We’re knee deep in Big BN5 Christmas Draw tickets in the BN5 office at the moment; exciting times for us as we start to sell tickets in the run up to the Big Draw on Friday 9 December at the Henfield Christmas Shopping Evening. At the time of going to print we have received 66 incredible prizes, with a combined value in excess of £3,200! How amazingly generous Henfield businesses are, also businesses in Brighton, Worthing, Horsham, Partridge Green and all around. THANK YOU ALL. The reason behind their great generosity has little to do with us and a lot to do with a very special place in Worthing, our local hospice. St Barnabas House is a peaceful and beautiful place, with incredibly kind and caring staff and volunteers. With over 76% of their funding coming from donations, They need our support more than ever. Every penny raised from our Big Christmas Draw goes to St Barnabas - last year we raised more than £2,000 for the Henfield Youth Club and this year we hope to exceed that total, with a lot more prizes (see page 29 for the full list, so far!). So, while we encourage you to buy tickets because the prizes are so wonderful, we also want to tell you that your donation will make a big difference to St Barnabas. News | DECEMBER 2016 HENFIELD NEIGHBOURHOOD PLAN QUASHED The Henfield Neighbourhood Plan, which received overwhelming support from the community at referendum on 12 April of this year and was adopted by Horsham District Council on 27 April, has been quashed in the High Court. The developers, Stonegate Homes Ltd and Littleworth Properties Ltd, had applied for a Judicial review just prior to the referendum on three grounds: 1. The failure to lawfully assess reasonable alternatives to the spatial strategy, especially in regard to the reasonable alternative to permit development on the western edge of Henfield. The Henfield Neighbourhood Plan did assess alternatives to its spatial strategy but the judge ruled that it had not taken into consideration the appeal decision of the Barratt’s site in West End Lane regarding the sustainability of the local roads. What the judge did not recognise was the importance of the plan being acceptable at referendum. There were 653 letters of objection to the Barratt’s site development and the Steering Group managing the Neighbourhood Plan reasoned that, should the Neighbourhood Plan support further development in West End Lane, then many local people would possibly vote against the Plan. No material importance was

given to referenda in Neighbourhood Plans by the judge. 2. The failure to consider any alternative to the Built-Up Area Boundary (BUAB) The Steering Group amended the BUAB in preparation for the pre-submission consultation that ran from 5 December 2014 to 21 January 2015. Although the decision to uphold the Barratt’s appeal was made on 2 June 2014 it was further challenged by Horsham District Council in the High Court. The final decision to uphold the appeal was only made on 21 January 2015 – the date the Neighbourhood Plan pre-submission consultation ended. 3. The failure of the Local Planning Authority or the Examiner to give adequate reasons as to why the Henfield Neighbourhood Plan met EU regulations. The judge ruled that because the Henfield Neighbourhood Plan was in breach of the Strategic Environmental Assessment Directive Regulations on the grounds 1 and 2 above, the Local Planning Authority should not have adopted the Plan as it did not comply with EU regulations. During the plan-making process the Henfield Neighbourhood Plan passed through all its checks and examinations satisfactorily and was commended at many stages. Henfield Parish Council must now consider whether it should produce another Neighbourhood Plan. It is obvious that the ‘light touch’ attitude regarding evidence once regarded as sufficient for a Neighbourhood Plan is no longer the case and Neighbourhood Plans now have to be approached with the same vigour as a local plan. In Henfield’s case the neighbourhood planning bar was raised after we had cleared it. The Sandgate Nursery appeal decision that has now been delayed until 12 December 2016 may have an impact on how far back the community would have to go in the plan-making process if Henfield Parish Council decides to produce another one. The Parish Council discussed the issue at the November Parish Council meeting. It is awaiting advice on how to proceed from Horsham District Council, Locality (advisory organisation supported by the Department of Communities & Local Government) and the National Association of Local Councils. Once these organisations have provided advice, the Parish Council will then consider how to proceed. Ray Osgood

Pictured above you will see the current seven HART First Responders, together with Dave Fletcher who was the founder of HART and still its inspiration. These days Dave works tirelessly behind the scenes helping with training, promotion and maintenance of HART’s PAD (Public Access Defibrillator) sites, but it is sad to say that the level of on-call time that HART was once able to provide and that Dave initially envisaged, is no longer possible. Why? Quite simply, HART does not have as many dedicated First Responders as it needs. The Ambulance Service requires that First Responders do, on average, at least six hours on-call time per week, at times to suit them. Is this something that you might consider? Do you belong to a club or society locally, and could you arrange for a HART member to come to one of your meetings to give a very brief (5-10 minute) chat on what we do? FAMILY’S RESPONSE TO ‘SAVE DAGBROOK LANE’ My family have owned and managed Brookside Farm since 1940. This includes a large section of the Downs Link, Dagbrook Lane both present and historic as well as the footpath which runs through the bottom of the Dagbrooks. I lost my father two years ago and I am continuing the conservation work on Brookside Farm, that my father continued following the death of my grandmother Mary Elsam around 1970. Part of this means leaving areas of land undisturbed from walkers and their pet dogs so that our natural wildlife is able to thrive. The best way to achieve this is for people to keep to public rights of way and to keep their animals either on leads or under close control. This is also one of the conditions of the Higher-Level Management Scheme we have with Natural England. The Deciduous Woodlands to the South of Henfield referred to in the village plan were planted by my father and are now maintained by me.

For many years, my parents asked people to keep to footpaths and not to walk on our land where they have no permission. Signs and gates have been put up but are just removed damaged and ignored. We have spoken to walkers and explained our position wherever possible. However, some people were continuing to walk without permission, in particular along part of the historic route of Dagbrook Lane under the Downs Link. Every time we did something to prevent trespass, either damage or theft appeared to be the stock response. I noted, in my view, the one-sided letter published in October 16 BN5 but chose to ignore it. Since then there have been a number of incidents of theft and criminal damage to our property which in frustration have now been reported to the police. We have no issue at all with people using footpaths, we spent a considerable amount of time and money improving and drying out the footpath through the Dagbrooks. Hopefully it will now be useable all year round. We have also brought heritage cattle back to manage the Dagbrook area. This does not make commercial sense but it is I believe best for our environment. As an aside when we put up signs explaining what we have been doing they were removed! There is now a sign up on part of the Downs Link canvassing support to open up part of our family’s land for an additional footpath. This is a duplicate route parallel to the one we have just dried out. As a family, we seek to improve the habitat for our wildlife. This can be seen by anyone who has walked the Downs Link or its parallel footpath through our bottom fields (when not flooded!), I would point out the large increase in Lapwing, Geese, Swans, Coots, Egrets etc. now present for large parts of the year. To finish I am strongly opposed to allowing the establishment of another public right of way when it is not needed as another is close by and I am prepared to defend my position by all means necessary. JEREMY’S DONATES VILLAGE CHRISTMAS TREE Jeremy’s, Henfield has come to the rescue of Henfield’s BP Guild and our village agreeing to donate this year’s Christmas tree! The BP Guild was bereft of a suitable tree to erect outside Barclay’s in the High Street and illuminate for Christmas, so they put out the call. THE WHITE HART’S BIG CHEQUE FOR HART HART is, and always has been, overwhelmed by the generosity of Henfield residents, businesses and clubs, and is so grateful for all the local support it gets. We regularly receive one-off donations, and no matter how large or small these are, they are all received with equal gratitude and appreciation. As well as the one-off donators, we also have several ongoing supporters, and none more so than Gyles and Mo Culver of the White Hart. Over the years they have sponsored Hart members when they undertook the Three Peaks Challenge, and also sponsored Hart First Responder Sandra Parsons when she undertook the Across Scotland Challenge. They have regularly run quizzes in aid of HART and as a result Gyles recently presented HART with a large cheque (in all senses) for £2,750 - amazing! EXTRA FUNDS BRING BOOST TO LOCAL BUSINESSES Horsham District Council’s Economic Development team has teamed up with other local authority colleagues across West Sussex to secure £500,000 to set up a grant pot for small businesses. The grant scheme is called the Local Enterprise and Apprenticeship Platform (LEAP) and will be launched on Saturday 3 December, when Horsham celebrates Small Business Saturday. If you are hoping to develop a new business, or if you want to take on an apprentice, you can now apply for a share of these grant funds to help you out. For small business grants, you can apply for up to £2,000 which you will need to match with additional funds, and up to £1,500 to match the funding that the Government makes available for apprentices. The funding is available from December 2016 until September 2017 and will be decided by a grants appraisal team at Horsham District Council. Applicants need to be registered with Companies House. CAM WALTON RACING HIGHLIGHTS RETHINK MENTAL ILLNESS CHARITY I have been racing in karting and club level car racing for the last three years and have achieved wins and podiums consistently in both. I recently graduated from Brunel University with a Masters degree with Honours in Motorsport Engineering, and completed a year-long work placement at McLaren. Working with the Rethink Mental Illness charity and drawing on my own experiences, I will be doing an awareness film followed by an online documentary series as part of my motor racing season - using the high profile of the events as a perfect way to attract attention for the cause and raise money for the charity. The series I am entering is the top support series for the British Touring Car Championship; the Renault UK Clio Cup, and with its live TV coverage and huge audiences it is the perfect platform to use for this purpose.

HENFIELD REMEMBERS There was a fantastic turn-out for the Henfield Remembrance Day service and parade on Sunday 13 November. The parade, featuring representatives from the Armed Forces, the Fire Brigade and the Police, as well as the Guides, Scouts and St Peters Primary School, met in the autumn sunshine next to the War Memorial on Cagefoot Lane to remember those who have given their lives in armed conflict over the years. Following the band, the parade marched down the High Street and along Church Road to St Peters Church where the Rev Paul Doick led a service for Remembrance Sunday. After the service the

parade proceeded to the War Memorial where Rev Paul Doick led the Act of Remembrance. The last post was sounded at both services, as was the poignant roll-call of those from the village who gave their lives during World War I and II. Poppy wreaths were laid on both war memorials and both Deacon Seamus Mahon and a representative from Henfield Evangelical Free Church gave a reading at the War Memorial on Cagefoot Lane. After the parade was dismissed, Henfield Club very generously provided refreshments for those parading and attending – a wonderful end to a touching village event. Sarah Butler

LLOYDS PHARMACY DRESSES UP FOR ALZHEIMER’S SOCIETY A big thank you from all at Lloyds Pharmacy, as on Friday 21 October we held a fundraising day raising money and awareness for our charity the Alzheimer’s Society. As a team, we wore fancy dress which included a crazy professor, bat girl, a yeti and a glamorous vintage girl. As well as the fancy dress, we had a tombola and some fantastic sales on perfume. The Henfield Haven has just celebrated its first birthday since being taken over by the local community, and is proving to be popular with residents by offering a range of activities and services, together with a café which provides freshly cooked meals and refreshments. However, The Haven needs ongoing support from the community if it is to prosper and thrive. There would be no membership charge; Friends – those who would like to support the Haven and be kept aware of what’s happening. Next year we will be holding a Guiness World Record Breaker and are asking you to help us by donating any unwanted denim jeans. As part of our Chelsea Fringe Festival, which runs from 1-11 June 2017 we will be staging ‘Jean, Jean, Genius’ which will see the creation of the longest strip of denim in Sussex or even the world! In the process we will be collecting money for the ‘Jeans for Genes’ charity – ‘Genetic Disorders UK’, a charity that aims to transform the lives of children with genetic disorders. Running as a trail from our entrance right through the garden and weaving through the borders, there will be tabs stitched into the piece dispensing information and facts about the process of making denim (the good, the bad and the ugly) and its history. Zips, button flies, tags and pockets will create the joints along the way. We are seeking donations of old pairs of jeans to make this possible. BAKING FOR CHARITY Over half term a group of Steyning Grammar students, Esme, TigerLily, Isla and Megan were given £10 to create a fundraising idea of their choice. For our REMAP work at Steyning Grammar schools we had to raise money for a charity of our own choice. My group chose to raise money for Macmillan Cancer Support. Our location we chose to raise money was in the High Street, Henfield. We were selling Halloween themed cupcakes, lots of brownies, a few cookies and lots and lots of sweets. We also made a ‘head through the holes’ wall to take pictures for people with either their phone or our Polaroid camera. Once we had sold

The musical evening of the year! This concert was beautifully performed by local diva Sidonie Winter together with colleagues, bass Mark Beesley and supreme accompanist Lesley Anne Sammons in a programme of music entitled ‘Songs of Stage and Screen’. The programme opened with Cole Porter and Ivor Novello then progressed to South Pacific with Sidonie’s spirited take on ‘I’m gonna wash that man right outta my hair’ and Mark’s rich ‘Some enchanted evening’. The audience heard a mellifluous Summertime from Sidonie, Lesley Anne’s vocal expertise with’ Latte’, a story of a girls’s love for a Starbuck’s barista! The first half concluded with three pieces by Mozart. HENFIELD COMMON MEMORIAL FIELD Henfield Parish Council has scheduled the work to renovate the two football pitches on Henfield Common’s Memorial Field for late May 2017. This should provide Henfield Football Club with two brand new fully drained football pitches, which with the necessary ongoing maintenance, should ensure football on the Common for many years to come. Whilst the work is being carried out and for a period afterwards, it will be necessary to fence off this area to allow the pitches to settle and the grass to grow. The office in Henfield will remain open and Kay and Ginny will still be there, so the only real difference as far as our clients are concerned will be that Emma Rivers will be in my seat. In practice, I shall still be around for a little while, but I shall soon be leaving to fulfil a long held dream of moving to Cornwall. At the Library they’ll have Christmas story time, mince pies and a giant book sale, do call in to Full of Beans round the corner for gingerbread lattes and hot chocolate. There will be lots of mince pies, mulled wine and other delicious treats at various shops in the High Street, to enjoy while you listen to the Christmas carols! All the Henfield pubs will be open with festive treats in store at the George, while the Plough have mulled wine and mince pies and The White Hart will be donating to St Barnabas for every glass of mulled wine sold. At Cinder Rose there will be fizz and nibbles with Natasha’s Pop Up Beauty Shop with nail art and make up demonstrations. At Stevens the ticket office is open for HTC’s Dick Turpin production, and Anne Stern will have her handmade jewellery. At stokes Santa has let some

of his reindeer come to visit (real ones!) and his elves will be on hand to collect your letters to Santa. Little ones will enjoy the funfair and candyfloss outside Setyres and the BP Guild are helping Santa to park his sleigh conveniently outside the Henfield Club. He will be taking a break from his busy North Pole schedule to help Henfield Youth Club with their present distribution in their grotto next to the Post Office. he Henfield Nativity Sheep Trail is back and this year, not only is it bigger and better, it will also be raising money for charity! The trail is free to enter and children can pick up an entry form from the Library. The sheep will be hiding in the participating shops and businesses up and down the High Street throughout the month of December. All children have to do is find which sheep is in which shop and write it down on the entry form (parents and carers can help the younger participants with this). Once they have collected the names of all the flock, they can hand their entry form back in at the Library up until 31 December. The winner will be the first correct entry to be pulled from the hat after this date. Mrs Jean Whiting is the inspiration behind the popular sheep trail which has become one of the Henfield’s Christmas traditions. The response to last years’ trail was fantastic and so this year the flock has grown, enabling more Henfield shops and businesses to take part. New for this year we also have special smooth black sheep in the flock courtesy of Southdown Galleries, as well as the gorgeous woolly sheep knitted by Jean and her family. Jean, who is a member of the Free Church congregation, is travelling to Haiti in January to help the children who have been so badly affected by the earthquake and more recently, Hurricane Matthew. Whilst there she will help set-up an education provision for local children and expects to be there for about six months. All the shops and businesses taking part in the Sheep Trail this year have donated £10 the ‘Hope House Haiti’ charity who are helping the local community following the disaster. This is a brilliant example of our

community helping others less fortunate and the Henfield Community Partnership are proud to be associated with such a great project. It’s panto time again!

W

ith Christmas just around the corner it’s time to book your seats for the Henfield Theatre Company’s pantomime which runs from 5 to 7 January. This season’s fun and frolics come packaged in the story of ‘Dick Turpin’, the real-life highwayman of the eighteenth century. Although the main character was real, the production will not even resemble a factual historical review. ‘Dick Turpin’ is a traditional family panto filled with catchy modern songs and some terrible old jokes! There may, potentially, also be a few good ones! This lesser known, charming and very entertaining pantomime was written by Paul Reakes, and the Henfield production is directed by Graeme Muncer with Jane Haines as Musical Director. Both Graeme and Jane are long standing and experienced members of the Theatre Company, on and off stage. Graeme unashamedly adores panto and has appeared in many and directed several of them before. Jane’s acting and musical talents are well known in the village and the audiences will certainly be in for a musical treat. The multitalented Alice Forward is Choreographer; her flair for dance routines has been having quite an

impact on the Henfield stage in recent years and we can look forward to seeing her work in action this time round. This wonderful, family friendly show is full of all the traditional elements of panto - oh yes it is! Will the dastardly Mr X cause the downfall of Dick Turpin, or will Dick be able to restore his reputation and settle down with the lovely Caroline? Dame Dollop may not help very much but she will certainly keep us entertained along the way. The pantomime is kindly sponsored by Stevens Estate Agents. Local artists Katherine Lawrie - Jeweller I started making jewellery when I was very little. I soon found out that school friends would actually give me money to make them things so I had an incentive to create! I started my business nearly twenty years ago, but I’ve been jewelling for much longer. I love texture and natural forms and I use a technique called roller texturing which involves applying something - a leaf, feather or piece of lace - to the surface and then rolling it through steel mills. I am often amazed at what impressions are left on the metal’s surface by something so soft, often leaving an ethereal, fossil-like image.

Pauline Finlay – Studio Shards Glasswork For as long as can remember I have drawn, painted, sculpted and photographed. However, five years ago I was introduced to glass and I became completely obsessed. My work ranges from wall art, to sculptural pieces for both indoors and out. I love the richness of the colours and the reflective properties that glass presents. In my work I cut and layer glass shards and frit (small granules of glass) to create artwork that has movement, texture and a sense of energy. Most of my work is inspired from nature right on my door step; the crashing waves and rolling hills of the South Downs. The medium of glass lends itself particularly well to water-inspired pieces

My inspiration includes my Dad and Step-mum, both of whom work as jewelers. I also love the work of Art Nouveau jewellers and artists. I get a buzz from my customers’ reaction. I’ve had customers burst into tears before when they come to collect something I have made for them. Simply it’s because they love it, but more often because it’s special, either in memory of someone or for a big event. r i h s t m C as t a Libby Francis – Peeps and Squeaks Through Peeps & Squeaks Studio I offers bespoke original artwork. Each illustration is taken from a photograph and hand drawn onto high quality sketch paper or beautiful fine linen canvas. To create a quality of line in pencil and then to add colour and stitch is at the heart of my work. The best part of my job is putting pencil to paper for those first few sketches from the piece and quiet of my kitchen table. It’s always exciting to see how the composition of the work will look and I often find myself unable to stop once I’m in the zone! My main work is children and family pets.

My family and I first moved to Sussex nearly seven years ago and I set up my home-based business when I moved to Henfield. Having grown up in a creative environment I have always loved to draw and I studied mixed-media textiles at the Royal College of Art. I’m inspired by many wonderful artists in my extended family, however it’s my little Peeps & Squeaks - the nicknames for my daughter, Evie and son, Henry – who are my greatest inspiration. Sarah Duffield - Painter My art is my way of responding to the environment around me. Sometimes I am inspired by the way light can transform a landscape: I am loving the Autumnal sunsets we are getting at the moment which for just a few minutes each day bathe the landscape with a warm, orange glow. Sometimes I am inspired by the sweeping forms of the Downs or the man-made stripes that bring chequer board fields to life every year. I have lived in Sussex for the majority of my life and have always loved the diversity of the county. I have always been inspired by post-impressionist painters when art became more than a window on

the world, it became about a glimpse at an artist’s soul. In my paintings I use colour to express the feeling of the time and the place, the emotion I felt when I experienced a particular view. I do not paint photographs and I do not paint accurately; I move fields, add or remove trees and always ignore pylons. I love it when clients send me a photograph of one of my paintings, framed and hanging in their home - it makes me happy that something I create can bring joy to others. Jim Young - Wood turner My involvement in wood did not start until I retired from the city at the age of 52. At first I tried cabinetmaking then woodturning. I had one woodturning lesson and then spent time in front of my lathe improving my skill and have now been turning 18 years.

Woodturning is an old craft and there are many outstanding turners in the world, but a local turner Bert Marsh, who I witness turning when I started, was my inspiration. I have not yet reached his standard. The joy of the craft is to take a log and turn it into something practical or ornamental. Every piece of wood is different, even from the same tree, so your interest is always there. For the last few years I have been recycling old, oak gate and fence posts into candle sticks - this gives them a new lease of life and saves them being burnt. I belong to two craft clubs: the Sussex Woodcraft Society and the South Downs Wood turners. Both clubs have web sites and show a variety work that members do. We attend a small number of fairs throughout the year to sell our work to help defray the costs of wood and equipment. I will be at the Sussex Woodcraft Society event in Henfield on 3 December.

Local artists Jose Heasman Stained glass artist The type of craftwork I do has been around for hundreds of years. I work with stained glass using the copper foiled soldering technique, perfected by Louis Comfort Tiffany way back in the 1800’s. He was a true visionary and influential designer of the period. Along with Tiffany I have been very much inspired by a much more local person of our times, Annelies Clarke. I was very fortunate to have been tutored by Annelies, who invited me in 1997 to have an intense week learning the art of copper foiling in her glass studio in Brighton; it was love at first break! The rest is history.

Diversifying from a background in fine art and a career in graphic design, I found moving into and working with glass, inspiring, mood-enhancing and challenging. I strive to capture the essence of nature within my designs and use of glass. All my work is hand crafted to my own original designs. My inspiration comes from the Sussex countryside and coastline; it never stops to amaze me with its exceptional beauty, a constant stimulus of colour and light. I was lucky enough, (I think that now!) to be made redundant when I was expecting my third child, so it seemed only natural for me to turn to what I was trained in which was photography. I began Samphire Photography and it has been running successfully now for five years and I love it. For me portraiture with newborn and young children even through to adults is about understanding that everyone is different. I place no expectations on anyone I photograph and I work with each individual to try to get the most out of them in what is sometimes quite a short

period of time. I have endless amounts of patience with the children I photograph and the rewards you get back when you know they trust you are amazing. Henri Cartier-Bresson is probably the photographer who most influenced me. He believed in the decisive moment when taking a photograph and I really know this to be true. Even in today’s digital age where we take countless amounts of images, I know the moment my finger presses the trigger whether it’s a keeper. Mark Webb - Jeweller I make up-cycled and individual silver jewellry pieces created from both new bullion and antique silver items. I work a lot with recycled antique cutlery and use my skills to craft new bullion into various designs of rings, pendants and bangles. I have been crafting silver for around two years, all self-taught and inspired by friends and the feedback from people who have seen, purchased and worn my pieces. With a background in engineering, I have had experience in metallurgy and have worked with metals and furnaces at high temperatures. My favorite part of crafting silver is that I can watch a piece of cutlery that may have been hidden away in a cupboard somewhere, be transformed into a beautiful, individual, very wearable item of jewellry. I’ve lived in Sussex most of my life and I love its untouched beauty. The natural forms, from a simple oak leaf to a beautiful butterfly, inspire me and I incorporate them into some of my work. Christmas Parties & Gifts

If you are planning a Christmas party for your staff, don’t let the taxman crush your festive spirits! Paul Samrah of chartered accountants and business advisers Kingston Smith advises how to celebrate in style. A staff party paid for by an employer counts as a benefit in kind on which employees are taxed. However, there are exemptions that allow employers to host the event without it being treated as a taxable benefit. One such exemption applies where the cost per head is no more than £150. For this to apply, the event must be open to all and not exclusive to a particular group. However, events based on separate working locations or departments are allowed, if available to all employees within the location or department. Employers may organise more than one annual event and all events may qualify for relief as long as the cost per head, in any one tax year, does not exceed £150. For example, if two events are held, one costing £120 per head and the second £40 per head, the total £150 limit has been breached. In this case, the whole of the first event will fall within the £150 exemption, but none of the second. The second event costing £40 may be covered by a new tax relief introduced from April 2016 relating to trivial benefits. This relief allows employers to provide employees with any number of benefits provided that the cost of each is less than £50, the benefit is not cash or a cash voucher, there is no contractual entitlement to the benefit, and the benefit is not specifically provided in recognition of services performed by the employee. If only one event is held in the year and the sum spent is more than £150 per head, then the full amount spent will become liable to income tax and national insurance (NI) for both staff and employer alike. It is not possible to combine the two regimes to give a combined limit of £200 towards a single event. When planning your event and estimating the tax implications, remember that the price per head is calculated on the total number of attendees. Secondly, make sure you include all incidental costs, not just venue hire and catering costs but also entertainment fees, taxi fares, overnight accommodation and any VAT charged (regardless of whether or not you are VAT registered). Divide the total cost of each function by the total number of people (including non-employees) who attend, in order to arrive at the cost per head. If an HMRC enquiry is launched, you will need to provide details of all the costs and attendees. Beware of trying to apply HMRC’s concession to ordinary staff entertaining. You need to hold an event

that is clearly a formally organised function. Some employers also make the mistake of charging the party to entertainment in the accounts, then forgetting that an event worth over £150 per head must be disclosed on the P11D. There are potentially harsh penalties for incorrect completion of the forms as well as corporation tax implications. It is worth remembering that although VAT on entertainment is not reclaimable, VAT on staff parties can be reclaimed, even if it exceeds £150 per head. Turning to staff gifts from an employer, HMRC do accept that minor gifts may be provided tax-free for employees. There is no statutory de minimis limit, so care is needed. An employer may provide employees with a seasonal gift, such as a turkey or a bottle of wine at Christmas. These gifts are considered to be trivial and are as such not taxable. If the gift extends beyond the trivial, i.e. from a bottle or two of wine to a case, you should take advice as it is likely to be treated as a taxable benefit in kind. As a consequence, unless the cost is shown on the employee’s P11d (and the employee pays the tax accordingly) the employer will need to enter into a PAYE settlement agreement with HMRC. The employer will also have a Class 1A (or 1B) NI liability. If the gift comprises non-cash vouchers, the Class 1A NI liability would transfer to a Class 1 NI liability, meaning both employees and employers would be liable. The cost to the employer of providing the vouchers would need to be added to the employee’s gross pay in the pay period that the vouchers were provided, to enable the calculation and deduction of Class 1 NI to be made. Cash presents, such as Christmas bonuses or vouchers redeemable for cash will require tax and NI contributions to be paid through the PAYE system. Finally, if you are considering making Christmas gifts to clients, be aware there is a £50 limit in any tax year. The gift must be a business-related gift, e.g. a calendar or a pen. It must carry an advertisement for your business, otherwise it will be classed as entertainment expenditure and will be disallowed.
