I occasionally appreciate Paul Danish’s contrarian views, but sometimes they need to be answered — especially when the issue is something as important as climate breakdown.

In “Have we accidentally prevented another ice age?” (Danish Plan, March 21), he supports global warming as preferable to another ice age, but, not being a climatologist, he doesn’t understand that they are not alternatives. As

t’s one thing for Big Oil frackers to bust into our Earth, our communities and our economic well-being — but the fracking fad is also busting the free speech rights of locals who dare to speak out against it.

Welcome to Sanford, N.Y., a pleasant place of 2,800 citizens on the New York-Pennsylvania border.

Unfortunately, the pleasantness has been interrupted by a major squabble over

James Hansen, one of the world’s most respected climate scientists, points out in his book Storms of My Grandchildren: The Truth About the Coming Climate Catastrophe and our Last Chance to Save Humanity (2009): “Even though we sometimes hear geoscientists talk as if ice ages will occur again, it won’t happen — unless humans go extinct. Forces instigating ice ages, as we shall see, are so small and slow that a single chlorofluorocarbon factory would be more

than sufficient to overcome any natural tendency toward an ice age. Ice sheets will not descend over North America and Europe again as long as we are around to stop them.” [pp. 36-37] The challenge we must address is how to avoid runaway global warming, not how to prevent another ice age.

whether corporate drillers should be allowed to extract natural gas by fracturing the huge Marcellus Shale formation that underlies the region. Hydraulic fracturing is rampant on the Pennsylvania side, but New York imposed a moratorium on the inherently dangerous process in order to assess the health and safety issues involved.

However, as OnEarth magazine reports, Sanford’s town board is eager to allow oil and gas outfits to frack away — the board even leased land to one corporation that wants to drill inside the town. But last fall, Sanford officials went further, imperiously imposing a gag order on their own citizens. It seems that opponents of the profiteering rush were using the board’s public comment session to, well, to comment publicly.

Irritated, the board decreed that any topic could be discussed at its meetings — except fracking.

restriction on people’s democratic rights by saying that the ongoing discussion on whether to frack or not got in the way of other board business. But, gosh, that’s the way it is in a democracy — the people themselves can dare to set the agenda by insisting on discussing the Big Issues that matter most to their families and communities.

The consequences of a wildlife comeback

A

midst the horrors of fracking and climate change, America has a mostly unnoticed environmental success story. In his fascinating new book Nature Wars: The Incredible Story of How Wildlife Comebacks Turned Backyards into Battlegrounds, Jim Sterba — veteran reporter for The New York Times and the Wall Street Journal — points out that we have an embarrassment of riches.

Over the past 150 years, there has been a vast re-greening of the landscape from the Atlantic Ocean to the Great Plains. Wild species that almost became extinct are now flourishing. Most Americans have become “forest dwellers,” notes Sterba. In the Northeast, people live closer today to “more animals, birds and trees than anywhere on the planet at any time in history.”

Of course, it is a peculiar forest, with roads, highways, parking lots, office parks and shopping centers. But from above, you see a thick canopy of trees. It increasingly feels like home to many deer, beavers, bears and wild turkeys. We provide lots of food, water, shelter and protection for them. There is plenty of grass, gardens, shrubs, birdseed, mulch, yummy garbage and tasty tame pets.

The 2000 Census revealed that for the first time in our history, an absolute majority don’t live in cities or on farms but in the suburban, exurban and rural sprawl in between.

Boulder’s recent encounters with elk and coyotes are not unusual. Sterba says many formerly scarce wild animals have used suburban sprawl to become overabundant, constituting a danger to human beings and other species.

The term “roadkill” is our gruesome joke for the routine slaughter of millions of wild creatures. Upwards of 250 people die and 30,000 are hospitalized each year as a result of these collisions. Between 3,000 and 4,000 deer are killed by motor vehicles per day in this country. Per day.

Deer are gorgeous and graceful saucer-eyed critters that are wonderful to watch. But their population has exploded. They do more than $850 million worth of damage per year to farm crops and forests. They spread Lyme disease.

They eat $250 million worth of landscaping, gardens and shrubbery. When they eat plants that grow under large trees, they are damaging songbird habitats and putting some birds at risk.

Suburbanites have divided into “Kill 8 March 28, 2013

Bambi” and “Save Bambi” factions. After Princeton, N.J., hired sharpshooters to cull its deer population, Sterba notes that “the mayor’s car was splattered with deer guts and the township animal control officer began wearing a bulletproof vest after finding his dog poisoned and his cat crushed to death.”

In Wheaton, Ill., a coyote attacked a small dog and had to be euthanized.

When a nuisance wildlife mitigation company killed four coyotes, there were hundreds of protests around the country.

There were voicemail death threats. A brick was tossed through a city official’s window. City council members received threats in letters and emails from outside the state. The FBI was called in because it is an illegal terrorist act to use the U.S. Postal Service to make threats.

Defenders of feral cats (between 60 million and 100 million in the U.S.) are waging bitter battles with bird lovers.

The American Bird Conservatory said it believes free-roaming cats kill 500 million birds in the United States a year.

Canada geese are taking over public parks, lakes, athletic fields, golf courses and beaches. Their hyperactive digestive system compels them to defecate approximately fives times an hour.

Officials of an upstate New York village concerned with an infestation of these geese were confronted with a protest against a “goose Holocaust.”

The total cost of wildlife damage to crops, landscaping and infrastructure in this country now exceeds $28 billion a year, according to Michael Conover of Utah State University, who monitors conflicts between people and wildlife.

We may want to just leave nature alone, but we have become accidental ecosystem managers. We may grimace at the thought of hunters shooting deer, but have grown tolerant of cars regularly killing those same creatures.

Sterba argues that we have to become stewards of nature: “Americans think of wilderness as some pristine place over the mountain, and somehow the landscape we occupy is sullied by our presence. But that landscape is an ecosystem, and we have an obligation to manage it for all its occupants. We’ve made mistakes in the past, but we’ve learned from them — we have a rare second chance to save the forest.”

Before getting too snarky about Magpul (“Get Out, Guns Blazing,” ICUMI, March 21) and swooning over our noble state legislature, bear in mind that Democrats offered to give Magpul a loophole: They’d allow the manufacture of high-capacity magazines here in Colorado, as long as they were sold out of state. Not just out of the country, or to law enforcement and military customers, but simply out of state.

Doesn’t sound so principled that way, does it?

Gun rights advocates claim that background checks for private purchases can’t be enforced because shady sellers would simply cross the Wyoming border and do the deal in the first parking lot they find. Who knew that Colorado state Democrats would suggest Magpul do essentially the same thing?

Expose truth on UFOs too

Joel Dyer’s recent article “Not-sosunny days” (cover story, March 14) drives home some good points about the need for transparency at local, state and federal levels. His assertion that “Our national security apparatus is out of control, but the critical information that would prove to what extent it is being illegally kept from the public,” caught my eye. There is one topic around which, over the last 70 years, the military-industrial-intelligencecomplex has built an impenetrable barrier of secrecy: The existence of UFOs and the identity, as best they know, of those operating them.

Now that the obligatory eye rolls and comments about little green men and rectal probes are over, let’s move forward. Though he started out researching Cold War politics, Richard Dolan, an Oxford student and Rhodes scholar finalist, detoured into Ufology 20 years ago. He did so because, while sorting through Soviet-era military reports, he encountered voluminous evidence that UFOs were real and taken very seriously by the Soviets.

Dolan is now two-thirds through writing his three-part book series UFOs and the National Security State, considered by many to be the most definitive survey of the UFO phenomenon of the last 70 years. He and co-writer Bryce Zabel also recently wrote A.D. After Disclosure. It is a courageous attempt to envision how human civilization will be altered once the fact of the UFO/ET presence can no longer be denied by the powers that be.

If you’re convinced the UFO topic is hogwash, then read Dolan’s books or watch the documentary The Day Before Disclosure on YouTube or check out the testimonials gathered by Steven Greer on his Disclosure Project website.

Be they good, bad or indifferent, the ETs are here. Humanity’s ongoing interface with them is the greatest story never told. That the well of information about this topic has been poisoned with disinformation, cover-ups and lies doesn’t mean the charade can go on indefinitely.

As citizens it is necessary we become informed and push for disclosure now!

FRACKING HYPOCRISY So, we have a story in this week’s issue about the tens of millions of dollars the state uses to compensate communities for their losses when oil and gas companies and other land pillagers move in, do their business, then pull out, so to speak.

Apparently, state officials believe that counties, cities and even school districts have the right to be reimbursed when something of value is taken from them, whether it’s their health or the natural gas under their feet.

To hear the director of the department that administers the funds tell it, the minerals, oil and gas in the earth are resources owned by the people, and those people should be repaid when that asset is taken from them.

Or at least be given a lollipop after getting a shot in the ass.

But doesn’t that fly in the face of what his boss, Gov. Frackenlooper, has been saying? The governor’s line is that the lease-holding oil and gas companies have all rights to the resource, and that no measly municipality like Longmont can dare pass a ban on fracking, because that would deter the companies’ ability to access their resources, resources that the people have no rights to.

Granted, this state assistance fund was created by the legislature decades ago, well before the governor got his first whiff of frack fluid, so he may have a different opinion than, um, state law, but you can’t have it both ways, folks.

You can’t claim that fracking and other oil and gas operations are perfectly safe, and sue municipalities that have the gall to pass bans on certain practices, and then turn around and acknowledge that these operators are taking the people’s resources and leaving behind a bag of shit that costs tens of millions of dollars to make up for.

You can’t pretend like there are no serious impacts involved with oil and gas operations, then turn around and compensate people for — you guessed it — those impacts.

Our favorite was the Colorado county that used one of those state grants to buy … wait for it … a wind turbine.

AND IN THE LEFT CORNER …

Speaking of Frackenlooper, we can’t wait for him to debate our newest county commissioner, Elise Jones, over the fracking issue.

But we’ve got to point out that it would have been a much livelier debate if Garry Sanfaçon had beaten Jones in the commissioner race last fall, because one of Sanfaçon’s main platforms was banning fracking outright in Boulder County.

We journalists always like a good fight, and that would have been a humdinger.

Jones, while clearly opposed to fracking, is buddies with the governor and seems more willing to compromise, to acknowledge that with the exception of some gray areas, the state has more power to regulate oil and gas than local governments. Like she told us during candidate interviews last year, “There isn’t a silver bullet, but there’s a lot of silver buckshot.”

She’s a reasonable, pragmatic consensus builder, not that there’s anything wrong with that.

It’s just that we hope to see some fire from her when she takes on the governor April 1. We hope the term “debate” is not a misnomer. We really hope they don’t start speaking in unison.

After all, that’s why we elected Jones — to represent the views of her constituents, who seem to be yelling pretty clearly: “Slow the frack down until the science catches up!”

ANOTHER HICK LICK Finally, we must take the governor task once again for his reaction to a Denver TV reporter who had the gall to ask whether he pulled strings to get a friend’s son out of prison — a son that has gone on to be accused of murdering Hick’s Department of Corrections chief, Tom Clements. When the TV reporter pressed him on the issue, mentioning that the suspect’s father had contributed to the governor’s campaign, Hickenlooper lashed out, calling it a “stupid question” and then making it even worse for himself by threatening to yank the reporter’s access to the governor’s office.

“I mean, that’s your choice,” he said, “but you lose your ability to have access when you treat people like that.”

We, for one, can’t wait for the voters to get the opportunity to take away this guy’s access to the governor’s office.

The fox shouldn’t be guarding the hen house

It’s spring here on my small Boulder County farm, and for my family, that means baby chicks, among other things.

Each year we raise a couple dozen chicks as a 4-H project for my own and other local kids. It’s a great way for the kids to learn about caring for an animal that eventually provides a healthy food product, and they also get a chance to earn a few bucks when they sell the mature birds at the Boulder County Fair in August.

One afternoon, my daughter went out to feed the 24 chickens and discovered that 11 were dead and five were missing. Off in the distance, we saw a little red fox with one of the birds clenched in its jaw. It was a bad day, to say the least.

We figured out that the fox had dug a hole under our sturdy fence to get into the chicken run. Now, imagine if we had consulted the fox to ask him how we should fix the problem? Do you think he would have had a vested interest in finding a real solution?

Doubtful. Yet this is just what we’re expecting the Colorado Oil and Gas Conservation Commission (COGCC) to do when it comes to regulating fracking and protecting our health and safety. As a state agency, the COGCC currently holds a dual mandate: (1) to promote oil and gas development and (2) to regulate oil and gas development.

Hmmm, sounds like the fox guarding the hen house to me!

Fortunately, Rep. Mike Foote is sponsoring a bill (HB 1269) to end this dual mandate and limit COGCC to the mission of protecting the environment and human health. This makes perfect sense to me. Why should we be using taxpayer dollars to promote the wealthiest industry in the world?

While this bill by no means solves the numerous issues regarding health and safety that fracking creates, it’s an important first step. Please call Mike Foote and thank him, and then call your own state representatives and senators and encourage them to support this bill (you can find your reps’ contact info at www.VoteSmart.org).

It’s time to stop allowing the foxes at COGCC to guard our own houses, playgrounds, farmyards and waterways.

Property permanence

I wonder how many judicial decisions (and opinions) have been rendered that are now obsolete, thanks to new technology, practices, customs or mores.

People and their values change, as do needs. And property is not really all Boulder Weekly

that “permanent.”

For example, try to consider how many property owners gave any thought to uranium when they sold their ranch and reserved all or some part of the mineral estate, especially if the transaction occurred before the Curies used some pitchblende from Gilpin County for their experiments. In all probability none of those owners could imagine uranium at the time! Then ask about the discovery that nuclear radiation can actually be bad for one (as discovered

the hard way by chemist Henri de Becquerel). Me, I’d like to anticipate and prevent problems.

Similarly, maybe — just maybe — landowners who severed a mineral estate from a surface estate prior to 1949 (or maybe even later) could have contemplated hydraulic fracturing as a production method for oil and gas. If a particular mineral’s rendering is uneconomic at this time or that, has it value? And if a method of “enjoyment” has not even been invented yet, how can a property

owner be deemed to have willfully “reserved” it? I know, I know; if I own property I own everything it can do for me. Or to me. So I’ll hedge my bets.

But I’ll wager that none of these land sellers thought there was anything in that shale beneath their feet, assuming they even knew there was shale. Or that they would know a chunk of shale if it broke their window.

Something to ponder, especially if you work in the state Capitol.

Impacts of seismic testing for oil/gas exploration disputed

W

hile much has been made of fracking, or hydraulic fracturing, another possibly negative side effect of oil and gas operations has emerged.

It’s called seismic testing, and it’s beginning to cause a stir nationally. It’s also making its mark near Fort Lupton, only about 14 miles east of Boulder County, not far from a huge new Halliburton facility where industrial semi trucks bearing massive tanks and other equipment are common sights on sleepy farm roads.

Seismic testing is used to measure underground formations and identify oil and gas deposits. It often involves the use of a “thumper truck” or “vibroseis” equipment. A large metal plate is extended onto the ground from the undercarriage of the vehicle, shooting physical shock and sound waves through the earth, sending signals to sensors.

Unfortunately, sometimes these operations appear to have unintended consequences. In Wyoming, Houstonbased company Geokinetics was fined last spring for seismic activity that damaged the surface of 10 ranches, causing ruts and other disturbances, according to media reports. **** That same company has recently been blamed for causing the collapse of a water well and cracked walls on property owned by Charlie and Mieko Crumbley, who live in Weld County, south of Fort Lupton.

“I was sitting here doing homework when the whole house started shaking,” Mieko Crumbley tells Boulder Weekly, describing the Dec. 14 incident when Geokinetics vibroseis trucks came down her road and she caught a member of its monitoring service, Urban Seismic, walking through her property despite three “No Trespassing” signs. The Crumbleys have video surveillance of the employee’s trespass and a truck passing by in the background.

Soon after, they noticed new cracks in their walls and ceiling, and then their well began collapsing, damage they attribute to the vibrations.

chances of damage to water wells from seismic testing are slim, it can happen.

On the other hand, a 1994 study of vibroseis impacts on a test house found that hammering nails and slamming doors generated a greater response than the vibrations. Another 1994 study on the effects of vibroseis trucks in the Los Angeles area uncovered minor damage: aggravation of an existing break in an old wooden beam.

The Crumbleys have been told they will need to drill a new well within five years, to the tune of $20,000 that they don’t have. Otherwise, they say, their property value will plummet.

“If we don’t have water, we can’t live here and it will be worth nothing,” Mieko Crumbley says. “We’ve lived here 17 years and never had a problem with our well or cracking or anything.”

Charlie Crumbley adds, “I was looking back this morning at 17 years of mortgage payments, which is about $300,000, for something I’m going to have to walk away from, and that’s pretty sad. A house without water, you can’t live in.”

The companies, which were contracted by Anadarko Petroleum Corp., visited the Crumbleys’ property and determined they weren’t at fault, saying the vibrations measured by the employee, who they acknowledge was trespassing, did not rise to the level of being able to cause structural damage.

And Mieko Crumbley says she doesn’t hold out much hope that a

recently opened investigation by the Colorado Oil and Gas Conservation Commission, which is simultaneously charged with promoting and regulating the oil and gas industry in the state, will yield satisfying results, since the investigator is “already saying that we live in an area that has expanding clay soils.”

COGCC spokesperson Todd Hartman said the commission employee investigating the situation, Steve Lindblom, is enlisting outside engineering expertise “to provide further insight into what may or may not have happened to their well.”

Hartman added that complaints about seismic testing are rare; the state has had only 16 such complaints over the last 13 years, “and most of those weren’t even related to claims of damage, so it’s an unusual thing.” **** While damage claims may be rare in Colorado so far, they are a growing reality in areas where the nation’s shale gas boom is creating the need for more seismic testing, such as Texas, Pennsylvania and New York.

In both southeast Texas and in neighborhoods around Fort Worth, where drilling activity is centered on the gas-rich Barnett shale, stories similar to the Crumbleys’ are becoming commonplace. Entire neighborhoods are claiming that their homes have been damaged by the vibrations from seismic trucks.

According to a report in the Fort

Worth Star-Telegram, it was August 2011 when Delores Newton was sitting in her house in Fort Worth when seismic trucks started working not far from her home. Newton told the paper, “It scared me. When I stood up, I was shaking. My ceiling fans were shaking.”

Newton wasn’t alone. Her neighbors on her street also felt the vibrations, and when things stopped shaking, they claimed that they could see new damage to their homes. “You can go around my house and look,” Newton told the StarTelegram. Wanda Theragood, Newton’s neighbor, likewise told the paper, “There are fresh cracks everywhere.”

Another similarity between these Fort Worth claims and the Crumbleys’ is that the seismic company in Fort Worth claims that its trucks did not cause the damage, despite the descriptions by homeowners that they felt their entire houses shaking as the trucks thumped past.

That is nearly identical to what is claimed to have happened in Vidor, Texas, according to the Southeast Texas Legal Journal.

According to a lawsuit filed by several Vidor residents who lived on the same street, “In late November 2005, defendants [the seismic company and its monitoring company] began seismic testing on Briarcliff with ‘thumper trucks,’ sending strong sound waves into the earth to detect mineral reserves. …

As a result of the loud sound waves, pictures were shaken off the walls and their homes damaged. … Plaintiffs discovered their houses sustained serious losses and damages after the seismic testing.”

Just as with the Crumbleys and in Fort Worth, the seismic company performed its own investigation and concluded that the obvious damage to the homes was more likely caused by natural settlement or shifting soil than seismic testing.

In Pennsylvania and New York, it is damage to water wells that is of greatest concern. Claims that shallow water wells have been damaged by seismic trucks working up to a mile away in the Marcellus shale areas of Pennsylvania have been made. And in New York, sevSee SEISMIC TESTING Page 14

eral towns have at one time or another considered moratoriums on seismic testing in an effort to protect water wells and sewage pipes. **** The COGCC’s Hartman says he is not aware of any fines for damages resulting from seismic testing in Colorado, but acknowledges that there has been at least one fine issued to a company for accessing land without properly getting permission from the property owner.

When notified of the COGCC investigation, Anadarko spokesperson John Christiansen said, “That would be a good thing, in this case.”

He added that the company and its contractors are very careful about monitoring vibrations and notifying property owners in advance of the testing.

But Jan Moles, president of the monitoring company Urban Seismic, told BW that his employee “made a mistake” when he walked onto the Crumbleys’ land without first gaining permission or at least notifying them.

“He was reprimanded and sent home for a while. … It was just an honest mistake. We were trying to protect their property.”

When asked what might have caused the damage to the Crumbleys’ property if it wasn’t the trucks, Moles says there are a variety of environmental conditions that can cause soils “to expand and contract, and it puts a whole lot more stress on these structures than the vibrations from these trucks.”

He adds that most of the energy emitted by the equipment travels straight down, and the vibrations along the surface represent “one-tenth of what it would take to make concrete crack.

It’s physically impossible. … I’ve been in this business 15 to 20 years, and I’ve never seen damage caused by these vibrations.”

It appears difficult to prove that cracked walls and foundations were caused by seismic testing vibrations.

While it may be possible to get a baseline test of the condition of a water well before seismic testing begins in an area, something that critics of seismic testing encourage landowners to do, it is more difficult to do the same for a home. The only precaution for homeowners would be to shell out the cash for a home and land inspection prior to the arrival of the trucks, to document the existing condition of the property.

Certified home inspector Jeff Lyons, owner of A-Pro Home Inspection Services of Boulder County, agrees that it is difficult to pinpoint the exact cause

of a crack in a wall or ceiling like those found in the Crumbley household.

“You really can’t tell,” he tells BW. “There are a number of things it could be, but you couldn’t definitively tell that’s what it is, not just by doing a visual examination.”

Lyons says that inspectors can make an educated guess about the cause based on other indicators, like foundation cracks, root intrusion and the location and angle of cracks around doors, windows and drywall.

He says one-time cracks caused by vibrations like those from seismic trucks shouldn’t continue to spread over time, so homeowners could mark the ends of the cracks and photograph them. If they continue to spread, it is probably indicative of shifting soil or another ongoing problem rather than a single event.

“But you wouldn’t be able to definitively tell, you would only be able to make some assumptions,” Lyons says.

“It’s not an exact science.”

Still, Anne Sheehan, a geophysics professor at the University of Colorado, says she is skeptical that seismic testing is capable of causing cracks in walls and a well to collapse.

“I would be surprised if the damage you mention is due to vibroseis trucks,” she wrote via email. “I have visited a number of vibroseis experiments over the years (including riding in the trucks and standing next to the trucks to feel the shaking). The vibrations are similar to a truck driving and sounds are similar to those from a garbage truck.

“I took my undergraduate geophysics class out to visit the Geokinetics seismic crew east of Greeley last month,” she continued. “In my opinion, they are doing a very careful job and are sensitive to any landowner and resident concerns.”

But the Crumbleys have considered pressing trespassing charges against Urban Seismic and its employee, or even filing a lawsuit, although Charlie Crumbley says he has been advised that a suit will cost six figures because the couple will be outgunned.

“Once you get involved with a company like Anadarko, they’ll price you out of the game,” he says. “What’s happening to us is a very common thing.

They come in and do their investigation and then deny.”

And as another truck rumbles by, Mieko Crumbley says the nearby Halliburton facility used to be a feed lot.

“We wish we had that old feed lot back,” she says. “It used to be a nice, quiet place to live.”

State resurrects fund that compensates communities for oil/gas impacts

he state has resumed pouring millions of dollars into a 35-year-old fund that aims to offset impacts caused by oil and gas operations and other forms of resource extraction.

The Energy/Mineral Impact Assistance Fund (EIAF), created by the Legislature in 1977, has been dormant in recent years because state officials were raiding its funding to offset budget shortfalls. It has historically been doled out to government entities like counties, cities and school districts to compensate communities for negative socioeconomic impacts caused by activities like drilling and mining.

The three-year funding hiatus, when combined with the recent expansion of oil/gas activity around the state and heightened concerns about hydraulic fracturing, or fracking, has created fierce competition for the restored EIAF grants.

“As you can imagine, the demand now is so great,” says Linda Rice, spokesperson for the Department of Local Affairs, the state agency that administers the fund.

“There’s pent-up demand,” adds Tony Hernandez, director of the department. “It’s very competitive.”

When the first round of grants recipients in three years were selected earlier this spring, the applications far exceeded the number of projects that could be funded. The state had $20 million to distribute and about $36 million in requests, according to Hernandez. The next deadline for applications is April 1, when the department will have another $20 million to hand out. A total of $75.5 million will be granted this year.

Hernandez says natural gas extraction is currently the biggest driver behind the applications his department is seeing.

He explains that the EIAF money is not intended for cleanup activities or mitigating environmental damage done by the extraction of natural resources.

It’s aimed at compensating entities for the loss of the natural resource or other negative effects caused by activities like oil/gas operations, he says, citing everything from damage to roads or other infrastructure to social impacts like crime and alcohol abuse.

Many used the money for upgrades to water drainage and treatment systems, while others applied the grants to new emergency warning and health monitoring systems. The department received proposals for upgrades to hospitals and fire stations, emergency response vehicles, hazardous material identification kits and radiology equipment.

Prowers County used its 2009 grant to buy a wind turbine.

But a government entity can also use the funds for projects seemingly unrelated to oil, gas or minerals, like a new library, school or community center, because the money is intended to compensate the community for a loss by providing an asset, Hernandez says.

Political entities applying for the grants must commit at least 25 percent of the funding for the project, and the applications are rated on seven criteria: demonstration of need, measurable outcomes, relationship to community goals, local commitment, ability to pay, readiness to go and energy/mineral impact.

While Hernandez makes the final decisions on EIAF funding requests, he is assisted by a 12-member advisory committee (seven members are appointed by the governor, while the others are directors of state departments or their designees).

Hernandez says the natural resource extraction industry is not the only business that generates so many negative impacts that the state has set aside millions of dollars a year to address the effects. He points to the gaming industry, which also warrants a separate assistance fund in his department, although that program is financed at a drastically lower level, only $4 million to $5 million a year.

In 2009, when the program was last fully funded, there were 338 grants issued, to the tune of more than $140 million.

That year, city of Longmont applied for about $1 million of that for Quail Road infrastructure improvements, but was denied. Nederland was awarded $600,000 for a water treatment plant project in 2009.

Colorado’s rainwater harvesting laws pose a challenge for ‘biotecture’ homes

Joe Callahan, an environmental engineer and educator of renewable energy, built an earthship up Fourmile Canyon in 1995.

He renovated a conventional home into an earthship, and the former property owners had already drilled a well nearby.

Having been warned about the restrictions of water harvest, Callahan primarily used the well for water consumption to avoid any trouble.

“It seems crazy to me that we mix wastewater with more water and bring all this energy into filtering it for sanitary use,” Callahan says. “Gray water is a great way to use water. Plants love it. My banana trees wouldn’t stop growing.”

Callahan did seek permission from the state health department to reuse gray water and was given the green light.

Earthships are generally designed with pipes to transfer gray water, or water from the shower or washing machine, to an indoor greenhouse for plants. The water filters through soil, is collected, and transferred to the bath house, where it’s used to flush a composting toilet, turning into “black water.” Finally, the remaining water is sent to an underground septic tank. When building codes allow earthships to function the way they are meant to, rainwater is used three times, aside from drinking, before it’s slowly pumped back into the ground.

In 2007, a study done by the Colorado Water Conservation Board revealed that 97 percent of rain evaporates before it reaches a stream or reservoir.

A bee venom toxin’s anti-HIV properties have long been known to science, but Washington University School of Medicine researchers recently discovered a way to load the toxin onto nano particles, so it can destroy HIV cells without harming other body cells.

That’s a crucial step, they say, towards developing a gel that could prevent the spread of AIDS. Melittin is the potent toxin found in bee venom that can destroy viruses and even tumor cells by poking holes in the cells’ boundaries.

Until recently, it was unclear how normal body cells could survive a dose of melittin. But because human cells are much bigger than nanoparticles, and HIV cells much smaller, the Washington University researchers added “bumpers” to the nanoparticles they coated in melittin. The bumpers make normal cells bounce off the nanoparticles, while the tiny HIV cells slide between bumpers, approaching the nanoparticle’s toxic coating.

The study, published in Antiviral Therapy, suggests that this approach differs from existing HIV treatments, which target the virus’s ability to replicate. Melittincarrying nanoparticles could be used in a vaginal gel to prevent initial infections, especially in areas where AIDS is rampant. The nanoparticles could also theoretically clear HIV from the bloodstream after an infection.

the amount of rainwater usually harvested is so minimal, he’s never heard of anyone getting arrested or filing suit.

“Catching rainwater isn’t a problem unless everyone is doing it,” Kenney says.

Amber Hess, a friend of Callahan’s, also built an earthship in Boulder. Hers is considered a “greenhouse studio,” and it’s situated right behind her conventional 6th Street house. When Hess had concerns about potential power crises with Y2K on the rise, she heard

about earthships and had to check them out. Hess ventured to Taos for a weekend workshop, spent the night in one and fell in love. She started to build in 1999.

“On almost a visceral level, it feels right to be in a cave,” Hess says, referring to earthships’ more primitive characteristics. “The idea of having all the luxury of a glass front and all the protection is like the best of both worlds. You have that feeling of being housed, like a hobbit house. And you

have the fact that these houses take care of you.”

Hess hasn’t used her trenched rooftop or water system even once. Her studio serves as a space for her yoga practice and she waters plants like her avocado tree by hand.

Like Callahan and Fry, Hess says she hopes the rainwater rules will eventually loosen, so that she may serve her greenhouse the way earthships are supposed to.

W

ith each turn of my skis, snow sloughs off the steep chute and cascades down toward the basin below. It’s not enough snow to be frightening, certainly, but enough to feel like I really am off the beaten track.

And that, of course, is the point.

I’m cat skiing with Monarch Snowcat Tours in a snowcat packed with a crew (plus a few of us hangers-on) from Liberty Skis, the Avon-based ski comAnton Sponar pany that makes powder-hungry, easy turning skis from bamboo cores. We’re spending the day out beyond that dotted red line on the ski area map, ducking ropes at the invitation of ski patrol and our guides. My first question for the day — can the reporter with the desk job hang with the people who ski for a living and can see the Beavercreek lifts from their office windows? — will be quickly buried by boot-deep powder or shed in some of the windblown crust I’ll skim across on my loaner Liberty skis.

What takes over, as we speed down steep chutes, pivot around trees and sink edges into the slough of open bowls, then pop out of our skis and ride up in our cozy cat, comes back to a larger conversation I’d started on the drive up, spending my I-70 time catching up with a friend on the phone.

I was heading toward the exit for Highway 119 and south toward Salida, passing the beacon lights of snowcats on Copper Mountain, as we hit on the topic of the essence of skiing. Backcountry skiing, we agreed, was the true essence — a stripped down expe-

Monarch will hit its 75th anniversary in 2014, but those mountains have been getting skied since 1914, according to Monarch Mountain’s website, making next year a clean century of people skiing down that valley.

Ski resorts in Colorado reported more than 12 million skier visits in the 2011-2012 season; 6.1 million at Colorado Ski Country resorts like Copper, Arapahoe Basin and Monarch, and 6.1 million at Vail resorts — down 12 percent from 7 million the previous year after a season that saw 50 percent the usual annual snowfall.

Colorado Ski Country resorts saw a similar dip. While those resorts have weathered some leaner seasons lately, it’s tough to say that the sport is suffering. But the industry is also keeping an eye on the increasing attention to backcountry skiing. At the Outdoor Retailers Winter Market in January, some of the centerpiece discussions focused on increasing safety, gear advancements in the backcountry — and increasing interest in using resorts for backcountry access.

taken a short cat ride off the back side of Monarch, looked down at the sobering view of an avalanche that hit the lake below so hard that it moved the ice sheet across the top and spilled water into a neighboring meadow.

The cat skiing guides are trained in avalanche mitigation and manage those slopes to prevent similar snow activity where we’re skiing, shearing off cornices and shooting for avalanches when necessary. In some ways, the price point of a cat tour — the whole cat reserves for 12 people for $3,000 in the peak season, which ended March 25, or an individual seat goes for $275 — pays for that degree of safety. It’s a sidecountry experience, terrain tough enough to find challenging and fun, while also being crowd-free, avalanche controlled, personally guided, and interspersed with warm-up breaks inside the climate-controlled cat.

Cat skiing may bring all of the glory — 10 to 12 runs and 900 vertical feet in a day, on average — and none of the hard work that “true essence” of backcountry provides, but as we squeeze into the canary yellow snowcat, the rack packed with Liberty skis, the buzz is palpable. It may not be the bare essentials essence of skiing, but we’re tapped into the soul of the sport. At least, that’s how it feels, seven laps later, every bit of my legs consumed with a feel-good

burn and the day not even half spent.

A clear morning allows for a view of the surrounding mountain ranges — the Sawatch in either direction, the San Juans and Sangre de Cristos to the south, the solitary Pikes Peak back east and even, just as a dark smudge far out there, the rim of the Black Canyon.

Through the course of the day, we’ll lose the views as a storm rolls in from the south and obscures the previously visible peaks, the temperature drops and snow begins to fall.

And the atmosphere in the cat stays charged despite the chill in the weather. I’d thought I’d be the only person present who spends more days at a keyboard than on snow (and my first thought to that is “Oh my God, I hope I’m not the first person to eat it”), but I’m skiing with Adrianna Simpson, a Florida transplant who came to the University of Colorado so she could ski more often and now does the administrative work for Liberty, and Dan Chalfant, who was a fly fish-

ing guide for 18 years before deciding he’d need to get a real job to stay in a ski town.

OK, and a couple guys who pretty much ski for a living. But they can huck the big cliffs while the rest of us carve our way down chutes — and that’s pretty much what we do through Dog Heaven, the Krudski Chutes and Mirkwood Basin off the north

edge of Monarch.

The conversation between runs while we pop off goggles and snack on energy bars is the predicted accident and snow reports and YouTube crash videos (which has to be the real reason for wearing a GoPro everywhere you go). And then it’s a surprise — guys comparing the colors in this season’s line versus next season and saying they’re going to wait so they don’t have to glow in this year’s borderline fluorescent color scheme.

I’ve been set up with a pair of Liberty Envy Powder skis, the women’s model powder ski, a generous 105mm at the waist and 135mm at the tip.

They float in a way my own skis don’t, to the point that when I’m releasing my uphill edge on those first turns, I actually pick up the ski, it’s so light. When we hit the groomed trail headed in for lunch, that’s when their incredible ability to slalom shows itself. I’m tipping like a ski racer and it’s virtually flat, but

adventure they’re so light and easy — they go right to my head, let me put it that way.

A chair lift conversation with Anton Sponer, whose father, Toni Sponer, founded a cat skiing company in Chile where Anton now guides tours, circles back to that topic of increasing interest in the backcountry — and how skis like these, which float over windblown crusts and stay on top of the powder — are fueling the interest in the backcountry skiing. They just make it so damn easy.

One thing’s for sure: the skis were more shred-ready than my jacket, which started spitting its 800-fill down well before lunch time.

Adrianna and I pair up with a smile for tree runs and it’s only when I smack into a pine bough hard enough to shred my new GoLite jacket that she has to turn back and call “Liz?” I’m not lost.

Just hung up momentarily.

At close to 4 p.m., we’re still whipping through the trees. My companions are audible more often than they’re visible. The sounds of them whooping and hollering to one another just barely cuts through the dense trees that allow for a choose-your-own-adventure feel: Stay right, and it’ll be more mellow, open trees and less steep terrain; go skier’s left, and you’ll find the steeper, tighter trees and a few drops. It never closes down to the half-expected thickets.

There’s always a route, and it’s often got a heap of powder over the top. The toughest part is not smiling so much you catch pine needles in your teeth.

We’ll ski until after the lifts have shut down, finally coasting in to the lodge and heading directly to the Sidewinder Saloon.

Dan Chalfant, Liberty’s CEO, gets me caught up on the company’s history as we’re rehydrating Austrian-style over beers.

“Nobody’s going to make $1 million in the ski industry. We love it because it’s what we do, it’s who we are,” he says.

“You have that point in your life where you’re going to decide either you’re going to have a real job in a mountain town or you’re going to move on.”

After 18 years as a fly fishing guide, Dan was hitting that point.

A good idea and a lot of luck helped make staying in a mountain town with a real job — a company he co-founded with Jim Satloff — possible. The way he tells the story over a kolsch now, the right things came together at the right time.

After fishing on split cane bamboo rods, which have a desired bend and give but can still reel in enormous fish, they had the idea of bamboo for a ski core as a lightweight but less noodle-y Boulder Weekly

option for skis meant for powder days.

Then, in 2003, they went to the Snowsports Industry trade show at Mandalay Bay in Las Vegas. Satloff went up to a craps table and won $20,000. They won enough money over two days to start their first production run.

“Most of what I remember about that is yelling, ‘Winna winna chicken dinner,’” Dan says.

They put together the idea with

some money and the right people — a production group in China near the groves where the bamboo that goes into their skis is made.

The company has grown over the years, now with a staff of six, three of whom were hired in the last year and a half. He picked people who were looking for what he was looking for — a real job that meant making a real life in a mountain town. They now all live and work out of Avon and can see

Not a bad setup, really.

And cat skiing Monarch is every bit the prize for them as it is for me. It’s both a late season reward for all the ice and crud and rocks I’ve skied or tried to ski over this season, and the spark that’ll fuel the chase for some slushy spring skiing runs into closing days everywhere.

few days before her African dance class presentation, University of Colorado Boulder student Jessie DePasquale’s dance partner said she wouldn’t be there.

Her teacher, Nii Armah Sowah, had put DePasquale in a group with only one other person, while other groups had 10. He challenged the two girls because they had taken the class already, and they listened to Sowah when he said, “You can see [this pairing] as a stumbling block where you will fall and not manifest your radiance, or you can use it as a stepping stone and shine.”

DePasquale wanted to shine, but dancing alone terrified her.

“I was like, I don’t want to go by myself. You can’t make me go in the middle of everyone and dance. University Theater Building. She talked to classmates dressed in colorful traditional African pants or skirts tied around their waists, and the Ghanaian drummers who pumped the class with visceral rhythms. Sowah told her to “find her power” and to not be afraid.

But on the day of her performance, as she moved and clapped in a ring of encouragement around each dancing group, she had to make her decision.

“She stepped out,” Sowah says. “She took all the centers of her being — the emotional, the mental, physical, spiritual — and connected all of them. She expressed herself and, within moments of her stepping out, there was light.

People started screaming. People went on the floor and started beating the floor. She danced from her soul.”

Sowah doesn’t consider himself a dance teacher, or even a teacher in general. His life’s work is healing and inspiring people to be better humans.

Viewing dance as “the mother of the arts,” he studied and taught the art form at the University of Ghana’s School of Performing Arts. But he followed his true passion for human development in the early ’90s when he came to Boston to get a master’s degree in expressive arts therapies at Lesley University.

Though Sowah taught a dance class and garnered a small following that embraced his approach, Boston was an inhospitable environment for the Ghanaian.

“The East Coast was cold and socially it was colder. I arrived in a blizzard in my sneakers, airport closed, lost all my luggage except my handbag for a whole month with only $80 in my pocket. [I would get] lost in the street and nobody wanted to talk to me because I’m black,” Sowah says.

“All of those things happened and I felt like I needed to go to a place where people were open. I don’t believe in going door-to-door begging people to listen to me. I needed to find people who were open and ready to go to Ghana.”

After hearing about the sunny weather and open-mindedness of Boulder, he made the move. Sowah now also runs his 1,000 Voices projects, a community choir, and also officiates weddings, supports fundraisers and even counsels families with adopted African children. He even says other Africans, like the drummers for his class, only moved to Boulder after hearing of his work in the area.

But one of the truest measures of Sowah’s success is through his African dance students at CU, who say that Sowah is doing more than just teaching.

“He’s giving us really important life lessons and giving us a safe space to explore our passions and our limits and our potentials, not only as dancers,” says Rosie Dooley, a sophomore environmental studies major. “It’s unlike any class I’ve taken in my life.”

“There are courses that can teach you knowledge and ideas about the world.

But he says you have the power to be an integral part of a community.”

Creating a safe space for a community to blossom in a classroom is central to Sowah’s philosophy for education. Knowledge of every name in class is required so students can see their peers not just as bodies, but as fellow human beings, and students are divided into families that work on routines and cook together outside of class.

Sowah invites the group to his house for storytelling, and even devotes a day to a class-wide pillow fight. Though Sowah’s class is a far cry from most conventional university classes, students say that the value of their lessons can’t be measured in letter grades.

“A lot of the time in class you don’t get to know people sitting next to you,” says Helen Katich, a geography and community studies major. “But he encourages friendship and interaction.

You don’t just learn the steps and leave sweaty, you take something bigger away with you.”

Not only does this community make dance easier, but it also teaches about differences between cultural norms. In African culture more than in Western culture, dance, music and daily life flow between one another. By taking dance out of the traditional concert hall and repurposing it as everyday expression, Sowah says he hopes to transform his Boulder Weekly

students into open, global citizens.

“If I put a basket on the wall, it’s beautiful, or if I put a dance on the stage, it’s beautiful,” Sowah says. “But the real place of a basket is carrying oranges. The real place of dance is living and feeling, not showing. It’s interacting. When you take that idea out of your education and you’re visiting any village, you’re aware of cultural values like this. Otherwise you just go without any desire to embrace or appreciate a different aesthetic.”

But the ultimate goal of Sowah’s class is the self-empowerment that DePasquale experienced during her solo dance. After she finished, she was shaking for a long time. By dancing so freely with the support of the community behind her, she says, she felt like a part of her had been healed. Later she met with Sowah to talk about what had happened.

“He believed in me,” DePasquale says. “He pushes students and challenges them, and the students who meet the challenges are greatly rewarded not only in class, but in life. I overcame my fears and it felt really good. The more I do things like that, the more I can do it in my life.”

For Sowah, he hopes every student discovers what DePasquale discovered that day.

“That is what I am talking about, finding your power and shining it,” Sowah says. “That is when you are living fully.”

asoline Lollipops’ founder Clay Rose is tired of people saying that songwriters should just be themselves. Though this may manifest itself more overtly in his side project where band members dress and act like 1920s zombies, Gasoline Lollipops certainly creates its own enchanted atmosphere. The Boulder musician thinks it’s important to be genuine onstage — but genuine is very different than ordinary.

“When you’re watching Bruce Springsteen running back and forth and sliding on his knees and doing what he does onstage, it’s not like he slides across the kitchen to get another beer,” Rose says. “He’s just a normal person, but he does it onstage for Arianne Autaubo our benefit because it’s entertaining.”

Formed in 2009, Gasoline Lollipops’ blend of folk and gypsypunk aims to conjure an environment, one where hobo travelers ride the rails to unknown destinations. At one time featuring artists like Ben Wahamaki (The Lumineers) and Gregory Alan Isakov, Rose and Gas Pop’s current lineup ( Jeb Bows, Don Ambory, Matt Cantor and Jonny Mauser) weave tales to take people out of Boulder County and into an imaginary world.

“It’s my dream life that runs parallel to my physical life, where my Jeep Cherokee is actually a freight train, where my wife is actually a hobo jungle princess, and where Boulder is actually Atlantis or some mythical place,” he says. “My songs are everyday life put through a filter of romance.”

Growing up, Rose split his time between living in Nashville with his songwriter mom, who once worked with Willie Nelson, and living in Boulder with his dad, who was a hobo back in the ’60s. The Gas Pops’ folk sensibility clearly reflects his upbringing among the pedal scales players and harmonica players in Nashville’s Bluebird Theater.

But Rose’s first love was punk rock and, as a young adult, he was drawn to an enticing music scene that took hold in Boulder.

“I had this liberty spike mohawk and wore big combat boots and sang really fast and played really fast and everything was aggro,” Rose says. “I would just sing about how screwed up the country is.”

This penchant for rebellion emerges in the sometimes

gruff, growling vocals that pepper the band’s earnest altfolk on its newest release, Dawn. With seven songs on the album (or “lucky seven,” as Rose calls it), the EP is the first in a three-part series. The band plans to release the second installment, Death, over the summer and the third, Resurrection, this Christmas.

“We’re taking a little trip through birth, old age and death,” Rose says. “But there’s going to be a little resurrection so people don’t kill themselves after they listen to our trilogy.”

It seems the macabre is never far from Rose’s mind, and in addition to the Gas Pops, Rose plays in his other band, called The Widow’s Bane. Though the theatrical group is in high demand and has a new album set to be released this June, Rose says Gasoline Lollipops is the band he’s most sincere about. But each project does have its own appeal.

“There are days when I certainly want to be detached and have some distance from my art and my heart, because it hurts too much,” Rose says. “With Gas Pops, when you go out to play an empty dive bar where you’re singing from your heart, it can be painful sometimes.

But with Widow’s Bane, Mortimer Leech is a crusty old fucker and he could care less if you like his songs or not.

So it’s sort of liberating to go out with that brass.”

Rose’s big goal is to get both Gasoline Lollipops and The Widow’s Bane in to next year’s SXSW, but for now he’s at least hoping for a Gas Pops Midwest tour later this year.

Beyond their upcoming show at Quixote’s True Blue in Denver on March 31, Rose is looking forward to playing with The Paula Nelson Band in April at The Walnut Room.

He’s never met Nelson, who is Willie Nelson’s daughter, but he dryly hints at something he might learn at that show.

“Things were pretty blurry back then in the day when my mom was hanging out with Willie, but I’ll let you draw conclusions,” Rose says, coyly. “If she looks just like me, I may have to sue her dad for child support.”

“We do lots of improvisation,” Sites says. “A song might be seven minutes long one night and 14 minutes the next. Our bass player is a jazz-head who surfs his bass, and when you add that to the mix along with drums, the music takes on a life of its own.”

And for that reason, the drummer’s job is likely safe no matter what kind of song he offers for the band to take a ride on. Anybody up for a little deathmetal bluegrass?

Whitewater Ramble may be the first band on the ticket this spring at the Planet Bluegrass Wildflower Pavilion in Lyons, but it isn’t the last.

The Hillbenders, along with Finnders & Youngberg, will be leaving no string unpicked as their version of energy bluegrass finds it way into the Pavilion on Friday, April 5.

CU professor looks to make the biggest student film ever

W

hile discussing his ambitious new project — “the biggest student film of all time” — director, screenwriter and University of Colorado assistant professor Alex Cox brings up an interesting point about anti-war movies. More specifically, about the lack thereof.

“It’s hard to make antiwar films,” Cox says. “People don’t really want to make them. You can be ambiguous about war.”

Cox should know. The director of Repo Man and Sid & Nancy has been trying to make an unequivocal anti-war film for 30 years, to no avail.

The movie is Bill, The Galactic Hero, based on the Harry Harrison science fiction book of the same name. After Cox made Repo Man, he found himself with “a little bit of money left over,” and he optioned the movie rights from Harrison. However, he couldn’t find enough money to make the film, so he shelved the project.

Thirty years and around a dozen feature films later, Cox hasn’t forgotten about Bill. It seems that being at the University of Colorado has offered him a unique chance at finally making the film a reality. Surrounded by scores of free labor, he figured, why not make Bill, The Galactic Hero come to life as a student film?

Cox has it all worked out. By using the resources around him at the university, he is confident he can make Bill, The Galactic Hero with an all-student crew and keep his artistic intentions intact.

The aerospace engineering department has mock spacesuits and a space shuttle they use in simulations that Cox will be able to borrow for the film (he will need to procure 20 such suits in order to shoot the film, he says). He wants to poach actors from the theater and dance program, a design team from the art department, and film students to handle the camera work and editing.

Harrison wrote Bill, The Galactic Hero as a “riposte” to Robert Heinlein’s Starship Troopers, which Harrison saw as unforgivably pro-military, Cox says.

Like Heinlein, Harrison was a World War II vet, but he emerged from the war with a bitter taste and soured view of the military.

“The whole idea is that you can only vote in [the Starship Troopers universe] if you’ve actually been in the army,” Cox says. “So it’s a very narrow interpretation of the height of human civilization.”

Even given the bevy of resources available to him, Cox still lacks one thing: money. To this effect, he is starting a Kickstarter campaign (http://bit. ly/BillHero) to raise $100,000 to fund the film’s production. Fundraising began March 22, and as of press time, the campaign had already garnered more than $31,000 in donations.

Supervising the students will be a slew of industry professionals. Sound designer Richard Beggs, who worked on Apocalypse Now, some Harry Potter movies and some of Cox’s films, will help with the audio. Composer Dan

Wool, a longtime Cox collaborator, will help with the movie’s soundtrack. Special effects gurus from Tippett Studios and Collateral Image will lend wisdom to the CGI side of things, and two cinematographers, Tom Richmond and Steve Freidberg, will pitch in.

In an ironic twist, the producer of Starship Troopers, Jon Davidson, has agreed to lead the initial pre-production meeting, Cox says.

“Years ago, we were trying to do a film called Mars Attacks, based on the bubble gum cards. That was our project, but we could never get it on. Tim Burton ended up directing it,” Cox says of his relationship with Davidson. “But we always remained in touch. We did a film together about five years ago called Searchers 2.0, and so he’s agreed to come out and sort of be the producer spirit.”

As Cox admits on the Kickstarter page, the dangers of funding such a venture are two-fold: that the film might not be completed, and that it might be bad. The former seems unlikely, Cox says, given his decadeslong career as a filmmaker in Hollywood and elsewhere, and the latter has a few things working against it. Chiefly, the project has the blessing of the book’s author, Harrison. He and Cox worked together on the screenplay before Harrison’s death in August 2012.

“Harry read about two-thirds of the script. Then he went to his reward, and I finished it,” Cox says. “It’s done and it’s ready to go, ready to be made.”

The project will hopefully complete the circle for Cox and bring some closure to the 30-year project. But he also hopes to make that rarity of films these days, an unabashedly anti-war one.

“I think good art should be unambiguous,” Cox says. “The time for ambiguity has passed. … I think art has to be unambiguous, given the times.”

‘Die Hard’ got ‘Air Force One’ pregnant

T

he only explanation that makes sense for the existence of Olympus Has Fallen is that someone found a 1990s action movie on VHS underneath Joel Silver’s bed and paid to have Gerard Butler digitally transposed over Steven Seagal.

The Die Hard franchise may be hiking up its skirt and whoring its nostalgia, but look no further than this blathering gibberish for a genuine blast from the past; it hails from a time when men were monosyllabic, women were senselessly killed off to motivate dude anger and the bad guy’s nationality mattered less than how creatively he would be killed.

The Internet says that Creighton Rothenberger and Katrin Benedikt wrote the screenplay, but it’s lying.

The only way it would take two people to write this is if they were stroke victims and one could only write nouns and the other could only write verbs. Director Antoine Fuqua, simultaneously a maestro of schlock action and the director responsible for Denzel Washington’s sole Best Actor Oscar, completely understood his role and this film’s merit: create a visceral adult cartoon where physics are mere suggestions and “characterization” is the hero grimacing when he shoves his fingers through a villain’s eye socket.

Butler plays Mike Banning, the most overqualified Secret Serviceman in the history of ever. He can defeat North Korea with a Bic lighter, but the government thought he’d be best used as a glorified chaperone. When he heroically saves President Asher (Aaron Eckhart), he gets fired for reasons you need to ask Ashley Judd about. Luckily, when a terrorist cell

descends upon the White House, he’s available.

While the evil Kang (Rick Yune) tortures forgotten Oscar-winner Melissa Leo, who plays the secretary of defense, the speaker of the House (Morgan Freeman) and the Secret Service director (Angela Bassett) talk on the phone to Banning, who’s polite enough to call even while busy murdering. Faster than you can say “Is that Dylan McDermott or Dermot Mulroney,” this lone warrior is shoving knives into brains for America.

The film is one more shot of a tattered flag from being a Toby Keith song.

Dumb, dumb, dumb. Dumb everywhere. From blatantly silly dialogue to the fact that the movie never clarifies the true identity or intent of the villain, this feels like a college student on spring break guarding his last functioning brain cell. And thank God! Yes, thank God it is so stupid, because nobody can take it seriously and fetishize the villain (like Ledger’s Joker). The NRA’s adorable assertion that somehow movies are more dangerous than actual firearms has increased the scrutiny on fictional violence; because it’s that or having to tell billionaire gun company CEOs “no.” Olympus Has Fallen is glorious because of its resplendent stupidity. It is a live-action Tom and Jerry cartoon with some marginally famous people in it. It is meaningless, insignificant fun so grounded in fantasy nobody would dare ape it. In short, it is a guilty pleasure enjoyed with a clean conscience.

M

ike MacKinnon leads Christie into a small room and up onto a platform, where her neck is harnessed to keep her in place.

Then he grabs a clean pail, pulls up a stool and begins to milk the French Alpine dairy goat, which recently gave birth at Frog Belly Farm in Longmont.

But this is no ordinary dairy.

The process of making this milk ready to drink is almost over, and includes running the liquid through a strainer, and then chilling it in the farm’s walk-in refrigerator before bottling. The folks at Frog Belly Farm prefer their dairy raw rather than pasteurized.

“Everything you need is in raw milk,” farm owner MacKinnon says during a tour of his property. MacKinnon sells shares of his 35-goat herd — the only legal way to buy or sell raw milk in Colorado — to about 40 local shareholders. Frog Belly Farm is one of just three dairies in Boulder County — and 47 in the state — on the Raw Milk Association of Colorado’s membership list.

Membership is not mandatory, but the numbers are still a clear indicator that raw-milk drinkers are in the minority.

Access, or lack thereof, to raw dairy is an obvious obstacle. But advocates face a huge uphill battle when it comes to shaking the stigma of raw milk as

even argue that the pasteurization process removes many of the healthful proteins and vitamins found naturally in milk.

“When they pasteurize milk, they take all the good stuff out and then they try to put it back in,” says Rick Jones, owner of Custom Nutrition and Exercise in Boulder. “It’s no longer in its natural state. When they put the vitamins and hormones back in, you’re not getting as good of a quality of milk. People often have a harder time digesting it.”

His opinion is in line with those of the Weston A. Price Foundation, a nonprofit with chapters all over the world that encourages the safe consumption of raw milk.

Twenty Ninth Street’s Ristorante L, formerly known as Laudisio, has announced a new menu that will be available at the restaurant’s tapasstyle bar during all hours of operation.

The happy hour menu will also be offered throughout the restaurant — in the dining room, patio and bar — during lunch hour.

Scott Schaden, a representative of The L, says the menu was inspired by a trip to Italy, and will reflect both fine dining and small-café food. He mentions a Caesar salad with white anchovies, pork milanese, chicken mattone and a margherita pizza as highlights of the smallerportion menu.

Schaden says an emphasis on freshness has prompted the restaurant to slice meats and prepare some sauces to order rather than ahead of time. The L will also offer wine from a new wine list in the bar area.

Mara’s a longtime fan of duck, and she quickly gravitated to the $21 Long Island Peking Duck, which bore little resemblance to the Chinese restaurant specialty. In this instance, slices of rare duck rested atop a bed of pearl-sized al dente couscous. Bing cherry and pomegranate flavors testified to the effectiveness of pairing fruit with this bird.

Mara took her time enjoying this dish, saying she wanted to “savor every bite.”

For the finish, a $8 pumpkin creme brulee was a tad more sweet than it needed to be. While the caramelized sugar crust wasn’t too thick, the overall

sweetness made the squash flavor difficult to detect. Which was too bad, because once I tasted a hint of the pumpkin, it added a subtle earthiness that built depth and rounded out the flavor profile.

Harold’s holds its own with just about any fine dining experience in the county, and it distinguishes itself with friendly service that’s still in tune with the slightly formal ambience. It’s a welcoming spot, well-suited to a date, special occasion meal, or those times when you want to treat yourself to a repast that’s a cut above.

“I don’t doubt that the people who consume raw milk believe there are positive impacts, but there are no studies to back that up,” Drager says. “I do know what it can do — it can kill people or make people very, very ill.”

Drager says greater county regulation wouldn’t really help.

“I don’t think we could ever get there,” Drager says. “Without that pasteurization step, the most critical step, it’s never going to be completely safe.”

Despite the warnings against consuming raw dairy, MacKinnon maintains that it is not only his choice but his right to choose what he puts into his body.

“It’s right for me. I drink it,” he says. “But I believe it’s up to the individual to make that decision, to do the research and decide if it’s right for them.”

MacKinnon set up his operation

following guidelines from the Raw Milk Association of Colorado. The organization’s mission is to unite producers and consumers, while creating standards for sanitation, testing and distribution that will help ensure the quality of raw milk available in Colorado. Even so, with no oversight committee or inspections, MacKinnon encourages those interested in buying a share of a goat or cow to visit the farm and get to know the farmer.

“I have visited some farms where I would not want to drink the milk they produce,” he says. “We’re pretty fastidious about our cleaning operations.”

Drager says this idea is nice, but it won’t beat pasteurization when it comes to keeping the milk safe.

“Really make sure you know what you’re drinking,” he advises. “Just saying, ‘I know the farm it’s from, I’ve been out there and it looks like they’re running a good operation and they’re really nice people,’ that doesn’t mean they can’t make a product that will make you very, very ill.”

MacKinnon says the benefits of raw milk outweigh the extra work.

“I have to live in the world, not separated from it,” MacKinnon says, explaining the driving force behind his decision to become a farmer. “I do it because I love raw milk — I want to drink it.”

’d like to apologize.

I’ve been inspired by Greg Mitchell, media critic and columnist for The Nation, who recently wrote an analysis for The Washington Post ripping that publication and many other media outlets for failing to criticize the war in Iraq and failing, even 10 years later, to admit they shared blame for the war.

The Post pulled Mitchell’s story and ran one much nicer to the media, but I’ve still been inspired to offer my own apology for failing on my own beat.

I am sorry for not liking Oskar Blues. I am sorry to you, the reader, and to the beer itself.

To Oskar Blues: I am sorry. I am sorry I didn’t recognize how awesome your beer is. I extend my apologies to Oskar and to the rest of the Blues family, and to all of their vaguely Southern, vaguely biker-themed kin.

I’m sorry that I ever referred to your beer as “hop-water,” not that I ever did, but if I did. You do a lot more than hop-water.

I’m sorry I thought Old Chub Scottish strong ale was an aberration and Ten Fidy stout was an accident.

I’m sorry that I hadn’t had Dale’s Pale for years before we came by on March 22. I don’t like pale ales, and still don’t, but I’m sorry anyway.

I apologize, and I was wrong, and I’m asking your forgiveness. And also that you make more barrel-aged Old Chub. And actually I’d take that over forgiveness.

ing two of Oskar Blues’ three locations. At Lyons’ Grill & Brew we couldn’t turn down the 10-taster tray with one of everything, including three specials: a wheat, a brown and an Irish red. The specials were, outside of maybe the imperial stout Ten Fidy, the maltiest and least hoppy beers available. Is Oskar Blues making an effort to round out the county’s hoppiest beer list? Did they prepare for me because they knew I was coming? Maybe and no, respectively.

Of course, all the Oskar Blues favorites were there, including Deviant Dale’s Imperial IPA and Gubna … umm … also Imperial IPA. OK, so the sky’s blue, the pope’s Catholic and hops are still the star for OB. But I’ve left the best for last: Old Chub, aged in whiskey barrels, was one of the specials at Tasty Weasel, housed in the Longmont brewery. It’s off tap now, so it would just be cruel to tell you too much. It blew me away. I can only recommend that everyone call Tasty Weasel with reasonable frequency — say, once every 20 minutes — asking them to put it back on tap.

I’m not a disciple or anything. I won’t be grabbing Deviant Dale’s next time I hit the liquor store. But I hope, over time, I can atone for the errors of my ways.

And again, if not, I’d gladly settle for more of that barrel-aged Old Chub.
