The Yellow Rose: a look at the plight of an undocumented teen By FE P. KOONS

T

he plight of children caught in the harsh web of the nation’s broken immigration system has always been a nagging one. We particularly cry for those children who were separated from their parents who were deemed “illegals.” Yellow Rose, an independent film directed by Diane Paragas, is a story of a young teenage girl Rosario Garcia (Eva Noblezada), who despite of all the hardships that go along with having an undocumented status, still managed to realize her dream of becoming a country singer. In the movie, Rosario has to deal with the over protectiveness of her

mother Priscilla, a character played by Princess Punzalan. Punzalan did a great job to her character Priscilla which was an exact opposite to the villain character that she played in the tele-serye titled “Mula Sa Puso.” Priscilla’s over the top distrust for almost everyone displays the sort of realism and fear that undocumented mothers harbor as they go about their daily lives which always involve hard work. Clearly, among the highlights of the movie came when Rosario screams when she found out that her mother has been snatched by the immigration officers. Who would take care of her now? Would she still be able to reach her dream of being a country folksinger?

Worse, her aunt Gail (played by Lea Salonga) could not even her help, not even to provide her a space in her home. A positive turn in the plot came with the entry of Dale Watson. Rose met him at bar which led to an endearing relationship. He mentored her. In one scene, Rose sings the popular love song “Dahil sa Iyo” which was obviously a metaphor for the love that has been imparted to her by her mother and as well as the inspiration that her love for music infuses to her character. The lyrics of the ballad totally fits the gratitude that prevails in inspiring the character of Rose. Yellow Rose is a film about hope and perseverance.

resident Dona ld Trump and his xenophobic agenda may be voted out of office Nov. 3, but a panel of civil rights advocates predicts that bias-related crimes and incidents will continue to be on the rise. Asian Americans have experienced the biggest increase in bias-related incidents, but the President’s implicit “permission to hate” has impacted all groups. “Even if Joe Biden wins the presidency, these issues will not go away,” said John Yang, executive director of Asian Americans Advancing Justice, at an Oct. 9 briefing organized by Ethnic Media Services. Tensions between the U.S. and China will continue, predicted the long-time civil rights advocate. Violent extremism unleashed by the Trump administration will also continue, he said. “So we should not let our guard down even if the election

brings changes of federal policymakers or even some state policymakers. We need to be vigilant and talk about this in thoughtful way,” said Yang. Manjusha Kulkarni, executive director of the Asian Pacific Policy and Planning Council — A3PCON — agreed with Yang. “We don’t expect significant changes after this election,” she said, noting that Muslims, Arabs, and South Asian Americans experienced a significant backlash of hate-based violence for as long as a decade after 9/11. Some of that backlash continues still today, she said. Hate incidents against the Asian American community have spiked in the U.S. since the beginning of the year, when the COVID-19 pandemic emerged in the U.S. Trump fanned the flames of anti Asian American xenophobia referring to COVID as “the China virus,” “the China plague,” and “Kung flu,” among other terms. He has repeatedly blamed China for the spread of the virus in the U.S.

The first known case of COVID was logged in Wuhan, China’s most central city. A3PCON logged 2,583 bias-related incidents from March 19 to Aug. 5 on its self-reporting site, STOP AAPI HATE. The portal has logged incidents in several Asian languages, but most attacks were targeted at Chinese Americans and Korean Americans. Physical assault made up nine percent of the incidents. Alarmingly, more than onethird of hate incidents took place at supermarkets and drug stores. A high number of incidents also occurred in public parks. Women were twice more likely to be the targets of hate incidents, and elderly victims were not spared, according to data collected at the portal. Four out of 10 Asian Americans and Black people surveyed by the Pew Research Center this summer said they had experienced discrimination during the pandemic. The survey was

conducted against the backdrop of Black Lives Matter protests, as many Americans were forced to consider their own innate biases. Interestingly, noted Neil Ruiz, Associate Director of Global Migration and Demography Research at the Pew Center and lead researcher for the report, 15 percent of Black people surveyed said they had experienced some form of hate or discrimination. But 51 percent of Black people said someone had expressed support for them because of their race or ethnicity. Former FBI agent Michael German, currently a fellow at the Brennan Center for Justice’s Liberty and National Security program, said there is no methodology currently for tracking the number of hate crimes in the U.S. The FBI’s annual Uniform Crime Reports have a section for law enforcement agencies to report bias-related incidents — including race and ethnicity — but German said this is an unreliable source as

police departments and county sheriffs voluntarily report data; reporting is not mandated. Only about 12 percent of such crimes are reported, he said, noting that law enforcement agencies face push-back from local officials who don’t want the data reported. “No mayor wants to be the state leader in hate crimes. So when your Police Commissioner comes to you and says: ‘Hey look at these hate crimes we’re going to report,’and you’re trying to get some multinational company to build a factory, you don't want to be known as the hate crime capital of the world. So there's a lot of good reasons why the police don't report,” said German. The researcher also noted that there is currently no way to track the rise of white supremacist organizations. The government does not track such data, and private organizations trying to track white supremacy largely rely on media reports, he said. CONTNUED ON PAGE 4

KArAoKE... from PAgE 1 Under guideline number 7, “singing, chanting and shouting” were referred to as physical exertions “that significantly increase the release of respiratory droplets and fine aerosols into the air.” Hence, “people who are singing or chanting should wear a face covering at all times.” “People who are singing or chanting are strongly encouraged to do so quietly (at or below the volume of a normal speaking voice).” “Instrumental music is allowed as long as the musicians maintain at least 6-foot physical distancing. Musicians must be from one of the three households. Playing of wind instruments (any instrument played by the mouth, such as a trumpet or clarinet) is strongly discouraged.” The health guideline was issued on October 9, apparently in anticipation of upcoming holiday celebrations. Gatherings should not involve more than three households at any time and must be held outside.

Health officials also urged those who are hosting gatherings to collect the names of all attendees to make it easier for authorities to conduct i contact tracing in case infections are reported after the event. The document also said that gatherings have to e limited to two hours or less. Other applicable precautions, such as the 6-feet-apart distancing, washing of hands with water and soap, providing sanitizers for attendees and the wearing of face coverings or masks were mentioned in the document. “Gatherings may occur in outdoor spaces that are covered by umbrellas, canopies, awnings, roofs, and other shade structures provided that at least three sides of the space (or 75%) are open to the outdoors,” the document said. “Anyone who develops COVID-19 within 48 hours after attending a gathering should notify the other attendees as soon as possible regarding the potential exposure.”

SIPA names Caloza as “Civic Servant of the Year”

os Angeles Board of Public Works Commissioner Jessica Caloza has been honored as “Civic Servant of the Year” and received the Lingkod Bayan Award from Search to Involve Pilipino Americans (SIPA) during its 48th Annual Benefit and Virtual Gala. This award is intended to recognize individuals who have demonstrated outstanding public service and community leadership. SIPA is a nonprofit organization in Historic Filipinotown providing programs and services to empower and uplift Filipino Americans. Commissioner Caloza was recognized with this award for her leadership on the Board of Public Works overseeing the City of Los Angeles’ most critical infrastructure projects and core services that improve the quality of life for its more than four million residents. She is a long-time supporter of community-based organizations like SIPA and its mission as exemplified through her own commitment to community building and advancing equity and inclusion for the Filipino American community and all underrepresented groups. “I’m humbled to receive this prestigious award and join the ranks of past recipients, including Mayor Garcetti. I’d like to thank SIPA for this special recognition. Lastly, I would like to dedicate this award to our incredible team at Public Works who work hard every single day to take care of our residents

and to our frontline workers, especially our Filipino healthcare professionals who risk their lives to take care of others during COVID-19,” said Commissioner Caloza. Appointed by Mayor Eric Garcetti and confirmed by the City Council in March 2019, Commissioner Caloza is the first Filipina American to serve on the Board of Public Works. During her time at the Board, she has led efforts to provide more language access to our City services to better help our immigrant communities and ensured that local and small businesses have access to networking opportunities and resources to work with public agencies through the City’s flagship Accessing L.A. events. Census count stops, but not all is lost

A new President and Congress may have some remedies down the line. By PILAR MARRERO

fter a Supreme Court ruling this week allowed the Department of Commerce to stop Census enumeration efforts by Friday October 15, advocates point to other pending rulings and to the November 3rd elections as important determinants of what happens with the data that has been collected by the Census Bureau. Arturo Vargas, Executive Director of the National Association of Latino Elected and Appointed Officials (NALEO), said that not all is lost, despite the confusion over the changing dates and recent rulings. “We forced the Census Bureau to extend it two weeks beyond what they wanted, we are missing out on just two weeks”, he said. “Now the big question is how accurate and complete that count is going to be, and that´s an unknown right now”. On Tuesday SCOTUS granted an appeal by the Trump Administration to an appeals panel decision that ordered it to continue enumeration efforts until Halloween, which was the original plan of the Department of Commerce after the Covid-19 pandemic hit. But the Department changed its mind and moved that date back to September 30th, arguing it would not have enough time to finish processing the data to turn it over to the President of the United States as the law mandates, on December 31st of this year. The data received by the President is used for reapportionment of Congressional seats and is by the states for reapportionment of the state legislatures. However, a memo issued in July by the Administration indicates that it intends to “exclude illegal aliens from the apportionment base.” This could potentially reduce the num-

ber of Congressional seats in states that are estimated to have a larger undocumented population, like California as well as some red states, like Florida, Texas and many in the South, said Vargas. So far, a court in New York has said that it would be illegal for the Trump Administration to make such adjustments to the data. That ruling was appealed to SCOTUS, which has not ruled on it yet. “Even if the Supreme Court says the memo is legal there will be a constitutional challenge,” said Vargas. In the event the courts rule against the civil rights groups and allow the President to modify the data using “estimates” about the number of “illegal aliens” in every state, the future of the data will be in the hands of a new Congress and a new President, said Vargas. “The House can reject the apportionment numbers after the President sends them to Capitol Hill,” Vargas added. A new Congress is sworn in by January 3rd, 17 days before the new presidential term begins. “If there is a change in the Senate and the House and the Presidency all go to the same party, I think the strategy changes completely.” Civil rights organizations, which have sued the Administration over different aspects of the way it has conducted the Census, are also fighting over the issue of post collection processing and whether the Bureau should take additional time before turning the data over to the President. Thomas A. Saenz, President and General Counsel of the Mexican American Legal Defense and Educational Fund, said that after the enumeration is finished, the Bureau “will use administrative records and check

First virtual Bioscience forum held in LA

A

group of scientists, engineers and executives from Los Angeles-based bioscience companies painted a vivid virtual picture of the industry’s racial inequities as well as the ability to save lives while creating jobs within the booming bioscience industry. S up e r v i s o r M a r k R i d ley-Thomas and BioscienceLA hosted the first ever virtual Bioscience Forum: Advancing Diversity and Equity. The virtual Forum brought together thought leaders in the life sciences and healthcare industries to discuss steps to reverse healthcare disparities, increase minority representation, provide local jobs, and combat the world’s most vexing and urgent health crises. “Not only is our country in the middle of a significant reckoning over its history of racism and injustice, but this reckoning is occurring during a pandemic that has not shown any signs of relenting,” said Supervisor Ridley-Thomas. “In the push for testing, vac-

cines, and therapies, bioscience will play a significant role in any path forward, but the truth is communities of color are significantly underrepresented in the life science industry.” African Americans account for less than 4% of the bio sector workforce. The numbers are even more discouraging at the executive level with less than 1% of African American representation. For the Latino community, just 5% are represented in non-executive roles and 3% in executive roles. Years ago, bioscience did not have as strong of a presence in Los Angeles County, especially in the Second District, making it more difficult for constituents to connect with the job opportunities arising from the industry’s steady growth. But five years ago, that changed with a motion in 2015 by Supervisor Ridley-Thomas. Following the motion’s approval, the Board of Supervisors directed the County to study key industries for job growth and economic development. The result was the development of

a Countywide Bioscience Initiative that included a goal to create a workforce pipeline to diversify the industry. “The County recognizes the moral imperative of this mandate for equality and to that end we have funded and helped develop the Bio-Flex program,” Supervisor Ridley-Thomas said. Bio-Flex, a first-in-the-nation apprenticeship training program, was launched in partnership with the South Bay Workforce Investment Board, Cal State Dominguez Hills, West LA College and the bioscience industry itself, including companies such as Bachem, Thermo Fisher Scientific, and Takeda to prepare persons of color and the economically disadvantaged for jobs in the bioscience industry. “Bio-Flex is an employer-driven system,” said South Bay Workforce Investment Board Executive Director Jan Vogel. “It is a career pathway program allowing students to get on the job training.” “I learned the value of job readiness and explored the intersections of business, chem-

This year’s Forum was part of the comprehensive countywide effort to increase local opportunities in the field of bioscience, which is increasingly important during the current economic downturn. In March of this year the County announced the first Bioscience Investment Fund through a public private partnership with bioscience investment firm MarsBio. “Supporting a cohesive innovation ecosystem requires a coordinated approach to funding, space, and talent, among other areas,” explained David J. Whelan, Chief Executive Officer of BioscienceLA. “The County’s commitment to growing the entire sector has jumpstarted so many related initiatives, including BioscienceLA, and the momentum is increasing rapidly. Diversity and inclusion can accelerate innovation, and we look forward to continuing today’s conversations.”

While today was the first virtual forum, it is the third event of its kind in the County. Last year’s in person forum was held at that hot-house of high-tech innovation, Google’s Spruce Goose Hanger. Last year’s forum highlighted how artificial intelligence is revolutionizing the medical field, with much of that transformative energy taking place in Los Angeles County. And this year’s virtual forum was just one week after the first Los Angeles County Youth Bioscience Summit, focusing on ways Los Angeles County has invested in bioscience, highlighting strategies to be competitive for entry-level jobs and the various ways a degree in the life sciences touches a wide range of industries. Over 200 students from high schools and community colleges in Los Angeles County were in attendance. “Our mission today is to explore ways that we can change this picture for a more inclusive tomorrow,” concluded the supervisor.

ately tripling the size of the park and bringing the first dog park to Carson. The lease agreement allows for recreation, sporting uses, ancillary facilities like parking and a dog. The lease terms also provide the flexibility for the City to also engage third-party operators and opens the door for grant opportunities. Because of the size of the new sized park, the options are abundant for the City to address the recreational needs of Carson, including but not limited to, sports fields, picnic areas, play areas for children, walking paths, and areas devoted to exercising. The City Council unanimously voted to approve the lease agreement. “This is a phenomenal opportunity; I am excited about the open space and recreational opportunities coming to Carson. We are about to triple the

size of one of our existing parks and build additional facilities the community needs, which include our first dog park and much needed sports fields,” said Carson Mayor Albert Robles. “The increased park size is not only beneficial for Carson, but also for the entire region,” added Mayor Robles. The next steps include the development of a state of the art facility and identifying additional resident desired amenities for the park. Carson is pursuing funding sources, including but not limited to Proposition 68, a Parks and Water Bond Act approved in June 2018. It is a measure to authorize $4 billion in general obligation bonds for state and local parks, environmental protection projects, water infrastructure projects, and flood protection projects.

HATE... from Page 2 Yang noted Senate Bill 2043 — also known as the Jabera-Heyer No Hate Act — would provide incentives to municipalities for reporting hate crimes, and grants to set up and manage state-run hate crime reporting hot-lines. Those convicted of hate crimes would be required to do community service directly correlated to the community harmed by the perpetrator. No action has been taken on the bill since its introduction last year. In September, the House passed a bill denouncing hate incidents against Asian Americans, sponsored by Rep. Grace Meng, D-New York. The bill passed along party lines. “It really pains me that 164 Republicans opposed that resolution and there was no good reason given except that the resolution specifically called out President Trump,” said Yang. Asian Americans Advancing Justice and other community advocacy organizations have been conducting “bystander intervention” training. Yang suggested simple interventions, such as dropping keys to create a distraction, or yelling at the aggressor, or moving the victim to a safe space, taking back power into the situation. Kulkarni described some of the incidents reported at the portal: grandparents were walking their grandchild around a neighborhood as a group of young adults drove by, screaming racist epithets. A middle schooler was physically attacked by a bully who told him to “go back to China.” When he responded that he was not Chinese, he was punched in the head 20 times by the bully. No immediate action was taken by school administration. Ruiz said Asian Americans and Black people are the highest mask-wearing demographic, but have also expressed concern that wearing a mask makes them look more suspicious and thus more vulnerable to attack.

n Sunday, October 11, 2020, a local television station, Channel 5 News, showed photos of UNOFFICIAL Drop Box for ELECTION Ballots. The first one was found out by a Pastor in front of his Church in the City of Santa Clarita. According to the televised report, there were allegedly around 50 of these UNOFFICIAL Ballot Boxes scattered around heavily trafficked areas such as: gyms, churches and gun stores throughout Southern California. These metal containers some in dark blue, some in white, are marked as "Official Ballot Drop Box," urging voters to drop off their ballots inside the box. Apparently, some Republicans have been actively promoting them, such as a man named Jordan Tygh, a GOP Field Director, who sent a now-deleted post last Friday, October 9, 2020 that said "DM me for convenient locations to drop your ballots off at." His message was accompanied by a photo of him kneeling in front of one of the UNOFFICIAL box, holding a BALLOT and wearing a mask, with Orange County's congressional candidate Michele Steele's name on it. That particular box was not an isolated incident. There was another box spotted outside the Freedom's Way Baptist Church in the City of Castaic, located in the northern part of Los Angeles County, where its presence was promoted by Pastor Jerry Cook, in a now-deleted post, where he said: "our church has a voting drop box in front of our complex and if you are voting early, drop your ballot on by."

The decision reversed the lower court ruling, allowing the Census to stop the enumeration. The U.S. Census Bureau issued a formal statement indicating that it has counted 99.9% of the households in the U.S. which sounds like complete success, but statistical experts and civil rights groups challenge that assertion. The American Statistical Association has raised questions about the quality of the data due to the shortened schedule, dropped quality control procedures, pending lawsuits and the outsize politicization of some parts of the 2020 Census. “It´s not enough to complete an enumeration. It´s also important to count everyone in doing so,” said John Thompson, a former Census Bureau director who was on the task force. A statement released on Tuesday by a coalition of Native American organizations said that the “completion rates provided by the Bureau merely refer to the percentage of households not responding to the Census that they are no longer trying to contact…by saying they have completed, the agency means they have stopped trying to contact them”. Vargas added that it is not known if all people in households were counted or if all households were included in the list. There´s also questions about the accuracy of part of the data that was filled in by proxy (by neighbors or other members of a household and not the person counted). How to avoid your property to go to Probate: property after you die. This may not be what you want if you’re in a second or later marriage. You might want your spouse to have the use of your property after your death, but then you want it to go to your own children after your spouse’s death. Joint ownership with right of survivorship or tenancy by the entirety won’t accomplish your final wishes in this situation. Your spouse can freely choose to leave your property to their children instead of your own, or even to a new spouse.

PROBATE is relatively easy and painless to avoid, yet many people fail to take steps to do so when they plan their estates. Mechanisms exist, from joint ownership to living trusts. What will work in your situation will depend on how your assets are titled and who you want to inherit your estate when you die. What Is Probate? Probate—or another means by which property can legally pass from a deceased individual to a beneficiary—is necessary because deceased individuals cannot own property. Ownership of each asset at the time of death must have some way of passing to a living individual. Probate is required when no other mechanism is in place. # 1 Get Rid of All of Your Property The most extreme way to avoid probate of your estate is to get rid of your property. You will not have an estate that require probate if you don't own anything to transfer to living beneficiaries after your death. Of course, this isn't practical because you'll need money to live on until your death, but giving most of your assets away through the use of a special type of trust can work in some cases. The key is to name yourself as a beneficiary of the trust. Using this type of trust combined with one or more other techniques for any assets that aren't transferred into the trust means no probate assets. And no probate assets means no probate estate. # 2 Take Advantage of Joint Ownership Adding a joint owner to a bank account, an investment account, or to a real estate deed will also avoid probate, provided

that it's clear that the account is owned as joint tenants with rights of survivorship and not as tenants in common. That word "survivorship" makes all the difference. Rights of survivorship guarantee that when one owner dies, their share of an asset automatically transfers to the survivor or survivors. You and your spouse can own property with rights of survivorship in the form of tenancy by the entirety in certain states. This is a similar type of deed reserved for married couples and it also avoids probate. Disadvantages of Joint Ownership There are several drawbacks to relying on joint ownership with rights of survivorship to avoid probate, however. Gift Taxes Adding a joint owner to an account or a deed can be a taxable gift that must be reported to the IRS on Form 709, the federal gift tax return. A gift tax can be incurred if the value of the joint owner's share exceeds $15,000 per person per year as of 2020.4 Many states additionally impose a gift tax. Additionally, judgment creditor or divorcing spouse might be able to take some or even all of the assets in a joint account if the co-owner is sued or divorces.

# 3 Use Beneficiary Designations You are probably already taking advantage of probate avoidance through the use of beneficiary designations if you own life insurance or assets held in a retirement account, such as an IRA, 401(k), or annuity. Most states also allow you to designate beneficiaries for your bank accounts, referred to as a “payable on death” or “POD” accounts, and also for non-retirement investment accounts, known as “transfer on death” or “TOD” accounts. A number of states allow you to designate beneficiaries for your real estate through the use of transfer on death deeds, or beneficiary deeds or affidavits as well. You can use a life estate deed to retain ownership of real estate during your lifetime in some states, then pass the property on to the beneficiaries of your choice after you die. This also avoids probate of real estate. # 4 Use a Revocable Living Trust A revocable living trust is a written agreement that covers three phases of your life:

If you become mentally incapacitated After you die Signing a revocable living trust agreement by itself isn’t enough to avoid probate of your property. You must then title your assets in the name of your trust. Your assets will only avoid probate after your revocable living trust has become the record owner of your assets instead of you. This process is known as “funding” your trust. Think of your trust as a bucket. You have to fill the bucket with your assets to ensure that they’ll avoid probate. Any that remain outside the bucket will require probate to transfer to a living beneficiary at the time of your death unless they have a beneficiary designation or they’re owned with rights of survivorship. The Bottom Line on Avoiding Probate What works for you will depend on your own unique family dynamics and your financial situation. The bottom line is that you will create peace of mind for yourself, as well as for your loved ones during a difficult time, if you use one or more techniques to avoid the probate of your property. Automatic revocation of wills and trust upon entry of divorce or nullity judgment YOU just finalized your divorce. You are free and single again. Ever wonder what happens to the will or revocable trust you executed during your marriage with your ex spouse naming your ex spouse or her family as beneficiary in case you pass away? Well, those documents are revoked by operation of law. A judgment of dissolution or nullity automatically cancels, by operation of law, non probate transfers between the former spouses or domestic partners. It also terminates the right of survivorship interest in joint tenancies between the former spouses/domestic partners and in community property with right of survivorship. Prob.C. §§ 5601, 5602, 5604. Unless the respective wills otherwise provide, the judgment also revokes all testamentary transfers between the former spouses or domestic partners and any provision in the will of either nominating the former spouse or domestic partner as executor, trustee, conservator or guardian. Probate Code § 6122; Estate of Coleman (2005) 129 CA4th 380, 389, 28 CR3d 282, 288; Estate of Jones (2004) 122 CA4th 326, 332–333, 18 CR3d 637, 641. Probate Code Section 6122 provides: (a) Unless the will expressly provides otherwise, if after executing a will the testator's marriage is dissolved or annulled, the dissolution or annulment revokes all of the following: (1) Any disposition or appointment of property made by the will to the former spouse. (2) Any provision of the will conferring a general or special power of appointment on the former spouse. (3) Any provision of the will nominating the former spouse as executor, trustee, conservator, or guardian. (b) If any disposition or other provision of a will is revoked solely by this section, it is revived by the testator's remarriage to the former spouse. (c) In case of revocation by dissolution or annulment: (1) Property prevented from passing

to a former spouse because of the revocation passes as if the former spouse failed to survive the testator. (2) Other provisions of the will conferring some power or office on the former spouse shall be interpreted as if the former spouse failed to survive the testator. A divorce judgment and nullity judgment also affects non probate transfers such as trusts. A broad range of surviving spouse/domestic partner rights are canceled upon finality of a judgment of dissolution or nullity including beneficiary rights under retirement plans, pay on death accounts, transfer on death vehicle registrations, trusts and a marital property agreement. Probate Code § 5600(e). Now since Wills and Trusts executed during the marriage is revoked upon entry of divorce or nullity judgment, you should think about setting up a new estate plan after the divorce or nullity to have a new plan in place in case you pass away. If you pass away with at least $166,250 in gross assets and you do not have a living trust (even if you have a will), your beneficiaries would have to open up a probate case before title to the assets can pass to them. When I say gross asset, I mean regardless of how much debt you owe on them. For example if you own a house valued at $850,000 at the time of your death, it does not matter that your mortgage balance is 800,000, a probate case has to be opened in order to pass title to that property. The same is true with other types of assets such

as owning a business, a professional practice, bonds, equities, etc. This is a very low threshold to exceed specially in California where real estate prices, even after the economic crisis, remains in the upper end of the curve among the 50 states. Commencing a probate case is expensive and a very slow process. Someone qualified will have to file a Petition with the probate court to have someone appointed as executor or administrator. The Petitioner's attorney gets paid a statutory rate for attorney's fees commencing with 4% of the gross estate. The probate referee will have to be paid for appraising the assets of the estate. If it is necessary to post bond, the premium on the bond would have to be paid as well. There is also the cost of administering the estate such as selling some of the assets to satisfy the estate's obligations and to divide the estate according to the will or the intestate line of succession if there is no will. The entire process could take up years specially if certain beneficiaries and creditors file certain claims. The probate court file would be public record. On the other hand if you have a revocable trust, your estate can avoid the entire court system and court supervision. In certain situations, the process may also save you estate taxes which may be substantial if your assets exceed a certain threshold. Basically, you and/or your spouse can be named as the initial trustee of the trust while you are alive. The trustee is the person who manages the trust. This means you retain control of all your assets the same way as if you

never had a trust. For revocable trusts, you can later on, at any time during your lifetime, revoke the entire trust if you change your mind. The assets held in your living trust will be managed by the trustee and distributed according to your directions without court supervision and involvement when you pass away. This can save your heirs time and money. Since the trust would not be under the direct management of the probate court, your assets and their value and your beneficiaries' identities would not become a public record. Your heirs and beneficiaries would still have to be notified about the living trust and advised, among other things, of their right to obtain a copy of the trust. If you recently got divorced or had a marriage annulled, you should have a new estate plan (wills and trust) set up to save on estate taxes, save on probate and administration cost, and make it more convenient for your beneficiaries to inherit from your estate. MINDING YOUR FINANCES… FROM PAGE 6 While the government is doing its best to provide safety nets during this crisis, you are still left to figure out on your own how to survive financially. Your stimulus check may be enough to keep you afloat for a month or two, but once that’s gone, you’re back in the same situation. For small businesses hoping to get a loan from the SBA, the money quickly ran out in a couple of weeks, and there has been no word if they’ll even get any money if Congress decides to provide additional funding. If you have stopped paying your mortgage due to your lender agreeing to a temporary forbearance, you should realize that this relief is temporary, and that the money will still need to be paid back whether in payments or a lump sum. No such thing as a free lunch. Same thing applies to suspended rent payments due to the government issuing a moratorium on evictions for the time being. Once the stay at home order is lifted, you should assume that the missed rent will be due and unless you can work something out with your landlord, you can be evicted. The best thing you can do right now is to develop a financial strategy instead of doing nothing. Some people who call my office tell me that they are not even calling their mortgage company or the lender on their vehicle because they don’t know what to say. This is the wrong approach. It is always best to maintain communication with creditors who have quicker legal remedies than others. Your mortgage company can foreclose on your home. The lender on your car can repossess. It is important to let them know how the virus has affected your finances and see what type of assistance they can provide even if temporary. Remember that food and health should be at the top of your priority list. If you are fortunate enough to have a bit of savings, make sure that you only spend this on essentials for daily survival. It would not make sense to waste this money paying a bill that you could wipe out in bankruptcy if you have to file later. Don’t assume that just because you’re now unemployed or that the fact that your hours have been cut that you will automatically qualify for bankruptcy. The court still looks at your income for the last 6 months and if you’re likely to go back to work soon making the same amount of money, it will be tough trying to convince the court that you have no ability to pay. But if you are uncertain as to when and if you’d even be able to go back to work, you may have a good argument to file bankruptcy now while the timing is right. Every situation is different and must be analyzed by an experienced bankruptcy attorney. Obviously, if now is the right time to file bankruptcy, the sooner you do it, the sooner you can rebuild your credit and get back on your feet. If

you’ve hit the bottom or about to, you may be feeling a lot of stress right now like everyone. My suggestion is to take things day by day, remember that there is only so much that you can do and to be pro-active in developing a financial strategy instead of just waiting for things to happen. Are you paid at least $456 a day when working a 24-hour shift? C A REGI V ERS work i ng i n Residential Care Facilities provide an important service to elderly and disabled individuals, as well as their families. These caregivers often work up to 24 hours per day, providing necessar y care and supervision to ensure the health and safety of each facility resident. However, many facility caregivers are grossly underpaid for the services they provide. For tunately, Ca lifornia law protects caregivers who work in licensed Residential Care Facilities from wage theft. Specifically, all facility caregivers are entitled to receive at least minimum wage for every hour they work, including all hours they are required to be present at the facility. The current minimum wage rate in California is $12.00 per hour for employers with 25 employees or less, and $13.00 per hour for employers with 26 or more employees. Additionally, with some exceptions, facility caregivers are also entitled to overtime compensation for all hours worked in excess of 8 per day or 40 per week, and double time compensation for all hours worked in excess of 12 per day. In light of these requirements, facility caregivers who work 24-hour shifts must be paid at least $456 per day to comply with California’s minimum wage laws. That includes 8 hours of pay at the minimum wage rate of $12.00/hour ($96), four hours of pay at the overtime rate of $18.00/hour ($72), and 12 hours of pay at the double time rate of $24/hour ($288). In lieu of paying overtime and double time wages, many employers pay facility caregivers a fixed salary, regardless of the actual number of hours they work each day. In actuality, under California law, payment of a fixed salary to a non-exempt employee only compensates that employee for their regular, non-overtime hours worked. This means that a non-exempt facility caregiver who receives a fixed salary has probably not been compensated for any hours he or she worked in excess of 8 per day or 40 per week. Furthermore, those uncompensated hours are considered overtime and double time hours, compensable at a rate one-and-one half times or two times the facility caregiver’s regular rate of pay. If you are a facility caregiver receiving a fixed salary for working 24-hour shifts, you may have a substantial unpaid overtime claim. For purposes of illustration, below is an example of how wage and hour claims are calculated for facility caregivers under California law: Tony is a facility caregiver. He works 24 hours per day and is not allowed to leave the care facility at any time during his scheduled shifts. Tony’s employer also requires him to sleep in the facility at night and the residents frequently wake him asking for assistance. Tony receives a daily salary of $100 each day he works. This makes Tony’s regular rate of pay $12.50 per hour ($100/8 hours per day). Subject to that calculation,

The Department of Foreign Affairs said in a statement Thursday that Ambassador Enrique Manalo, Philippine Permanent Representative to the United Nations, called for multilateral cooperation and genuine dialogue for promotion and protection of human rights during the Third Committee of the General Assembly in its opening session on Oct. 5. “We seek to ensure a safe and secure environment where human rights and fundamental freedoms are enjoyed by every Filipino, free from crime and the evil of illegal drugs,” Manalo told other delegates in the UN. The United Nations Human Rights Council earlier adopted a resolution that would provide technical cooperation and capacity-building for promotion and protection of human rights in the Philippines, which rights groups say falls short of launching an independent international probe into the human rights situation in the country. The resolution, co-sponsored by the Philippines and other countries, requested the Office of the High Commissioner on Human Rights to provide technical assistance and capacity-building for “domestic investigative and accountability measures, data gathering on alleged police violations, civic space and engagement with civil society and the Commission on Human Rights, national mechanism for reporting and follow-up, counter-terrorism legislation and human rights-based approaches to drug control.” Rights groups who had been lobbying for an impartial, independent international probe since President Rodrigo Duterte's drug war began, said the resolution does not provide meaningful actions. DOLE eyes Europe as potential new market for displaced OFWs

MANILA (Mabuhay) — The government is looking at Europe as an alternative market for overseas Filipino workers (OFWs) who were displaced by the coronavirus disease (Covid-19) pandemic. “The number one program for our migrant workers is to look for a new market for employment purposes. We are opening new markets where we can employ our overseas Filipino workers,” Labor Secretary Silvestre Bello III said on Thursday in a Laging Handa briefing. He said among the potential new markets for the deployment of OFWs are Russia, Germany, United Kingdom, and eastern Europe. "However, we are still being cautious because we want to make sure that once they go there, they would not be infected with Covid-19," he added. Bello said job opportunities are also available locally especially in the construction industry and business process outsourcing. "We had a recent meeting with the IT-BPO sector. They are in need of 30,000 call center agents. With that, more OFWs would be accommodated in terms of employment," he said. Bello said livelihood programs are also available for those who would like to stay in the country to be with their families. "We have the new concept of a collective livelihood program. Mas malaki ang mabibigay na livelihood assistance kung mag-form ang ating mga OFWs ng (Our OFWs would get bigger livelihood assistance if they will form an) association or cooperative. This is for our repatriated OFWs," he added. To date, Bello said there are more than 250,000 OFWs who have been repatriated. “As of 2 a.m. Thursday, 250,000 plus OFWs, have been repatriated and we are expecting an additional 100,000 to come home,” he said. 21 churches damaged in 2013 Bohol quake restored MANILA (Mabuhay) — Almost all of the 25 churches in the Diocese of Tagbilaran that were damaged by the magnitude 7.2 earthquake that hit the province of Bohol seven years ago have been restored. Senate panel OKs distribution of cash aid for rice farmers using surplus from RCEF MANIL A (Mabuhay) — The Senate committee on agriculture on Friday approved a joint resolution seeking to distribute direct cash aid to Filipino rice farmers using the surplus from the Rice Competitiveness Enhancement Fund (RCEF). Senate Joint Resolution No. 12 seeks to include everything in excess of the P10-billion RCEF in 2020 to the budget for the next fiscal year so that these may be distributed as direct cash assistance to rice farmers who till less than one hectare of land. Senator Cynthia Villar, citing a preliminary figure, said the amount in excess of the RCEF is about 3.6 billion, based on the collected duties under the Rice Tariffication Law from January to September 2020 alone. During the hearing, Villar added that the excess from the 2019 collection of rice taxes from rice imports must also

Duterte approves lifting of oil exploration moratorium in WPS MANILA (Mabuhay) — President Rodrigo Duterte has approved the recommendation of the Department of Energy (DOE) to lift the suspension of petroleum activities in the West Philippine Sea (WPS). “I thank the President for approving the DOE recommendation. We need to explore so we may address the country’s energy security,” DOE Secretary Alfonso Cusi said in a press release on Thursday. Under Republic Act 7638 or the "Department of Energy Act of 1992”, the DOE has the authority to regulate the exploration of the country’s indigenous energy resources. "With the impending depletion of our natural gas reserve in Malampaya, it is the department’s position that there is an urgent imperative to resume exploration, development, and production activities within our EEZ to ensure continuity of supply of indigenous resources in the country,” Cusi said. He said the DOE has issued a “Resume-to-Work” to the Service Contractors doing petroleum-related activities in the areas of SC 59, 72, and 75 in the West Philippine Sea. The activities there were suspended on the ground “force majeure” due to the WPS dispute. SCs 59 and 72 are operated by the Philippine National Oil Company-Exploration Corp. (PNOCEC) and Forum Ltd., respectively. Meanwhile, PXP Energy Corp. operates SC 75. Cusi pointed out that the lifting of the suspension will infuse the economy with fresh foreign direct investments and generates high-skills jobs, both of which are need to boost economic recovery following the coronavirus disease (Covid-19) pandemic. “The lifting of the suspension places the service contractors under legal obligation to put capital into the contract areas and hire Filipino engineers and technical workers to resume exploration,” he said. Cusi said he has informed Foreign Affairs Secretary Teodoro Locsin Jr. of the President’s approval of the DOE recommendation.

He pointed out that the lifting of the moratorium was arrived at in good faith and with full regard of the ongoing negotiations between the Philippines and China, and Forum Ltd. and the China National Offshore Corp. (CNOOC). “The oasis of peace that the Philippine Department of Foreign Affairs and the Chinese Ministry of Foreign Affairs envision must also be an oasis of prosperity. PCG gets 2 new rescue choppers MANILA (Mabuhay) — The Philippine Coast Guard (PCG) has received two new Airbus H145 light twin-engine helicopters, boosting the maritime organization’s disaster response and humanitarian activities. Each helicopter costs PHP685 million and was built and designed in Germany. One of the helicopters was earlier commissioned on June 18, 2020, while the other was commissioned during the 119th anniversary of the PCG on Wednesday. “CGH-1451 a nd CGH-1452 a re equipped with high-frequency radios, emergency flotation gears, as well as fast-roping, cargo sling, searchlight, and electro-optical systems to

perform critical missions including search and rescue, medical evacuation, and maritime patrol operation,” the PCG said in a statement on Facebook. At this time of the pandemic, the choppers will be useful in transporting personal protective equipment sets, medical supplies, and medicines to far-flung areas and coastal communities, it said. “Above all, said aerial assets will significantly enhance PCG’s capabilities in upholding maritime law enforcement, maritime search and rescue, maritime security, maritime safety, and marine environmental protection in service to the Republic of the Philippines,” the PCG said. Gov't allows resumption of non-essential outbound travel of Filipinos MANILA (Mabuhay) — The government’s COVID-19 task force has lifted the restriction on non-essential outbound travel of Filipinos, Malacañang announced on Friday. Presidential spokesperson Harry Roque said the policy will be effective on October 21. The Inter-Agency Task Force for the Management of Infectious Diseases (IATF) earlier suspended the implementation of this policy. Under the guidelines, a traveler must have adequate travel and health insurance and submit confirmed roundtrip tickets for those traveling on tourist visas. He or she must also execute a declaration acknowledging the risks in traveling and must have a negative antigen test result 24 hours prior to departure and follow the COVID-19 guidelines for returning Filipinos. Roque said the policy will be beneficial to Filipinos who wish to visit their

foreign partners abroad. Sale events Roque also announced that the IATF has also allowed business establishments and malls to hold sales and other marketing events to spur consumer spending amid the COVID-19 crisis. The government previously disallowed marketing events and other promotions in malls, which tend to attract large crowds, to prevent the spread of COVID-19. Tourism, travel This developed as the Department of Trade and Industry (DTI) allowed tourism and travel-related activities to resume under relaxed quarantine classifications. The DTI issued Memorandum Circular No. 20-53, dated October 14, prescribing the recategorization of travel agencies, tour operators, reservation

service, and related activities from Category IV to Category III. This means the said establishments are “allowed to reopen at 50% operational capacity for areas placed under GCQ (general community quarantine) and 100% capacity for areas under modified GCQ, subject to minimum public health standards and protocols.” These developments came days after the Department of Tourism (DOT) cleared several hotels for “staycation” as it eyes more for bookings amid the pandemic. Last month, the IATF gave its approval to “staycations” in areas under GCQ. Increase in transmission seen The easing of restrictions, however, is expected to result in an increase in COVID-19 transmission in the country, according to UP assistant professor Ranjit Rye of OCTA Research.

The bulk of the newly reported infections were still recorded in Metro Manila at 624, followed by Cavite with 219 new cases, Batangas with 104, Rizal with 91, and Negros Occidental with 63. Bill granting PRRD anti-red tape powers gets final House nod MANILA (Mabuhay) — The House of Representatives on Friday night approved on third and final reading a measure granting President Rodrigo Duterte the authority to expedite the processing and issuance of national and local permits, licenses, and certifications during national emergencies. With 267 affirmative votes, six negative votes, and no abstention, the chamber approved House Bill No. 7884, granting Duterte anti-red tape powers. The third reading approval came after it was approved on second reading on the same day. President Duterte has certified the bill as urgent, which lifts the “three-day” rule between the second and third readings. M aj or it y L e ade r M a r t i n Romualdez and Speaker Lord Allan Velasco led the filing of the bill, which aims to accelerate the country’s socio-economic recovery and ensure an effective government response to the present health crisis brought about by the coronavirus disease (Covid-19) pandemic. The bill gives Duterte the authority to suspend the requirements for national and local permits, licenses and certifications, and to streamline and expedite the process of issuance. The bill covers all agencies of

Under the measure, the President has the power to suspend or remove any government official or employee performing acts contrary to the measure consistent with Article VII Sections 1 and 17 of the Constitution, the Revised Administrative Code, other existing laws, and jurisprudence. TF Zero Hunger launches food policies for PH, BARMM MANILA (Mabuhay) — The government launched on Friday twin initiatives to avoid hunger and secure food for every Filipino’s table during the culmination of the World Food Day at the Department of Agriculture (DA) compound. Cabinet Secretary and head of Task Force (TF) Zero Hunger Karlo Nograles said the goal of the National Food Policy (NFP) is to end hunger in the Philippines "within this generation’s lifetimes". Aside from the NFP, Nograles also led the virtual launch of the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM) Food Security and Nutrition (FSN) Roadmap. “ T he P r e sident (R o d r igo Duterte), by issuing Executive Order No. 101, acknowledged that there is a need to carefully coordinate, rationalize, monitor, and assess the efforts of involved government agencies to ensure not only a whole-of-nation approach but a whole-of-society collaboration in eradicating hunger and achieving food security,” Nograles said. He said the two initiatives underscore the government’s commitment in addressing involuntary hunger, food security, undernutrition, child wasting, stunting, and mortality –– concerns that the President had prioritized even before the onset of the coronavirus disease 2019 (Covid-19) pandemic. The NFP includes initiatives for ending hunger, achieving food security, improving nutrition, and promoting sustainable agriculture. It states six key result areas including: (1) To review and rationalize existing policies, rules, and regulations related to the Zero Hunger efforts of government; (2) To ensure available and affordable food; (3) To secure nutrition adequacy; (4) To secure food accessibility and

House approves P4.5-T nat'l budget for 2021

MANILA (Mabuhay) — The House of Representatives on Friday approved on third and final reading the proposed PHP4.5-trillion national budget for 2021. A total of 267 lawmakers approved House Bill 7727 or the 2021 General Appropriations Bill (GAB) on third and final reading after the plenary passed the measure on second reading on the same day. Only six lawmakers opposed, while no one abstained from voting. President Rodrigo Duterte has certified the spending measure as urgent, which lifts the “three-day” rule between the second and third readings. The House gave its greenlight to the 2021 GAB after holding a special session from October 13 to 16, as called upon by President Duterte. In a speech following the bill’s third reading approval, Velasco assured the public that there would be no reenacted national budget for next year. “I congratulate all House members for their active involvement in the timely passage on third and final reading of the General Appropriations Bill. But I assure you and the President that we will not have a reenacted budget by January of next year,” Velasco said. Velasco said they will “transmit without delay” the House-approved budget bill to the Senate to give their counterparts sufficient time to examine the spending measure. Velasco described the 2021 national budget as “an extraordinary budget for extraordinary times”. “There is so much at stake here: our health, the economy, jobs and livelihood, food security, the education of our children, and much more. And we thank President Rodrigo Roa Duterte for taking a principled, decisive leadership in calling this special session so that the budget would get the complete attention that it deserves,” he said. He noted that next year’s budget would not only provide the fiscal stimulus for economic recovery, but also help fund the government's efforts to contain and mitigate the spread of the coronavirus disease (Covid-19). House appropriations committee chair Eric Yap, sponsor of the bill, said the proposed budget is crucial to the country’s recovery from the adverse effects of the coronavirus pandemic as it will serve as an investment for resiliency and sustainability. “We stand along with the budget philosophy of this administration that more than our priorities for a responsive and dynamic governance, we have to focus our resources to the most urgent priority -- to reset our momentum and action, rebound for the devastating effect of the pandemic on the health and economy, and fully recover from the current and continuing impact of this crisis,” Yap said. The pandemic has hampered opportunities for socio-economic growth and development, with many losing their jobs and livelihood following closures of companies. “This budget carries the aspiration of our Filipino people to recover from the hardship brought by the pandemic to our livelihood and to recover the country's economic growth. The timely passage of the General Appropriations Bill will ensure that our government, through its programs and projects, will be able to rebound, reset, and recover our lost momentum,” he said. The proposed national budget is 9.9 percent higher than the PHP4.1-trillion appropriations for 2020 and equivalent to 21.8 percent of the gross domestic product (GDP). The bulk of next year’s proposed budget will be provided to the social services sector amounting to PHP1.664 trillion, equivalent to 36.9 percent. This includes funding support for programs related to health, social protection, and education. The economic services sector will receive the second highest allocation with PHP1.347 trillion or 29.9 percent of the proposed budget. Meanwhile, the general public services sector will be allocated with PHP724.2 billion, debt burden with PHP560.2 billion, and defense with PHP210.6 billion. The top 10 agencies with the highest budget allocations include the Department of Education (DepEd), Department of Public Works and Highways (DPWH), the Department of the Interior and Local Government (DILG), the Department of National Defense (DND), the Department of Health (DOH), the Department of Social Welfare and Development (DSWD), the Department of Transportation (DOTr), the Department of Agriculture, the Judiciary, and the Department of Labor and Employment (DOLE). Earlier, budget deliberations were stalled due to the speakership tussle between then Speaker Alan Peter Cayetano and his successor, Velasco. Cayetano's move to abruptly suspend the session and hastily pass the 2021 budget bill on second reading on October 6 was an attempt to prevent any speakership takeover. However, plenary debates eventually resumed on Tuesday after Velasco was elected by a majority of House members. Under the term-sharing deal brokered by President Duterte, Cayetano would serve as the House Speaker for the first 15 months, or until October 2020 while Velasco would take over and assume the position for the remaining 21 months or until the 18th Congress ends in 2022. DA banning cooperatives from rice imports to avoid trader abuse — Dar MANILA (Mabuhay) — Cooperatives in the country will be banned from importing rice, Agriculture Secretary William Dar said Friday. At the Senate hearing on agriculture, Senator Cynthia Villar said farmers' cooperatives are being used by rice importers to skirt tariff laws. "They are being used by the traders. Ginamit na 'yan before eh. Nang makulong, ako pa nagbayad ng kanilang piyansa kasi naawa ako eh. Ginamit sila eh. Nung iniimbestigahan na sila, wala na 'yung trader. Kawawa 'yang mga cooperatives na 'yan," Villar said. "They said if you use the

coop, you are not paying tariff. Kaya ginagamit na ng rice importer 'yung coop," she added. Dar said the DA has also looked into the concern and has come up with a position. "I will issue an order not to allow now cooperatives and associations to import (rice)," he said. Senator Francis "Kiko" Pangilinan said the cooperatives should instead be assisted by the local government by directly purchasing rice from them "Part of the reason na ginagawa 'yan ng mga coopetives ay sila ay naaanggihan," he said.

Diokno: Remittances to shrink less than expected Gov’t allows return of sale events MANILA (Mabuhay) — Despite the challenging overseas labor environment brought by the COVID-19 pandemic, the Bangko Sentral ng Pilipinas (BSP) said Friday money sent home by Filipinos abroad will decline less than what it earlier estimated. “With four months to go before the end of the year, there is a strong likelihood that the 2020 OF (overseas Filipinos) remittances would shrink by less than 5%,” BSP Governor Benjamin Diokno told reporters in a Viber group message. This, after the January to August personal remittances

— the sum of transfers sent in cash or in-kind through informal channels — declined by 2.6% to $21.414 billion from $21.995 billion year-on-year. “Year-to-date, remittances from Filipino workers contracted by 2.6%. That’s good news. That’s lower than BSP’s revised forecast of negative 5%,” Diokno said.. The BSP earlier forecast that the remittances for the whole 2020 could contract by 5% due to the pandemic. “Other analysts predict that OF remittances would contract by as much as 20%,” Diokno said.

For January to August, cash remittances — money transfers coursed through banks — stood at $19.285 billion, down 2.6% from $19.808 billion last year. In terms of cumulative share, receipts from the US registered the highest share to total cash remittances year-todate at 40.2% followed by Singapore, the United Kingdom, Japan, Saudi Arabia, United Arab Emirates, Canada, Hong Kong, Taiwan, and Qatar. Self-taught artist uses talent to earn amid pandemic

ary Bonguit, a self-taught artist from San Pedro, Laguna, started to paint portraits of celebrities for him to have the chance to meet these local stars in person. His first artwork was a portrait of actress Liza Soberano, which he painted nine years ago. Some of his artworks include television personalities like Angel Locsin, Anne Curtis, and Kathryn Bernardo, as well as Miss Universe beauty queens Pia Wurtzbach and Catriona Gray. He already painted Vice Ganda, Robi Domingo, Jane De Leon, Kim Domingo, Kyline Alcantara, and social media stars Mimiyuuuh and the late Lloyd Cadena. As he wished, Bonguit was able to meet and give his artworks to these celebrities. “Bilang isang ordinar yong tao, masarap sa pakiramdam, at hindi ko ma-explain ang aking nararamdaman sa tuwing nagugustuhan at humahanga ang mga tao sa aking mga obra. Sapat na sa akin ang makita ko sila at maibahagi ang aking likha (As an ordinary person, it feels good, and I can’t explain how I feel every time people like and admire my works. It was enough for me to see them (celebrities) and share my creation),” Bonguit told the Philippine News Agency (PNA). The 28-year-old artist shared that he would like to take Fine Arts in college. 3 potential COVID-19 vaccines to have clinical trials in Philippines — Palace MANILA (Mabuhay) — At least three potential vaccines against COVID-19 are set to have clinical trials in the Philippines, according to presidential spokesperson Harry Roque on Thursday. “Meron po tayong tatlo na magkakaroon tayo ng clinical trials,” Roque said. “Kasama na po dyan ang Russia at tsaka 'yung sa China, at kung hindi ako nagkakamali meron pang isang Western company, hindi ko lang po masigurado kung ito po yung sa Oxford o sa Amerika.” In a televised address on Wednesday, President Rodrigo Duterte once again expressed confidence in the COVID-19 vaccines being developed by China. He also assured Filipinos of the safety of China’s potential vaccines. “Those of you who are asking me kung safe ba itong China: I can say that China is a modern country and it has all the wherewithal… [its] integrity is fully protected by its achievements,” Duterte said. 2 studies suggest blood type O at less Covid-19 risk

Two medical studies have suggested that people with blood type O may be at lower risk of contracting the novel coronavirus. A Danish study, conducted by 11 researchers based on information of 473,654 individuals tested for Covid-19, found that blood group O was associated with a decreased risk of coronavirus infection. "We demonstrate that blood group O is significantly associated with reduced susceptibility to SARS-CoV-2 infection," said the study published Wednesday on Blood Advances, a peer-reviewed medical journal of the American Society of Hematology. The research indicated that individuals with blood types A, B, and AB were also at higher risk of exhibiting thrombosis -- the clotting of blood inside a blood vessel -- and cardiovascular diseases, which are significant co-occurring conditions among hospitalized Covid-19 patients. Similar results were found by a Canadian medical study conducted by 14 researchers based on data collected from intensive care unit patients in six metropolitan Vancouver hospitals.

"Covid-19 patients with blood group A or AB appear to exhibit a greater disease severity than patients with blood group O or B," found the study, which was published in the same journal, adding that individuals with blood group O were reported to be "less susceptible to SARS-CoV-2 infection." The study also noted that Covid-19 patients of blood group A or AB had a higher risk of requiring mechanical ventilation and longer duration in intensive care, compared to those with blood group O or B. While 84 percent of patients with blood groups A or AB required mechanical ventilation in SARS-CoV-2 infection, that level was 61 percent for patients with blood types O or B, according to the research. The median length of staying in intensive care units was 13.5 days for patients with A or AB blood types, while it was only nine days for patients with O or B blood types, the study found. The number of Covid-19 cases in the world stood around 38.5 million and deaths close to 1.1 million on Thursday, according to Johns Hopkins University data. (PNA)

A study of CMS and Bureau of Labor Statistics (national figures) show that the rate of MediCaid enrollment has not gone at par with unemployment claims from March up to September, 2020. The big gap, to me, is indicative of our people’s lack of Medicaid awareness and the difficulty of getting connected with the Department of Public Social Services (DPSS) for inquiries. MediCaid is a federal public health insurance program administered by the states. It is known by different names in different states. In California, it is known as Medi-Cal. It provides free or low-cost comprehensive coverage for those with low income. To qualify for Medi-Cal, DPSS considers income and size of household for those aged below 65; income and resources for those aged 65 and beyond. Medi-Cal considers current monthly income rather than annual income. Hence, those of

moderate or high income before they lost their jobs, may qualify. Furthermore, those receiving unemployment benefits must know that DPSS does not include the $600 (pre-July) and $300 (post-July) supplemental unemployment benefits provided by the federal government in computing for their monthly income. In 2020, you may qualify if your income is less than 138% of the federal poverty level. Translation: $1,467 a month for an individual; $1,983 for a family of 2; and, $3,013 for a family of 4. You can apply anytime. You don’t have to wait for an open enrollment period or special enrollment as in Medicare. You may apply online or submit your paper application directly to your DPSS office. PH Army Covid-19 molecular lab now operational MANILA (Mabuhay) — In line with its ongoing efforts to contain the coronavirus disease 2019 (Covid-19), the Philippine Army (PA) on Thursday announced that its molecular laboratory is now operational after receiving accreditation from the Department of Health (DOH). The facility was established to provide quality health care services related to emerging infectious diseases in the Army as well as leveling up the organization’s capabilities against the Covid-19. "Army personnel and dependents, civilian human resource, and other authorized civilians can avail the laboratory’s services by sending their swab samples collected and delivered by the requesting individual or institution,"

The PA Molecular Laboratory is also capable of conducting the reverse transcription-polymerase chain reaction" (RT-PCR) Covid-19 testing process and can accommodate about 90 samples a day. Army commander, Lt. Gen. Cirilito Sobejana, meanwhile, thanked the DOH and the Research Institute for Tropical Medicine as well as the Army offices and units that made this new healthcare capability possible. "The PA rises to the challenges to be resilient even in the face of this pandemic. PH Covid-19 recoveries now 294,161

MANILA (Mabuhay) — The Department of Health on Thursday logged 385 new recovered cases, bringing the overall tally of coronavirus disease 2019 (Covid-19) recoveries nationwide to 294,161. In its latest case bulletin, the DOH also reported 2,361 new confirmed cases, bringing the total number of active cases to 48,040. Of the active cases, about 84.6 percent are mild, 10.7 percent are asymptomatic, 1.6 percent are severe, and 3.2 percent are in critical condition. The majority of the new confirmed cases were from the National Capital Region with 565, followed by the provinces of Cavite (174), Pangasinan (145), Northern Samar (104), and Quezon (98). The DOH also reported 50 deaths, which brings the death toll to 6,497. Of the 50 deaths, 34 or 68 percent occurred in October, nine or 18 percent in September, five or 10 percent in August, and one or 2 percent each in July and June. "About 99 duplicates were removed from the total case count, and 77 of these were recovered cases and two were deaths. Moreover, seven cases, which were previously tagged as recovered, were reclassified as deaths," the DOH said. As of Wednesday, the 112 DOH-licensed reverse transcription - polymerase chain reaction laboratories and 35 GeneXpert laboratories have done a total of 4,012,853 tests nationwide.

The DOH said it has 20,600 beds dedicated to Covid-19 patients. Occupied are about 47 percent of 1,900 intensive care unit beds; 45 percent of 13,300 isolation beds; and 42 percent of 5,400 ward beds. About 24 percent of 2,200 ventilators are in use. Meanwhile, the number of Filipinos abroad who have recovered from the coronavirus disease 2019 (Covid-19) is now 7,175 after three more have been added to the tally as of October 15, the Department of Foreign Affairs (DFA) said Thursday. The total confirmed cases are currently pegged at 11,141 after 24 new infections were recorded in the Asia Pacific, Europe, the Middle East, and the Americas. As of this writing, there are 3,155 active cases, 520 of whom are undergoing treatment in the Asia Pacific, 173 in Europe, 2,295 in the Middle East/Africa, and 167 in the Americas. The death toll still stands at 811 as there were no recorded fatalities. "The DFA shall continue to keep track of the status of overseas Filipinos and stands ready to assist and facilitate repatriations, whenever possible," the department said. To date, the total number of countries and regions with confirmed cases among Filipinos is 81, following a confirmed case reported in one country in Africa. (MNS)

Palace assures Covid-19 vaccine’s affordability
