Highroad What’s killing America’s middle class?

s the royal triumvirate of Donald Trump, Paul Ryan and Mitch McConnell continue their perverse quest to turn our America into a gold-plated Trumplandistan for oligarchs, they keep insisting that their blatantly elitist schemes will magically elevate the middle class and even the poor, delivering a sevencourse dinner to everyone!

Yeah, right — as we’ve now seen from their totally regressive new tax law, your and my seven-course dinner turns out to be a six-pack and a possum. In fact, as the nonpartisan Tax Policy Center reports, 10 years from now, 83 percent of the benefits in the Trump-Ryan-McConnell tax act will be flowing to the wealthiest families, while more

than half of America’s middle-income and poor people will actually see their taxes rise during the next decade.

Meanwhile, this egregious giveaway to undeserving corporate elites will add as much as $1.5 trillion to the federal deficit. No problem, says the slap-happy triumvirate, for we have a plan to cover the cost of these lavish tax cuts we’ve given to the royals (including cuts for the gilded Trump family, which just happens to be one of the act’s top beneficiaries). As Trump himself explained the plan: “We’re going to go into welfare reform.” Yes, the plan is to cut such essential safety net programs as children’s health care, food stamps, jobless programs, and — as Ryan now publicly admits — they intend to cut your and my Medicare and Social Security.

What we have here is plutocracy in action: The precious few are intentionally knocking down and locking down the many to further enrich themselves. This is why the social cancer of inequality is spreading so rampantly in America, devouring the very middle class that Trump & Company are using — ironically and cynically — as an Orwellian rationale for passing their plutocratic agenda.

T

here was no official commemoration of the 100th anniversary of the Russian Revolution last year.

Vladimir Putin’s spokesman, Dmitry Peskov, asked, “What is there to celebrate?”

Meanwhile, hundreds of thousands of Russians participated on Vkontakte (the Russian version of Facebook) in Project 1917, which was created by independent journalist Mikhail Zygar. Every day of the year, people read the observations of those who lived through the events of the Russian Revolution a century ago. The content came from diaries and other historical documents converted into social media posts. For example, on an August day, Czar Nicholas II posted a status update about going on a pleasant walk and reading some Sherlock Holmes.

The focus of the project was on ordinary people, not those in power.

Zygar said, “This project is against the stereotype that Russia’s destiny is to be a dictatorship, that Russia’s destiny is to be an empire. No, that’s not true. We had a lot of people who were fighting for Russia’s democracy and freedom, and we can be proud of that as well.”

The project was not allowed on the traditional media. Zygar said, “Those in power are quite conservative, they consider television to be the method to control minds. ... We don’t have any quality newspapers, we don’t have any normal TV channels. All the independent journalism is on the internet. All the investigations, all the real news, all the really important issues are discussed there.” Now Putin is repressing the internet.

Russian-American scholar Keith

Gessen says the 1917 revolution is almost the only historical event that the regime doesn’t celebrate as part of Russian history. He says, “Putin has been a fervent devotee of the Russian Orthodox Church, Soviet military might, émigré existentialist philosophers and the occasional tsar. Popular culture has been equally promiscuous: figures as disparate as Genghis Khan, fictional 17th-century Ukrainian Cossack Taras Bulba, leader of the (counter revolutionary) White armies Admiral Kolchak, the T-34 tank, 1950s hipsters and most controversially Stalin have all been featured as admirable or at least sympathetic figures in the Russian movies and television shows of the past decade.”

“But,” Gessen says, “Lenin and the Bolsheviks are out of bounds. They appear sometimes late at night on the quasi-fantastic ‘history’ shows on pro-Kremlin NTV as German agents or secret Freemasons or not-so-secret Jews.”

There was another recent anniversary that was ignored. Twenty-five years ago last Christmas, the Soviet Union dissolved. The country had consisted of 15 republics, which became separate nation-states in 1991. The last Soviet president, Mikhail Gorbachev, wanted a transition to something like a Scandinavian social democracy. But President Boris Yeltsin of the newly created Russian Federation rapidly carried out “shock therapy” privatization.

This provoked an economic depression that would be much worse than what was experienced by Americans in the 1930s.

In 2018, the U.S. Forest Service will amend the Forest Plan regarding Recreational Sport Shooting (RSS) on nearby National Forest Service lands.

Four “alternative management strategies” have been drafted in collaboration with stakeholders comprising the Northern Front Range Sport Shooting Management Partnership. This effort seeks to adopt a balanced management strategy in response to growing concerns and conflicts resulting from increased sport shooting activity — which is currently allowed on public lands. Lawful hunting activities are not affected.

For those unfamiliar with the impacts of recreational sport shooting, and “dispersed recreational sport shooting” in particular, I offer this story. A couple of years ago I joined some friends for a day of rock climbing. We drove past Lyons on Highway 7 and turned onto Bunce School Road.

Reaching our destination, we were surrounded by beautiful forest and rock outcroppings. For the entire day barely a minute passed without the jarring barrage of noise from pistol and military-style gunfire.

There are serious negative consequences of sport shooting on our public lands, which include: 1.

Jeopardizing the safety of others; 2.

Destroying the peaceful enjoyment of our public lands; 3. Degrading wildlife habitat; 4. Sacrificing the quality of life for rural residents — without their consent; 5. Increasing the risk of forest fires; and 6. Polluting land, water and wildlife with lead bullets.

Unbelievably, three of the four

alternatives would designate large swaths of the 10 “wilderness areas,” including Indian Peaks Wilderness and James Peak Wilderness, as “suitable for dispersed recreational sport shooting.”

Only Alternative 4 designates wilderness areas as “unsuitable” for RSS, while providing additional shooting ranges: “Alternative 4: No Dispersed Shooting anywhere on the Arapaho and Roosevelt National Forests.”

To those who care about safety in the mountains

In the summer of 2017, over a span of 43 days, there were five deaths on Capitol Peak.

Five sets of friends, families and communities were devastated by the tragic and unnecessary loss of dear friends, brothers, sisters, daughters, sons and community members who attempted to climb Capitol this summer and lost their lives in the process.

We are still filled with overwhelming sadness and grief for those that are dearly missed.

unprecedented and a shock to many observers across the globe. Why did it happen? In their book Revolution from Above, economist David Kotz and Moscow-based journalist Fred Weir argue: “The Soviet system had been dispatched, not by economic collapse combined with a popular uprising, but by its own ruling class in pursuit of its own perceived interests.” The partystate elite found that the Soviet system provided a less privileged life for them than a transition to capitalism.

Kotz and Weir cite a study of the ideology of a sample of the Moscow elite in June 1991, which found that 76.7 percent had come to favor capitalism while only 12.3 percent supported democratic socialism and another 9.6 percent had a communist or nationalist ideology.

In his book Stealing the State: Control and Collapse in Soviet Institutions, political scientist Steven Solnick says that bureaucrats began engaging in massive insubordination by seizing the governmental resources they were supposed to be managing: “Soviet institutions were victimized by the organizational equivalent of a colossal ‘bank run,’ in which local officials

rushed to claim their assets before the bureaucratic doors shut for good.” His conclusion is based upon a close study of the Communist Youth League (Komsomol), the system of job assignments for university graduates and military conscription.

Meanwhile, the Bush and Clinton administrations in the 1990s played an important role in encouraging the brutal privatization of Russia’s economy. In 1996, the Clinton administration aided Yeltsin when he was running for re-election. The cover of the July 16 issue of Time magazine featured a cartoon of a smiling Yeltsin waving a little American flag with the headline. “Yanks to the Rescue: The Secret Story of How American Advisers Helped Yeltsin Win.” That was a different time. Today many American conservatives, including the president, are big Putin fans. The Christian right admires Putin’s staunch opposition to gay marriage and his alliance with the Russian Orthodox Church.

Neo-Nazis marched in this country chanting, “Russia is our friend.” They are excited that Putin supports European far-right parties with fascist origins.

Capitol Peak is notorious for being one of the state’s most dangerous 14ers, but the five lives it claimed this summer were unprecedented. In the previous 10 years, four people lost their lives climbing Capitol, but in 2017, five perished over a span of six weeks.

It was an insult to the memory of those we have lost that a widely read and respected magazine for Colorado’s outdoor community, with a veteran editorial staff, had the audacity and gall to publish a story of this nature — in effect challenging readers to climb Capitol Peak if they had the “nerve” and (necessary skill) — as an afterthought. As a major publication in the outdoor space, 5280 has the obligation and duty to equip their readers with the information and safety tips they need to be successful in exploring the outdoors — and not romanticize or downplay the dangers of Mother Nature.

The language used by the authors was problematic to say the least, insulting and devastating to read at worst. “The nerve” ... as though a highly technical, dangerous climb can be taken as a dare or game. I am irrevocably disappointed in the staff of 5280 for such a callous turn of phrase, given recent events.

Even more galling is the photo that snagged the cover of last month’s issue — featuring a climber straddling the infamous Knife Edge Ridge — without a helmet. Choosing to portray the climb as a cakewalk instead of a serious endeavor to the public implies that the route can be accomplished or “bagged” by the casual climber or even someone with little experience or knowledge of mountain safety.

Readers may very well attempt to summit Capitol unprepared, without the necessary skill level after being exposed to magazine covers, social media and newspapers — given the nonchalant language and accompanying photos that are being published with little regard for human life.

Media should be taking the lead and promoting safe, sane and responsible outdoor recreation.

Readers deserve a public apology, as well as a commitment that this type of article and language will never again be seen in the magazine. Editorial staff have a journalistic and moral obligation to do their research, prepare their readers and portray a realistic portrait of their recommendations.

Colorado readers, as well as the families of the five, deserve better.

President Trump continues to believe Putin’s comments, and questions the U.S. intelligence agencies’ analyses about Russian meddling in the 2016 election. Trump does not want the validity of his election as president to be questioned, but his criticism of our intelligence agencies and the FBI poses a risk to national security. The new FBI Director, Christopher Wray, is reassigning the top echelon in the

FBI to purge it of agents who Trump dislikes, and it is quite similar to the operations of past and current foreign despotic rulers.

Trump, and the country, have to rely on our intelligence agencies and the FBI to provide information on our adversaries in the world. If the agencies do not trust the President, they might be adversely affected in doing their jobs. I heard that morale takes a hit at the agencies every time Trump criticiz-

es them. Trump is disrupting our intelligence agencies and the FBI. Unfortunately, Russia, China and other countries know that Trump likes to be flattered, which they are happy to do in order to receive favorable treatment by our insecure President.

Our adversaries in the world are manipulating Trump to obtain concessions, and our national security is in jeopardy.

Small-scale farmers say ‘onerous’ Boulder County regs limit financial viability and research opportunities

f the 24 organic farmers who started working Boulder County land in 2011, only five are still in business.

There are a lot of reasons for the roughly 80 percent failure rate, and everyone has an opinion on the definitive cause — farming in Colorado is tough, the County doesn’t give farmers enough resources, the land is not ideal, the farmers were bad farmers and on and on.

One obstacle that many farmers, particularly smallscale organic farmers, agree exists is the County’s Land Use Code, which they find restrictive, keeping them from buying infrastructure and engaging in activities that would help make their farms financially viable.

So the County, in response to complaints about the Code, reached out to the community a few weeks ago, asking farmers and members of the public to comment on how the Code can be improved. On Jan. 18, the County Land Use Department will hold a public meeting to share the results and hear more concerns.

But there’s been controversy about the process by which the County has engaged farmers and citizens in this attempt to update the Code; it’s fitting, as this is the latest in a series of controversies regarding agriculture on Boulder County unincorporated land.

He notes that in the first three weeks open to public comment, only one farmer submitted his thoughts. One reason might be, he says, is because current Land Use Code is enforced only when there are complaints, and that many farmers may be operating in violation of code out of necessity, thus incriminating themselves by participating in the survey.

For instance, Guttridge hosted about 80 Boulder Valley School District students recently to teach them about carbon sequestration, cover crops and other regenerative farming techniques. But the event exceeded the six events he’s allowed to host each year on his farm per the County’s Land Use Code. The six-event limit is an arbitrary rule, Guttridge says, developed from one isolated incident and applied to the rest of the farmers in the County. (An additional six events are allowed with a special review process with the County.) He says it prevents farmers from hosting a culturally

impactful amount of farm-totable dinners, educational events, ceremonies and more, which could also provide valuable income.

There are other issues farmers are taking with the Code.

Greenhouses, in certain zones, are disallowed because they’re considered part of “intensive agricultural uses,” even though Guttridge says they’re critical to keep his farm financially stable in the winter and keep key organic material such as seedlings alive.

Wyatt Barnes of Red Wagon Farm says the rules regarding farm stands are financially prohibitive (and complex). In his case, he either has to run his farm store off-site or limit the amount he can sell at his on-site store.

“Getting empty land and only using it for a farm stand does not work financially. No one can get a foothold to start a business and grow it to where maybe they could buy an entire property to dedicate to a farm stand,” he says.

The County, of course, must

act not only on behalf of the farmers but of the people who live near agricultural operations. Traffic, machinery, blocked views — those are negative impacts.

Walt Pounds operates a farm on 60 acres of a conservation easement north of Longmont. He understands the concerns neighbors have, but operating a successful farm simply necessitates certain bits of infrastructure, he says.

“The neighbors definitely prefer to not see any change to the property and ... they like looking out across the pasture, so they don’t want to see any active ag development,” Pounds says. “I do think that’s a problem. We have a beautiful county and it’s because we didn’t allow overdevelopment, and I very much appreciate that. [But if ] the answer from an ag perspective is not to do any [land improvements], you end up with a perpetual decline in soil fertility and noxious weeds, and it isn’t remedied.”

Amy Oeth, planner at the Boulder County Land Use Department, says that although “agri-tourism can help support an agricultural operation,” there are impacts on the environment, neighbors and other farmers. To what extent the County would expand agri-tourism possibilities for farmers, Oeth says there is not a “set view on the appropriate scale.” The open comment period, See CROPPED OUT Page 12

DAY BY DAY, ONE BY ONE A year after being released from detention, a Bangladeshi immigrant finds a new life in Colorado

T

hree hundred and fiftynine. That’s how many days Shoeb Iqbal has been free in America. If you’re reading this after Jan. 11, 2018, it’s been longer.

The last time we talked to Iqbal (referred to with the pseudonym Mishkat Sarkar in previous reporting) it was early 2016 and he was being held at the U.S. Immigration and Customs Enforcement (ICE) Denver Contract Detention Facility in Aurora. At the time, he had been in immigration detention for more than 15 months, starting Nov. 13, 2014 — the day he crossed into the U.S. from Mexico.

After being held for more than two years, Iqbal was released on Jan. 17, 2017, and has been adjusting to life outside of detention in his new home city of Denver since.

“When I got out, everything was like a dream,” Iqbal says.

As previously reported, [Re: “Opposite of America,” Feb. 18, 2016], Iqbal arrived in the U.S. after a harrowing escape from his home country of Bangladesh after experiencing death threats due to his political affiliation with the Bangladesh National Party (BNP), the second largest political party in the country. The BNP had recently lost power to the Awami League and hundreds of its members fled the country due to political unrest.

In 2014, Iqbal came to the U.S. seeking asylum, but was denied because the Department of Homeland Security (DHS) classifies the BNP as an “undesignated terrorist organization,” despite previous joint efforts to combat terrorBoulder Weekly

ism with the group.

Iqbal denied such claims and filed an appeal. As he awaited a decision, hundreds of Bangladeshis also sat in detention around the country in the same predicament. Many, including Iqbal at the Aurora facility, organized hunger strikes, protesting their prolonged detention.

After we reported Iqbal’s story in 2016, he was transferred to detention centers in Arizona and Louisiana before landing in Alabama at the Etowah County Jail, where immigration detainees are housed with inmates facing criminal charges.

Immigration advocates have long been concerned with conditions at detention facilities, both those housed in public jails and others operated by private prison corporations. A recent DHS report criticizes ICE for “unsafe and unhealthy detention conditions” at facilities across the country, although neither the Aurora nor Etowah facilities were named specifically.

But in Etowah, Iqbal experienced the worst conditions yet. The facility was often put on lockdown, where he would have to stay in his cell for hours, even days, at a time, he says. It cost at least $5 to make a phone call, and it was difficult to stay in touch with his family back home in Bangladesh as well as the friends he had made in Denver.

While there, his mom passed away after suffering a stroke in Bangladesh.

He had talked to her the week before and “she was very healthy,” he says. But he didn’t even find out about her pass-

ing until a few days later because his family wasn’t able to call him, and due to the cost, he wasn’t able to call home all that often.

“It was hard to hang on to hope,” he says, remembering the loneliness he felt in those days.

Just a few days later, however, the Board of Immigration appeals ruled in his favor and he was granted asylum.

Iqbal says he’s lucky. He had built a support system in Denver and had immigration lawyers from California and Washington D.C. working on his case. Nationally, only 14 percent of people held in detention have legal counsel, despite the fact that those who do are four times more likely to be released. Of the 15 people or so with whom Iqbal traveled from Bangladesh, all but three were deported, he says.

“They are afraid for the political condition,” Iqbal says of those living in Bangladesh again. The political persecution that led them to flee in the first place is expected to flare up again this year. A general election is set to take place later this fall amid growing fear of unrest as the BNP will once again challenge the ruling Awami League for power.

ICE transferred Iqbal back to Colorado — back to the Aurora detention facility — where he had filed his appeal, before releasing him. On Jan. 17, 2017, he was finally free.

“The fact that he managed to last two-and-a-half years just going through horrible situations is remarkable,” Ledbury says. “When we’d go visit him, he’d have days when he was really up and days when he was very low.”

But it was all celebration the day he was released last winter. The group went out to dinner, where Iqbal was overwhelmed by the plethora of options on the menu. Walking into the restaurant, Giordano says, Iqbal touched her arm and whispered, “We don’t have to talk through a glass window anymore,” with a smile.

ostensibly, is an opportunity to broaden that scope.

But Guttridge says despite the fact that the County is soliciting input on specific regulations, the underlying relationship between farmers and County regulators needs to change.

“We need a cultural shift in the County,” he says. “Most of the farmers I’ve talked to, it’s not the specific code, it’s this culture of hindering instead of helping.”

Barnes says the Code is “intentionally vague,” and agrees that a cultural shift needs to occur in order to support farmers.

“There is no way to read [the Code] and really understand what will happen when you go to do something,” Wyatt says.

Pounds says the application of the Code is as bad, if not worse, than the Code itself. He says he spent a year and thousands of dollars in attorney’s fees to site a small piece of infrastructure on his property. “[The Code application] is very onerous,” Pounds says. “The practices that we have in Boulder County are far more rigorous and difficult than they would be in other parts of the state by far.”

In response, Oeth wrote in an email that the County “hopes to further understand the community’s viewpoints and where opportunities exist for making changes as identified through this initial outreach.”

Land Use Code amendments may sound like small potatoes to the general public, Guttridge says, but improving the Code is critical to advancing sustainable agriculture — if the public appreciates that, they need to have a say in this process. However, the process is muddied for public involvement, he says. With the deadline for public comment Jan. 12, Guttridge thinks the public hasn’t been engaged well enough.

“It’s kind of hard for someone from the public to access [the public comment form] because there are general categories ... that are not providing the background the average citizen needs to engage in this process,” he says.

Oeth says the public meeting on Jan. 18 will feature Land Use staff members able to answer questions.

Ironically, education events at Ollin Farms and other agricultural spots would be one way to get the average citizen up to speed. The Boulder County Farmers’ Markets are often the only interaction citizens have with farmers, but it’s not easy in those situa-

tions to convey concepts like regenerative farming and carbon sequestration — and how regulations regarding how many interns can live on your property or which animals can graze affect the ability to execute those groundbreaking environmental concepts.

“In general, there’s a new form of agriculture coming, a new paradigm of agriculture being blossomed,” Guttridge says. “To me, it’s summarized by putting the ecosystem back in the field. We’re seeing farms bringing animals and managing multiple crops.

You need greenhouses, new people. In some ways, it’s a little more intense.”

The County recently scrapped its Sustainable Agricultural Research and Innovation Initiative (SARII) program because of a controversial bidding process. SARII would’ve helped large farmers transition off GMOs, which were ordered to be phased out, but Guttridge and Pounds say high-profile cases like that obfuscate a larger point: that farmers in Boulder County are doing cutting edge research in sustainable farming, outside of GMO research, with little help and publicity.

“One of the unfortunate things, we seem to want to just grab onto a sound bite as a citizenry and that sound bite [pertains to] GMOs,” Pounds says. “So we’ve paid all this attention as to whether or not we have genetically modified crops on our ag land and that’s a very small component of the issue. The issue is really around soil fertility, and it’s unfortunate.”

Oeth says carbon sequestration is not the focus of this public input period.

The County did take a small step in the right direction, Guttridge says, with its Colorado State University-led program working with EcoCycle to study agriculture and composting. But given the relatively small scope of that, he and other local sustainable farmers are having to pick up the slack by organizing and hosting research initiatives.

Even still, he says, the County, after scrapping SARII, hasn’t effectively managed the GMO transition.

“We’re no closer to the GMO transition, like we still haven’t figured out alternatives for bigger farms on open space, so we’re kind of moving into crisis mode,” he says.

Oeth says there is no timeline for actually implementing anything that comes out of the public comment period, but says the County will pinpoint areas for further research and outreach.

affected by detention a place to stay, whether they’re recently released or visiting family members currently being held. Then he went to Lutheran Family Services, a refugee and asylee resettlement agency that helped him with food and rental assistance, while he waited for his social security to process. It took a month, but he started working right away, often holding multiple jobs at once. He got his driver’s licence in April, and he now works at DIA in passenger assistance as well as drives for Lyft. But, he says, he wants to go to Emily Griffith Technical College and study accounting or marketing.

“I make my dream come true, day by day, one by one, one step by one step,” he says. “My next dream is I want to get educated, go to college, get a better job. It is hard. But nothing is impossible if you want to do it.”

Slowly, he’s adjusting to life in Colorado.

“It’s a new environment, a new culture. Sometimes people are helpful, sometimes they are not,” he says. “Of course, it’s better than detention — your life is more free.”

“He’s the most self-motivated person you have ever met,” Giordano says.

“It’s definitely a rocky ride at times but he’s adapting really well. It’s so nice to have him out and actually spend time with him as a friend.”

Iqbal sees Whitney and Ledbury often and has breakfast with Giordano every Friday. They’ve also visited other detainees at the Aurora facility, including a woman from Mexico who was eventually released.

“There’s really only so much that I can say to somebody who’s in detention, but with Shoeb there, he knew exactly Boulder Weekly

Iqbal is adjusting “It was beautiful to life in Denver. to watch them have a conversation, in pretty broken English, but that didn’t get in the way of understanding each other and where each other was coming from.”

“Lots of people really don’t know what’s going on in detention,” Iqbal says, or even that there is a detention center in Aurora. Often, when driving for Lyft on Peoria Street, Iqbal will ask his customers if they know the building is a detention center.

“They often say it’s a factory,” he says.

“No, this is not a factory. You need to go and look. It is a jail,” he tells them.

On the one year anniversary of his release, Iqbal will be eligible to apply for permanent residency, and he’s already working on his application. He talks to his family — his father, sister and brother — back in Bangladesh every day, and hopes to be able to bring them to Colorado soon, despite changing national immigration policies that may make it more difficult.

Still, he generally has a positive demeanor, talking brightly about the future and smiling often throughout our conversation. It’s a far cry from the often despondent detainee we talked to on the phone back in 2016.

“I feel like my life is where I want to be,” he says. “I’m pretty much OK. I’m not really happy, but I’m trying to be. I hope, I feel, someday it will all be worth it.”

Prospecting nearby worlds

T

he past year has been fantastic for commercial spaceflight, with Elon Musk’s SpaceX successfully launching 18 Falcon-9 rockets in 2017. It now seems almost routine to watch the first stage of the Falcon-9 gently land itself back on the launch pad after sending its cargo into orbit. The company expects to reuse even more rockets in 2018, leveling out to a steady slate of 30 to 40 launches per year. Later this spring, one of those rockets will carry NASA’s next mission to find planets around other stars: the Transiting Exoplanet Survey Satellite, or TESS. The method that TESS will use to search for planets was pioneered by scientists at NCAR nearly 20 years ago. The concept is simple: If you stare for long enough at a large number of stars, you might catch one of them blink as a planet passes directly in front of it. Not all of the planetary systems will be aligned so fortuitously, but a few of them will. From basic geometry, the amount of light that goes missing during these mini-eclipses (technically called transits) reveals the size of the planet as a fraction of the size of the star. Keep watching and

you’ll see it come around again, giving the orbital period of the planet, which is related by Newton’s laws to its separation from the star.

NASA’s previous planet-hunting mission, the Kepler space telescope, was built in Boulder at Ball Aerospace.

From 2009 to 2013, it surveyed nearly 200,000 stars in a small patch of the summer sky about as big as your fist at arms length. Kepler measured the brightness of each target star every half-hour for four years. What it discovered was amazing: Planets are so common in our galaxy that almost every star in the sky has at least one.

Most of the planets discovered by Kepler were quite small, and rocky worlds like the Earth are among the most common planets around.

With Kepler showing that planets are sprinkled everywhere, the logical next step is to scan the entire sky and find them around the nearest stars.

This is the job of the TESS mission, which is currently expected to launch in late-March from Cape Canaveral, Florida. It will orbit the Earth on an elongated path that takes it from twice the altitude of most weather satellites out to nearly the distance of the moon.

Over a two-year mission, TESS will use four large cameras to scan the sky in 26 partially overlapping strips. For most of the sky, TESS will linger on each strip for about a month, but for two special regions it will collect up to a full year of brightness measurements.

“In a few years, I hope we’ll have a sample of at least a thousand new planets,” says Zach Berta-Thompson, an astronomy professor at University of Colorado Boulder and collaborator on the TESS mission. BertaThompson came to Boulder in 2016, after finishing a Ph.D. at Harvard University and working for a few years at MIT, where the TESS mission was developed. His technical contribution to the project was to devise a strategy for cleaning the TESS images of artifacts caused by cosmic rays, but his scientific interest is in characterizing the atmospheres of nearby small planets. “The closer a planet is, the more precisely we can measure its properties,” he explains.

If a distant observer watched the Earth pass in front of the Sun, it would block less than one-10,000th of the light for about six hours once a year. An even smaller fraction of the light would pass through the Earth’s atmosphere along the way, imprinting the signature of water and other molecules that might be associated with life. Half a year later, the reflection of sunlight off the Earth would provide additional information, possibly revealBoulder Weekly

ing the presence of green plants. TESS won’t make these measurements directly, but it will find the nearest planetary systems around the brightest stars, where such measurements are feasible.

“By effectively measuring the color of sunset on these planets, we can learn something about the composition of their atmospheres,” says BertaThompson. He notes that the two special regions where TESS will look for a full year coincide with the parts of the sky that will always be visible from the James Webb space telescope ( JWST), NASA’s successor to Hubble.

The JWST will launch in 2019 with instruments that can characterize the atmospheres of nearby planets, so it should be ready to make the measurements as soon as TESS finds the best places to look.

If everything proceeds as expected, the 10th Falcon-9 launch of 2018 will begin the next phase of NASA’s quest to understand whether the Earth is exceptional compared to planets around other stars. There’s no word yet on whether SpaceX intends to launch TESS on a reused rocket, but either way it promises to be spectacular, ushering in a new age of exploration.

enver’s skyline is picturesque, with downtown buildings framed by snowcapped mountains and sunny skies. But a measure that went into effect Jan. 1 requiring rooftop gardens will soon have the city growing more green.

While urban landscaping adds aerial aesthetic to a cityscape, this is an environmental matter championed by a small group of residents to address climate change concerns in the Mile High City.

Denver’s Initiative 300, known locally as the Green Roof Initiative, mandates all new buildings (or additions or remodeling to buildings) over 25,000 square feet to cover 20 to 60 percent of their rooftops with gardens. It passed with 54 percent of the vote in November.

Brandon Rietheimer spearheaded the initiative with five friends in early 2017, wanting to do something for the climate, specifically the problems associated with air quality, temperature and dirty waterways.

“Looking at Denver’s environmental scorecard there are all these problems you wouldn’t think an otherwise environmentally friendly city would have,” he says. “In looking for one all-encompassing thing, green roofs really addressed all those issues.”

According to the National Park Service, green roofs are ecologically beneficial, retaining up to 80 percent of storm-water runoff and lowering roof temperatures. Vegetation also helps lower the urban heat island effect (UHIE), when heavily developed regions absorb heat in buildings’ surfaces, making metro areas significantly warmer than surrounding rural areas.

In a 2014 study, Denver had the third worst UHIE in the country. Downtown is, on average, 5 degrees — and can be as much as 23 degrees — warmer than the rural suburbs.

San Francisco, which enacted a similar policy this year, shared research and study materials with Denver city officials for fine-tuning.

The average green roof installation costs $17 to $23 per square foot, according to Andy Creath, owner of installation company Green Roofs of Colorado.

Upkeep requires about a dozen yearly reviews, costing roughly $1 per square foot for the first year and $.50 the second year.

While the up-front costs are about 2.5 times higher than those of traditional roofs, a recent study done by the Green Infrastructure Foundation found there will be a return investment in approximately six years, and that by 2058 an added 57.5 million square feet of green rooftops will have generated $1.85 billion in savings.

Once green roofs are fully functioning gardens, the shrubbery insulates a building, saving up to 15 percent on energy expenses. Water absorbing plants add longevity to the roofs, meaning green roofs need to be replaced much less frequently than traditional rooftops.

“The problem is [the developers] want to buy a building and sell it in a year or two, so they don’t get the long-term financial benefits,” Creath explains.

“They’re saying, ‘Why would we put in these environmental benefits and other measures that are going to cost us money and not get the payback?’”

Rietheimer also understands the requirements may dissuade development. He is working closely with the City and stakeholders to specify exemptions, which will include schools, residential units under four stories, energy star-rated buildings and developers who qualify that pay a cash-in-lieu fee.

There will be a public hearing Jan. 17 for comments, questions and suggestions about the ordinance and its rules, and the City will vote on amendments in May or June.

Questions remain with Denver’s new Green Roof Initiative by Katie Porter While alleviating climate stressors and beautifying buildings sound ideal, there has been significant resistance to the Green Roof Initiative.

Denver Mayor Michael Hancock spoke out against the mandate. During the campaign process, the Denver Metro Chamber of Commerce, the Downtown Denver Partnership and several real estate and development companies formed an opposition group called Citizens For a Responsible Denver. They raised roughly $250,000 trying to stop the measure from passing, nearly 12 times the $21,000 raised by supporters.

“The fact that we’re grassroots and big corporations were against us, I think that rallied people together,” Rietheimer says. “It was really an opportunity for the people of Denver to vote their values, you know, and say, ‘We’re not going to be outvoted by the developers.’”

Much of the contention was due to the quick implementation timeline, which didn’t allow adequate time to establish costs and protocols, says Michael Gifford, CEO of the Associated General Contractors of Colorado, one of the associations opposed to the Green Roof Initiative.

Artists in Saber Acomodar make it a point to shine a light on the technical skill involved with making these objects, and the immense respect the artist has for the artisan.

In “Una escuela de huaracheros,” Claudia Fernández gathered multiple pairs of huaraches, traditional leather shoes handwoven by craft makers in Guadalajara, and put them in a display case.

Looking at these shoes in this way lets the viewer slow down and appreciate their intrinsic beauty. Fernández puts the huaraches in a new context for the viewer to see them as art.

This practice of reimagining art signals back to a famous disruptive work of the early 20th century by Marcel Duchamp. The 1917 piece, called “Fountain,” was nothing more than a plain porcelain urinal.

“Duchamp didn’t really care about showing the urinal as a cultural object. No one was going to all of a sudden appreciate the artistry that it took to make a urinal,” Larkins says. “They were more just scandalized that it was in an art space. It really was Duchamp saying, ‘I can take anything, and I can call it art because it’s me who gets to decide.’

“But [“Una escuela de huaracheros”] is forcing us to reengage with these objects,” Larkins continues. “In this sense, it’s way more about the object.”

The phrase “saber acomodar” doesn’t translate concisely into English, but its sentiment captures the essence of the exhibit.

“It has a couple different meanings,” Larkins says. “‘Saber acomodar’ means ‘know-how,’ like the idea of technical skill or savvy, which clearly the artisans who made the work have. It also means ‘to know how to place’ or ‘how to arrange,’ which gives it the idea of territorial work. But maybe even more appropriately to the context of this show is that gesture of artists knowing which objects to place in an institutional setting.”

The artists in the show are asking you to take a second look. As Larkins says, “Because artists like Claudia Fernández are putting these carefully made objects in an institutional context, she’s saying, ‘Yeah, as an artist working in 2017, I get to decide what’s art, and I get to tell you what you should look at as art, and I’m telling you to look at these.’”

Colorado’s iconic bluegrass band celebrates 40 years with all-star pickers by John Lehndorff

ong before Hot Rize played its first official notes on Jan. 18, 1978 at Boulder’s Hungry Farmer Restaurant, the band already had a name. Banjoist Pete Wernick found it on bags of Martha White’s Self-Rising Flour, long-time sponsors of the Grand Ole Opry radio show. The flour’s secret ingredient was “Hot Rize.”

Forty years later the Boulder-based band is regarded as one of bluegrass music’s most iconic acts. To celebrate, Hot Rize performs four sold-out shows this week: Thurdsay at eTown Hall and Friday through Sunday at the Boulder Theater.

“It’s going to be a really big sound.

These shows will be like Hot Rize Plus,” enthuses Tim O’Brien. The band’s lead singer noted the new, improved ingredient now touted on Martha White sacks.

Joining Hot Rize are three longtime friends and masters of their respective instruments: Sam Bush (mandolin), Jerry Douglas (resophonic guitar or Dobro) and Stuart Duncan (violin). A veteran crew from eTown will record 20 January 11 , 2018

the proceedings for an upcoming DVD. “It’s like ‘The Last Waltz’ except we’re not breaking up the band,” Wernick says.

The quartet of Wernick, songwriter and multi-instrumentalist Tim O’Brien, bassist and emcee Nick Forster and guitarist Charles Sawtelle were not welcomed warmly at the start by bluegrass fundamentalists.

“We stuck out. We were young people playing traditional music,” O’Brien says. “They said: ‘Your hair is too big.’

‘You’ve got an electric bass.’ ‘You come from Colorado.’”

The members wore suits and wrote most of their own songs. They had a lead guitar player, uncommon for a bluegrass band, and featured a phase shifted banjo that gave songs a futuristic quality. Also a rarity: Hot Rize traveled with a sound man to have Grateful Dead-quality concert sound.

The bluegrass mold was already being broken by The Country Gentlemen, the Seldom Scene, Old and In the Way, New Grass Revival and John Hartford.

“It was a sign that bluegrass was

changing and taking the music to a new place. We were part of that reform movement built on tradition,” O’Brien says.

Hot Rize has never had a star vehicle like Bill Monroe’s many Bluegrass Boys. “It’s one of those rare bands with four equal members. Everybody has an important role to play. It’s Tim’s singing, the harmonies, Nick’s emceeing and Pete’s banjo,” says Bryan Sutton, the band’s guitarist for the past 16 years.

And then there is Red Knuckles and the Trailblazers. The oddly hilarious, alter-ego honkytonk-Western Swing ensemble appears midway through virtually every Hot Rize show.

Some of the finest acoustic musicians of our time dress up and cut loose with the band.

“It’s been Halloween every night and everybody always wants to sit in with the Trailblazers,” O’Brien says.

But the band takes the twang seriously. “When the music being played is high quality the comedy is better. Red Knuckles is a great honkytonk band that could play anywhere,” Sutton says.

The Front Range proved a fertile place to birth the band. “In 1978 we were part of a very vibrant musical community here. However, Hot Rize still resonates.

“It’s not tradition for tradition’s sake. Hot Rize honors the past but isn’t weighed down by it,” Sutton says.

Hot Rize is also aware of its own traditions. Many of the band’s songs have become part of the bluegrass repertoire. More critically, the tunes are sung around campfires every summer.

“I think Hot Rize will be remembered for the material, the songs that a lot of people are still singing and recording, songs like ‘Colleen Malone,’ ‘Nellie Kane’ and ‘Just Like You,’” Wernick says.

“Bluegrass is a treasure to me and it’s important to me that it continue to exist: It’s great to see great younger players choosing to play bluegrass,” he says.

O’Brien is optimistic about the future of the genre. “There’s some new band right now in Boulder that’s practicing and playing and doesn’t know how hard it will be. Bluegrass just keeps regenerating itself,” he says.

Sutton is still wowed by the opportunity. “I never take for granted that I get to be part of songs like ‘Nellie Kane.’ When we kick off with ‘Blue Night’ I remember hearing them play it when I saw them as a kid,” he says.

And Forster is looking ahead: “It is 40 years and I still don’t know how this is all going to turn out.”

Boulder-based Irish duo Adam Agee and Jon Sousa will celebrate the release of their second album with a concert at the Nomad Theater on Saturday, Jan. 13. Their new album, Ceol na gCarad, translates from Irish Gealic to mean “music of friendship.” Adam Agee and Jon Sousa met through the Boulder Irish session music scene in the early aughts.

They played together in various configurations over the following years before deciding to take their passion for Irish music further by moving to Ireland in mid-2008. Moving back to Boulder in 2009, they started to focus more as a duo. They regularly teach and tour nationally and internationally. Tickets are $15–$26.

E

leanor’s childhood was still standing at the corner of Maple and Eighth. It had always been, seemed like it always would be. When she pulled up in her Hertz rental car, the first thing she noticed — the thing that hit her like a brick wall — was the dullness of it all. It was still a nice house on a nice lot, but the paint was chipping away and wet leaves stuck themselves to the walkway. The disrepair, Eleanor supposed, had started when her mother had died, which, come to think of it, was the last time she’d been here.

But now she was back. Her father was gone too and the task of sorting through ninety years of accumulated stuff had fallen to her.

Eleanor got out of the car.

Her childhood memories were all in vivid technicolor—memories of laughing, birthday cakes, Halloween candy, Christmas presents, and summer nights. The dullness continued inside, in the musty rooms and the dirty dishes in the kitchen sink.

Eleanor started in the dining room, yanking out items from the side table drawers, dinner invitations and Christmas cards.

In the top right drawer, the one with the brass handle that always got stuck, were Eleanor’s father’s medals, staring up at her like long-lost faces. When she was little she’d pin them on her sweater and march around. When she was older, she’d ask her father how he’d gotten them. Her mother always silenced both of them with a glare. The look on her father’s face everytime it was brought up told Eleanor that it was about the war. It was the sole point of contention in her childhood. One day, when her mother was out, Eleanor tried again.

“Daddy,” she said, “how’d you get those medals?”

He looked at her in resignation and she knew she’d gotten him this time; that he would tell her. Eleanor’s father sighed. “During the war…” he said. “Someone had to do the dirty work.”

Eleanor looked at the medals, remembered the pain in her father’s face when he told her and, with enough force to ensure the drawer wouldn’t catch, pushed it back in.

Inside marriage with ‘Phantom Thread’ by Michael J. Casey

Y

our wife’s got that gorgeous glow that comes with your first marriage,” a party guest quips to the oblivious husband. Yes, his face says silently, she does. But is that all? Probably not, this is Phantom Thread, after all. It’s the latest film from writer/director Paul Thomas Anderson, and, yes, it’s about love and marriage, but that quote should tip you off: this isn’t your ordinary spin around the old oak tree.

The wife is Alma (Vicky Krieps), a waitress from a remote country village, and the husband is Reynolds Woodcock (Daniel Day-Lewis reportedly in his final performance), an haute couture dressmaker living in post-war London, sometime between Powell & Pressburger’s The Small Back Room and Hitchcock’s Vertigo.

As a designer, Woodcock is ostentatious, designing dresses for royalty and socialites with magnificent flair. As a man, he is reserved and severe, living a life of austere rigor with the only woman he trusts, his sister, Cyril (Lesley Manville).

Into this life bounds Alma, whom Woodcock picks up because her figure is to his liking. Few filmmakers are as American as Paul Thomas Anderson. His two best — The Master and There Will Be Blood — practically scream Americana with every shot, every cut, every needle drop. Phantom Thread doesn’t. It’s a quieter film, one that screams little and ponders more — more about love and romance, partnerships and relationships, and, quite possibly, collaboration. At its core, filmmaking is a collaborative art, one that requires all parties to move and sway to the same beat. Should one disrupt that movement, the whole damn thing comes screeching to a halt.

Nothing and no one gets in Phantom Thread’s way. The performances are stellar, the camerawork magnificent, the mood remarkable and the music — composed by Jonny Greenwood and bolstered with some pieces from Debussy, Fauré and Schubert — is enchanting and almost constant.

Along with the camera, Woodcock moves to the music, music that drowns out all of life’s little annoyances. Alma hears the music too, moving in time with Woodcock’s unheard rhymes. But then, she doesn’t. She stops the music cold and replaces it with a knife scraping the burnt end off her toast, with loud slurps from her cereal and with dramatic pours from a water pitcher. What fun she derives, reminding him how in his world she is.

Yes, Phantom Thread is a romance and a complete one at that. It’s about marriage. It’s about the little things they do that irritate us, how they disrupt our routines and infuriate us, and how we simply cannot live without them. There is a moment in everyone’s “happily ever after” that involves riding hand-in-hand into the sunset. It also involves listening to them chew their toast. Love is both.

lthough the savory pie has been around for a while, it’s mostly been relegated to the chicken pot variety in your local freezer section. But there is a renaissance of sorts occurring in Photos by staff the U.S., as food trucks and bake shops are experimenting with the dish, much to diners’ delight. The folks at Humble Pie offer a variety of savory pies, often introducing new flavors. While their take on the classic chicken pot pie is anything but boring, the mushroom trio pie drew our attention. The presentation is simple: a single sprig of rosemary adorns the pastry dough casing. But the perfectly flaky crust is filled with plump crimini, oyster and shiitake mushrooms in a cheesy cream sauce, to melt-in-your-mouth perfection. Their sweet pie offerings are just as eclectic and scrumptious. $6 a slice.

fter devouring a “meat tornado” — a burrito overstuffed with various meats — for the first time, Parks and Rec’s Ron Swanson leaned back and said, “It’s a whole new meat delivery system.

Thank you, son.”

We felt the same way after eating Lechuga’s smothered “meat cannoli.” Titled, incredibly, “The Elegante,” a spicy sausage is split, wrapped in pizza dough, topped with provolone, baked, then smothered in tomato sauce. It’s then topped, maybe superfluously, with shredded lettuce and mozzarella cheese. It truly is a new meat delivery system: not quite a stromboli, not quite a sandwich. But its appeal isn’t only in its novelty, the sausage is robustly spiced and tender, the red sauce is out of this world, and it’ll fill you up for the day for no money at all. $7.

hadn’t fried anything in years.

I pan sauté ingredients all the time in olive oil, but that’s not the same. It has been drilled into my head over decades that boiling food in oil is dietary kryptonite, banished from the home of any true dieter. (When dining out I admit to being occasionally seduced by the allure of fried falafel, doughnuts and clams.)

Over the holidays, my son and I visited H-Mart to pick up diverse vegetables to make vegetable tempura, something we order at Asian eateries but never attempt at home. I didn’t need to do any research.

Deep-frying is like riding a bicycle. I knew how to do it after countless hours cooking tens of thousands of onion rings in Boulder restaurants.

However, when you haven’t done it, deep frying seems complicated and dangerous. It turned out to be pretty easy and inexpensive.

You buy a box of tempura mix — there are numerous brands — and combine it with water to make a batter. Cut extra-thin slices or strips of vegetables, coat all over in batter and drop into hot oil. Turn after two minutes and fry until it is done, which is determined by tastetesting.

frying We considered grapeseed and peanut oils, but settled on a bottle of corn oil. We poured it in a very deep saucepan about an inch deep, which lessens the pain of splattering fat. You need a Goldilocks oil temperature — not so hot that it smokes and not so cool it doesn’t fry. We guessed by sprinkling water in the gradually

BY JOHN LEHNDORFF heating oil until it sizzled. Experts recommend about 375 degrees on a candy/frying thermometer.

Fried vegetables — with or without batter — aren’t necessarily dietary demons. Proper frying adds a minimal amount of fat and preserves fresh vegetable flavors. You can also fry with good fats like coconut versus the undeniably tasty lard and tallow. Frying done wrong results in flaccid, oil-soaked substances.

You remove items from the oil with a slot-

A novice adventure in making vegetable tempura (and tempura bacon, too) ted spoon and drain on paper towels before eating. We made a dip with soy sauce, toasted sesame oil, vinegar and sriracha. Most of our tempura got eaten standing up in the kitchen.

We used the opportunity to try frying a slew of veggies and almost everything else edible within reach. Some ingredients fared better than others.

Long purple Asian eggplant became exceptionally creamy inside when tempura fried. Eggplant does need to be carefully coated and fried as it is a natural sponge for oil.

Strips of fennel bulb retained their crunch and hint of licorice flavor. Thin pieces of mildly onion-flavored leek — the bottom, not the tough leaves — were perfect. Tempuradipped bok choy leaves had a bright fresh flavor.

Peeled slices of sweet yellow beet needed to sizzle in the oil twice as long to cook inside.

The chips worked better simply fried like potato chips.

For old time’s sake, I fried some yellow onion to make a quasi-onion ring. Yum. Potatoes were best without batter and fried twice: once for about two minutes, set aside, see NIBBLES Page 38

and then fried to crispiness a second time.

Because we had a vat of hot corn oil, the experiment expanded. Tempura hard boiled egg slices tasted exactly like egg croquettes my Mom used to make.

Batter-fried pre-crisped bacon was wonderful, as was tempura salmon.

For dessert there were fritter-like Granny Smith apple slices with fried walnut halves.

In a separate pan, we tried frying tempura banana slices in a little leftover smoky bacon fat. It was a fine combo with bottled Indonesian peanut sauce.

Don’t fry too many pieces of tempura at once. It will cool the oil too much to crisp them deliciously. Also, the oil can be strained and reused if you don’t scorch it. Adequate ventilation will prevent your smoke alarm from wailing.

The ultimate wisdom I drew from this family exercise is that deep-frying is damn delicious, very messy and I’d do it again, especially for a gathering.

The uncommon tale of Cellar West’s Zach Nichols’ uncommon beers by Matt Cortina

Z

ach Nichols lives on the edge. He dumped his shares in a successful and popular microbrewery and used the money to open a funky, little one of his own. And the barrel-fermented, yeasty and weird wild ales he creates at Cellar West Artisan Ales in North Boulder exist on the periphery as much as his business decisions.

But it’s life on the edge that has yielded stellar results for Nichols and Cellar West as it starts its second year in business: A Great American Beer Festival silver medal, accolades from national beer magazines, and a growing legion of patrons eager to consume the brewery’s premium, esteemed and niche beer.

“I’m not bashful about the fact that we’ve sort of picked an avenue to explore pretty specifically,” Nichols says. “To be perfectly frank, it’s not a beer that is super hot right now. Saison, as sexy as I think that style is, it’s not super cool to the average consumer right now. However, there are enough people who find it to be really enjoyable that we do have a market for it.”

Producing only about 100 barrels last year, the stakes are high for Nichols while brewing, and he laboriously tends to each barrel during the production process. The very nature of brewing wild ale (Nichols says he produces Saison-style farmhouse ales that aren’t quite sour, but are funky, and are certainly within the “wild ale” style) means things can go wrong seemingly without explanation. Brettanomyces yeast), and three can turn out fine, while the fourth tastes like vinegar “or wet dog.”

“It sucks to have six-grand in the bank account and you’re dumping $5,000 worth of beer,” Nichols says.

And the beer kind of has to be good, Nichols says, because that’s what he’s invested all his time and

money into.

“I tell people, ‘We’re literally behind a strip club and a homeless shelter, and because of that, we’re forced to make really quality beer. It’s not a fancy taproom, people come here for the beer and the conversation,” he says.

The launch of Cellar West was entirely bootstrapped, and Nichols and his wife own 100 percent of the business. It’s the product of several bold choices Nichols made, which have brought him from drinking Keystone Light on Friday nights to producing artisan, renowned ales on Monday mornings.

Nichols stocked shelves at a liquor store in downtown Madison, Wisconsin, during college, occasionally getting a chance to taste new styles from dented, returned and incomplete six-packs. It sparked curiosity, and Nichols began home-brewing, and soon upgraded his employment to a job at a brewpub outside Madison. His wife, a student at CU at the time, encouraged him to come to Boulder, and he did.

Soon, he joined some friends at Boulder Beer who were talking about opening their own brewery. That idea turned into Sanitas Brewing, and Nichols worked in the brewhouse and used a background in graphic design to label cans and create the brewery’s iconic owl emblem.

Soon, though, Nichols felt he was spending less time brewing and more time marketing. He’d learned a lot about brewing at Sanitas and had started to experiment with Brettanomyces and funkier styles at Boulder Weekly

Changing times

W

ith the New Year comes my anniversary with Weed Between the Lines. When I first started writing the column two years ago, I approached marijuana professionally, to write an op-ed that also covered the bizarre time in-between federal prohibition and state legalization.

Exploring along these lines, it didn’t take long before my curiosity became more expansive and personal. I realized I needn’t look far for a big story and that the most momentous changes were happening on the most subtle and personal levels. It was as if legalization had spurred collective introspection, and my greatest opportunity was to cover the confrontation between what we thought we knew and what we had yet to learn.

What we thought we knew was imposed on us by a federal government that told us that drugs were bad, not just physically, but morally. They told us drug users belonged in jail, that pushers should be locked up for life and that traffickers, especially in other countries, deserved to die. And so the country waged its war on drugs, no matter the cost, so long as it eradicated the evils of pot.

And then suddenly, in 2012, there were finally enough people who collectively called bullshit on that narrative to legalize recreational marijuana use in two states. Now, with historical perspective, we can look back to those early days of recreational legalization in the Wild West and remark on the

courage it took for citizens and states to legalize, despite the propaganda and without knowing what the federal response would be.

It was a fragile moment. It still is. A rare instance of state rebellion against national and international law, and one that was, surprisingly, tolerated by the U.S. government, evidenced by the issuance of the “Cole Memo” in 2012. Which is not to over-glorify “tolerance,” a mere recognition of a difference in practice, nothing more and nothing less. Perhaps naively, I hoped for something more resolute.

I remember watching, with no small degree of shame, as a representative for the U.S. stood at the podium at the U.N. Special Session on Drug Policy in New York in 2016 and said, well, nothing, insisting that federal prohibition remain while recognizing that its own states were breaking that very notion. It was an admission not just of hypocrisy, but of cowardice.

When Nixon declared the war on drugs in 1971 it came with international repercussions, legitimizing U.S. military aid and intervention across the world.

Marketed as a war, not only did criminalized prohibition endorse violence, but it gave permission to authoritarian regimes to kill and behead drug users, which continues even to this day.

Simultaneously, prohibition prevented countries like Jamaica from allowing its citizens to use marijuana for religious purposes, halted meaningful medical and scientific research in countries like Israel and threatened severe sanctions against any nation, like Mexico, that considered legalization or decrimi-

nalization as an alternative policy.

This past Thursday, Jan. 4, the nation was sent into confusion, shock and even uproar when Attorney General Jeff Sessions, long a vocal opponent of the legalization of marijuana, rescinded the Obama-era Cole Memo.

Sessions explained the revocation in a statement saying, “It is the mission of the Department of Justice to enforce the laws of the United States, and the previous issuance of guidance (the Cole Memo) undermines the rule of law.”

Yes, removing the Cole Memo casts some serious confusion over the already confusing landscape of legal marijuana. But, in some ways, rescinding the Memo is, at least, honest in that it recognizes what’s actually on the books. Nice as it was to have the reassurance of the Department of Justice to stay out of the way, it was only a promise, which is to say it was not meaningful change.

There is the adage that a crisis is also an opportunity and in this case, it’s a multifaceted one. The recension of the Cole Memo is a chance to demand meaningful change in U.S. law; to hold our nation accountable to damaging fallacies; to insist, as a citizenry, that our government recognize and uphold our votes, the bedrock of our democracy; as individuals, to enact the freedom to define morality for ourselves, and as individuals, to be courageous enough to think independently and be openly honest about our conclusions, even as they shift and evolve.

After two years of writing this column I admit that cannabis has changed me, not just politically but personally. The plant has helped me see the world in a new way and has allowed me to confront deeply held prejudices so as to overcome them. With this, my last column for Weed Between the Lines, I leave with a deep sense of appreciation for what cannabis has taught me, that our greatest power as a human species lies in our individual capacity for humility and empathy. There is strength in yielding to the motion in a fall.

Matt Gaetz, described by the website Drug War Chronicle as “a leading Trump ally,” called Sessions’ decision “heartless and cold.”

House Minority Leader Nancy Pelosi also chimed in: “Attorney General Jeff Sessions’ decision bulldozes over the will of the American people and insults the democratic process under which majorities of voters in California and in states across the nation supported decriminalization at the ballot box,” she said.

“Yet again, Republicans expose their utter hypocrisy in paying lip service to states’ rights while trampling over laws they personally dislike.”

Boulder Democratic Representative and gubernatorial candidate Jared Polis, a founding member of the Congressional Cannabis Caucus, said, “The Trump Administration needs to back off and allow marijuana to be treated like alcohol under the law... ” The Politico website/magazine published a long piece speculating on whether Sessions’ decision improved the odds of Congress acting to legalize marijuana.

Et cetera.

What should we make of all this?

First, all the righteous rhetoric is just that — rhetoric — unless Congress chooses to act. There are bills already introduced in Congress to remove marijuana from the Controlled Substances Act and treat it like alcohol or, failing that, to exempt it from federal prohibitions in states that have legalized it. Gardner, Murkowski, Pelosi, et al. should get behind them or introduce their own.

Second, if there was any lingering doubt that Democrats would make marijuana an issue in the 2018 election, Sessions has ended it.

The Democrats’ biggest challenge in 2018 will be turning out Democratleaning lazy voters, the two largest groups of which are the young (ages 18-30) and blacks. Both groups are overwhelmingly in favor of legalizing marijuana (more than 70 percent in some polls). They are also the groups most likely to be targeted in a renewed drug war. Sessions just gave them a reason to vote.

The more interesting question is what Trump will do with this issue.

Maybe this: Trump has his first State of the Union speech coming up.

It would be a fine forum in which to ask Congress to pass some sort of legislation giving the states final say on marijuana legalization, which he said he favored during the campaign.

Trump has been pretty assiduous about keeping his campaign promises.

Keeping his pot promise might also help pull his job approval rating out of the toilet — and help keep the Republican Party from going over a cliff in 2018.
