Highroad Why Trumpcare is sickening

s Democratic Rep. Lloyd Doggett of Texas noted, “When you buy... a new pair of pants, it usually helps to ask two questions: What does it cost?

What size is it?”

Yet, as he was pointing out, Republicans in Congress want to ram their new Trumpcare health scheme into law without anyone knowing its size or price.

However, we do know this: As usual, GOP congress critters have

rigged their bill so it greatly enriches corporations and the rich, while grossly punishing the elderly, the working class and the poor.

Start with the rich. In February, Trump’s treasury secretary flat-out promised there would be “no absolute tax cut for the upper class.” Only one month later, the Trumpcare bill turned his promise into a flat-out lie. The bill provides tax cuts of $158 billion to the wealthiest Wall Street investors, $145 billion to insurance corporations, $25 billion to the drug giants and $20 billion to medical device corporations.

Meanwhile, even though Trump himself promised to lift up hard-hit working-class families, calling them America’s “forgotten men and women,” his health care plan turns the candidate’s campaign promise into a presidential lie. Trumpcare

would let insurance corporations cut their benefits and drastically raise the price of coverage — including being allowed to charge older workers and retirees five times more than young people would pay for the same policy. And good luck if you’re a poverty-wage worker — the Republican bill slashes $880 billion a year in Medicaid funds, literally cutting off millions of poor people from getting basic health care.

For those who wonder where inequality comes from, there it is.

Trumpcare would deliberately increase inequality by transferring billions of dollars in wealth from the working class to the ultra-rich.

ormer Boulder City Councilman Steve Pomerance had an op-ed piece in the Daily Camera last Sunday that appeared under the headline “Is this the end of Boulder as we know it?”

The brief answer to the question is yes, and for the reasons Pomerance marshals.

Pomerance’s thesis is that the basic charter amendments, ordinances and resolutions that have protected Boulder’s environment, character and quality of life for half a century are being systematically dismantled.

Nearly all of these core policies, which constitute Boulder’s unwritten environmental constitution, are under attack or soon will be. The hit list includes: The Boulder Valley Comprehensive Plan: A pro-growth/pro-densification faction on the City Council — consisting of Matt Appelbaum, Aaron Brockett, Jan Burton, Andrew Shoemaker and Bob Yates — wants to change it to eliminate the provision that requires urban development outside the city but in Boulder’s planning area to pass “four-body review.” Four-body review means that changes to the plan that would allow such development have to be approved by the City Council, the City Planning Board, the County Planning Commission and the County Commissioners.

The pro-growthers want to cut the County Planning Commission and the County Commissioners out of the decision-making process — probably out of fear that the county bodies might stand in the way of some of the progrowthers pet projects — as happened when the County Planning Commission shot down the Twin Lakes high-density housing atrocity.

Four-body review was written into the plan in the 1970s, precisely because local governments, including Boulder’s, routinely tore up comp plans whenever the flip-chart and wing-tips crowd showed up with a “very special, oncein-a-lifetime” mega-project — often with the pig wearing affordable housing or new urbanist lipstick.

Boulder (with the exception of those built by the University of Colorado Boulder, which isn’t covered by the City’s charter provisions). Pomerance says he expects to see a push to scrap it.

“There is a plan, supported by the Boulder Chamber, to massively densify the East Arapahoe area, including buildings of well over the 55-foot height limit,” he says. He expects the current majority on council to put a charter amendment to do this on the ballot for the next election. He also expects to see the city’s current moratorium on buildings higher than 35 feet (but lower than 55 feet) abandoned.

Current zoning densities: It’s no secret that the current council majority has been flirting with a back-door upzoning of Boulder’s existing residential neighborhoods, using gimmicks like allowing so-called mother-in-law apartments in the single-family homes. Now they’re evidently going to try the frontdoor approach.

Pomerance says there is a survey in progress “allegedly done by an ‘independent organization,’ asking people about their support for cutting minimum lot sizes in half, allowing duplexes in place of single-family residences, and legalizing two homes on one lot. It also asks for favorability ratings for local organizations, including Open Boulder, Better Boulder, the Chamber of Commerce, Boulder Neighborhood Association, and PLAN-Boulder.”

Surveys of this sort generally cost $20,000-$30,000, and are often followed by a full-court press at the ballot box. (Chances are a developer front group, like the Chamber, Open Boulder, or Better Boulder, picked up the tab. Pomerance said PLAN Boulder and the Boulder Neighborhood Alliance told him they didn’t.)

The usual justification for densifying Boulder is that it will make housing more affordable and, when combined with mixed-use zoning (zoning that allows various residential and commercial uses in the same neighborhoods and sometimes in the same buildings), reduce traffic.

It’s a beautiful theory that has been repeatedly mugged by ugly little facts.

For years, Boulder’s social liberals and the Boulder City Council have been obsessed with creating more “affordable see DANISH PLAN Page 8

It has come to the attention of Boulder Weekly that the quote in question was from an email exchange from several years ago. BW has also learned that the email exchange between Hurrell and Metcalfe was a private exchange and at no time was Hurrell ever made aware that his words could be used for publication. The March 23 Lab Notes column makes no mention that the Hurrell statement was several years old and therefore gives it the appearance of having been from a recent email exchange. Boulder Weekly’s editorial ethics dictate that people being interviewed must know from the onset that what they are saying may be published in the future. Great rebuttal to Danish!

Thank you, BW, for featuring as a guest column, the very well-written, empathetic, and factual piece by Dennis Duckett [Re: “Danish is all about propaganda,” March 16]. I also tire of Paul Danish’s “regurgitation of right-wing propaganda”— his classing the protesters at Standing Rock as “slobs” was one of his most egregiously distorted pack of lies.

I only hope that Mr. Duckett will further publicize the facts and truth that he witnessed at his various visits to Standing Rock, as even the conventional media fell far short of presenting the full story on how the protectors were victimized in trying to clean-up their encampment site.

Ted Kennedy who, in 1962, began a 40-year career writing laws to improve cancer research, health insurance, disability discrimination, AIDS care, civil rights, mental health benefits and children’s health insurance. Millions throughout this great country and world, we all knew.

What do you expect from a party that won the White House with derision and ultimatums? After eight years, Republicans have hate and obstruction down to a science. Of course, addressing selfish, superficial, destructive behavior in Republicans’ should not distract us from addressing the hateful things Democrats say and do.

providing even the most basic health care at a reasonable price people can afford? The Republican proposal does nothing to improve access or lower costs. It penalizes the elderly and the working class in order to pour more money into the pockets of insurance companies and drug manufacturers.

Let’s implement a fair system. Get rid of insurance business and provide care directly to the people. Health care does not need to be free. That would cause abuses. But it needs to be in line with real costs. I for one am seriously condidering dropping my insurance altogether if Obamacare ends. I have better uses for my hard earned money than lining the pockets of insurance companies.

I am deeply troubled that Sen. Gardner voted to legalize killing baby animals and hibernating bears on refuges (i.e., OUR public lands) throughout Alaska via House Joint Resolution 69, a resolution to nullify a U.S. Fish and Wildlife Service’s rule that protected these carnivores, which passed Tuesday, March 21. Why should we care in Colorado? We should care because it’s messed up. It sets a precedent across the county that inhumane and unsportsmanlike behavior is acceptable — clearly Sen. Gardner thinks so. Our rooted respect for the land, mountains and wildlife in Colorado defines us as a community and Sen. Gardner does not reflect that.

Just want to say I smoked pot at 16 years of age and most of my 20s. I am now 65 years old. Then one day I decided no more (too much lethargy). So much for the “evil pot addiction.” Never thought much about it again.

Could have had some anytime, especially after it became legal and some friends were growing it or I could get medical or recreational pot easily.

Meanwhile, I did go through a bout of “real” drug addiction around the age of 20 when I ran into a high school girlfriend who was involved with heroin and I allowed myself to get involved (unfortunately). After about one year I landed in jail for a while, which helped me withdraw and upon release, never looked back. Fast forward to a year and a half ago, I elected to receive knee replacement and was given generous prescriptions of hydrocodone and codeine (narcotics). After three days of taking codeine (which still feels fine to me), I decided I needed off the drugs because of very bad digestion problems on top of other recuperation traumas.

Then I discovered “The Drops.” An edible that enabled me to take very slight doses and brought back much appreciated sleep! (Throbbing after knee surgery really sucks at night when trying to sleep.) So just want to say BEEN THERE DONE THAT! I know what real addiction is (I still have a needle track scar) and smoked pot over 10 years everyday as well, and I can personally vouch it’s not addictive. (I quit cigarettes, too — much worse!) Smoking or using pot is a CHOICE and not one see LETTERS Page 9

housing,” whatever that means — to the point of sacrificing more and more of Boulder’s environmental values on the affordable housing altar. Boulder progrowth interests have seized on this opening and used affordability and diversity as pretexts for maximizing build-out, by rebranding densification and high-rise development as environmental goods.

And the libs drank the kool-aid.

The result? According to a story in the March 17 Camera, a study by the Longmont Association of Realtors and Land Title Guarantee Company found that there is no affordable housing currently available in Boulder County, let alone the City of Boulder. Zero. Zip. Zilch. Nada.

At the time of the study, there was

exactly one single-family home for sale in Boulder under $250,000 and two attached units for sale under $150,000.

As for traffic being reduced by greater densification and mixed use, Boulder’s traffic congestion has taken quantum leaps upward in the last three years, and it is at its worst in the areas that have seen the most intensive densification — starting with the 28th and 30th street corridors, which are also among the least pedestrian-friendly and most architecturally oppressive areas of the city.

The upshot is “Boulder as we know it” is no longer Boulder as we knew it — even a few years ago. And if the madness doesn’t stop, what’s left of Boulder as we knew it is toast.

tions bills. Party politics, insider backscratching and concern for the common good usually result in appropriations that generally reflect the proposed budget. Trump, elected by a minority of voters and therefore carrying no mandate, submitted a budget proposal that grossly differs from what the majority of Americans believe is important for our country’s health, prosperity, security and freedom. It merits no consideration.

Congress will best support Americans through an appropriations package that ignores Trump’s proposed budget, incorporating the middle class economic support that this past election demonstrated is needed while continuing a reasonable level of support for the social progress that our country has championed for the past several decades.

Congress’ responsibility is to act on our country’s behalf. It is our

responsibility to encourage our elected representatives to work together and to promise our support when they do.

We must urge them to use the budget to produce targeted political gains and flash-point-avoiding compromises to keep our country great, begin the social healing process and re-establish confidence in our system of government.

Bennet voted correctly

It was heartbreaking watching the House of Representatives pass House Joint Resolution 69, which allows egregious and cruel killing methods on 76 million acres of federal public lands in Alaska — but it was positively gutwrenching watching the Senate follow suit. With this vote, Congress has now voted in favor of wolf pups being killed in their dens, and grizzly bears being caught in barbaric steel-jawed leghold traps and wire snares.

I want to sincerely thank my senator, Michael Bennet, for voting against this horrible resolution. I’m grateful that the Senate has members willing to listen to their constituents and stand up against this cruelty. Those that voted yes on the resolution should be ashamed of themselves.

Social media has made it easier than it’s ever been for constituents to contact their lawmakers, and I appreciate the responses I’ve received from Sen. Michael Bennet.

Now H.J. Res. 69 is headed to President Trump’s desk, and I implore him to listen to the vast majority of Americans who do not want this to pass.

Congress’s chance to lead

Trump’s shallow, paranoid leadership that has increased our country’s social schism promises to do the same with the country’s economic class division, and has damaged our international reputation. The new administration clearly has no clue how to implement important economic and social reforms without destroying the past 50 years of societal gains. As a result, Congress is in the unusual position of being able to drive this effort. Achieving this will require a level of cooperation between chambers and between parties that has been missing these last 20 years or so. Doing so will greatly contribute to restoring confidence in at least one branch of our government.

Editor’s note: For several years now, Boulder Weekly has been covering the hardships Front Range families face when a loved one is held in immigration detention and/or deported. For the most part, our reporting has ended at the time of deportation, but the truth is, that is only the beginning of the story for many such families.

We first met and reported on the Guerrero family in January 2015. Luis was being held in detention while his wife Sofia and four children struggled to get by in his absence. Shortly thereafter we reported that Luis had been suddenly deported to Mexico without any prior notice to his family. That is where our previous reporting stopped.

Eventually, Sofia had little choice but to take her three youngest children, all U.S. citizens, to Mexico in an effort to keep the family together.

Needless to say, it’s a very difficult transition for them.

This time around, we have stayed on the story.

Last year we sent Angela K. Evans to a small town

north of Mexico City to reconnect with the Guerrero family. She has also stayed in touch with the oldest son Andy, who still lives in Colorado.

This week we give you the first installment in a series about this remarkable family. We hope it will resonate with you, especially in these times of extreme difficulty for our immigrant communities.

And with that, Boulder Weekly is pleased to present the rest of the story, that is to say, the rest so far.

eated at his mother’s grave for the first time, Jose Luis Guerrero grieved not only for her, but also for his wife and children. Though still alive, they were thousands of miles away at home in Aurora. For almost 20 years, Guerrero, who goes

by Luis, lived and worked in the U.S., mostly in Colorado, starting a family with his wife Sofia and raising their four American-born children, Andy, Jenny, Melody and Lucy — ages 18, 15, 9

and 4 respectively. But after his deportation the previous week, Luis now found himself in a place that no longer felt like home.

All of Luis’ siblings died as children.

His mother died the year before his deportation, without seeing her only living son in years. His father is his only family left in Mexico, and his home state of Nuevo León has grown increasingly dangerous since he left, plagued by violent drug cartels and corrupt cops.

So Luis considered crossing the border back into the U.S. “I know that I’m not from there, but I don’t belong here,” he told his dad as they sat in the graveyard together.

Living in Mexico just didn’t make sense; he didn’t feel like he belonged there; he belonged with his wife and kids.

“I was thinking, if I go no one will miss me, but if I stay there’s my family,” Luis says.

He remembered going out to breakfast as a family and playing baseball in the backyard with everyone on weekends. He pictured his kids laughing and screaming on the roller coasters at Elitch’s, and the pride he felt when they talked about school and going to college someday. He sat and thought about all the seemingly trivial things that brought him daily comfort in his life in Aurora. “We had a small patio in the back and at the end there were these windows that the sun always came through,” he says.

Luis is an intricate and sometimes long-winded storyteller. But his animated recounting of events is captivating. “I could write a book,” he repeats throughout our conversations. And I believe him.

After visiting the cemetery that day, Luis started making plans, figuring out the safest way to traverse the southern U.S. border undetected. Things had changed since he first made the crossing in the early ’90s. Back then, he simply walked across the border and continued traveling north. Now there’s the cartel to consider, and the militarized border patrol. And of course there’s the risk of being detained if he made it to the U.S. “I was thinking, but what if I try to go back and they put me back in prison? I had just left prison and I didn’t want to go back,” Luis says. “No matter what, after you leave prison you feel good because you are free.”

Before his deportation, Luis spent almost six months in immigration detention at the Immigration and Customs Enforcement (ICE) Denver Contract Facility in Aurora, operated by the private prison corporation the GEO Group, Inc. While fighting to stay in the country with his family, he was held in prisonlike conditions under constant surveillance, allowed to see his family once a week during visiting hours.

Faced with the reality of being thrown back into detention at the hands of ICE, Luis once again reconsidered his plan to head north across the border. But how could he live so far away from his wife and kids?

He still couldn’t reconcile a life in Mexico without them. It felt like an impossible decision.

• • • • Luis and Sofia lived in Aurora for more than a decade, raising their children and building their careers. Like most families, they balanced the workweek with school schedules and the kids’ activities.

She worked at Burger King for five years before moving into the cleaning industry, eventually starting her own business. He worked in construction, also starting his own company in the summer of 2014. They paid taxes, owned their cars and wanted to plan a vacation to Disneyland.

“Everything was going so well,” Luis says. “But in a moment, everything changed.”

Early one August morning that same year, Sofia was awakened by a knock at the front door to their Aurora house. Luis was in the shower and their youngest daughter Lucy was still asleep. The three older children, Andy, Jenny and Melody were finishing their summer break in Mexico with their maternal grandparents, easily traveling across the border with their U.S. passports.

Sofia opened the inner door to find ICE agents standing on the front stoop behind the glass outer door. A few days earlier, one of Luis’ workers was driving the company truck when he was pulled over.

The police didn’t ticket the worker, himself undocumented, but did take down Luis’ information from the car registration. Although the employee informed Sofia and Luis about what had happened, the couple thought little of it — until Sofia saw ICE agents around 6 a.m. that morning. One of the female officers asked for the employee in Spanish, Sofia remembers, noticing a slew of officers on her front lawn and several ICE vehicles in the street.

“I told them he doesn’t live here,” she says.

Sophia says the officer never introduced herself or showed her any ID, and Sofia talked through the glass, refusing to let the agents inside unless they could show her a warrant.

But in that moment, the agents around the house were pulling out their guns.”

At this point, Sofia went to get Luis, afraid the officers would wake up Lucy.

“I was strong but I was scared when I saw the guns,” she says.

When Luis came to the door, the agents grew increasingly aggressive, asking for his cell phone and identification. In the middle of all of this, Lucy woke up and Sofia held her at the front door while the agents attempted to draw Luis out of the house.

Finally, he handed them his cell phone and valid New Mexico driver’s license, but still refused to cross the threshold. Eventually, the agents left, leaving his things on the front lawn.

Relieved for the moment, Luis and Sofia immediately called a lawyer, who told Luis not to leave the house. For two days, he stayed inside, only occasionally going into the backyard, afraid that if he even stepped out the front, ICE would arrest him.

But one day, he had to leave for work. He was trying to get a contract to build a big apartment complex near Coors Field and couldn’t afford to miss the meeting.

By the time Luis reached the end of his street, ICE officers had him surrounded. They asked him to step out of his truck, then proceeded to cuff both his wrists and ankles. “He put them on really tight,” Luis says. “I asked him to make it bigger because it’s hurtSee HERE AND THERE Page 12

ing me but he did the same with the other hand.”

Sofia, returning from dropping Lucy off at a babysitter’s, saw Luis inside one of the unmarked vehicles and recognized the same female ICE officer she’d seen on her front lawn a few days before.

Sofia stopped and asked her why Luis was being arrested.

“She answered, ‘I left a paper in the truck and that’s all I can tell you,’” Sofia says. “It was not in a good tone.”

Sofia stood in her driveway, helpless, as Luis was driven away. She was in complete shock, unaware that she wouldn’t be able to touch her husband again until they reunited more than nine months later.

They took Luis to what he calls an “immigration station,” not a police station and not the detention center.

They removed the cuffs and fingerprinted him, speaking to him in Spanish but showing him paperwork in English. Someone offered him voluntary departure papers to sign, which would require him to leave the country quickly and of his own accord, avoiding detention and giving up the legal right to fight his case in immigration court. He refused. Not only could he not read the English document, he was unwilling to give up so quickly, to leave his family behind so definitively.

His refusal to leave voluntarily triggered expedited removal proceedings due to previous deportations.

More than a decade before, when Andy and Jenny were small children, Luis had been forcibly removed 12 March 30, 2017

from the country while living in McAllen, Texas. He was deported again attempting to cross the border.

Each time, he was held in jail for one night and then released on the other side of the border. And each time Luis came back — back to his family, back to work. Although he hadn’t had any run-ins with ICE for more than a decade, these deportations remained on his record.

That day in 2015 he was taken to the GEO detention facility in Aurora, one of some 200 such detention centers around the U.S. currently detaining 40,000 people. The conditions at many private detention facilities are often substandard, including inadequate health care, safety and security, as well as the use of solitary confinement, raising alarms with both advocacy groups and the Department of Justice. A March 2017 class-action lawsuit against the private prison corporation GEO Group, Inc. also alleges the use of forced labor and violating antislavery laws, specifically citing the Aurora facility where Luis would spend the next several months.

Sofia waited to tell her three older children what had happened until she picked them up from the airport the following day. Although Andy and Jenny had spent several summers at Sofia’s parents’ house in Ixmiquilpan, located three hours northwest of Mexico City, it was Melody’s first time away from her parents for so long.

“It was so sudden,” Andy says of his dad’s deten-

tion. “I knew that it was a possibility and it was one of the fears that my family faced, but I’d try not to think about it. I knew it was out there but you could say it was kind of vague until it started orbiting on top of us.”

Even a couple years later, he is emotional talking about his first visit to see his father at GEO. “Seeing him behind a piece of glass and only being able to talk to him through a phone kind of crushed me,” he says.

The family all sat together to talk to Luis, separated by a thick window. Lucy, only a toddler, looked under the counter to see if she could get through to hug her dad, then she ran over to the door at the far end of the room to try and get to him. All the kids cried that day.

“I really wanted to tear the walls down when they came to visit me the first time,” Luis says.

“You’re frustrated because your family cannot hug you. They can see you, but they cannot touch you.

When the time for visits is over you have to go in that moment and that’s it,” he says, snapping his fingers.

A few days later, Sofia went back to cleaning houses, while trying to also figure out Luis’ immigration defense, and the kids returned to school.

As Andy began his junior year of high school, everything had changed. As the oldest, he now had the extra pressure to help his mom pay the bills.

“There was a sudden weight on my shoulders,” he says. “It was a weight that both my mom and I carried.”

He picked up a job at the Pepsi Center, “sweeping the floors, cleaning up beer.” He’d start at 5 p.m., often getting off at midnight or 1 a.m., only to ride the bus for another hour to get back home.

Eventually, Sofia took a second job cleaning local churches at night, and Andy quit the Pepsi Center to help her, starting at 8 p.m. and finishing up around 3 See HERE AND THERE Page 14

a.m. They would grab just a few hours of sleep before getting up for school and work, and doing it all over again.

But through it all, Andy remained resolved to finish high school and get into college. He started spending a lot of time alone, afraid his friends would distract him from his goal.

“College was my number one priority and I stopped talking to a lot of people because I was like they aren’t going to help me, they might even pull me down, even if that means that I have to be alone,” he says.

The weekend routine changed too. Instead of playing games together or exploring Denver by light-rail as a family, Sofia and Andy spent Saturday night cleaning, Lucy often falling asleep on the couch in the church office while they worked.

And they would all go to GEO to visit Luis, allowed only one hour of visiting time for the entire family. Andy says it was too painful to talk to his dad about how his life at school and work had changed.

“I didn’t want to talk about anything else besides how he’s doing,” Andy says. “I know it was hard; we were out here and he was inside.”

So Luis would talk to his family about life in GEO — how bad the food was, his lack of freedom, what he missed.

He’d talk about the Hispanic butcher shop across the street from their house, smiling as he thought about the carnitas, chicharon and other Mexican meats. “But there (in GEO) they just gave me damn bread everyday,” he says.

He’d watch families on TV eating together, a constant reminder of what had been taken from him. His life had been reduced to memories.

He’d recall birthday celebrations and holidays, school activities and simply watching TV together in the evenings.

“I’m very close with my family,” Luis says. “One day they took them away from me and that’s when they cut my wings.”

The only hope Luis was able to offer his family were the stories of someone else’s release. He told his wife and children every time someone won their immigration case and was allowed to go home to their families. For months the entire family held onto the hope that it could be Luis next week, that he would be home in time for the holidays, that the entire ordeal would be over.

“That was the hope that we had,” Andy says.

As the weeks turned into months, and the winter holidays approached, it became evident Luis might not win his appeal to remain in the U.S. with his family. His hope was slipping away.

He says it felt like he was wasting his days, even comparing himself to Marty the Zebra in the animated film Madagascar which he had seen with his kids.

“I’ll be here all week,” Marty tells zoo visitors. “In fact, I’ll be here my entire life. 365 days a year.”

Often frustrated by seeing others come and go, Luis didn’t understand why they were holding him for so long. He watched as other detainees were released after just a week or two, people he says were accused of domestic violence, caught growing marijuana in their homes or had criminal records.

It was one of the only distractions he had; the other was talking to the pastors and priests who came to talk to the detainees.

“When you’re outside you just see Bibles go by and when people try to share with you about God you are always busy and you say, ‘no,’” Luis says. “And inside when you are with your Bible and that’s the only thing you have, that’s when you learn to talk to God.” He would often stay up late, reading the Bible until he fell asleep.

Meanwhile, Sofia continued to work on his legal case with the help of advocates and lawyers. She says she paid more than $4,000 in lawyer’s fees, which got her nowhere. She filed a stay of removal application, which would allow Luis’ release, citing their four U.S.-citizen children. But the application was denied.

When then-President Obama announced the Deferred Action for Parents of Americans (DAPA) program by executive order in November 2014, the family once again got their hopes up. The program would have granted deferred action and work permits to thousands of undocumented parents of U.S. citizens, however, a Texas Judge soon blocked it. As Luis sat alone in GEO, Sofia and the rest of the family waited.

It was almost too much for them to handle.

The entire family would cry at the weekly GEO visits and Sofia cried in court every time an immigration judge ruled deporting Luis wouldn’t cause a hardship on the kids. The family was living through the opposite reality. The hardship was unbearable.

Andy was mad — angry that his dad was being detained, mad that neither he nor any number of lawyers and advocates who were helping the family, could do anything to get him out.

Fourteen-year-old Jenny was taking it especially hard.

“I was depressed,” she says. “I didn’t talk to anyone at school.”

“Jenny was always really close to her dad,” Sofia adds. “He’s a dad that is very close with his daughters. I don’t know, maybe she wanted to blame me. But she became very aggressive and I was trying to do my best.”

As she became more and more reclusive at school, Jenny acted out more and more at home, often fighting with Sofia. She tried to be upbeat on her weekly visits to the Aurora facility, but would end up leaving feeling worse than when she walked in. And she tried to go to every one of Luis’ court dates, hoping to see her father without a glass barrier between them, even if she still wasn’t able to touch him or talk to him.

At his final court date, when the judge gave the final deportation order, Jenny was there, sobbing in the gallery.

“He wanted to hug me but they wouldn’t let him,” she remembers. “You never know when it’s your last time seeing them.”

In a last ditch effort, Sofia appealed to Sen. Michael Bennet through the help of immigration advocates. She was told ICE would not deport Luis until Bennet was able to talk to them. That meant he’d be in Aurora for a few more days at least, or so she thought.

• • • • Early one morning in late January 2015, several guards came into Luis’ cell, demanding he sign yet another piece of paper he couldn’t read. For the most part, Luis says the immigration officers at GEO intimidated him. “You have to do what they say and that’s it,” he says. Regardless, he says he was often accused of disrespecting the officers when he wouldn’t do what they wanted, even if it was asking other detainees to translate for him. When he refused to sign the paper, which he later realized was his deportation order, Luis says the ICE officers were violent, wrestling him to the ground, hitting him and forcing his fingerprint on the paper.

“They took my fingerprint and said the fingerprint is more valuable than the signature,” he says.

In the process, Luis hurt his knee and in turn lashed out, telling them “really bad things,” scared by their actions. One officer warned him, he says, telling him to be careful because they had started their body cameras. It wasn’t the first time immigration officers were violent, Luis says. One time an officer even threw food at him. But, the security cameras were often turned off at GEO, he says, and he has no way to prove he or anyone else was mistreated.

He understands it’s their word against his and doesn’t really think sharing his stories will change anything.

“You won’t find any evidence they hit me,” he says.

“There’s no way to prove what they did. It’s impossible.”

After the fingerprinting incident, officers led him to a van. At first he thought maybe he was being released since there weren’t any other detainees with him. But the van traveled several hours before stopping. Luis still hoped it was a Greyhound station and they were sending him home, but he soon realized this wasn’t the case.

New Mexico. He only found out where he was by asking a guard. The next day, they gave him a winter coat, which he still has, and returned his wallet after removing his driver’s license and any other form of identification he had.

“They said, ‘This stays here. If you’re Mexican, what could you want with a U.S. ID?’” Luis remembers. His license didn’t expire for another year.

After a few more hours of driving, Luis stepped out of the van surrounded by immigration agents. As he looked around, he realized he was at the border. Juarez, Mexico, could be seen in the distance.

Just as suddenly and unexpectedly as Luis was taken from his life in Denver and held in detention, he was deported back to Mexico before his family even knew he was gone.

“I tried to keep my hope but when I found out he was down there... ” Andy trails off. “I was demolished inside. I was broken. I was shattered in pieces.”

While his family grieved in Aurora, Luis found himself alone at the border. He started walking toward Mexico, leaving the ICE officers behind him, refusing to look back. Once he crossed into Juarez, he saw a man selling tacos from a roadside cart. Luis hadn’t eaten any decent food in months but he didn’t have any money either. As he walked by, the man asked him where he was going.

“I don’t really know where I’m going because immigration just threw me out,” Boulder Weekly

Luis answered.

The man offered him discada tacos, a mixture of grilled meats and spices, and insisted he take them even after Luis said he had no way to pay for them.

“I used to make this with my family,’” Luis told the man. “Before they took me, when I was together with my family at home, we used to make discada, frying all the meat and putting it on crackers.”

Another vendor offered Luis a Coke, which he happily accepted. It had been a long time since he had such a good meal. As he finished, the taco seller wrapped a few more tacos in tinfoil for Luis to take with him.

From there, Luis went to the Mexican immigration office at the border. He was frightened, not knowing what they would do and afraid they’d detain him, this time in Mexico. Instead, they brought him into the office and allowed him to use the phone. They directed him to the “house of immigrants,” he says, a place for recent deportees to stay a few nights, take a shower, get paperwork in order.

“That’s where I fell asleep and actually rested because I had a good bed, not like in prison where you had only a thin mattress,” he says.

At the immigration house, officials were able to secure a temporary ID for Luis and give him enough money to travel back to Monterrey, the capital of his home state of Nuevo León. With roughly 1,000 pesos (about $53) in his pocket, Luis was met by his dad at the Monterrey bus station. The next day, they went to the cemetery.

He recalls the last time he spoke to his mom over the phone. He was speaking to her just 20 minutes before she died, telling her that Sofia was going to be fine despite spending more than a month in the hospital with preeclampsia while pregnant with Lucy.

Luis knew she was sick, but she always told him not to come back to visit, not to risk separation from his wife and kids for her sake. “She always told me I need to take care of my family,” he says.

• • • • While Luis was deliberating what to do next, Sofia was making hard decisions of her own.

She decided to send Jenny to Mexico to be with her dad. Jenny’s aggressive and depressed behavior had increased. Then her school called.

Someone had found a note written by Jenny, describing how she had begun cutting herself, that she contemplated hurting herself further. Life without her father was too much for the young teenager to bear.

“So, I made the decision that if she Boulder Weekly

wanted to be with her dad then she should go be with him,” Sofia says. Luis was deported at the end of January 2015 and in March Sophia put Jenny on a plane to Mexico City alone. Jenny was ecstatic to see her dad, holding back tears at their reunion.

“I wanted to cry, but I was brave enough not to,” she says.

However, it was a temporary solution, hastily decided in an effort to save Jenny. The rest of the family remained in limbo. Back in Aurora, Sofia didn’t know what to do next. Should she

move back to Mexico too, leaving her life in Colorado behind, perhaps for good? Should she stay, hoping there was some way Luis and Jenny could return together? Or should the family remain separated? If that were the case, she would effectively be losing both her husband and daughter. The questions wore on her other children as well.

“It was just a hard thing to see my mom crying. I noticed her mood changed, she was just really bummed out all day, she just didn’t want to go out and see friends,” Andy says. “And

that’s how I feel now.”

Finally, Sophia made up her mind.

After months of working two jobs, raising four kids on her own and fighting her husband’s legal case only to lose in the end, she would also leave the U.S. Her three daughters would join her, American citizens who had never lived in Mexico before. Andy would stay in Colorado by himself to finish high school and, hopefully, go to college. It seemed the reality of Luis’ deportation had left the family with no other choice.

WildEarth Guardians file injunction to halt CPW’s predator management plans

n Mar. 24, WildEarth Guardians filed a temporary restraining order and preliminary injunction in Denver County District Court in their lawsuit against Colorado Parks and Wildlife (CPW), the Parks and Wildlife Commission (PWC), and the Department of Natural Resources (DNR). The injunction would halt implementation of CPW’s Piceance Basin and Upper Arkansas River predator management plans, which were unanimously approved by the PWC in December 2016.

The plans call for the annual trapping, snaring, hounding and killing of hundreds of mountain lions and black bears in the name of research intended to help with the recovery of the mule deer population in those areas.

Critics argue that the predator management plans are not based on sound science, the killing of mountain lions and bears is unwarranted and would have negligible impact on mule deer numbers (see BW’s “Off target,” Feb. 9, “Update,” Feb. 23, and “CPW and the oil and gas industry can’t have it both ways,” March 16).

According to Bethany Cotton, Wildlife Program Director for WildEarth Guardians, the motion for a temporary restraining order and preliminary injunction are necessary because CPW has indicated its intent to move forward with the killing plans despite WildEarth Guardians’ lawsuit. “Many animals could be killed before the judge rules on the case,” Cotton says, adding, “Our hope is the judge will enjoin CPW from setting traps and the like while the merits of the lawsuit are considered.” The plans would begin May 1, and an increase in the killing of mountain lions in the Upper Arkansas River area via increased hunting quotas began in Dec. 2016. CPW was unclear as to whether or not they’d contract Wildlife Services to fill Boulder Weekly

their kill quota should hunters be unsuccessful.

CPW declined to comment on the ongoing litigation.

WildEarth Guardians staff attorney Stuart Wilcox, along with attorneys Randall Weiner and Annmarie Cording are challenging both plans as well as the PWC’s process for their approval, arguing they violate the Colorado Constitution, as well as the Colorado Administrative Procedure Act. They claim, “because the planned trapping and snaring plans are lethal and are not bona fide scientific research projects,” they do not qualify for exemption from the trapping ban passed into law in 1996. According to the Ballot Proposal Analysis from that year, Amendment 14 provided an exemption for the use of certain non-lethal snares, traps or nets to take wildlife for purposes of scientific research. The lawsuit argues CPW’s plans are lethal, which CPW explicitly states is their goal.

Cording, Weiner and Wilcox argue that the Parks and Wildlife Commission did not make the “statutorily required determination that must precede such takings,” or killings, because they don’t assure maintenance of adequate predator populations and don’t preserve the proper ecological balance of the environment. In addition to this

procedural violation, the motion argues, CPW, PWC and DNR could not make a determination that there are adequate populations of mountain lions and black bears because they failed to obtain current site-specific mountain lion and bear population estimates.

CPW has explicitly admitted to this fact.

In an interview with BW on Jan. 11, Chuck Anderson, CPW mammals research section leader, said, “the question of how many bears there are before we start and after we start is not the primary question.”

And on Feb. 16, during a panel discussion hosted by the Colorado Legislative Animal Welfare Caucus, Anderson responded to Rep. Steve Lebsock’s (D-Northglenn) remark regarding the lack of baseline predator population data by saying, “Yeah, I think that’s a good point. It would be ideal to have carnivore population data associated with it,” continuing, “On the bear side, we don’t know.”

For now, the ball is in the courts where according to Cotton, “the judge will either rule on the briefs or hold a hearing.”

Over the past two decades, billions of dollars have been pumped into startup and early-stage clean technology companies as a result of the forum. Each year, 30 presenting companies, reviewed and vetted by an external committee of more than 80 investors and national incubators, are selected from a pool of around 150 applicants.

In 2015, Reeser knew he’d have to use his 10 minutes on stage wisely. In addition to attracting private investors, three winners receive technology assistance from NREL — a privilege that can help launch a company into the market spotlight.

That year, he was presented with the Best Venture Award after describing how his company’s braking system can significantly reduce not only fuel use, but also fuel emissions.

Since then, Lightening Hybrids has jumped right into the global clean energy market. Currently, they have 50 systems running in UPS trucks in Chicago; 68 systems are installed in paratransit buses in Boston; a Volvo company in India is running a pilot system, as is another in Mexico; in London, DHL uses the system in their delivery trucks; even NREL adopted Lightning Hybrids’ system in its shuttle busses.

On April 13, IGF’s next installment kicks off, including presentations from two Colorado-based companies: Forge Nano, developers of innovative nano-technology that can apply protective coats to the smallest materials on earth; and Vartega, a low-cost recycling company that develops carbon fiber for use in fabrics, 3-D printing filaments and thermoplastic pellets.

NREL forum helps clean tech startups

fter seven years as a conference attendee, in November 2015 Tim Reeser stood on Denver’s Grand Hyatt ballroom stage as a presenter at the two-day Industry Growth Forum (IGF), hosted by the National Renewable Energy Laboratory (NREL). Before him sat more people than he could count. Many were just like him — clean technology business CEOs and founders eager to pitch the promise of their up-and-coming companies. But some out there were bigwig investors — there to listen, score his pitch and maybe even strike up a deal if he was convincing enough.

As president and co-founder of Loveland-based Lightning Hybrids, a technology company that equips trucks and busses with energy-saving brake systems, Reeser was trying to make the ultimate sale.

As the U.S. Department of Energy’s chief national laboratory for renewable energy and energy-efficiency research, NREL identified long ago that the lack of funding for clean tech startups is one of the largest barriers to the industry’s advancement. Nearly every year since 1995, IGF has brought together the most innovative nascent companies from around the globe to help entrepreneurs

Aside from the presentation competition, the forum also organizes a networking session where more than 600 meetings take place. A panel of NREL’s expert clean-energy team members will address different strategies and challenges that emerging companies may face.

“We’re hoping to make as many connections as possible,” Cheesbrough says. “We want to create awareness and visibility not only of these new companies, but of the importance of clean energy.”

Additionally, IGF recognizes the diverse array of companies involved in clean technology. “When most people think of clean tech, they think about renewables,” says Chris Shepard, executive director of Colorado Cleantech, a Denver-based organization that has partnered with IGF since 2008. “But there are many more sectors that are included in clean tech that have the same outcomes — making the environment cleaner and more sustainable, like advanced transportation, energy efficiency in buildings, grid infrastructure, energy storage, water and air technologies.”

Especially with the Environmental Protection Agency high on the new presidential administration’s chopping block, Shepard says IGF will continue to play a pivotal role in propelling America’s energy future. Over the past decade, renewable energy markets have “advanced so quickly and prices have come down so drastically that wind and solar and other clean tech initiatives are price-competitive with coal plants, even without the [government] incentive,” Shepard says. “The markets, instead of policy, are driving the uptake and deployment of clean tech. Big corporations are saying they want to be 100 percent renewable and more efficient because their customers are demanding it.”

Plus, many companies attending IGF also cater to European markets, which generally have higher efficiency standards, necessitating innovations that go beyond American regulations.

“I refuse to let any administration dictate my business,” Reeser adds. “I’m going to find a way to create value for customers and world energy, and if I’m doing that successfully, I’ll do that regardless of political headwinds.”

As for his own business, Reeser doesn’t seem worried.

Rather, he sees the opposition as a chance to rise to the occasion.

“One of the challenges with a supportive administration was that they tended to pick favorites. If you were doing something out of ordinary, you maybe didn’t get as much support,” he says. “But I’m an optimist by nature, and I believe if we are creating good value, we’ll find the way, regardless of the political structure, to success.”

To Roubaix or not to Roubaix

few happy hours ago, I sat down with two cyclists to contemplate the Boulder Roubaix.

“I’m comfortable with the dirt,” Scott Forrest says. He’s more of a dirt guy — cyclocross mostly, and mountain biking — than a strict roadie. “The speed of the paved sections is always a bit daunting to me.”

Forrest has done the Roubaix before — three times in 15 or 20 years, including the last time around, in 2015. (It’s held every two years.) Over happy hour drinks that evening, he was still undecided on signing up for the 2017 race.

“It’s like doing two cross races,” Forrest says. The distance is one of the biggest hurdles for him: 74.8 miles, or four 18.7-mile laps. That’s the distance for his category — Master Men, age 40 and over, categories 1, 2 and 3 — and an extra lap longer than the last time he raced, based on his age and category at the time. He’s come to rather like the shorter distances of cyclocross competitions.

A few days prior, Clark Rider had just ridden the Roubaix course, in north Boulder, to get a feel for it. He’s more of a roadie-turned-cross guy, and although he’s also into the shorter cyclocross races, he’s on the fence as to whether to race this Roubaix for different reasons. It’d be his first time. On his training ride, he’d crossed paths with a couple on the same route. He asked if they’d be signing up for the Roubaix.

“It was the classic response,” Rider says, rehashing the exchange. “He’s like, ‘Yeah, I don’t trust roadies on dirt. I would never do a race like this because the last thing I want is to be in a pack of roadies coming around this corner.’”

That’s just what the Roubaix does: It brings roadies who don’t mind dirt and dirt hounds who don’t mind roads together, likely weeding out some of the more — how shall we say — uptight, traditional folks in the process. And for Rider, that’s the whole appeal of the Roubaix, which is 43 percent paved, 57 percent unpaved.

“That’s exactly why I’d do the race, because that’s one spot where I might have a little advantage,” he says. “Not that I’m that great at bike handling, but I just don’t worry about other people.

“I won’t be in the front of the pack, but I might be able to mix it up for a while,” he adds. He’s debating whether he wants to spend money on registration, just to “mix it up for a while” and then maybe get shot out the back of the pack to ride solo in the front for the rest of the long haul.

In 2015, Forrest actually spent a good part of the first lap leading the pack in his category, he says. He got an earful for it.

“I was miraculously at the front,” Forrest says. “When we transitioned off the dirt onto the pavement section, I was so far ahead I didn’t know what to do.

I relaxed. It still took them forever to catch me.”

He waited because he knew he wouldn’t have enough “gas” to power himself through the entire race at that pace without a little help from the pack — in other words, without “drafting” off of other riders, each one riding in the low-pressure wake of the cyclist in front of them, and all conserving energy (even the leader of the pack) because of it.

“When they finally caught me, one of the guys was like, Hey, don’t do that again, man. Relax and just drop in,’” Forrest says. “And at that point I just tried to manage somewhere in the front,” and hang on for dozens more miles yet.

He describes the last few sections of the Roubaix course: a long downhill to a hard right turn, and then onto a dirt uphill, transitioning into a stout climb, and finally a leveling off onto a long, dirt straightaway. In 2015, he says, it was hard to find the right pace across all that, and hard to gauge everyone’s level of aggression on turns and descents on the dirt. That hard right turn in particular was a cluster, he adds.

Crashes are not uncommon in the Boulder Roubaix, or in the Paris-Roubaix for that matter. For Rider, that’s about where the similarities end.

“Really the only connection as I see is there are sections that aren’t on pavement,” he says. “They’re racing on these cobblestones that are insane... It’s more the idea of a non-road race than it is a parallel race.”

The Paris-Roubaix, first run in 1896, was once called “the last great madness of cycling.” Slipping and bumping over uneven, often wet cobblestones at impossible speeds, riders frequently end up covered in mud and bloodied. As centuries-old cobblestone roads are gradually resurfaced, each year organizers adjust the route to maintain a high portion of cobbled roads to preserve the madness. This year the race is 257 kilometers — nearly 160 miles — 55 kilometers of which are over cobblestones. It starts in Compiegne, France, more than an hour north of Paris, and ends in Roubaix, with a few laps around the Roubaix velodrome that the race was originally intended to celebrate.

“If you win that race, you’re the fucking king,” Rider says. “The trophy is a rock. It’s literally a cobblestone.”

By comparison, the Boulder Roubaix — referred to as just “Roubaix” in cycling circles — might not seem worthy of all the decision-paralysis and stress. But it’s a special race for Boulder and for cycling. It epitomizes the surge in popularity of road-meets-dirt riding, and all the new types of bicycle models and setups to match. It’s capped at 1,000 slots, and this year — 27 years since it was first raced — it’s predicted to sell out.

The Roubaix happens next Saturday, April 8. Online registration closes Wednesday, April 5. The race’s inspiration, the Paris-Roubaix, happens the following day.

As of publication, Rider is still deciding: to Roubaix or not to Roubaix? But a recent injury will keep Forrest out of the race — for now.

An insatiable

appetite Installation shines spotlight on humanity’s ongoing hunger for genocide

T

here’s nothing quite as Artist Larry “Bug” Franklin asks inviting as a table with audiences to face the tragedy and reality of white linens, clean genocide in his exhibit Signature. plates and shiny silverware. It makes the stomach growl and mouth water. In The Dairy’s latest exhibit, Signature, there are three neat rows of 27 tables, all daintily set with plates and cutlery. The dishes are full, but the meal isn’t appetizing.

On each plate lie bones — broken, gray, gritty — with writing on them: Australia 1900-1969, Nazi-Germany Controlled Europe 1933-1945, Rwanda 1994, Bosnia & Herzegovina 1992-1995, Darfur 2003-Present, Northern Iraq and Syria 2014-Present... Each plate representing a genocide of the last century.

artist Larry “Bug” Franklin. “And then all of a sudden it twists around.”

Showing through April 9, Signature is the latest installation from Bug. He’s spent more than two decades as an installation artist, exhibiting his work in Denver and around the country. With no agenda in mind, he mostly deals with social issues.

“I’m trying to say something more socially about living in the world we are today and trying to make that connection with what we all feel and sense,” he says.

The off-putting “food” he serves in his show speaks to the regularity of a crisis as horrifying as genocide. As the only beings who exhibit such behavior, Bug says, it might be the “signature” of humanity.

“The bigger idea is that we seem to have this insatiable appetite for this,” he says. “As time is going on, we have this more and more.”

This is not the first iteration of this piece. The first showing was in 2007 and since then, Bug’s added five tables to the installation.

“It’s creepy,” he says. “But you feel in some respects you have to do it, because it’s something that has to be stated.”

The Dairy’s McMahon Gallery, which is displaying Signature, is 1,050 square feet. While not the biggest space, it comfortably holds all 27 of Bug’s current tables. But he acknowledges that won’t always be the case.

“The sad thing about this piece is it just continues to grow,” Bug says. “So I imagine in about another dozen years or so, this space will not be big enough to even house this amount of tables. That’s really kind of weird as an artist, because most times when you do a piece and you show it again, it’s done, and you just do the same thing over again.

But with this, every time I show it, I have to construct more tables, more bones. And so it’s just a weird piece; it’ll never be finished.”

The inspiration for Signature came about naturally, stemming from his Jewish heritage. As he grew up, he learned 30 March 30, 2017

about the Holocaust, and he says many of the older people in his life had identification tattoos.

“So to me, that’s part of my history,” he says. “So when you start seeing more of it around the world, you’re more in tune to it. I never went through it myself, but you’re just more aware of it.”

Genocide is an intimidating topic, but Signature captures the sorrow and destruction in a straightforward manner. It doesn’t overinflate the heaviness of the issue, but boils it down to the bare bones: death and misery.

Bug purposefully Amanda Moutinho designed the show so the audience has to interact with the pieces, walking between the tables, unable to skirt around the suffering.

The simplicity garners a visceral reaction from the viewer.

The piece also features video projections on the wall. One video shows pictures from Polish concentration camps, which serve as a common link between multiple events.

“You can put any image up on this wall, and I would assume that somebody who lived through one of these other genocides would [relate],” he says.

buzz people. In one, multiple people are shaking their heads back and forth. Bug says this represents the insanity and confusion of the ongoing nature of these tragedies.

In the other, people cover their ears, eyes and mouths. This video, he says, symbolizes the people in these regions who hear, see and speak about the genocides, yet are hesitant to rise up to fight against them, in fear of their own safety. While the picture montage and the tables are black and white, the two other videos are in color — a deliberate choice in order to depict the past and present.

The individual elements of the exhibit are compelling on their own, and while Bug’s intentions and inspirations are clear, the work remains vague enough for the audience to project their own ideas onto it. For one alternate explanation, the subjects in the videos could symbolize the denial that outsiders go through in wanting to stay ignorant to the suffering in other nations. “[That] response is as authentic as mine,” Bug says. “Because really, as an artist, what I don’t want to do is [necessitate] that you have to [interpret] it exactly this way. I want to leave it open-ended. I want people to approach it the way they see it and how they feel about it.

“Art is really powerful when you can fill in those gaps,” he continues.

“If I go to the museum and I have to read a big artist statement to figure out what in the world I’m looking at, to me that’s really missing the boat.

But if they would give me an insight or a doorway into it, that’s much more powerful.”

Bug provides a look into genocide, but stops short of providing a reason or a remedy. He’s just as confused as anyone as to why this keeps happening, especially in today’s modern world.

“We’re the only species that has ever lived on this planet that’s ever done this,” he says. “And I don’t know if more intellect means more hostile. I don’t know what it is, but you almost think it would be the reverse. This would be primal man, and we’d be much more evolved in not dealing with this.”

The current political atmosphere cast Bug’s piece in a new light for him.

He gained insight into the seeds of these occurrences.

“To be honest, I think of how much hatred would it take for a society or group of people to do this...

But then you look at the news, especially after the election and the inauBoulder Weekly

guration and then you start seeing, ‘Oh, well this is maybe how it starts,’” he says. “Where people are just truly polar opposites and they just yell at each other and they cannot seem to get along, and eventually... and I’m not saying it would happen here, but maybe this is how it starts.”

Arguably, the most moving piece in the show resides at the upper corner of the exhibit. There sits a table

dressed with linens, silverware and an empty plate.

Initially, Bug says, he wrestled with the idea of including the vacant table in the installation. But he ultimately decided it was necessary — an openended finish to an ongoing tragedy.

“If this table was removed, it would read differently,” he says. “It would read more as a historical piece, but now it reads more as current.”

While Signature might seem grim, Bug sees it as a “somewhat upbeat” show. Hopefully, this is humanity’s rock bottom and the future will be brighter.

And maybe one day, Bug’s piece will be finished and he’ll be able to pack up the waiting table.

“Boy, that would be really nice,” he says with a laugh.

But until then, the final plate sits empty, ready for its next meal.

For Benevento, paradoxically schooled by the music of keyboard monsters of the ’60s and ’70s — Chick Corea, Herbie Hancock, Larry Young — but ultimately liberated by the vast depth and deepening maturity of ’80s and ’90s electronica, the virtuosity is subsumed by the context, the texture of the piece, the madness of the moment.

For anyone who encountered piano lessons as a kid, the reality is stark, certainly starker than for the wannabe guitarist. The pianist has to know the theory. Keys don’t let you slide, at least not in the way that lots of sludgy distortion can forgive a bum note on a guitar fretboard.

“It’s like this mystical, weird thing when you start learning theory. Like, what makes a third, what makes a major different from a minor?” Benevento mused.

“I’ve taught theory to some people, like my uncle who just kind of wanted to know how it all works. In the end though, it’s sound and what you like.

Some of the best musicians don’t know a damn thing about theory. But I’ve seen other people get totally sidetracked by it, as if they don’t care about it but they think other people think they should care about it. Some people are really drawn to it, and that’s cool. But in the end, you should just play your music for other people to enjoy.”

And Benevento, a self-admitted tennis junkie when he’s not playing the keyboard, has also taken up another hobby: skateboarding.

“Yeah, I used to skate a lot when I was a kid, always wanted to do half-pipes and stuff like that, so I’ve started to do a little bit of it again. Kind of re-capturing some of my youth.”

Suggests the elder, isn’t that a little... y’know, risky?

“I wear boxing gloves, so I don’t hurt my hands.”

ntil a decade ago, Rich Forer was a fervent supporter of Israel. Raised in a reformed synagogue in New Jersey with orthodox family living in the West Bank, how could he not be? But everything changed in the summer of 2006. As the second Lebanon War unfolded into a 33-day conflict between Israel and the paramilitary/political party Hezbollah, Forer grew increasingly distressed. He saw the latest conflict between Israel and its neighbors as further proof that his long-held beliefs were justified.

“I believed Israeli soldiers only killed if they absolutely had to, and that Israel treated everybody fairly. But the Arab world was pathologically hateful towards Jews and they just wanted to drive the Jews into the sea,” he says. “But these are all myths that people are brought up with in Israel and in Jewish communities around the world.”

After researching the conflict with more fervor than ever before, Forer was surprised by what he found. In addition to the atrocities committed against Jews living in Israel, he read documented accounts of human rights abuses committed by the Israeli military against the Palestinians by well-respected organizations like Amnesty International and Human Rights Watch.

“I was horrified by the things I was reading about what Israel was doing,” he says.

At this point, he had what he calls a spiritual awakening, an epiphany if you will.

“I transcended my limited identity as a Jew and rediscovered my common humanity or my common identity with all people,” he says. “Fear was replaced by compassion. And confusion, which always accompanies fear, was replaced by clarity. Ever since then, I’ve advocated equal rights for all people, not just some people, because it’s the only path to peace. It’s the only path that will save the Jews and the Palestinians. “ Forer’s story of transformation is one of 24 similar stories of Jewish Americans of all ages from all over the country captured in filmmaker Marjorie Wright’s 2016 award-winning documentary Jews Step Forward.

Wright experienced a similar transformation herself during the first Intifada in the late 1980s. As a

Several of the people featured in the film run their own organizations promoting peace between Israel and Palestine, while many have written books about the subject. Some are doctors, others lawyers, professors, journalists and activists. Two women, both of whom passed away in 2016, were Holocaust survivors.

“They all have a strong Jewish identity and that identity is anchored in universal human rights,” Wright says. It’s what she calls tikkun olam, a Jewish religious principle meaning “to mend, heal and transform the world” that demands social action.

“This is how these individuals view their Judaism and their responsibility,” Wright says.

But speaking out against some of Israel’s actions isn’t about prioritizing Palestinians over Jews as some have criticized, Forer argues.

“The way people talk about this subject is very confusing,” he says. “If someone criticizes Israel’s violation of human rights and simply wants Israel to comply with international law or simply expresses concern for the lives of Palestinians, they are considered pro-Palestinian and anti-Israeli. And what I’m saying is, I’m no more pro-Palestinian than I am antiIsraeli. I am pro-human rights and anti-oppression, that’s all.”

Although their position remains controversial among Jews and Israel supporters, with screenings of Jews Step Forward around the country, Wright and Forer seek to start a conversation that they hope will lead to lasting peace.

“Just like all of the individuals interviewed, at a certain point [I] said, I need to inform myself, I need to read about this, I need to know more than what is the general socialization,” she says.

What she found was a growing, although still controversial, movement within Judaism questioning America’s status-quo support of the state of Israel.

Through personal narratives of transformation, the film challenges Jewish Americans to consider alternative narratives to the Israel/Palestine conflict in an effort, Wright says, to protect both the future of Israel and its Jewish citizens.

“It’s not that they’re against Israel, but they are certainly questioning the direction the leadership is tak-

Every actress shines in different ways — Hindsley gives Snow White a Shannon Doherty circa 90210 bitchiness and has a nice set of pipes; Warren nails the exaggerated, breathy princess voice.

But the jewel-encrusted tiara goes to Annie Dwyer’s Princess Ambien, I mean Sleeping Beauty. Very much like a female Wayne Kennedy — and I mean that as the highest compliment — Dwyer sticks out her tongue, rolls her eyes and mugs it up with joyous abandon. She’s the highlight of virtually every one of her scenes.

As one expects from BDT Stage, all the technical elements, from Campion’s costumes to the props and the playing of the live band, are spot on. Combined with maximum effort from the director and cast, it’s no wonder there wasn’t an empty seat in the house on the night I attended, and I wouldn’t be surprised if tickets are hard to come by as word of Disenchanted’s dominance gets around.

With laments about the burden of being drawn by sexually-frustrated men (the hilarious number “Big Tits”) and an overall feeling of raunchy empowerment, Disenchanted delivers.

Unlike objects, two stories can occupy the same space

Out along the last curve in the brick walk the grass has begun to green, with the freezing cold and coming snow its certain fate.

The cranes make the same mistake, fields of red capped heads attest their arrival just before the worst blizzard of winter makes it impossible to tell the field from the river.

And we, too, have known these mortal mishaps, miscalculated our time, found ourselves out of step, arriving too early, staying on too late, misjudging the nearness, the vengeance of the storm.

The cranes, the grass, they tell us: this can go on for millions of years.

This reboot of the 1990s TV show features five teenagers who must stop Elizabeth Banks from getting to a Krispy Kreme. That’s the real plot. And you know what? It’s pretty great.

n the first 10 minutes of Power Rangers, an alien Bryan Cranston kills all the dinosaurs and a high-school kid performs bestiality. Things get weirder from there. No one had reason to expect much from a big-budget reboot of the profoundly schlocky 1990s TV show, Mighty Morphin Power Rangers, which was itself hobbled together out of bonkers stock footage from a Japanese series.

Both buoyed and burdened by the maniacal nostalgia of fans, director Dean Israelite and screenwriter John Gatins had to delicately balance an inexplicably dense sciencefiction conceit with gaudy visual goofiness, kung fu and teenage angst. The result is a messy, weird, simplistic superhero riff that is somehow pretty great. Honestly.

From worst to best, the core characters are Jason (Dacre Montgomery), who is basically the embodiment of season two of Friday Night Lights; Kimberly (Naomi Scott), who has an updated backstory involving revenge pornography; Zack (Ludi Lin), who lives in a trailer with his mom and claims to be “crazy” every other sentence; Trini (Becky G), who is bisexual and unhappy at home; and Billy (RJ Cyler) who is wicked smart and on the autistic spectrum. The five find glowing magic coins that give them superpowers and are told by the holographic head of Zordon (Bryan Cranston) and a robot, Alpha 5 (Bill Hader), that they’ll need to stop Rita Repulsa (Elizabeth Banks) from using a giant monster made of gold from pulling a giant crystal out from beneath a Krispy Kreme. Cue the wailing guitar, it’s morphin’ time!

Power Rangers is stupid. But almost every comic book or superhero movie is, at its core; some just successfully disguise that stupidity with spectacle and quality characters (most Marvel movies), whereas others attempt to mask it with gritty self-importance (most DC movies). Power Rangers goes with secret option C: It embraces the stupidity and conflicting tones, and rides that shit like a roller coaster designed on LSD. This is a movie where heartfelt, nuanced character revelations are sandwiched between Elizabeth Banks eating gold necklaces and Bryan Cranston emotionally chastising teenagers for their lack of morphin’ prowess. And it works. It works precisely because it is sincere about every ridiculous twist of tone, committing as much to quiet father/son strife as to lines about stopping the forces of evil from getting to the Krispy Kreme. It also works because they cast the living crap out of it, choosing young actors with potent charisma and not just model-caliber bods.

The nonchalant handling of Trini’s nonbinary sexuality is deft, with her and Kimberly having as much flirtatious energy as any would-be hetero pairing. Billy’s autistic spectrum placement may not get the most revelatory or nuanced handling, but he’s easily the best character and refreshingly different from 99 percent of superhero tropes. Sure, nobody needs another white, misunderstood, small-town high-school star quarterback as “team leader,” but even Jason is surprisingly forgivable in light of how other characters are depicted.

Compared to the bulk of the superhero cinematic era, Power Rangers has more diversity in sexuality and race; is more secure in its silliness; demonstrates fantastic pacing; places its emphasis on its heroes and leads, and not supporting cast or villains; and feels light and kinetic even when trying to be “real” and serious. Exceeding expectations and promising fun times ahead, give me scores more Power Rangers before whatever Batman has in store next.

Much to her surprise, flowers have already been placed on his grave. Who visited her beloved, she asks the gravedigger. He replies by holding up a Franc coin and spitting in disgust.

The year is 1919 and German repulsion for the victorious French is at an all-time high. That mysterious French visitor is Adrien (Pierre Niney), a man who claims to be Frantz’s closest friend and is merely paying his respects. Anna invites Adrien to meet Frantz’s parents, and he charms them with stories from his time as a student in Paris with Frantz. Even though Frantz’s father belongs to a vocal and radical anti-French political group, he welcomes Adrien into his home and life. Despite their differing nationalities, he sees that the children pay dearly for the sins of their fathers, and this war was their most egregious sin.

Little by little, Anna falls for the handsome Frenchman, as do Frantz’s parents, but Adrien harbors a secret, one that will wrap up Anna entirely. Everybody lies. Some to others; others to themselves, but every lie is different. Some lies are told in favor of protection, others for deception. Either Frantz isn’t a scary movie, but it is a ghost story in which lies are way, the truth will abundant. come out and all will be devastated.

Loosely based on the 1932 American movie Broken Lullaby, Frantz is expertly directed by Ozon in a twisty manner, one that keeps viewers guessing until the final seconds. That’s not to say Frantz is a mystery to be resolved, but it is a ghost story, haunted by not only Frantz, but by all the sons of France and Germany who were lost during the Great War. Unfortunately, this mourning will not bring about any resolution. Looking at these events with the privilege of history, we can see the seeds of another war being sown. At one point a Parisian café bursts into a vociferous rendition of “La Marseilles” at the sight of decorated officers. Though Anna finds herself on enemy soil, she must bear witness to this showing of victorious patriotism. One cannot help but think back to an earlier scene where Frantz’s father cowered in a pub corner with a group of defeated German patriots, plotting their return.

It was not enough that Germany was defeated in the war; they had to be humiliated as well. That is the sad truth that Anna faces as she travels from Germany to France searching for an explanation. Fortunately for Anna, she can transcend that humiliation and find a truth worth living for.

I’m only slightly ashamed to admit how often I eat tacos — but I am a little embarrassed. And listen, sometimes I manage to go a whole week without eating a taco. So don’t get the wrong idea about me.

I know you’re not here to judge me. I know you see me for who I really am, just a cuisine writer trying to navigate a world full of tacos, looking for the next place to get my fix. And hey, there are worse things I could be, unhealthier things I could hunger for.

Taco Junky brings an air of sophistication to everybody’s favorite street food Still, I’ve written about tacos before, and here I am writing about tacos again. And I know it won’t be the last time, if at least in part due to the fact that I write a food column. Oh, cruel fate.

I also know I’m not alone. There’s a place in Boulder that unabashedly caters to my dark passenger: Taco Junky.

This eatery opened up shop on University Hill in 2015, taking over the space Mamacitas Restaurant Y Cantina had occupied since 1993. It may seem like Taco Junky was just one Mexican restaurant replacing another, but owners Mike and Evey Caravello teamed up with general manager Toula Georgakopoulos to create a Latin-inspired casual dining experience that tends toward the fashionable, falling in line with the upscale restaurant movement that started building on the Hill in 2010 when Cafe Aion brought a little sophistication and a serious wine list to the area.

Similarly, Taco Junky moved in with a menu full of chic eats and a bar stocked with infused tequilas.

And after a renovation, the atmosphere at Taco Junky is as lively as the name, playing off the vibrant colors

Generally, I do tip when I get takeout, even if it’s just a few coins. Long ago I worked in restaurants in Boulder and appreciate the work involved. The amount depends on a lot of things, like whether I’m a regular. That seems to be true for many diners who always get takeout from the Susan France same places and “especially if people are informative, enthusiastic or helpful,” one of my friend’s said.

I asked Laura Bloom, a friend who has dined far and wide, how she dealt with it. “In principal, I don’t believe in tipping for takeout food because I’m not getting service throughout my meal. That said, if someone is just really nice to me or the restaurant is good at guilting me into it without going overboard and making me feel pushed into it, I’ll usually tip a bit,” she said.

Q: Do you tip more for carryout from a full service restaurant and less for the same purchase at a fast casual eatery? Do you tip a higher percentage for your latte or a sandwich at Panera?

Do you tip more for sushi than for tacos?

A: I tip depending on how I’m treated when I walk in and while I’m waiting for my food. I do tip more when I order my barbecue to-go through a bartender at the bar - somehow it seems natural. One common response: “I tip whatever coins I receive in change unless it’s just a few cents, in which case I feel compelled to add a dollar to it.”

Q: Who tips for takeout pizza?

They aren’t doing the dishes or refilling your water.

Why would anyone tip when they aren’t getting service?

A: My unscientific opinion is that most people tip a little most of the time, even if they aren’t sure why.

According to a CNBC online poll of almost 40,000 Americans, only 14 percent said that they tip for takeout. That percentage seems way too low to me.

Maybe it’s a question of definition: What constitutes “takeout?” I don’t tip for food I get at drive-through windows unless a barista is involved. You have to draw the line somewhere. One (male)

friend told me, “I tip more if I am physically attracted to the person handing me my food.

“I wish prices would just reflect what it costs to pay a living wage for all employees rather than me continually have to make an arbitrary decision about how much to tip.”

I agree, but the U.S. is a long way from being tip-free. According to the etiquette experts, emilypost.com, you are under “no obligation” to tip for takeout, unless it is curb-side delivery or it is a large, complicated order. I believe that if you want your takeout tofu jungle curry then you have to pay your fair share for the human infrastructure required to produce the dish.

As one friend put it: “Cashiers need to make a living, too.”

Q: Who actually gets your tip when a customer picks up takeout food?

A: You can always ask if the eatery pools its tips and splits them. One person told me that they do tip for espresso but don’t when they were picking up Chinese food (at their favorite eatery) because “I know the owner is pocketing the money.”

I asked chef James Van Dyk of Mojo Taqueria in Lyons why customers should tip for takeout food. “There is always labor involved in serving food.

Finally, the question about takeout food led to a query about a hazy new area of hospitality: Q: How much does one tip their budtender at a cannabis store? Is it just another take-out situa-

tion and therefore handled the same?

A: I think the same rules apply for budtenders that apply to anyone providing a service. If you are a regular and the budtender treats you well, then you tip a buck or two depending on the purchase.

It is interesting that we don’t feel similarly obliged to tip at a wine or liquor store.

The Boulder County Farmers Market opens for the season at 8 a.m.

Food court additions range from Wholly Bao (sandwich-like filled steamed buns) and Yayi’s Empanadas to Chaos & Cream (Thai-style rolled ice cream) and On Tap Kitchen (soft and crunchy pretzels). Taste of the Week

Singular units of tastiness are available (but hidden) in the parking lot behind Union Jack Liquor at the southwest corner of 95th Street and South Boulder Road in Louisville. Pupusas is the small, red trailer semi-permanently parked there. Pupusas are all that the family-run shop sells. The griddled soft cornmeal pancakes are filled in the middle with cheese and a choice of fillings such as beans, loroco (a mild green flower bud), mushrooms, pepperoni and rajas (summer squash). A sign on the side of the trailer notes with some urgency and exclamation points that these pupusas are an authentic, madeto-order food that takes a solid 15 minutes to cook. They are not microwaved and well worth the wait. There are a couple of tables in the back and some logs to sit on, or you can go buy some beer although you can’t drink it.

Regulars know to call ahead. I went with one pork and one chicken pupusa.

Combining bites of molten pupusa with crispy curtido cabbage and jalapeño slaw and tomato salsa is a little piece of street food heaven.

f you’re like me and enjoy perusing the various nooks and crannies of the Colorado craft beer scene, then you know that the best-kept secrets are often found in garages. These cramped little hovels are home to innovation, experimentation and love. But sometimes you just get tired of living in a garage. You suddenly find yourself identifying with the great frontiersman, Davy Crockett and his incessant search for “more elbow room.” Maybe you even want to play a game of pick-up basketball, a little table tennis, an arcade game or just lounge on an enormous patio while enjoying the lovely weather. Well, if you find yourself in that situation, then please allow me to suggest a visit to Wonderland.

Wonderland Brewing Co. — located off of U.S.-287 and Sheridan Boulevard in Broomfield — is simply enormous. The building and land once belonged to a local church youth Susan France group, but in 2014 Wonderland turned the 9,000-square-foot facility into a local hangout where just about everyone could find seating. The never-ending bar top is made of reclaimed wood, the booths come from a Chinese restaurant and the large rectangular picnic tables look like they’ve seen a fair amount of life.

Wonderland may only be three years old, but it has that comforting, lived-in aesthetic that I adore in some of my favorite bars throughout the country.

As the name suggests, Wonderland draws inspiration from the famous Lewis Carroll fairy tale and the 1951 Disney animated film Alice in Wonderland.

Considering that the film inspired the brewery’s logo, they really ought to brew a beer in honor of Bartender Kevin Young enjoying a delicious the great Ward Kimball, who aniWonderland Brewing experience in a glass. mated that dastardly Cheshire Cat smile, and the incomparable Sterling Holloway, who provided the Cat’s mischievous dulcet tones. In the meantime, Wonderland offers fantasy in the form of Alice Blonde (5.2% ABV ), a quaffable German wheat that is heavy on the wheat, The Cat’s Pajamas (8.6%), a fizzy sipping Belgian Doppel Weizen with plenty of clove and banana, and TweedleWeiss (5%), an easy drinking light-bodied German Weiss Bier, all designed to “turn every frown upside down” as their marketing tag promises.

Not every beer at Wonderland is beholden to the English fairy tale. With 12 taps, Wonderland offers myriad American inspired beers — Three Putt Pale Ale (5.5%) and Hoppy McHopFace (6.8%) — Belgian — The Fuzz (5%) and Farmer’s Only Saison (6.4%) and German — Good Gose (5.6%) and Blood Orange Shandy Time (6.3%) — to please a large crowd seeking a night out where some can watch television, others can play a bout of ping-pong, a couple can enjoy the live music and the rest can just sit and drink while they pretend to listen to each other. Or you can just go and enjoy a Farmer’s Only Saison on your own with the company of your phone. It’s not lonely; it’s relaxing.

I

n November, InSys Therapeutics, an Arizonabased pharmaceutical company, donated $500,000 to the successful campaign to defeat a marijuana legalization initiative in their home state. In December, the company’s ex-CEO and six other former top executives were arrested and accused of bribing doctors, defrauding insurance companies and fueling America’s opioid crisis by way of the illegal marketing of Fetanyl. InSys’ stocks plummeted, but a certain small group of analysts were optimistic.

These positive expectations were largely based on the company’s new Public Domain (NASA) drug Syndros, a synthetic marijuana compound that had been granted approval from the Food and Drug Administration (FDA) for treatment of anorexia in AIDS patients and nausea and vomiting in patients undergoing chemotherapy. Last week the drug received preliminary approval from the Drug Enforcement Administration (DEA) and the company gained a minor bump in stock valuation to boot.

So after a year of duplicitous behavior by InSys, their fake version of marijuana has earned a Schedule II classification and rights to a potentially profitable and patent-protected new market. opposites. As Jerry says, “in Bizarro World up is down, down is up. [You] say hello when [you] leave and goodbye when [you] arrive.”

Similarly, for those of us living in real-world legalized marijuana markets, the whole Syndros situation seems too odd to be trustworthy. How is it possible that a synthetic oral solution of the cannabinoid dronabinol (a pharmaceutical version of tetrahydrocannabinol, otherwise known as THC) breaks through rigid scheduling of the Controlled Substances Act while botanical or “whole plant” marijuana is totally blockaded?

With the DEA, FDA and InSys all predictably tightlipped, we’re left grappling with what has become an all-toofamiliar line of questioning in this day and age: What is the difference between real and fake and why does it matter?

Or, as Guy Debord asks in his 1967 book Society of the Spectacle, how do we end up in a place where the authentic is replaced with artificial? How do we come to live “in a world which really is topsy-turvy, [where] the true is a moment of the false?”

It’s not so simple, because synthetic does not necessarily equivocate with falsity. Its Greek origin — syntithenai — merely means “put together.” What is “real,” then, seems to have less to do with substance itself than it does with our own cultural persuasion and positioning.

As painted by Debord, the threat of the spectacle is that the proliferation of capitalist markets and media will completely replace direct experience with its interpretation, leaving society at large prone to manipulation.

This is what creates a world where we can look at a meager inauguration crowd and actually engage in

(weeks worth of ) conversation about whether or not there is validity to the claim that it is the “biggest in history.” Or how InSys can simultaneously sell addictive Fentanyl and its antidote, Buprenorphine Naloxone. Or how marijuana remains federally illegal while synthetic THC is granted medical and political legitimacy by the FDA and DEA. Collectively, we are struggling to distinguish between experience and its interpretation.

But the thing about real marijuana is that it doesn’t just palliate pain or rouse the appetite, it induces an experience of which those effects are a part. THC is a psychoactive substance — it’s what makes marijuana marijuana — but on InSys’ website that property is portrayed differently — as a side effect: “Syndros may cause psychiatric and cognitive effects and impair mental and/or physical abilities.”

Do you feel better now that getting high comes with a warning and a prescription? InSys sure hopes you do as they “expect to convert a large portion of the market to Syndros as well as expand the market through direct detailing to physicians, highlighting the improved product profile of Syndros.” Through this sort of marketing and with their newfound DEA clearance, a few analysts think they will be able to double their stock price based on the release of this one drug alone.

But there is something deep down in me that doubts we can be so thoroughly duped as to mistake Syndros for cannabis, thraE for Earth, Bizarro Jerry for real Jerry. As Susan Sontag asserts in her final book, Regarding the Pain of Others, there is a limit to the trance of the spectacle: ‘’To speak of reality becoming a spectacle is a breathtaking provincialism. It universalizes the viewing habits of a small, educated population living in the rich part of the world, where news has been converted into entertainment. ... It assumes that everyone is a spectator. It suggests, perversely, unseriously, that there is no real suffering in the world ... There are hundreds of millions of television watchers who are far from inured to what they see on television. They do not have the luxury of patronizing reality.”

Would John Calhoun approve of states legalizing pot?

ohn C. Calhoun is a slave-owning dead white guy whose big idea is suddenly all the rage again — and in no small part due to marijuana.

These days Calhoun isn’t as well-known as slave-owning dead white guys like George Washington, Thomas Jefferson and Andrew Jackson.

Still, chances are you would have heard of him if you were paying attention in white-privilege class (or, as we used to call it, American history).

Between 1817 and his death in 1850, Calhoun served as secretary of war, vice president for two different presidents, secretary of state and U.S. senator from South Carolina.

But what he’s remembered for is his political thought, which laid the ideological foundation for secession and the Confederacy.

Calhoun’s biggest idea, and the one that is catching on again today, is nullification.

Nullification is the concept that state governments have the right to invalidate federal laws that they consider unconstitutional. Calhoun maintained that the federal government’s powers were restricted to those specifically granted to it by the Constitution, also called “the enumerated powers,” and that in the exercise of all other political power, the states were superior to the federal government. A state could nullify within its borders any federal law that went beyond the enumerated powers, he said, and secede if the feds objected.

Today’s flirtation with nullification has taken two forms — the sanctuary city movement and state-level legalization of marijuana.

There are currently about 300 so-called sanctuary cities, counties and states in the U.S. The governments in each has voted either to refrain from or ban local enforcement of federal immigration law within their boundaries — or more plainly to nullify it.

As for marijuana, eight states and the District of Columbia have voted to legalize and regulate it, and 28 states have voted to legalize it for medical purposes, notwithstanding the fact that possession, use, production and sale of pot are all federal felonies.

Which raises an obvious question: Is there any difference between nullification and rebellion? In 1832, President Andrew Jackson didn’t think so.

On Nov. 24, 1832, the legislature of Calhoun’s home state of South Carolina voted to formally nullify a high protective tariff that Congress had passed in 1828. Southerners considered the tariff, which they dubbed the “Tariff of Abominations,” particularly damaging to their economic and social interests.

tariff ’s nullification.

President Jackson wasn’t amused. He promptly sent a naval squadron into Charleston Harbor and threatened to hang Calhoun or any man who worked to support nullification or secession.

(The South Carolina legislature blinked, decided to quit being the resistance and embraced The Art of the Deal. The Deal, in this case, being the Compromise Tariff of 1833, which was put together by one of America’s all-time great deal-makers, Henry Clay.)

OK, there are major differences between 1832style nullification and the 2017 versions.

For one thing, neither the sanctuary cities or the states with legalized pot are threatening to use force to prevent the enforcement of federal law within their jurisdictions, as South Carolina was.

Sanctuary cities for the most part are practicing non-cooperation with federal law, which is a less brazen form of nullification than affirmatively preventing its enforcement.

In the case of marijuana, the states that have legalized did so by repealing state laws and saying nothing about the enforcement of federal ones. They said to the feds, in so many words, “you do your own thing and we’ll do ours.”

And the federal government has enforced federal anti-pot laws in states that have legalized, often with the help of local authorities when the feds asked for it. But the federal government has also been circumspect about enforcing federal pot law in states that have legalized; the guidelines in the Cole Memorandum have averted a head-on clash with the states. Marijuana legalization may be an example of latter-day nullification, but it’s nullification lite.

It’s still nullification, though, and that can be a ticking time bomb. That’s why there’s real urgency for Congress passing legislation that defers to the states on pot. South Carolina may have backed down in 1833, but things didn’t end as happily in 1861. You can only kick a can of dynamite down the road for so long before it blows.

And Trump has a portrait of Jackson hanging in the Oval Office. Just sayin’.

So what, you ask, did they settle on?

Boulder’s official pet is the kitty cat.

(We’re not sure what the “kitty” adds, but we’re just here to report the facts.)

Now, here at the newspaper office, there’s some debate on cats. Some are staunch cat lovers, while others think cats are “sleazy.” (Yeah, we’re not sure how cats can be sleazy, but everyone’s allowed their opinion.) But, in general, we at BW approve the choice. Good on you, City Council.

The vote happened during what had to have been a heated, contentious breakfast. This isn’t your typical brunch ladies and gentleman; this is serious. It came down to three votes for dogs and six votes for cats. And as one brave member said, “We just think kitties really have the heart of Boulder.” And another, “They are soft, cuddly, and they purr.” And probably the biggest defense: “They are clean and unlike dogs.”

Now who can argue with that?

Probably owners of clean dogs. But we digress.
