Highroad Corporate weasels trying to escape paying for workers’ injuries

W

hen you come across a corporate lobbying group claiming to be pushing “Responsible Alternatives to Such-and-Such,” you can rightly assume that it’s really pushing something totally irresponsible, as well as malicious, self-serving and even disgusting.

That’s the case of the Association

for Responsible Alternatives to Workers’ Compensation (ARAWC).

Mother Jones magazine reports that this is a front group funded by hugely-profitable retail chains and other corporate behemoths that want to weasel out of compensating employees who suffer injuries at work. By law, corporations in nearly every state must carry workers’ comp insurance, but the ARAWC lobbying combine is pressuring legislators to allow the giants to opt-out of the state benefit plans and instead substitute their own, highly-restricted set of benefits.

What a deal! But it’s a raw deal for injured workers. In Texas, which already has this write-it-yourself loophole, more than half of the corporate plans — get this — pay nothing to the families of workers who’re killed in job accidents! Similarly, under an ARAWCwritten opt-out provision that a Tennessee senator sponsored this year, employers wouldn’t have to cover artifi-

cial limbs, home care or even funeral expenses of on-the-job accident victims.

Also, the Tennessee bill lets a company simply walk away from maimed workers after just three years, or after paying only $300,000 in expenses.

Corporations always claim to “value” their employees — and this tells us exactly how little that value is.

By the way, the CEO of ARAWC also happens to be the head of “risk management” at the mingiest of workplaces: Walmart. And that’s what this opt-out scam amounts to — corporate profiteers hoping they can manage to escape paying for risking the lives of America’s workforce.

T

he Boulder City Council’s latest mantra seems to have been taken directly from the Vietnam War: It became necessary to destroy the town in order to save it.

How else can you explain all the crap it has allowed to be built in the 28th and 30th street corridors — and in a lot of other parts of town as well?

The council’s land use and development decisions, motivated by a mindless, delusional obsession with affordable housing (whatever that is) and sustainability (whatever that means) has led to an explosion of dense, ugly development that is destroying the character of Boulder, is degrading its quality of life, and is, to paraphrase former CU President George Norlin, an affront to the Flatirons.

While densification in the name of sustainability is being inflicted on any number of Boulder neighborhoods (in order to save them from the heartbreak of unsustainability), the most egregious examples are found along 28th and 30th streets (and oozing several blocks to the east in some places) from Iris to Baseline. For simplicity’s sake call the area 28th/30th Street corridor.

This new development is not doing what it was supposed to do.

It is not making Boulder a less autodependent and more pedestrian-friendly city. The 28th and 30th street corridor is choked with traffic, and each new multi-

unit housing, office and commercial complex adds more. There is so much traffic in the area that it is threatening to exceed the carrying capacity of the roads.

Driving in the corridor sucks.

The people who live in the housing complexes are not getting a higher quality of life in exchange for higher density.

They’re getting a degraded one.

They are getting more congestion, more noise, more pollution, more crowding and (paradoxically) more isolation from the rest of the city.

The 28th/30th Street corridor is hands down the single least livable part of the city — yet that is the area that City Council has chosen for some of its most intensive residential development.

Why? If you ask a council member or a planner or a developer, chances are you will get a song and dance about the virtues of “primary mixed use” development — development in which housing, shopping, restaurants and entertainment exist cheek by jowl with residential housing.

This is supposed to reduce the need for cars (and the impact of an auto-dependent civilization on the environment) and make for a more pedestrian-friendly, social and humane community.

It’s a beautiful theory, and there are places where it has worked, but in Boulder the theory is getting mugged by a gang of ugly little facts. see DANISH PLAN Page 8

[District Attorney] Stan Garnett was quoted on Feb. 22, 2014, “Philosophically I have a real belief that the grand jury process is valuable.”

If that statement is still true and correct, the question must be raised as to, 1. Why the grand jury did not conduct an investigation?

According to the Fifth and Seventh amendments, a grand jury must be empaneled “... at common law, where the value in controversy shall exceed 20 dollars....”

2. Why would the district attorney state that he is bringing forth counts on “pregnancy statutes” when statutes are not law?

Additionally, a map of state fetal (baby) homicide (statutes, not) laws was removed to avoid confusion.

Suppose the people within Boulder County, our society, truly had a grand jury “…over whose functioning the courts do not preside…” Justice Scalia, is it possible that a true bill, an indictment would be handed down for a prosecution of murder? Laci Peterson was eight months pregnant (as Michelle) when her and her unborn son Conner were murdered by Scott Peterson, who was sentenced to death in 2002, and remains on death row.

3. Does deceased baby Aurora have a value less than 20 dollars? Or does a district attorney have authority to decide to prosecute under statute rather than law?

Middle East equilibrium

Due to indecision by the Obama White House to support moderate Sunni rebels in Syria, Islamic terrorists in Syria (ISIS) were able to reposition forces and attack the Iraqi Army, which folded and abandoned its U.S. equipment, including many Humvees and 155mm guns. The Iraqi government requested air strikes against ISIS, but President Obama ignored the request, referring to ISIS as the “JV Team.” The result was ISIS captured our military equipment and established territory from which they can launch terrorist attacks. We belatedly decided to send advisers to assist the Iraqi Army, and we launched air strikes against ISIS. We appear to be fostering equilibrium in the Middle East with Shiites of Syria, Iran, Lebanon, Yemen and Iraq counterweighted by Sunnis of Saudi Boulder Weekly

Arabia, the Emirates, Jordan, Egypt, Syria and Iraq. We should continue to conduct air strikes, training and covert operations in Iraq and Syria to counter ISIS. The Kurds, who are reliable Arab allies, should be well armed. Other Arabs, including so called moderates, should be sold used equipment without spare parts.

With the decrease in our depen-

dence on Middle East oil, containment of turmoil and fighting by Arabs in the Middle East could translate to increased security for the U.S. and other countries.

The new residential housing is not gracefully connected to the nearby commercial areas by pedestrian-friendly streets with wide sidewalks lined with shops and restaurants. ( Jane Jacobs, arguably the greatest urban planner of the 20th century, called such streets “seams” between neighborhoods.)

Twenty-Eighth and 30th Streets are not seams. They function as barriers, that cut off the residents of the new dense housing from the commercial areas. The commercial development along the streets is for the most part not adjacent to sidewalks, but set back from the street by parking lots, some of them hundreds of feet wide. They are auto-friendly, not pedestrian friendly.

The people who live in the corridor will find it more convenient — and more pleasant — to drive to Whole Foods or to the Twenty-Ninth Street mall than to walk there.

The new housing projects show little sense of proportion and less sense of place. They are not inviting.

Aesthetically they run the gamut from indifferent to irritating. And collectively they are making Boulder feel more claustrophobic. Judging by outer appearances, there isn’t a mobile home park in the Boulder Valley that isn’t a more attractive housing option.

Speaking of mobile home parks, if the city council is serious about providing affordable housing options, it should approve some new ones — ones in which the residents can buy the pads their homes occupy instead of having to rent them. When you don’t own the land under your house, and when your

house can be evicted at the whim of the landlord, you can’t make long-term investments in maintaining and improving it. Your home is a depreciating asset, like a car. But when you do own the land under your house, you can invest in your home, maintain it and improve it. And then it becomes an appreciating asset.

Mobile homes are the private sector’s great affordable housing success story.

Boulder has a long history of treating them and their owners shabbily and giving them short shrift, which is as stupid as it is rude.

Boulder’s problem is that it is trying to stuff too much stuff into the town. It isn’t that it can’t be done. It’s that it can’t be done without doing real violence to the town’s environment, character and quality of life.

The City Council does not have a political mandate to densify Boulder.

Quite the opposite. Projects that remotely smell of increasing the density in existing neighborhoods routinely draw ferocious opposition from the neighbors — mixed use, affordable housing and sustainability be damned.

It’s been that way for more than 30 years. I can’t recall a single public hearing — and I’ve sat through two or three dozen — at which a neighborhood welcomed densification or mixed-use development. The political mandate is for less development, not more — even if it has been green-washed in the name of sustainability or white-washed in the name of affordability.

In the ravine behind their second or third home, where it flattened out and some trees had keeled over and died, he taught her how to shoot at the debatable age of six. She’d run around collecting bottles, which they’d set in a row along some mossy log or use to ornament the branches of an unlucky pine. He had started a beard and it rested on her shoulder: “Make it, and you, a line to your target. Hold your breath like in the lake.” Later, the memory would appear as a stain in her whiskey glass, straight rye two fingers.

The disease came first for our first kiss. One morning, hands against the counter and eyes on the coffee maker, I realized that kiss was gone. I asked you to remind me. I’m sure you did, but it didn’t stick.

Today I woke up seeing only red violet. I stay coherent, moving and floating slowly in that color. Drugs? Not at all.

It isn’t easy to focus on what needs healing next. My spiritual health should probably come first. For now I’d like to stay in this tranquil place by a lake. A bucolic stop in my head.

Maybe I can leave this boxcar soon. After the sun breaks through.

1. Elephant Grass

The last elephant put the circus behind her, leaving no forwarding address. They’d offered her sanctuary, but it seemed a poor choice to gain your freedom and then so soon give it away. She’d simply packed her trunk and said goodbye. She headed west, leaving footprints like platters in the asphalt, kicking up dust on dirt roads, until the coolness of grass told her she was home.

There were pumpkins and sweet water — a fine place to be. Then a man spotted her and stood, gawk-eyed, waiting. She knew how to dance, but she chose not to.

He gets out of bed, realizing he’s already lost the war.

Cyril’s Puzzles

Along the clinically white hallway of the active seniors’ home hang dozens of Cyril’s puzzles, framed simply. The Meals on Wheels volunteer decides after delivering to the tall, lank gentleman that she will purchase him a puzzle to do. Clearly he enjoys them. Cyril accepts his hot meal, milk, bread, apple, and new 500-piece puzzle the next week with a look of dread in his eyes. Two weeks later, he gifts it to the young woman in a plain black frame like the rest. “Please don’t bring me anymore puzzles,” he says. She hands him his meal; he closes the door.

The Moment

We saw Annie at the concert last night. I recalled our first meeting. Joseph brought her by and introduced her as his daughter, though she was a foster child.

She didn’t speak, just hid behind him and peeked out avoiding eye contact. She never spoke. Born addicted and alcoholic, the first thirty days of her life were in withdrawal. For seven years she never spoke.

A tiny girl, hidden behind the cellos, only the white top of her bassoon and her music proved her existence there. During applause we caught a glimpse of her smile. The music was exquisite. We spoke.

My brother whimpers against the sounds next door. Still he holds his eyes tight against the darkness. His face mashes into my sweatshirt he uses as a pillow. The conditions were much less than perfect as we approached the summit.

Being too late to turn back we honed in on all of the experiences that brought us to this moment. The sky opened up and let loose as thunder clapped, startling us.

With the earth shaking beneath us, we made eye contact and subtly nodded, this was it. “Climbing,” I shouted, above the clouds, as I heard static electricity transmit between the ropes and ’biners. Wiping my face dry, I dug in for the final push.

Pringle’s just a part of the family, you know? There was no question of doing everything possible, like the $100s every week in medications, the wheeled cart for his paralyzed back legs, or carrying him up and down the stairs.

So maybe he can’t lift a leg to pee on other dogs at the park anymore, but it’s about quality of life. On his wheels, he can still snap at delivery folks, can still roll into a room just to fart bomb everyone, but no, don’t pet him. He still bites, too.

Local law enforcement, DA’s office speak to efforts to assist veterans when they have run-ins with the law

Veterans may also return with a sense of moral injury — a new term for the sense some soldiers experience of having had their morals constantly torn down by their experiences during combat.

an officer may come up and be too authoritative, or be a little too aggressive in their interaction with the veteran, it can cause the veteran to regress,” he says.

Community awareness also needs to step up — and that’s where the Veterans Awareness Series forums from Veterans Helping Veterans Now and sponsored by the City of Boulder Community Event Fund comes in.

Soldiers have also been trained to spot a threat and respond to it without taking an extra second to assess whether the threat is real or perceived when those seconds might cost a life.

“You’re not going to take the time to see, you’re going to react,” Ruprecht says.

“We train these guys — they trained me, they train us to be that way, but they don’t de-train you when they let you go.”

That can lead to fights in bars and incidences of domestic violence, cops called and criminal charges.

None of it helps guys coming home, or the families and friends that surround them.

When Jenn Calaway came home from the Marine Corps, where she worked as a broadcast journalist in Japan covering coalition forces exercises and completed a tour in Afghanistan, making the right decisions after years of not having to make decisions for herself was part of a tough transition.

“We were told how to do everything for so long that all these choices were really overwhelming,” she says.

“Shopping at the grocery store, it was so hard, there are so many choices and so many colors and I didn’t even really know how to take care of myself. It

was really hard. I remember one day just sitting on my floor, and it was going back to basics from boot camp, like, tie my left shoe, tie my right shoe. … It was really hard, and it was made twice as hard by the amount of alcohol I was drinking.”

Even after she’d started college at the University of Colorado, where she is still a student working toward a degree in public relations, drinking like she had when she was in the Marines continued to be a problem.

“Sometimes when I would be under the influence and be kind of roaming around town, I would feel like I was above the law, I had moments where I was kind of cocky: ‘I’ve deployed, I’ve done my service, I’ve done my time, and these rules don’t apply to me,’” Calaway says.

Eventually, she landed an alcoholrelated charge.

“The judge gave me a talking to, and I heard it, for the first time in my life,” Calaway says. “[He said,] ‘You’re a marine, you should be contributing to your community rather than being a nuisance to it.’”

Her sentencing called for the kind of oversight and guidance she wasn’t given as she left the military, like alcohol classes and check-ins with a guidance counselor. She joined AA and is still sober and in the program.

“I think that especially when there’s substances involved, veterans can get really misguided and just get astray, so I think it’s important to note that they’re often just astray and there’s so much potential to turn this person around into a contributing member of community,” Calaway says.

At least one district court in Colorado has a veterans court specifically to handle those cases, and the subsidiary issues surrounding veterans, like a drug court takes into account that sending an addict to jail isn’t likely to solve the problem without incorSee VETERANS Page 18

associate professor researching bio-fuels and wasteto-energy (WTE) technologies at the Colorado School of Mines. “This is a relatively new problem, and we’re still learning how to scale up some of these reactors. [But] it’s not insurmountable.”

Other research supports Persichetti’s position.

“It is a research challenge to optimize the [pyrolysis] process by maximizing product quality and quantity while paying proper attention to minimizing costs and environmental concerns,” a Central Queensland University study of pyrolysis processes states. “Although a lot of studies have been conducted on pyrolysis economy, most of those were limited in small or pilot scale production. Detail[ed] economical assessment of industrial scale pyrolysis plant[s] may be required to establish this technology as a competitor with conventional energy and other alternative energy sources.”

Using information provided by CES, a Colorado Department of Public Health and Education report concludes that the two proposed operations in Otero and Morgan counties would be “the largest pyrolysisfor-energy production facilities in the world.” And with solid waste from landfills required to fuel the plants, a steady stream of waste will be required to keep the plants running — even after existing landfills have been depleted.

In the past, WTE companies have instituted “put-or-pay” contracts that “require municipalities to pay a predetermined monthly fee … regardless of whether it makes economic or ecological sense to do so in the future,” according to a report by the Global Alliance for Incinerator Alternatives. “As a result, these contracts destroy the financial incentives for a city to reduce and separate its waste at the source, and reuse, recycle and compost.”

report, saying that pyrolysis’ worth lies in its practicality, rather than its economic viability.

“The problem tends to be that if somebody tries to do it for economic purposes, and say, ‘Yeah, we’re not going to be spending money, we’re going to be able to actually make money from this,’ that doesn’t always tend to work out — because of the costs of drying it,” Persichetti says, referring to the drying process required before pyrolysis can occur. “So it’s not a good business venture. But if you’re trying to reduce landfill it’s a great idea.”

The Pyrolyx AG technology tackling CH2E’s 60 million scrap tires is faced with a similar problem — how to create a large-scale production facility that is sustainable without ignoring environmental concerns. The plant, geared toward making recovered carbon black, which is added to rubber as a filler and strengthening agent, would be the first closed-loop pyrolysis process. Carbon black would be captured and utilized to create new tires.

The Colorado Waste Tire Management Plan, prepared for the Waste Tire Advisory Committee and the CDPHE, says that in order for Colorado to meet its goal of consuming the state’s waste tires by 2024, enduse capacity would have to increase by an additional 6 million tires per year.

But despite the good intentions behind House Bill 14-1352, which instituted Colorado’s waste tire legislation, Marjorie Griek, executive director of the Colorado Association for Recycling, says that the law may be forcing monofills to consider pyrolysis before the technology has been adequately tested.

“I think that further research is definitely needed to make determinations about what will give us the best outcome in the long term,” Griek says. “I know that the tire monofills are under pressure to close within a certain number of years and therefore would look at something like pyrolysis as a great way for dealing with those tires. But I don’t know that they’re looking at the big picture.”

Monofills are required to stop adding to their stockpiles in 2018 and focus on depleting their remaining supply. Brian Gaboriau, waste tires grant administrator at the CDPHE, says pyrolysis could be a powerful tool in creating a new market for existing waste tires, as well as repurpose Colorado’s tires in the future.

“With the changes last year with House Bill 14-1352, we’re trying to do some changes and we’re trying to make them positive,” Gaboriau says.

“Because at the end of the day, we all know that 2018 will be here before we know it, so we want to make sure that we have a good program and that we have sustainable markets out there for the tires. … When those tires have value, then they have a place to go.”

Due to the difficulties behind characterizing more rubbery materials, Persichetti advises steering clear of tire pyrolysis. But he says he still sees the process as an extremely promising prospect.

“In general, [pyrolysis] is on a pretty good track,” Persichetti says. “But it, in some cases, could still be a decade away. In other cases, we’re at a point of demonstrating some better application of some newer technologies to improve the efficiency.”

hen world-renowned ocean explorer Robert Ballard undertook a mission to find the wreckage of RMS Titanic, which sank in the North Atlantic Ocean in April 1912, that story was actually a cover operation. In truth, Ballard says, he was on a series of highly classified military missions to find U.S. submarines that had been lost during the Cold War. Ballard’s team had a relative idea as to where the submarines went off the grid, which meant the main objective of the mission wasn’t to discover their location. Instead, Ballard says, he and his team were sent to collect nuclear weapons that had been inside one of the sunken watercrafts. tion he considers his most significant. In 1977, he acted as the cochief scientist of an expedition that led to the discovery of hydrothermal vents at the Galapagos Rift, which lies about 250 miles from the Galapagos Islands. Ballard says this discovery rewrote the origin of life on this planet.

“We found, in a world of total darkness, a complete ecosystem that was living not off the sun, but off the energy of the earth through a process we call chemosynthesis,” Ballard says. “It is in these hydrothermal vents where we believe life started on planet Earth.”

Ballard’s curiosity for the ocean, and what lies beneath the waves, came about at a young age. Growing up in San Diego, Ballard lived not only near the ocean, but also in close proximity to the Scripps Institution of Oceanography.

“So basically, I am a product of my environment,” Ballard says.

He went on to read Jules Verne’s Twenty Thousand Leagues Under the Sea, which fueled his interest in oceans. Ballard started walking around looking at tidal pools and eventually learned to snorkel and scuba dive, but it wasn’t until his junior year of high school that his future career path was set in motion.

Ballard wrote to Scripps and asked what a young man like himself might be able to do to get involved in the field. The response from the research institution included information on a scholarship program they had for high school students; a scholarship see EXPLORING Page 26

for which Ballard applied and subsequently received. Ballard went to sea in the summer of 1959 and says he fell in love with the whole process.

After years of working in the field of ocean exploration and making both historical and scientific discoveries that work to provide a better understanding of the planet as it is and as it could ultimately be, Ballard founded the Ocean Exploration Trust in 2008. In addition to exploring the ocean and conducting research, much of which is done from the 64-meter Exploration Vessel (E/V) Nautilus, the Ocean Exploration Trust also offers their expedition experiences to explorers on shore through a technology known as telepresence.

“If we find something that’s of interest, then we simply network people to the bottom of the ocean so that they don’t have to physically be there anymore,” Ballard says. “It’s all electronic travel.”

The Ocean of Exploration Trust calls their team aboard the Nautilus the Corps of Exploration, similar to Lewis and Clark’s Corps of Discovery, Ballard says.

Together, they hold three main objectives. First, they work to be the leader in the development of exploratory technology. Second, they take that technology to explore where no one has explored before, and finally, they use their technology and the discoveries they’ve made to spark an interest in science, technology, engineering and mathematics education within the minds of the next generation of explorers.

“Our mantra is to go where no one has gone before on planet Earth,” Ballard says.

Ballard has been a part of more than 120 dives in a career that spans more than 50 years to explore the history and the science of the ocean. He is on a quest to better understand the planet as it is now, and as it may be in

the future. And whether that quest is composed of research in the field of archeology, biology, geology or the like, Ballard says it’s all done to better understand the planet we live on.

“The Earth is reacting to us, and I think we need to understand that it might ultimately be able to kill us,” Ballard says. “So we need to figure out how to sort of strike a peaceful relationship with it, and the only way we can do that is to understand the creature itself and what makes it tick.”

The Corps of Exploration recently embarked on a six-month field expedition that will explore sites ranging from the Gulf of Mexico to British Columbia. One leg of the expedition will take the team to the location of the 2010 Deepwater Horizon oil spill to look into the ecosystem responses and effects of the spill. Ballard says dispersants used in response to oil spills pose a particular set of problems for oceanic ecosystems due to their toxicity, so this leg of the expedition will focus largely on figuring out how to best respond to the next oil spill and give guidance to others on how to do the right thing.

Other legs of the expedition will take the team to Panama, through the Panama Canal and on to the Galapagos Islands, the area in which Ballard discovered hydrothermal vents years ago.

Here, they will explore the biological diversity and geological structures of the foundation of the Galapagos Islands and the surrounding area to the north.

At 6:30 p.m. on Tuesday, April 21, Robert Ballard will be speaking at the UMC Glenn Miller Ballroom on the University of Colorado Boulder campus as a guest of the Distinguished Speakers Board. He will deliver a lecture on his most recent work and share findings from expeditions that resulted in his discovery of sites of historical significance.

GRABBING THE PIE IN THE SKY THE OFFICE OF ARTS AND CULTURE DETAILS PLAN FOR CULTURAL IMPROVEMENT

hile revitalizing a city’s art scene seems like a daunting task, there are people in Boulder working to make it a reality. Think: more venues, more art districts, more festivals and more resources for artists and the community.

“We want to make sure it’s a realistic plan, not just some pie in the sky,” Martin Cohen said in the Taste Test, a series of meetings held April 9 and 10 to discuss the future of Boulder’s cultural scene.

Cohen is one of the consultants from the Cultural Planning Group that is working alongside the Office of Arts and Culture to assess the cultural needs of Boulder and how to address them. In the fall, they took to the streets to find out what Boulderites wanted with a series of community outreach events called the Culture Kitchen. Through these events, they learned Boulderites want more outlets for the arts. They also found that Boulder is composed of a lot of artists who want more venues to showcase and cultivate their work. With this response, the team has outlined a blueprint for the future and is working toward a plan that will unfold over the next nine years, focusing on three-year increments.

Partners and staff of the Office of Arts and Culture held the Taste Test so members of the community could hear a presentation of their findings and engage in a dialogue about the future, all in an effort to draft a cultural plan for Boulder. The meetings drew 10 to 20 community

members, both artists and non, and the voices were loud and passionate.

“The conversation has been really robust and sophisticated,” says Matt Chasansky, manager of the Office of Arts and Culture. “We’ve been challenged on a lot of great things, which is exactly what we needed.

It was our worst fear that the room would be absolutely silent or that there would just be consent.”

The missions they’ve identified are to grow Boulder’s creative vitality, make arts and culture a civic priority, elevate Boulder’s cultural identity, and to enhance the visual and experimental environment. To achieve those goals, they’ve divided the strategies into six parts: building resources for cultural organizations and for artists; fostering environment for artists and creatives; building awareness in the community; providing access, inclusion and equity; making a public art plan and increasing cultural facilities and spaces. Some examples include supporting art districts, throwing neighborhood-focused festivals, developing cultural spaces in the community and providing resources for artists.

The next step is finalizing a draft of the plan. Chasansky says they will gather everything they heard through the Taste Test and wrap up some ongoing research projects including a benchmark study, a creative vitality index study, cultural asset mapping and a study of foundational documents. He plans to also attend city board and commission meetings, which will be another chance for the public to weigh in. All of this inforsee PIE IN THE SKY Page 30

mation, including dates and times of meetings, will be available on their website (boulderarts.org). He says they will present a final draft to City Council at their July 14 meeting and will hopefully begin right away with implementation.

While the plan seems thoroughly thought through, it all boils down to implementation, and there was some skepticism at the meetings.

“One of the things I find a lot in Boulder is an idea is presented and everyone gets excited, but then the follow-through doesn’t seem to happen — the actual making-it-real part,” said artist Sally Eckert.

To answer this question, Jerry Allen, of the Cultural Planning Group, said that each step of the process will be met with an identification of resources, strategies, timelines and searching for commitment in the community from organizations or citizens to provide further support. They anticipate problems will arise, but Allen reassured meeting attendees that they’re focused on action-oriented plan-making. The strength of those strategies will be assessed as the plan continues to evolve.

One big concern rose to the top during the meeting: “We all know,” Eckhart said, “it’s all about the money.”

The plan calls for an increase of the Office of Arts and Culture’s grants program, meaning doubling the current budget of $250,000 to $500,000. That money will then be repurposed to create tools and resources for cultural organizations, including building capacity, creating innovation funds and sponsoring different projects in the community.

With the new plan, Chasansky says he hopes the city staff will see the value in the arts and will repurpose funds.

“It’s about priorities for the community,” Chasansky says. “This [plan] should demonstrate to City Council and to city staff that the community’s priorities for art are at a new level.

There have been priorities about open space, social service and municipalization of the electrical system. If the arts are elevated to that level — and [the plan] should be the proof of that — it should back up any decision making for the budget.”

As the project expands, he says, he hopes the funding options will continue to grow. He knows the key for the future is continuous cash flow so that organizations can count on funding even in times of change.

“The fact of the matter is that when there’s an economic downturn or different initiatives come up, the arts are the first to be scrutinized for reduction,” he says. “In order to create a type of pro30 April 16, 2015

gram that the community is demanding, we need that sustainable funding.”

As ambitious as this plan is, it begs the question of executable manpower.

Right now the Office of Arts and Culture only has two full-time employees, Chasansky says. The office also receives substantial help from library employees, volunteers, different departments within the city and from various cultural organizations around Boulder, but he sees an obvious need for more people to help execute the plan, which will hopefully come after City Council approval.

“We need to grow,” he says. “We need to have the help and the partnerships and more volunteers in the future.

We do need to be honest about the fact that this is going to require a large amount of people that we don’t have yet. We need to staff up.”

One place they’ll be looking for help, Chasansky says, is the community.

Part of their plan is to integrate more artists into positions of power on boards and committees. City councilwoman Mary Young attended the April 10 meeting to show her support of the project. She said that it all starts with making connections “The process is very open — open to anyone,” Young said. “The only constraint on an applicant is if they live in the city. ... [Being on a council] is a really good way to influence policy.

That’s how you begin to infiltrate.”

But several members of the crowd insisted there needs to be trickle-down effect from the top to pull in key people. Some meeting attendees insisted that artists can be introverted and don’t usually partake in these roles. Artist Nii Armah Sowah said that there’s an intimidation factor that stops people from joining boards and committees.

Originally from Ghana, Sowah also pointed out a need for diversity in these conversations.

“A lot of minority groups and artists do not push themselves into higher positions because they don’t want to be dismissed,” Sowah said. “So how do we get invitations? [It’s about] identifying key people and reaching out.”

Diversity, or lack thereof, is an issue that surfaced frequently in the meetings. Out of the estimated 2,000 people surveyed, only about 4 percent were self-identified as Latino, 3 percent African American and 1 percent Asian.

There’s a consensus that these numbers need to increase to include diversity among ethnicities, generations and economic class.

Chasansky says he plans to reach out to diverse communities and identify organizations to work with. He says he

wants to work to properly represent these voices in the community and have authentic conversations about what those communities want. “[The survey number] doesn’t meet our very high expectations of this plan,” he says. “We’d like to overcorrect for those groups and understand their needs fully. We want to do more work to build some trust, build some bridges and continue to make sure these programs are the right fit for everyone involved.”

Apart from diversity issues, the attendants of the meeting were antsy to get projects rolling and concerned about the nine-year timeline. One specific element they’d love to see is a proposed website that will aggregate all the cultural events happening around town.

The immediate goals, what Chasansky calls the “low-hanging fruits,” include public art and the grants program. Not everything will take nine years, but he also begs for some patience.

At the conclusion of the meetings, it was clear that much more work needs to be done. While some questions went unanswered, that’s not surprising in this stage of the plan. The mission of the Taste Test was to present the findings, gather feedback and identify weak spots. Now, Chasansky says, they can look to the future with a clearer vision.

Accountability for future success ultimately falls with the public. The Office of Arts and Culture will be a commited to being transparent and setting deadlines, Chasansky says, but now the community has to get involved.

“If this plan’s going to be successful, people need to come forward. I’m not worried about it, honestly. The response to these events have shown that there are passionate people in the community,” Chasansky says. “There aren’t a million people showing up, but the people who are showing up are convening on their own to have discussions. We want to erase all barriers. … If this really is a civic priority, then they’ll show up. And it is. And they will.”

Eckert says she felt better after attending the meeting. She sees a clear structure and plan for the future, and she also acknowledges the vital role of the community. As an artist, she says, she’s learned to speak up because no one is going to do it for her.

“We need everyone to get up, stand up, write letters saying, ‘Yes. This is important,’” she says. “You want to keep Boulder, Boulder? Keep the artists here.

Bottom line. … They have a good structure, but now it’s up to the public to implement it. I see this as a good step, but now it’s up to us to do the work.”

“The reconstruction of such a score amounts to more of an act of composition than anything else,” is the way Carthy puts it. Lacking specialized resources, he is preparing a version for CU that will be scored simply for a string quintet with harpsichord. And “it matters not at all” how much of the music is actually Monteverdi’s.

“We perform the opera we have,” he says.

One complication is casting the role of Nero, which was written for a castrato — a voice type happily not available in 2015. With two casts, CU will use both possible solutions: a male tenor, singing the role down an octave, and a mezzo-soprano singing the role at written pitch.

After the musical problems have been solved, The Coronation of Poppea is a beautiful piece of music that presents one of the basic dilemmas of human existence. Tolstoy once remarked on “the illusion that beauty is goodness,” and that is the illusion that stands at the heart of the opera. We are startled to see so much beauty lavished on such evil characters. And rather than tie it up neatly at the end, Monteverdi leaves the question open.

“There’s a lot of beauty, but there’s a lot of evil up there,” Holman says.

“They marry and there’s a big celebration, and then what happens? It leaves it to us.”

Dweezil sometimes takes months to hone two-seconds of one of Frank’s song, especially with more difficult ones like “Black Page,” “Inca Rose,” “G-Spot Tornado” or “Dog Meat.”

“Learning his music is quite the undertaking,” he admits. “Early on, it was much, much more difficult to get it all together because there were all these unknowns. You sort of find a way to create your best learning process. What I had to do early on is completely overhaul my approach to guitar and even more difficult was to overhaul the mental approach. My father’s playing is so unorthodox. You have to have at least some of the same tools he was using to be able to play his music. That was a couple of years of work before I even started doing the band.”

The fact Zappa Plays Zappa stays true to Frank’s music is a testament to his skill level, as well as his love for his father, who passed away when Dweezil was in his early 20s. He still has many unanswered questions, but on stage playing his music gets him as close to his father as possible.

“There’s times where I will play something that will be so reminiscent of something he would do, even though I’m improvising,” he says. “Sometimes I’ll play something, and I don’t know if that was me that played that. The more I dig into the details, the more amazed I am at what he was able to do in such a short amount of time. He not only had all the quality, but he worked at an amazing, proficient speed. Unless people really know, they can’t understand.”

So this poem by Melissa Balmain really caught my attention. Balmain lives in New York State, and her most recent book is Walking in on People, from Able Muse Press.

Love Poem The afternoon we left our first apartment, we scrubbed it down from ceiling to parquet.

Who knew the place could smell like lemon muffins?

It suddenly seemed nuts to move away.

The morning someone bought our station wagon, it gleamed with wax and every piston purred.

That car looked like a centerfold in Hot Rod! Too late, we saw that selling was absurd.

And then there was the freshly tuned piano we passed along to neighbors with a wince.

We told ourselves we’d find one even better; instead we’ve missed its timbre ever since.

Husbands My mother likes a man who works. She likes my husband’s muddy knees, grass stains on the cuffs.

She loved my father, though when weekends came he’d sleep till nine and would not lift his eyes up from the page to move the feet she’d vacuum under. On Saturdays my husband digs the holes for her new roses, softening the clay with peat and compost.

He changes bulbs she can no longer reach and understands the inside of her toaster.

My father’s feet would carry him from chair to bookshelf, back again till Monday came.

My mother likes to tell my husband sit down in this chair and put your feet up.

Upslope Brewing Company will be hosting its second annual music festival, Upslope Get Down on Saturday, May 16 at Flatiron Park in Boulder.

The free event will feature local Boulder County food trucks and eight bands playing on two stages continuously from 1-11 p.m.

“As the temperatures begin to rise, so does our excitement for the annual Upslope Get Down music festival,” said Upslope Marketing Manager Katie Hill in a press release. “Year one was a huge success and we’re looking forward to making the second annual event bigger and better.”

Participating bands include Taylor Frederick’s Funk Circus, Rowdy Shadehouse, The Yawpers, A. Tom Collins, Technicolor Tone Factory and more.

DRINK PINK WINE When flowers pop out of the ground seemingly overnight and the foothills turn mint green (and then quickly burn) we put away the skis and jackets and bust out the flip-flops and sunscreen. Almost every house on the tour will have a chef preparing food samples, and the tour will bring you around Boulder and Niwot to showcase a variety of styles and designs.

Colossal pairings BruFrou brings culinary and brewing titans together

C

olorado’s culinary world will collide with the craft beer scene at the second annual BruFrou, a celebration of beer and food pairings. On Saturday, April 25, 80 Colorado brewers and chefs, including many from Boulder County, will team up to create 50 unique pairings to elevate the experience of both the dish and the accompanying brew.

When creating the chef and brewer partnerships for the three-hour event, pairs with existing relationships naturally emerged, like Boulder’s Basta and Wild Woods Brewing.

“Their beer definitely creates a story with every sip,” says Chad Luman, beer coordinator at Basta, of their partner brewery. Luman says that the herbs and spices used in Wild Woods’ beers make pairing a dish with them even better. Luman feels with so many different styles of beer, the possibilities when pairing food are endless.

He says the complexities of the beer, in his opinion, lend a little better than wine, which most people think of as the traditional choice.

“The reason we do the dinners and events is to raise awareness of how special the marriage of craft beer and food can be,” he says.

Patrons at last year’s BruFrou enjoyed dynamic craft beer and culinary combinations.

Evans, owners of Wild Woods Brewing, have been going to Basta since it opened and have become both neighbors and friends.

“We really respect and admire Chef Kelly [Whitaker]’s simple, beautiful approach to food that lets the ingredients and cooking method speak for themselves,” says Erin Evans. She says last year they sat down and thought about the food and beer side by side.

But this year, they’ve decided to make a beer specifically for the event, after which the Basta crew will make a dish to pair it with. Basta’s love of wine was

their inspiration, so they opted for Nelson Sauvin hops from New Zealand, which have a similar flavor to sauvignon blanc grapes.

“We chose a light, refreshing blonde ale style to really let these beautiful, fruity, white grape-flavored hops shine, and decided to round out the beer with a hint of tartness from a touch of fresh kiwi fruit,” Evans says.

Another duo with a previous relationship is Jax Fish House & Oyster Bar with Denver Beer Co. Adam Reed, director of operations at Jax Fish House, says they’re happy to be involved in an

event that reaches so many people. He describes last year’s event as loud, boisterous, fun and vibrant.

“We love working with BruFrou because of the enormous opportunity to connect with beer makers at the top of the craft game in town and also the chance to reach a huge base of guests who are as passionate about craft beer and great food as we are,” Reed says.

They’ll be serving a seared duck andouille with English mustard, duck gelee and brioche toast with Denver Beer Co.’s Employee of the Month Sour. They’re also preparing a Jaz Emersum Oyster Shooter with strawberries, cucumber, Banyuls Gastrique and Denver Brewing Co.’s Raspberry Princess Yum Yum paired with the same beer.

“I would say that the creative process started in the kitchen, but ideas were solidified once we tasted the beers,” Reed says.

Another process for pairing the teams is when someone has a request to work with a specific chef or brewer that they may not have had an opportunity to work with in the past.

“We love this because we feel we act as a community builder, which is key to this Colorado-only event,” says John Heins, creative director and co-founder see BRUFROU Page 54

If no requests are made for a collaboration, the BruFrou team considers beer styles compared with food styles, clientele, brand alignment and the concept of both the eateries and breweries.

“We paired Finkel & Garf with Glazed and Infused Donuts. Both have super light-hearted brands that focus on the fun of creating taste sensations, without taking themselves too seriously,” Heins explains. Finkel & Garf (of

Boulder) will be bringing their Rye Saison and says once they met the team at Glazed and Infused, they knew they had a “stellar combination.”

A chefs’ motivation for what dish they’d pair with a brew is quite eclectic.

Dakota Soifer, chef and owner of Café Aion, says he will generally pair hoppy beers with something “a little fatty,” such as pork. This is particularly important in this case since they are eagerly looking forward to teaming up with

High Hops Brewing because the brewery grows their own hops.

Zeal’s Head Chef Leslie White, who is teamed with 12 Degree Brewing, says she hopes to use the beer in the cooking process.

Davin Helden, CEO of Liquid Mechanics Brewing Co., wanted to pair with a gourmet restaurant who did things similarly to how they create beer.

their brews have deep aromas and flavors that would pair well. Head Chef Scott Bauer came to the brewery to taste beers with Brewer Seth Townsend.

They sampled the brews, talked about which menu items might work and decided on the Imperial Porter.

“We think the event should be seen as an educational one for everyone involved and the general public,” Helden adds.

But not all dishes are going to be created by a duo. The Post Brewing Co. is “pairing” with their in-house Goodbird Kitchen, and FATE Brewing Company is on their own. FATE is preparing a crostini with housemade smoked sausage, herbed goat cheese, pickled green tomatoes and fresh cracked pepper to be paired with their Laimas Kolsch Style Ale, a 2014 Gold Medal winner at the Great American Beer Festival.

“Flavor, seasonality and execution are the biggest for us,” says Tim Berry, FATE Brewing head chef.

There is also a strong effort to expand the fest’s offerings. A private website is open to the eatery partners, where they choose from a series of main ingredient options — beef, pork, poultry, vegetables and sweets along with main dish types like pizza, ceviche, sliders, soup, taco, mousse and more.

“The idea is to curate a more diverse option menu for attendees and also challenge the chefs to collectively create a menu that has something for everyone,” explains Co-Founder Heins.

Setting this event farther apart is the unique backdrop: the Wings Over the Rockies Museum in Denver, a World War II-era airplane hangar.

“The venue alone makes this event hard to miss,” says FATE Brewing owner Mike Lawinkski.

Tickets are still available for the afternoon session (1-4 p.m.) and the evening session (5-8 p.m.). A full pairing ticket includes all-you-can-enjoy beer and food, a Belgian beer tasting glass and a party plate with tasting glass holder ($95). Food-only tickets are $65.

BruFrou also offers a TastyTalks Session (11 a.m.–12:30 p.m. before the tasting session) to learn brewer and chef insights and to enjoy food and beer pairings. Boulder area chefs include Kyle Mendenhall from The Kitchen, Dave Query from Big Red F Restaurant Group and Kelly Whitaker from Basta and Cart-Driver. FATE Brewing’s Lawinski and brewmaster and cofounder of The Post Brewing Co., Bryan Selders, will be sharing their insights as well.

to get a better handle on edibles. But how much more can it do? This case shows once again that there will be a tiny minority who, for whatever reasons, aren’t going to read labels, pay attention to what the bud tender is saying or just doesn’t give a good goddamn and is going to push the limits.

So the suggestion that this is somehow the fault of the cannabis industry or the state’s regulations or legalization just doesn’t wash. The cannabis was sold to an adult, and the packaging explicitly said how much each dosage was and that the effects might be delayed.

Nobody wants things like this to happen. But honestly, what more could the state or the industry or anyone else have done to stop this?

Colorado retail cannabis sales continue to rise. State retail outlets sold $39.2 million worth of cannabis in February, the most in any month since legalization began in January 2014.

That’s up from January sales of $36.4 million.

In terms of taxes, last year $10,290,536 was raised for school construction projects, and in both January and February of this year more than $2 million has been moved to the school fund. A common misperception is that the money is going to school district operating expenses. It’s not. Funded by the 15 percent excise tax on wholesale marijuana, the money does contribute to the Building Excellent Schools Today program in the form of grants for school building repairs, construction and security updates. It provides money for proj-

ects as diverse as repairing a roof or making fire or safety code improvements as well as constructing new school buildings. The BEST program is also funded by money from the state land trust and leftover Powerball profits.

At least some of the latest sales growth is because the city of Aurora, tired of watching its citizens drive into Denver to buy cannabis, now has nine stores open, with more on the way. I think this is also indicative that more people are feeling comfortable about going into retail shops. Some expected legalization to immediately end the black market. But let’s face it, an illegal trade that developed and actually flourished over a half century isn’t going to be wiped out by 15 months of legal marijuana sales in Colorado. Given time, education, acceptance and more states legalizing, that market should continue to diminish.

The U.S. Border Patrol recently announced that it was seizing less and less marijuana coming into the country from Mexico, another consequence of legalization. In 2011 it confiscated 2.5 million pounds of pot; in 2014 that number went down to 1.9 million pounds. And Mexican authorities saw a 32 percent decline in tons of marijuana apprehended.

I saw a news story last month about one of those seizures in California that included a photo of a small truck whose back door was open, exposing 20 or 30 smuggled “bricks.” I laughed out loud.

Anybody trying to smuggle that shit to Colorado is crazy — that’s ditch weed, dudes.

AS THE WORLD TURNS (MONSANTO’S WORLD THAT IS) OK, let’s recap a little bit. First we told you about the World Health Organization declaring that glyphosate — the main active ingredient in Monsanto’s Roundup pesticide — is probably carcinogenic to humans. This was a really big deal because Monsanto has been claiming for years that this stuff is completely harmless and as result, the whole world has dumped tens of millions of tons of this crap on itself.

Well, the next thing to happen in this ongoing chemical soap opera was for Monsanto to demand a retraction from WHO of its conclusion that glyphosate isn’t good for you.

WHO responded something like “stick it.”

This week the saga continues with Jack Dykinga multiple news outlets reporting that this “probably carcinogenic” glyphosate is being found in products we use everyday including honey, baby formula and even the breast milk of new moms. That’s scary stuff. Why is this happening?

According to Ken Cook, president and co-founder of Environmental Working Group, “When chemical agriculture blankets millions of acres of genetically engineered corn and soybean fields with hundreds of millions of pounds of glyphosate, it’s not a surprise babies are now consuming Monsanto’s signature chemical with breast milk and infant formula. The primary reason millions of Americans, including infants, are now exposed to this probable carcinogen is due to the explosion of genetically engineered crops that now dominate farmland across the U.S.” Wow, sucks to be us. Too bad our country won’t ban or require labeling of GMOs like all the other nations of the civilized world.

So what happens next? Apparently we are getting ready to hear about a lot of additional foods that we eat being contaminated by this “probable” cancer-causer.

According to Reuters, there has been a major increase in requests to have food products and people tested for glyphosate ever since the WHO report came out.

ARE HUMANS TOO STUPID TO LIVE? A funny thing has occurred over the last half-century or so: Our eyesight has gotten steadily worse when it comes to what’s known as nearsightedness.

According to a report in the journal George Hodan Science, myopia — aka nearsightedness, which requires corrective lenses —is getting out of hand globally. In China, for instance, 90 percent of young adults have it today compared with only 10 percent or so 60 years ago. In the U.S. and Europe, we’re also losing our vision in the same way.

Our rates of nearsightedness have doubled in the last six decades.

So what’s going on? Has some strange virus infected us? Are solar flares blinding us? Is it because we now binge watch entire seasons of our favorite shows on Netflix in a single session? Nope. Well, that last one might have a little to do with it.

The truth is, we are going blind as a species because we no longer are exposed to sunlight. Not kidding. Our newer generations are spending so much time indoors that the shapes of their eyes are actually being distorted causing nearsightedness.

We really are too stupid to live. If we weren’t already so blind, we could probably look into the future and see our final evolutionary stage, the one where we’ve become six foot tall sightless mole people covered in loose pink skin… still watching back-to-back episodes of Breaking Bad.
