83-year-old Filipina celebrates life and freedom for the first time A s the country celebrates its independence this 4th of July, freedom takes on a new meaning for Fedelina Lugasan, a victim of modern-day slavery and human traﬃcking. For decades, the 83-yearold Filipina was enslaved and coerced into a life of domestic servitude without pay or any days off. Fedelina Lugasan was rescued earlier last year in Northridge, California, by the Federal Bureau of Investigation (FBI)

LA County’s DCBA’s online dispute resolution program to get award The Los Angeles County Department of Consumer and Business Affairs (DCBA) will be honored with a prestigious national award for its innovative program to help consumers resolve their disputes in a convenient, cost-free manner. DCBA’s Online Dispute Resolution Program (ODR) will receive a 2019 Achievement Award in Information Technology by the National Association of Counties (NACo) at the agency’s annual Conference and Exposition, which is taking place this weekend in Clark County, Nevada. Today’s consumer and business owners demand quick, convenient service and DCBA has answered the call. DCBA launched the Online Dispute Resolution Program in 2015 as a new, effective, and transparent space for parties to resolve their disputes. DCBA mediators, who act as neutral third parties to help parties settle their disputes as an alternative to going to court, guide the parties to use their own personal electronic devices from a location and time of their choice. Since the ODR program was implemented, mediation requests at DCBA have increased 3,000 percent. Three of every four DCBA mediation cases are handled through ODR. DCBA is the only government agency in Southern California that provides free online dispute resolution. DCBA’s ODR program is helping communities across Los Angeles County, including people experiencing homelessness. Every month, DCBA mediators connect with people experiencing homelessness in Downtown Los Angeles and help them access our online services so they can work toward resolving their disputes with other individuals or businesses. “Our department prides itself on innovation and serving consumers and business owners in new, forward-thinking ways,” said Joseph M. Nicchitta, Director of the Department of Consumer and Business Affairs. “Our Online Dispute Resolution Program is a perfect example of how government can adapt its methods to meet the needs of our online-centric world. assisted Lugasan during her rescue and in finding her path to independence by providing access to medical care, housing, food and legal support services. She was also introduced to a community of Filipinos who now call her “Nanay,” which means mother in Tagalog. After months of investigation, Cox was put on house arrest, sentenced to probation for 5 years and ordered to pay $101,119.98 in restitution. Pilipino Workers Center also leads a workplace justice campaign that brings abused workers to justice by fi ling wage claims and restitution of wages. With the assumption that Fedelina has been working round-the-clock from the day of her arrival in the US, PWC estimates that the total back wages should be a minimum of $1,625,856.00. This is based on the California minimum wage from the time she started working for Cox’s family in the United States in 1980, up until the time of her rescue in 2018, excluding overtime pay. “Although we celebrate her freedom from slavery, it is a bittersweet victory knowing that Nanay Fedelina’s restitution did not even come close to a tenth of the back wages that she deserved. The results of her case highlights the brokenness of our judicial system and exposes a greater need for reform in legislation of anti-traﬃcking laws and better protection policies for human traﬃcking survivors,” said Aquilina Soriano Versoza, executive director of Pilipino Workers Center. Lugasan was born in Leyte, a province in the Philippines. At age 16, she was recruited by Cox’s mother, to work for their family as a live-in domestic worker. With the promise of a better life, Lugasan was brought to their home in Manila - the Philippines’ capital. She worked by doing all kinds of household chores and taking care of the children. But she ended up not getting paid for her services. Though she wanted to leave, she was left with no money or any other means to go back to her hometown. With her back against the wall, Lugasan stayed. At age 28, Lugasan was brought to the United States to take care of Cox's sister who was sick at that time. But she ended up working for the entire family. For over 30 years, Lugasan served them by cleaning, cooking, gardening, taking care of children and more, all without any pay and no days off. She lived in a house with 4 bedrooms and 3 bathrooms but slept on the floor. She did not have a bed. Lugasan reports, “One time, when I asked for money, Cox’s mother got mad at me. I told her I wanted to leave but she said to me”, “Where would you go?” She adds, “Her family would always tell me, “If you leave the house, we will call the police and tell them you stole many things.” I was scared. I never stole anything. But I also I did not know anyone or have anyone to help me. I did not want to be put in jail for

something I did not do.” At some point, Lugasan realized that Cox hid her passport and birth certificate. When she asked to get them back, Cox violently refused. Without any form of identification, no money and nowhere else to go, Lugasan experienced even more abuse and exploitation. For years, the family continued to deceive her and instill immense fear by projecting threats of deportation and arrest. “About two months after the Northridge earthquake in 1994, Benedicta sold her house because it was damaged by the earthquake. We moved to another house in Northridge. During this time, I was also the household help for Benedicta’s daughter. I cleaned their house, cooked for the whole family, and did laundry for them. Her family included her 2 kids and husband, as well as mother-inlaw and sister-in-law. I took the bus at 5:30 AM to their house, got there by 6 AM then went back to the Northridge house late at night. I did this for 18 years, from when the older child was born until he was 18 years old. I did not get paid for doing this,” claims Lugasan. As the family’s slave, Lugasan was not given the care that she deserved. Even when she was sick, they would force her to work and even accused her of faking illness. Once, she was pushed and almost fell down the stairs. “I worked and worked even when both my hands and feet were hurting. When it got really bad, my tears would just roll down my cheeks. I felt so helpless,” recalled Lugasan. Lugasan’s case is not an isolated one. Modern-day slavery happens more often than people think. Lugasan lived in a typical residential home in Los Angeles and in the San Fernando Valley. She did normal day-to-day activities like riding the bus, going grocery shopping, picking up the kids from school. And yet, it took 38 years before someone identified her as a possible victim of abuse. have a confession to make. Years ago in Manila, Korean Drama kept me up until wee hours. I was so addicted.

My son, Philip who watches his 8pm bedtime religiously, would preach about melatonin and serotonin. He told me- “Ma, there is a reason why it’s called beauty sleep.” Lack of sleep can cause bad skin and weight gain. He was ahead of his time Watching KDrama, it turns out, is not a recipe for good sleep. I belonged to generation who believed that “5 hours shut eye is enough” and that sleep was for wimps. Attitude about sleep has shifted, though. America is now obsessed with sleep. There are now thousands of studies that preach on the healing power of sleep. It’s not enough that we get eight hours. The REM kind, they say, produces hormones that decreases stress and gives us good skin. And we’re right to take sleep seriously. Sleep deprivation affects us physically and mentally. It affects our ability to focus. I have signed up countless car accident clients who were rear ended by a tired driver. Drowsiness, due to lack of sleep is as bad as drunk driving Sleep makes us nicer and maybe even wiser. Who isn’t grouchy when they have little sleep?

Community What keeps you awake at night? The eye candy KDdrama stars who looked like angels on earth and dress the way most of us would in our dreams, invaded my nights and my bedroom. When we allow work, worries and technology inside our bedrooms, we lose our innate ability to sleep. Years ago, when I was a new single mom back in Manila, financial worries kept me awake. How I do I pay for tuitions fees and car amortization? These days, I have other reasons that keeps me up at night. Living in America, I am in two time zones. As I get ready for bed, my sons in the Philippines are waking up to start their day. Technology means I am always connected. My brain never switches off. The business of sleep – from designer mattresses, expensive essential oils to rub between your toes, sleep consultants and 11 kg blankets that mimics the feeling of being hugged -– is now worth $40bn. Restful nights are a luxury. A nice cup of chamomile tea is a thing of the past. This new “sleep religion” has rubbed off on me. I learned to take sleep seriously. I embraced a new lifestyle to help me get to REM level. I curbed my coffee intake from three cups a day to one. Caffeine stays in our system for eight hours. It keeps our brains active and lit up like Christmas tree, even in sleep. In maid less America, where we do all housework- minus the house help I was used to back home - I get so obsessed with cleaning when I get home from the work. These days, I learned to slow down. I should be done with everything by 9pm to give me at least an hour to unwind before I hit bed at 10pm.

Over 100 Pinoy performers in LA to compete in WCOPA By ABNER GALINO

oVeR 100 mostly young Filipino singers, dancers and performers arrived in Los Angeles this week to compete at the 23rd World Championships of Performing Arts (WCOPA). The Philippine contingent arrived on Wednesday at the LAX with popular singer Jed Madela as its lead oﬃcial. Madela was WCOPA’s 2005 “grand champion performer of the world.” The Filipino competitors will see action in the different categories in WCOPA from July 12 to 21. In 2016, the Philippine team won the grand championship title through the dance group Junior New System. The same group that made it to the finals of Asia’s Got Talent. Last year, WCOPA Team Philippines brought home 55 gold medals out of

the 286 medals, plaques, and badges that it garnered. The Philippine contingent will be competing against 52 countries in the annual Olympic-style international meet of aspiring singers, musicians, dancers, variety artists, actors, and models around the world. The members of the team who will make it to the finals of the competition will get to perform at the Long Beach Performing Arts Center where the awarding will also take place. Before coming to the US, the delegates held the traditional Blue Jacket Ceremony where they were recognized as oﬃcial Philippine delegates. The ceremony was led by WCOPA Hall of Fame member and WCOPA Team Philippines Regional Director Jed Madela.

But no matter what I do, there are very few nights that I don’t wake from deep sleep. Through the night, I check my phone- I think of home. The wonders of facetime allows us to have conversations, face to face. It soothes loneliness of separation. It also means that my phone is never silent. Just in case. Are they ok? Is there typhoon? Where was the last earthquake? This is the real cost of migration. Sleep deprivation. Nothing tests our faith more than separation from our family. The helplessness of knowing that we are thousands of miles away. Not even expensive pillows and oily toes help. I once heard by husband pray with Ethan, our grandson this way“Now I lay me down to sleep, I pray the Lord my Soul to keep, If I die before I wake, I pray the Lord my Soul to take” Looking at Ethan’s eyes made me realize how scary this prayer sounds to a child! “If I die before I wake??” And so, I said – “Ethan, let me pray with you, again.” Simply, we thanked the Lord for the day and asked Him to protect our families in the Philippines and Michigan. And so, I went back to my “old religion”. One that has kept me and my children at peace, prayers. caReGIVeRs working in Residential Care Facilities provide an important service to elderly and disabled individuals, as well as their families. These caregivers often work up to 24 hours per day, providing necessary care and supervision to ensure the health and safety of each facility resident. However, many facility caregivers are grossly underpaid for the services they provide. Fortunately, California law protects caregivers who work in licensed Residential Care Facilities from wage theft. Specifically, all facility caregivers are entitled to receive at least minimum wage for every hour they work, including all hours they are required to be present at the facility. The current minimum wage rate in California is $11.00 per hour for employers with 25 employees or less, and $12.00 per hour for employers with 26 or more employees. Additionally, with some exceptions, facility caregivers are also entitled to receive overtime compensation for all hours worked in excess of 8 per day or 40 per week, and double time compensation for all hours worked in excess of 12 per day. In light of these requirements, facility caregivers, who work 24-hour shifts, must be paid at least $418 per day to comply with California’s minimum wage laws. That includes 8 hours of pay at the minimum wage rate of $11.00/hour ($88), four hours of pay at the overtime rate of $16.50/ hour ($66), and 12 hours of pay at the double time rate of $22/hour ($264). In lieu of paying overtime and double time wages, many employers pay facility caregivers a fixed salary, regardless of the actual number of hours they work each day. However, paying an employee a fixed salary, predetermined in advance, does not disqualify that employee from receiving minimum wage or overtime compensation. In fact, the salary paid is sometimes far less than the legally required minimum wage. More importantly, payment of a fixed salary to a non-exempt employee only compensates that employee for their regular, non-overtime hours worked. This means that a non-exempt facility caregiver, who receives a set rate of pay or fixed salary for the work they perform, has not been compensated for any hours he or she worked in excess of 8 per day or 40 per week. Furthermore, those uncompensated hours are considered overtime hours, compensable at the legal overtime rate of one-and-one half the facility caregiver’s regular rate of pay.

For purposes of illustration, below is an example of how wage and hour claims are calculated for facility caregivers under California law: Tony is a facility caregiver. He works 24-hours per day and is not allowed to leave the care facility at any time during his scheduled shifts. Tony’s employer also requires him to sleep in the facility at night and the residents frequently wake him asking for assistance. Tony receives a daily salary of $100 each day he works. This makes Tony’s regular rate of pay $12.50 per hour ($100/8 hours per day). Subject to that calculation, Tony’s overtime rate is $18.75 per hour and his double-time rate is $25 per hour, respectively. Because Tony’s daily salary of $100 does not compensate him for any overtime hours worked, Tony’s employer owes him $375.00 per day in unpaid wages: 4 overtime hours x $18.75 (Tony’s overtime rate), plus 12 double time hours x $25.00 (Tony’s double time rate). If Tony works 5 days per week, he is owed $1,875 per week, which equals $97,500 each year he works. If Tony brings a claim against his employer for these unpaid wages, he can seek unpaid wages going back four years, along with interest, attorney’s fees and costs, liquidated damages and penalties. DOT ‘appreciates’ Isko’s street-clearing ops in Manila ManILa — The Department of Tourism (DOT) on Wednesday expressed appreciation for the steps taken by Manila Mayor Isko Moreno in clearing up streets and sidewalks in Divisoria and other areas in the country’s capital city, noting that this would help make destinations more accessible to tourists. “The efforts of Manila Mayor Isko Moreno is very much appreciated in making the areas more accessible to tourists because we are aiming to provide our tourists with a more diverse tourist offerings here in Manila,” said DOT Assistant Secretary Roberto Albado III in an economic briefing at the Malacañan Palace. “So just imagine if our tourists can walk around the streets of Manila and at the same time enjoy the food in Binondo at a more organized manner,” he added. Alabado pointed out that Manila has always been a premier destination of tourists who, upon landing, would immediately visit several sites including Intramuros, Rizal Park, Divisoria, and Binondo. He described Divisoria as “a shopping paradise”, particularly for Southeast Asian tourists.

Meanwhile, Alabado also addressed concerns on the relocation of vendors in Divisoria, noting that his department continues to work closely with the Manila mayor’s office to ensure that they get to keep their livelihood. “The Secretary has ordered or instructed the regional office of NCR (National Capital Region), the Intramuros Administration (IA) to work closely with the mayor’s office so that we can coordinate our efforts,” Alabado said. “This is a local thing--the relocation of our street vendors but as we have always said, the more tourists that we can provided access to Divisoria, Binondo and Intramuros the more economic activities that can be spurred in those local destinations,” he added. Moreno also continues to hold dialogues with vendors and other stakeholders to determine areas they can sell in without getting evicted. According to Alabado, the tourism industry was responsible for creating 5.4 million jobs in 2018. “Livelihoods spurred by tourism have a ripple effect as workers are able to support families, put their children to school, and give them a secure future,” Alabado said. SC asked to unseat 8 incumbent senators, compel Comelec to impose term limits on elective ofﬁcials tHe Supreme Court (SC) was asked Monday to declare unconstitutional the election of eight incumbent “termed out” senators and several members of the House of Representatives and to compel the Commission on Elections (Comelec) to enforce the term limits on elective officials, particularly those in Congress, in the 2022 elections. In a petition, the incumbent “termed out” senators were identified as Senate President Vicente Sotto III, and Senators Franklin Drilon, Panfilo Lacson, Francis Pangilinan, Lito Lapid, Ramon “Bong” Revilla Jr., Pia Cayetano, and Aquilino “Koko” Pimentel III. The petition pleaded that “the election of the termed out legislators and local elective officials be declared unconstitutional such that if this case would be determined prior to the expiration of the term of the termed out elective officials, the remaining balance of their unexpired term be declared vacant to pave the way for the election of fresh aspirants who would not suffer from the inhibition of the term limit rule.” The petition which was filed by a group of lawyers and private individuals told the SC that under the 1987 Constitution, a senator cannot serve for more than two terms of six years each or a total of 12 years, while a member of the House of Representative has a term limit of nine years for three consecutive terms of three years each. This means, the petition stated, that once a person is elected senator and has served consecutively for two terms or a total of 12 years, he or she cannot run

again and be elected senator for the rest of his/her life. It added that the same rule applies to those elected for three consecutive terms or a total of nine years for members of the House of Representatives. They cannot run again and be elected congressmen. The petition was filed by Vladimir Alarique T. Cabigao, Yen Makabenta, Mary Wendy A. Duran, Monolito Coronado, Socorro Marcel Namia Nepomuceno, Jef Nalus Aquino, Antonio Santos and Cesar Evangelista. The Comelec was named respondent. They cited Sections 4 and 7, Article VI of the Constitution. Section 4 provides, among other things, that “the term of office of the Senator shall be six years and shall commence, unless otherwise provided by law, at noon on the thirtieth day of June next following their election and that no Senator shall serve for more than two consecutive terms.” Section 7, on the other hand, provides, among other things, that “the members of the House of Representatives shall be elected for a term of three years which shall begin, unless otherwise provided by law, at noon of the thirtieth day of June next following their election, and no Member of the House of Representatives shall serve for more than three consecutive terms.” The petitioners told the SC that the Comelec “has failed, for the past 32 years, to implement Sections 4 and 7, Article VI, 1987 Constitution that makes this petition imperative to be filed with the Supreme Court in the absence of ‘other plain, speedy and adequate remedy in

PH communities urged to adopt program vs. gender-based violence ManILa — The Swedish Embassy in Manila is hoping that communities nationwide would adopt their own awareness campaign against gender-based violence as it continues to promote the "Respeto Naman" initiative, a program that seeks to bring the issue of rape and sexual harassment into the mainstream. "I hope that this campaign will result in the work continuing at the local level," Swedish Ambassador Harald Fries said in a media interview at his residence in Makati City on Tuesday. "The message of Respeto Naman needs to reverberate not just in Metro Manila, but also to the farthest towns in the Philippines as it tackles important, but often overlooked questions," he pointed out, referring to the sufficiency of laws protecting women from exploitation, harassment, and rape, and whether social norms are enabling a culture of abuse of women. Maica Teves, executive director of the Samahan ng mga Pilipina para sa Reporma at Kaunlaran (SPARK!), echoed the envoy's sentiments and expressed hopes the campaign will not just end on advocacy and awareness. "We want to change policy regarding

our rape laws, we would like this under our gender and development program, all local government agencies have that budget and we hope that the topic of gender-based violence could be part of their activities," she said. After its successful run in Metro Manila, the campaign is now gearing up for a wider audience, with stops in Cebu, Bacolod, Iloilo, and Naga. On July 18, the movement will take on its first Visayas leg in Cebu City, starting with the exhibit display of "Don't Tell Me How To Dress" at the Ayala Center Cebu. Padilla in 1987, 1995, 1998, 2001, 2007, 2010, 2013.” The petition, filed through lawyer Socorro Maricel Nepomuceno, asked the SC to compel the Comelec to deny the certificates of candidacy of senators, members of the House of Representatives and local elective officials in the upcoming May 2022 elections and in future elections for having served beyond their term limits. It said that the Comelec has failed, to enforce the term limits by allowing elective officials to have respite or “hiatus,” despite the absence of such permission in the text of the said provisions in the Constitution. It stressed that the provisions in the Constitution on term limits are regulatory rules whose aim is to restrict conduct for particular purposes such as to “guarantee equal access to opportunities for public service.” “Sections 4 and 7, Article VI, 1987 Constitution do not grant power. Rather, they limit the grant of power. If they are limitations to a grant of power, the more that they should be construed narrowly or restrictively,” it said. “Hence, the respondent Comelec cannot expand the limitation of power by allowing aspirants for the office of a senator or member of the House of Representatives to seek a third or fourth term after serving ‘two or three consecutive terms,’ respectively,” it added. Recto ﬁles bill proposing one evacuation center per town

senate President Pro Tempore Ralph Recto is again pushing for the establishment of multi-purpose gymnasiums in each of the towns and cities in the Philippines to serve as evacuation centers in time of calamities. Recto filed Senate Bill No. 47, or the proposed Multipurpose Gym in all Municipalities and Cities Act, as one of his priorities in the 18th Congress. In pushing his “one tow n, one evacuat ion center” proposal, Recto stressed anew the need for evacuation centers to avoid schools from being used as the default refuge of residents during calamities and conflicts. “If there’s one reason why we should put them up is that they will prevent schools from becoming default evacuation sites during calamities, a practice which turns students into displaced persons,

when their learning is disrupted,” Recto said in a statement. The Senate leader added that the building of multipurpose gymnasiums “addresses both the shortage of sports facilities in towns and the need for a disaster-resilient building people can seek shelter in during calamities.” In his bill, the g yms must be able to withstand 300 kilometer per hour winds and an Intensity 8 earthquake. These should also serve a s t he of f ice a nd t he equipment depot of the local disaster response and mitigation teams. Recto said the buildings should have toilet facilities and a clinic area, and be spacious enough to install modular cubicles for families during evacuation. Meanwhile, Recto lauded t he Depa r t ment of Public Works and Highways (DPWH) for building 82 evacuation centers in 52 provinces. He said 55 more are underway. DEATH THROUGH LETHAL INJECTION It was Major General Vicente G. Vinarao, then Director of the Bureau of Corrections who organized the use of lethal injection as a medium for carrying out death penalty. This was in 1997. A year later, the lethal injection chamber rose up as every piece of screw has been installed and all the pre-fab materials built around the facility have been properly attached including the gurney, that which is used to be the “death bed” of the convict. On this score, the first convict that would undergo the procedure would be sent back to his creator no longer through electrocution but through a cocktail of deadly injectable dosages introduced intravenously. Death via electric chair had seen better days and the fledging contraption, while a dreaded piece of furniture in the past could no longer be able to cope up with the exigencies of times. As if intended, the death chamber where the electric contraption was situated gutted fire and from then on never repaired. What used to be a haunting corner of the penitentiary that invites controversy and public spectacle became a vacant ruin. Death by electrocution has been replaced by Death by Lethal Injection as soon as the capital penalty was legislated anew. An upsurge of heinous crime disturbed the nation’s nerves. Government began to flexed its legislative muscle until Congress revived the death penalty law. Under said law, the mode of execution to be carried out would be through lethal injection. The courts had to deal with horrendous crimes, from massacre to rape to serial offenses. Violation of drug laws were likewise meted with death penalty. (The Ramos government however never had time to implement the law because of term limits and the gauntlet was passed on until the Estrada government took over.) Penal experts here and abroad claim that the use of lethal injection carries a lighter emotional load than the horrific scene shown through electrocution. Note that the electric chair con-

ducts a full transmission of 3,300 volts as it flows through the body of the condemned man. There were instances when the scent of burnt flesh would trail within the enclosed chamber aggravated by a wailing cry of pain which could be heard from a distance. Historically, there were around 65 convicts who perished under electrocution. For a brief period, it was traditionally used by the State in executing those condemned to receive the law death penalty until the capital punishment of death was abolished under the 1987 Constitution. Years before that during Martial Law, government-imposed death via firing squad. In the late 90s and through lethal injection, the cost of sending the condemned man to life hereafter was P10K. The cost may be tripled at the present rate and may increase in the succeeding period. During the period from 1998 to 1999, there were 9 convicts executed before the death penalty law was stayed. And during those trying times when the supreme penalty was applied without glitch, I was named not only as the face who dealt media with updates as spokesman but also would double as the one in charge of the execution. I could not forget those times. On the day of execution, I was directed to man the booth where the Red Phone was installed. It was directly wired to the Office of the President, and I was instructed to wait for Presidential instructions should there be any executive intervention. The Department of Justice under then Justice Serafin Cuevas directed then Corrections Director Pedro Sistoza that I should keep media posted and if the ranks of phlebotomists would turn their backs on their responsibilities, it would be me and my staff that would take over. At that time, the lobby of the Church reached and affected the conscience and stand of most correctional practitioners. Secretary Cuevas assured then President Joseph Estrada that death penalty will not be saddled

with problems. Then President Joseph Estrada wanted to show the world that he is decisive and that death penalty can be conducted without hitch. That time, it was a good 23 years when the last execution was made. After the Cory government, which abolished death penalty, Ramos administration re-introduced the death penalty law on 11 crimes. (the previous death penalty law specified around 23 crimes). While previously, there were around 800 prisoners under death penalty, under the Cory government’s abolition of death penalty, all penalties on capital punishment were technically reduced to life imprisonment. As the death penalty law was re-introduced, a number conviction imposing death penalty had been decided. The term of Ramos government ended as the Estrada administration ushered in. Six months after being sworn to as Chief Executive, President Estrada was informed by the Secretary of Justice Serafin Cuevas on the impending execution. The Bureau of Corrections received already a letter from the court with an assigned date for the execution of death penalty. (The procedure there is that after the high tribunal, the Supreme Court, has affirmed the penalty of death, the papers of the convict go down to the lower court, that branch which meted the capital offense for determination of the day of execution. Once a date is scheduled, the court sends a letter memo to the Director of Corrections--who in turn advises the Secretary of Justice, to prepare the necessary groundworks and proceeds with the execution unless a reprieve order is issued by the Chief Executive.) It was the case of Echegaray, the step father who raped his step daughter repeatedly. A case of statutory rape since the victim was a minor. The penalty was death. The lower court has ruled, affirmed with finality by the Supreme Court, brought the affirmation back to the lower court and now the lower court upon receipt of the final verdict, has given the date. The Bureau of Corrections in receipt of court determined schedule, after more than two decades of silence, will have to exercise the power of the state to impose the extreme penalty of death. And so, it goes without saying, the first execution was conducted successfully one fine day of February 5, 1999.

Rates are still considered low, you are better off paying off 17+% credit card interest rates, you are better paying off 8-10% student loans with these low rates being offered now for home mortgages. For homebuyers, Stocks and Bonds are losing a lot of steam and it might have a correction this year. WHAT IS THE DIFFERENCE BETWEEN AN ANNULMENT AND A DIVORCE? What is the difference between a divorce and an annulment? Many people think these concepts are the same and interchangeable. There are many differences between the two concepts. A divorce ends a valid existing marriage. In a nullity, a determination is made about the validity of the marriage itself. When a marriage is annulled, it has the same effect as if the marriage never existed. A nullity results in a void. In California, any spouse can obtain a divorce regardless of the reason. A common basis used is a catchall phrase “irreconcilable differences.” However, anyone who wants to end a marriage can end the marriage and there is nothing the other spouse can do to stop that. However in a petition for nullity, the court will not automatically grant you the nullity. There has to be a legal basis for seeking the nullity as outlined in the family code. Some of the basis are 1) entering into a bigamous marriage 2) incestuous marriage 3)fraud in obtaining the other spouse’s consent to marriage 4) incurable physical incapacity 5) unsound mind among others. The petitioner would have to prove one of these grounds in court to be able to get a nullity. In a Nullity, there is a statute of limitations. That means you have to file your nullity within a certain time period depending on the basis for seeking the Nullity. Each ground has a different statute of limitation. For example, if you are filing the nullity based on fraud, you have to file within 4 years of discovering the fraud. If you blow the statute of limitation, this can be used as a defense to dismiss your case. On the other hand there is no statute of limitation in a divorce. You can file a divorce at any time regardless of how long you have been separated from your spouse. In a divorce, husband and wife are presumed to be the parents of children born during the marriage. In a Nullity, the marriage has no validity so it will affect the presumption of parentage of the children. The Court will have to make a finding of parentage for the children on a different basis before it can make

orders relating to custody, visitation, and support. The treatment of spousal support (alimony) is different between the two. In a divorce, the spouse that has less earning capacity and access to resources may seek an award of spousal support. This is not available in a Nullity since the marriage is invalid and there is no spouse as a result. The division of property is also different. In a divorce, community property is divided equally between the spouses. In a nullity, since there is no valid marriage, there is no community property created and properties are not divided between the spouse. Similarly, neither party can receive survivorship benefits and inheritance rights from the other party in a Nullity. Finally, there are different immigration consequences between a divorce and a nullity when an immigrant spouse is involved. In a divorce, the immigrant spouse who obtains a greencard from a US Citizen spouse stands a bigger chance of keeping his or her greencard and ultimately become a US Citizen. In a nullity, the immigrant spouse may lose their greencard status when the marriage is found to be invalid since it is the basis for the greencard. Recent earthquakes rattled Southern California residents - are we prepared for the “Big One?”

he recent 6.4 magnitude earthquake which initially rattled Southern California residents on the morning of Thursday, July 4, 2019, was quite an eye-opener. Though our family wasn't in the Los Angeles area at the time but were spending the holidays on the 34th floor of a Las Vegas hotel, we were all quite rattled because as with our previous experience in the Northridge earthquake, we were again unprepared for it. Two days after, on Saturday, July 6, 2019 as we were coming home in Los Angeles around 8:00 pm, the second quake with a magnitude of 7.4 jolted all of us once more.

Thus, we are all sort of wondering that the fabled "Big One," which geologists have warned, is forthcoming. It has been known that this "Big One," has long been "lurking around," and is likely "overdue." along the San Andreas Fault. The two recent simultaneous quakes, allowed us to search for news on where the epicenter was. Apparently, it was in the area of Ridgecrest, California. The 7.1 magnitude's epicenter was about 10 miles northeast of Ridgecrest. The earthquake sequence started with a 4.0 quake 11 kilometers (6.8 mi) southwest of Searles Valley, then at 10.33 A.M. the 6.4 quake struck 12 kilometers (7.5 mi) southwest of Searles Valley; in total over 1,400 aftershocks struck Searles Valley and Ridgecrest for two days on July 4th and July 5th. Unfamiliar with the area of Ridgecrest, this writer was intrigued to look it up on Wikipedia and below is a brief history of the area: "Ridgecrest is a city in Kern County, California, along U.S. 395 route (the lovely scenic route which we usually take going north to Reno and Lake Tahoe areas), adjacent to the Naval Air Weapons Station China Lake. It was incorporated as a city in 1963. The population was 27, 616 on the 2010 census, up from 24,927 on the 2000 census. The city is surrounded by four mountain ranges: the Sierra Nevada on the west, the Cosos on the north, the Argus Range

on the east and El Paso Mountains on the south. It is approximately 82 miles (132 km) from the Lancaster/ Palmdale area, 110 miles (177 km) from Bakersfield and 120 miles (193 km) from San Bernardino, the three nearest major urban centers. Lizquen IF there's anyone who can emerge from surgery and still be adorable, it's Liza Soberano. The actress recently underwent surgery for her injured finger in the United States, and a video now circulating on social media shows her waking up from it and not really recognizing who her boyfriend is. In the video, taken from the Instagram stories of Liza's aunt Jonilyn Castillo, Liza is shown lying on a hospital bed and still apparently coming down from the effects of anesthesia. When her on- and off-screen partner Enrique Gil turns up at her bedside with flowers, she asks him: "Who are you?" "It's me, it's Quen," he replies, laughing. She then continues to ask him who he is, while drifting in and out of sleep. She later posted several photos on Instagram on July 6, to show the metal plates that were placed in her finger, which she said "will never function in the same way again." "Finally done with my last procedure in hopes of fixing my finger," she said. Earlier in June, Liza took some time off as she healed from a bone infection related to the injury. "I was supposed to have surgery to remove my plates but, it turns out that we were dealing with more than just protruding hardware. During surgery the doctor discovered that my bone wasn’t healed and that I also had a bone infection," she explained. The injury, which she sustained while filming the teleserye Bagani in 2018, required Liza to undergo several surgeries, and led Liza to drop out of her role as the iconic superhero Darna in the upcoming film remake. Thai beauty queen aspirant criticized for calling Catriona Gray 'fat'

Thai beauty queen contestant is being criticized by pageant fans after she posted a photo of Miss Universe 2018 Catriona Gray that described her as fat. Miss Grand Nak hon Phanom 2019 Coco Arayha Suparurk posted on her Instagram stories a photo of the Filipino-Australian beauty queen next to that of Miss Grand International 2018 Clara Sosa. In the photo, Clara was described as fit while "fat" was put on Catriona's photo. The photo has since been deleted but a number of pageant fan pages and websites were able to screenshot the post. Fans have since bombarded her Instagram account, calling Coco out bodyshaming Catriona. Both Coco and Catriona have yet to respond to the issue. Why fans are reacting. ‘Artwork by the sidewalk’: Ilonggo painter’s life changes after going viral By Rhick Lars Vladimer Albay

ILOILO CITY, Philippines – A lot has changed for 52-year-old artist Larry Casinao since he first displayed his artwork on the sidewalk of Jaro, Iloilo. Casinao has made a living from selling his art for 25 years now, struggling to make ends meet given the twice-weekly dialysis sessions needed by his wife. In late June 2019, Casinao went viral as the lolo artist (grandfather artist) after photos of him painting and displaying his artwork along a corner street near Jaro Plaza – a major thoroughfare in the city – were shared on social media by Ilonggo student Sal Molinos. “While [I was on] my way home, I saw this lolo who was busy painting, with a lot of other paintings displayed along the sidewalk. It’s sad to see a local artist not having a proper venue to showcase his art and talent,” shared Molinos on his original entry, dated June 23. As of writing, the Facebook Rappler post has gained at least 2,400 shares and 3,100 reactions. “I hope he gets the recognition he deserves because he puts so much passion into his work,” continued Molinos. The viral post has enabled many benevolent people to reach out to Casinao to offer help in their own ways.

Difficult days

The self-taught artist, a father of two, admitted that art has not been the most lucrative trade, but it largely sufficed in providing for his family for a while. Four years ago, however, Casinao’s wife Angelita was diagnosed with a failing kidney, requiring her to undergo at least two dialysis sessions weekly. Since then, they struggled to keep a roof over their heads. With his craft falling on hard times, he decided to take things into his own hands. “Ang na-agyan namun hindi basta-basta (What we’ve been through has not been easy),” Casinao told Rappler. Casinao, who hails originally from Baldoza, La Paz, completed a 2-year drafting course at the former Iloilo School of Arts and Trades.

A few years ago, he started selling both his oil paintings and charcoal portraits house-to-house to potentially reach more people and garner more sales. Casinao’s endeavor brought him to the farflung Iloilo towns of Dumangas, Janiuay, and Barotac Nuevo, among others. However, he admits that days would fly by without him selling a single painting. “May mga adlaw gid nga zero ka na, gutom ka pa, kapoy ka pa. Kilanlan ko pa mangutang para lang may iplete papuli, kis-a gahibi nalang ko sa dalan,” (There were plenty of difficult days when I made zero sales. Two months ago, Casinao decided to regularly put up his artwork outside an abandoned building along Rizal Street, across Jaro Plaza – hanging his pieces from a rusty chain-link fence to create his own humble gallery. While displaying his work, he would often also be found beginning a new oil painting by the side of the road. That’s when Molinos managed to take his photo and share it on social media.

Unexpected blessings

When Rappler contacted Casinao, it had been a few days since he had been able to set up his artwork at the public plaza due to a spell of rain. Vatican declares Pinoy teen ‘Servant of God,’ a step closer to sainthood

MANILA—A Filipino teen who spent most of his life helping street children before dying of an illness has been declared “Servant of God”, a step closer to sainthood. Rome bestowed the title upon Darwin Ramos on March 29, the Catholic Bishops’ Conference of the Philippines (CBCP) said Friday. Following the declaration, the Cubao Diocesan Tribunal will begin initiating the process for beatifying and canonizing Ramos. “The Vatican has given us the go-signal to go deeper in his life, how he lived his faith and how he gave witness to Jesus to whom he was very close,” Bishop Honesto Ongtioco of Cubao said in an article posted on the CBCP website. According to the CBCP, Ramos spent his childhood in the slums of Pasay, where he scavenged the streets with his younger sister. He was later diagnosed with Duchenne mus-

In 2006, Ramos joined the Tulay ng Kabataan, a non-government organization focused on helping street children. “Darwin is an example of holiness. After becoming “Servant of God,” the next step to sainthood is becoming a “venerable” after the person’s “heroic virtues” is recognized by the pontiff. A venerable will be approved for beatification once a miracle is attributed to his or her intercession. With the pope’s approval of a decree of a miracle, the person can now be beatified, earning him or her the title of “blessed.”

It blooms under sunshine and needs well-drained soil. It cannot withstand temperature below 13-degree Celsius so it needs to be brought indoors in winter. Unless a huge growth is wanted, pruning it is necessary as it grows quite large if left unpruned. Pinching the stems encourages new growth. Protect from strong winds. Moonﬂower. Its scientific name is Ipomoea alba. It is from the same family as that of morning glory. The difference is that its spectacular flowers unfurl from cone-shaped buds when the sun goes down unlike morning glory which blooms in sunlight and its color is white. It also remains unfurled on some cloudy days however it closes when sunlight touches it. It blooms all summer. Moonflower has huge robust vines which need the support of trellis to grow. Since it grows huge up to 10 feet it needs a huge trellis. It can also be grown on roofs. It requires little care or attention and can grow in any type of well-drained soil. A little compost from time to time gives good results. It requires water only when the soil is dry. It is a good self-seeder, dropping many seeds around the base of the support it grows on. In tropicals, it is perennial whereas in other areas it is annual. It gives out a powerful fragrance throughout the night. The plant is poisonous especially the seeds so keep it away from pets and small children. Flame Vine. Its scientific name is pyrostegia ignea or venusta. It is from the same family of trumpet vine. It grows very fast under full /partial sun. It uses tendrils to climb. It climbs over anything that offers support. It is great for fences, balconies, trellis, archways. It is better to avoid growing it near trees as it can

strangulate trees. It flowers most at the top of the structure it is growing on. This woody vine attracts hummingbirds and butterflies with beautiful long tubular orange flowers and is drought resistant. It needs to be pruned to control and avoid smothering of other plants. After a while, it learns to use the support of its older stems to send shoots up to grow. It enjoys growing free and wild. NSPIRED by his travels, Chef Nicco mase a version of this Sungaporean staple that adds more herbs and also cuts marination time from overnight to one to two hours.

INGREDIENTS Marinade: 1 kilo pork ribs 5 tbsp Knorr SavorRich Pork Liquid Seasoning 3 tbsp light soy sauce 1 tbsp sesame oil for marinade 1 tbsp flour

DIRECTION 1. Marinate the pork ribs: In a bowl, mix in your Knorr SavorRich Pork Liquid Seasoning, light soy sauce, and sesame oil. Once mixed, add in your pork and rub them well together with the marinate. Sprinkle some flour to thicken the marinade and make sure it sticks to the pork. Leave for 2 hours. 2. Make the sauce. In a pot, sauté ginger and garlic with some oil. Once done, add in your water and coffee. Then add your hoisin, Knorr SavorRich Pork Liquid Seasoning, sesame oil, and white sugar and let simmer for 5 mins.

In the armpit, this could be a deodorant or antiperspirant, or even a soap or detergent that the person uses to wash their clothing. Allergic contact dermatitis causes a red, bumpy rash that is very itchy. In the initial stages, fluid filled blisters may appear. People can work with a dermatologist to determine what is causing the reaction. Avoiding the allergen should clear the rash. Sometimes, patch testing is necessary to confirm the problematic ingredient. Certain medications can help relieve allergic contact dermatitis. Over the counter antihistamines can help with itching, and topical steroid creams may be enough to soothe a mild reaction.

As a result, the armpits are prone to pimples, boils, and other skin issues, which can be uncomfortable. Many everyday factors can cause armpit pimples and bumps, including friction, ingrown hairs, razor burn, and bacterial infections. Even though red bumps and pimples may all look the same, there are some distinct differences in how a doctor will diagnose and treat them.

Friction

The underarm area gets exposure to quite a lot of friction as the arms swing back and forth. Whenever skin rubs over skin, it is possible that injury, irritation, and even infection can result. The skin can also rub against tight clothing, the band on a bra, and the straps of a purse or backpack. This friction can contribute to inflammation and irritation in the armpits, leading to clogged pores and pimples. People often sweat in the armpits, even after using a deodorant or antiperspirant, and this moisture can worsen the irritation.

Razor burn

Routinely using a razor to remove the hair from under the armpit increases friction and irritation to the delicate skin in this area. Shaving the skin under the arms can sometimes cause a red, bumpy rash and skin irritation. It can be itchy and uncomfortable but tends to resolve within a few days. Razor burn is especially likely if a person uses an old or dull razor or does not moisturize the skin. Using an old or dull razor can also introduce bacteria into small breaks in the skin, which can lead to a skin infection, such as folliculitis, or boils, which can resemble pimples. If a person shaves the hair from their armpits, ingrown hairs may also result.

Ingrown hair

An ingrown hair is a hair that has grown out of the hair follicle and then coiled or curled around to grow back into the skin again. In some cases, an ingrown hair curls and turns back into the hair follicle before it even exits the skin. Ingrown hairs should resolve on their own. It is important to avoid picking at or breaking the skin over an ingrown hair as this can introduce bacteria, which may cause folliculitis.

Folliculitis

Folliculitis is an infection of the hair follicle. Folliculitis looks like a red bump in or near the hair strand, and it can contain pus or blood. If bacteria are the cause, people may treat folliculitis with antibiotics. An antibacterial soap, such as a benzoyl peroxide wash, can also help kill the bacteria on the skin. However, this can be very irritating to the skin in some individuals. It is best to speak with a dermatologist before using any over the counter antibiotics since these can sometimes cause an allergic skin reaction called allergic contact dermatitis. People can prevent reinfection by using a new razor and keeping the armpits clean and free of bacteria. Shaving in the direction of hair growth can help prevent folliculitis. There are other causes of folliculitis, aside from bacteria, which may require further evaluation by a dermatologist to diagnose.

Allergic contact dermatitis

A person can talk to a dermatologist to determine what is causing their allergic contact dermatitis. Allergic contact dermatitis occurs when the skin comes into contact with a substance or ingredient to which the skin is allergic.

immune-boostinG compound FiGhts deadly pancreatic cancer WASHINGTON -- Scientists in the United States have identified an immune-boosting compound that could significantly shrink the pancreatic tumors in animals when combined with immunotherapy. The study published on Wednesday in Science Translational Medicine showed that in mice experiments, the compound worked to reduce tumor growth and metastases of the pancreatic cancer, a disease so deadly that only eight percent of patients are still alive five years after diagnosis. In theory, immunotherapies release the brake on immune T cells to prod them into killing cancer cells. In practice, those therapies worked only for fewer than five percent of pancreatic cancer patients. The researchers then realized that myeloid cells in and around tumors can either tamp down or ramp up the immune response by releasing molecules that affect how many T cells are recruited to the tumor. In pancreatic tumors, however, myeloid cells typically suppress other immune cells, according to the study. The researchers from Rush University in Chicago found a compound called ADH-503 that could interfere with the migration of myeloid

cells. Administering the compound to mice with pancreatic cancer decreased the myeloid cells and increased cancer-killing T cells in the tumor, according to the study. Then, the researchers including those from Washington University School of Medicine treated those mice with a standard immunotherapy in conjunction with ADH-503, and they found that the tumors shrank and the mice survived significantly longer. In some experiments, all the tumors disappeared within a month of treatment and all the mice survived for four months, while all the untreated mice died within six weeks, according to the study. Also, mice treated with chemotherapy or radiation therapy both fared significantly better when ADH-503 was included into the regimen. â€œIn animal studies, this small molecule led to very marked improvements and was even curative in some cases. We are hopeful that this approach could help pancreatic cancer patients,â€? said the paperâ€™s co-senior author David DeNardo, associate professor of medicine at Washington University School of Medicine. Boils, or furuncles, are red and painful bumps resulting from a bacterial infection. Boils are more likely to appear on skin that gets exposure to moisture and friction, such as that in the armpits and groin. Without treatment, boils can continue to grow larger and more painful. However, over time, they will usually burst open and heal on their own. A person should avoid squeezing and popping a boil as this can worsen the infection. Applying a moist heat pack a few times a day can help speed the healing process. Once the boil ruptures, a person can apply petroleum jelly and then cover it with sterile gauze until it heals. If a boil worsens or does not go away on its own within a few weeks, or if the person has a fever or feels unwell, they should see their doctor. In some cases, the doctor will need to make a small incision to help the boil drain and heal.

Yeast infection

Areas of the skin that often become moist are at risk of developing a yeast or fungal infection, which an organism called Candida causes. Yeast infections frequently produce red bumps or pustules, which are pus-filled red blisters. People can often treat yeast infections with over the counter antifungal creams. A yeast infection can resemble other conditions that need different treatment, so it is best to get a diagnosis from a doctor.

Hidradenitis suppurativa

A doctor may suggest lifestyle changes, such as weight loss and quitting smoking, to help treat hidradenitis suppurativa. Hidradenitis suppurativa is a skin condition that most commonly involves the armpits and groin but can affect other areas. It starts with the growth of red, pimple-like bumps on the affected skin. Without treatment, it can worsen as the bumps expand and go deeper into the skin. It can be painful and might even make moving the arm difficult. Over time, the bumps may cause severe scarring that results in sinus tract formation and drainage. Doctors use various methods to treat hidradenitis suppurativa. These may include: - medications, such as antibiotics - lifestyle changes, for example, weight loss and quitting smoking - surgical resection of the affected areas - antibacterial washes, such as chlorhexidine 4% wash and benzoyl peroxide 10% wash In some cases, these treatments are not successful, and doctors will inject a biologic medication called adalimumab (Humira) instead. TUBA, Benguet -- Spelunkers will have an alternative site to enjoy caving in this upland town in northern Philippines, with the Aran Cave now open to the public. Located at the scenic mountains of historic Kennon Road, bordering Barangays Camp 3 and Twin Peaks, the cave’s mouth is found on a cliff along the Bued River. With three distinct portions inside leading to various exits, the Aran Cave is endowed with flora and fauna, including orchids, vines, and shrub species endemic to the place. There are also countless bats that inhabit the big chamber of Aran Cave’s “Cave 3” that is naturally hallowed out just past the main entrance. An underground stream at “Cave 1” harbors some eels. Like in the adjoining rock walls, some flowering and wild herbs grow among the moss at the cave’s mouth. A geological and hydrological wonder include Cave 1’s underground stream of crystal clear water. A waterfall as high as five meters with a deep pond is found along the watercourse.

Inside are dominant rock formations of stalactites and flowstones or calcite deposited by a thin sheet of flowing water on the walls or floor of the cave. Coming from the side of Kennon Road is a hanging bridge -- which adds to the adventure -- leading to the mouth of the cave that opens to the inside. Municipal tourism officer Anabel Solano told the Philippine News Agency (PNA) that all management, operational, and safety measures were in place to safeguard visitors. Based on the management plan of the eco-tourism site, the three caves cover an approximate area of 157.75 hectares. Local folks claimed that Cave 1, which was the initial site that was opened, is very deep, while Caves 2 and 3 are comparatively shallow ones. Accordingly, the Americans who then explored the cave during the construction of Kennon Road in the early 1900s told residents that Cave 1 reached San Fernando, La Union. Caves 1 and 3 are circuitous with detours and branches. Cave 1 has two entrances, both located on a cliff facing some 30 meters from the water edge

folklore story that the cave was once the home of a giant named “Aran.” The story tells that during the construction of the historic Kennon Road engineered by Lyman Kennon with laborers from 46 different nations and nearby local provinces, laborers mysteriously went missing one by one.
