A Word from Our President: ND Dept. of Health is Levying Fines on Stormwater Violators Stormwater management has been a hot topic in the industry and the association lately. We have received notice that builders and developers in our communities are being fined by the ND Dept. of Health for not filing permits and/ or having adequate BMPs in place. As you might have seen in the recent notices from the BMHBA, builders Eric Brenden and developers are strongly Board President encouraged to make sure they have adequate BMPs in place and are filing for the proper permits with the City of Bismarck and the ND Dept. of Health. ND Dept. of Health inspectors have been making rounds in the area. No one wants a fine, so please take the time to make sure that your job site has adequate BMPs and

your permits have been filed. The City of Bismarck has offered to walk your job site with you to ensure you have the correct BMPs in place if you would like.

As you know, stormwater management can be a complicated issue, especially when dealing with multiple regulatory entities like we are. The BMHBA is working with the City of Bismarck, ND Dept. of Health and the ND chapter of the North American Stormwater and Erosion Control Association, to try to simplify the process and educate builders and developers on the proper procedures for permitting and the use of BMPs. Our hope is that by working with the city and state departments to educate our members on stormwater regulations, there will be less confusion around the issue and our members will be able to comply more easily.

For more information on the local and state requirements, see the Stormwater Central section on pages 10-11. Our work on this issue is ongoing. If you have any specific concerns you think the association should hear, feel free to contact me.

Committee Highlight: Home Show Committee Kicks Off Planning for 2014 Show The Home Show Committee, as its name implies, is tasked with planning our annual Home Show. In 2014, this will be the 37th Annual Home Show presented by the Bismarck-Mandan Home Builders Association.

The committee had their first meeting for the 2014 show on Oct. 23. The committee has a hand in nearly all aspects of the show. They do everything from approve the contracts before they are sent out to make final decisions on Home Show policy. The committee also reviews all Home Show advertising and volunteers during set-up.

The 2014 Home Show is set for March 14-16 at the Bismarck Civic Center. It typically boasts over 350 booths featuring everyone from builders to landscapers to mortgage lenders to retail sales. The Home Show is open to members and non-members to participate. For more information on this year’s show, turn to page 12 or contact the BMHBA office.

Board members are responsible for attending monthly board meetings, and encouraged to attend BMHBA events throughout the year. Board meetings are typically held the fourth Thursday of the month and last about an hour and a half. Board members who are elected in November will be inducted at the Annual Banquet in January.

BMHBA Board of Directors Votes to Add Two Additional Board Positions During the October 22 Board meeting, the Board of Directors voted to add two additional positions to the then 10-person Board of Directors BMHBA Board of Directors. One additional position will be designated for a Builder member and the other for an Associate member.

Following the 2014 elections, the Board of Directors will be comprised of seven Builder members and five Associate members. The goal of this decision is to increase member representation on the Board and allow more members to be involved with the state and national associations.

The additional two Board members will be up for election at the Associate General Membership Meeting on Nov. 14, along with the four current Board positions up for renewal.

Breanna Hutchinson, internal auditor at Starion Financial, recently completed the Community Bank Internal Auditing Program, sponsored by the Independent Community Bankers of America.

To earn certification, Hutchinson successfully completed the requirements of a comprehensive bank auditing program and passed all certification examinations.

Starion Financial Shows Support for Troops

Starion Financial employees donated more than $1,000 worth of food and money to purchase care packages to send to deployed soldiers. The packages were sent to five different deployed troops, including troops of Starion employees’ family members.

The Bismarck-Mandan Development Association (BMDA) Board of Directors appointed Brian Ritter to the position of President/CEO of the organization at its board meeting.

Ritter has been serving as interim executive director of BMDA since June 2013, following the retirement from BMDA of Russ Staiger. Staiger served as BMDA’s President/CEO for 33 years.

Ritter has been with BMDA since 2004. As Director of Business Development for the last five years, he has been responsible for all general business development activities including the attraction of new businesses, the retention and expansion of existing businesses and assisting in the development of entrepreneurs.

A two-time graduate of the University of Mary with a bachelor’s degree in business communications and a master’s in business administration (MBA), Ritter has also graduated from the University of Oklahoma’s Economic Development Institute, as well as Leadership Bismarck-Mandan.

Congratulations Mike Hopfauf and Hopfauf Custom Builders!

Mike Hopfauf, owner of Hopfauf Custom Builders, was announced as the Bismarck-Mandan Home Builders Association BEAM (Builders Engaging Associate Members) Award Winner at the Fall Awards Mixer on Oct. 15.

Mike is a 17-year member of the Bismarck-Mandan Home Builders Association and has served on the Board of Directors for most of that time. Mike firmly believes that it is good business to do business with a member.

STORMWATER CENTRAL City of Bismarck Stormwater Management Process A City of Bismarck Erosion and Sediment Control Permit is required for any type of land disturbance.

This permit can be downloaded at http://www.bismarck.org/ index.aspx?nid=192. There is a small fee with this permit which goes toward stormwater system maintenance and cleaning in new developments.

All BMPs must be placed prior to any land disturbance.

These inspection records must be kept for the duration of the project.

Any changes to your site BMPs and any maintenance of your existing BMPs must be documented. If items are in good condition, that should be noted as well.

Final site stabilization measures (planting seed or other type of permanent vegetation or erosion control like sod, blankets, crimping, or mulch) are put in place and documented.

All BMPs must be maintained and in proper working order.

Your site foreman or designee should conduct regular stormwater site inspections documenting condition of BMPs. KEY: PERMITTING

ON-SITE REQUIREMENTS

All BMPs must be removed when final site stabilization has taken place.

When work is completed, an N.O.T. (Notice of Termination) should be submitted to cease coverage of this permit and your site responsibility. A copy of the inspection records should be included with the N.O.T. INSPECTIONS/DOCUMENTATION

STORMWATER CENTRAL ND Dept. of Health Pollution Prevention Requirements for Home Builders

As a homebuilder, you will need to follow pollution prevention requirements if you are building in a development. The requirements were developed by the North Dakota Department of Health (NDDoH) and apply whether you are building within city limits or in the county.

First, you have to develop a stormwater pollution prevention plan. The purpose of the plan is to identify sources of pollution at the building site that could be carried away by rain or snowmelt and outline what will be done to minimize pollution in runoff from the site. Sources of pollution include dirt and petroleum products as well as construction material and waste.

The plan describes where erosion and sediment controls will be used, general housekeeping practices, spill prevention and response procedures, and other daily control measures.

During construction, regular site inspections must be conducted and recorded to make sure the plan is followed and working. Erosion and sediment controls, such as fiber rolls and inlet protection, must be correctly installed. These controls must be cleaned and maintained regularly to keep them functioning.

Petroleum products, construction material and waste must be stored properly, and leaks must be stopped.

The plan and pollution prevention measures must be maintained until a home is occupied or there is grass cover over 70 percent of the lawn. If a home is ready to be occupied, erosion and sediment controls must be left in place, and a homeowner fact sheet must be given to the homeowner.

You must submit a notice of intent (NOI) to the NDDoH to be covered by the NDDoH’s general permit.

Your NOI can cover all of your lots in a development, and coverage continues until the general permit expires.

To terminate coverage you must submit a notice of termination (NOT). An NOT may be submitted when you are no longer building in a development or have 70 percent grass cover.

With over one hundred people in attendance, the first BMHBA Family Night at Papa’s Pumpkin Patch was a great success. It was wonderful to get to meet our members’ families. The cost for a 10x10 booth space is $365 for members and $565 for non-members for the 2014 Home Show. All 2013 exhibitors have first right of refusal on their booth space. They have until Dec. 6 to claim their old space.

Once that date has passed, all new or moving exhibitors will be assigned a booth space in the order contracts were received. So if you are considering being a vendor this year, the sooner the better!

The Home Show is set for March 14-16 at the Bismarck Civic Center. The Civic Center is under construction as part of their exhibit hall expansion project. This should have a minimal impact on our Home Show. Vendors who may be affected will be contacted by BMHBA staff in advance of the show. Thank you for your patience and understanding!

New Burleigh County/City of Bismarck Zoning Maps The Bismarck City Commission recently approved an agreement with Burleigh County to define jurisdictional lines between the two entities for planning, zoning and building permits.

The Burleigh County Commission has already approved the agreement which goes into effect January 1 and automatically renews every two years, but can be renegotiated at any time. A map of the new boundaries can be found at www.bismarcktribune.com. Search for: zoning maps burleigh county.

National News: Homeowner Flood Insurance Affordability Act Introduced in House and Senate, Commended by NAHB Editor’s Note: The Bismarck-Mandan Board of Directors voted to lend our support to a letter urging President Obama to administratively delay implementation of rate increases on all pre-FIRM businesses, non-primary residences, and homes purchased after enactment of the Biggert-Waters Act of 2012, and to allow time for FEMA to conduct the required affordability study. The letter was signed by HBAs, realtor associations and others across the nation, and sent before this new legislation was introduced.

NAHB - Rick Judson, chairman of the National Association of Home Builders (NAHB) and a home builder and developer from Charlotte, N.C., issued the following statement on the introduction of the Homeowner Flood Insurance Affordability Act in the House and the Senate: “NAHB commends Sens. Robert Menendez (D-N.J.) and Johnny Isakson (R-Ga.) and Reps. Michael Grimm (R-N.Y.) and Maxine Waters (D-Calif.) for championing identical bipartisan legislation in the Senate and House that will provide relief from soaring flood insurance premium rates for countless home owners across the nation.

“The Homeowner Flood Insurance Affordability Act offers a common-sense solution to fix some of the costly and unintended consequences resulting from the implementation of the Biggert-Waters Flood Insurance Reform Act. The legislation would prevent premium rate hikes from taking effect for four years, which will give

FEMA time to conduct an affordability study and to reimburse those who can prove that its existing flood plain maps are inaccurate.

The measure also requires FEMA to adopt sound engineering practices to accurately determine flood risk.

“These provisions in the insurance reform bill will prevent undue hardship on the recovering housing market, help current and future policyholders keep their premiums affordable, prevent home values from dropping, and make the National Flood Insurance Program more effective for years to come.”

Ask your representative and senators to co-sponsor the Homeowner Flood Insurance Affordability Act (H.R. 3370/S. 1610).

Beginning January 4, 2014, changes to the Safe Drinking Water Act will further reduce the maximum allowable lead content of pipe, pipe fittings, plumbing fittings and fixtures to 0.25% throughout the United States. Affected products include: appliances with water dispensers, kitchen and lavatory faucets, solder, flux, pipe, pipe fittings, brass/bronze valves, and supplies and stops.

The only products that will not be affected by this are pipe, pipe fittings, plumbing fittings or fixtures, including backflow preventers, used exclusively for non-potable services such as manufacturing, industrial

processing, irrigation outdoor watering or other uses not intended for human consumption. Also, toilets, bidets, urinals, fill valves, tub fillers, shower valves, service saddles or water distribution main gate valves that are two inches in diameter or larger are exempt from this requirement.

Builders are encouraged to talk with their plumbers and suppliers to make sure these requirements are being adhered to. Many products will be marked LeadFree or with labels that certify adherence to the NSF 372 requirements.

NDAB tops 2K members, leaders travel to Colorado

In preparing reports for the National Association of Home Builders’ Fall Board of Directors meeting, I noticed Jason Eid that the North Dakota Association of NDAB President Builders has hit a major milestone: We have exceeded 2,000 members statewide! Congratulations to our local associations on making this happen. It is an exciting time in our great state and our industry is doing very well.

Several of our leaders traveled to Colorado Springs, Colo., last month for NAHB’s board meeting. I am happy to report that NDAB’s own Ralph Applegren, Applegren Construction, Grand Forks, was unanimously approved as national Area 10 chairman. He began serving as an NAHB National Director in 1992, is now a Senior Life Director and previously served as NAHB’s state representative for North Dakota. Congratulations! Area 10 chairmen serve on NAHB’s executive committee. Area 10 includes Iowa, Minnesota, North Dakota, South Dakota and Wisconsin.

National flood insurance program changes Flood insurance at the national level is still a hot topic and a major concern. Our national association is in the process of gathering information on the most current effects. If anyone has new construction addresses that have seen the increase in flood insurance premiums, NAHB staff needs those addresses and the information surrounding them. NDAB will hold its Annual Meeting and Awards Banquet Nov. 21-22 at the Grand Williston Hotel & Conference Center in Williston. We are planning a patriotic theme and encourage attendees to dress in red, white and blue for the banquet Friday night. NDAB member benefit highlight: NDPB

The North Dakota Professional Builder (NDPB) certification program is administered by NDAB is and the only one of its kind in the state of North Dakota. This voluntary certification program for home builders was established to recognize professionals in the home building industry.

Participants in the program set themselves apart with these benefits and advantages in the market place: website link and listing on the NDAB website www.ndbuild.com; consumer brochures provided to NDPBs for distribution to potential customers; NDPB window clings; NDPB logos for your use on marketing materials.

Cost is $100 and you must complete seven credits of continuing education annually.

The largest Bismarck-Mandan Fall Parade of Homes yet was a great success with 39 homes and increased attendance. Congratulations to our Fall Parade of Homes winning builders: Venture Building Company, Lexar Homes, J & D Construction, Diversity Homes, Stoneshire Builders, Hallmark Homes, Fireside Custom Homes, Lausch Construction, Scott D. Banquet was Oct. 15 at the Holiday Inn Riverside. Builder of the Year award went to Al Schall, Northstar Steel Inc. Associate of the Year went to Kevin Connole, Connole & Somerville Plumbing, Heating & Air, and our Citizen of the Year award went to Rev. Paul Krueger who established Hope Village to feed and house 5,000 out-of-town volunteers for our flood recovery efforts.
