Conspiracy theories are sometimes warranted

(Re: “The new era of conspiracy thinking,” commentary, Feb. 7.) Who are the real conspiracy theorists? I can agree with Mr. Dyer that there are nutcases out there, but I suggest he look into who is to blame for an epidemic of conspiracy theorists. I partially blame our government and mass media. Nanomaterials, that is — manufactured or natural substances that are broken down in high-tech facilities to be teensie-tiny, molecule-sized particles. Don’t look for them on the ingredient list of food packages, because the big corporate processors of our edibles don’t want us to know that their goodies include these miniscule, mysterious “things” that, when ingested, go to

There are nutcases that claim our president is a Kenyan socialist that will take away your guns. Yes, Fox News is nothing but lies and propaganda designed to keep morons in a state of fear, and those that believe bigfoot is beyond the 9/11 attacks. These people are nutcases, not conspiracy theorists.

The term conspiracy theorist is a derogatory term, a broad brush used against those rational people that have every reason to be doubtful about what media and government tells them.

Wolfie Clark/Thornton I love the Boulder Weekly, but I had serious objections with Joel Dyer’s piece on conspiracies.

In many ways that article was filled with as many exaggerations and falsehoods about the Constitutionalist revival as anything you’d find on the “conspiracy” sites. He is constantly associating distrust of the Federal Reserve with anti-Semitic views. While these players no doubt exist, the most measured and accurate criticisms of the Fed come from decidedly non-bigoted people. Like Bernie Sanders and Peter Schiff (who is Jewish).

I laud what the president is doing and only wish he could do more towards gun control. I really think the problem has gotten out of hand. I was a Marine sergeant without combat experience. However, my life experience tells me that people were safer and saner prior to the proliferation of weapons occurring today. When I was young, people simply did not hoard or amass weapons and we felt a lot safer.

No one thought of a gun as a means of protection. It was essentially for hunting, and lectures from my father and other elders about safety still are vibrant in my memory. I believe that we face far greater danger from uncontrolled gun ownership than from any other domestic threat to contemporary society.

Hickenlooper’s drinking problem

here’s more than one way to lie. You can knowingly offer up false information as truth, or you can offer up little pieces of a story while leaving out other parts of the tale in order to convey a false impression without actually stating an inaccurate fact.

Morally, it’s all the same. Do it and you’re a liar. The governor of Colorado, John Hickenlooper, chose the second path to setting his pants on fire, and it’s not all that funny.

Technically, the governor can’t be punished for fibbing in his recent statements before the U.S. Senate Committee on Energy and Natural Resources, pity. You may recall the untruth in question came about when Hickenlooper decided to entertain the committee with his now infamous recounting of sitting around a table and drinking fracking fluid with his pals from Dick Cheney’s old employer Halliburton, apparently for no other reason than because it’s such a darn safe concoction to ingest.

I guess such seemingly bizarre behavior could be excused. After all, if survivalist action hero Bear Grylls can be fascinated with drinking his own urine on a weekly basis, then why shouldn’t a former oil and gas geologist like Hickenlooper get his rocks off knocking back a few shots of fracking fluid? I say to each his own, if it’s not hurting anybody else.

Not only do I not begrudge the governor his fracking fluid shooters, heck, I’ve caught myself of late wishing he’d drink a lot more of them, straight out of any fracking-fluid truck at any well site located anywhere in our state. But the governor wouldn’t do that, because he’s not crazy, he’s just a liar.

Hickenlooper used his drinking story in an effort to persuade members of Congress that what Halliburton and the other oil and gas companies are doing in Colorado and across our nation is completely safe and beneficial. The governor knew at the time he was drinking Halliburton’s fracking fluid that it was only a test fluid made from food derivatives and that it wasn’t the real deal that was actually being used for commercial Boulder Weekly

energy extraction purposes in Colorado and elsewhere.

In fact, it seems that the only actual use for Halliburton’s so-called experimental, non-toxic fracking fluid is that it gives industry lapdogs like Hickenlooper something they can drink and then lie about in order to deceive their constituents, and even their political peers, into believing that fracking is safe.

The reason Hickenlooper won’t be accepting any challenges to slurp back any real fracking fluid is simple. He knows, or darn sure should know, that according to research by the National Academy of Sciences, real fracking fluid on average contains 632 chemicals; 25 percent of those chemicals have been linked to causing cancer or other cellular mutations; 37 percent have been found to affect hormones; 75 percent have been known to adversely affect sensory organs and respiratory and gastrointestinal systems; and between 40 percent and 50 percent can screw up your kidneys and nervous, immune and cardiovascular systems. So have one more on me, governor. No really, you deserve it.

So next time you hear Hickenlooper say that Colorado has the strictest oil and gas regulations in the country, remember where his mouth has been, and take it for what it is, just another lie. Hickenlooper’s disarming smile has run its course in this state. It is clearly past time for him to use his well-earned pass through the revolving door between government and the oil and gas industry. I hope he has the good sense to move out of the Governor’s Mansion before we have to primary him out with an actual Democratic candidate in next year’s election.

The sooner we get rid of this oil and gas pitchman posing as our governor, the sooner the rest of us, the 70 percent or so of Colorado residents who oppose fracking and the state’s current industry-friendly oil and gas regulatory system, can get back to putting our commitment to the environment, our children’s health and Colorado’s quality of life ahead of the profits of Hickenlooper’s pals. We’ll all drink to that.

WHAT A BUNCH OF BOUGHT AND PAID FOR JERKS On Feb. 19, some 70 elected officials from various Colorado counties and municipalities signed a letter obviously penned by some PR hack from the oil and gas industry (it reeks like a typical Colorado Oil and Gas Association ploy, but who knows). The letter is a big thank you to our governor/gas-industry pitchman John Hickenlooper for his willingness to sue the city of Longmont for having the audacity to try to create safer drilling regulations that would better maintain the city’s quality of life and protect human health.

The letter states that “if left unchallenged [Longmont’s new oil and gas regulations]open the floodgates for other additional regulatory responses ... and would discourage future investment in energy development in Colorado.”

In other words, sue them fast, Mr. Governor, before other citizens start believing that they, too, have a right to self-determination as opposed to being required by the state to do what the oil companies want, no matter how destructive or dangerous.

It must feel like quite a threat to these little bureaucrats with cow patties for brains who signed this letter, to think that people might start believing that their governments are supposed to be doing what they want instead of doing the bidding of the oil and gas dick who bought their last round of golf.

But here’s the real punchline: The elected officials who signed the letter all come from areas that have already been drilled to hell. These are actually the morons in charge of all those places like Weld County, Firestone, Brighton, Parachute, Rangely, Yuma and Mesa County, places where you have to roll up your windows and lock your doors when you drive through because they smell like ass, and the locals, after years of economic, educational, environmental and democratic degradation, look like they just stepped out of the movie Deliverance (think banjo player).

Hickenlooper must be really proud that he is being praised by a bunch of local politicians from places that think that having a prison located nearby and a gas well on the front lawn of the elementary school is a sign of prestige. These ignorant letter signers represent the communities least likely to ever be featured in a Colorado tourism ad, and yet they have the yarbles to want to see Longmont get sued by the state for its effort to try to not become another oil and gas armpit like them.

The disingenuous men and women who allowed the industry to prod them into putting their John Hancock on this silly letter of support claim that if Longmont doesn’t allow drilling in its neighborhoods, the oil and gas industry will become confused and leave our state.

Honestly, this oft-repeated hollow threat by the industry and its lackeys is the equivalent of Cleavon Little (Sheriff Bart) holding the gun to his own head in Mel Brook’s film Blazing Saddles and threatening to shoot the N-word. And Hickenlooper and these letter signers are the movie town’s mayor saying, “Get back, I think he means it.”

If the oil and gas industry isn’t willing to abide by local regulations designed to protect health, quality of life and property values in exchange for the billions of dollars in profit they can make off of our natural resources, then we say, “Don’t let the state of Colorado’s door hit you in the ass on your way out.”

Better to lose the potential recipients of Social Security and Medicare than those who will have to sustain the trust funds.

Think of this as entitlement reform with live ammunition. The vast majority of military jobs — probably more than 80 percent of them — do not require extraordinary physical fitness or stamina, and could be filled by the middleaged just as easily as by the young.

There are millions of Americans who drive trucks, repair planes, cook meals, clean latrines and shuffle papers well into their 60s. They could obviously do the same in uniform. A healthy 55-yearold is just as capable of flying predator drones or driving remotely controlled robots as, say, a 20-year-old. (Hey, 55-year-olds have been playing video games for a lot longer.)

Much of what the modern military does involves command, control and

communications — management, in other words. Americans over the age of 55 have a lot more management experience than Americans aged 18-25.

Uncle Sam needs them. Their employers, who are desperate to reduce pension and health care costs, don’t.

And, of course, when it comes to hatred and grudges, the stuff that wars are really made of, the old beat the young hands down. In war, the young can sustain themselves with righteous

anger easily enough, but for genuine, industrial-strength hate, for grudges that transcend time and space, for the psychic poison that fuels and sustains fights to the death, ah, that is the stuff of old men.

Like I said before, war, like youth, is wasted on the young. Don’t send a boy to do a man’s job.

Do it for the chickens

(Re: “Advocates: Chicken flap belies true egg industry practices,” News, Feb. 7.) The focus on the warm and fuzzy adoption of chickens, effectively saving them from imminent slaughter, distracts us from the real issue: animal agriculture, regardless of scale, will never have the animal’s best interest at heart.

Their lives are the last priority; they are pure commodities to be bought, owned, sold, or slaughtered.

Taking their eggs throughout their lives is no different from slavery, as these chickens live and die at the hands of humans. Chickens, like all sentient, intelligent beings, have a natural order and way of life that we can’t fully understand. When in the wild, they follow complex social behaviors, establish sentries to watch over the flock, and they usually peck and eat their unfertilized eggs to absorb the calcium and other nutrients lost during egg-laying.

The fetishization of “small-scale” animal agriculture has led us to this horrible situation in which thousands of chickens were slaughtered at the folly of their “owner,” proving again that CSA animal agriculture is not the answer to factory farming; it’s not a way to re-create a life with meaning in our relationship with animals. To have a truly compassionate relationship with animals, we can’t take their things which aren’t ours — their eggs or their lives.

So go ahead, please adopt hens if you can, but consider adopting more than that: adopt a vegan diet. It’s the kindest thing you can do for the animals.

I

f the crackdown on bars that city of Boulder officials were discussing at a city council meeting this week sounds familiar, it’s probably because it’s similar to the approach that City Attorney Tom Carr took when he was Seattle’s city attorney.

But Carr denies that he’s driving the changes, and that his reputation of having a puritan-like agenda against nightlife and bars is not deserved.

Still, to some, the most recent effort to increase enforcement and regulation of establishments with liquor licenses smacks of the same authoritarian approach that city officials have been applying to other issues in recent years, from the camping ordinance that keeps homeless people from sleeping outdoors to the attempt at requiring protesters to obtain permits to the heavy-handed policing of medical marijuana dispensaries and the annual 4/20 pot smokeout.

Could the Republic of Boulder, once considered a bastion of progressive thought that fiercely protected people’s freedoms and individualism, now be the biggest nanny state in the area? **** Among the changes that city officials proposed this week in a new “action plan” for dealing with alcoholrelated problems are to: • target “problem” liquor-licensed establishments, also referred to as “bad actors,” without much detail on how a business will earn that tag • remove the Beverage Licensing Authority’s power to revoke or suspend liquor licenses and give that authority to the municipal judge or a contracted attorney • create new land-use definitions that differentiate between “low-impact” restaurants and establishments that serve primarily alcohol, especially hard liquor, after 11 p.m. as “high-impact,” holding them more accountable for their effects • consider the creation of “late-night business licenses” and collect fees from bars that operate after 11 p.m., providing an “additional tool to resolve bad actors’ community impacts,” according to city council materials.

The moves sound a bit like some of the tactics Carr was credited with using in increasing regulation of nightlife in Seattle.

As Boulder Weekly reported in June 2010 in a piece by Seattle journalist Dominic Holden, a longtime critic of Carr, the former Seattle city attorney was at the center of what some say were heavy-handed approaches to crack down on bars.

City attorney says crackdown on bars not a reprise of his controversial past

by Jefferson Dodge For example, Holden wrote, in a 2007 sting operation called “Operation Sobering Thought,” Carr and the Seattle Police Department claimed that two dozen people either illegally served minors or let undercover operatives who didn’t have valid ID into bars. But some called the campaign overzealous and sloppy. In one instance, police jailed a bar employee for 11 hours, allegedly for serving a drink to a drunk man, even though the Seattle Times wrote that the police report says the bartender only “poured him a glass of water.” Carr charged the bartenders and doormen with gross misdemeanors, punishable by a year in jail, but none of the cases resulted in a conviction. Public criticism swelled, and some speculated that the sting was politically timed one week before the Seattle City Council was set to vote on strict new rules for nightclubs. Carr offered plea agreements for lesser charges to 17 of the defendants, most of whom had no criminal history.

In 2009, Holden reported, an assistant attorney at Carr’s office warned bar

owners — who had overwhelmingly come out to support Carr’s opponent, whom he eventually lost to — that police would approach apparently intoxicated pedestrians, ask them where they’ve been drinking, and try to shut down bars they named. Carr claimed problems of over-service at bars in one neighborhood were linked to rising assaults and robberies, but police records showed that those crimes in the neighborhood were actually down.

According to Holden, Carr also implemented “good neighbor agreements,” which were contracts that a restaurant or bar owner would have to sign before they could obtain a liquor permit. According to nightlife advocates, one such agreement he drafted for a bar called Twist contained 54 specific regulations, including that no doors or windows could ever be open, no dancing was allowed, and that staff had to wear “finely tailored black suits.” And the Blue Moon bar had to sign an agreement that required the owner to pay for any security employed by a neighbor-

hood association, and that bar security had to carry “a high-beam flashlight.”

The Blue Moon’s owner refused to sign the agreement.

“If they want to kill nightlife in Boulder — make bars go away, make music venues go away — Tom Carr is your guy,” David Meinert, an owner of Seattle restaurants and bars and a leader of the Seattle Nightlife and Music Association, told Holden.

In Seattle, Carr “was going in and telling restaurants that they were not restaurants and they were improperly zoned,” added David Osgood, an attorney who defended several cases against Carr.

But at least one Boulder city council member said Carr’s approach to nightlife was part of the reason for hiring him.

Then-Deputy Mayor Ken Wilson, a resident of the often-rowdy University Hill area, said at the time of Carr’s hiring that he was particularly impressed

by Carr’s ideas to regulate bars in a section of the city that over the years has been plagued with over-service, underage drinking, binge drinking and even riots.

“We have a lot of bars near the university and a lot of rental properties that become party houses,” Wilson said.

“It has been a long struggle.”

City Council asked the three city attorney finalists about their strategies for addressing the problem.

“I felt that Tom Carr had a good, progressive attitude about holding the bars accountable for being good establishments, not over-serving and holding them to the law,” Wilson said at the time. He said Carr talked about his “good neighbor agreements,” adding that “we have tried to use those also, so I think he can help us with that.”

When asked whether the council was concerned about Carr’s history with nightlife in Seattle, Wilson replied, “I looked briefly at some of the reporting on that, and it sounded like he had a pretty strong stance, and some bar owners didn’t like that and organized against him. We saw his career as a whole and saw it as being positive.”

Wilson said the city may have influence over bars by changing land-use rules.

“We are looking at closing times and zoning rules and where you can put bars,” he said at the time. **** Fast-forward to 2013, and the city seems to be finally moving forward with that agenda. City of Boulder officials, including Carr, went to city counBoulder Weekly

news cil on Feb. 19 to ask for permission to implement an action plan to enhance regulation of bars using similar methods. Council members gave them the green light, for the most part.

Carr told BW in an interview that while the perception that he is the main driver behind the proposed changes makes for a good story, it’s not accurate.

He says he is only one of many city officials involved in putting forward the recommendations, and they grew out of the findings of a community working group.

For example, he says, it was Boulder Police Chief Mark Beckner who came up with the “bad actor” concept, the idea that instead of spreading enforcement and regulation efforts equally across all restaurants and bars, the city should focus its resources on the problem establishments.

Carr says the idea of cracking down on “bad actors” is supported by “good actors,” because it levels the playing field. If a bar is serving alcohol to minors or over-serving, for instance, it may be lucrative, but it’s not fair to those establishments that are playing by the rules.

“To be a good operator, you have to

have strong morals,” he says. “If you’re the place where, if you have a fake ID, you’re known as the place that is not going to look too hard, you’re going to get a lot of business.”

He says the effort to strip the Beverage Licensing Authority (BLA) of its ability to revoke or suspend liquor licenses and hand that to a hearing officer is not an attempted power grab.

According to Carr, it’s not ideal to have a citizen board working such long hours (a hearing on K’s China lasted about six hours) and performing an adjudication role, ruling on evidence like a panel of judges. For one thing, he said, it is easier to mount a legal defense of a revocation or suspension if that decision was made by a trained hearing officer rather than a citizen board.

He says he would not be gaining any control over enforcement efforts if there were a switch to a hearing officer.

If it were the municipal judge acting in that capacity, that individual answers to the city council; if a contract attorney were used, that person would be hired by the city manager’s office, not his office.

As for his record in Seattle, he acknowledges that Operation Sobering

Thought was controversial because, unlike Boulder, Seattle had not been doing checks on whether bars were following the rules when it came to checking IDs and over-serving. The cops arrested a bunch of bartenders and bouncers, and it made such a splash that to this day, Seattle bouncers are still telling customers they could get arrested for not thoroughly checking IDs. “I got a lot of criticism for that,” he says, adding that he was tough when it came to prosecuting driving under the influence cases as well.

While Carr acknowledges that having an alcoholic father who died in an alcohol-related accident falling down a flight of stairs when he was only 14 years old affected him, he does not have a personal agenda against the consumption of alcohol.

“I’m Irish Catholic; I’m not morally opposed to alcohol,” he says. “My dad was an alcoholic. I saw what it does to folks. But I spent a lot of my life in bars.”

Carr says his primary concern is the negative impacts associated with the excessive use of alcohol, and when there are an excessive number of bars in an area, it can create competition that drives establishments to offer drink

specials that can lead to overconsumption.

At the Feb. 19 meeting, several representatives from restaurants and bars questioned city council about the motivation behind the proposed crackdown, and at one point, council member K.C. Becker even acknowledged that the city shouldn’t be a “nanny.”

Stephen Schein of Half Fast Subs on the Hill said the council, if it was truly elected to represent its constituents, should follow the guidance provided by a citizen survey in which 75 percent of respondents said overconsumption is not a problem, and 86 percent did not support new zoning regulations for businesses that sell alcohol or operate after 11 p.m.

Calling the action plan “heavyhanded and unnecessary regulations” that is being driven by a small group of people, he asked why the council would want to “smash a problem that may not be as big a problem as presumed.

“Who are these bad actors?” Schein asked. “It doesn’t make sense to me. I feel like a target.”

Throughout October and November, the city asked Boulder resident Mark Gelband for $2,975 for records he requested. Then, in January 2013, BW was asked for $700, then $350, then $140 for records. The last was for records related to the Camera’s CORA requests.

But while some were facing new, high charges in the second half of 2012, Camera reporter Erica Meltzer wasn’t.

She submitted four CORA or CORAstyle requests in 2012. One returned no documents, one was filled for free and two appear incomplete in records provided to BW. An August request from Meltzer was met with no charge and a note that the city’s central records office had no documents related to her request. Since

Meltzer had requested “emails or other written correspondence,” her request was forwarded to the city’s IT department, which handles records requests for emails. But that’s where the trail ends — in the documents provided, there are no emails between Meltzer and the IT department.

In two other cases, Meltzer apparently received records without paying, according to the documents provided to BW. A

records request submitted by Boulder Weekly has found that in 2012, reporters for the Boulder Daily Camera were given records for free most of the time, were directed to the appropriate custodian of records and were not charged as much as BW or individual citizens have been charged lately for records requests.

City of Boulder employees continue to defend the city’s $35-an-hour charge to perform Colorado Open Records Act (CORA) searches, saying it represents costs from various departments and it’s only a fraction of the city’s actual costs.

And city spokespeople defended Boulder’s practice of requiring requesters to pay the estimated costs of research before the research takes place, without later providing the time the research actually took and how much the requester actually should have paid.

But there may not be a conspiracy to Boulder Weekly

bilk BW — or use charges to block the newspaper from accessing records.

Instead, it appears there was a move in the summer of 2012 to charge a lot more than the city ever had for open records.

During its 10-part series on contamination at Valmont Butte, written in the first half of 2012, BW was not charged for access to most city records. In some cases, BW reporters were allowed access to a city-owned computer with records on it and were only charged printing costs. During the same period, a Camera reporter was charged $105 for requested records. BW has not been asked for less than $140 in the past six months.

But in August, only a few months after BW was given City Attorney Tom Carr’s phone records and financial disclosure forms for city council members for free, the city’s practices changed — and with a bang. out charge.

Lastly, in October, city spokesperson Jennifer Bray responded to a Meltzer CORA request with the requested documents at no charge.

The last remaining request filed by the Camera in 2012 was a joke on the occasion of a city employee’s retirement.

Nobody responded to it, apparently.

Meltzer declined to comment.

Media attorney Steve Zansberg of Levine Sullivan Koch & Schulz told BW that government agencies can’t discourage negative coverage by using discrimination, retribution or retaliation.

“They have to charge all members of the media the same,” he says. “The motivation is irrelevant.”

City spokesperson Sarah Huntley said in an interview that the requests were filled without payment because Camera reporters’ requests are usually narrower than BW requests. **** For the CORA request asking for the Camera’s open records history, the city’s IT department estimated four hours of work, costing $140.

After receiving the results of that request — six requests and 12 total emails — BW asked for a log of the department’s time. The city’s policy on open records requires that logs be kept.

While Director of Communications Patrick von Keyserling told BW that one was kept, he did not provide it.

As with the city’s other CORA responses, no evidence was given that the estimated time, four hours, was accurate — or that $140 was the true cost. **** When asked about the city’s approach to open records requests, Carr said in an interview that the boilerplate letter the city uses to justify the cost of providing documents and set an extended timeline for producing them is not automatically sent out in response to all requests, only large ones.

Carr said his office declined a BW request for that letter because it might set a precedent that would make other materials public, like the notes used to develop it.

When asked about claims by Seattle media and attorneys that he broadened

the types of materials that could be kept secret under the guise of attorney-client privilege while he served as city attorney for Seattle, Carr told BW that a Seattle newspaper initiated legal action to assert that the state’s open records law trumped attorney-client privilege, and he was simply defending that privilege. He insisted that his intent was not to broaden it, just to protect it from being compromised by the open records law, and the state’s Supreme Court ruled in his favor.

He acknowledged that the city’s approach has changed in recent months, but only because the city attorney’s office has directed departments to follow the city’s policy on access to public records, which was created in 2001 and updated in 2006. He says his office has tried to educate city employees to be methodical and comprehensive about providing the requested records.

“I believe we’re doing it better now,” Carr says, adding that sometimes it used to take a couple of weeks for city staff to respond to records requests.

When asked how $35 an hour could possibly be viewed as a “nominal” amount of the city’s actual search and retrieval costs, as required by state law, he pointed out that the city attorney’s office normally bills $125 an hour in its budget calculations, and the planning department’s hourly rate is higher than $35 as well. Carr says that unlike other communities, which charge on a sliding scale depending on who is handling the records request, Boulder just charges a flat rate.

He also said that while the city’s central records department currently reports to him, open records requests are not automatically routed through his office, they are handled by the department where the records are kept.

Carr also asserted that CORA doesn’t necessarily require government agencies to produce documents within a three-day period or seven-day extension.

CORA states, “The date and hour set for the inspection of records not readily available at the time of the request shall be within a reasonable time after the request. … A ‘reasonable time’ shall be presumed to be three working days or less. Such period may be extendBoulder Weekly

However, such period of extension shall not exceed seven working days.”

But Carr told BW that the law is not clear. He said that “it’s about what is possible” when accommodating very large requests.

Carr denied that officials’ approach to BW shifted after the newspaper printed critical coverage of city government, from Valmont Butte to appearances of impropriety among city council members. He said there is no double standard in how the city has responded to requests filed by BW and the Camera.

“That would not be our goal or policy,” he says. “We would treat you as we’ve always treated you. … We don’t look at who the requester is.”

He says that while a stiff fee for a records search may encourage a requester to narrow the scope of his or her request, there is no concerted effort to use exorbitant fees to discourage people from asking to see the public’s documents.

“That’s not my intent at all, it’s to have a system that works,” Carr says. **** In 2003’s Black v. Southwestern Water Conservancy District, the Colorado Court of Appeals ruled that any CORA fee must be “nominal,” legally defined as “trifling, esp[ecially] as compared to what would be expected.” Under that definition, the city’s actual costs — which do not include things like producing paper copies — should be higher than $35 an hour, so much higher that the totals accumulated by requesting $35 an hour are trifling in comparison.

The annual salary of the average employee working on CORA requests should be much higher than $72,800, which is $35 an hour. Requesters could be paying 50 percent of their salary ($145,600), or 40 percent ($182,000), or 25 percent ($291,000). The highest-paid city employee, Executive Director of Energy Strategy Heather Bailey, makes $250,000 annually, so the city’s definition of “trifling” is higher than 25 percent.

Huntley says $35 an hour is within the law’s stipulations. She points out that the city attorney’s office reviews CORA results when they include staff emails, to make sure nothing is released that should not be public record. She says that in the case of Meltzer’s free results, like the November one, she forwarded emails from city council members’ accounts.

“The city’s position is that we are in compliance with the law, and the fee that we charge meets the definitions described by the court,” she says.

**** Since Carr’s arrival in 2010, Boulder has seen some visible changes from the city attorney’s office. Former City Attorney Jerry Gordon, who retired before Carr was hired, says CORA procedures have also changed under Carr.

Gordon hesitated to make definitive statements, saying he couldn’t remember many particulars from his two-year stint

as city attorney.

“Most requests were simply, the information was provided,” he says.

“Lawyers were never involved. …

“I don’t remember what the charges were then,” he says. “I don’t think I ever had anything to do with what the charges were. If I did, it was so tangential.”

Gordon says that during his tenure, the office of the city attorney wasn’t

involved with CORA requests. “[Most records requests] never went to attorneys at all. There was no reason to keep it secret and it was public,” he says. “Sometimes I think the departments remembered to charge and I don’t remember what they charged. They never asked me what to charge, as far as I can remember.”

boulderganic Can third time be the charm in the uphill battle for GMO labeling?

U

.S. Rep. Jared Polis, D-Boulder, knows his numbers. He knows that more than 90 percent of Americans believe that all foods that contain or are made with genetically modified organisms (GMOs) should be required to have labels that state as much. Unfortunately, he also knows that it’s going to be tough to get the number of votes needed in the House of Representatives to pass a new GMO labeling bill he intends to co-sponsor along with Rep. Peter DeFazio (D-Ore.). But that isn’t stopping him from trying.

This isn’t the first attempt to get a GMO labeling bill through Congress. In late 2011, Polis joined then-Rep. Dennis Kucinich (D-Ohio) and others in an effort to attach a GMO labeling amendment to the Farm Bill.

That effort failed when the entire Farm Bill vote was blocked and the previous Farm Bill was simply extended. Then came the June 2012 effort by Sen. Bernie Sanders (I-Vt.) that many felt had a good chance to pass. Sanders used an amendment to last year’s Farm Bill in an attempt to make GMO labeling an issue to be decided by each state. Several states at that point had indicated their desire to initiate labeling requirements for GMOs, only to back down under

the threat of lawsuits by big biotech companies such as Monsanto.

Sanders believed that Republicans would support the amendment because it was a “states’ rights” issue and he felt sure that Democrats would join him because GMO labeling would create better consumer information and thereby, finally, consumer choice. But unlike Polis, Sanders didn’t know his numbers.

It appears he underestimated the power of the millions upon millions of dollars that the biotech and other big ag corporations had dropped into the campaign coffers of his peers in Congress over the years. In the end, the vast majority of both Democrats and Republicans voted against Sanders’ amendment despite the massive support for the measure among their own constituents.

Polis wants to take a different approach. The DeFazio GMO bill he intends to co-sponsor, once the exact wording can be finalized, is national in scope. It would require the labeling of all products containing GMOs throughout the United States. At least that’s the intention at this point in the process.

According to Polis, one of the problems with having GMO labeling in individual states is that it creates a substantial expense to the food companies because they have to create one package

with GMO labels for one state while creating separate packaging to be used elsewhere, and that expense would most likely be passed on to consumers in the form of higher food prices, which nobody wants.

“If we require labeling nationally it won’t create additional cost,” says Polis.

He also notes that his bill would open up more than 40 foreign markets for trade with countries that currently require GMO labeling.

Even though the proposed GMO labeling bill makes economic sense and has the support of nine out of 10 people in the U.S., Polis knows that getting it out of the House’s Agriculture Committee, should the bill go that route, isn’t likely.

“We understand that this bill doesn’t have much chance of getting through the committee to a full vote,” he says.

And that is hardly a surprise, considering that the ag committee reads like a who’s who of Monsanto and friends campaign finance efforts. Rep. Frank Lucas (R-Okla.), who chairs the committee, recently helped push through the controversial FDA decision to allow the unrestricted commercial cultivation of GMO alfalfa without restrictions that would have prevented the genetically engineered crop from contaminating nearby non-GMO alfalfa. Lucas has been the recipient of more than $1.2 million in campaign donations from big ag interests, including Monsanto and the pro-GMO Farm Bureau. In other words, Lucas and his other biotech-supported politicos on

the committee will do everything in their power to make sure that any GMO labeling bill never sees the light of day.

Even so, Polis is undaunted.

“We want to get a bill to a full vote of the House,” he says, “so we will most likely need to attach it as an amendment to a relevant bill dealing with ag.”

Even though it is an uphill fight, Polis understands the value of that fight.

He explains that the bill he intends to co-sponsor is about creating public awareness.

“The more public awareness, the more people will write and call their representatives and tell them to vote for GMO labeling,” says Polis. “If we can get this to a vote on the floor, then people can finally see how their representative actually voted on this issue.”

Yes, Polis knows his numbers. He understands that with overwhelming support among the public, if he can get a GMO labeling bill to a full vote of the House, it becomes very difficult for politicians to publicly go on record voting for their campaign donors’ interests instead of those of the men and women who elected them, and who have the power to send them back home in the next election cycle.

Whatever winds up happening with Polis’ GMO labeling bill, it will have been another important step in the fight for a consumer’s right to know and choose what they put into their bodies — and their children’s bodies.

NUCLEAR SENSORS COULD BE USED TO PREDICT TSUNAMIS AND TRACK GREENHOUSE GASES

A network of sensors used to track nuclear weapons since the Cold War could be used for environmental monitoring instead, according to a study published in Science last week.

The international monitoring system uses more than 254 seismic and waterbased sensors to track sound waves, which ripple through the ground after a nuclear explosion. These sensors could have been used, the authors say, to predict the 2004 tsunami in the Indian Ocean that claimed 230,000 lives.

Their study focuses on the sensors’ potential use by the scientific community, but the sensors could also provide a way to avoid governmental control of data, says Christopher Stubbs, an experimental physicist at Harvard University. He envisions citizen scientists, equipped with sensors, contributing to a map of global greenhouse emissions — including in countries unfriendly to emissions tracking.

A common psychiatric medication may affect fish behavior, according to a new study published in Science. Researchers in Sweden exposed wild perch to varying concentrations of Oxazepam, a drug prescribed for anxiety. Like the estrogen from birth control that scientists found “feminizing” fish in Boulder Creek, Oxazepam travels from bathrooms to waterways, escaping wastewater treatment.

Researchers reported that fish exposed to Oxazepam became less social and more aggressive eaters. After exposure, “they were totally different fish,” lead author Tomas Brodin told The New York Times.

The repercussions, he says, are unclear. Perch populations could benefit from more aggressive eating habits, or they could be eaten more often, if their chemically induced boldness makes

Right-wing billionaires have funneled $120 million through secretive donation channels to fund climate-change skepticism, The Guardian reported last week.

The donations helped create a network of more than 100 think tanks and activist groups intended to re-brand climate change as a partisan issue, rather than a scientific fact.

omewhere over the more than two years of interviews that went into making 5 Races 5, Continents, which tracks toward the emotional core of trail running, the conversation among the filmmakers and one of their central subjects, Killian Jornet, turned to the growing popularity of the sport.

think the American trail running community is just so cool and so down to earth, and the guys who run it are just such cool guys,” Leslie says.

Grant was interviewed both at the Hard Rock 100 and the Ultra-Trail du Mont-Blanc (UTMB), which circumnavigates Mont Blanc, traveling through three countries to do so.

“The first time I ran 100 miles was UTMB,” he says. “I was really taken by the course — you’re running around Mont Blanc, it’s just a very iconic mountain, so I went into it, I think, a little bit naïve, in terms of I wasn’t worried at all about the distance and it was more just like, ‘Oh we’re running around this incredible mountain.’ … I got to mile 70 and didn’t really know what was happening to me. I couldn’t really put down any food any more, and I just ran through the whole night, and

so it was a bit odd from a physical standpoint because I wasn’t really quite sure sort of where my limits were. Am I doing real damage to myself or am I going to collapse here and be taken out on a stretcher or something? Or am I just being kind of soft here and I should just march it in? And that is the battle that you have when it’s a new distance and you’re not quite sure, twothirds of the way in, whether you’re going to be able to do this or not.”

The full race distance gets broken down into smaller goals of subsequent aid stations, exiting the borders of Switzerland or Italy, or simply completing the task at hand — missing the rocks on the trail while continuing to put one foot in front of another.

“It’s just a long walk, really, you’re sort of jogging along and hiking the uphills and then running the downs,

and so when you kind of break it down it’s very simple,” Grant says. “You just — you eat, you drink, you run, and so I like to think that I can do that, you know?”

5 Races, 5 Continents is just a taste of a much larger body of work that’s appeared in Salomon Running’s episodes and was informed by the work Fell and Leslie did on Wandering Fever, which focuses on their lifelong friend Ryan Sandes and his rocketspeed leap into the forefront of the ultrarunning scene.

Their footage on Sandes got the attention of Salomon Running, one of his sponsors.

“It was good timing — they were actually looking for a film crew at the time,” Leslie says. “They emailed asking us to join in the 5 Races, 5 Continents project. It was quite last minute and fairly loose, but the initial mail was kind of, ‘We’re shooting on five continents following Killian Jornet around the world, and would you like to shoot it?’ And our response was, obviously, ‘Of course.’”

Two weeks later, they were in Australia, having met no one, including Jornet. They’ve released episodes on Salomon Running TV that focus on each race individually. And while Australia stands out for the challenge of sleep deprivation — Leslie says they

were on the road for nine days and got a full night’s sleep perhaps four of them — the Leadville 100, which was filmed for Wandering Fever instead of 5 Races, stood out for its own reasons. It’s the ending of Wandering Fever, which added some emotion, and the course itself posed challenges in terms of altitude and a late-night arrival followed by an early morning race start.

“It’s maybe not the most beautiful out of all the races, but there’s something there, I think it’s a mixture of the history and the people, and that’s always going to trump anything,” Leslie says. “There’s not a lot of people at the finish line, but it’s probably, it’s almost like the UTMB is so big that you lost that connection that you would have because it’s such a spectacle. At Leadville, you have a lump in your throat when you’re standing at the finish line. That’s one of the things I love about the sport is you can get all these different experiences.”

“If I was to never race again, I wouldn’t say it wouldn’t bother me, I enjoy racing, but truly just being out in the mountains is kind of what drives me,” Grant says. “But there’s this community coming together aspect that I think is really powerful, particularly since it’s quite a small community, so you tend to know a lot of people and feel pretty at home.”

Grant started as a climber and hiker, and transitioned to running as a way to simplify his experience in the mountains, reducing the amount of gear.

“I wouldn’t say that initially running was secondary, but it was more just kind of, OK, this is a way to engage with this see RUNNING Page 20

environment in a primary sort of way and stripped-down way,” he says.

“There’s not a lot of things between you and that experience. It’s very, very primal in some ways ... I think the racing aspect is interesting because of the community appeal. I’m not a particularly competitive person, but I do like the framework of the race that enables you to push yourself, and it enables you to kind of share this experience with other people, and it’s a very different sort of thing when you’ve got a catered race where every five, six miles you’ve got an aid station and there’s support, so you can really just kind of run and experience that.

Whereas when you’re by yourself in the mountains you’re dealing with a lot of other factors, and it’s not that you’re not pushing yourself hard, it’s just a different type of effort because you have to get yourself up the hill and there’s no real contingency plan other than, well, either I can do this or I can’t.”

And while the sport may be blossoming into increasing popularity and notoriety, the boundaries it draws — and the requirement, particularly in trail running, to go it alone and be comfortable alone ­— will thin the starting line crowds.

“Even when you’re competing with hundreds of other people, it’s much more individual, and so I think it caters to people who primarily want to kind of have that experience and people that are comfortable being out on their own,” Roes says. “I just think that it’s kind of the spiritual thread that weaves through going out in the mountains by yourself for a long period of time. I think that’s just a huge, inherent part of the sport, and people who don’t have that that get into ultrarunning, they don’t tend to, I think, stay as passionate about it. If you don’t have this larger thing pulling you into it, it’s pretty easy to get emotionally and/or physically just completely burnt out on it. It’s a really

grueling thing to do, so there has to be something larger driving you.”

Making space for art

I

Group of NoBo artists want an art district where National Guard Armory now stands

n the past few years, a group of North Boulder artists, coalescing as the NoBo Art District, has been diligently showing its work, holding monthly First Friday exhibitions at various locations north of Pearl Street.

Talk among the group has revolved around establishing a strong geographical identity — including an actual, physical art center that would showcase work while also housing affordable studio space and housing for member artists. Official plans for such a gathering place have yet to be agreed upon.

A handful of individual artists aren’t waiting for that day to cheerfully announce itself. Not with a prime North Boulder site up for re-development for the first time in 65 years — one that has already been associated with a couple of recent brushes with controversy.

The National Guard Armory is “the last big parcel left up here” and “a keystone property,” says Aaron Brockett, a member of the Boulder Planning Board and also a resident of the Holiday neighborhood, which sits just to the east and south of the 8.5acre compound at the southeast corner of Broadway and Lee Hill Road.

by Jim Lillie Broadway commercial corridor ends up getting developed,” Brockett says. “Integrating it with the NoBo Art District would be fantastic. How those old buildings might get integrated into a new plan might be tough.”

Whether the concrete block structures stay or go is one of many concerns about what might occupy a new Armory site. Others involve the amount and type of commercial versus residential square footage; the existence of an anchor retailer to attract small businesses; and an overall design and layout that serves as an inviting gateway to the north end of the city, which currently welcomes visitors with industrial-strength locations such as a strip club, a homeless shelter and various warehouse spaces.

Then there are the controversies, beginning with a plan, unsuccessfully pitched to neighbors a few years ago by local developer Jim Loftus, to build a big box-style supermarket on the site, a continuation of an earlier lost cause when Loftus proposed a similar store a few blocks down Broadway at the current Uptown business/residential center. On top of that, just last year, some in the neighborhood waged a campaign opposing Boulder Housing Partners’ plans

to construct 31 apartments for the chronically homeless at a site located diagonally across the street from the Armory. That project got the green light, but not without a bitter fight that left many vowing to yell even louder about further development, including what happens with the Armory.

For now, things are on hold until the city finishes reviewing the North Boulder sub-community plan, which is expected to take until late spring or early summer. Once that’s finished, though, will Boulder be on course for the mother of all development battles? Or will the Armory project prove a unique chance for residents and developers to come together on a plan that works for everybody? Is that even possible?

While the players involved will get an opportunity to air their views, one major key to some battleground questions rests with how the Armory’s codevelopers, Bruce Dierking and Loftus, choose to interact with individuals from the NoBo Art District — a point both sides acknowledge.

“I know what the neighborhood thought five years ago,” says Dierking, a Boulder attorney. “But I don’t know what the neighborhood thinks now. Do people still want a neighborhood center for North Boulder, and what will that mean? We want to do Boulder Weekly

something that’s worthy of today. … There are things that pay the freight and things that cost money, and we need to balance that out.”

At least three Boulder artists see reciprocal value in working with Dierking and Loftus to form a consensus approach to developing the Armory. Buffy Andrews, Sally Eckert and Amy Tremper, all NoBo Art District members as well as Holiday residents, say that their artistic/architectural backgrounds, connections and skills can enhance any planned development while helping Dierking and Loftus save — and make — more money.

Tremper points out that a Minneapolis-based outfit called Artspace specializes in turning old buildings, including a granary in Loveland, into art centers that include studios and living spaces. Artspace representatives plan to visit the Boulder/Loveland area next month and offer some preliminary ideas, for free, as to how that might work with the Armory — including possible access to grant money that could shave down construction costs. Any new buildings, Tremper says, could be built around the existing ones.

“Or, the developers could build other things and someone else could build the art center,” Tremper says.

Plus, says Andrews, any plans to develop the Armory shouldn’t stop at the current boundaries of the property.

“We need to include [the planned homeless apartments at] 1175 Lee Hill in the rest of the community,” she says.

To that end, Andrews has suggested design changes to the developers of that property that include opening up the Boulder Weekly

complex’s entrance, as opposed to plans to close it off, to the intersection of Lee Hill and Broadway.

“We don’t want to work against the developers,” she says.

“We’re offering our creative services to help develop this community.”

Eckert’s message to Loftus and Dierking includes a plea to think long-term.

“It’s a pivotal piece of development for the next 10, 20 years,” Eckert says. “There’s a way, architecturally, to make this happen without gearing up for a fight. Let’s be creative.

Let’s talk about how these men can make a lot of money by doing something creative. Our vision is that if you create artist housing, you can have high-end lofts next to an artist’s home, which keeps a good mix in the neighborhood while also keeping artists in their homes. If we start working together now, we can save them money.”

Dierking, for his part, allows that, “Occasionally neighbors come up with better ideas than developers.” Also, whatever anyone might think of past controversies, he and Loftus “are willing to listen to everybody.”

And, says Brockett, they will. “Boulder focuses on the public input and process. If you bring in something people will hate, it’s harder to get approved. There has to be some kind of give-and-take process that works for developers and the neighborhood. Spending time to work upfront with neighbors is more efficient for them.”

Not to mention more profitable all the way around.

othing happens quickly in Jerry Greene’s world, at least when it comes to developing and staging his erstwhile music project Cowgirl Radio.

neatly as subtexts to their videos, usually hand-held camcorder vignettes of street scenes (Boulderites will recognize some locations), diffident and abstract. And they are in fact, in some ways, practice for the kind of trade that Greene envisions for Cowgirl Radio.

“One of things I’m trying to do is get songs into film and TV,” Greene explains, “and I’ve actually signed a couple of deals with some agents in New York and Los Angeles, and one that works with MTV. A lot of TV shows and commercials have this kind of ethereal background music, so I’m kind of writing for that market. I’ve got a couple of agents who really like my stuff and are shopping it around.”

For now, though, taking the project on the road doesn’t appear to be an active option for Greene.

“Eh, probably not,” Greene says.

“We’re all pretty well tied down in Boulder. I have a full-time job at CU and I’m raising a 10-year-old son. … I mean, if all of a sudden some record company wants to put me on tour for six months,” he trails off.

What about his son?

“Take him with me. Like Jackson Browne, take him on the tour bus with me,” Greene says.

Which could be a dicey proposition, since his son, indirectly, is the reason Greene appears with a cast on his right hand in some press shots from last year.

“It was a serious thumb sprain that I got playing after-school football with my son and a bunch of his friends,” Greene says. “I stepped in a hole on the field. It’s weird because I spent a lot of time doing extreme sports — rock climbing, kayaking, wind surfing — and the worst injury I ever got was playing football with my son.”

A

ssembling a work of art is like putting together a puzzle: Sometimes it’s a struggle to make the pieces fit, and sometimes they just fall into place.

The latter surely happened with A Woman’s Life, a cycle of songs for soprano and orchestra by Richard Danielpour, based on seven poems by Maya Angelou.

Recounting the stages of life from childhood to old age, A Woman’s Life will be presented by the Boulder Philharmonic Saturday in a program with Brahms’ German Requiem (7:30 p.m., Macky Auditorium). Joining the philharmonic and Director Michael Butterman will be soprano Angela Brown, baritone Patrick Mason and the Boulder Chorale.

Danielpour wrote A Woman’s Life for Brown after she sang in the 2005 premiere of his opera Margaret Garner.

Afterwards, she asked him if he would write some songs for her. Jokingly, she decided to “go for broke,” she says, and suggested Angelou for the texts.

“He looked at me very seriously,” Brown recalls. “He said, ‘You know, she’s been like a second mother to me.

I’ve known Dr. Angelou for a very long time.”

Not long after, Danielpour visited Angelou. He remembers, “I told her I wanted her to write a series of poems based on the cycle of a woman’s life, and she said, ‘I’ve already done that.

They’re all hidden in my collected [poems]. I’ll read them for you.’”

And then creative lightning struck.

Danielpour describes the moment: “At her dining room table in her Harlem townhouse she read eight poems, sometimes with her eyes closed, sometimes reading the book, sometimes holding our hands as if we were in a church service, and it was one of the greatest per-

“The only way I could relate to these pieces was to act them out,” she says. “I’ve been able to refine it so you know when I’m a little girl, you know when I’m that precocious girl that’s not scared of anything, you know when I’m that woman that thinks she’s being beguiling. This piece is one I’ve grown into.”

A curious misfire by Curious

Curious’ latest, then, is an outlier. A statistical anomaly. It’s the exception that proves the rule and, even so, it’s not chewoff-your-foot-to-escape-it bad, it’s just not very good. Primary blame must be placed on playwright Jordan Harrison, for his Maple and Vine takes an intriguing premise and then misses every single opportunity to wring something meaningful or memorable from it.

We first meet yuppie couple Katha and Ryu (Karen Slack and Dale Li, respectively) in bed in front of a beautiful treeshaped, built-in bookshelf that was, in a way, the highlight of Maple and Vine for me. A play examining the psychology of such a person, or mining what would seem to be easy-pickings humor from this particularly flamboyant strain of obsession, would likely be a joy.

Sadly, Harrison’s Maple and Vine not only fails to explore these ideas at all, it stumbles over its own feet with even the most basic plot and character choices. As noted above, there is the second act revelation that is anything but revelatory. The flat, unbelievable characters (with the exception of Robinson’s Dean, who is spot-on throughout), lazy plotting and lack of insightfulness are exacerbated by a structure that seems somehow to have more scene changes than scenes. The actors have no chance to establish rhythms because the stage hands are front and center every two minutes moving floating walls and furniture about to no particular end.

Of all the plays I’ve seen, many of the best were presented by the Curious Theatre Company. Though Maple and Vine is a moxie-free miss, I’ve no doubt that Curious will be knocking socks off again next time around.

ock stars don’t always have the prettiest personal lives.

John Lennon (pre-Yoko) intimidated and threatened the women in his life. Sid Vicious may or may not have killed Nancy Spungen. Buddy Rich allegedly verbally abused every member of his band, making scores of enemies in the process.

Which brings us to Beware of Mr. Baker and its protagonist, Ginger Baker, the fire-haired drummer for Cream and Blind Faith. A virtuoso on the kit, Baker was an absolute mess of a man, running through and neglecting multiple wives and children as he compulsively tore through life. Now arthritic and in old age, the documentary starts out with an enraged Baker inflicting a bloody nose on director Jay Bulger. The fire is still alive.

The documentary tells Baker’s life story through interviews with the drummer himself and with a slew of people he played with — Eric Clapton, Jack Bruce, Steve Winwood, Carlos Santana, Johnny Rotten and more. Bulger fills in hand-drawn animations. Everyone is basically in agreement: wonderful drummer, slightly insane man.

Baker grew up in post-World War II Britain without a father, and his earliest memories of music involved acting as a decoy while his buddies nicked

always identify himself as a jazz drummer who played rock rather than the other way around. The documentary respects this and shows not just his time as a rock drummer, but the time he spent seeking the approval of jazz drummers, who he considered to be at the top of the craft. The way the documentary treats the famous rock music Baker made is also refreshing. It focuses on the music through the drum-bass battery, instead of through the usual guitar-singer lens. Clapton, for example, is treated as a sideman to the Jack Bruce-Ginger Baker show while part of Cream.

Baker’s personality is the most engaging part of the documentary. He’s a wreck, constantly insulting the interviewers while dodging uncomfortable questions about his life. At one point, Bulger asks him, “Do you consider yourself to be a tragic hero?” Baker fires back, “Go on with the interview and quit trying to be an intellectual dick head.”

He’s volatile, talented and ornery. Therefore, he’s perfect for a documentary.

Upon hearing Roach, Baker recognized a kindred spirit. He knew then and there, he would become a drummer.

eel free to call director Steven Soderbergh’s latest film (and potentially last, if you believe his retirement threats) a wacky mallard because it is one odd duck. If a Hitchcock movie took a Dateline NBC segment behind the art house theater and got it pregnant, Side Effects is what would emerge from the birth canal.

Like Frankenstein’s monster or fans of Two Broke Girls, this film shouldn’t exist and definitely shouldn’t work.

And yet, it does. Boy howdy, does it ever.

Writer Scott Z. Burns’ script plays chess while other thrillers of this ilk are content to bumble their way through a drunken game of checkers. And Soderbergh sets the hook in the audience by using some tasty bait: Rooney Mara. The angsty, elfish waif crushes it as Emily Taylor, who we meet visiting

her husband (Channing Tatum) in jail, where he’s doing time for insider trading. Upon his release, Emily’s ongoing battle with depression goes from “it’ll get better, kiddo” to “hide all sharp objects.”

After playing chicken in her car with a brick wall (which, by the way, did not flinch), Emily finds herself randomly in the care of the on-duty psychiatrist at the hospital, Dr. Jonathon Banks ( Jude Law). For reasons that shan’t be spoiled or soiled here, Banks winds up having to contact Emily’s old therapist (Catherine ZetaJones). And that’s when things go from maudlin to “mwahahaha.”

Knowing that a luminary like Soderbergh is on the project will tempt you to scan the film for some kind of social commentary on our overmedicated, pharmaceutical complex-controlled society: Resist that urge for the red her-

ring it is. Any observations about the impropriety of drug advertising are purely Burns and Soderbergh having some cheeky fun. This is an old-school thriller, a whodunit where we know who did it. And damn does it crackle.

Just as Liam Neeson’s turn last year in The Grey, and that film itself, was forgotten by the time the designated period in which we reward performances and films rolled around, so too will Mara and Soderbergh find themselves on the outside looking in come next year’s back-patting ceremonies.

Which sucks. Mara absolutely obliterates a role that requires more 180-degree turns than the Winter X-Games. Meanwhile, Law punches

far above his usual weight class as a remarkably complex protagonist. Hell, even Channing Tatum doesn’t totally blow!

This is because Soderbergh is an elite director who has never, and may never, get the full credit he deserves. His ability to coax audiencefriendly films to the upper echelon of their genre is a gift we overlook too willingly. Like his exceptional last project, Haywire, Side Effects will be lost due to its place in cinematic limbo: it is too well-acted, methodically paced and smart to be popcorn fare and too full of slow-burn, mainstream thrills to be considered art.

Please don’t leave us with an “either/or” world in which movies are either entertaining or creative, Steven.

But in the last 10 years or so, Markel says she has noticed a shift in awareness around food that she believes is in part due to the slow food movement, which has a strong foothold in Boulder.

“If you look at, for example, the slow food movement, and body and mind awareness groups, you’ll see that people are starting to value what they have and what is around, “ she says.

While her culinary adventure trips provide a chance to see the world, Markel says she believes you don’t have to leave your neighborhood to connect to a rich history.

“Here in the Southwest, when the Indians were prevalent, they had handfuls of various squashes, beans, wheat, rye and buffalo,” she says. “There was a real gestalt about how they grew, the wisdom of how to kill an animal, how to use every bit of it, that was in har-

rguably, some of the county’s best Asian dining can be found near the intersection of South Public Road and South Boulder Road in Lafayette. Further evidence for this Pho Cafe increasingly solid 1085 South Public Road, proposition comes in Lafayette the form of the Pho 303-665-0666 Cafe, another affordable strip mall spot. Like many pho restaurants nowadays, this humble spot has diversified its portfolio beyond beef noodle soup. But for my purposes on this cold day, I intended to bypass enticing rice and noodle plates as well as Thai-inflected entrees for a lunch of this eatery’s namesake specialty.

Next up is the platter of garnishes, and the quality and quantity of this plate often foreshadows the quality of the soup itself. Happily, this was a decent pile of crisp bean sprouts, juicy lime wedges, fiery jalapeño slices and fragrant basil.

The main event, a $7.25 medium bowl of pho sac biet, arrived swiftly, freighted with a beefy smorgasbord of rare steak, well-done flank, tendon, meatball and tripe. The thin steak had a slightly pinkish cast, indicating that the meat had been properly slipped into the steaming broth moments before serving. I didn’t detect much tripe, but that’s not necessarily a bad thing, and the tendon darn near melted in the mouth.

For many, the true measure of a pho’s quality lies in the broth.

Although this version lacked the depth of what you’d find in a topnotch Bay Area Vietnamese joint, it still should satisfy most soup cravings.

The balance of seasonings was right, with hints of star anise, onion and not too much salt.

Additionally, this soup was less greasy than others. I felt the broth’s relative lightness was evidence of the chef ’s legitimate decision to make a healthier soup than indicative of someone in the kitchen who didn’t know how pho should taste. While it might not serve the exact soup found in an urban ethnic enclave, Pho Cafe’s namesake dish could be the county’s best at a properly affordable price.

mony with nature. They were living with the elements at all times, so there was an understanding. I think we are regaining some of that. Markets are now appreciated based on a particular berry they sell, or native foods. Towns like Boulder are starting to have an identity for food.”

She says she hopes to see a shift in lifestyle away from people eating canned soup in front of their computers and toward sharing stories at the dinner table. According to research done by CBS, approximately half of American families eat dinner together each night, but usually distractions like cell phones and televisions are present.

“Sitting around the table is the home perch for the family, it’s where you sit and have conversation,” says Markel. “If you are away for meal time, you lose touch. And bonding at dinnertime is important for children as well.

In many of the places I visit, you would never find someone eating in front of their computer. That would never take priority.”

She recalls a visit from the 15-yearold son of a chef friend from Italy.

During his visit, she planned a day to explore the mountains. They took off one afternoon in the car with packed lunches.

“He just stared at me with his sandwich in his lap and this big grin,” she says. “He told me he’d never eaten in a car in his entire life.”

With the advent of fast food and drive-throughs in America, many of us eat on the road as habit. Though her trips are in part about breaking routine and trying new customs, there is something much deeper at play that the traveling component encourages.

“A travel experience connected to food can be transformative because when we are outside of our normal environments, we are vulnerable and more open,” she says. “You examine yourself and cross your own personal boundaries because you have to have courage to do so. When you are willing to meet with cultures it opens your understanding to a different way of looking at things than you thought was possible. With food it is fundamental.

Even with your biggest enemy it can be a way of sharing. It crosses all political, religious and what-have-you notions of separatism and puts you in relationship to each other. We don’t get stuck in our dramas.”

It was coincidence that Markel’s second home after Boulder is Florence, where her father fed those children years ago. But her dad’s kindness did teach her an important lesson that she hopes people who take her trip can learn: Despite cultural differences, food is a shared constant among us that can strengthen bonds and transform people.

Brilliant nanobrewery deserves new digs

est Pearl Street is no place for a beer nerd.

On the heels of news that Ian Clark, head chef at Jax Fish House, is planning to open a brewpub under his quickly expanding BRU Beer brand, we visited Jax on West Pearl to try BRU in its current home.

And let’s just say we’re excited to see BRU’s restaurant get started. Clark, one of Boulder’s biggest beer nerds, needs a bigger, more beer-centric stage for a nanobrewery that should be ranked among the state’s best.

Joel Dyer A veteran homebrewer, Clark first brought BRU to the public as head chef at El Centro. When he was transferred to fellow Big Red F restaurant Jax, BRU came with him. It’s also distributed in bomber bottles in some liquor stores.

For our visit, Jax had just one BRU beer on tap, though it wasn’t on the chalkboard menu. So what we took at first to be a very, very flat version of BRU’s Obitus Brown Ale was in fact Clark’s pumpkin porter. And it was very, very flat for a reason, as he explains to us when he steps out of the kitchen to greet us.

“That’s a real ale,” Clark says, refer,ring to an unfiltered, unpasteurized, low-carbonation beer style. Ohhh. It all makes sense.

That’s only a glimpse of Clark’s deep understanding of the craft of beer.

He tells us how excited he is to start brewing a Scottish wee heavy; he describes in detail the kinds of flavors to expect from the pumpkin porter; he recites ABVs by memory.

He’s saving our trip, basically.

Especially when he tells us three other BRUs are stocked in the cooler in Jax’s basement — information the bartender didn’t have. So we get to try Obitus after all, as well as Citrum IPA and Beezel Belgian.

And we don’t blame the bartenders here. This isn’t Falling Rock or Backcountry Pizza. These guys are used to mixing drinks and recommending wines, and we get the sense beer nerds rarely make a pilgrimage here to try garage-made craft ales.

But they should, because BRU’s beer is flat-out awesome. The bright, apricotand honey-flavored Beezel, “champagnelike” in Jeff ’s words, is drained in minutes. Citrum wins over the IPA-shy in our group — “That is one of my favorite pale ales I’ve ever had,” Joel says — even as hophead David says it’s a little too malty.

Elizabeth calls it “mild-mannered” as far as IPAs go.

Naturally, I liked it a lot. Obitus, meanwhile, wins praise from all around.

“That’s how I want all brown ales to taste,” David says, which Elizabeth seconds.

We’re more than impressed. We’re marking our calendars for that planned mid-April opening of BRU Handbuilt Ales and Eats at 5290 Arapahoe Ave. because we always celebrate the blossoming of another beer nerd in Boulder.
