A Word from Our President: New Bismarck Green Space Ordinance to be Drafted The Green Space Ordinance, which was put on hold during the legislative session, will most likely come before the commission again in the near future. At the May 28 city commission meeting, commissioner Josh Askvig talked about it for a few minutes. He stated that there would be a new proposed ordinance drafted soon. The city commission Eric Brenden would then discuss the two Board President different proposals and decide which one should go forward through the approval process. It sounds like final action, however, will probably not happen until August or September.

The original proposed ordinance was drafted last year, and was based on the discussion of the committee which had been set up, which was comprised of various members of the community. This ordinance would have

required the developer to either dedicate 7% of the net developable land to the city and/or park district or give a payment–in-lieu of land dedication based on the fair market value of the land. Payment-in-lieu of fees were only to be used for the purchase of land, or the construction or installation of new improvements. The use of the fees was also limited to the quadrant of the city in which the new subdivision was located.

As of the time I am writing this, I have not seen the new proposed ordinance. However, it sounds like with the second proposal the city would pay for the property at fair market value and the park itself would be special assessed against all the benefitted property. We will be following the progress of this, as it is an important issue to many of our members. If anyone has any questions or concerns, please do not hesitate to call me.

On another note, we have our annual picnic coming up on June 13. It is always fun to go to the Post south of Mandan and see people that we may not have seen for a while. Hopefully we will get some nice weather so we can enjoy the evening outdoors.

Committee Highlight: Reinvigorated Events Committee Shakes Things Up The Events Committee, under the guidance of committee chair and board member Minda Lloyd, is hitting the ground running this year. With the combination of new members and long-time Events Committee participants, the committee is setting out to find a balance between tradition and the desires of the new generation of members.

The Events Committee is charged with organizing the member events throughout the year, including nearly every event other than the Parades of Homes, Home Show and education. This includes everything from the general membership meetings to the golf tournament.

This year, they are excited to offer two new events for the membership: Bowling with the Builders and BMHBA Night at the Pumpkin Patch. Bowling with the Bulders, held in March, went off great. The bowlers enjoyed two or three games of bowling, pizza, contests and prizes.

BMHBA Night at the Pumpkin Patch will be held October 3. More information will be available closer to the date, but make sure to mark your calendars for this familyfriendly event!

The Events Committee also instituted the rolling drawing first held at the Spring General Membership Meeting in May. For the rolling drawing, $50 is up for grabs at the first meeting. One member company is drawn from a hat to win. If a representative of the company is present, they go home with $50. If they are not, the money rolls over into the next event, making that total $100. There will be 5 drawings a year, with the final drawing at the Annual Banquet in January where names will be called until a winner is found.

The Annual Picnic will be held Thursday, June 13 at The Post in Mandan. The evening starts at 6 p.m. The picnic will feature the always delicious pit-fired beef, sides, and free beer.

This is a great way to get your employees involved, too. Each member company gets 2 free tickets. Additional tickets are $15 a piece.

The picnic features a silent auction benefiting the BSC Scholarship Fund. Each year, the BMHBA uses the proceeds from the two silent auctions and 50/50 drawings throughout the year to fund three $1,000 scholarships for BSC students. There are two scholarships for carpentry students and one for HVAC. There will also be a very special live auction item. Turn to page 8 for more information.

Mark your calendars for the golf tournament Tuesday, July 16 at Hawktree Golf Course! Registration starts at 11 a.m. with tee off at noon. The BMHBA was happy to host ND Attorney General Wayne Stenehjem and former senator Nick Hacker as our guest speakers at the Spring General Membership Meeting on May 16 at the Seven Seas. NDAB Executive Officer Doreen Riedman also made a presentation on the results of home building issues this legislative session. Thank you to everyone who attended this great event and congratulations to our Spring Parade of Homes winners!

The Spring GMM was followed quickly by the 3rd Annual New Member BBQ sponsored by Ferguson Enterprises. Board member Greg Zenker served as the grillmaster for the evening with delicious bbq ribs for all the attendees. All members who had joined in the last two years were invited to the BMHBA office to get to know each other, the board members and committee chairpeople. It was a great evening of networking and fun. ATTENTION BUILDERS & DEVELOPERS! Fines Are Being Levied on State Stormwater Violations The State Health Department received word that EPA will be coming to Bismarck this summer to inspect stormwater management on local developments. In an effort to be proactive, the North Dakota State Health Department has been doing stormwater inspections on developments/lots in Bismarck. They are on the lookout for any sites that lack BMPs (Best Management Practices) which include silt fence, straw wattles, etc. used for perimeter control.

If your job site/development is found to be in violation, you will be receive a Notice of Violation first, followed by monetary fines if the issue is not dealt with accordingly. The fines are determined by size of the lot, location and the waterway affected. Typically, if the builder/developer is seen to be doing their due diligence in regards to sediment control, the authorities will be more willing to work with them to fix any problems.

Another issue on the radar of the State Health Department is permits. Some builders have been filing for a permit with the City of Bismarck, but not the state.

Unlike city permits, filing with the state is free. The

builder/developer must provide the proper paperwork regarding their stormwater pollution prevention plan and the frequent site inspections that each contractor should be doing.

If you have any questions about whether you’re in compliance on your jobsite or if what you need to do to fulfill the requirements, you can contact the local or state stormwater officials. Also, you’re encouraged to contact the state officials if you need to apply for permits on the state level.

BMHBA News & Events You Could Own a Piece of HBA History

Sign To Be Auctioned Off at the Annual Picnic The Annual Picnic on June 13 holds your key to a piece of HBA history. Lori Willson, 2004 board president, donated an original “Bismarck Home Builders Member” sign back to the association to be auctioned off at the Annual Picnic. The sign (pictured at right) was originally given to the HBA builder members in 1968 to display at their place of business, according to Lee Mitzel, 1992 board president.

According to collective recollection, a few of the signs have been circulating through the HBA over the years – being donated to the HBA for a silent auction item multiple times. Lee is also a proud owner of one of the original signs – which he purchased at an HBA silent auction. His sign previously belonged to Reuben Anderson, 1970 board president. Lori’s sign was purchased for her as a gift at a HBA Picnic silent auction about 10 years ago. “I thought it was a good idea to keep it going and give back to the association,” says Lori. The sign has been matted and framed since Lori took ownership of it.

The signs were created before the HBA became the Bismarck-Mandan Home Builders Association, which is why it only bears the name of Bismarck.

According to Joe Mathern, 1973 board president, the association name was changed before we joined the National Association of Home Builders in 1973.

The sign will be auctioned off during a live auction at the Annual Picnic June 13. We hope you’ll join us for the picnic and take part in this great opportunity to own a piece of HBA history.

City Beat: Jamestown Seeks Housing Developers Submitted by Jamestown/Stutsman Development Corporation Calling all housing developers! Looking for a place to build homes? Jamestown, ND is your city! Why, you ask?

Well, we have several reasons.

First, we have several upcoming projects, which will bring in a multitude of jobs. CHS. Inc. is building a $1.4B fertilizer plant in the Spiritwood township just east of Jamestown, which will bring in 100-150 full-time jobs.

Dakota Spirit AgEnergy will be starting up a corn ethanol plant in fall of 2014, which will bring in an estimated 36 full-time jobs. We have a brand-new Hampton Inn that will be opening soon, which will need approximately 40 employees. Several other businesses are starting up or expanding in our area, such as: • John Deere Seeding Group – approximately 115 new jobs • 200 MW Operational Wind Farm – approximately 8-10 new jobs • Noridian – 30-40 new jobs • E-nugget/Carbontec – 25-30 new jobs There are also several new job opportunities being created in Valley City, and Jamestown local manufacturers are ramping up hiring as well.

In other words, we are expecting a lot of people in the near future. The only problem is, we need a place to put them!

The second reason you should build here is that we have plenty of land available for development. The listings for areas of development inside city limits can be found on our homepage, www.growingjamestown.com, under the Builders/Developers section, which is located on the lefthand side, under the Preliminary Proposal link.

Our third and final reason for developing in Jamestown and Stutsman County, ND is simple: we have incentives!

The Flex PACE Affordable Housing program is a great incentive that we offer – it is geared toward assisting the financing of affordable multi-family housing units for individuals in areas of North Dakota affected by oil and

gas development. A maximum of $25,000 of BND interest buydown is available for each unit developers commit to affordable housing.

Several other housing development incentives are available for all types of development projects. We’re looking for everything—feedback from local realtors here in Jamestown proves that. They want to see single family homes, twin homes, and single level townhouses built.

What would folks here in town like to see? Open floor plans, three bedrooms, a garage, and access to a backyard.

So if you are looking for a new project, look no further– build in Jamestown. We are eager to continue growing, but we need your help!

Background: JSDC was organized to develop employment opportunities, to improve business conditions, and advance the interests of the City of Jamestown and Stutsman County, North Dakota by implementing and sustaining an organized effort to attract new businesses and industry, support existing businesses and industry, and encourage new business starts. Jamestown/Stutsman Development Corporation’s focus is primary sector job creation.

The corporation has a multimillion-dollar economic development program available to assist with expanding or relocating business. The Jamestown/Stutsman Development Corporation owns an Ag Processing Industrial Park with 55 acres of land available as well as the new I-94 Business Park which has 30 acres available for manufacturing, warehouse distribution or national service.

National News: House Lead Paint Bill Would Help Remodelers and Consumers

NAHB - Responding to concerns from the National Association of Home Builders (NAHB) and affiliated trade groups, bipartisan legislation to make much-needed improvements to the Environmental Protection Agency’s (EPA) Lead: Renovation, Repair and Painting (LRRP) rule was reintroduced in the U.S. House of Representatives May 22.

The Lead Exposure Reduction Amendments Act of 2013 (H.R. 2093) is identical to legislation introduced in the last Congress. The bill would reinstate the opt-out provision to allow home owners without small children or pregnant women residing in the home to decide whether to require LRRP compliance, allow remodelers to correct paperwork errors without facing full penalties and provide an exemption for emergency renovations. It would also eliminate the requirement that recertification training be “hands on,” so that remodelers would no longer have to travel to training facilities out of their region.

The bipartisan bill, companion legislation to S. 484, was introduced in the U.S. House of Representatives by Rep. Tim Murphy (R-Pa.), along with 21 original co-sponsors.

“H.R. 2093 will make common sense improvements to the EPA’s lead paint rule for home owners and

remodelers who must comply with the regulation’s costly work practices and recordkeeping requirements,” said NAHB Remodelers Chairman Bill Shaw, GMR, GMB, CGP, a remodeler from Houston. “Most importantly, it will continue to protect pregnant women and small children against lead hazards. I commend the bill’s co-sponsors for their commitment to improve this burdensome regulation.”

The LRRP rule applies to homes built before 1978 and requires renovator training and certification, adherence to lead-safe work practices and record keeping.

By removing the opt-out provision in July 2010, EPA more than doubled the number of homes subject to the LRRP rule, adding an estimated $336 million per year in compliance costs to the remodeling community – without making young children any safer.

Vance Vetter, BMHBA 1st Vice President, is attending the NAHB Legislative Conference on June 5. He will be able to hear from congressional speakers regarding home building issues in a morning keynote session.

The featured speakers are Sen. John McCain (R-Ariz.) and Rep. Pat Tiberi (R-Ohio). Following the keynotes, members will meet with legislators on Capitol Hill before reconvening for a final reception and de-briefing.

The NAHB delegates, including Vance, will be stressing the top four areas of concern for NAHB: tax reform, immigration reform, housing finance reform and addressing the housing production credit crisis.

The topic of tax reform encompasses three key areas: the mortgage interest deduction, second homes, and the low income housing tax credit.

NAHB’s stance on immigration reform hinges on two issues: employment verification and labor shortages.

NAHB believes that a workable employment verification system must be fair, efficient and not impose significant burdens on employers. Labor shortages are seen as

a possible problem, as well, since 22 percent of the construction labor force nationally is made up of foreignborn workers.

In the eyes of NAHB, the solution to the housing finance problem is not to make Fannie Mae and Freddie Mac government agencies, nor completely turn them over to the private market. NAHB believes it is crucial for the federal government to continue to provide a backstop for the housing finance system to ensure a reliable and adequate flow of affordable housing credit in all economic and financial conditions.

The final issue of housing production credit can only be solved through congressional action at this point. NAHB is a strong supporter of two bills that address that issue this session - the Home Construction Lending Regulatory Improvement Act (H.R. 1255) and the Home Building Lending Improvement Act (S. 1002).

June is National Homeownership Month

Learn How New Homes Benefit More Than Just Buyers and Builders The only people who benefit when a house is built are the family members who get to live there, and the builder who constructed and sold the home, right?

Wrong. The positive impact of new residential construction is far-reaching, bringing benefits to families, businesses and services throughout a community immediately, as well as for years to come.

According to economists at the National Association of Home Builders, the one-year estimated local impacts of building 100 single-family homes in a typical metro area include $21.1 million in local income, $2.2 million in taxes and other local government revenue, and 324 local jobs.

But what does that economic impact mean in the real, day-to-day lives of community residents?

Just think about it. When a family moves to a community and buys a new house, they will likely shop at local stores to buy furniture and accessories to decorate the home. They will fill their car’s gas tank at local gas stations so they can get to the stores, have local mechanics work on the car when it breaks down or needs the oil changed, or buy a new car at a local dealer when it’s time to replace the old one.

The family may need to hire local companies for regular services to maintain their home, such as landscaping, house cleaning, pet sitters or pool upkeep.

The children will enroll in local schools. This increases enrollment, meaning more teachers, janitors, cafeteria workers and other school support staff will need to be hired. Those kids will also join sports leagues and other activities, buy equipment and pay registration fees that provide stipends for referees and coaches.

who can then afford to go out and spend money themselves, which recycles even more money into the community’s economy.

The new family also pays local and state taxes. These tax revenues help pay for a wide range of government services, including school teachers, police departments, refuse collection, parks maintenance and road repairs.

Over the long term, as the families who move into new homes become part of the community, their positive impact continues. NAHB estimates that those 100 new homes also provide the community with additional, annually-recurring impacts of $3.1 million in local income, $743,000 in taxes and other revenue for local governments, and 53 local jobs.

Families who buy a newly built home enjoy benefits including safety, amenities, energy efficiency and floor plans to fit a modern lifestyle. But the advantages of new homes extend far beyond the buyers and the builders—residential construction has a positive, direct impact on the local community for years.

Facebook & Your Business

Remember when Facebook was just a place to post funny stuff or reconnect with an old buddy? Well, the times are changing and now Facebook wants to “friend” your business. Since Facebook has moved from the college dorm room to global domination, Facebook is now becoming the place to market your business.

A business Facebook page works similar to a website by providing information about your business, such as your address, business hours, and phone number. Additionally, you can add Facebook Tabs to your profile that work like web pages; these tabs can be used to highlight your portfolio, videos, and services. It also retains all the basic features of Facebook such as “posting” and “liking”.

Hands down the most important feature Facebook provides is the “Like” button. When a person “likes” your page it means: they enjoyed your product or service, want to stay informed about your company, and want to share your company profile with their friends. This is a pretty big statement for just clicking a button.

The possibilities are endless with marketing your business through Facebook, plus it’s free. Check out the Coca-Cola Facebook page to see a great example of a business using Facebook. Coca-Cola has over 66 million “likes” so we’ve got some work to do. President’s Message

More than 20 representatives of the North Dakota Association of Builders and local associations will participate in the NAHB Legislative Conference on June 5th in Washington, DC. Some of the major issues we will discuss with our state’s congressional Jason Eid delegation include:  Water Resources Development Act (WRDA) Bill: This has passed the Senate and now moves to the House. If successful, it would authorize funding for numerous water projects, including the Red River Diversion.  National Flood Insurance Program: We’ll discuss the concerns of homebuilders and homeowners on the potential cost increases in federal flood insurance policies.  Tax Reform: The preservation of the mortgage interest deduction is a major goal, since 70 percent of homeowners claim this deduction.  Immigration Reform: We support a fair and workable employer verification system and market-based visa program to ensure workers for the construction industry.

Legislative Wrap-Up

The 63rd Legislative Assembly has completed its work, and NDAB fared quite well during this session. Here are highlights on the 115 bills tracked by NDAB:  Supported One-Call Notification: Worked with a coalition to amend the process to allow for 21-day locates, up from 10 Doreen Riedman days. Whitelining is now required, though residential projects are exempt from this provision. Fines increased to $25,000. Bill passed.  Opposed New Construction Unemployment Insurance Classification Changes: This would have raised premiums for others in the construction groups. Bill failed.  Opposed Fire Sprinkler Legislation: This had potential for code exemptions that could lead to residential fire sprinkler requirements. Bill failed.  Opposed Changes to State Building Code Advisory Committee: Would have changed the committee makeup without prior discussion among entities. Bill failed.  Supported Sales Price Disclosures: Though we preferred some privacy aspects, this bill now provides sales price disclosures on real estate. Appraisers lobbied for this legislation to enhance efficiency and accuracy. Bill passed.

Home Builders Assoc. of Fargo-Moorhead Bryce Johnson, Executive Vice President 701-232-5846 hbafm.com  North Dakota House Bill 1020, containing appropriations for the North Dakota Water Commission and funding for the F-M Area Diversion Project, passed with acceptable language through the North Dakota Legislature. This spring, joint efforts by the HBA and several local business organizations were successful in helping to find compromise in the bill that saw many forms and amendment language that jeopardized state funding for the project.  The HBA’s Golf Outing this summer will now feature two dates offering afternoon flights: June 10 and July 9 at Oxbow Country Club.  The HBA will host classes on Fargo’s adoption of the 2012 International Residential Code June 25 and 27.

They will be taught by Fargo Inspections Administrator Ron Strand. 
