Pot perspectives (Re: “Pot at the Tea Party,” letters, April 29.) Boulder Weekly letter-writer Brain Sherwin writes in the April 29 edition, “And don’t tell us that the free market will take care of [uninsured sick people], because it’s had multiple decades to get it right and it hasn’t.”

But is that really true? And what is a free market anyway?

A free market is a market where the government’s only roles are to protect people participating in it from force and fraud, to settle disputes and to enforce contracts. If there is any other government interference in the market, by definition it’s not a free market.

Does the U.S. health care market over the past few decades meet the definition of a free market? Not at all, because government interference in the health care market is everywhere: Doctors, nurses and pharmacists are licensed by the government. The FDA controls which medical procedures and drugs are permitted and drives up health care prices with Byzantine testing requirements. Almost half of every health care dollar spent in the U.S. is spent by government, through such programs as Medicare, Medicaid, SCHIP, government employee health coverage and VA health benefits, among others.

The states mandate certain health care insurance coverage (Colorado has 51 mandates), but bar buying health insurance across state lines. The Emergency Medical Treatment and Active Labor Act (EMTALA) forces

hospitals and ambulance services to provide care to anyone needing emergency health care treatment regardless of citizenship, legal status or ability to pay.

Government interference in the health care market is so pervasive that the DEA is waging a war on sick people by making doctors fearful of prescribing adequate pain medication and outlawing beneficial drugs such as medical marijuana. One cannot even buy certain cold

oing a public service was the very last thing on the minds of the geniuses at Goldman Sachs who created Abacus 2007-ACI, but I, for one, am grateful to them.

Abacus is the name of the investment package that has caused mighty Goldman to get its tail caught in a crack at the Securities and Exchange Commission. According to the federal fraud cops, Abacus is nothing but a scam. Yet I find it enormously useful, because it reveals two dirty little secrets that Wall Street does not want us outsiders catching on to.

Secret #1 is that Wall Street has radically and abruptly shifted its function. Rather than being the financier of productive business enterprises, it is now a global gambling house for the super-rich, as Abacus proves.

Crying over spilled oil

he world’s biggest oil spill was not caused by an oil rig blowout like the Deepwater Horizon or by an oil tanker rupture like the Exxon Valdez. Nor was it caused by a big oil company. It was caused by an asshole.

His name was Saddam Hussein.

On Jan. 21, 1991, Saddam took time off from his busy schedule of filling mass graves and invading his neighbors to have his army open the valves at Kuwait’s Sea Island oil terminal with the deliberate intent of causing a spill.

He succeeded. The ensuing fiveinch-thick, 42-mile-wide oil slick eventually stretched for 101 miles down the Kuwaiti and Saudi Arabian coasts. It contained about 1.5 million metric tons of oil.

(A metric ton of Kuwaiti crude oil equals 7.33 barrels or 308 gallons, so Saddam’s slick contained about 11 million barrels or 462 million gallons of crude.)

When it comes to oil pollution, Saddam is in a class by himself. Not only is he responsible for the world’s largest oil spill, he gets credit for the fifthlargest spill, too.

That one occurred on Feb. 4, 1983, when his air force bombed Iran’s Nowruz oil field platform, resulting in a 260,000-metric-ton (1.9-million-barrel/80-million-gallon) spill.

Then there’s the matter of torching 750 Kuwaiti oil wells as his army was hastily leaving the country in March 1991. The fires burned for eight months and consumed about 5 million barrels of oil a day.

Happily, Saddam was eventually hanged, albeit for crimes against humanity rather than crimes against nature. (Think of it as reducing his carbon footprint with extreme prejudice.)

The lesson to be learned from this is plain enough, although a bit nonintuitive: Hanging dictators is not only good for human rights, it’s also good for the environment.

There are lessons to be learned from most of the world’s major oil spills, also

non-intuitive and inconvenient for the most part. Take the spill following the Deepwater Horizon rig blowout two weeks ago.

Lesson 1 is drill, baby, drill. That well is flowing at 5,000 barrels a day, and maybe 25,000 barrels a day by some estimates. If the last is correct, the well’s output is approaching Saudi standards.

Spill or no spill, the country is still economically and strategically addicted to oil, and that isn’t going to change for at least a generation, even if we started converting to electric cars and green electricity tomorrow. We are currently fighting two wars with enemies who are at least in part funded by dollars spent

by American consumers on gasoline made from imported crude. The U.S. currently imports about 5 billion barrels of oil a year. Think of it as a half-trilliondollar economic stimulus plan in reverse. Under the circumstances, not to develop big domestic oil finds verges on treason.

Lesson 2 is drilling for oil in the U.S. is less likely to result in a major spill than importing it in tankers. Since 1967, there have been 14 oil spills in the world that have resulted in the release of 100,000 metric tons or more of oil. Setting aside the two caused by Saddam, 10 of the remaining 12 involved tankers.

(By comparison with these disasters, the Exxon Valdez disaster — which America’s hyperventilating news media seems to think is the gold standard of oil spills — is pretty small potatoes.

The Exxon Valdez was carrying 175,600 metric tons of oil when it ran aground in Prince William Sound, but only about 37,000 tons spilled.)

Lesson 3 is that when it comes to oil spills, error recovery is more critical than accident prevention. Oil is produced safely most of the time, but that doesn’t change the fact that drilling for oil 50 miles from land in 5,000 feet of

who were practically bulletproof. The New York Times carried a scurrilous editorial condemning mythical “cocaine ni**ers” committing mass murders in the South. However, modern research can find no records of cocaine-using blacks in the South publicly assaulting white women or shooting down strangers in the streets. In that era, the slightest step against white supremacy was instantly met with a lynching, so such stories are bare-faced lies. (See “Negro cocaine ‘fiends’ new Southern menace,” The New York Times, Sunday Feb. 8, 1914, www.druglibrary.org/ SCHAFFER/HISTORY/negro_ cocaine_fiends.htm) Marijuana laws were also passed using racial aspersions: “Marihuana influences Negroes to look at white people in the eye, step on white men’s shadows and look at a white woman twice.” (Hearst newspapers nationwide, 1934.)

Once the “purpose” of American drug laws is understood, the Constitutional basis for drug prohibition becomes shaky.

I’m a 38-year-old college grad who has had asthma all his life. I would like to tell you a story about how I found out about marijuana and its effects on my asthma. I am confused about if I can get a card or not, so I plead my case to the public in order to educate you on how some people are asthmatic and use marijuana to relieve the pain in the lungs from over-expansion, in order to cough up phlegm.

It is also known as an expectorant and helps to break up the phlegm, which is causing oxygen loss. I don’t know if this works for everyone but it sure does for me. When I was a kid I would use four Primatine mist bottles a month in order to breath. I had all the newest and best medicines, and Primatine mist was all that would work for me. That is, until my good friend and sister told me about marijuana and its use for asthma. I was having an asthma attack in New York, N.Y., and might have died due to loss of oxygen.

My friends had a joint lit as I entered the room with asthma and sat on the couch. I didn’t notice at first that they were smoking, but then I smelt the joint and my asthma was getting some relief.

(Re: “Appearance is everything,” news, April 22.) Thank you for your dogged efforts to obtain information about the “branding and marketing project” at the University of Colorado — in particular its $785,000 price tag.

It is easy to agree with Regent Tom Lucero, who told the Weekly that CU “could have used those dollars elsewhere,” and that it “looks like an extravagant expense.” He says a person could ask the question, “Was it worth $785,000?” And it’s easy to see why Regent Stephen Ludwig, a marketing and communications consultant by trade, would think the price tag is acceptable. He echoes top administrators in repeating their belief that there is a lot of “confusion,” inconsistency and lack of “discipline” in the university’s messages.

As a member of the university community, I received an April 21 e-mail memo from the office of President Bruce Benson, who was promoting the importance of the branding initiative.

Benson refers to CU’s many “stakeholders,” who “have a stake in the university’s success and are willing to help us.”

In the memo, Benson says, “We project hundreds of different and sometimes competing messages and visual images that muddy and dilute our efforts to connect with our key audiences. In a world where people are bombarded with images and messages, we cannot afford to foster confusion.”

I am wondering who is really confused here. Is it that confusing when the law school in Boulder, the three different business schools, the medical school in Aurora, music and entertainment industry studies in Denver and the art gallery in Colorado Springs have different brochures, graphics and photos? Are CU administrators talking about donors who are confused about the different university programs? I doubt CU students, faculty and staff, who Benson includes in the list of stakeholders, are troubled on a day-to-day basis by this “confusion.” Rather, it could be seen as illustrative of the rich diversity of the university’s programs.

Benson said in his memo that he planned to present the progress of the initiative to the regents on April 22. “I will share with the board the brand

architecture, the visual representation of the university that will provide guidelines for moving forward,” he said. I find it unfortunate that he added, “The project is not complete,” even after all the money spent on the consultant.

“What remains is refining key messages and finishing the graphic identity standards that will provide the roadmap for how we present ourselves visually,” Benson said.

Now that the regents have seen the results of the study, the materials that CU labeled as “work product” and would not release to the Weekly should now be deemed public records. It will be interesting to see details on the logos and the “identity standards manual.”

Somehow I doubt they will be worth all the money that could have been spent elsewhere.

Beyond bourgeois Dr. Jenni Skyler could have added a sixth language to the five she presented in her article “Learning each other’s love language” — economic class (Sophisticated Sex, April 22). That is a language she speaks fluently.

Based on the details she has given us of the kind of person she wants to turn into a better lover — he nibbles on appetizers at The Med, he buys a Porsche 911, among other things — it is clear that she is pandering to affluent suburbanites and the rich. Her five-step plan to help such a person sounds boring and silly. But it really doesn’t matter, because most of the people who make up the class of people she is addressing could not feel passionate love if it fell on their heads, although they will always pay people like Dr. Skyler to tell them that they do.

If Dr. Skyler really wanted to read revolutionary books, she would find herself confronted with authors whose lives and works are filled with sex, passion, torrid love affairs, messiness and contradictions.

More importantly, she would be challenged with ideas that transgress the conservative bourgeois values she is working so hard to defend.

water is risky business, or that blowouts, like shit, happen — and failing to deal with them is not an option.

British Petroleum’s response to the Deepwater Horizon disaster has had the feel of NASA’s response to the Apollo 13 disaster — it’s been marked by aggressive, creative improvisation — as has the response of federal and state authorities, which is all to the good. But given the scale of the problem and the consequences it can have, the oil industry and the government need to have the material and human resources in place to respond in a way that minimizes the need for improvisation.

Lesson 4 is nature is less fragile than environmentalists. The world’s major oil spills seem to play out in remarkably similar patterns: There’s usually a big die-off of marine life, especially birds and shellfish. Fishing and tourist communities get hammered.

Anguished environmentalists declare beaches and the “fragile” marine ecosystem poisoned forever.

But that isn’t what happens. Study after study of major oil spills, including Saddam’s spills, marvel over the fact that within a year or two, nature is coming back, and that 20 or 30 years

after the fact most (although usually not all) species have recovered or are on the way to recovery.

After a few decades it is hard to know that anything happened.

Take the Exxon Valdez disaster. A recent study found that some 21,000 gallons of crude still remain under the sands of 1,300 miles of Prince William Sound’s shoreline — 21,000 gallons out of 11.4 million gallons spilled. Twentyone thousand gallons of oil would just about fill two tanker trucks, and it’s spread out over a distance roughly equivalent to the distance between Denver and Detroit. Between the efforts of Exxon and nature, the Exxon Valdez cleanup appears to have been a screaming success.

The impact of an oil spill and the time it takes nature to recover doesn’t seem to be much different from the impact of a large forest fire.

Environmentalists viewing the Deepwater Horizon blow out have been gleefully answering “drill baby drill” with “spill baby spill.” Fair enough. But when it comes it spilling, there are two options: oil and blood. If you’re not willing to spill blood for oil, you better be prepared to drill for it.

Boulder meets 2010 census goal The mail-back phase of the 2010 Census is complete, and 75 percent of Boulder residents participated, which is the same rate achieved in 2000.

Census workers are now visiting, in person, every residence that did not mail back a completed census form.

Census workers will also re-visit every address that was previously classified as vacant or as non-existent to ensure that the classification was correct and to take the count in person if the address was misclassified.

Workers will begin in the University Hill and Goss Grove neighborhoods to try to count college students before they leave for the summer. Census workers are identifiable by a census badge, and many will also be carrying a census bag.

Census workers will visit a household up to six times to attempt to reach the residents and complete the questionnaire. If no one is home, the census worker will leave a notice about how to complete the interview or schedule a visit. Follow-up operations begin May 1 and will continue through July.

Longmont Humane Society hosts fundraiser Ella’s Walk, a fundraiser for the Longmont Humane Society, will be held on May 15 at the Boulder County Fairgrounds picnic area.

The walk, in memory of Meredith Hope Emerson, is named for Meredith’s dog, Ella. It is a tribute to Emerson’s life and a celebration of her passion for animals and her willingness to help others in need. Emerson was abducted and killed in 2008 while hiking in Georgia with her dog, Ella, which she adopted from a rescue organization. Ella will once again join the festivities and be introduced on stage prior to the walk.

Registration for the walk begins at 8:30 a.m. The three-mile walk along the St.Vrain Greenway begins at 9:30 a.m. After the walk, activities on “Mutt Main Street” include the “Adoptable Pet Parade;” agility and flyball demonstrations; Angelyne, the amazing deaf cattle dog, showing off her skills; canine massage; and a microchip clinic. Live music throughout the festival will be provided by Mojomama.

The Longmont Humane Society has set a goal of raising $45,000 at the walk. All proceeds go to the care and shelter of homeless animals at Longmont Humane Society.

Paradigm Pilot garners praise Boulder County’s Paradigm Pilot project has received a second place award in the Denver Regional Council of Government’s (DRCOG) 2010 Local Government Awards Program for Collaboration.

The “Paradigm Pilot Project: A Blueprint for Change,” a Boulder County Housing & Human Services Housing Development project, follows the design, development and testing of new sustainable building technologies in two affordable housing units of the Boulder County Housing Authority (BCHA). The duplex and single-family affordable housing units are located at 900 Avalon in Lafayette.

Paradigm Pilot involved the construction of energy-efficient affordable housing units partly funded by Temporary Aid to Needy Families (TANF) funds. The renewable energy features include passive solar, systemsbuilt (modular) construction, performance building design and the use of photovoltaic and geothermal loops. The Paradigm Pilot project’s development timeline was less than a year — from comprehensive plan amendment in November 2008 to certificate of occupancy in September 2009.

Naropa gets environmental award The Princeton Review has named Naropa University as one of the most environmentally responsible colleges in the country. The education services company selected Naropa for inclusion

in a resource it created for college applicants called “The Princeton Review’s Guide to 286 Green Colleges.” Naropa was recognized for its zero-waste program, particularly because at the 2007 graduation ceremony, 2,000 people produced just one small bag of trash. The university composts its waste from the Naropa Café as well as its bathroom paper towels, and students are given bus passes for local and regional travel.

Naropa also purchases 100 percent of its electricity from wind power.

The Princeton Review Guide also provides information on schools that have an important environmental studies curriculum. Naropa offers a B.A. in environmental studies and minors in subjects ranging from horticulture to sacred ecology, as well as graduate programs in environmental studies. Local groups team up for festival Pekoe Sip House has teamed up with Sambazon, Conscious Coffees, Ideal Market, Radda, Cronin Jewelers, Urban Pearl, Easton Brazilian Jujitsu, Breeze Bars, Izze, Celementine Studio and Pharmaca to host a benefit festival on Saturday, May 22.

The festival, which runs from 1 to 5 p.m. at the Ideal Broadway Shops on Alpine and Broadway, will raise awareness and funds for the Global Education Fund. Food, beverages and giveaways will be available, as well as live music by Samba Dende and Ginga, face painting, children’s book reading, arts and crafts and a raffle. Proceeds will be donated to the Global Education Fund.

County wins well workplace award The Wellness Councils of America (WELCOA) has awarded Boulder County a ‘Gold’ Well Workplace Award for its efforts in maximizing employee health and wellbeing.

WELCOA recognizes organizations that make a commitment to employee health and well-being, and Boulder County met seven of the organization’s benchmarks and underwent a review to examine workplace wellness efforts.

It ranked gold on a scale of bronze to platinum, and an award ceremony was held on April 27 at the Boulder County Courthouse.

Kinetics workshops on deck In preparation for the Aug. 28 Colorado Kinetics Sculpture Race at Union Reservoir in Longmont, two “Build Your Own Kinetic Sculpture” workshops have been planned, for May 22 and June 12.

The workshops will be held from 9 a.m. to noon at the Longmont Parks and Recreation Department, at 7 S. Sunset St. in Longmont.

Women’s cycling event returns Venus de Miles, Colorado’s only allwomen’s cycling event, will return to Boulder County for its third annual event on Sunday, Aug. 29.

Organizers expect up to 3,000 participants in this year’s event, which is open to women of all ages and ability levels. Participants may choose from one of three course options (33, 51 or 67 miles), all of which wind through the Boulder foothills and are supported with aid stations, mechanical assistance and entertainment-fueled rest stops. After the ride, a festival will be held at Prospect Park in Longmont, featuring gourmet food, live music by Elephant Revival, cocktails, beer from Lefthand Brewery and a “wellness station” offering massage, mini-facials and other treatments.

Venus de Miles is organized by and benefits Greenhouse Scholars, a Boulder nonprofit that provides mentoring and scholarship support to highperforming, under-resourced students.

Reptile expo comes to Longmont The Colorado Reptile Humane Society’s (CoRHS) annual open house “The Reptile Experience!” will be held on Saturday and Sunday, June 26 and 27, from noon to 5 p.m.

Targeting dispensaries Pot rules spark fierce debate

ocal and state officials are crafting new legislation aimed at the medical marijuana industry, and regulation efforts are close to passing at both levels.

The Boulder City Council approved a set of regulations including requiring a $5,000 up-front licensing fee with a $2,000 renewal fee, barring dispensaries from opening within 500 feet of a school, making owners go through a background check and requiring the purchase of renewable energy credits if they are growing marijuana on-site.

Though council members approved the measure, they plan to discuss the rules again at a later date.

Two bills are finishing the bloody march through the state legislature and are close to becoming law. One bill, SB 109, would regulate the doctors who recommend marijuana to patients and has breezed through the legislature virtually unopposed. The bill has passed the House and the Senate, and at press time, the two chambers were hashing out the differences in committee.

The second bill, HB 1284, would give the state power to regulate medical marijuana dispensaries. Lawmakers from both sides of the aisle have thrown a dizzying array of amendments towards the bill at all stops, swelling the bill from a husky 45 pages to an obese 72. As of press time, the bill was scheduled for a second reading on the Senate floor. The bill would create a state agency to license and oversee dispensaries and require that all dispensaries purchase a license to do business in the state. It would also ban anyone under the age of 21 from working at a dispensary and establish a list of requirements for anyone wishing to own one — new owners, for example, would have to have Colorado residency for two years as well as pass a federal and state background check.

“I didn’t really see the rush,” Levy says. “The local governments were dealing with the issue themselves. ... I didn’t think we needed this elaborate twotiered system.”

Sen. Chris Romer, D-Denver, who sponsors both bills, said that he expects HB 1284 to force about 50 percent of dispensaries to close. The real number, 12 May 6, 2010

says Laura Criho of the Cannabis Therapy Institute, is higher.

“Once we actually saw the bill and read it, we realized it would be targeting more like 80 percent of the dispensaries of the state. And once Romer mentioned the licensing fees, we upped that number to 95 percent,” she says.

Romer did not respond to repeated attempts to contact him about the bill over the past two weeks.

Another part of the bill would require dispensaries to grow 70 percent of their marijuana, either on site or in a separate building. Amendment 20 allows one patient or his or her caregiver to grow six plants at a time and possess up to two ounces of usable marijuana. Most dispensary owners are caregivers for dozens or even hundreds of patients, and if they were forced to grow enough marijuana to supply 70 percent of their patients, the number of plants could grow quite high. Kathleen Chippi, owner of Nederland dispensary One Brown Mouse, says she serves 1,500 patients and thinks that requirement will expose her to federal raids, which tend to target grows with more than 100 plants.

“They’re forcing us to have enough plants to supply 1,500 patients,” Chippi says. “I’m frightened of the fact that I’m going to be forced to grow. I personally have less than 99 plants. I’m not going to go above 99 plants, because the federal government is going to come bust me. ... They’re setting us all up to be out of federal compliance.”

Included in HB 1284 is a licensing fee for opening a dispensary. The proposed cost has fluctuated but has settled on $35,000 for a new dispensary. Add that to the proposed $5,000 fee required by the city, and many dispensaries fear they might be priced out of the industry.

Pierre Werner, owner of the DrReefer.com dispensary on the Hill, says the impending bill is forcing him to put his business up for sale. He has a felony drug conviction on his record, and he would not be able to pass the staterequired background check. Plus, he wouldn’t have the cash to pay both the state and the city fees.

“It’s their fees that are outrageous that bother me,” Werner says. “It’s going to put my employees out of a job.”

Police Blotter Cops crash campout At approximately 5:45 p.m. on April 28, deputies from the Boulder County Sheriff ’s Office received a call that seniors from Boulder High School were planning to hold a campout in the mountains west of Boulder. Deputies responded to the area of Gordon Gulch, located on Highway 72 between Nederland and Ward, and found roughly 200 students camping in the area. The deputies remained on scene overnight, because of the number of students and inclement weather conditions.

According to the report, as deputies made their rounds, they encountered students with alcohol and made them pour it out. The rain and snow caused driving conditions to deteriorate and deputies had to tow vehicles that were blocking the road and access to the campground.

Later that evening, deputies conducted a foot patrol in the campground and were accompanied by EMTs and paramedics. Three students were transported to Boulder Community Hospital because of over-consumption of alcohol, and other students were transported to the Alcohol Recovery Center. One student was arrested on charges of third-degree assault and released to her parents.

On April 29, additional deputies were sent to the campground to assist students leaving the area, and a tow truck was called to assist with the 40 to 50 cars that were stuck.

On April 30, Boulder County Sheriff ’s Deputies identified the person allegedly responsible for purchasing four kegs of beer for the camp-out: Brandon Gouin, a 21-year-old Boulder resident and student at the University of Colorado. They charged him with providing alcohol to an underage person, a class one misdemeanor. Deputies were able to identify the suspect after contacting local liquor stores to determine who had purchased the brand and quantity of beer that was confiscated during the camp out.

Protesters arrested On Tuesday, April 27 at 12:55 p.m., approximately 15 deputies from the Boulder County Sheriff ’s Office and the Boulder Police

Department responded to a report of trespassers at the Xcel power plant, at 1800 63rd St. Roughly 20 people gathered outside the power plant to protest the Xcel plant’s use of coal.

Five protesters managed to climb over the fence and onto the property belonging to Xcel. The five protesters were each arrested on one count of second-degree trespassing, a class three misdemeanor, and they were transported to the Boulder County Jail.

Be wary of burglars Early on May 3, the Erie Police Department received reports of three residences that were burglarized in the Arapahoe Ridge area. The burglaries occurred at three separate locations: Stevens Circle, Southard Street and Wharton Court. In all three instances, the suspect or suspects entered the house through an outside garage door. No suspects have been identified. Erie police are asking residents to be aware of neighborhood activity and report any suspicious activity they see.

Anyone with information regarding these or any other crimes are asked to contact the police department.

Failed flee Shortly after 2 a.m. on April 25, two deputies from the Boulder County Sheriff ’s Office observed a vehicle driving recklessly in the area of McCaslin Boulevard and Coalton Road in Superior. The deputies caught up to the vehicle near Flatiron Drive and Interlocken Loop in Broomfield County and attempted to perform a traffic stop.

According to reports, the suspect failed to stop, and the deputies pursued the vehicle at a safe distance in the westbound lanes until the suspect crashed the vehicle a short distance later. The suspect, a 51-yearold woman, was not injured, but reportedly would not obey the deputies’ commands, so they deployed a police dog. The dog seized the suspect on her left arm, but because she was wearing a heavy coat she did not sustain any injuries, according to the police report. The suspect was charged with first-degree assault, vehicular eluding, resisting arrest, obstructing a peace officer and other charges.

The

little sign on the front door tells me I’m in the right place. It warns me that if I knock, I should be prepared for the fact that the people who live here are naturalists who more often than not go nude inside their home.

It’s their naturalist lifestyle — or more specifically, some people’s reaction to it — that brings me here.

Bob and Catharine Pierce are in the midst of a media maelstrom because Catharine likes to garden and take out the trash while topless. The two weren’t enthusiastic about talking with me. They feel the media have been unfair to them from the first articles that ran in local papers to farright pundit Bill O’Reilly’s calling Catharine “a pinhead” on television last month. sphere, they’re understandably leery of reporters.

“Are you willing to take off your shirt and sit outside with me?”

Catharine asked when I approached her about the possibility of an interview more than a week ago.

She was asking me to put my money where my mouth was. I had just finished telling her about the editorials I’d written in favor of women’s right to go topless. But sitting outside wearing little more than a pad of

paper and a pencil was not what I had in mind.

“I won’t sit outside, but I will do the interview topless in your living room,” I offered.

And that’s what I’m prepared to do as I stand on the Pierces’ front porch on a chilly spring day.

Bob Pierce opens the door. He’s wearing clothes. He invites me inside.

When Catharine appears, she’s also fully dressed—white slacks, white sweater, pretty crystal earrings. And it immediately becomes clear that demanding I go topless for the interview was just a test.

We settle down in the living room, which, apart from the ceramic mug with a penis for a handle, is no different from the average living room. I say this as someone who has done a lot of interviews in a lot of living rooms over the years, from that of poor CU students with cinderblock furniture to that of a well-known local attorney who unabashedly keeps hardcore BDSM porn on his coffee table.

I ask Catharine what she thinks about the media’s coverage of her topless gardening.

“Most of it is untrue,” she says.

Some papers, including one in Singapore, gave her credit for the fact that female nipples weren’t banned when City Council recently passed the city’s new nudity ordinance.

“I don’t take the credit. I give credit to City Council for having the courage to have equality between men and women when it comes to baring their breasts,” she says.

Catharine has lived in Boulder since 1976 and remembers a time when bare-breasted women could occasionally be seen walking down Pearl Street, when nude sunbathers were common at Coot Lake and Gross Reservoir, and when women hiked while topless.

Born in 1957 and raised in Ohio in a Catholic household, Catharine was introduced to the naturalist lifestyle when she met Bob. It’s a lifestyle she embraced, gardening topless for years without complaints while living in Boulder Meadows.

She and her husband, both disabled, moved to public housing operated by Boulder Housing Authority (BHA) in 2001. At the time, Boulder Weekly

Catharine was recovering from surgery that fused together vertebrae in her cervical spine and was too incapacitated to garden. But her husband immediately began working in the yard wearing only thong bathing trunks.

And no one complained.

Sometimes he worked out nude in the back of their home within view of the window, and although they periodically caught women watching him, still no one complained.

Then three summers ago, Catharine felt strong enough to get back to gardening. And that meant gardening without a top on.

“At first I was reluctant to do it,” she says. “I started out being very discrete about it.”

That meant gardening in the middle of the day when kids were at school and people were at work.

“Then it developed to the point where, hey, this is natural,” she says.

At that point, she quit worrying about being seen and just went about her business, gardening and taking out the trash or the recycling wearing as little as a thong bikini bottom.

But Catharine’s neighbors, who’d been silent for years about Bob’s gardening in a thong — and his working out in front of a window in the nude — called the police to complain.

“Bob was doing it for a long time before I was doing it,” she says. “But when I do it, it’s like, ‘Wait a minute.’”

What’s the difference?

Catharine takes me outside and shows me the small space she plants with flowers, tomatoes and cantaloupes each year. And it is small, indeed. Right now, the space is home mostly to small weeds, just sprouting.

Tiny tomato plants, sheltered by cellophane, sit in pots on her front porch, waiting for warmer days.

“I’ve always enjoyed getting out in the yard and weeding and gardening and beautifying the earth that God gave us,” she says.

She is happy to share the small amount of vegetables and fruit that she grows each year with neighbors or homeless passersby. It is her way of saying thank you and giving back to the community, she says.

She shows me where she typically works when she gardens — a retaining wall that runs along the sidewalk and around the corner to the front of her house. Her perch places her across the street from a park and parking lot.

Diagonally to the east within line of sight is a school. It is, in short, a very visible spot.

But that’s not the issue, Catharine says.

“What’s the difference between a man’s chest and a woman’s chest?” she asks. “A woman’s sticks out more in some cases. I’ve seen men with big beer guts and breasts as large as women’s walking around with their shirts off.”

In fact, the public park across the street, which some people cite as a reason why Catharine should not be permitted to go topless, is a place where topless men can often be seen on sunny days. And no one is worried about how their bare chests will impact the neighborhood. It is, she says, “very unfair.”

“If a guy can go out here without a shirt while kids are out playing, then I should be able to, too,” she says. “It’s men who’ve made women’s breasts into sexual organs because they obsess over them.”

More has been made of Catharine’s proximity to the school.

But she says that seeing breasts cannot possibly hurt a child — or anyone else for that matter.

“I don’t think that there’s anyone who is being hurt by it,” she says. “In fact, I believe you should be honest with your children [and tell them], ‘It’s natural. It’s beautiful. And have respect for women.’”

She doesn’t necessarily believe that people are sincerely concerned about her exposed breasts because children might see her.

“If you don’t like what I’m doing, please don’t use your children as an excuse,” she says. “Don’t teach your children that women have to be entirely covered, but teach them respect. If more people had respect and tolerance all over the country, we’d have a better society.”

She finds it strange that religion and morality are used as justification to restrict women’s ability to go topless.

“The churches teach people that when the body is uncovered it is sinful,” she says. “It’s like putting down God for creating them in his image.”

And don’t tell her that going barebreasted in her 50s is somehow offensive due to her age or appearance.

“I may not have the most perfect body in the world, but I thank the good Lord that I have the body that I have today,” she says. “Young girls may see my body and say, ‘Oh, yuck,’ but one day they’re going to be this way.

Instead of turning to a plastic surgeon, they should be proud of what they have.”

What’s wrong and unhealthy, she says, is the way breasts are exploited in advertising, with images of surgically altered cleavage used to sell everything

from cars to music. She worries that this cultural obsession with big boobs will lead young women to have surgery, risking their health for a bigger cup size.

“To me that is just taking away from how your body was created just so you can attract a man,” she says. “A man should be attracted to you for who you are.”

Use the right — or lose it “I’m not out to embarrass other people, but this is part of our beliefs and our lifestyle,” Catharine says.

The reaction of some passersby and neighbors indicate that not everyone agrees with that lifestyle — or intends to tolerate it.

“A woman pulled up at the stop sign and yelled, ‘Put your clothes on!’”

Catharine says. “To me that was rude.

She could have pulled up next to me, and she and I could have had a oneon-one conversation.”

Children have made comments, too.

“Yeah, there’s been some comments from kids passing by, but that’s just kids being kids,” she says.

At other times, people have pulled up to the stop sign — and stayed there snapping photos.

But what galls her is the fact that those who object to what she’s doing won’t come over and talk with her about it, instead complaining to BHA or the police. They didn’t even speak at the City Council hearings, she says. “[BHA] policy says you should work things out with each other before going through mediation,” she says, showing me the manual.

In this case, complaints were made to BHA and the police, and they weren’t approached personally. If they would approach her politely and discuss their concerns, she might be willing to put on a shirt, she says.

Catharine and Bob believe their lifestyle has left them subject to harassment and even vandalism. Last summer, someone destroyed her tomato harvest, picking all the green tomatoes off the vines and leaving them in a bag on her porch. Someone also smashed some of Catharine’s cantaloupes, as well.

“To me it’s just mind-boggling,” she says.

Now that the new city ordinance has put the question of female breasts to rest for the foreseeable future — the ordinance requires the covering of genitalia only — Catharine would like to move on. But that doesn’t seem to be happening.

BHA, which has allowed her to garden for years, is now requiring that

all residents who wish to garden receive permission first. And although she asked for permission more than two weeks ago, she hasn’t heard back.

She believes the new policy is BHA’s way of trying to get her out of the garden and keep her indoors. (Boulder Weekly placed a call to BHA, which did not respond by press time.)

But it’s not just BHA, Catharine says.

These days it’s not uncommon to find a police squad car parked directly across from the house, its windshield pointed straight at the house, she says.

I suggest that they’re trying to catch speeders in a school zone. She shakes her head.

“I’ve never seen them ticket a speeder [on this street],” she says. “It’s like they’re sitting there waiting for me to come out. It’s just plain harassment.”

In recent letters to the editor, some of her neighbors have accused her and her husband of being exhibitionists, rather than naturalists. It’s an allegation that she dismisses outright.

“If I’m taking out the garbage and I’m wearing only a thong and it needs to go out, I take it out,” she says. “I don’t look out my back window to see who’s outside so that I can go out topless. I just take the garbage out.

“It’s just like with the recycling. If there happen to be people out there, oh, well. It’s not like they haven’t seen it all before. It’s not like I’m standing up and shaking my jugs all over the place, saying, ‘Hey, look at me because I’m topless.’”

But she isn’t about to quit going topless any time soon.

For Catharine it comes down to the issue of equality — and protecting one’s rights.

“I think anywhere a man can go topless, a woman should be able to also. If you don’t use the law to your advantage, then you’re going to lose that right that the law gives you,” she says. “To have people telling you [you can’t go topless] because they don’t know what the law is — they’re just ignorant. But ignorance of the law is no excuse. If you’re arrested for something, you can’t plead that you didn’t know it was illegal. You should be aware of your rights.”

Catharine now carries the city ordinance so that she can prove that what she’s doing is legal.

In the meantime, she’s astonished when she searches for her own name on Google — and finds 89,400 hits.

“I’m bewildered to say the least.

Singapore?” she says, shaking her head. “I never in my life expected for it to go this far.”

Shackling bill moves ahead

Senate approves SB 193

S

enate Bill 193, the legislation prompted by a Boulder Weekly investigation into the practice of shackling pregnant inmates while they are in labor, cleared the Colorado Senate this week.

But on May 4, the bill sparked a debate on the Senate floor that had both sides of the abortion issue squaring off over a proposed amendment to the bill.

That amendment, brought by Sen. Keith King, R-Colorado Springs, stressed that any regulations limiting the shackling of inmates in labor is not just about protecting the mother, but also the unborn baby.

King’s amendment, which failed, would have tacked a legislative declaration onto the bill containing language about how various types of restraints, from handcuffs to belly belts, can threaten the health and safety of both the mother and the unborn baby and called for the use of “best practices” in the treatment of pregnant women who are incarcerated.

But the language about protecting the baby prompted opposition among Democrats and pro-choice groups.

While both Republicans and Democrats praised the bill itself and urged their colleagues to vote in favor of it, they took turns at the podium arguing about King’s amendment.

King outlined the provisions of the amendment and said it had the support of Boulder Weekly Editor Pamela White, who penned the Feb. 18 Boulder Weekly article about the shackling of inmates in labor and spearheaded the effort to pass legislation regulating the practice. Citing an editorial endorsing the SB 193 in the Colorado Springs Gazette, King said that even White, “a self-professed feminist liberal, says she fully supports this declaration.”

The bill’s Senate sponsor, Evie Hudak, D-Westminster, countered that the amendment is unnecessary because it simply restates the arguments for the bill and doesn’t add anything new.

“If you agree with what he just said, you should simply support the bill,” she said.

Betty Boyd, D-Lakewood, joined Hudak in arguing against King’s addition.

King insisted that the language was not intended to ignite a political debate.

“This isn’t partisan,” he said. “This has nothing to do with abortion.”

including Sen. Josh Penry of Grand Junction, Kevin Lundberg of Berthoud and Dave Schultheis of Colorado Springs. They urged the Senate to at least acknowledge that the bill would also help protect unborn babies.

“It’s not an ostrich, it’s a baby being born here,” Schultheis said.

After the amendment was defeated, Scott Renfroe, R-Greeley, said the measure failed because pro-choice group NARAL and Planned Parenthood weighed in. “This has nothing to do with abortion; [the women] chose to have the baby,” he said. “But one side of the aisle is so blatantly blind that we can’t put that amendment on.”

Still, the two sides were unanimous when it came to supporting the bill itself.

It passed on a voice vote on second reading and unanimously on May 5 during third and final reading.

“I couldn’t believe some of the shackling going on,” said King, who voted in favor of the bill when the Senate Appropriations Committee approved it on April 30. “How many people are going to be fleeing during childbirth? They can’t go anywhere. They’re giving birth to a baby!”

King cited a case in Pennsylvania in which a prison guard temporarily left his post. The laboring mother’s life became endangered, so the doctor began using a hacksaw to cut through the chains because he didn’t have the key.

And Sen. Pat Steadman, D-Denver, pointed to the recent ruling in Nelson v.

Norris by the U.S. Court of Appeals for the Eighth Circuit, which called shackling an inmate in labor a violation of the 8th Amendment, which prohibits “cruel and unusual punishments.”

Steadman said that case arose because of an incident in Arkansas in which a woman gave birth with both legs shackled to the bedposts.

“I can’t tell you how outraged I was to hear about that,” he said. “It’s horrendous, barbaric and outdated for this to happen in a correctional facility.”

A fiscal note had been attached to the bill at the request of the Department of Corrections, which argued that additional guards would be necessary if laboring inmates are unshackled. But that fiscal note was removed by Senate Appropriations on April 30.

The legislation now moves on to the House.

Wood is commencement speaker John Wood, founder of the international nonprofit organization “Room to Read,” will give the commencement address during the University of Colorado at Boulder’s spring graduation ceremony on Friday, May 7, beginning at 8:30 a.m. at Folsom Field.

Wood is a 1986 graduate of CU’s Leeds School of Business. Over the past 10 years, his organization has established about 10,000 libraries across the developing world. “Room to Read” currently operates in nine countries — Bangladesh, Cambodia, India, Laos, Nepal, Sri Lanka, Vietnam, South Africa and Zambia.

Wood has appeared on The Oprah Winfrey Show, CNN and National Geographic Television to tell his story.

Stadium gates will open at 7 a.m. and guests are urged to be in their seats by 8:15 a.m. University officials recommend that people arrive as early as possible to avoid traffic delays.

During the ceremony, 5,825 degrees will be conferred. Degrees to be awarded include 4,530 bachelor’s degrees, 850 master’s degrees, 175 law degrees and 270 doctoral degrees.

Alumni Association gives awards The CU-Boulder Alumni Association has announced its annual awards, and the 21 recipients were honored at a May 5 ceremony.

The George Norlin Award, which honors outstanding alumni, was presented to Juli Steinhauer, Hank Brown, Richard Knowlton and Laurence Boxer.

The Robert L. Stearns Award, given in recognition of extraordinary contributions to the university, went to three faculty members — John Cumalat, Richard Noble and Robert Schulzinger — as well as one administrator, chief financial officer Ric Porreca.

The recipients of the Alumni Recognition Award are Woody Eaton, Leslie Bernstein Eaton, Joanne Arnold and Clancy Herbst Jr. Mary Allen Judd received the Leanne Skupa-Lee Award, while the Kalpana Chawla Outstanding Recent Graduate Award went to Nick Sowden.

Eight students received the Public Interest Internship Experience awards: Wynne Adams, Denise Justice, Bryant Mason, Heidi Meyer, Austin Rempel and Mercedes Ruiz.

Environmental Center donates PCs The University of Colorado at Boulder Environmental Center, with support from a number of campus departments and private sources, is expanding “Computers To Youth,” its initiative to protect the environment and benefit disadvantaged communities in Colorado.

It will now be an ongoing, yearround program, and its formal launch is set for Saturday, May 15, on the CU campus.

Computers To Youth provides middle and high school students from low-income communities around Colorado with upgraded computers and basic computing programs. Surplus computer are donated

by CU’s property services department, which test components and securely remove any data. The high school students then bundle these components into an upgraded computer and load the latest software to assist their academic achievement when they take their computer home.

On-site instruction and follow-up mentoring is provided by CU students from the state-wide MESA program (Mathematics Engineering Science Achievement).

Ten MESA high school students are recommended by MESA advisors (teachers) in schools throughout Colorado and work together with five engineering students on a Saturday.

The Environmental Center got funding from Dell for CU’s first computer round-up in 2005, when more than 50 working systems were collected.

A satisfied Tim Leary must be grinning somewhere in that great black-light room in the sky.

Scientists are once again experimenting with psilocybin, a hallucinogenic drug, to help induce profound spiritual understanding for people suffering anything from depression to obsessive-compulsive disorder to drug and alcohol addiction, according to a recent article in The New York Times.

When test subjects talk about their psychedelic experiences, it sounds like something out of a Leary pamphlet.

“All of a sudden, everything started evaporating,” a retired clinical psychologist seeking treatment for depression told the Times. “Imagine you fall out of a boat out in the open ocean, and you turn around, and the boat is gone. And then the water’s gone. And then you’re gone.”

Apparently this “existential medicine,” as one psychologist called it, is wired into the brain and could actually be an evolutionary advantage, helping ancient tribes bond with one another and encouraging “reciprocal generosity.”

So if you’re one of those New Age types who shy away from pharmaceutical treatments for depression, science has another option for you, and it’s the same as what cost you $15 an eight as a teenager.

Show me your papers Heard about that new Arizona law requiring immigrants to carry their “papers” on them at all times? It authorizes police to lock up people they suspect of being undocumented workers until they can check with the feds on their immigration status. Talk about open season on Hispanics.

In protest, the City of Boulder has banned all city-sponsored travel to Arizona. Perhaps more importantly, there is pressure on Major League Baseball Commissioner Bud Selig to pull the 2011 MLB All-Star Game out of Phoenix.

The Denver Public Schools banned all district-sponsored travel to Arizona, which proved to be quite the bait for our local anti-immigrant right-wing nuts.

Senate Minority Leader Josh Penry, R-Grand Junction, ripped into DPS Supt. Tom Boasberg. “Instead of imposing politically motivated travel bans, perhaps Mr. Boasberg ought to focus on improving a school system that fails far too many kids each and every day.”

And, of course, the man who is beginning to rival Tom Tancredo as our top resident Mexican-hater, Sen. Dave Schultheis, R-Colorado Springs, tore U.S. Rep. Jared Polis a new one for criticizing the new law.

Polis said, and rightly so, that Arizona is becoming a police state and that the law is reminiscent of the secondclass status of Jews in Germany before World War II. The news releases from both Republicans contained some innocuous boilerplate language about the new law just being some good ol’ common sense: “The Arizona law, which enjoys broad public support, requires police to check with federal authorities on a person’s immigration status if officers have already stopped that person for some legitimate reason and have a reasonable suspicion that the person might be in the U.S. illegally. The law makes clear that if the person produces a valid driver’s license or other state-issued identification — something nearly every American and legal resident possesses — they are presumed to be in the United States legally.”

Schultheis says: “Apparently in Congressman Polis’s fantasy world, asking someone for their driver’s license is the moral equivalent of state-sponsored genocide.”

THE PERSISTENCE OF MEMORY Inspired by Boulder’s past, Otis Taylor digs into his own

B

rant Turney drove his shovel into the soil on a property in west Boulder a couple of years ago, working a landscaping project for the property owner, when the business end of the blade hit something that wasn’t supposed to be there. Or, wasn’t supposed to be found.

What came out of the ground was a cache of about 80 hewn prehistoric stone tools, subsequently dated to about 14,000 years ago — evidence of the elusive and mysterious Clovis People, migratory prehistoric humans whose existence is a still-disputed milestone of the habitation of pre-Columbian North America.

Otis Taylor lives across the street from the property owner, and got to see some of them.

“Yeah, he’s a friend of mine. I looked at about 20 tools — these were skinning tools, they had DNA of camels and saber-tooth tigers. Pretty interesting,” Taylor says.

And as it turns out, by one of those weird confluences that has characterized his career, Taylor had an album project in the works, brushing off a little soil from some of his own relics.

“It all sort of happened at the same time. I just said ‘I should name this Clovis People,’ because I had been doing some older songs, like from Blue Eyed Monster, which will never be re-released. And a few new songs, and some from records people can still get,” Taylor says. see MEMORY Page 22

Titled Clovis People Vol. 3, (the listener gets to think about where Vol. 1 and Vol. 2 are) Taylor’s 10th CD hits the racks and cyber-shacks in a week or two.

Of the 12 songs on the CD, nine of them are essentially re-records of tunes that appeared on earlier CDs, a couple even extending back to Blue Eyed Monster, his first CD (now out of print) from 1995.

Interesting project, we thought, especially coming from a guy who, by his own admission, has dozens of songs in various states of completion drifting through his head. New material isn’t a problem for Taylor.

“I just wanted to do them a different way. Some are from ’95. ‘Coffee Woman,’ ‘Harry Turn the Music Up’ go back to ’95, on Blue Eyed Monster. If you try to get it, the last one sold for $50 on eBay. So, yeah, it’s hard to get. Maybe if you get with Andy at Albums On The Hill, he can find you one,” he says.

“Rain So Hard,” a raw and tribal blues testament from White African (2001), reincarnates here as more prayerful, more lamenting than the original, softened by Ron Miles’ gentle background riffing, a tale now as much about regret as the original was about guilt and pain. “It’s Done Happened Again,” another tale of heartbreak, echoes here somewhat tenser, more brittle and men-

acing than the hushed mystery that first appeared on 2004’s Double V. And “Hands On Your Stomach,” which first appeared crazed and dangerous in 2002 on Respect The Dead, hanging onto the signature riff for dear life, is now an inthe-pocket rock tune, the riff now carrying Taylor’s reverb-distanced voice with confidence, the ghost visitation now more allegory and less viscera.

And throughout, Taylor’s trademark “drone blues” feels somewhat less raw and confrontational. His treatments here are more considered, generally more arranged, and poised as if they were real songs and not just the spit of transitory snarl. “[The record company] thinks it’s one of my best records, they’re very excited about it. The guy who did the cover — he’s shot all of my album covers — he said I’ll never be able to do a record that good again. Kind of funny,” he says. “I don’t know, people say it’s more user-friendly. More accessible for people, y’know? Just had to do something different, and if it works for everybody, it’s good. It’s not like [2009’s] Pentatonic Wars and Love Songs. It doesn’t sound like that at all. I’ve started a new album already, but I’m having sort of a conceptual block … not a writer’s block, but a conceptual block. How I want to put it together.”

The CD also has some bits from

Taylor’s un-released past as well, such as “Little Willie,” a sketchy and affecting tale of a school shooting. Taylor says this one had challenged him for years.

“I had written it for [daughter and frequent guest singer] Cassie. I have a version of Cassie singing that song when she was about 15 or 16. I just did it a different way. I could never get it right the way I wanted it,” Taylor says. “Every time I wanted to do it, it just never worked out right. But it’s a completely different version than the way Cassie did it, y’know? She did it sort of like a pop song, a little girl singing it, like a really heavy pop song.

“It literally took me 10 years to record that song. But the problem was when I wrote that song, it was about eight months before Columbine. And when Columbine happened, I didn’t want that song to come out. It just seemed too … wrong. Like I wrote a song about Katrina, but you didn’t know it was about Katrina. It was for Definition of a Circle, it was called ‘They Wore Blue;’ I made it like seven minutes long so no one would think it was commercial. I’m very touchy about that stuff.”

And there’s “Lee and Arnez,” a remembrance of some neighbors of his parents, and their boxer.

“Yeah, people seem to like ‘Lee and

Arnez.’ I’m surprised, y’know? It’s kind of different. It’s sort of a sad story. My parents had these friends I really liked.

When my mother passed away, she had a picture of them, but I didn’t get it. I don’t know what happened to it. The dog was the first dog I knew. I was three years old or something. I really liked the dog. Y’know how your parents have friends that you like better than your parents sometimes? I loved those people.

“One time, I went to see them in the ’80s, and they gave me a picture of my parents kissing. And I lost it. I was really bummed out about that too. It was taken on the south side of Chicago,” he says.

So it’s all about memory, and past, and trying to recreate the past the way we wish it could be, and letting go of the things that we can’t get back. It’s a good thing to have a past, even if sometimes it’s just beyond the end of the shovel.

“I don’t have a choice. If I could be young again … You know how old people always want to be young again,” he says.

And about the Clovis People, Boulder’s first transients — we couldn’t help thinking about what someone told us years ago, that the thing they didn’t like about Boulder was that it had a past, but it had no memory.

“Well,” says Taylor, not even catching a breath, “it has one now.”

Making strides Greg Laswell takes a bow

I

t is nice to know that Greg Laswell has a sense of humor. When asked how his latest album, Take a Bow, compares to his previous albums, he deadpans, “I use different song titles and lyrics and melodies.”

Moments like this are proof that Laswell is in a good place, both personally and musically. For someone who has made a name for himself in the indie music scene with his prowess as a songwriter and his ability to create cathartic experiences by writing about sadness and heartbreak, it is nice to see that he is anything but a rain cloud these days.

“My first two records were written and recorded while I was still in the middle of heartache,” he says. “This record was written and recorded as I was coming out of the woods, so to speak. It allowed me to touch some of the same subject matter as my first two records, but from a more objective and even sarcastic side.”

The sarcasm is evident on the album’s first single, “Take Everything,” an acoustic pop gem that has Laswell almost gleefully telling a former lover to just take everything from him because he swears he is OK with it. And while the video for this single is not sarcastic in and of itself, it allows him to present the song’s content in an unexpected way. In the video — which was filmed entirely in reverse — as Laswell walks through streets, buildings and set pieces, everything that has been destroyed around him is recreated, and everything that was removed from his person is given back to him.

“The chorus says, ‘Go on and take everything from me.’ We thought it would be cool to show the opposite of that,” he says.

But while Take a Bow does contain a somewhat lighter tone than his previous releases, there is still a fair amount of weight and gravity, too. One such track is the sweeping, epic drama “Around the Bend,” which focuses on one of life’s less-pleasant subjects: breaking up.

“[It] is about missing someone that doesn’t deserve to be missed. Some relationships just linger on you like cigarette smoke on your clothes, and you just have to put in your time and wait for the smell to dissipate. It’s also about that little tiny part of you that keeps it going longer than it should — like breaking up with the break-up.”

On this record, Laswell demonstrates that he is clearly not afraid of diving into all aspects of life, be it the incredible ups, catastrophic downs or sticky inbetweens that we often wish we could skip over. The

authenticity of his lyrics comes as a result of having such a deep connection with whatever he writes about.

“Every time I release something, there is part of me asking the question, ‘You too?’ If the answer is ‘Yes,’ then I have succeeded in what I set out to do.”

But Laswell is serious when he says he is in a better place these days. Tracks like the winning jaunt “Off I Go” — which has Laswell stepping into an uncertain future with calm fearlessness — are autobiographical in a way. The song speaks very simply of the fact that wherever we go is where we land, and Laswell took a similar approach by choosing to record Take a Bow in a remote cabin in Arizona.

“Some friends of mine own a cabin seven miles south of Flagstaff in a little town called Mountainaire. I stayed there for one of my days off during a tour last year and fell in love with it.

I remember getting up to get something out of the kitchen and on my way back saying out loud to myself, ‘Wouldn’t it be cool if I could move my studio and record my next record here?’ Six weeks later I was doing just that. I took my dog and essentially moved there for almost five months.”

On this album and in person, Laswell shows the complexity of his thoughts, emotions and experiences. From one song to the next he is angry, happy, sarcastic or serious, and when asked why he makes music, he says it is a way for him to process life and face things. But he preceded this comment with a much different response.

“I have to. Just kidding. What a stupid answer that is. If anyone ever answers that question with an ‘I don’t know, I just have to, you know?’ I want to say, ‘No, I don’t know. But by all means, come down here and join us on Earth.’”

An album reborn

For second CD, Mute Math had to restart from scratch

s Mute Math began touring in support of its latest CD, Armistice, the band faced a familiar challenge — how to rework the new songs so the four-piece band can play them live.

“Some songs are more challenging than others,” singer/guitarist Paul Meany says in a recent phone interview. “True to a Mute Math record, we definitely did not consider how we were going to be doing this live as we were recording it,” he says. But it paid off.

“When I listen to the record, I do love it and I’m glad we took a lot of the chances that we did,” he says. Chances are, any problems Mute Math went through in working out how to play the songs from Armistice live will pale in comparison to the struggles the band faced in trying to make the new CD. While on tour behind its 2006 self-titled fulllength debut CD, Meany and his bandmates were writing songs and, in fact, arrived for initial recording sessions in New Orleans fully expecting that batch of 16 songs to make the new CD. But when the songs floundered in the studio in spring 2008, Mute Math hit a tipping point that no group or artist wants to reach — the realization that things weren’t working, and the entire project was in serious jeopardy.

“When you put so much time, money, effort, energy into something and then all of a sudden you realize this wasn’t meant to be, and [face] the whole idea of starting over or having to shelve it, yeah, that causes tension,” Meany says. “And when you try to find what exactly is the solution to that, it doesn’t always go over well. But that’s where we were. We thought we were recording our record, but we knew we weren’t really happy with it. We weren’t sure why. Everyone had different ideas of how to get happy with it, but no one could agree.”

“Everything he heard, he says, ‘No, I just think you guys should start over and come up with music that you guys can quickly rally around,’ which was a new idea for us,” Meany says. “But when he says that, it was the kind of thing where you knew he was saying something right, but we immediately [resisted]. You begin to weigh the costs of that decision, weigh the fact that there goes deadlines, there goes whatever.”

When the band members, without a word, chose to go back inside the New Orleans home studio, they essentially accepted Herrin’s idea of starting over. And it wasn’t long before Mute Math started seeing signs that the group was beginning to rediscover the magic.

“We sat down and just started playing music and forgot about the pressure, the pressure of labels and management and budgets and all that distracting stuff,” Meany says. “We got into just why we got into it in the first place, just living for that moment when something comes alive in a room between four guys. That was it, and it started happening.

And ‘Spotlight’ was the first song that dropped out of the sky, and up to that point, it was the best thing that we had recorded. And that wound up kind of being the gateway song. It opened up the floodgates to the rest of the music that unfolded for the record.”

Having been on the road since fall, Mute Math has not only been playing new songs in its concerts, it continues to evolve its material live, which Meany says is a key part of the band’s live experience.

“We’ll definitely be taking some liberties,” he says.

“I love that. The bands that I’ve admired over the years, that’s what I come to expect when I go to a show. I’m not really that excited about the record getting recreated anyway. It’s like, take me to some new places. Let these songs go somewhere. Anyway, we’ll be doing that. We don’t have a choice, really.”

Without saying anything to each other, the band members went back into the house, picked up their instruments and started playing.

Shortly before the day of that argument, Meany says, the group had already talked to a few producers trying to find the magic in the songs the band had written on the road.

Conan vs. Leno

hile former Tonight Show host Conan O’Brien is moving on with his career by embracing Twitter and headlining a hit comedy tour that visits Boulder on Sunday, David Letterman isn’t finished talking about O’Brien’s well-publicized feud with Jay Leno and NBC. “I’ve known Jay since 1975, and when we were first hanging around, everybody loved Jay,” Letterman told told Dr. Phil when they discussed the Jay Leno/Conan O’Brien controversy that captivated and entertained America a few months ago.

“He’s so funny, so engaging, so compelling … but then there’s also this other side of him where he’s just a complete boob. He can’t help himself.”

Those are fairly strong words, but nothing compared to the nightly whuppin’ Letterman put on Leno earlier this year when the public discovered that Leno, the 60-year-old yawn-inducing host of The Tonight Show, demanded that heralded position back after spending less than a year in retirement (aka the 10 p.m. Jay Leno Show). Since his childhood, O’Brien dreamed of being the next in a long line of respected and hilarious Tonight Show hosts dating back to Steve Allen, Jack Paar and Johnny Carson. He signed a deal in 2004 to replace Leno in 2009 after Leno’s 17-year stint on the Tonight Show and O’Brien handling Late Night afterwards. O’Brien had his chance. Before he knew it, that chance was gone.

Substituting Leno’s bland, middle-of-the-road monologues, gutless interviews and edgeless house band with racy and zany skits, cutting remarks on current events, an impressive jazz group and a masturbating bear, the antonymous O’Brien attracted a younger, hipper and arguably sharper Tonight Show audience when he moved from the 12:30 a.m. to 1:30 a.m. spot to the

11:30 p.m. to 12:30 a.m. position in June of 2009.

In early January, after just seven months of hosting the Tonight Show, O’Brien was suddenly given two options by NBC, with no notice: Either give Leno his own show from 11:35 to 12:00 and go on just after midnight, or leave the network. In response, O’Brien released a written statement revealing his position.

“The Tonight Show at 12:05 simply isn’t the Tonight Show,” he said. “I cannot express in words how much I enjoy hosting this program and what an enormous personal disappointment it is for me to consider losing it … but I cannot participate in what I honestly believe is its destruction.”

Although it was reported that NBC paid O’Brien $45 million to settle his contract, basically paying him not to appear on television for a while, the behavior of both Leno and NBC was despicable. Support from other late-night heavies like Letterman, Jimmy Kimmel and Craig Ferguson appeared immediately.

the controversy went public, telling his audience, “Hello, my name is Jay Leno, and let it hereby be known that I’m taking over all the shows in late night — beginning with this one!” Kimmel also joked that it was great to be on ABC, also known as “Always Bump Conan.”

Essentially, Leno walked away from The Tonight Show in 2009 after almost 20 years at the helm and voluntarily handed the show over to a younger successor who made his way through the trenches of later-night talk show hosting. In 2004, when he announced his impending retirement, Leno called The Tonight Show a “dynasty,” saying, “You hold it and hand it off to the next person. Conan, it’s yours! See you in five years, buddy!” Then Leno took the show back after half a year, ending both O’Brien’s dream and Leno’s respectability.

But now, the 47-year-old O’Brien is barnstorming across the country with his “Legally Prohibited From Being Funny On Television” tour, featuring performances by O’Brien, his usual house band (minus its leader Max Weinberg), young comedians like Reggie Watts, and loads of surprise guests, including a certain self-servicing bear. O’Brien joined Twitter to promote the tour and now has almost two million followers on that site and Facebook combined, and his teamcoco. com blog is a hit.

O’Brien recently inked a deal with TBS to host a show on the cable network beginning in November, but reveling in his refreshing new experience as a touring performer is good enough for the poofyhaired Harvard graduate for the time being.

“No matter what I do, tonight your asses are mine,” O’Brien told a capacity crowd at San Francisco’s 3,000-capacity Masonic Center two weeks ago. “You can’t change the channel.”

Amendment 62 assaults our sex lives

A

nthropology demonstrates that human beings have undergone extensive lifestyle transitions, from hunting and gathering to agriculture and farming to agri-business and Wall Street shenanigans. This social evolution has led to the emergence of law and religion. Law and religion now serve big societies by providing order, values and ethical standards by which to live. At least that’s the idea.

Law and religion also get highly aroused by being voyeurs into our sex lives. They sit on the edges of our beds with binoculars, peering into everything we do and how we construct our sexual identities. Then, they put on paper everything we are not allowed to do because it will lead to the end of society. Utter and total chaos — everyone just take the high road to hell.

I exaggerate, somewhat. But law and religion would do well to take their dirty little hands out of our sex lives. Where is the crime in someone sharing sexual pleasure with another person of the same gender? Why should a couple be shamed for having sex before marriage, to test-run their sexual compatibility?

Legally, the cellular life and growth of cancer in our body is not punishable, but when it’s a zygote, it’s potentially criminal. Selling guns in Texas is acceptable, but selling vibrators can get you jail time.

We permit capital punishment, but outlaw oral sex in 19 U.S. states.

The most recent assault on our sex lives comes in the form of proposed Amendment 62. Amendment 62 is a repeat of the “personhood” measure of 2008 (Amendment 48) whereby a “person” with full legal rights is defined from the moment of fertilization. Fertilization is the successful unification of sperm and egg. Preventing fertilization through birth control or wasting eggs that could fertilized via in-vitro would be considered murder. Abortion would also be considered murder — even in cases of rape, incest and to save the life of the woman.

Our legal system charges murder very seriously. This is not like being slapped with a fine for stealing a Snickers bar from King Soopers. Luckily, the previous effort to define a person in the Colorado Constitution lost in every county of the state. Seventy-three percent of voters — 1.7 million people from nearly every 40 May 6, 2010

demographic group — rejected it.

In a press release last week, Rev. Phil Campbell, director of ministry studies at the Iliff School of Theology, stated that the government intrusion of this amendment would threaten religious freedom in Colorado. “(It can) take away a woman’s right to make decisions about her own health care with her doctor, her family, and her God,” he said.

Leslie Durgin, senior vice president of Planned Parenthood of the Rocky Mountains, declared, “Amendment 62 is bad policy, bad law and bad medicine. It was a bad idea in 2008, and it is still a bad idea now. Amendment 62 would insert the government into the personal, private health care decisions that women and their families make every single day.”

Unfortunately, proposed Amendment 62 is not the only strike our sex lives are currently enduring. Another recent attack on our sexuality included a Boulder County pre-schooler being booted out of the Sacred Heart of Jesus Catholic school because the parents were lesbians.

Sex therapist Marty Klein of, author of America’s War on Sex, claims that many legal and religious systems are waging war against sex. “Those who are trying to ‘clean up’ America say they’re fighting for a number of critical reasons: the family, marriage, morals, education, community safety. … But this isn’t really true. It’s a war against sex: sexual expression, sexual exploration, sexual arrangements, sexual privacy, sexual choice, sexual entertainment, sexual health, sexual imagination, sexual pleasure.”

At the end of the day, who we have consensual sex with is our personal business. How we express our gender, our sexual orientation and our sexual activities is our personal business. What grows in our body is our personal business. What we choose to do with our bodies, inside and out, is our personal business.

Don’t let the social system shrink your sexual voice. Don’t let Amendment 62 seize your sexual choice. Our sexuality is no one’s business but our own.

Mason Reed falls prey to his own pretension

T

he most on-target aspect of hippie-blues rocker Mason Reed’s latest EP, You Can’t Come Back From Heaven, is the CD packaging. The cover features a slightly dazed Reed looking resolutely through his aviators and out the windshield of a blurry automobile. Sun-diluted photographs of roadsides reminiscent of Cool Hand Luke jumble together on the inside jacket. A string of beads with a feather hangs in front of a car window on the backside track listing.

Overall, it’s a neatly packaged collection of overused pastiches on bohemian life, which makes it such an excellent representation of the album.

From the very start of You Can’t Come Back From Heaven, something just feels off. There’s a genuine attempt at profound bluesy pondering throughout the EP, but it’s offset by a true lack of serious sound that hinders the whole thing.

The most obvious culprit for this lack of seriousness is Reed’s almost novel approach to vocals. His overly abrasive voice, best exemplified when he sings “This could be your life” on the final track, “Six Shallow Women,” makes the whole EP feel almost like a caricature of Willie Nelson.

Just like his voice, the instruments of Reed’s work are laughably ruffian. The guitar tries so hard to be a tough guy on songs like “Poor Old Man” that it has no sense of shame or sensibility. When it does manage to control itself in a gentle fashion, the guitar contrasts starkly with Reed’s ever-scratching vocals.

The drums bang on practically the same riff incessantly throughout the album, pausing only briefly to take a slowly reflecting and smooth tone midway through on “Only Gonna Break Your Heart,” a good song ruined by foolish lyrics.

No matter the positives on some songs, there’s always some quality that compromises the total package. When Reed’s growling voice finally fits in with the sound, some other quality will swoop down and distract. When the drums manage to perform a subtle riff, it will be all for naught because of Reed’s aforementioned ridiculous vocals.

Reed’s music is ironic, really. He sings in constant defiance of conformity, but in the end he ends up trying so hard to be a rebel that his music can be neatly packaged and bundled with the rest of the music that sounds exactly like his. On the opener, “I Don’t Love Nobody,” Reed sings almost desperately that he truly doesn’t love anything but the road. He sounds as if he’s hopelessly trying to convince the listener that he really is the hardened rough man he says he is.

You Can’t Come Back From Heaven has such a predictable sound that listening to it feels almost like hearing the sound of stereotype. People have been replicating the biker vibe for long enough in music that the genre sounds as old and dried out as the road kill that the artists so constantly pass over on their genre, going nowhere.

Try this descent while getting high on a fourteener

ou can see it from the trail. A white cleft that drops directly off of Torreys Peak.

It draws the eye in a sinuous line, plunging off the summit, a throat-wrenching vertical elevator that spills into a large snow-filled basin. It’s steep, and it’s scary, and you can’t help but want to ride it, even though it looks as if a fall would send you tumbling to your death.

The Dead Dog Coulior is a Colorado classic. And, although it is steep, the descent is well within the reach of solid skiers and snowboarders. Advanced intermediates should be able to swallow this one, while for those who have spent a bit more time on the hill — the experts — the line is the stuff that dreams are made of.

The best part of doing the Dog is the access. Bakerville sits on the east side of I-70’s Eisenhower Tunnel. The mining hamlet has dwindled to a few scrappy residents who hold on during the harsh winters.

You can’t tell that this place used to be crowded, but the old mining tailings hint at boom-time days.

Bakerville provides the jumping off point for accessing two of Colorado’s fourteeners — Grays and Torreys. Because of this, the rugged dirt road that climbs out of Bakerville is well traveled, although a high-clearance vehicle will serve you well.

The popularity of bagging Colorado’s 14,000-foot peaks, coupled with the ease of access and proximity to the Front Range, means that you probably won’t be the only group in the parking lot. But that’s OK, as the Forest Service has put a virtual highway to the summit of Gray’s to accommodate the latter day rush of peak baggers.

The going is fast and smooth, attributes that will be appreciated by anyone with a pair of skis or snowboard on their back. The trail also offers the perfect vantage point from which to scope your descent.

Take your time and memorize the entrance to the chute.

It’s the only technical, exposed section of the run. Halfway up the northeast face of Gray’s, it’s possible to follow several scree-lined trails that access the saddle between that summit and Torreys, your destination. From there the most difficult part of the climb — a steep hump up the flank of

14,267-ft. Torreys awaits.

The summit of Torreys is one of the best in Colorado. It’s a true high point, not just a high spot on a ridge, and it’s smack dab on the Continental Divide. Views stretch deep into the 10-Mile Range and east, all the way to Kansas. Dog training 101: Swimming

I

f you have had trouble getting your dog to swim, dog trainer Jim Closson of A Better Pet in Boise, Idaho has some tips. “You just don’t throw them in the water. That will scare the heck out of them,” Closson said.

He recommended: —Start off with playing with the dog’s favorite toy or bumper in an empty kids’ pool. Let them jump in to retrieve the toy.

—Add a little water and get them used to jumping in the ankle-deep water for the toy.

—Keep adding a little water to get them used to the water and splashes.

—If you know someone with a home pool, take them there and work obedience training around the pool and get them used to

being around water until it isn’t an issue. Don’t let them in the pool.

—Then take them to a small pond and while working them on heel, throw the bummer out in the pond. Make sure a line is attached to it. Put it close to shore and each time the dog goes in shallow water to get it, throw it out just a little further.

—Another way to try to get the dog used to water is to put on your waders and carry the pup out into the water. Have someone on shore to call the dog.

—Put the pup in the water pointed toward shore while the other person is calling. Do this several times until the dog feels comfortable in the water.

arth Day’s 40th anniversary The Wedge Community Co-op last month got me thinking in Minneapolis in 1977. about all the wacky notions advocated by the longhaired, tie-dyed, wirerimmed youthful hipsters of the early ’70s.

(Yes, I was among them.)

You know, those wild anarchists who read the Whole Earth Catalog and may as well have been called “nattering nabobs of negativism,” to recycle a phrase from then Vice President Spiro Agnew. They not only thought that plenty was wrong with the world, but also believed fervently that they could make it right by encouraging a few small changes in our lives, such as eating brown rice.

We tend to think of Earth Day as a celebration of the three Rs (reduce-reuserecycle). But many of the rallying cries of those ’70s activists were food-related, from how we grew first time in 1970?

“They’ll probably sue us.”

“We like our strawberries in January and asparagus in December, thank you very much.”

For all those who persisted in the effort for good, healthful food (we didn’t worry too much if it tasted good back then), despite naysayers and roadblocks, a big thanks is due.

Clay’s Obscurity Corner Try tri-tip

T

ri-tip beef was popularized by the citizens of Santa Maria, a Santa Barbara hamlet that dubs itself California’s Barbecue Capital. Derived from the bottom sirloin, this cut gets its name from being a triangular-shaped piece of muscle. Until the middle of the 20th century, this cut was likely to be processed for other culinary uses, such as being cut into steaks or ground into hamburger. But town residents began cooking the piece on its own, typically over a roaring oak fire. It has relatively little fat and is popular as a type of chili meat, especially in competitive cook-offs.

ties of the cheese. Although I prefer a more cracker-like crust, I appreciated the whole-grain texure. This crust does tend to soften up over time, so this is best eaten quickly.

We ended with a $4 dessert flatbread topped with Nutella, fresh strawberries and powdered sugar. This crepelike dessert was a fulfilling end to a satisfying-yet-healthy lunch, the not-toosweet crust tempering the topping’s more decadent qualities.

Savory Spice Shop owner to host Food Network show A new Food Network show called “Spice and Easy,” hosted by Savory Spice Shop owner Janet Johnston, premiered on April 24 and will air for six consecutive Saturdays at 9:30 a.m. The Denver-based Savory Spice Shop, which offers a vast array of spices from around the world, has four locations, including one in Boulder. The show will feature Janet preparing foods for various occasions, such as a “Movie Night” and “Friday Night Book Club.”

Dessert Diva A local chef shares her sweet secrets

ho doesn’t like a good cup of Joe? I do believe life as I know it would be utterly destroyed without my morning coffee.

Who am I kidding? My morning, noon and night coffee. I have made big strides to cut out the after 4 p.m. cup. Baby steps.

My dessert this week is Sweetened Cold Coffee Parfaits. It is inspired by the musical In the Heights.

I went to opening night at the Buell Theatre and loved it. A lot of great music, dancing and a lot of coffee talk.

Of course I like my coffee like I like my ... bikinis. Black. I will, however, bend for this treat and enjoy all the other wonderful flavors that the coffee will enhance.

Parfait is French for perfect, and I think this treat might just measure up to the highest of my coffee-drinking, French-speaking, sweet-toothed friends’ standards. Whipped cream, chocolate wafers, sweetened milk and coffee, umm, you might want to make sure you have all night for girl talk, because no one is sleeping after this concoction.

I suggest going on in to Pettyjohn’s Liquor and Wine and having them recommend a nice coffee liqueur to go along with your parfait. Of course, a nice shot of espresso alongside it might do the trick, as well.

And please for the love of everything caffeinated, there is no “x” in espresso. Just saying.

Sweetened Cold Coffee Parfaits 1/2 cup instant espresso 2 tbsp. sugar 1 14-ounce can condensed milk 1-1/2 cups heavy whipping cream 2 tsp. vanilla 14-16 Famous chocolate wafers

Follow directions for 1 cup instant espresso using only 1/2 cup hot water.

Add 2 tbls. sugar and dissolve. Let cool.

Add condensed milk to coffee and whisk until starting to thicken. Beat heavy whipping cream and vanilla until stiff peaks form. Fold half of beaten whipped cream into coffee mixture.

Layer coffee whipped cream, regular whipped cream and 2-3 chocolate wafers (stuck in between creams) divided between your favorite parfait or wine glasses. Top with one chocolate wafer on top. Dust with powdered sugar. Enjoy!

Note: You can use a strong cup of coffee if you don’t have espresso.

Clear coffee mugs or water glasses work great too; you can do multiple layers for bigger glasses.

1/2 cup slivered almonds 1/2 cup unsalted raw pumpkin seeds (pepitas) 1/2 cup wheat germ 1/4 cup oil 1/4 cup honey 1/3 cup water 1 cup finely chopped dried apricots 1 cup finely chopped prunes 1 cup raisins

Heat oven to 250 degrees. Lightly grease 2 (9-by-13-inch) baking pans.

In large bowl, combine oats, sunflower nuts, coconut, almonds, pumpkin seeds and wheat germ.

In small bowl, combine oil and honey. Add oil-honey mixture to dry ingredients, stirring until well mixed.

Sprinkle water over mixture, a tablespoon at a time, while tossing and stirring.

Divide mixture into prepared pans.

Bake for 1 hour, stirring every 15 minutes until mixture starts to turn light brown.

Stir in apricots, prunes and raisins.

Return to oven for an additional 15 minutes or until desired dryness; fruit should be slightly soft, not dried out.

Cool and store in tightly covered container.

hile the contemporary ambience and Guernica-sized mural of Chinese village life may suggest the potential for high prices, meals here are actually quite reasonable.

Most of their lunches are priced well under $10, and there’s plenty to choose from off of the predominantly Chinese-American menu.

There are old chestnuts like broccoli beef and a winning chow fun, as well as more traditional tripe dishes, Shanghai-style cold plates and whole steamed fish.

Conned by a film

T

he brilliantly untrustworthy documentary Exit Through the Gift Shop reminds us that a film can start out in one direction and then change course so radically, it becomes an act of provocation unto itself.

It’s billed as the first feature by the shadowy British street artist known as Banksy, who appears on-screen in literal shadows and a hoodie, with a digitally scrambled voice. (His kind of graffiti and urban commentary exists, as he says, in “a bit of a legal gray area.”) The movie — or rather a different, unfinished movie — starts out as a documentary chronicling street artists in action. The man behind the camera: Thierry Guetta, a muttonchopped Frenchman with a fashionable clothing store in Los Angeles and an insatiable voyeuristic streak.

Guetta is a compulsive videographer, filming his family life, his work life, his recreational life almost perpetually. He becomes obsessed with street artists and their below-the-radar yet highly visible endeavors, all around the world. He is both their Boswell and their stalker, filming, filming, filming, always.

Then the holy grail of reclusive street artists arrives in L.A.: the British provocateur Banksy, ready-

ing a solo show. Guetta is eager to film this superstar in action to complete his collage portrait of what narrator Rhys Ifans describes as “the biggest countercultural movement since punk.” By this time Guetta has amassed hundreds, perhaps thousands of hours of unedited footage he keeps in unlabeled boxes. A firstdraft version of Guetta’s documentary, titled Life Remote Control, turns out to be a trippy mess.

According to Exit Through the Gift Shop, Banksy took over, casually suggesting to Guetta that he try

pursuing an art career of his own, more or less to get rid of him. Banksy and his associates then began making a movie about Guetta’s pipe dream of becoming an artist.

The entire film comprises a series of painfully funny train wrecks, open to more than one interpretation of the truth.

Is Guetta for real? Or is he a fabrication of Banksy’s — a key component of what might be a colossal put-on? Some critics have suggested that it doesn’t matter: Either way, goes the argument, Exit Through the Gift Shop makes drolly incisive points about art-world pros and cons and the merry gullibility of the public. I feel somewhat differently. If, in fact, Guetta is not who the film claims he is, and things didn’t happen roughly this way, my admiration for Banksy (the credited director of the final version, and a street artist of genuine wit) takes a distant second to feeling as if I’d been had by an extremely clever fellow.

Yet it’s undeniable: The film’s slippery surface makes its contents all the more tantalizing.

One-two punch

A

nerve-racking noir from Australia, The Square is accompanied by a nine-minute curtain-raiser, a short film called “Spider,” from the same director, Nash Edgerton. The less you know about “Spider” the better. I’ll say this much: There may be no more effective sucker-punch demonstration in the perils of taking a joke too far.

It’s fabulously sick.

The Square, less so: Its mood is stern, and its suspense a different, crafty sort of accomplishment. The story follows a pattern of adultery and lovers’ plans for escape that go quite, quite badly, along the lines of Blood Simple but with fewer visual flourishes and a subtler brand of irony. The lovers, both married though not to each other, are Raymond (David Roberts), whose construction project gives the film its title, and Carla (Claire van der Boom), a hairstylist whose husband is a lowlevel criminal. Early in the picture, we see this man with the mullet stash a duffel bag full of ill-gotten cash into a crawlspace above the laundry room. We also see Carla watching and wondering how that money might best be used.

The screws tighten. The lovers hire an arsonist to dispose of Carla’s house, but not before they clear out the money. The arson job goes quite, quite badly, and from there, The Square becomes a study in Roberts’ increasingly distraught face, as he struggles to maintain a facade of normalcy while guilt, evasion and bodies pile up around him. There are some wonderful touches. The two key couples in The Square live across a river from each other. We’re told the river plays host to the occasional shark. (Information like that rarely

goes unexploited in a thriller.) A blackmailer enters the narrative, identity unknown both to Ray and to the audience, at least for a nice long while.

If The Square has limitations, it’s because the mainspring of the plot keeps the characters interesting without allowing for much in the way of psychology or surprise. Van der Boom’s performance is probably the best of the batch, though her role is on the thin side. The stringalong, bad-to-worse nature of The Square affords a distinct, if sour, sort of satisfaction. Yet its construction is a thing of considerable soundness.

Taken together, The Square and “Spider” are a fine pair of calling cards. Hollywood can always use talent like Nash Edgerton and his brother, Joel, who co-wrote the script with Matthew Dabner and who plays Billy, the arsonist whose lax sense of quality control allows each subsequent twist a chance to spin forward, like a top spun by Fate.

Alice in Wonderland Director Tim Burton’s new extravaganza, the second Disney-backed Alice and a bookend to the cheerily benign 1951 animated version, won’t be for everyone.

It’s a little rough for preteens, and it doesn’t throw many laughs the audience’s way, but along with Sweeney Todd, this is Burton’s most interesting project in a decade. Wonderfully well-chosen Australian actress Mia Wasikowska plays Alice, and Johnny Depp continues his fruitfully nervy collaboration with Burton by playing the Mad Hatter. The Back-up Plan

The Back-up Plan is about as much fun as 36 hours of labor, only you don’t get to go home with a baby at the end. Instead, you leave with a throbbing headache and a lot of questions about why anybody still thinks Jennifer Lopez can anchor a movie.

After all, Out of Sight was a long time ago. Lopez plays Zoe, a gorgeous New York businesswoman who is inexplicably single. Zoe desperately wants a baby, and as the movie opens she’s being impregnated with sperm from an anonymous donor. On her way out of the doctor’s office, she hails and gets into a cab. A hot guy (Alex O’Loughlin of TV’s defunct “Moonlight”) jumps in at the same time.

Naturally, they squabble, meet again and eventually fall in love, forcing Zoe to confess she’s already pregnant, an announcement that will lead to terror, misunderstandings and a tiresome amount of bickering about trust and commitment. If there’s a cli-

che available for any given moment, screenwriter Kate Angelo latches onto it. Zoe has a sassy grandma (Linda Lavin). A dog eats a home-pregnancy test. A wacky group of single moms hosts a birth in a living room, complete with chanting and drums. You can predict with alarming accuracy when Zoe’s water will break, which is notable only in that it signals the end of the movie is near. Or so we hope. Rated PG-13. Jennifer Aniston stars as a reporter on the trail of a police corruption scandal. She skips a court hearing to meet up with a snitch, and her ex-husband, a bounty hunter played by Gerard Butler, is thrilled to be the one bringing her in. But he owes some

loan sharks, so everyone’s trying to kill them, and they bicker and bicker and chase and chase and are chased and chased again. Raymond De Felitta’s screwball farce City Island introduces us to the Rizzos, a boisterous party of four living in the tradition-steeped, seaside spit of Bronx real estate of the movie’s title. The Rizzos don’t talk to one another much, and when they do the neighbors undoubtedly hear every word. But deep down, we’re meant to understand, they shout because they care. The movie’s setup would barely pass muster on “Three’s Company,” and there’s little doubt that the whole thing is going to end in a group hug. But “City Island” scrapes by and delivers a smile or two because it does contain a fundamental understanding of the rot that sets in when people hide their true selves from the ones they love. Comedy is hard. Farce is harder. The momentum and lunacy need to keep building. The characters’ cluelessness needs to be endearing, but they can’t come off as imbeciles — the audience will turn against them entirely. The outrageous hijinks can’t be pushed too hard or the whole delicate conceit is apt to collapse into desperate chaos. Wonder of wonders, then, that Shawn Levy, the director of such middle-of-the-road fare as Cheaper by the Dozen and The Pink Panther, and Josh Klausner, one of 12 credited screenwriters who worked on Shrek the 3rd, should turn out to be such gifted practitioners of this very tricky genre in Date Night. That there is a beating heart at the center of all this makes it all the more appealing. Rated PG-13. At Twin Peaks, Century and Colony Square — Christopher Kelly

Hot Tub Time Machine’s title may say it all. But just in case it doesn’t, here’s an alternative: “Back to The Hangover.” A sloppy, raucous, time travel farce in the grown-men-gone-wild Hangover style, it’s a surprisingly satisfying, if not exactly LMAO riot.

There are some big laughs and a few great running gags, and the Back to the Future sweet moments of reflection mostly work. It’s not The Hangover, but at least this Hot Tub won’t have you hating yourself in the morning. Rated R. At Flatiron. — Roger Moore.

How to Train Your Dragon

The iconoclastic English painter Banksy may be the most important artist on the run from police.

Or the most creative vandal. A graffiti muralist who satirizes government, authority and society, his unauthorized use of urban buildings as his gallery space obliges him to remain anonymous.

Wearing disguises, he has glued his own art-mocking oil paintings onto the walls of leading museums. In 2006 he smuggled a life-size inflatable replica of an orange-jumpsuited Guantanamo Bay detainee into Disneyland, setting off a major security alert. Quite the outlaw. Yet prints of his art fetch a fortune at Sotheby’s, and his coffee-table books are sold at Urban Outfitters. Banksy’s tightrope walk between secrecy and publicity is a central theme of the documentary Exit Through the Gift Shop. At Mayan. — Colin Covert

The swoops and dives of this exuberant animated feature, in which the teen hero befriends the winged enemy, should prove as addicting to its target audience as similar scenes have in Avatar. On the Island of Berk, the Vikings have been putting up with dragon attacks for 300 years. Hiccup (voice of Jay Baruchel) meets one of the dreaded beasts and learns dragons are a misjudged species, which puts him at odds with his father (Gerard Butler) and the rest of the village.

The flying scenes are fantastic, so seeing Dragon in 3-D really is a must. Rated PG (language and sexual content). At Flatiron, Century, Colony Square and Twin Peaks. — Michael Phillips

Furry Vengeance

It would be so easy just to dismiss Furry Vengeance as the cinema swill it is, considering the horrible acting, lack of direction and writing that’s about as intelligent as scribbles on a bathroom wall. So easy.

Instead, here are some positives from this movie about a father who transplants his family from the urban jungle of Chicago to a woodland area so he can oversee the construction of a subdivision being built on an animal reserve. Brendan Fraser, who plays the work-centered father, no longer has to carry the shame of starring in Dudley Do-Right and George of the Jungle. Furry Vengeance has enough stink to obliterate the bad memories from those two turkeys. Then there’s Brooke Shields.

Her portrayal of the disbelieving wife is bland, but compared to the rest of the cast, she gives an award-worthy performance. Director Roger Kumble’s past credits include episodes of the embarrassingly bad “Kath & Kim” TV show and both of the awful Cruel Intentions movies. He hits a new low with this film because the direction isn’t over-the-top enough to be broad comedy or smart enough to be original. He gets no help from the bad special effects. The woodland creatures aren’t even as well-done as the lovable critters you see in those car-insurance commercials on TV. Furry Vengeance is the film industry’s answer to road kill. It’s a bloody mess that needs to be removed as quickly as possible. Rated PG. At Flatiron, Century, Colony Square and Twin Peaks.

She is the protege of her ex-cop father, also a crime-fighter behind a mask, operating as “Big Daddy” (Nicolas Cage). The gore is stupidly relentless from beginning to end. Rated R. Any film based on a novel by Nicholas Sparks is going to be sentimental. It’s how the actors wade through the emotional bogs that make or break the film. Miley Cyrus throws off the blonde wig of Hannah Montana to play rebellious teen Ronnie, who does nothing to hide her contempt when she and her little brother (Bobby Coleman) are sent from New York City to a beach town in Georgia to spend the summer with their father, Steve (Greg Kinnear). The role of Ronnie is a huge stretch for Cyrus, and at this point in her acting career, the role is just beyond her reach. Only Cyrus’ scenes with Kinnear have a spark of truth.

Kinnear has a knack for playing characters with heavy hearts who are more complex than they seem. That ability is what makes The Last Song

more sentimental than melodramatic. And while the film doesn’t hit any major sour notes, it’s just a familiar tune that could have used some better supporting voices for Kinnear. Rated PG. At Flatiron. — Rick Bentley The Losers

The charismatic Gianni Di Gregorio (co-scenarist of the smash hit Gomorrah) stars in his directorial debut — an utterly charming tale of good food, feisty ladies and unlikely friendships during a very Roman holiday. Broke, and armed with only a glass of wine and a wry sense of humor, middle-aged Gianni resides with his 93-year-old mother in their ancient apartment. The condo debts are mounting, but if Gianni looks after the building manager’s mother during the Pranzo di Ferragosto (Italy’s biggest summer holiday, and the Feast of the Assumption), all will be forgiven. Then the manager also shows up with an auntie, and then a doctor friend appears with his mother in tow. Can Gianni keep four such lively mamas well-fed and happy in these cramped quarters? Like a cover band with more stagecraft than talent, A Nightmare on Elm Street looks good recycling “greatest hits” moments but fails to capture the excitement of the original. The much-revived Freddy Krueger’s ninth return to the screen is a subpar exercise, hardly the stuff dreams are made of. Primitive production values, overwrought acting and dreadful hairstyles notwithstanding, Wes Craven’s 1984 Nightmare offered the first fresh horror concept in eons. Freddy was a bad dream come to life, a monster who wakes up when you go to sleep. A child molester burned to death by upstanding suburban vigilantes, he returned to torture their now-teenaged kids. Skulking around his victims’ subconscious, he could take any form, and he taunted their helplessness with maniacal glee.

Who can forget Freddy’s tongue licking a pretty teen’s face through the mouthpiece of her phone as he sneered, “I’m your boyfriend now”? That line recurs in the new film, alongside images and entire sequences replicated beat for beat. What’s lacking is the imagination, inspiration and emotional impact that made the original a touchstone of the genre. It’s a far cry from this spring’s nervewracking revival of George Romero’s 1973 bio-terror shocker, The Crazies, a case study in how to make a remake. Rated R. DisneyNature follows up its sprawling, over-reaching Earth Day 2009 documentary Earth with a more dazzling, more on-message movie about the state of the world’s seas. The “wow” factor alone makes Oceans a great Earth Day/Earth Week at the movies. We see vast armies of crabs on the floor of Melbourne harbor, sprinting pods of dolphins stretching to the horizon, a torrent of cormorants, neon-nosed cuttlefish, great white sharks and great blue whales. And those are just the familiar sea creatures this French documentary crew (the directors of Winged Migration were in charge) caught on film. The blanket octopus of Australia looks like a Bedouin headdress floating

in an undersea breeze. The ribbon eel winds and unwinds, stretching out like the contents of a broken video cassette. The ancient Asian sheepshead wrasse is an aquatic Jay Leno — all forehead and chin. The messages are basic and nothing new. In the ocean, big fish eat little fish, sharks and orcas eat seals and sea lions (graphic enough), and frigate birds snap up baby sea turtles. But not all of them. And this seemingly infinite, seemingly inexhaustible resource is under grave threat from pollution, over-fishing (bottom-trawling) and simple apathy. Rated G. Benjamín Espósito (Ricardo Darín) has spent his entire working life as a criminal court employee.

In 1999, recently retired and with time on his hands, he decides to write a novel. Drawing on his own past life as a civil servant, he creates a true, moving and tragic story in which he was very directly involved — in 1974, his court was assigned an investigation into the rape and murder of a beautiful young woman. Moved by grief of bank employee Ricardo Morales, who had married the girl a short time before, Espósito tries to help him find the culprit despite having to contend with the apathy and ineptitude of the police and legal system. The investigation takes him deep into the world of Argentina in 1974 — a perfect backdrop for the violence, hate, revenge and death — no longer as an observer, but an unwilling central character. That storm also envelops the presentday Espósito, the old would-be writer, and sets him adrift. As he writes, his past rises up before his eyes and awakens all his demons: particularly those involving his past decisions, uncertainties and irreparable mistakes. Telling the story from the past is no longer just a pastime to fill his empty hours — he must justify his own life, if he is to give any meaning to the years remaining to him, and if once and for all he is to face up to the woman who he is still in love with after 30 years.

A stylish, twist-filled neo-noir worthy of the Coen Brothers, The Square centers on an adulterous couple whose scheming leads to arson, blackmail and murder. Escaping the monotony of a loveless marriage, construction supervisor Ray (David Roberts) becomes entangled in an affair with the lovely but troubled Carla (Claire van der Boom).

She presents him with a large chunk of money stolen by her husband, suggesting that they keep it for themselves. Ray agrees, and they hire a professional arsonist (Joel Edgerton), which turns out to be the first of a series of deadly errors. At first all seems to go well, but soon the bodies start to pile up, and then the first blackmail note arrives from a mystery author. At Mayan. —Landmark Theatres.

The Warlords

Set in the midst of war and political upheaval during the Taiping Rebellion of the 1860s, The Warlords is a spectacular historical action film starring Jet Li (in his best role since Hero). Li plays martial arts master General Pang, who barely survives a brutal massacre of his fellow soldiers by playing dead, and joins a band of bandits led by Er Hu (Andy Lau) and Wu Yang (Takeshi Kaneshiro). After fighting back attackers from a helpless village, the three men take an oath to become “blood brothers,” pledging loyalty to one another until death.

But things quickly turn sour and the three men become embroiled in a web of political deceit, and a love triangle between Pang, Er Hu and a village beauty (Wu Jing-Lei).
