Dogs and shelters (Re: “Surviving shelters,” cover story, Nov. 10.) I want to thank Elizabeth Miller for writing this article. Finally someone is willing to be honest publicly about HSBV’s less-than-humane decisions about the animals that people take to them, thinking they will be safe.

I am a foster parent for Wyoming Australian Shepherd Rescue and Akbash Rescue. I know firsthand how much money comes out of my pocket and out of the pockets of people running the rescues.

I didn’t realize before this article that HSBV actually pretended to put dogs on the euthanasia list so that the rescues would work harder to find them foster homes. Wow, with a huge budget, one would think that Boulder’s humane society would want to help the rescue organizations rather than misuse them.

About seven years ago, I was being asked by HSBV’s volunteers if I would be willing to read their stories about what was going on at the shelter and expose the stories to the public. These volunteers only wanted to see HSBV become an advocate for the animals, which they didn’t think was happening. Too many of the stories involved animals being killed for a lack of space, which goes against one of their policies. I found other such discrepancies when comparing the policies and procedures with stories I was told.

For many years and still now, people in Boulder believe that HSBV is a no-kill shelter, or that they only kill sick or very aggressive animals. Not true!

I suggested they need to be responsible for what they write. “Today, only animals that are not deemed adoptable for temperament or health reasons are euthanized,” is a direct quote from their website. This is true, but remember that an “unadoptable” dog or cat could have a very treatable skin condition, like Sawyer.

He is not the first one with a treatable skin condition that HSBV didn’t want to keep alive. I took lists of them to a local vet, asking if the skin conditions listed were treatable. The response was usually “yes.” When I told him they would be killed because of these conditions at

rim-faced military officers and ashen-faced politicians describe a horrific “war zone,” with “hundreds of people murdered” and “citizens under attack around the clock.” Some of the politicos say that the situation is so dire that it “may require our military.”

Like the frenetic Bush-Cheney litany of lies that rushed America into the senseless Iraq war, what we’re now getting is a similar burst of mendacity about Mexican drug violence spilling across the border into our country. Rick Perry, the Texas gubernatorial goober, is even trying to make it a presidential campaign issue. “It is not safe on that border,” he recently wailed to New Hampshire Republicans, suggesting that he might send U.S. troops into Mexico “to kill these drug cartels.”

Adding to this macho melodrama, two retired Army generals produced a “study” asserting that

But, the most important is that you, the public, know what might happen to your animal when you take it to HSBV. Please remember the peril you might be putting your animal in if you take them there.

They appear to be about getting the animals out in a timely fashion rather than putting the animal first.

War on the Mexican border!

At a press conference, McCaffery pointed excitedly to “hundreds of people murdered on our side of the frontier.”

Boulder Humane releases 91 percent of the animals they take in, it’s documented and verifiable; the article even touches on that. They also take in every animal brought to them, and they regularly take transfers from other agencies throughout the country.

They’re an animal welfare organization, they’re not breed-specific, and they don’t advertise as a no-kill shelter. Breedspecific rescues are filled with “animal people,” not people who are prepared to make the hard decisions that not every animal surrendered or picked up is adoptable. The fact is, not every animal is adoptable, and a 91 percent live release rate is amazing, given the fact they don’t turn anybody away and take so many animals from other shelters in the country.

What I found most important and I feel was glossed over is the fact that Boulder Humane actively exhausts all options before considering euthanizing an animal. They take the animal in, they evaluate, they train if necessary, they contact rescues, not the other way around, and if every option is exhausted, then they consider euthanization.

How about you focus on the good things the shelter does? The way they responded to the animal welfare needs when there were fires in Boulder County last year? How about you focus on their humane no-pinch collar training techniques? turned out to be a South Texas rancher full of anecdotes about dead bodies found in the brush — but the Border Patrol says these were unlucky immigrants who perished during the past several years trying to enter our country, not recent victims of Mexican cartels. In fact, far from being a chaotic war scene, a study of the 14 Texas counties bordering Mexico shows that the number of murders has actually gone down in the past five years.

Rumors of a Mexican cartel war in the U.S. are nothing but lies by self-serving political opportunists and self-aggrandizing military contractors out to line their pockets.

Anti-GMO activism is evil

ccording to the U.S. Department of Agriculture’s Economic Research Service, 88 percent of the 2011 U.S. corn crop consists of genetically engineered varieties — either herbicide-tolerant types like Monsanto’s Roundup Ready corn, or insect-resistant types containing genes from the soil bacterium Bacillus thuringiensis (Bt), or both. The figure for the 2011 U.S. soybean crop is 94 percent genetically modified. For the 2011 cotton crop the figure is 90 percent genetically modified.

As for sugar beets, the crop that prompted the latest local witch-hunt about growing genetically modified crops on Boulder County open space, the figure for the 2010 crop is 95 percent, according to The New York Times.

The foregoing raises an obvious question about the controversy over growing genetically modified crops on Boulder County open space, which is, why are we even having this conversation? The genie is out of the bottle. The horse is out of the barn. The train has left the station.

The attempt to ban GM crops on county open space is meaningless environmental posturing. It would be farcical except for the fact that it is trashing the livelihoods of several Boulder County farm families.

Are GM crops perfectly safe?

Probably not. No activity involving humans is “perfectly safe.” But GM crops are clearly safe enough. GM crops have been grown for 15 years. Anti-GMO activists talk darkly of possible toxins and allergens tainting the food supply, but after 15 years there is a distinct paucity of victims. Given the pervasiveness of Roundup Ready and Bt corn and soybeans, there should be hundreds of thousands of human cases of GMO-induced Boulder Weekly

human illness and tens of millions of sick chickens, pigs and cows. So far, few, if any, convincing examples have emerged.

What has emerged is that some weeds have managed to incorporate the Roundup Ready resistant gene and develop resistance to Roundup. Anti-GMO activists want to believe this is a show-stopper, but it is hard to see why it would be. All it means is that seed companies will develop different herbicides and find genes that impart resistance to them to add to their offerings, or find other work-arounds.

American agriculture has embraced GM crops and the science behind them, and it is not going to give them up because there might be downsides any more than it would give up tractors because they might contribute to global warming. So to return to the original question: Why is Boulder County having this conversation?

No mystery there. Anti-GMO activists see opposition to agricultural genetic engineering as a political organizing tool and as an avenue for attacking American corporations — which they do with an irrational virulence.

For example, a recent letter writer to the Camera characterized the GMO biotech industry as “built on corruption, bribery, intimidation, government complicity and falsehood.”

“The Monsantos, Syngentas, etc. are not to be trusted,” he added.

Well, the guy is entitled to his opinion, but personally I think Monsanto is a lot more trustworthy and has a lot more integrity than the folks at, say, the Rocky Mountain Peace and Justice Center who routinely besmirch both Monsanto and its products. Monsanto probably does see DANISH PLAN Page 7

social experiment was conducted last week by some folks from Colorado, and it failed. The implications of that failure ought to bring some relief to those of us who believe in women’s equality.

Personhood USA, the Colorado Springs-based Christian group that wants to see fertilized eggs given personhood and full constitutional rights, was behind the experiment. Having twice failed by overwhelming margins to win voter approval for a “personhood” amendment in Colorado, the group set its sights on more fertile territory — Mississippi.

Women’s rights advocates have often called Mississippi the worst state in the nation to be a woman, in part due to its restrictive abortion laws. If Roe v. Wade should ever be overturned, abortion would immediately become illegal in Mississippi.

Currently, there is a single abortion provider in the state, forcing 91 percent of the women in Mississippi to travel across the state or out of state for abortion care. A woman must receive state-directed counseling that includes information intended to discourage her from having an abortion.

Then she must wait 24 hours before the procedure can be performed. Counseling must be provided in person and must take place before the waiting period begins, thereby necessitating two separate trips to the medical facility. For poor women, this means shouldering the expense not only of travel, but also an extra night in a hotel.

It’s not surprising that the folks at Personhood USA, not very popular in their home state, should look to a state like Mississippi. Up to Nov. 8, when Mississippi voters went to the polls, Initiative 26, which would have banned abortion without exceptions and made certain forms of birth control and fertility treatment illegal, as well, was expected to pass.

But when voters reached the secrecy of the polls, they voted against it. The measure failed, with 58 percent of voters in that very conservative, very religious state rejecting Initiative 26.

Some voters were concerned about the proposed amendment’s impact on in-vitro fertilization, which often results in unwanted frozen embryos. Others knew that birth control pills, emergency contraception and intrauterine devices (IUDs) would be outlawed as well, given that they can result in a woman’s body rejecting a fertilized egg (something women’s bodies do naturally quite often). Still others didn’t want to see their daughters, wives and sisters subjected to criminal investigations and forensic vaginal exams after miscarriages, as occurs in Guatemala as the result of a similar law.

And what would happen to women who were pregnant but found out they had ectopic pregnancies or cancer? Would they be forced to give up their own lives for that of their fetuses? Would doctors see PERSONHOOD Page 7

tions for them? How about you focus on their being awarded the top shelter for live adoptions by the ASPCA in the country last year?

Instead your article focused on the “sky is falling” stories of a few “animal people” who are committed to their specific breed. I’ve had a couple of dogs from breed rescue and I recognized the breathless innuendo I’ve experienced firsthand the minute I read the quotes in the article. They believe no animals should be euthanized. They believe every situation is urgent and requires immediate action before the animal is put down.

The reality is far from that. While it appears there can be an improvement on the communication front, it’s also clear that Boulder Humane actively promotes these rescues as another way to save lives. It’s also clear that communication

goes both ways. Fact is, no animal is going to be euthanized if a rescue says they can take it.

Really disappointed that your article sought to pit people who are doing good work against each other. The fact is, they all do good work and Boulder Humane in particular has been recognized nationally for that work.

Bullying in the name of God Two weeks ago, Michigan’s Republican-dominated Senate inserted language at the last minute into an anti-bullying bill that exempted bullies motivated by “a sincerely held religious belief or moral conviction.”

If the homophobia and religious bigotry in those words were more thinly veiled they’d be naked. Senate Minority Leader Gretchen Whitmer, explaining her “no” vote, gave an impassioned speech after the bill passed, saying that the Republicans’ last-minute exception had “swallowed the rule.”

Her speech went viral and sparked a national outcry, causing Republican Sen. Rick Jones, who introduced the bill, to recant the exemption, feebly justifying the language as protecting free speech, not bullies.

Jones has since vowed to vote for the House version Republican Sen. of the bill, which lacks the controversial words. But Rick Jones Jones’ sentiment is clear, that it is OK to bully as long as your religion dictates it. While the First Amendment gives pompous and pious neanderthals like Jones the right to hate gays, it also gives the rest of us the right to berate them into keeping their Stone-Age beliefs in church and out of the classroom. Pray that this fool isn’t in public office for long.

Worst attempt at holiday immortality Everyone has his or her favorite holiday TV traditions, from reruns of the old Andy Williams Show to a drinking game built around Olive, The Other Reindeer. For celebrities, carving out a spot in the holiday genre is as close to immortality as it gets. Think Jimmy Stewart in It’s a Wonderful Life or the gruff voice of Burl Ives as the snowman in Rudolph the Red-nosed Reindeer. Famous people continue to launch myriad attempts at new holiday programming. Let’s just say some efforts are stronger than others.

This year’s award for creating the most contrived holiday show since David Bowie joined Bing Crosby in an odd rendition of “The Little Drummer Boy” goes to (drum roll) celebrity chef Emeril Lagasse. This is the best idea he could whip up.

On Dec. 2, at 9 a.m., Lagasse will be joined by the Radio City Rockettes dressed up like elves as he teaches them, and you, how to make an “Elvis inspired” peanut butter and banana sandwich. We could be wrong, but can’t most Americans over the age of five, including Rockettes, already handle this one? Whatever. It sounds like a drinking game just waiting to be born.

Benson’s generosity overwhelms So we’re supposed to fall all over CU President Bruce Benson because he turned down his measly 3 percent raise this year? The guy only makes $359,100 annually. Cry us a river. What a grand gesture for a filthy rich oil tycoon.

Oh, and the university’s PR machine reminds us that he was among the overpaid administrators who agreed to have their salaries cut by 5 percent during the recession. What a sacrifice.

Taking a tiny percentage out of salaries that are well into the six figures as a symbolic gesture rings hollow with the CU employees who actually lost their jobs during that time.

You want to impress us, Bruce? Figure out how Colorado’s flagship university is going to survive in the long term in a state where higher education funding is being throttled in an increasingly tightening noose.

After all, you weren’t hired because of your academic credentials. You were hired for your business acumen.

who gave women medication be indicted if that medication resulted in a miscarriage? Would women be held accountable if participation in sports or other activities led them to miscarry?

Mississippi Gov. Haley Barbour, a staunch anti-choice Republican, told MSNBC, “I am concerned about some of the ramifications on in vitro fertilization, ectopic pregnancies where pregnancies [occur] outside the uterus and in the fallopian tubes. That concerns me, I have to just say it.”

more good in a week — by preventing famine on a planet whose human population is growing at a rate of 80 million a year, by making it possible for Third World peoples who have scratched out a subsistence existence since the dawn of time to produce the agricultural surpluses that are a necessary precondition for developing First World standards of living — than the entire peace and justice movement has produced in a generation.

The author of the letter also intimated that he “was warned as a child to be very careful about who I hang out with.”

Good point. He ought to take a good look at the denizens of the Rocky Mountain Peace and Justice Center, the prime instigator of the local anti-GMO program, before hanging with them. The biggest environmental accomplishment of these folks was helping to delegitimize nuclear power a generation ago. The result of that “triumph” has been that three-quarters of the world’s electric power is produced by burning coal and natural gas and will continue to be for decades. They are as responsible for global warming as any oil or mining company.

Back in the 1970s the ideological predecessors of today’s anti-GMO activists were attacking Norman Borlaug’s Green Revolution, which is widely credited with preventing global famine and saving a billion lives, with the same zeal with which they are attacking GMOs today — and with strikingly similar arguments: Someone is going to make money selling the seeds, poor farmers can’t afford the seeds and the fertilizers and pesticides they need, the new crops may hold hidden dangers and be setting the world up for a fall, etc.

To hear the activists tell it, antiGMO activism represents the apotheosis of environmental morality.

Just my opinion, but I don’t find tampering with the world’s ability to feed itself for political gain a very moral undertaking. In fact, I think it is malignantly evil — and that Boulder County should reject the counsel of those who do it like a disease.

The fact that these same reasons resonated with voters in Mississippi ought to be reassuring to those of us concerned about reproductive rights. If Personhood USA can’t pass a “personhood” amendment in Mississippi, it’s extremely unlikely that such a measure will pass anywhere.

But Personhood USA — it’s embarrassing to think they’re just down I-25 — isn’t discouraged and stands by its goal of getting similar measures on the ballots of Florida, Montana, Ohio, Oregon, Nevada and California in 2012.

As hot-button an issue as abortion is,

it’s pretty clear that the average American doesn’t want to see it become inaccessible to rape and incest victims, women with badly deformed fetuses and those whose lives are in peril. Nor do most Americans want to lose access to the most reliable

forms of contraception. At a time when extremists dominate the public conversation on abortion, those of us who favor a woman’s right to choose can take at least some reassurance from that.

Rebates power biz lighting upgrades

he money is on the table.

And unless Boulder County businesses act by year’s end, nearly a quarter million dollars in rebates aimed to upgrade commercial buildings and improve energy efficiency will vanish as revelers welcome in 2012.

Since January, $217,000 in EnergySmart rebates have helped 230 commercial properties sport new, high-efficiency lighting. Eighteen have upgraded heating, air conditioning and water heaters, and 16 boast improved refrigeration.

However, $233,000 of the $450,000 allotted for 2011 for business and commercial property owners remains available through Dec. 31.

The funding is part of $12 million awarded to Boulder County by the American Recovery and Reinvestment Act (ARRA) through the Department of Energy’s Better Buildings Program.

The grant runs through May 2013 and helps power the EnergySmart program, which targets both businesses and residences for energy-efficiency upgrades.

Until Dec. 31, Xcel Energy is sweetening the deal with a 50 percent bonus rebate for businesses that retrofit their heat-producing, halogen lights (T12s) to high-efficiency T8 fluorescent lighting and high-efficiency electronic ballasts.

“The biggest bang for the buck on the commercial side is to look at lighting and do a lighting upgrade,” says Mary Wiener, an energy efficiency and sustainability specialist who advises business and commercial property owners for EnergySmart. “In retail, 40 percent of your electric bill can be from lighting.”

The light bulbs are changing anyway. The Energy Independence and Security Act of 2007 will end production of the T12s in July.

“When we found out about [EnergySmart rebates], we were blown away,” says Wade Arnold of The Colorado Group, a commercial real estate firm serving the Front Range. “I have three other part-

“We’ve had a significant improvement in the working environment as a result of the energy upgrade,” says Patton, who directs business operations at Wild Goose Engineering. “We manufacture high-precision, detailed products, so the improvement in the lighting was significant. The fact that our landlord was willing to participate is another reason why we’re staying with Wade Arnold and The Colorado Group.”

Since January, nearly 1,000 commercial decision-makers have sought guidance from Wiener and her colleagues. EnergySmart’s advisers perform an energy audit or analyze one already performed by the utility. They collaborate to establish the clients’ goals and priorities, budget and available rebates. They connect them with preapproved contractors, help them analyze bids and fill in any rebate paperwork. The advisers, in essence, help folks flip the switch with one-stop shopping.

Through the grant, EnergySmart aims to stimulate economic growth and investment in energy efficiency, while advancing Colorado’s energy independence through large-scale energy upgrades.

EnergySmart is sponsored in partnership with Boulder County, the cities of Boulder and Longmont, Xcel Energy and Platte River Power Authority. Partners offer rebates of their own.

“Some of the rebates can be up to $45 per fixture,” says Wiener. “So if the total project cost is $1,000, the rebates are going to cover $600. You’re out of pocket only $400. Then, we look at how many kilowatts you’re going to be saving, and we can determine how quickly that lighting project will pay for itself.”

Wiener says improved lighting saves 35 percent of energy use, on average. Plus, highefficiency lighting provides truer colors and better quality light, lasts longer, and has been shown to increase productivity, she says. The T8s don’t hum, either.

“There is no catch,” Arnold said. “At some point you have to replace these lights. If it’s going to make our existing tenants happy and save some energy, why not do it sooner rather than later?”

now, most of us are aware that our health care system has been compromised yet again.

This time it’s a crisis born of a seemingly never-ending number of unexplained drug shortages. We have heard the horror stories and seen the faces of children suffering from leukemia and other forms of cancer, unable to get their hands on the medications that could save their lives or at least ease their pain. We’ve been made aware of breast cancer victims postponing necessary treatments for lack of a certain

following information was produced from a market analThe ysis conducted by Premier Healthcare Alliance during a two-week period in April and titled Buyer Beware: Drug Shortages and the Gray Market. The full report can be viewed at www.premierinc. com.

According to the analysis, the average markup for drugs in short supply or back-ordered being offered by suppliers on the gray market during the research period was 650 percent. However, the markups were found to be much higher for drugs being offered in certain critical care areas.

As with all tragedies resulting from some human shortcoming such as incompetence, greed or the longing for power, we need, even demand, someone to blame, but who?

Thanks to the world’s largest drug manufacturers, our elected officials and a media environment addicted to good visuals and easy answers, we have been given a culprit in recent weeks, a dastardly collection of small medical distribution companies collectively referred to as the “gray market.” These companies make their profits in the secretive shadows of the mainstream pharmaceutical sector.

And chances are these opportunistic distributors can get you what you need. The catch is that on the gray market, the drug may cost hundreds of times its original price. (See “Drug shortage price gouging” at right) It may be mislabeled, counterfeit, or no longer safe to put in your body from having been stored or transported improperly.

way to the highest bidder willing to take a chance on their products.

But paying more can’t always solve the problem. When he last checked the status of generic cancer drugs on the market in August of this year, Dr. Ezekiel J. Emanuel, chairman of the department of medical ethics and health policy at the University of Pennsylvania, found that 14 of the 34 drugs were in short supply. Some of the 14 unavailable drugs are necessary for the treatments to cure leukemia, testicular cancer and lymphoma. It is no wonder that when faced with such diseases and no drugs to treat them, people will at least attempt to find them on the gray market.

Desperate times call for desperate measures, and recent research offers evidence that this is driving the market. It seems the more integral a medication in short supply is to a person’s survival, the higher the prices can go. So it should come as no surprise that this market of desperation has resulted in oncology and other acute-care drugs comprising the top 10 most exploited-by-price medications.

What may come as a surprise, however, is that these disturbing examples of capitalism at the point of a gun may be little more than a diversion, a smokescreen, if you will, that hides from view the real and considerably more complicated truth behind the current drug shortage crisis.

drugs were in short supply and another 400 drugs were on back order by the end of the year. This year, according to DIRC, we are expected to have shortages on as many as 360 different drugs, which would make 2011 the worst year in history for such unavailability.

Making matters worse, most of the shortfall is impacting medications that are needed for chemotherapy, emergency care and anesthesia. (See “Local oncologist, patient have firsthand experience with short supply” at right.)

Over a two-week period in April, Premier Healthcare Alliance analyzed the incidence of gray market offers being made to its members. Premier documented 1,745 examples of offers for unavailable or back-ordered drugs.

On average, the drugs were priced at a 650 percent markup to the drugs’ regular price, with some drugs being offered at more than 4,000 percent price increases. In all, the offers documented

Local oncologist, patient have firsthand experience with short supply

Leslie Busby of hematology and medical oncology at the Rocky Mountain Cancer Center (RMCC) in Boulder says he’s seen local shortages in generic prescription drugs, but so far no patients have been unable to get medicine they need to survive. But that may change soon.

Dr. Busby says he has only run out of two drugs completely. The first, leucovorin, helps a chemotherapy drug work better, he says, and the second, doxil, is a chemotherapy drug that is still unavailable due to a “manufacturing problem” that prompted a drug recall.

“It’s hard to find a lot of details on why or what happened,” he says of the doxil plant’s shutdown.

The thing is, one of his cancer patients may need it next week.

Martha Thomas, who underwent treatment for advanced ovarian cancer from December 2009 to May 2010, had a relapse five and a half months later, and she still has a 9.5-centimeter tumor. Doctors sent samples of the tumor to a lab in California to test what drugs would work best on it. If her scan scheduled this week shows no decrease in tumor size, doxil is one of the drugs that should be given to her as the next step, she says.

“That would impact me and other people who have ovarian cancer, and maybe other cancers as well,” Thomas says.

In most cases, Dr. Busby explains, there are alternate medicines that can be used when one drug runs out. But

once, in the case of an extreme shortage in the leukemia drug cytarabine, doctors in his network had to decide which patients really needed that medicine the most, because there wasn’t enough to go around. No patients have suffered from the shortages yet, he says, due to “a lot of hard work in the background.”

He says the reimbursement to medical providers for certain generic drugs has been getting lower and lower, because fewer companies have been able to maintain their margins.

“They can’t make a profit on it, or profit is very slim,” Busby says. “So they don’t have a lot of motivation to make more than they need to make.”

A plant typically makes as much of a particular drug as manufacturers think they will need for the entire year, he explains. Then, when a plant is shut down by the Federal Drug Administration or the manufacturer, and there are only one or two others that have made that drug, demand suddenly skyrockets. Normally, when demand increases, prices go up, which should make it profitable for manufacturers. But thanks to The Medicare Prescription Drug, Improvement and Modernization Act of 2003, prices on certain generic drugs are capped, reducing manufacturers’ motivation to meet demand.

Busby agrees that it’s the manufacturers, not the “gray market” that Congress and President Barack Obama are so riled up about, that are driving the drug shortage.

lem,” he says. “I’m not saying they’re wonderful people, either, but they’re not the problem, they’re just taking advantage of a situation that’s out there. They hoarded up some drug and then they’re trying to sell it at a huge profit.”

When asked about the federal government’s efforts to crack down on the drug shortage through measures like ensuring that manufacturers give six months’ notice of an anticipated shortage, Busby says, “I’m not sure what they’re talking about is going to fix it.”

The solution, he says, is encouraging manufacturers to make more generic drugs, possibly by amending the 2003 act to increase the allowable reimbursement rate above the current cost-plus-6-percent level for generics.

Currently, the economics of Medicare encourage providers to prescribe expensive drugs because they get higher reimbursement, according to Busby.

Another idea, he says, is to take a hard look at whether any federal drug regulations can be cut back, since that is one of the factors that drives up costs and, as a result, prices. Busby adds that the FDA doesn’t have a good back-up plan if a drug supply is exhausted, such as looking to European suppliers.

When asked whether he would consider buying from the gray market if faced with a life or death situation and unable to find the necessary drug elsewhere, Busby replies, “That’s a good question.”

But even if medical providers buy

Busby agrees that the current assault on the gray market is, to some extent, political posturing.

“To me, it’s a great way to get political points — no one likes to see Grandma getting charged 100 times more than the drug is usually billed for,” he says. “That upsets everybody.

But the gray market is not the problem, in my opinion. They’re a symptom of the problem. If you encourage companies to make lots of generic drugs and make it somewhat profitable for them, you’re not going to have a gray market, because they’ll always have drugs available.”

As for his patient Thomas, she agrees that “there does appear that there are a lot of politics between the FDA and the drug companies and the profit centers.”

She has heard of a cancer patient who was told she had 30 days to live by heavy hitters like MD Anderson, the Mayo Clinic and Sloan-Kettering. The patient moved to Brazil for the drugs she needed and is still alive, seven years later.

“Maybe I should go to Brazil,” Thomas says.

In fact, as a matter of perspective, consider that the overall losses attributed to the gray market ($426 million) are only about half as much as the $800 million the pharmaceutical industry spends each year just to fill the campaign coffers of politicians and lobby for industry-friendly legislation.

It seems the pharmaceutical industry is second to none when it comes to keeping government off its back and out of its business, which may help to explain why recent attempts by politicians to deal with the drug shortage crisis can look more like political theater than problem-solving.

Washington non sequitur We know the problem. We have a supply dilemma for a growing number

of drugs, particularly low-cost generics that are increasingly becoming unavailable to health professionals and their patients for a variety of reasons. (See “Pharmacists describe local effects of shortage,” page 18.)

The proposed solution coming out of Washington is to pass legislation that would make manufacturers warn us when a drug is going to become in short supply, and to hold hearings to berate the gray-market suppliers who make excessive profits because of the shortages.

In other words, the drug shortage solutions coming from inside the Beltway don’t actually address the drug shortages at all. For instance, Colorado Rep. First of all, ten grand is hardly a fearful penalty for an industry doing more than $2.5 billion a day in business. In fact, it’s equal to about an hour’s worth of interest at 3 percent, compounded annually. Perspective.

Critics also point out that giving notice that a drug will be in short supply could cause earlier hoarding of the drug by the larger hospitals and the gray-market suppliers as well, likely exacerbating an already difficult situation and pushing prices even higher. So why address a symptom instead of the disease?

Why not attack the real problem behind the shortages with legislation aimed directly at the pharmaceutical manufacturers? It’s a question no one in Washington who has to periodically run expensive political campaigns seems eager to answer. Like many of her colleagues, Congresswoman DeGette gets more of her campaign funding from the pharmaceutical/health products sector than any other single industry source, according to the website Maplight, which tracks the influence of money in politics. (DeGette was traveling and was not available for an interview with Boulder Weekly.)

So let’s try again. Why exactly are there so many shortages, and why does it seem that only certain categories of drugs are being affected? As DIRC’s Dr. Fox accurately points out, the only people who can answer this question with authority on a drug-by-drug basis are the manufacturers themselves, and they aren’t talking. We know that there are raw material issues, line closings due to contamination or equipment failure,

compliance issues, not enough FDA inspectors, and so on. There are also issues of too few competitors in the marketplace, manufacturers choosing to produce more profitable drugs over less profitable ones, and other problems that stem from economic decisions. It is complicated.

If government wants to fix the problem, it must force drug manufacturers to provide detailed, specific and verifiable (no self-reporting loopholes) explanations for each and every shortage that occurs, and also address market issues such as consolidation and pricing.

So why would the industry oppose divulging all of the reasons for its shortages? One answer is that publicly traded companies that make drugs and have paid good money to politicians to protect their business interests understand how they would be viewed by a growing public movement sick and tired of corporations that place profits above people. Think #Occupy Johnson & Johnson.

After all, what company would want to report that a drug shortage had occurred because it chose to use its limited facilities to manufacture a highly profitable drug at the expense of a less profitable or even money-losing generic medicine, even though it knew that people could potentially die or become ill as a result of that decision? The truth doesn’t always make a good brochure.

Just ask the banks.

We know profit-driven manufacturing decisions that cause shortages are being made by the industry every day. We just aren’t sure how much of the problem they represent.

pharmacy directors say they have felt the effects of the national prescription drug shortage, but luckily their patients have been spared from serious impacts so far.

Karen Monserud, pharmacy director at Boulder Community Hospital, says that while her pharmacy has not completely run out of any medicines, her staff monitors a list of about 50 drugs that are in limited supply.

She says BCH deals only with reputable distributors, not the gray market, and it has never done business with Superior Medical Supply in Westminster, one of a handful of alleged graymarket distributors asked to provide documents as part of a congressional investigation.

“I don’t believe the gray market caused the shortage,” Monserud says. “The gray market is taking advantage of the situation.”

John Ives, director of pharmacy services for Longmont United Hospital, says he sees the biggest shortages in injectable, generic drugs that need to be kept sterile, and while he says the primary problem lies with manufacturers’ business decisions and manufacturing problems, the gray market is a contributing factor.

“The gray-market companies are also a problem,” he says. “They certainly don’t help.

But it’s much bigger than the gray-market companies, because it’s much more of a big-business financial decision.”

According to Ives, the number of manufacturers that make these types of drugs has dwindled, in some cases to one or two, because they pick and choose what medicines make the most profit. Often, he says, when a market is already cornered by a couple of companies, other manufacturers focus their attention elsewhere.

policies or some other reason, it can be devastating for providers, because they are left with little to no choice.

Hospitals get many drugs from a single distributor that carries a variety of medicines, Ives says, so when one drug’s manufacturer gets put on hold, the hospital sometimes has to contract directly with a second manufacturer for that substance, which can drive up prices.

“If we have to order 2,000 drugs from different companies, we’ve got trouble,” he says.

Ives says the gray market just exacerbates the situation.

“They’ve always been out there, doing what they do,” he says. “And what they do is look for drugs that are short and buying them up, and sometimes they’re buying them up before the drugs are short, with the hope that they will become short at some time so they can turn them around at a profit.”

Asked about Superior Medical Supply, Ives says he’s heard of the company.

“You’re not going to get them to talk,” he says. “What they’ll say is they’re providing a service to the medical community, but in reality, they’re not, because they’re perpetuating the shortage by buying them up, and then they hold us ransom at higher prices when these drugs are short, and so I see no value to the service that they provide.”

Ives adds that the extra layers that the gray market contributes to the distribution system simply increases the chances that “counterfeit” drugs will be provided to patients. In the sanctioned supply chain, medicine should go from the manufacturer to an authorized distributor to the pharmacy. But he says there are some “unscrupulous pharmacies and medical providers” that will sell the drug to third parties somewhere within the supply chain.

Ives says one example of counterfeiting a liquid drug is to refill bottles with water and glue the lids back on.

He says Longmont United has purchased medicine from the gray market in the past, but discontinued that practice due to the fear of counterfeit drugs. He says, however, that Longmont United does “sell drugs back and forth” with local facilities like Boulder Community Hospital, because it increases the chances that it can get the prescriptions it needs for patients.

Ives says it would be a hard call to make if a patient were facing death and no reputable distributor had the drug he or she needed. If he had to go elsewhere for the medicine, he says, he would make sure the distributor was statelicensed by the Board of Pharmacy, and he’d inspect the drug’s “pedigree,” which is the documentation of the substance’s distribution history.

“But the problem is, those pedigrees can be fake,” Ives says.

The increased costs of going with a secondary manufacturer — or a gray market distributor — drives up prices for the consumer, although so far, Ives says, Longmont United has been eating those costs.

But he acknowledges that somewhere down the line, after hospitals and pharmacists increase the amount they bill to insurance companies, the patients pay.

“At some point, the hospitals have to pass those costs on,” Ives says. “At some point, I would say, it is contributing to an increase in overall costs. What it’s doing is it’s increasing the overall cost of health care, and so somebody’s paying that bill. It’s the consumer. It’s health insurance companies, and they pass that on with higher premium costs.”

can cause shortages,” the FDA says in a brochure written to help health care professionals plan for shortages. It further states, “Occasionally, manufacturers temporarily or permanently reduce production amounts of certain drug products as they shift production or reallocate resources to other products. An apparent practice among some manufacturers has been the halt of production when annual quotas are met. A manufacturer’s reasoned, sound business decision to discontinue production of a drug product because of insufficient financial return can cause a shortage.”

Even government regulators understand that profitable drugs sometimes take manufacturing priority over notso-profitable drugs. (See “Potential causes of drug shortages” at right.)But what they don’t know is just how often it happens and what percentage of the total shortages are caused by these profit-motivated decisions.

In an opinion piece he wrote in August of this year for The New York Times, Dr. Emanuel, an oncologist as well as a professor, made the following observation: “Only about 10 percent of the shortages can be attributed to a lack of raw materials and essential ingredients to manufacture the drugs. Most shortages appear instead to be the consequence of corporate decisions to cease production, or interruptions in production caused by money or quality problems, which manufacturers do not appear to be in a rush to fix.”

But in a country like ours that is driven by market forces such as supply and demand, the current drug shortages

make no apparent sense. If a drug is in demand, its price should rise until it offers appropriate incentive to be produced, and the demand is certainly there for most of the unavailable drugs.

After all, we have seen that when it comes to lifesaving medications, money is no object and people will pay as much as 4,000 percent premiums to get them in their hands. So why is it that the market seems to be broken when it comes to pharmaceuticals?

Good intentions, bad results

Over the past few decades, at the same time there seemed to be a neverending rise in the costs of medications, the pharmaceutical industry was being transformed. Like other global industries such as oil, media and agriculture, the pharmaceutical sector was consolidating into fewer and fewer, larger and larger companies. As competition waned, prices and profits naturally increased. All was going according to plan until about a decade ago.

According to Dr. Fox at DIRC, we now live in a world where “a very small number of companies, five to seven, make most of the drugs, and the three largest distributors control nearly all of see DRUGS Page 22

following explanations for drug shortages were provided by the U.S. Food and Drug Administration (FDA). They have been edited for length.

Raw and Bulk Material Unavailability. Disruptions can occur in the availability of raw and bulk materials to manufacturers of finished drug products. This is especially problematic when multiple manufacturers make a drug product with material available from only one source.

Manufacturing Difficulties. Shortages can occur when the primary or only manufacturer of a drug product halts production in response to an FDA enforcement action concerning noncompliance with Current Good Manufacturing Practices.

Voluntary Recalls. Voluntary recalls can cause shortages, especially when a sole manufacturer’s drug product dominates the market supply. Voluntary recalls usually affect specific lots.

Unexpected Increases in Demand. Occasionally, an unexpected increase in demand for a drug product exceeds production capacity.

Manufacturer Production Decisions. Manufacturer production decisions can cause shortages. Occasionally, manufacturers temporarily or permanently reduce production amounts of certain drug products as they shift production or reallocate resources to other products. An apparent practice among some manufacturers has been the halt of production when annual quotas are met. A manufacturer’s reasoned, sound business decision to discontinue production of a drug product because of insufficient financial return can cause a shortage. Under this circumstance, FDA might perform a medical necessity evaluation and, if the unavailability of the product puts the public at risk, encourage other manufacturers to produce the product.

Nontraditional Distributors. The shortage of drug products has attracted several nontraditional distributors who have been able to obtain certain products. When demand exceeded supply through normal channels, these distributors announced the availability of these products at substantially higher prices. How they obtain these products and whether their activities contribute to shortages is unknown. Compounding pharmacies also have announced the availability of drugs that are in short supply. Caution is warranted because preparations from these pharmacies may not have FDAapproved labeling, and their sources of raw materials have been questioned.

Orphan Drug Products. Drug products used to treat rare disorders for a relatively small patient population might be difficult to obtain.

Natural Disasters. Natural disasters cause drug product shortages when they affect manufacturing facilities, particularly those of manufacturers that are the sole source for a drug product or category of products.

Restricted Drug Product Distribution. An increase in the number of drug products available only through restricted distribution methods has caused artificial shortages for some health care organizations.

Industry Consolidations. Manufacturer mergers often result in decisions to narrow the focus of product lines, resulting in the discontinuation of drug products. In addition, merged manufacturers of competing products may consolidate production, making product supply more vulnerable should problems arise.

Market Shifts. The addition of a generic product to the market can precipitate a decrease in the production of the innovator product.

saw the perfect storm gathering on the horizon.

the supply.” Under normal market conditions, this drive toward consolidation would be expected to increase the price of drugs, but not necessarily cause any shortages of drugs, but we got both. So what went wrong?

During the same time period that the prices of pharmaceuticals were exploding upward, we began to hear the political mantra that Medicare and Medicaid were going to bankrupt the nation. And it was true. But still, the drug manufacturers were having a field day.

For drugs that were administered by physicians, such as oncology or anesthesia medications, the doctor or hospital pharmacy would purchase the drug and then bill Medicare or an insurance company for the cost. Drug companies were able to charge very inflated prices, and, as is often the case when other people’s money is being spent (in this case taxpayers’ money), no one complained. But the world changed and the abuses became intolerable.

With federal budget deficits returning following the events of 9/11, we crossed a political threshold.

Washington actually found the political will, albeit temporarily, to try to stop at least some of the bleeding from Medicare. But no one saw the perfect storm gathering on the horizon.

What happened next may well account for many of today’s drug shortages, and it helps explain what happened to supply and demand as a force in the drug market. In response to the excessive drug costs to the Medicare program, Congress passed The Medicare Prescription Drug, Improvement and Modernization Act of 2003.

The short version is that the act forced drug-makers to charge lower

prices to Medicare and, more importantly, due to the demands of the act for verification, etc., the price of the drugs could not rise by more than 6 percent every six months. Insurance companies followed suit, using the Medicare prices as a guide.

What this meant for the drug manufacturers is that older generic drugs that had their prices frozen in time by the act were quickly becoming marginally profitable or money-losing to produce. Since newly developed drugs are branded and come under the act’s control at much higher prices, they are much more — often hundreds of times more — profitable to produce than the older generic drugs. While it’s true that most generic drugs are produced by manufacturers that specialize in such low-cost medicines, even their generic world is comprised of different levels.

There are drugs that are money-losers, drugs that make pennies in profit, and still others that are quite lucrative to produce.

So due to the influence of the 2003 act, every drug that is eventually offered as a generic runs the risk of one day finding itself in short supply as its price falls.

Dr. Emanuel explained it this way in his recent New York Times opinion piece. He writes, “The act had an unintended consequence. In the first two or three years after a cancer drug goes generic, its price can drop by as much as 90 percent as manufacturers compete for market share. But if a shortage develops, the drug’s price should be able to increase again to attract more manufacturers. Because the 2003 act effectively limits drug price increases, it prevents this from happening. The low profit margins mean that manufacturers face a hard choice: lose money produc-

ing a lifesaving drug or switch limited production capacity to a more lucrative drug.”

Unfortunately, being a more profitable drug doesn’t mean being a more effective drug or a more in-demand drug.

Dr. Emanuel continues, “The sad fact is, there are plenty of newer brandname cancer drugs that do not cure anyone, but just extend life for a few months, at costs of up to $90,000 per patient. Only the older but curative cancer drugs — drugs that can cost as little as $3 per dose — have become unavailable. Most of these drugs have no substitutes, but, crazy as it seems, in some cases these shortages are forcing doctors to use brand-name drugs at more than 100 times the cost.”

The evidence suggests that with the passage of The Medicare Prescription Drug, Improvement and Modernization Act of 2003, the market forces that should have guaranteed that lifesaving drugs will continue to find their way to patients as long as demand exists were rendered impotent.

Having created at least part of the problem, Congress needs to act. No one is suggesting that gray-market reforms such as those currently being explored are not needed, but in the big picture, the gray market’s role in the drug shortage crisis is at most microscopic. The larger problem is that in its effort to save the taxpayer dollars that were being misspent on drugs through Medicare, Congress became a co-conspirator in the drug shortage, along with the pharmaceutical manufacturers.

There can be no doubt that some drug shortages are truly unavoidable and outside the control of the drugmakers. But there is also no question that many of the shortages are the result of companies choosing profits over people.

When asked by Boulder Weekly what he would do to fix the drug short-

age crisis, Emanuel suggested several things. First, he believes it is imperative that the government should get out of the business of pricing drugs. He says that this would ensure that manufacturers, particularly those making inexpensive generics used in cancer and other critical care areas, would maintain the financial incentive needed to ensure an adequate supply of the drugs. He also thinks that the FDA needs more inspectors for the sector, so that whether it’s a manufacturing line that goes down or a regulatory concern that causes a delay, the problem can be remedied in a more timely manner than is happening currently. But it’s easier said than done.

Imagine the difficulty of any politician taking such actions at this time.

What elected leader would want to be viewed as trying to increase the profits of the already rich and powerful drug companies? And suggesting that we add more FDA inspectors translates to increasing the budget of a government agency, not exactly a popular position in the current political environment, where cutting off your nose to save your face doesn’t go quite far enough for some folks. But what choice do we have?

The immoral profiteering of the gray market suppliers is an emotional and frustrating issue that needs to be addressed, but it is only one ingredient in the complicated mix that is causing the deaths and pain of the men, women and children who cannot get the drugs they need. While not every shortage can be avoided, many can. The largest contributors to the drug shortage crisis are the drug manufacturers that choose to under-produce some of the less-profitable lifesaving drugs to make more lucrative medications, and the politicians who have created the environment where such decisions are both allowed and even rational in economic, if not human, terms.

Raining on the animal parade

by Elizabeth Miller temperatures. Only a few of them, a few specialist species that live at the tops of peaks, would need to essentially float off the mountain to stay in cool enough temperatures.

In temperate climates, higher elevations tend to be wetter, meaning desert species could find themselves tracking their ideal temperatures into much wetter climates, McCain says. And at higher elevations, much of the precipitation falls in the form of snowpack, when many of the native species are dormant and unable to access it.

“We were just trying in our models to say, OK, there is uncertainty around how precipitation is going to change, but if we look at all that uncertainty, what is the risk?” McCain says. They ran their models assuming various levels of adaptability to wetter or drier climates for species.

“Regardless of which model you use … the risks are so much higher because of this disconnect between tracking a cooler temperature and moving outside your precipitation that you’re used to having.”

In Central America, where drastically drier conditions are predicted for the next century, amphibians like salamanders and frogs face a local extinction risk of up to 91 percent and 71 percent, respectively. In the Rockies, even common species like certain chipmunks and shrews are at risk, as is the more isolated American pika. North American local extinction risks go as high as 49 percent of vertebrate species per mountain range.

Research from a CU-Boulder study team on pikas in the southern Rocky Mountains has shown pika populations abandoning drier sites.

“We suspect that a lack of snowpack

leads to a lack of insulation for pikas in the winter. ... If they’re exposed to cold temperatures, because there isn’t sufficient snowpack, they could potentially freeze to death,” says Liesl Erb, the doctoral student who led the study team that assessed historic sites for pikas. “It’s also possible that the lack of precipitation could lead to lack of sufficient water in the vegetation that they eat. At this point it could be a combination of those factors.”

John Williams, a professor at the University of Wisconsin, has also studied climate change models that factored for both precipitation and temperature.

“What we found was that these climate model projections for the 21st century, if you compare those projections to the late 20th climates, you see areas where there’s novel climates emerging and current climates disappearing,” he says. “Meaning that in some areas of the world, climates that exist today will disappear or greatly shrink in size by the end of the century. In other areas of the world, mainly in the lower tropics, there will be expansions or appearances of novel climates that have not been seen within the earth’s system over the last several million years.”

These new climates might expand the habitat for some species, like those that live in relatively warm environments, but it could also eliminate the environments of those that prefer relatively cold environments, Williams says.

“There is some question of surprise,” he says. “What will happen in these novel climates that are outside of our experience?”

alf of the mammals, birds, amphibians and reptiles living in Colorado’s mountains are at risk of becoming extinct over the next century, according to a recent paper co-authored by a University of Colorado professor.

Climate change predictions that calculate only for temperature changes estimate extinction risks of about 5 percent of species. In this study, which looks at temperature increase and precipitation changes for 16,848 vertebrate species on 156 mountains, the possible local extinction rate increases 10-fold to roughly 50 percent over the next 100 years.

“Everyone thinks about just temperature change, but the truth is that for vertebrates and other mountain organisms, what these models are showing is that precipitation change can be so much more severe,” says Christy McCain, assistant professor in the University of Colorado’s Department of Ecology and Evolutionary Biology and curator of vertebrates for the CU Museum of Natural History. McCain co-authored the paper with University of Connecticut professor Robert Colwell.

Most climate change models don’t predict what the effect will be on precipitation, a more expensive and more tricky variable to calculate.

“So we said, let’s run the models for wetter, drier and average and see how species might respond,” McCain says.

“How much of their niche that they have now would be there in 100 years under all three of those scenarios?”

The expectation is that animals will move up in elevations to stay in cooler

from patients who didn’t want their extracted teeth.

It really added up—my check is for over $31,000!”

Otis Taylor teaches his flavor of blues at workshop

In

November 2010, Otis Taylor, Boulder’s grizzled guitar-wielding and banjo-slinging statesman of the blues, found himself with some rare time off between bouts of playing his signature trance blues in Europe. The 11-time Blues Music Awards winner decided to bring to reality an idea he’d been kicking around for awhile: Host an inclusive workshop teaching people how to play his style of music. If it’s successful, then build on it. If not, no harm done.

It was an instant success. The workshop quickly sold out, and on Nov. 28 of last year, about 50 people grabbed instruments and gathered in a conference room at the Boulder Outlook Hotel to absorb Taylor’s music and wisdom. Led by a band of pros that included bass, drums, djembe and more, Taylor soon had the entire room joining in playing a basic blues shuffle (“the heartbeat,” he called it), and soon he was telling stories, talking music and soloing intermittently over the hypnotic sounds emanating from the dozens of instruments.

“At the end, there was this feeling,” Taylor says, sitting on a metal folding chair in his living room.

“People left with a better feeling after the workshop than they did my concerts.”

Encouraged, the 63-year-old Taylor developed the festival into a three-day gala this year, bagging dozens of local sponsorships and recruiting a top-notch group of musicians to lead workshops over Thanksgiving weekend. Joining him this year will be Muddy Waters’ longtime sideman Bob Margolin, influential banjo master Tony Trischka, Native American blues-rocker Mato Nanji of the band see Trance blues Page 28

Indigenous, the legendary funk bass stylist George Porter Jr., Creole axe-man Don Vappie, and Taylor’s bass-slinging daughter, Cassie Taylor.

Taylor’s music recalls the one-chord blues drones of Muddy Waters and John Lee Hooker, but the musicians he has invited to the workshops play a wider range of styles. Porter, for example, is a legend of New Orleans funk. Trischka is a bluegrass master.

Margolin is known for traditional blues guitar. The way these styles blend, and the way these musicians choose to teach the workshops, is bound to be one of the most fascinating — and educational — aspects of the weekend. Taylor’s being intentionally tight-lipped with the musicians, preferring to let them lead their own way when they get here.

“It’s like, how would you put your bluegrass banjo on top of this music, how would you use your lead guitar?” Taylor says. “I’ll be able to mix it really easy, and it’s educational for people. And it’s fun.”

Margolin is upbeat about the stylistic experimentation to come. He loves the format and is relishing the chance to play with such different players.

“I think that’s going to add a lot of different textures to everything,” he says. “Tony Trischka is just a master of a banjo, and for me, personally, I’m just not in that world, musically. I think it’s going to be very different to hear what he and Otis do using that very percussive yet toneful instrument. George Porter Jr. is literally one of the legends of the kind of music that he plays, and I will be awed and inspired to just be anywhere near him.”

Taylor has packed the weekend with activities.

Friday, Nov. 25, will feature two events: an electric jam at the Outlook and an acoustic one at The Sink,

Taylor says. (The electric jam will be like a big circle, with people trading solos, and the acoustic jam will be a more inclusive, workshop-style event, he says.)

He’s dedicated to the group, not the individual sound, he says, and he wants to bring musicians together who wouldn’t normally play with one another.

“You want to sing good, sing good. You want to sing bad, sing bad. Bad’s almost better than good.

They’re almost better because they’re expressing themselves in a way they never have before,” Taylor says.

If the festival goes well this year, then Taylor wants to expand it to different cities, maybe even overseas. It’s not about ticket sales, he says. He wants to lasso enough local sponsorships to bring the cost of the workshop down to zero so that everyone who wants to can participate.

Margolin, who appears behind Muddy Waters during his performance in The Last Waltz, expects profound results.

“I’m kind of tickled that he chose me for it,” he says. “I always try to connect with an audience at my gigs, and I think this will turn out to be at the very least a different kind of connection, maybe even a deeper one.”

The New Orleans-based Porter is eager to contribute however he can to the musical jambalaya, though he says he has no idea yet what that will require of him. Taylor reached out to him in July, and he hasn’t heard much since.

“I’m not sure how I’d fit in. But he called me, and I said yes,” Porter says. “You know, my bass playing probably has to do with what’s needed. I can be a lead player, or I actually prefer being a pocket person, the guy who sticks with the drummer at home, so everyone can get back to me. It depends on the configuration of the music.”

“I’m going with a very, very open attitude,” Margolin says. “A lot of why I’m really excited about this is because it’s going to be different from what I usually do, and I don’t know what it is. I’m going to have to be creative in that moment, and I hope that something good’s going to come out of it. I can’t imagine what it will be yet, to be honest.”

At once sultry and excitable, his shout/croon style recalls artists like Howlin’ Wolf, Wilson Pickett and, of course, James Brown. Like the guitar, he says, “It just came naturally, I guess.”

After the Weary Boys went their own way, and then pulling together Ernst and company for his band, the Honeybears, Lewis self-released a couple of EPs. Two of those songs were plucked for his fourtrack, self-titled Lost Highway debut EP, the most notable being slow-burn soul rave-up “Bitch, I Love You.” The slyly humorous track (with some wicked lead guitar) has brought the band some heat, but true to form, Lewis could care less what other people think. The song cost him a chance to open for Al Green, which he finds amusing.

“He’s a hypocrite. He’s probably beat a few women in his time. What’s that story about having hot grits poured on him? You know he must’ve been doing something wrong,” Lewis laughs. “You can’t really worry about it, as long as people are talking about you. That’s the main thing.”

Similar wit shines on their two full-lengths, 2009’s Tell’em What Your Name Is? and the recently released Scandalous. It’s there on tracks like “Get Yo Sh*t,” where Lewis tries to console an angry girlfriend upon finding his stuff in the front yard after a night of drinking with his friends. “She said you don’t even buy me presents / Yeah I did, I bought you a box of chicken but I ate it on the way home,” he sings. “She said you don’t even know my name / I said, yeah, it’s Melissa, she said, no dumbass, it’s Roxanne.”

For Scandalous, they spice their blues-soul staples with a few more excursions into the rock end of the spectrum. Perhaps the most surprising of these is “What Love Is,” a searing cover of the Dead Boys’ punk classic. see JOE LEWIS Page 32

The “No Egos, No Tomatoes” tour will stop at the Fox Theatre on Nov. 17, featuring PLM members Gramatik, Michal Menert, SuperVision and Paul Basic with the intent to smear its own dynamic.

Denis Jasarvic, who performs as Gramatik, described this new teamwork mentality to Boulder Weekly over the phone. “That’s how

Michal and I were trying to set the tone of the tour, to be one big collective tour of people not concerned with egos. That’s why we called it ‘No Egos, No Tomatoes.’ We both hate egos, and we hate tomatoes even more. Mike and I discovered this one day when we started the tour — that we’ll eat every single derivative of tomatoes except the raw tomato itself.

“That shit,” Jasarvic says, likely of both egos and raw tomatoes, “makes us puke.”

“You just try to play music you like and I don’t think anyone should just do one thing,” says Lewis. “There are a bunch of different genres on the record.

They’re just the songs that ended up being cool that we came up with. We kind of put whatever’s the best on there.

Meanwhile they’ve scheduled their fourth trip for Australia next month and plan some more European touring next year — their sixth visit. It’s quite a switch for a guy who was homeless less than a decade ago.

“It’s rags to riches,” Lewis laughs.

Knowing too much about the specifics before seeing it yourself would greatly reduce the play’s effectiveness and your enjoyment of it. For that reason, I refuse to divulge virtually any particulars about the plot or the characters. What I can say is that Accomplice concerns itself with two couples. The men are business partners, the women are faithful companions and everyone is scheming against everyone else.

David Menich and Kent Randell play the men, while Alexandra Lewis and Laura Kruegel play the women. Given the frequency with which one character is revealed to be another, each actor pulls double or even triple duty, and they do so with aplomb.

Reasonably credible English accents give way to Irish accents, which give way to American accents before doubling back — often within one scene. As the actors morph from one personality to the next, their mannerisms and speech patterns must switch over completely and immediately. This is no easy feat, but Menich, Randell, Lewis and Kruegel manage it masterfully.

The program notes point out that the set design for Accomplice is bigger and better than anything Devil’s Thumb has attempted in the past. While the set is perfectly serviceable and shows dedication to production design and execution, it is no Taj Mahal.

This leads me to the conclusion that, as with many startup theatre groups, Devil’s Thumb is working with a huge heart but a tiny wallet.

Devil’s Thumb’s modest budget and minimal track record make the success of Accomplice that much more notable. This company is a scrappy Cinderella story out of left field, and judging from its choices of upcoming productions, Devil’s Thumb deserves close attention through its third season and beyond.

he news spread, like it always does, quickly.

Professional skier Jamie Pierre died Sunday afternoon in an early season avalanche while skiing yet-to-beopened Snowbird. The Utah resort hadn’t commenced avalanche control work, and the upper parts of the ski area’s steep, avalanche-prone mountain had been getting pounded by snow and wind, filling in lines and enticing local skiers. A thin October snowpack compounded the problem. Conditions were ripe for slides, and through Pierre was a veteran of big mountains and steep terrain, the slide swept him 400 feet though rocky terrain. Unburied, Pierre was a victim of trauma sustained in his ride down the mountain, and died on the scene.

Unfortunately, Pierre made the headlines the wrong way. But the reality is that with winds in excess of 100 mph gusting across Colorado’s mountains this past weekend, and the same kind of thin October snowpack here, the early season backcountry conditions are as dangerous as they’ve been in years. Forget last year, when Colorado kicked off November with a relatively deep and stable snowpack. This year is different, and it’s shaping up to be grim.

Avalanches don’t happen in a vacuum.

They’re the result of complex interactions between terrain, weather and snowfall. Throw in the human element — skiers and snowboarders jonesing for early season powder turns — and you have a converging set of factors that can lead to the worst possible outcome.

There is absolutely no reason why anyone should be caught in an avalanche. If you don’t head into the mountains when they have snow on them, you’re more likely to get struck by lightning than tum-

bled to your death in an icy wash cycle. But if you ski or snowboard, you will eventually have to deal with the avalanche decision-making process, even if it’s just looking at an avalanche closure rope and deciding to go the other way instead of cutting the closure.

According to Scott Toepfer of the Colorado Avalanche Information Center (CAIC), decision-making is a key part of mitigating the risk of avalanches for backcountry skiers and snowboarders.

A former patroller who has been employed at a wide variety of resorts, from Arapahoe Basin to Courchevel, France, to Mt. Hutt in New Zealand, Toepfer has been with the CAIC since the early ’90s. Toepfer is a skier, and understands the lust for November powder days.

“Everyone is getting jazzed,” Toepfer says of early season snowfall. “The resorts are opening, Warren Miller has had his show in town, and one of the reasons that people live here is to go out into the mountains. But it’s important to back up a step.

“You want to look at a slope and think about what an avalanche will do if you get caught in it,” says Toepfer. “Early season avalanches may not be that deep, but where will they take you?” see AVALANCHE Page 44

According to Toepfer, it is a crucial question.

“Are you going to be taken off of a 100-foot cliff into an old-growth forest or into a deep gully where you’ll be under 18 feet of snow?” Toepfer says.

“Being carried into rocks and stumps at 40 or 50 miles per hour isn’t going to make for a very pretty ride.”

And, with November’s thin snowpack, the odds are that most rides won’t be pretty, at least until more storms arrive and terrain gets filled in.

Other choices, says Toepfer, also play a part.

“It’s important to be educated,” he says, as well as have the right equipment. “A carpenter wouldn’t go to work without a hammer, so backcountry skiers and snowboarders absolutely must carry the correct equipment. A beacon, probe, shovel and first aid kit are the bare minimum.”

Toepfer admits that he can sound a bit like Chicken Little.

“I don’t want people to think that I’m running around saying ‘the sky is falling,’” he says of Colorado’s winters and the risk of avalanches. “I don’t want to tell people, ‘Don’t go.’ There will always be safe places to go, places with mellow terrain. But it’s human nature to push the envelope and push their limits. The thing for people to do is to reduce risk. If there’s snow on it, it can slide.”

And, according to Toepfer, the early conditions that we’re experiencing now

are pretty ugly.

“The snow we had in October is, for want of a better word, rotten,” he says. “It’s set up as our foundation for the winter, and it doesn’t inspire confidence.”

Along with a rotten October base, the winds arrived in November, as did more snow. In particular, the sustained winds last weekend have moved snow from the higher peaks and ridges to below treeline, creating conditions ripe for avalanches in areas usually considered safe.

“We’re starting to see avalanche formation in unusual places,” says Toepfer.

“And this condition is widespread across the state.”

For backcountry skiers and snowboarders, this creates a strange start to the season. Traditionally, areas below treeline are safer, but currently they could be some of the most dangerous.

And this danger can linger.

“There’s very little to hold the snow right now,” says Toepfer. “And the thing we always hear from people caught in avalanches at this time of year is that they say that they never thought there was enough snow to avalanche. Don’t be fooled by grass or other things sticking up from the snow.”

And take your time.

“As snow sits on the ground it becomes more comfortable,” says Toepfer. “Give it 24 to 48 hours after a storm, exercise patience. It’s OK to take it slow.”

he price of poker is going up in Puerto Rico.

That’s how Colorado men’s basketball coach Tad Boyle described the challenge his team faces this week at the Puerto Rico Tip-Off, starting tonight against Wichita State at 5:30 p.m. on ESPNU. Boyle’s Buffs are coming off an 85-57 victory over Division II Fort Lewis College. CU clearly wasn’t at its best against the Skyhawks, but they still managed to look impressive, with Austin Courtesy of CU athletics Dufault and Andre Roberson each recording doubledoubles.

“I thought we really played well tonight,” Boyle said after the game.

“Overall, I was pleased with how we played, especially given how many new guys played, some that haven’t played in quite some time in a college basketball game.

The good thing is you can win by this margin and still have room for improvement.”

The game didn’t come without issues for the Buffs.

Colorado gave up nine offensive rebounds to the much smaller Skyhawks.

Additionally, CU was guilty of two technicals — one on Ben Mills for dunking in pre-game warmups, and another on Shane Harris-Tunks for arguing with officials.

“We’ve got to handle our frustration better,” said Boyle. “Our freshmen have to [handle their frustration], I thought Shane got frustrated.

We’re going to run into more potent offensives, tougher defenses and bigger bodies [in Puerto Rico]. We’ve got to be ready to handle that emotionally and mentally.”

When CU opens play in Puerto Rico tonight against the Shockers, they will get a glimpse of the talent that Boyle speaks of. Wichita State features Boulder Weekly

Should the Buffs defeat Wichita State, they’ll face the winner of the Maryland-Alabama game.

Either matchup would certainly be intriguing.

Last spring, the Crimson Tide ended CU’s season in the semifinals of the NIT. The Buffs would be eager to achieve revenge against athletic Alabama. The Crimson Tide are an athletic bunch, ranked in the top 20 in the nation. They pride themselves on their ability to get deflections on defense, translating into easy points in transition.

First-year Maryland coach Mark Turgeon and Boyle are best of friends, going back to their days as teammates at Kansas.

Boyle coached under Turgeon at Wichita State, and the two faced each other last season, as Turgeon (then at Texas A&M), edged out Boyle’s Buffs in overtime. While he would never admit it, Boyle would love a rematch with his friend.

Other schools in the eight-team field include Purdue and Austin Dufault Temple, both of which are receiving votes in the top 25, as well as Iona and Western Michigan.

“I would rather ease into the schedule,” said Boyle. “But we don’t have that choice. The first two and a half weeks of the season we are going to learn a lot about our team and where we need to improve, but I would rather learn from winning than from losing.”

If CU ends up learning by virtue of the former rather than the latter, then the Buffs could be in for a very successful season in the Pac-12, which isn’t exactly a juggernaut in men’s basketball. Boyle and his staff certainly hope this is the case.

McGinnis says she used to struggle to find good gluten-free bread, but now she has local options like Udi’s and Canyon Bakehouse, which makes Thanksgiving easier and tastier.

“I used to always do a cornbread stuffing instead of using regular bread,” McGinnis says. “Now though, since the gluten-free bread tastes so much better, I may try to make a regular, bread-based stuffing this year.

Sarah Morgan, the healthy eating specialist at the Whole Foods Market on Pearl Street, recently helped host a vegan Thanksgiving supper club. The event included a four-course Thanksgiving meal, including winter squash soup, a caramelized onion tart, chestnut-herbed stuffing, a Yukon Gold potato mash and pumpkin pie.

Though it is difficult to imagine making mashed potatoes or the crust for a pumpkin pie or tart without any dairy or eggs, Morgan made it possible.

“There are tons of ways to make mashed potatoes vegan,” Morgan says. “The way we did the Yukon Gold mash was just with potatoes, water, coconut milk and a little salt, and it was delicious.”

The crusts for the tart and pumpkin pie are a little more inventive. The onion tart has a crust made of thinly sliced zucchini, and the pie, which Morgan says was a favorite of the attendees, has a crust made from a mix of dates, pecans, walnuts and almonds.

Though making a vegan dish may require you to use less traditional ingredients like coconut milk or nutritional yeast, Morgan says most vegan products can be found in the typical grocery store.

Pearl Street gets a new riff

n the late 1990s, I worked on west Walnut Street, a stone’s throw from the Pearl Street Mall. For lunch, I’d patronize now-defunct venues like Juanita’s and the New York Deli, and I’d often pick up morning coffee at the old Bookends Café. Like many, I felt a touch of melancholy when I heard that Bookends was closing, but I’ve also learned to accept that businesses invariably come and go on Pearl.

Riffs Urban Fare now occupies the Bookends space, and it’s owned by the same folks who had the Café. Chef duties are handled by John Platt of Q’s Restaurant. Upon entering for lunch, I experienced mild déjà vu, as this self-described “foodbar” had a similar layout to the cafe. I was joined by Louise and Grant, and it seemed appropriate to meet these new friends in this revived venue. Taking in the dark woods and industrial design bits, Louise observed that the space possessed an “urban, New York feel.”

The menu features small plates and larger portions of dishes like short rib ravioli and lobster risotto appropriate for an entrée or sharing. Soups, salads and sandwiches are also on tap, including a Colorado’s Best Beef Burger and a Kentucky Hot Brown, featuring cheese sauce over turkey.

We started with a $4 plate of house-pickled pickles, including wax beans, beets, cucumber and chard stems. Each possessed a pleasing, gentle crispness and delicate seasoning without an overwhelming vinegar

We ended with a duo of solidly prepared desserts, the $12 crisp duck confit’s richness. Some versions of this preserved poultry are tough and dry. Happily, this each priced at $8. These were an autumnal pumpkin custard with a thin gingersnap, and flourless chocolate wasn’t the case, as the duck had appropriately crisp cake with coffee ice cream. o, I would like to comment on the flood (OK, more a drizzle than a flood) of remarks I got from last week’s rustic cheddar and

apple pie.

Who knew it would gross so many of you out. Seriously? I thought it was much more common. I remember my family eating a hunk of cheddar with their apple pie growing up, and when I lived back East, there were plenty of places serving apple and cheese tarts and pies. Boulder, you don’t strike me as that out of the loop.

Come on, apple and cheese for everyone, live on the edge!

Guess I will keep my gouda and pear crisp recipe to myself.

Anyhoo, this week we will keep the savory away from the sweet. The two shall occupy the same space, but keep their flavors to themselves. Hey, that gives me a great idea for this week’s treat. How about an “Occu-Pie” — now that’s some good stuff. I think I will do a Toasted Pecan Pie. It’s perfect for the holidays, and some occupys (occu-pies) seem to be getting a little sticky, so I deem this appropriate on all levels!

This is going to be a basic pecan pie, not too many fancy things added. I am toasting the pecans, and placing them on the bottom to keep the crust nice and crisp just like a good pie should be: straight up, no soggy bottoms allowed. I love chocolate with my pie, but sometimes old-fashioned is just what you need, and this is a good old-fashioned, kiss-your-Grandma kind of pie.

I am, however, not using corn syrup.

People get so up in arms with poor little corn syrup, so this recipe is for all you corn syrup whiners. Kidding, kidding people, calm the h-e-double-hockey-sticks down.

This version will be just as tasty, a tad less sweet, and you will never want to make one with the devil syrup again.

Now you know you can make this recipe a whole lot easier on yourself if you buy a store-bought pie crust. The insides are so good, it’s hard for any crust to taste bad, but I will add my simple pie crust recipe for all of you

with pre-made, store-bought crust aversion syndrome. (P.M.S.B.C.A.S. is the clinical name.) I’m sure there is a nice drug out there for it.

I know a lot of people that prefer pecan pie instead of pumpkin (WTF) for Thanksgiving, so this will be an easy, breezy recipe to whip up for your guests.

You know what I like to do? (No, Danette, what do you like to do?)

Well, I’m glad you asked. I like to make a simple little pumpkin whipped cream to top the pecan pie with. Just make your basic whipped cream recipe, add a tablespoon of pure pumpkin and cinnamon, and yumdiddy-yum. You have a treat that will delight the masses, and you will be the hottest pilgrim in town.

Now, follow the directions, put some love into it, and invite me over when it’s done.

This is a good oldfashioned, kiss-yourGrandma kind of pie.

Toasted Pecan Pie 2 eggs 1 cup brown sugar 1/4 cup granulated sugar 1/2 cup melted butter (unsalted) 1 tbsp. milk (I used 2 percent) 1 tbsp. flour 1 1/2 tsp. vanilla Pinch of salt 1 1/2 cups toasted pecans (lay pecans on baking sheet, 5-7 minutes at 350) 1 unbaked pie shell (9-inch) Preheat oven to 325. In large bowl, beat eggs. Add in brown sugar, granulated sugar and butter, mix until well combined. Stir in milk, flour, vanilla and salt. Fold in 1 cup of the toasted pecans.

Take 1/2 cup of the toasted pecans and lay over bottom of unbaked pie crust. Pour filling over top.

Bake for 50-60 minutes, until filling is set. Take out, let cool completely.

Cut into slices, top with whipped cream and serve. Enjoy!

The restaurant offers homemade salads, sandwiches, soups and lunch entrees during the day, and delivers to local businesses from 10:30 a.m. to 2 p.m. Monday through Friday. The restaurant also offers a full bar with “Specialty Old Time American Cocktails” and Cuban cocktails, in addition to its “Minglewood only” imported spirits.

For Thanksgiving, Jake Rosenbarger, co-owner of Kim and Jake’s, suggests the pumpkin cake, which is basically made with all the contents of a pumpkin pie.

Rosenbarger says it sets up the frame of mind for Thanksgiving, but in a fun cake instead of a pie. Rosenbarger also points to the ginger molasses and carrot cakes as good spicy options.

Bad title, good movie

orty-five minutes or so into Tower Heist, the question arises: Is this movie with the title of purest generica — was “Stealing Money” taken? — truly good, or simply less bad than most of what director Brett Ratner has done previously?

The improbable answer is A. For what it is — recessionary wish-fulfillment escapism, with a lot of highly skilled familiar faces in its amply qualified cast — it’s fun.

The humor’s not subtle; a lot of it’s misogynous and fairly coarse. But the script by Ted Griffin (Ocean’s Eleven) and Jeff Nathanson (Catch Me If You Can) doesn’t make the usual action comedy mistake of piling on the action at the expense of the comedy.

Recently tapped and dropped as producer of the Academy Awards telecast, Ratner made his pile on the Rush Hour franchise and by directing the third (and drecky) X-Men film. With Tower Heist he takes his cue from the atmosphere and vibe of various, beloved 1970s heist pictures, among them the original The Taking of Pelham 123. Certainly Ratner’s composer, Christophe Becke, has studied that film’s David Shire score: The funky bass lines and trumpet blasts here keep announcing big, bad doings in Manhattan.

Played by the Trump Tower just off Columbus Circle across from Central Park, the luxe high-rise of Tower Heist is home to a Wall Street tycoon (Alan Alda) whose ethics recall Bernie Madoff ’s. He’s

orget Jack and Jill and the fact that Adam Sandler plays them both and not particularly well in his new “twins” comedy. Al Pacino is almost reason enough to see it, all by his bigger-than-life self.

Can I get a “HOO hah”?

Pacino plays a scary, cartoonish and more over-the-top-than-usual version of himself in this farce and scores big laughs with every entrance. He’s performing Richard III on the L.A. stage, bellowing at cellphone users. He may take Man of La Mancha to Broadway, even though he sings like Sinatra’s pet bullfrog.

And he’s mad for Jill, Jack’s obnoxious Bronx cheer of a sister, whom he met while sitting next to Johnny Depp in a Justin Bieber T-shirt at an L.A. Lakers game.

Jack (Sandler) is a wealthy TV commercial director who can’t stand his yenta-sibling, Jill (Sandler again). She comes to visit over the holidays, craving a little “twin time,” and all Jack can think of is ditching her.

“We shared our mother’s WOMB,” Jill pleads.

The promotional imagery for Tower Heist does not hide the sequences involving the Ferrari dangling from a cable outside the building, while down below the Macy’s Thanksgiving Day parade proceeds along

Central Park West. Compared with the outsized chaos of the Rush Hour sequels, though, Ratner’s latest has a pleasing sense of scale. The film actors such as Matthew Broderick (as a sad-sack Wall Street victim), Michael Pena (as a newly hired bellhop),Casey Affleck (whose droll line readings as the concierge are consistently surprising) and Gabourey ”Precious” Sidibe (as a safecracking maid).

I wouldn’t say that producer and co-star Murphy is slumming here, exactly, but it is too bad the superstar who ruled the world with such savvy commercial entertainments as the first Beverly Hills Cop and the first 48 Hrs. doesn’t get a little more elbow room. Likewise, the splendid Tea Leoni, in the role of an FBI agent, is allowed just enough screen time to remind you she’s not getting the screen time she deserves. Murphy’s key early byplay with Stiller — when the building manager explains the heist plan — ends with a simple, quick, “Let’s go get something to eat!” Note: That’s not a funny line. But Murphy’s delivery is hugely so. The sleek and efficient Tower Heist was made for one reason only: It’s all about the Benjamins. Even by sloppy Sandler movie standards, this one’s a wreck — fart jokes, potty zingers and pit-stain gags.

Live colleagues pepper the set, along with product placement from a certain pink stomach medicine, the aforementioned donuts and even a cruise line. Mexican comic Eugenio Derbez does some catchphrase shtick.

One running gag works: Scripted “interviews” with real twins open and close the film and are funnier than anything Sandler’s house director, Dennis Dugan, has ever managed.

They’re the reason Jack and Jill starts off as though it’s going to be far more evolved than the usual how-low-can-they-go wallow.

Sandler’s such a feeble actor that his bellowing rages never match the expression he musters on his blank face. He puts all his efforts into playing a woman, broadly and badly, so much so that the male twin is even duller than standard-issue Sandler.

But then there’s Pacino, out of place and yet somehow right at home. You want big? Al does BIG. And since this is as close as we’re likely to get to “Don Corleone Does Don Quixote,” that alone is worth the price of admission.
