut up are two of the reasons to skip the Mesa on weekends and explore the trail complex of the Enchanted Mesa, which sits just to the southeast of Chautauqua. The other reasons include a nice variety of interconnecting loops, great views of the Flatirons and Boulder and the fact that everyone will be hiking someplace else.

HOT HINT: Want to hike the Mesa Trail anyhow? Do it on a weekday or get going by 7 a.m. on weekends to avoid the crowds as well as to finish your hike before the temperatures rise.

Visit the backside of the Indian Peaks

The Indian Peaks wilderness has long been a favorite beat-the-heat destination for Boulder residents, and with numerous peaks over 13,000 feet, it’s easy to find patches of snow lingering late into July (the area is also home to several glaciers, including the off-limits-to-hikers-and-climbers Arapahoe Glacier, which provides Boulder’s drinking water).

On weekends the trailheads on the eastern slope of the wilderness area can get packed with hikers and families out for a day trip. Our solution is to load up the backpack and drop over into the Indian Peak’s western slope or “backside.” Here, at lakes like Columbine Lake, you’ll find ample room to camp without the crowds, unsullied views and the kind of remote and lonely feelings that have become a rarity on the Indian’s eastern slope.

Do the Boulder Museum Walk

Get some exercise while also feeding your mind by taking in some history, culture and art in an easy walking loop that also takes in some of Boulder’s most interesting neighborhoods. Start your trip at the Charles A. Haertling Sculpture Park, located at Canyon and Ninth streets, which features works by Tom Miller, Beth Juliar-Skodje and Jerry Wingren, before heading south up Ninth to the Boulder History Museum located at 12th and Euclid. Here you’ll find exhibits ranging from the story of Boulder County from before European-American settlement up until the early 1900s to more recent history, including local contributions to the evolution of active wear. From here, walk on over to the University of Colorado Natural History Museum, located in the Henderson Building at 15th and Broadway. The museum features exhibits ranging from contemporary Native American Pottery to the latest scientific research being carried out by the Museum’s research sections.

Colorado Music Festival kick-offs its season on Sunday

W

hen the Colorado Music Festival gets underway Sunday (7:30 p.m. in Chautauqua Auditorium), many of the festival’s familiar features will be in place.

There will be family concerts, patriotic pops, orchestral showpieces, guest artists, and a mix of popular and classical styles on the “Music Mash-up” series ( July 1, 15 and 29). There will be picnics on the lawn and people sitting outside enjoying the summer nights.

What won’t be there is Michael Christie, the festival’s popular musical director who gave up his position at the end of last season. Instead, audiences will have a chance to preview three finalists to replace Christie, conducting two programs each: William Boughton ( July 6, 10 and 11); Carlos Miguel Prieto ( July 17, 18 and 20); and JeanMarie Zeitouni (Aug. 3, 7 and 8; festival program at www.comusic.org/2014summer-festival/).

Sunday’s opening concert will feature two musicians well known in Boulder: conductor Michael Butterman, director of Boulder Philharmonic; and pianist Christopher Taylor, a Boulder native and Cliburn Competition medalist who now teaches at the University of Wisconsin-Madison.

The program fits the creative approach audiences have come to appreciate from both the Boulder Phil and CMF, combining familiar and unfamiliar elements. Here the composers are very familiar indeed, but the works are not: from Mozart, the Boulder Weekly

“Haffner Symphony,” less known than other late symphonies; from Richard Strauss, the rarely heard “Burlesque” for piano and orchestra and “Serenade” for winds; and from Brahms, the pastoral “Serenade No. 2.”

“This is a chance for [the orchestra] to do some music that is beautiful and worthy, but they probably haven’t played a lot,” Butterman says.

A festival hallmark, the Music Mash-up series was brought back to CMF after the success of last year’s Brahms/Radiohead concert. The recomposer (his word) and conductor of that performance, Steve Hackman, is back this year as director for all three concerts.

While the term “mashup” comes from the popular music world, it is not really new in classical spheres.

Orchestras have long offered pops concerts with popular artists, and orchestral film scores have often combined classical and popular idioms. Hackman, a conservatory-trained musician with wide interests, sees what he is doing as just the next step in that lineage.

Today, many orchestral musicians are similarly active in different idioms.

To appeal to those players, Hackman is careful to honor the sound of both classical and popular sources.

“If you show that you’re being ultimately respectful and reverent of Beethoven while combining with this new music, you’ve got a much better chance of winning the favor of the musicians,” he says.

The first of the mashup concerts, on July 1, features Beethoven and Coldplay

fused into a single composition.

“Brahms-Radiohead had a lot of musical similarities,” Hackman says, referring to last year’s concert. “With Beethoven and Coldplay it’s really more of a feeling and a universality that they have in common.”

Hackman has “re-composed” Beethoven’s “Eroica” Symphony while carefully maintaining Beethoven’s orchestra, adding only three singers to perform Coldplay songs. “I basically turned the ‘Eroica’ into an oratorio, adapting both musics so that I can use the themes of Coldplay superimposed over the Beethoven.”

The other two mashup concerts bring in artists Hackman admires to appear with the orchestra. All are conservatory trained, and, like Hackman, invested in both classical and popular idioms. On July 15, the guests are female vocalists Shara Worden (performing as My Brightest Diamond), Aoife O’Donovan and Olga Bell.

“I am proud of how unique these three female artists are,” Hackman says.

“You’re going to hear three extraordinary artists who have found such compelling yet different ways to bridge these gaps” between musical genres.

All three will perform with the CMF orchestra in arrangements created for them by Hackman, and perform together in three pieces based on their individual work.

The final mashup concert, on July 29, features the classical/indie-rock ensemble San Fermin with the CMF orchestra. The work of Yale-trained composer/songwriter Ellis Ludwig-

“This guy’s for real,” Hackman says.

“We put them in front of an orchestra, [and] combine those rock and classical elements, and I think the effect will be pretty stunning.”

These kinds of concerts — bringing popular artists into the concert hall — are often seen as cynical attempts to attract new audiences, but Hackman definitely does not see it that way.

“For me, this isn’t a strategized endeavor,” he says. “This is truly just who I am as a musician and who I’ve always been, somebody who lives in the classical and the pop worlds. I am someone who’s interested in making creative new works, who doesn’t see a huge difference between a masterwork of Beethoven and a masterwork of Coldplay.

“I just don’t see those lines.”

buzz Second time the charm for Colorado Music Festival?

E

veryone at the Colorado Music Festival (CMF) hopes that it’s the second time that’s the charm.

After a failed first attempt, the CMF announced that it has hired a new executive director. Andrew Bradford, currently the executive director of the Illinois Philharmonic Orchestra in Park Forest, Ill., will take the reins at CMF on Aug. 11.

The executive director is responsible for both the well known summer festival held primarily at Boulder’s Chautauqua Auditorium, and the Center for Musical Arts, an educational program located in

Lafayette that provides musical instruction and performance experiences for all ages, from early childhood through adulthood.

The executive director position has essentially been unfilled since Catherine Underhill left CMF in August 2013 after 11 years on the job. David Pratt of the Savannah (Georgia) Philharmonic was initially hired for the position in December 2013, but then backed out in January without publicly giving a reason for withdrawing.

Bradford knows of this history but expresses nothing but enthusiasm for the job.

“I know of no other regional arts organizations anywhere in the country that are doing what this organization is doing,” he says. “On one hand, [CMF is] producing a summer music festival that as far as I’m concerned is second to none, while at the same time operating a really robust community music school.

For me that was the real attraction.”

Bradford arrives at an awkward time for a new executive. The relationship between administrative and artistic leadership is key for any large musical organization, but Bradford does not know who his partner will be. The festival’s popular music director, Michael Christie, left at the end of last season, and his replacement will be hired after the summer festival.

Three final candidates for music director will each conduct two programs during this year’s festival: William Boughton on July 6, 10 and 11; Carolos Miguel Preito on July 17, 18 and 20; and Jean-Marie Zeitouni on Aug. 3, 7 and 8.

Bradford will not officially assume duties with the CMF until after the visits of the three candidates. Nevertheless, he expects to be involved in the hiring process.

“The board has made it very clear that because the relationship between the executive director and the artistic director is so important, that they want me to have input on the process,” he explains. “I’m flying out the week of July 7 and the week of July 14, when the first two candidates are going to be in town.”

Bradford is not troubled at the prospect of hiring a new musical director in his first weeks on the job.

“I actually think it’s an exciting thing,” he says.

“It’s not something that stresses me out or anything like that.”

One of his challenges will be balancing the different needs of the summer festival and the year-round school. Here again, Bradford is nothing but optimistic. “It’s certainly unique, and there may be challenges between the two sides that I don’t know about yet, but as far as I’m concerned, it’s entirely a positive thing.”

He also arrives at an interesting time for the entire music industry. Even while music conservatory graduates are proliferating, jobs are getting harder to find.

Classical music audiences are getting older. Many orchestras are having difficulty balancing the books, but they come under fire if they resort to what critics and others regard as “gimmicks” to bring in audiences.

If those are clouds for the Colorado Music Festival, Bradford is concentrating on the lining.

“I don’t buy at all this argument that I hear so many people making that classical music is dying,” he says. “Certainly there are issues facing the industry.

But I call this organization an exemplar of what the 21st century performing arts organization should be, because it has done what very few other organizations have done. It has taken two entities, the music festival and the music school, and put them under one roof, and what you’re seeing as a result is that there has been incredible success with engaging the next generation of classical music audiences.”

To his credit, Bradford is very clear on the two different roles played by administrative and artistic management.

“They are not hiring me for my artistic vision,” he says. “I am primarily a fundraiser, and I view my role as making sure that the organization has the resources that it needs to realize the vision of the artistic head.

“I’m happy to be the person behind the scenes making sure everything runs well.”

But it’s just March Fourth, and you’ll be able to see them perform at the Louisville Downtown Street Faire on Friday, June 27.

March Fourth (also known as M4 to its growing fan base) originated in Portland, Ore., getting its start when a group of musicians decided to put together a seven-song brass band set for a Fat Tuesday Mardi Gras party on March 4, 2003.

“It ended up being a huge success” says bandleader and bass player John Averill. “We decided we would stick with the theme and name the band after its first ever successful performance.”

The band booked more shows for its brass and drumline ensemble, and performed regularly in the Last Thursday art walks in Portland. Before long, it began to be viewed as the oddball city’s unofficial mascot.

n an online event description, the City of Louisville has this to say about March Fourth Marching Band: “This is impossible to explain, you’ll just have to be there.”

It’s not impossible to explain March Fourth, though it certainly is a challenge.

To see the band play is to have joyous percussion and bass work into your ear canals as you find yourself surrounded by dancers and acrobats. Everyone wears intricate, colorful costumes adding to the audible liveliness. Between the dancers, the rhythms and the spectacle, it’s something of a pocket of hyper-reality in which everything seems brighter and more vivid, like whatever it was that The Beatles were singing about in “Lucy in the Sky with Diamonds.”

circus performance. In fact, March Fourth Marching Band isn’t a marching band at all.

“We decided to add marching band to our name because we felt that fit pretty well with the theme of the band,” continues Averill. “However, through the years, we’ve actually realized how misleading the marching band at the end of our name really is and I think we’re actually going to drop that from our name to better clarify who we really are and be able to better reach out to other audiences, especially the college community.”

Though at times, its membership has swelled upwards of two-dozen, March Fourth currently consists of 13 musicians and a team of dancers, stiltwalkers and acrobats. A typical performance consists of an 18-song set with the performers frolicking around for four of them. The band members say they love to go out into the audience and encourage it to get involved and dance as they unleash their energetic melodies. Although there are now only four of the original members of the

band (attrition is due to member’s personal lives outside the band) March Fourth has maintained its New Orleans brass and groove-heavy rock style.

March Fourth played locally in Oregon for about four years before going off to tour nationwide. The band earned a reputation for stellar performances that bridged genres. Good reviews led March Fourth to tour Germany in 2006 (while the nation was hosting the FIFA World Cup) to perform at the Altontale Festival where it won the “Best in Show Award,” beating more than 50 other group performers from around the world.

But even with international acclaim rolling in, the band likes it here in the Rockies.

“Within the last 11 years or so we have travelled to perform all around the country and Colorado is by far one of our most favorite places to play,” says Averill.

“I would say we have performed in 25 to 30 different cities in Colorado, covering many mountain and ski towns, and its great to see how energetic the people in this state get when we get to go out and perform here.”

Between sold-out shows around the globe and well-received albums, March Fourth has had a steady rise since its debut in 2003, continuing to tour and never failing to seize the moment and bring its audience together for a fun experience that — almost — defies explanation.

T

hat The Tempest weaves through murderous plots, attempted rape, enslavement, ill-fated lovers and split families — the territory of tragedies, to be sure, and escapes relatively unscathed as something closer to a comedy is a testament to the strength of Shakespeare as a writer. By some counts, this final work by the Bard is his best, a victory lap demonstrating his mastery in capturing the human character.

Of course, any good captain could still fail without careful handling on the part of the ship’s crew, and it’s a credit to the execution at the Colorado Shakespeare Festival that they walk that happy line, dipping a toe on either side.

Audiences for The Tempest ride out waves of emotional highs and lows.

The Tempest, of course, does open with a shipwreck. At last, fate has brought the exiled duke Prospero’s enemies within the reach of his influence.

With the aid of a spirit, Ariel, and a magical staff, Prospero dashes their ships against the rocks of the island where he and his daughter have been living in the company of Ariel and the disfigured son of a sea witch, Caliban.

That he has raised his daughter on that near-empty island for more than 12 years without the riches his dukedom would have allowed — and, perhaps more importantly, without the library of books he would have used to educated her — has generated a palpable rage in Prospero. He’s ready to weather whatever the demands of setting the wheels of revenge in motion.

But The Tempest isn’t a story of vengeance. It’s a story of redemption and mercy.

Prospero, too, could easily be pushed over the edge into dangerous territory. But, as portrayed by Peter Simon Hilton, though his fury can raise storms, that superpower is tempered by

a mortal pain and exhaustion.

Hilton plays the occasionally sarcastic Prospero with a nuance that gives both a sense of the ongoing anger at injustice and the threads of the lingering hope that will later give way for mercy. And while the array of period garb from the 1700s is attractive, unlike tellings of Macbeth that moved to Afghanistan, as the Festival did last year, there’s little gained or lost in clarifying the time in which our story is told. It’s a timeless tale, and the best work done to add to the atmosphere, as can so often be the case in the Mary Rippon Outdoor Theatre, is the occasional evening storm.

So, let’s end with the fools.

The drunken buffoons Stefano and Trinocolo and the antics to which they descend with Caliban acquired as their drinking mate do much to pull the play back where it might otherwise be steered toward the grounds for a tragedy. In their respective roles as Trinculo and Stephano, Rodney Lizano and Sammie Joe Kinnett are all in — and infectiously in.

‘Hanna Ranch’ examines the fight for agriculture to go green

C

olorado rancher Kirk Hanna was the ideal cowboy: tall, dark and handsome, complete with a Tom Selleck mustache and a white Stetson hat. But Hanna was much more than your average cowboy. He was a progressive concerned with ecology and conservation, and to practice what he preached, he pioneered Holistic Resource Management practices at his family ranch located just south of Colorado Springs.

Converting Hanna Ranch from traditional ranching methods to holistic management was not any easy one.

Holistic Resource Management requires more planning, more work and more fences than traditional ranching, and is not something that can be accomplished individually — support from the surrounding community is a must. Hanna learned the hard way that progress is slow, costly and not exactly popular. He was met with resistance every step of the way, and found himself fighting a multifronted war against his family, friends, other ranchers, as well as the cities of Colorado Springs and Pueblo.

These struggles were documented

by director Mitch Dickman, whose feature, Hanna Ranch, will play at the Chautauqua Auditorium on June 27, followed by a Q&A with Dickman.

The Colorado-based director cobbles together interviews from Hanna’s family and a seemingly endless supply of Hanna home movies from the ’80s and ’90s to give an impression of who Kirk Hanna was and what he was trying to accomplish with Hanna Ranch.

A major focus of the film is Hanna’s belief that conservationists and ranchers should not be at odds, and his attempts to educate people on why they should work away more than just the land. Kirk Hanna is the environmentalist’s Marlboro Man

Hanna was a natural leading man and his battle against the establishment is ripe stuff, but sadly Hanna’s life lacked a Hollywood ending. Like most progressives, Hanna did not get very far, and in 1998 Kirk Hanna took his own life. The events leading up to Hanna’s suicide are still not a topic that his wife Ann and brother Jay are comfortable discussing and the documentary ends with some uncertainty. Hanna Ranch is now under the tutelage of Ann and Jay and they are doing their best to continue the journey that Kirk started.

Basically, I admit that I was at least half in the tank for The Signal before I went in. This is a movie laser targeted at my personal joy box.

The Signal isn’t quirky, it’s downright weird. Combining elements of Cronenbergian body horror, District 9’s believable-ish setting and the feel of Chronicle, writer/director William Eubank leveraged a small budget to great effect (and effects). Any film with this many WTF moments is insanely difficult to synopsize without spoiling things and thus taking some of the edge off. And this puppy is all edges, razor-sharp ones that are shaped like a labyrinth.

Here’s what I feel comfortable telling you: Nic (Brenton Twaites) is a college student with an unspecified degenerative medical condition that leaves him unable to walk without assistance. His girlfriend, Haley (Olivia Cooke), is moving from Massachusetts to California for one year due to a school opportunity. So Nic, Haley and their mutual buddy Jonah (Beau Knapp) are on a cross-country trip to get her settled in.

Nic and Jonah are MIT students who are being toyed with by a computer hacker who crashed servers at

their school. Out of a misplaced sense of justice, and partially out of frustration at life changes, the dudes convince Haley to let them take a detour to confront the hacker … in the middle of the desert … at night … It does not go well. The next thing he knows, Nic opens his eyes to see Damon (Laurence Fishburne), who is not a comforting first sight. I can’t tell you anything past that; you’re just gonna have to see it.

Thwaites is crazy good. Kudos to whatever casting director figured out this young fella could pretty much carry an entire movie on his own. Whole chunks of the film are just Thwaites thinkin’ ‘bout stuff or trying not to go bonkers. Speaking of bonkers: Holy crap this thing goes weirdo-insane in the best possible ways. Too often, cinematic scifi is afraid to go that extra mile and take a creative (but super weird idea) to its most science-fictiony place. The Signal goes to that place, goes past that place and then sends a postcard that says, “Hey, did you see what I did there? Crazy, huh?”

Like anchovies and the music of the 1980s, hard-core indie sci-fi is an acquired taste. If you’re a connoisseur of this flavor, The Signal is an all-out savory feast. I look forward to long discussions with fellow cinema nerds about the significance of the shapes and colors in the film and the use of the term “agitated.” I realize how insanely dorky that is, but you judging me like that is the reason your mom likes your sister better.

Local therapists exploring the value of gardening

S

o long as you have those cushy gardener knee pads from Home Depot and a sufficiently brimmed hat, working the fields (or even just pulling the weeds in your yard) is a remedial activity that does most people the favor of letting them relax, zone out and reconnect with nature.

But for those living with special physical or mental needs, therapists are discovering it can serve an even greater purpose.

Horticultural therapy picks up where medicinal treatments leave off. By way of gardening work and instruction, horticultural therapy serves to assist the elderly and people with disabilities through an expanded range of activities — both physical and social. And though horticultural therapy, like many other treatment paths, helps relieve pain and improve overall quality of life for patients, it stands apart by also offering a sense of purpose and community belonging.

“I think it’s one of those out-of-sight services; people don’t really know that it’s happening, but it’s important that it be available,” says Annie Sweeney, program director at Growing Gardens in Boulder.

Growing Gardens is one of only a handful of sites around Colorado where horticultural therapy programs take place. After partnering with the City of Boulder in 1998 to help manage the Hawthorn Community Gardens, the folks at Growing Gardens recognized there was a need for more.

“We wanted to increase the skills and resources people had to grow their own food,” explains Growing Gardens’ Development Director Alyson Duffy. “And then we started developing programs too; it all kind of sprouted from that.”

One of the programs that came from their expanded efforts is the horticulturConnect al therapy program. Relative pioneers of the practice in the with Boulderus area, Growing Gardens came to build their horticultural therapy garden with the help of the Colorado State University Extension office, after being prompted by the Center for People with Disabilities.

Walking around the Growing Gardens site, you immediately notice plant beds that are raised to assorted heights and broad paths that border and run through the Connect with us gardens. Sweeney explains that special design elements like these improve garden interaction for users with varying mobilities — such as someone with arthritis who can’t comfortably kneel down to the ground. Their new orchard behind the greenhouse will even have heirloom fruit trees where cherries, plums and apples will hang lower to accommodate for children and those in wheelchairs picking the fruit. see PAIN AND GROWTH Page 44

As the gardens become more lush throughout the summer months, the area will be filled with a sensory-oriented plant selection, characteristic of horticultural therapy gardens. Varieties used vary, but allow for the garden to be focused on bright color, texture and fragrance.

But this isn’t some modern age holistic therapy thing; in the U.S., documented ideas about horticultural therapy date back to the American Revolution. Considered the father of American Psychiatry, Dr. Benjamin Rush was the first to record his theory about the healing effects he noticed in his patients after spending time working outside. In 1768 — before we were even a country — Rush maintained that digging in soil had a curative effect for the mentally ill. Since then, what became known as horticultural therapy has been recognized as a therapeutic treatment for not only the mind, but also the body.

The benefits of horticultural therapy are far-reaching. Physically, it can help with basic motor skills, improving muscle coordination and providing a gentle enough movement to help relieve joints plagued by arthritis. But the emotional and intellectual benefits are just as numerous.

“There’s a real sense of excitement and passion from being outside for the those who work in the gardens,” says Sweeney. Duffy adds that “people with disabilities and seniors tend to be more isolated, and so the social interaction that they get here can be very healing.”

According to the American Horticultural Therapy Association, working regularly with a group and sharing the fruit of everyone’s labor (literally) is an important form of social growth. This is especially true for people who might easily feel on the fringe of society due to age, or mental or physical challenges — like those from the retirement community of Bella Vista, or the Temple Grandin School for Asperger’s students; groups who regularly participate in the program at Growing Gardens. Seeing themselves succeed in the garden improves participants’ sense of worth and confidence, and — particularly important for the elderly or emotionally troubled — it’s an activity that generates interest, even excitement for the future.

On top of all of this, for those who suffer from dementia or Alzheimer’s, the purposeful work that horticultural therapy offers can help conjure up good feelings from the past that they’ve lost.

However, like many horticultural therapy gardens, the site in Boulder also lends itself to groups who want to be more passive.

“It just depends on the group and their abilities. Some enjoy just sitting and enjoying the beauty of the garden,” Duffy explains.

Horticultural therapy programs also often include plant-centric activities that supplement the learning and growth started in the gardens. At Growing Gardens, people can expect to engage in cooking classes that provide an increased knowledge of food preparation using some of what is grown on site. There’s also bird identification and garden-based crafts, such as making artificial flowers or turning seeds and dried flowers into jewelry.

Despite all of its success, horticultural therapy still isn’t as widely known as it probably should be.

“Services for the elderly and people with different needs is declining,” regrets Sweeney. “There isn’t that same community outreach around them as there is for other populations.”

However, an increase in schools that offer accreditation in horticultural therapy is on the rise in the U.S., which bodes well for the continued spread of this therapy to people who need it.

Locally, the Horticultural Therapy Institute in Denver offers a certification program, and CSU in Fort Collins allows students to concentrate in horticultural therapy as part of a larger horticulture degree.

As Sweeney puts it though, “word of mouth is most crucial” for making people aware that this is a resource that exists and matters.

The Bitter Bar ditches its menu for finger food

hough downtown Boulder has its share of classy joints, when discerning Boulderites are looking for somewhere to wear their dress North Face jacket, or that little black dress that perfectly matches their nice Chacos, they head downtown to The Bitter Bar — this year’s

But after an ownership change earlier this year, The Bitter Bar closed down briefly to revamp itself as more of a neighborhood kind of place.

What’s changed?

Not much.

The dark lounge vibe is virtually unchanged, and there’s an equally stellar cocktail menu.

The only thing that really changed was the food, which is largely gone. The Bitter Bar’s full menu has been paired down to a handful of items, all of the snacks persuasion.

There are marinated olives, cheese and meat plates, and a smoked salmon pâté, as well as some rotating desserts.

And that’s it.

The change was largely one of con-

venience. Owner James Lee rented The Bitter Bar’s kitchen facilities to Hosea Rosenberg, winner of Bravo’s Top Chef Season Five, who uses the space to prepare food for his company, Blackbelly Catering, and prepares the snacks, freeing Lee to focus on the sweet, sweet booze. The cured meats ($14), which include slices of Napolitana (a coarsely ground, spicy pork salami), Coppa (a cured and spicy pork shoulder) and a six-month aged prosciutto, are all from Blackbelly’s farm. Served with crackers or bread and a portion of seeded mustard, each is a salty delight.

The cheeses in the Trio of Cheese ($14) are not from Blackbelly Farm (one is in-state and the other two are imported from Spain), although staff at The Bitter Bar told Boulder Weekly, that is something Rosenberg is working towards. But there is a nice variety of wedges, including cheese from cow’s, sheep’s and goat’s milk, and a delicious apricot compote to go with it.

Both platters are nice finger food that serves as an excellently salty companion to the sweetness of The Bitter Bar’s signature cocktails. They’re perfect for sharing amongst a table, but neither is very substantial as a meal, especially not for the price.

The best deal on the menu is the olive plate ($3). Not only is it the

cheapest item on the menu, but it’s a lot of freaking olives, more than enough to keep you throwing them in the air and trying to catch them in your mouth like your weird uncle at a holiday meal for some time. And with a mix of varieties, all marinated inhouse as well, it makes for yet another adventure in salting your tongue. But fair warning, they don’t come pitted, so be prepared to nibble.

If the chow just described sounds delicious to you, there’s one problem: according to Lee, it’s temporary, as Blackbelly Catering will be moving on from the space in the fall, when it begins running its catering business out of a brick and mortar restaurant it will be opening in East Boulder. Lee says he already has a line of other chefs and caterers interested in the space, and he’s interested in the idea of renting it to a patisserie so The Bitter Bar can feature faboo desserts. Which means that Boulder Weekly may have to return and review the new delicious offerings again soon, a tragedy on par with getting a puppy for your birthday and then living happily ever after. Darn.

Lindsay’s, the iconic deli and Haagen-Dazs shop on the southwest corner of Pearl and Broadway, spent its recent months tearing down its walls to expand, redecorate, add a kitchen, and offer “Grab-n-Go” deli items.

Owner Lindsay Shaw is wideeyed about the new launch set for June 27. More soups and sandwiches — some of which are employee-inspired — will join the classics like the “That’s What She Said,” and customized ice cream cakes made by Shaw will be available.

The new décor will have a funky “modern-vintage theme,” according to Shaw, with purple walls, a mural of the Shaw’s family history, “wood-tile” looking floors, beetle-kill pine and subway tile walls, a curved soffit, red chandeliers and turquoise deer head door hangers.

Hours will be 8 a.m. to 12 a.m. for summer, and 8 a.m. to 10:30 p.m. for winter.

ummer is officially upon us, marking three months of kicking back, maxing and relaxing all cool with a nice cold beer in hand.

Many breweries are ushering in the season with lighter summer fare, like Boulder Beer’s Hoopla, their dry-hopped festival beer. Others are planning to celebrate the season with one-off events like Avery’s Four on the Fourth 4K race, in which runners can compete before enjoying beer and breakfast burritos.

And even more breweries are gearing up for the 25th Annual Colorado Brewers Festival, which will go down in Fort Collins Friday, June 27 through Sunday, June 29.

But while all that is going on, one Boulder brewery has formed an interesting partnership that will last the whole summer long.

“We’re really excited about our deal with [Whitewater Tube Co.],” says Alyssa Lundgren, brand manager for Fate Brewing Company.

The two businesses, conveniently located across the street from each other and just off Boulder Creek, have joined forces to offer a voucher to customers who visit both establishments. The vouchers, which get a discount pub plate when renting tubes or stand-up paddleboards, can be purchased at either location and brought to the other.

Everyone involved seems especially excited now that Boulder Creek has reopened.

To try to help with this, Whitewater Tube is also offering a shuttle service to and from the waters for a nominal charge, taking customers to slower or still waters if that’s their preference.

In addition, the voucher is good for Phil Mudrock discount food rather than drinks, specifi–1963 cally to encourage responsible water sports.

t was great news to hear that New York has decided to legalize medical cannabis.

Well, sort of.

After weeks of debate and many compromises, the state will allow doctors to prescribe patients suffering from multiple sclerosis, epilepsy, glaucoma and cancer to use medical cannabis in the form of tinctures, edibles or oil for vaporizers.

They will not be allowed to smoke it.

The official reason for this peculiar concession is that Gov. Cuomo, along with some in the state legislature, are concerned that marijuana is a gateway drug.

Never mind that we’re not talking about the recreational user or children here; these are people with debilitating illnesses looking for symptom relief. Some will be using cannabis to replace the prescription drugs they currently use. And the governor is worried that they might get hooked on cannabis? That they might be looking to sneak a buzz instead of finding respite from a crippling disease?

Never mind that the “gateway theory” has been pretty much scientifically discredited. As far back as 1999, a government study, Marijuana and Medicine: Assessing the Science Base http://bit.ly/1j2tPY1 laid it out pretty succinctly. “The gateway analogy evokes two ideas that are often confused. The first, more often referred to as the ‘stepping stone’ hypothesis, is the idea that progression from marijuana to other drugs arises from pharmacological properties of marijuana itself.”

As the researchers found out, the “stepping stone” analogy applies only in the sense that someone who enjoys the feelings of cannabis might be wiling to try other mood-altering drugs.

“There is no evidence that marijuana serves as a stepping stone on the basis of its particular physiological effect,” they write. “One might argue that marijuana is generally used before other illicit mood-altering drugs, in part, because its effects are milder; in that case, marijuana is a stepping stone only in the same sense as taking a small dose of a particular drug

and then increasing that dose over time is a stepping stone to increased drug use.”

The second is that marijuana leads to a world of harder drugs where there is more pressure to try other illicit substances. “The latter does not suggest that the pharmacological qualities of marijuana make it a risk factor for progression to other drug use,” they found.

“Instead, the legal status of marijuana makes it a gateway drug.”

That hasn’t stopped prohibitionists and whomever has Gov. Cuomo’s ear on this subject these days from promoting the gateway theory 15 years later. The THC Fear Factor has dominated prohibitionist lore back to the 1930s. There is no evidence to suggest that people who alter their consciousness are any better or worse off than people who don’t. But something about THC brings out a kind of moral fervor in some to try and keep the rest of us from enjoying it.

And this, even though their own consciousness is altered by everything from alcohol to ice cream and coffee.

For many patients, smoking cannabis is still the fastest delivery system, and the one they can most control. For people dealing with nausea and extreme discomfort, waiting an hour for an edible to come on isn’t a reliable option, and edible consistency is still a work in progress. But that people with epilepsy, glaucoma and cancer shouldn’t be able to smoke marijuana because it might be a gateway drug sounds pretty desperate, especially from a credible governor of a major U.S. state. Will Cuomo arrest patients if they are caught smok-

ing? Or for buying bud from the black market?

THC Fear Factor thinking is at work in states that have allowed medical cannabis, but only if it’s extremely low in THC and high in CBD, another prominent cannabinoid. Florida last month joined Alabama, Iowa, Kentucky, Mississippi, South Carolina, Tennessee, Utah and Wisconsin to enact restrictive, CBD-only medical marijuana laws.

The problem is that some of these programs are aimed at one particular disease, specifically the rare epilepsy disorder that is calmed by “Charlotte’s Web”, a high-CBD strain featured in Sanjay Gupta’s CNN Weed specials. Although that’s a start, only a low percentage of patients need that particular strain. Many who use cannabis for other ailments won’t be helped by low-THC strains.

Tests and research indicate that hybrid strains that include THC and CBD (and other of the 85 cannabinoids) work better for those contending with multiple sclerosis, pain and nausea. And though the federal government doesn’t accept medical cannabis, it has approved a synthetic THC pill called Marinol. The jury is still out on whether it works as well as cannabis itself.

I don’t generally use the cannabis/alcohol analogy, but it applies here. People who change their consciousness with alcohol (or coffee, or prescription drugs) and want to restrict others from changing theirs with THC are the worst of hypocrites, especially since the scientific evidence continues to prove that alcohol is far more dangerous than cannabis.

Even if you believe that medical cannabis is a ruse to push legalization, millions of people around the country are using it to alleviate symptoms of various ailments, and whether they smoke it, eat it or vaporize it, if it works for them, why should anyone else care?
