’ Greetings BMHBA Members, May is here and I want to apologize for jinxing us after my last message about great weather!! I hope everyone was able to stay safe after the craziness of the record snowfall we had and was able to still get out and enjoy the 30th Annual Spring Parade of Homes. I want to thank our staff, volunteers and every member who helped make this event happen. I hope the participating homes had good traffic and possibly made some sales to add to their spring work. I also would like to thank all the participating builders for entering a home and the associate members for their continued support of this event. We had 30 homes entered in the 30th Annual Parade! When entering a home into the Parade we always ask for a list of all the contractors who worked on your homes. I hope that each builder submits a list and I encourage you to do business with current members of the BMHBA. If you are doing business with a non-member, ask them to become a member.

Increasing our membership only makes us a stronger voice when we are fighting on your behalf for affordable housing, favorable and minimal code changes, and working with local municipalities to help stop unfavorable conditions. While not always effective in stopping changes, we are actively fighting on behalf of our association. As always, if you want to know how you can be more involved in the association or have suggestions, please don't hesitate to contact me or any of the board members. The North Dakota Department of Commerce, Division of Community Services (DCS) is assigned the responsibility of updating and amending the North Dakota State Building Code.

The current North Dakota State Building Code consists of the 2018 International Building Code (IBC), 2018 International Residential Code (IRC), 2018 International Mechanical Code (IMC), 2018 International Fuel Gas Code (IFGC), 2018 International Energy Conservation Code (IECC), and 2018 International Existing Building Code (IEBC). These are nationally recognized codes published by the International Code Council and updated every three years. DCS recently announced its intentions to review and consider amendments to the newly published 2021 editions of the following model codes IBC, IRC, IMC, IFGC, IECC, and IEBC. The schedule for updating the North Dakota State Building Code is as follows: •

Proposed amendments were due to be submitted to the Division of Community Services by April 25th, 2022 to be assured consideration. Amendments submitted after this date may be considered at the public hearing on July 12th, 2022. The Building Code Advisory Committee will meet to review the proposed amendments and to develop additional amendments on May 4th, 2022. The Division of Community Services will make available all proposed amendments to the Building Code Advisory Committee, participating jurisdictions and interested parties by posting on the website by May 25th, 2022. A public hearing of the Building Code Advisory Committee to receive comments and develop recommendations on the proposed amendments is planned to be

The Division of Community Services will make available the recommendations by the Building Code Advisory Committee on the proposed amendments to the eligible voting towns, cities, counties, and committee members by posting on the DCS website. Letters will also go out to the jurisdictions about the registration process for the voting meeting planned to be held on July 28th, 2022. The meeting of the eligible voting jurisdictions and voting individuals to vote on the proposed amendments is planned to be held on September 7th, 2022. The 2023 North Dakota State Building Code will be posted on the website by November 15th. The proposed effective date of the updated North Dakota State Building Code is January 1, 2023.

If a city, county, or township in North Dakota elects to adopt and enforce building codes, it must adopt and enforce the State Building Code. However, a jurisdiction is permitted to further amend the State Building Code to conform to local needs. Fully chartered Home Rule cities may adopt something other than the State Building Code; however, at the present time all cities that enforce a building code have elected to adopt the same model codes that have been adopted as the North Dakota State Building Code. As we get into May, we’ll begin to see the election cycle pick up. And this cycle will be more active than usual, as there are more primary challenges than we’ve seen in quite some time. And for this political science nerd, it feels more like the Super Bowl. For more “normal” people, an audible moan as we think about the number of political commercials they will have to endure. But make no mistake folks. Politics impacts our everyday lives more than we’d like to admit. And for this Association and the subject in general, politics are local. And this freight train will either keep you and your business moving or run right over you.

These days it is admittedly hard to tell what source you can trust for information on issues and candidates. But if there’s one ultimate reason to be a part of your Association, this is it. The Association doesn’t identify a good candidate based on their party alone: we look at their voting record, their positions, and their willingness to work with us when recommending and ultimately contributing to their campaign. While PACs and Special Interests have gained a bad reputation over the years, it’s not a fair assumption in North Dakota that all are to be treated equally. Our association prides ourselves in its transparency, its nonpartisanship, and ultimately its ability to work on your behalf. We are a special interest. And our interest is in seeing the home building industry thrive. So as we continue to get closer to the election, you can count on your locals and your state Association to advocate for all levels of government to treat our members fairly. We exist to represent you.

Unlike much of the construction industry, Tobias Marman Construction has more women who are a part of the office staff than men! Our interior designer, marketing specialist, office manager, and one of our project managers are all female. Of those women, all are under 40 years old! Although a lot of what is shown to the community is pristine before and after photos or glam shots of different spaces, this is a total misconception of what you are getting yourself into. That is not what the construction industry is. Behind all the beautiful pictures and social media posts, there is the hidden side to the construction industry. You will deal with delays, irritable clients, things never going as planned, and if you want to be successful, you have to keep pushing and be adaptable. This industry is rewarding, but it is incredibly stressful. When things are good, they are amazing including the clients. When things are bad, they are horrible. You must be able to handle both circumstances and be flexible to constant change. I really don’t have a typical day as the owner of a construction company. It varies day to day. My day can go from working in my office drafting plans to helping the guys in the field set roof trusses to helping resolve an issue that came up for the day. A powder chasing skibum living a lowkey life, day to day chasing powder in the mountain west. I would probably live in a van. I hope to see Tobias Marman Construction have positive growth in the next few years in a few different ways. First, we would all like to have the freedom to pick and choose our projects more often and narrow down our niche. Second, we would like to grow internally with better vendor and subcontractor relationships. Construction was not exactly a choice for me. I became the 5th generation of men who worked in carpentry and construction in my family. So, really, I was born into it. Growing up, I spent a lot of time with my father and grandfather who both taught me all they knew about carpentry and the ‘building’ craft. I started Tobias Marman Construction in 2001 in response to the skills and values I learned growing up. It was what I knew how to do best. Tobias Marman Construction has a very diversified skill set. Unlike other builders in the area, we understand and can take on a variety of residential and commercial projects, including new builds and remodels. We tend to gravitate towards the out of the ordinary difficult projects. I guess we like a good challenge. Along with the satisfaction of finishing a difficult project, my favorite part of my job is working with our incredible staff. You cannot do what we do without having a great team. I feel that I have some of the best people in the area that work for me. I really do. I work a lot but when I am not working, I spend all my spare time with my amazing wife, kids, and other members of my family. Among all of that, my other hobby is snowboarding and exploring the mountains. I also like to cruise around and get ice cream with my kids in a 1960 AMC Rambler American 2-door station wagon. Like all North Dakotans, one of my favorite things about springtime is the temperatures starting to rise meaning summer is on its way. Otherwise, springtime for the construction industry means my team is not fighting the inconveniences of winter weather anymore. Along with being able to work longer days, our project managers and interior designer are not waiting as long on delayed product and our carpenters can work in safer environments and work on what they need to when they need to. Bismarck’s intense winter brings a lot of challenges for construction, so we all look forward to spring.


Our bank was started by two accountants from North Dakota that wanted to enhance the business banking culture in their home state. Prior to them purchasing our downtown Bismarck location, the city was considering tearing the building down for a parking lot. (This was before they built the 3rd Street ramp)

Nonfarm payroll employment increased in 34 states and the District of Columbia in March compared to the previous month while 16 states lost jobs. According to the Bureau of Labor Statistics, nationwide total nonfarm payroll employment increased by 431,000 in March, following a gain of 750,000 jobs in February. On a month-over-month basis, employment data was strong in California, which added 60,200 jobs, followed by Texas (+30,100) and New York (+28,100). Sixteen states lost a total of 22,000 jobs. In percentage terms, South Dakota employment increased by 0.6% while Wyoming reported a 0.4% decline between February and March. Year-over-year ending in March, 6.5 million jobs have been recovered, marking the economic rebound from the COVID-19 pandemic induced recession. All the states and District of Columbia added jobs compared to a year ago. The range of job gains spanned 1.0 million jobs in California to 5,000 jobs added in Alaska. In percentage terms, Nevada reported the highest increase by 9.1%, while Kansas increased by 1.5% compared to a year ago. Across the 48 states which reported construction sector jobs data—which includes both residential as well as nonresidential construction— 34 states reported an increase in March compared to February, while 13 lost construction sector jobs. Idaho reported no change. California added 8,900 construction jobs while New York lost 3,700 jobs. Overall, the construction industry added 19,000 jobs in March compared to the previous month. In percentage terms, South Dakota increased by 7.2% while Mississippi reported a decline of 3.3% between February and March. Year-over-year, construction sector jobs in the U.S. increased by 220,000, which is a 3.0% increase compared to the March 2021 level. Texas added 31,800 jobs, which was the largest gain of any state, while Pennsylvania, lost 2,200 jobs. In percentage terms, Wyoming had the highest annual growth rate in the construction sector by 11.1%. Over this period, Kentucky reported a decline of 1.1%.

"An important first step to address housing affordability challenges in this current high-inflation environment would be to immediately suspend tariffs on softwood lumber imports from Canada and to move quickly to enter into negotiations with Canada to pursue a new, long-term softwood lumber agreement...And seeking immediate remedies to lumber and building material supply chain bottlenecks will lower construction costs and increase production of badly needed affordable housing," the letter states. "As monetary policy tightens to combat the elevated pace of inflation, regulatory and economic policy should complement these changes by addressing ongoing supply-side economic problems. Keeping housing in the national forefront and addressing these critical housing affordability issues will reduce the risk of recession and help the residential construction industry to lead the economy forward." Rapidly rising interest rates combined with ongoing home price increases and higher construction costs continue to take a toll on builder confidence and housing affordability. Builder confidence in the market for newly built single-family homes moved two points lower to 77 in April, according to the National Association of Home Builders (NAHB)/Wells Fargo Housing Market Index (HMI) released today. This is the fourth straight month that builder sentiment has declined. “Despite low existing inventory, builders report sales traffic and current sales conditions have declined to their lowest points since last summer as a sharp jump in mortgage rates and persistent supply chain disruptions continue to unsettle the housing market,” said NAHB Chairman Jerry Konter, a builder and developer from Savannah, Ga. “Policymakers must take proactive steps to fix supply chain issues that will reduce the cost of development, stem the rise in home prices and allow builders to increase production.” “The housing market faces an inflection point as an unexpectedly quick rise in interest rates, rising home prices and escalating material costs have significantly decreased housing affordability conditions, particularly in the crucial entry-level market,” said NAHB Chief Economist Robert Dietz. Mortgage interest rates have jumped more than 1.9 percentage points since the start of the year and currently stand at 5%, the highest level in more than a decade. Derived from a monthly survey that NAHB has been conducting for more than 35 years, the NAHB/Wells Fargo HMI gauges builder perceptions of current single-family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores for each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view conditions as good than poor. The HMI index gauging current sales conditions fell two points to 85 and the component charting traffic of prospective buyers posted a six-point decline to 60. The gauge measuring sales expectations in the next six months increased three points to 73 following a 10point drop in March. Looking at the three-month moving averages for regional HMI scores, the Northeast posted a one-point gain to 72 while the Midwest dropped three points to 69, the South fell two points to 82 and the West edged one-point lower to 89.
