Editor’s Letter This month our cover image of bluebell woods comes from the beautiful gardens at Wakehurst Place, seeing these stunning carpets of bluebells on a spring walk is always a welcome sight after the winter months. We’re lucky to have several wonderful bluebell woods and copices around the area, you’ll find them at Tottington Woods, through the woodland at Henfield Common and some wonderful displays in Spithandle Lane, Ashurst. We are very lucky to live in Henfield for many reasons, especially in times of crisis. Local individuals and organisations are always amongst the first to respond when needed and the everdeveloping refugee crisis from the war in Ukraine has triggered a prompt and generous response from Henfield people. As we go to print, we are pleased to report that consignments of aid have left from the Corpus Christi Church and from Stokes Newsagents, while St Peter’s Church congregation has pledged to help through the Sanctuary scheme. Please see our news pages follow our Facebook page for the latest updates on how you can help.

Humanitarian aid for Ukraine
The incredible fundraising, donating and shows of support for the people of Ukraine that have been taking place on a local, national and international scale are wonderful to see. Here in the village Fiona and Rob from Stokes of Henfield collected donations of bedding, tinned food and hygiene products which they then shipped out to Poland in a lorry. Volunteers from the Corpus Christi Catholic Church have been packaging up donations of bedding, baby supplies, tinned food and hygiene products for the charity Hope and Aid Direct (www.hopeandaiddirect.org.uk/donateaid) which will also be taken out to where it’s needed most. It’s possible that another shipment may be sent soon, please contact Celia Emmott celiaexplorer@btinternet.com if you would like to donate. As we go to print, St Peters Church has signed up with Sanctuary Foundation to provide support for a Ukrainian refugee family with practical, financial and moral support, more information including practical requests will come in a future edition, when a family who needs help has been identified and homed (see https://sanctuaryfoundation.org.uk). Individually we can all help families who are fleeing this tragic conflict by donating whatever we can afford to humanitarian charities such as the Disasters Emergency Committee (www.dec.org. uk) and the British Red Cross (www.redcross.org. uk) who provide food, water, shelter and medical assistance to the millions who are fleeing the conflict.

Food Bank Street Collection & Mobile ‘Hub on the Move’
Horsham Matters will be holding a street collection on Saturday 23 April to raise money for Horsham Foodbank which will enable them to continue to support those in need in the Henfield area. Although life seems very much back to normal after the final lifting of covid restrictions, the reality is that in the Henfield area between December 2021 and January 2022, 14 adults and 4 children received emergency food support from Horsham Foodbank. The statistics across the whole of the district area in February already show a marked increase on late last year with many people already struggling with cost of living increases even before the rise in energy prices is levied. They are looking for BN5 residents who could volunteer to help on the day by holding a collection tin for an hour. If you are interested in this please call 0300 124 0204, option 3, or email fundraising@horsham-matters.org.uk Horsham Matters runs foodbank services throughout the Horsham District area including a parcel delivery provision run via BN5 magazine in Henfield and a session provided by the Horsham Matters mobile Foodbank vehicle, which stops every Friday between 11.45am-12.45pm in the Henfield Library car park. To use the mobile foodbank ring or email Horsham Matters on 0300 1240204 / info@horsham-matters.org.uk .The Hub carries a mini version of a supermarket so clients can choose items of food with a ‘shopping list’ as a rough guide.

Jenny’s friends and family Leap for Leukaemia
In May, a group of Henfield friends and family are planning to ‘Leap for Leukaemia’ down Peacehaven Cliffs in an abseil event in aid of Blood Cancer UK, coordinated and inspired by the amazing Jenny Davies from Henfield. Blood Cancer UK is a charity that funds research and supports people who are affected by leukaemia. It is dedicated to beating this awful disease, which is diagnosed in the UK every 20 minutes. Jenny, her family and friends are so grateful for the support given to them by this incredible charity that they decided to raise money to help towards finding a cure. Around 50 friends and family will be attending and participating in the Leap for Leukaemia, with the younger members of the team going down the ‘fast line’ and the more apprehensive taking a slower route, most probably looking up rather than down! All of them will be driven on by the enormous courage and positivity shown by Jenny. If you would like to make a donation to support their challenge please follow the link https://www. justgiving.com/fundraising/jennifer-davies40 Jenny would love to encourage you all to do one simple thing; register on one of the UK stem cell registers to give someone the chance of a cure. Only 30% of patients are able to find a compatible donor in their family so the register is vital in giving people the chance of life. There are two registers in the UK – DKMS UK (www.dkms.org. uk) which has a registration age of 17 – 55 and Anthony Nolan (www.anthonynolan.org) which has a registration age of 16 – 30. It is a very simple process, costs nothing and if you are found to be a lifesaving match, donating stem cells is as easy and painless as giving blood. We wish ‘Team Jenny’ the best of luck in May when they take their very bold steps for this brilliant charity.

The Friends of Henfield Museum AGM
Long resident in Henfield or new to the village? Join us for an illustrated talk on ‘Henfield’s Victorian High Street’ by Curator Alan Barwick and admire a display by Costume Curator Stephanie Richards, also focused on the Victorian era on Wednesday 13 April at 7pm in the Garden Room of the Henfield Hall. Hear of the local shops, industries and personalities now out of memory, from tailors, to brewers, to wheelwrights, to gunsmiths, to butchers, bakers and horse saddle makers! We’ll also be previewing the upcoming book ‘A History of Henfield High Street: From the 1800s to the Present-Day’. Through it, take a journey from those times past right up to those of our present-day High Street - names from more recent decades will ring a bell for many. We’ll be covering the AGM business and giving an update on the museum and projects from 7pm, followed by a break for wine and nibbles around 7:30pm, with time to view the costume display then and at the end of the night. The main talk is 8-9pm. Entry is free for Friends members. Standalone entry is £5, or you can join up as a member prior or on the night (£10 individual, £15 family membership). If attending just the main talk, you are welcome to arrive after the AGM itself. Hope to see you there!

A greener High Street
You may have noticed local craftspeople and traders working in the village recently to increase planting and refurbish some of our street furniture. This is part of a project funded by Horsham District Council with ‘Welcome Back’ funding which Henfield Community Partnership has been working on with several other local organisations. The WI Coronation Bench in Bishops Close has gone Platinum for the Queen’s Jubilee. There will be works in Coopers Way and in front of SETyres too. We hope to make Henfield’s centre more attractive for residents, shoppers and pollinating insects! More flowers with ‘year-round interest’ will mean more bees, and that should encourage other nature in turn. We are planning a special event on the morning of Bank Holiday Monday 2 May to celebrate. More details to follow!

Faith, whose biggest number 1 hit was ‘What do you want’ in 1959, lived with his wife Jackie at Whaphams (by what is now the Shell station) from 1971-74. Royal Jubilees Remembered Costume and Commemoration
The new costume display in Henfield Museum is open now. As a tribute to the Platinum Jubilee of Queen Elizabeth II, we present a case full of royal memories. Keepsakes of Queen Victoria’s Diamond Jubilee in 1897 surround a beautifully dressed Victorian lady, while items celebrating the 1935 Silver Jubilee of George V are shown next to a black lace dress, purple gauntlets, purple stockings and a pair of silver shoes. For our own Queen there are glimpses of milestones in her long reign; the Coronation in 1953 and the 1977, 2002 and 2012 jubilees. Featured photographs from these festivities show how Henfield celebrated. Items from the costume collection ranging from the 1950s to the 2020s show what we wore then. Come and see the Platinum tribute and explore the rest of the museum.

Henfield Platinum Jubilee celebrations
History of Horton Golf Club
For 30 years golf has been played at Horton Golf Club, a pretty 9-hole course at the back of Henfield Business Park. In celebration of this, a history of the club has been written, celebrating its special status as an ‘artisan club’, that is a club run and maintained entirely by its members, meaning it is able to keep golf affordable for most people who wish to play. Many people in the local area have either been members in the past or have associations with the club and may be interested in having a copy of the history. The club is asking for donations of a minimum of £2 a copy to cover printing costs. Any profit will be split between the club and charity. Bank House Clinic is a complementary health care clinic in the centre of Henfield High Street.
We are situated in a newly refurbished clinical suite just behind the recently opened Sussex Fine Food premises, which is right next door to Budgens supermarket and close to the two Henfield car parks. We offer osteopathy, acupuncture and massage therapy and we’re pleased to introduce our three qualified practitioners: Andre Stout, Caroline Rowley and Caroline Crowther. Andre Stout is our experienced osteopath, he qualified at the prestigious British School of Osteopathy 20 years ago. After qualification, Andre practiced in Australia while undertaking a master’s degree in Sydney. This led to Andre’s specialization of using Cranial Osteopathy to support his conventional osteopathic techniques. Osteopathy treats all areas of musculoskeletal pain with direct joint and muscular techniques. With cranial techniques a gentler approach is possible, often with remarkable results. Andre also has extensive experience treating specific conditions such as Chronic Fatigue, ME and Long Covid. He is currently undertaking a podiatry course to be able to offer foot orthotics to customers. He enjoys bringing together a holistic view of a problem and unravelling how issues came about, and then formulating a plan to get back on the path to well-being. Andre lives in Henfield with his wife Alison who runs the very successful relish café, which has been a lifeline to so many people during the recent lockdowns. They are both immersed in community life and you’ll often see Andre delivering meals for relish customers who are housebound, or you may even spot him being pulled around the village by Rosie their beautiful basset hound! Joining the team at Bank House Clinic is Caroline Rowley, who works as our massage therapist and reflexologist. She provides deep tissue massage, Swedish massage and hot stone massage and is currently completing her Level Four qualification in Sports Massage. With such a broad range of techniques, Caroline specializes in combining her approaches to best fit her clients’ needs. Caroline enjoys meeting new people and helping them to feel better both physically and often mentally too, as pain can be very debilitating.
Caroline helped to organise the Henfield Wellbeing Day recently, a showcase of the wealth of local therapists and other businesses in the wellness industry. This was a great success and really showed what a range of resources we have in our village, it also raised money for Henfield’s dementia care centre, the Henfield Haven. Finally, we’d like to introduce our other Caroline! Caroline Crowther is our acupuncturist at the clinic. In addition to acupuncture, she may use moxibustion, cupping, gua sha and massage in the treatment of her patients. Acupuncture, often combined with these other treatment modalities, is commonly used to treat many disorders, including: pain, mood disorders and mental health including stress, anxiety and depression; migraine/headaches, skin and digestive disorders, auto-immune conditions, women’s health, hormonal and neurological disorders, allergies, overactive bladder and more. Caroline qualified as a massage therapist in 1999 and moved to Sussex in 2003. In March 2019 she graduated with a BSc Hons from Greenwich University, studying for 3 years at the International College of Oriental Medicine. She is a member of the British Acupuncture Council and is taking further training as a Foot Health Practitioner, so watch this space for future services on offer. All three practitioners at Bank House Clinic live and work in Henfield and are dedicated to your health and wellbeing. Please pop in for a chat and find out how they can help you!

DEADLINE SOON
T
– have your say on proposed Parliamentary constituency boundaries before 4 April 2022
he Boundary Commission for England (BCE) is an independent and impartial non-departmental public body, which is responsible for reviewing Parliamentary constituency boundaries in England. It is currently conducting a consultation on proposed changes to new Parliamentary constituency boundaries which will affect Henfield and surrounding villages. The proposed new Parliamentary constituency for the village of Henfield is Shoreham. To view this on an interactive map go to www.bcereviews. org.uk and enter your postcode. You will be able to view comments submitted by others by either clicking on the map pins for the areas you are interested in, or clicking on the ‘View Comments’ button to browse, filter and search all responses in table form. You are encouraged to submit your own views on the proposals of BCE and the responses of others through the website using the ‘Make a Comment’ button during a statutory consultation period. Click on the ‘How to’ link at the top of the page for help on how to use this interactive site. You can alternatively view the proposal report for the region, and pdf maps, via the link under the ‘Useful links’ heading below the map.
01273 494002
This secondary consultation runs until 4 April 2022 inclusive and BCE cannot accept or take account of any comment or views received after this statutory consultation period. For information on the process see www.bcereviews.org.uk . What else do you need to know? • Under proposals, the number of constituencies in the South East increases from 84 to 91 (including two that must be given to the Isle of Wight) • By law, every constituency they propose - except the two for the Isle of Wight must contain between 69,724 and 77,062 Parliamentary electors (as at 2 March 2020) • As far as possible, they try to have regard to local ties, geographic factors, local government boundaries (as they were known at 1 December 2020), existing constituencies, and minimising disruption caused by proposed changes • BCE uses local government wards as the building blocks for proposed constituencies, but will consider splitting a ward where there is a strong case for doing so that helps better respect the factors above

Henfield Weekly Market
I
independent businesses and charities
f you go down to the Henfield Hall on a Monday morning, you’ll discover items that are not only useful, but recycled, upcycled, delicious, colourful, antique and even hand-crafted! You’ll get to meet the makers, the crafters, the upcyclers and the growers and bakers, the menders and the enthusiasts; and what’s more you’ll probably leave with a bag of great value, high quality items. The Henfield Hall is absolutely buzzing with the friendly chatter and laughter of stallholders and customers when I visit on a March Monday morning, some regular faces who always pop in for a browse and a cuppa and some homemade cake or a bacon buttie from the café. Others are new visitors, delighted to see such a vibrant and colourful mix of useful and unique stalls selling their goods. The Henfield Weekly Market is a bit of a ‘Henfield institution’ (previously known as the Monday Market). After Covid hit, the market was under threat of closure; dwindling numbers and the retirement of some stallholders meant it really was ready for some changes if it was to not only stay alive but to flourish. So, three stallholders, Carmel Guerin, Viv Whitton and Angela Manuel, with the support of other Market regulars, decided to take on the organisation and breathe some new life into the event. The work they’ve done has been amazing. Firstly, they made the market ‘not for profit’ – keeping the stall rental costs low with a team of volunteers making sure the organisation was good. The wonderfully bright and clean, newly refurbished Hall was a big attraction itself, bringing new and interesting stallholders. With low-cost parking the Market is also attracting a lot of visitors from outside the area. 28 | BN5 Magazine
The success of the project has not only given the Hall a new lease of life, but it’s contributed to our village with several large donations to local charities. The organisers have stuck to their ‘not for profit’ ethos and have already donated over £2,000, as well as giving subsidised or free stall spaces to local charities to allow them to sell their goods – in fact 25% of the stalls are charity. Visitors have commented that they enjoy coming for a chat, meeting friends, picking up a bargain or something made with love from a local independent business and knowing that in many cases they’re ‘giving back a little’. It’s win-win, and a huge asset for Henfield. Here’s a selection of the stalls you’ll find on a visit, but please remember this isn’t all of them, we just didn’t have room!

ON YOUR
BIKE! N
estled between the Downslink and the South Downs Way, Henfield is in the perfect position to enjoy a wide range of off road and traffic free bike rides. And, if you fancy some tarmac, not only is the pancake flat seafront less than 10km away but we also have a fantastic network of relatively quiet back roads and country lanes to explore. I’ve been cycling round these parts since 2010 as a competitive cyclist, a recreational enthusiast and more recently as a Dad. I want to encourage more people to get out on their bikes safely, and enjoy the benefits of fresh air, fitness and exploring the local world on two wheels! Before you ride there are a couple of key things to consider to make sure you and your bike are safe. Firstly, perform a few basic checks on your bike to make sure its road worthy: 1. Test your brakes – stand next to you bike and pull both brake levers. Do they move smoothly and firmly? If you rock the bike back and forth do the wheels stay stationary? If the answer to either of these is ‘no’ then you should get the brakes seen to by a professional before you go out. You can also check if the brakes are rubbing by giving the wheels a spin and listening for any rubbing or grinding noise. 2. Inflate your tyres – the recommended pressure is normally written on the side of your tyres. Pump them up to somewhere in the middle of this range and check to see if they stay inflated or if there’s any obvious air escaping. Also check the tyres for any splits or gashes, just like you would with a car before a long journey. Fixing a puncture is pretty straightforward, but it’s always easier to sort at home before you head out. 3. Helmet – do you have a helmet that fits? If not then get one before you ride. Some people argue that not wearing a helmet makes drivers give you more space and consideration. However, from personal experience, I can
01273 494002
tell you that when freak accidents happen, a helmet really is the difference between life and death. 4. Test ride the bike – if the brakes work, your skull is protected and your wheels are inflated then give the bike a short gentle ride. Check the gears change quickly and smoothly, listen out for anything rubbing, clicking, knocking or grinding (bikes can make all kinds of noises!) and if anything is loose then stop and tighten up any bolts. If you’re not sure, contact a professional and they will make sure it’s 100% safe for you. Once your bike is safe you can start thinking about where to ride. The Downslink is my favourite choice locally as it’s traffic free, easy to navigate and if you head South from Henfield you can be by the seaside within an hour or two. If you’re feeling more adventurous then head to the South Downs Way; you can always drive your bike to Devil’s Dyke or Ditchling Beacon if you don’t fancy the cycle uphill! But be warned, the Downs are a proper test of fitness and can cause quite a few punctures in the summer with all the small pieces of flint. If you have a road bike then there are hundreds of local lanes to explore. My favourite route is to head East towards Ditchling and explore the quiet lanes around Chailey and Lewes. It’s always a good idea to take a few basic bits of kit on a ride with you to save you getting stuck and calling a taxi (or in my case my wife!) to come get you. I always take spare inner tubes, tyre levers, a small pump and a basic multitool with a range of different size Allen keys on it. I also take a drink, a nice sugary snack (cycling burns a lot of calories!) and normally my drivers licence, debit card and phone in my back pocket in case of an accident or emergency. With the rise of e-bikes cycling is becoming accessible to more and more people and living in our little corner of rural England and it’s a great way to get out and improve your fitness and mental wellbeing. The recent changes to the Highway Code have caused some (heated!) discussion around cyclists on the road but common sense, decency and politeness should always prevail when using roads and bridleways. Just as car drivers should be aware of the vulnerability of cyclists, so should cyclists be aware of the vulnerability of horse riders and walkers. We all want to enjoy the countryside and we should all be able to do so safely. So why not get that old bike out from the garage and dust it off ready or a ride? Or treat yourself to an e-bike (they really are amazing) and explore places you thought were reserved for young fit types! Spring marks the start of longer days, better weather and happy times out on your bike.

CONNECTING YOUNG PEOPLE AT HENFIELD YOUTH CLUB
H
enfield Youth Club is celebrating the power of connectivity this week, thanks to a grant awarded by Focus Foundation. The charitable foundation equipped the youth group with four new computers and provided funding to cover the cost of essential software upgrades to existing equipment. The grant has been awarded with the vision it will provide the young people who attend Henfield Youth Club with the technology, equipment and skills they need to feel empowered to reach their full potential. It will allow the children who attend the youth club to use the computers for CV writing, job searches and applications together with providing an essential tool for career research and communication. In order to optimise the power of the new technology, one of the IT experts from Focus Group volunteered to deliver IT training to young people at the club. The training covered the knowledge and skills needed to maximise the benefits of the new equipment and how to maintain the technology. Focus Foundation is a fundraising and grantgiving charity, and the philanthropic arm of Focus Group - a leading UK provider of essential business technology. With its vision to connect customers, people, and communities at the heart of what they do, Focus Foundation was
established in 2021 to support UK-based charities and social enterprises. Its principal ambition is to make a positive and lasting change to people’s lives. Elaine Goodman, trustee at Focus Foundation said: “I’m delighted we’ve been able to support Henfield Youth Club. It’s been a challenging couple of years for young people, with ongoing disruption to education, training and personal development experiences. So now - more than ever - they need the tools, motivation and support to build the confidence they need to move into further education, training opportunities and career pathways.” Henfield Youth Club manager Debbie Slaughter, added: “We are really grateful to Focus Foundation for their support in this project. It has given our members a fantastic understanding of how computers are put together, which is a brilliant educational experience. We have been able to upgrade our very outdated systems, giving the young people the opportunity to use them for homework, research and not to mention fun playing their games! Mark has been brilliant with our young people, patient and informative. They have loved it!”
Elaine Goodman
Henfield Youth Club is a haven for local young people - a place to go for advice, fun and to get
away. It welcomes young people up to the age of 18 from Henfield and villages in the surrounding area. New members are always welcome. www.henfieldbn5.co.uk/clubs-and-groups/henfield-youth-club/ 01273 494002

The latest news about Southdown Enterprise Park
I
f you travel on the A2037 towards Small Dole you will have seen the recent groundworks taking place just opposite the Henfield Business Park. It’s the construction site for Southdown Enterprise Park – a new initiative from Sean Preston and the team at Southdown Engineers Ltd, a local company established back in 1972. We asked Sean for an update on progress and what his plans are for the future of the site. Please give us a brief outline of your plans for the new Southdown Enterprise Park. Basically, it’s in two parts. A new HQ for Southdown Engineers including 10,000 sq/ft of workshops and offices, plus a further 10,000 sq/ ft of new space for other businesses to utilise. The whole site will benefit from direct fibre optic internet access and a planting and landscaping scheme to give efficient use of space and habitat enhancement. Our night-time lighting scheme complies with the Southdown National Park ‘Dark Skies’ policy. We’re investing in a range of improvements to the 200m section of the ‘Shoreham Road’ outside including a new access, right turn lane, crossing point complete with crossing island, tactile paved drop kerbs and upgraded bus stops on both sides of the road. When is the estimated completion date? We plan to be operational late 2022, or early 2023. Will the development increase employment opportunities in the village? At Southdown Engineers we will continue to employ 20+ local people as we move out of our current rented premises in Albourne. It’s entirely possible at least the same amount will find work in the additional new business space. Can you see the project helping our local economy? Enormously so. For instance, the average commute for our current workforce is just 6.9 miles, pulling in and developing skilled people

from Steyning, Cowfold, Partridge Green and Horsham as well as a good smattering of Henfieldians. Conversely, our work takes us right across the UK, demonstrated by our involvement with COP26 in Glasgow, coastal defence projects right round the shores of Britain with our local friends at Mackleys and regular trips to London and the surrounding area. All of this brings revenue into the area from outside, to be spent by local people with local businesses. It’s worth noting that the tireless, unpaid (and in my view very much underappreciated) work of the likes of Ray Osgood and the Neighbourhood Planning committee went to some lengths to ensure a good mix of development in that plan. It would have been all too easy in a place like Henfield to overlook the need for real jobs and infrastructure and risk turning it into just another commuter dormitory town. Are you using local groundworks/contractors/ builders for the project? Aside from a couple of instances where very specialist legal processes were required, all our consultants, ecologists, surveyors, planners and geologists etc were drawn from a 15-mile radius. Indeed, the current site foreman is an ex-Vinalls man... and you don’t get much more Henfield than that! So, without needing to unjustifiably favour supply chain decisions on purely geographical grounds, we’ve been able to work with local providers based on their reputation and skills. Will there be much disruption to the traffic on the A2037 outside the site, if so, for how long? The highways improvements including new sections of footpath and bus stops are scheduled for around 8-10 weeks (mid-end April). After that the action moves inside and the disruption will cease.

Research & Development
HMRC has announced changes to the Research & Development (R&D) tax relief scheme that will take effect from April 2023. This will have repercussions across multiple sectors. The government will publish the draft legislation in summer 2022 and is inviting views from stakeholders on the detailed implementation of these measures.
undertake R&D. They would be given a code allowing them to make a claim in their end-ofyear tax return.
Essentially, the British taxpayer has been funding overseas employment and skills. While the intellectual property and some revenue from this overseas R&D may trickle back to UK businesses, the overseas R&D activities themselves will not count towards the UK’s ambitious target of R&D making up 2.4% of GDP.
Changes will be made ‘in the spirit of the existing legislation’, where relief is not available for general overheads associated with cloud computing, such as the rental costs of server hosting and data storage. The services of cloud storage will need to be itemised to ensure compliance.
1. Restriction on claiming for overseas R&D activities - R&D tax relief costs the exchequer more than £7 billion a year. As such, the government is keen to ensure that the benefit of this expenditure is felt here in the UK. Currently, businesses can claim for R&D tax relief for subcontractors or externally provided workers undertaking qualifying R&D abroad. HMRC proposes that such claims will not be possible in the future.
The exact mechanism for how this will work is still under examination. HMRC wants to understand where the proposed changes would unfairly stop businesses claiming for R&D that can only be undertaken overseas. A recent example is developing the AstraZeneca vaccine, where some clinical trials needed to be done in Brazil.
We are concerned that this will unfairly penalise some businesses who have not planned their R&D in advance, and we will express this to HMRC.
3. Cloud computing and data costs to qualify for relief for both SME and R&D Expenditure Credit (RDEC) schemes - Licence payments for datasets and cloud computing costs that can be attributed to computation, data processing and software will be eligible for tax relief. However, successfully attributing datasets solely to R&D will be a time-consuming and complex process. For example, datasets that can be resold or have a lasting value to the business beyond the duration of the project will not be eligible.
HMRC wants to understand how this distinction could operate in practice. There might be other costs billed in a cloud computing package that should be excluded in line with the wider principles of the reliefs.
4. Addressing unforeseen anomalies in the schemes - HMRC wants to rectify circumstances that have previously penalised some businesses. 2. Preventing abuse of the R&D scheme HMRC will allow companies to make an RDEC There has been a growing number of claimants claim, where an enquiry reveals that legitimate attempting to abuse the R&D tax scheme. HMRC R&D expenditure was claimed under the SME is now seeking to stamp it out. All claims will be scheme. This is to prevent unfairly penalising made digitally through HMRC’s COTAX portal, companies that have undertaken legitimate R&D possibly meaning a form of iXBRL being done to but, following an HMRC assessment, have been reports. Each claim will be endorsed by a senior found to have claimed under the wrong scheme. person at the company. This will likely involve a All companies in a group will enjoy a ‘period of director or a senior executive being involved in grace’ when they become a ‘large company’ the R&D claim process. for R&D purposes. At present, a quirk in the Companies will have to notify HMRC in advance rules means that when one company in a group that they wish to make a claim. HMRC suggested exceeds the thresholds to be considered a SME, that one possible mechanism would be to require it gets a one-year grace period before it needs a company to notify HMRC before the beginning to start claiming under the less generous RDEC of an accounting period of their intention to 60 | BN5 Magazine

scheme. However, all the other companies in the group are required to claim under the RDEC scheme immediately. The change will address this inherent unfairness.
The rules that prevent claims by companies which are not ‘going concerns’ will be amended to focus on unviable businesses. At present, where a business does not have ‘goingconcern’ status, it cannot make a claim. This is problematic when legitimate claims cannot be made due to the accounting standard not being met through, say, transfer of a trade.
Expenditure within two years of the end of the accounting period will qualify. While HMRC has always taken a fair approach to this, the existing rules mean that where expenditure has been accrued or paid in arrears and the payment has not been made during the period being claimed, it does not qualify.
Next steps - We continue our dialogue with the government ahead of the publication of the draft legislation in the summer 2022. Watch this space! Paul Samrah, Partner Moore Kingston Smith LLP T: 01737 781546 E: psamrah@mks.co.uk
