President’s Letter

G

reetings BMHBA Members,

June has arrived and we are operating full swing in the midst of our building season. I want to start by thanking everyone who attended our Spring Awards Mixer where we celebrated the success of the Spring Parade of Homes and saw seven builders rewarded for their efforts with the People’s Choice Awards. On a personal note my favorite part of the evening was the surprise video message from Master Chief Timothy Preabt who he echoed my adopted message of “All Hands on Deck” and the importance of everyone working together to succeed in our mission.

Our builder members aren’t the only ones to have been recognized lately, the association has also received some accolades as of recent. The NAHB recently ranked local HBAs and we made the list and landed in the top 100! We also were recognized as a winner of an Association Excellence Award for our work with the Girl Scouts! Our membership is great, our team at the office is outstanding, and it’s their efforts that help us attain this recognition. So when you are out and about and run into one of the members of our A-Team be sure to give them an adda-girl!

AGING-IN-PLACE REMODELING, MINOR MODIFICATIONS

Gaining Popularity, ACCORDING TO NAHB SURVEY

T

he past five years have seen increases in the number of remodelers engaged in aging-in-place home modifications and home owner awareness of these types of remodeling projects, according to a survey by NAHB Remodelers, the remodeling arm of the National Association of Home Builders (NAHB). Released as a kick off to National Home Remodeling Month in May, the survey of remodelers also revealed that simple and less costly modifications are increasing in popularity. “Low-cost, simple modifications to help people be safer and more comfortable in their homes, such as installing grab bars and higher toilets, continue to be the most popular aging-inplace remodeling projects,” said 2017 NAHB Remodelers Chair Dan Bawden, CAPS, CGP, CGR, GMB, a remodeler from Houston. “A professional remodeler can make recommendations to homeowners that meet both their lifestyle and budget needs.”

The five aging-in-place remodeling projects that saw the largest increases since 2013 were: • Added lighting/task lighting increased 12% • Curb-less showers increased 9% • Grab bars increased 7%

• Non-slip floors increased 7%

• Widening doorways increased 5%

More complex and costly projects saw minor decreases in popularity since 2013. Adding an entry-level bedroom dropped one point to 33%, and installing ramps or lowering thresholds decreased two points to 49%.

According to the survey, 80% of remodeling companies are doing aging-in-place projects, up from 68% in 2013. Remodelers reporting that “most” of their customers were familiar with the aging-in-place concept increased from 11% in 2013 to 17% in 2016.

Low-cost, simple modifications to help people be safer and more comfortable in their homes, such as installing grab bars and higher toilets, continue to be the most popular aging-in-place remodeling projects.

CITY & COUNTY Spray Noxious Weeds, Mow Grass

Old Red Trail Improvement Project to Begin

Noxious weeds and vegetation must be cut or sprayed to be maintained under a 6-inch maximum height. A City of Mandan ordinance requires property owners to mow tall grasses or spray weeds by May 1, June 1, July 1, Aug. 1, Sept. 1 and Oct. 1 of each year. Failure to comply, results in the property being cut or sprayed by the City with cost applied to special assessments for the property.

Property owners who neglect their lawns will be required to pay a minimum of $300, which includes a $150 fee and a minimum charge of $150 for each hour of lawn care services. To report concerns, call the Mandan Code Enforcement Officer at 667-3250 or use the Report a Concern form at www. cityofmandan.com. Note: Dandelions are not a noxious weed.

Don’t by a vehicle without calling us!

Construction along a portion of Old Red Trail in Mandan is expected to begin this summer. The street improvement project includes a project to widen the roadway adjacent to the Starion Sports Complex and commercial property on the south and the Tesoro property to the north.

The wider roadway will allow for a dedicated left turn lane into those benefiting properties and allow traffic to flow more smoothly and safely. The estimated $550,000 project will be funded through special assessments to the benefiting properties.

Mandan Building Official Moves Building Official Doug Lalim recently announced his departure from the City of Mandan. Lalim announced that he accepted a position as building official of Williams County in a move that will bring him and his wife closer to a new grandbaby. The association has appreciated working with Lalim over the past few years and will greatly miss his practical approach to building rules and regulations.

The association will stay in touch with the City of Mandan as they solicit and interview applicants for Lalim’s position.

BMHBA NEWS SUPPORT LOCAL STUDENTS AT THE ANNUAL SCHOLARSHIP FUNDRAISER PICNIC

W

hile you enjoy excellent food from the Harvest Grill and complimentary beverages, be sure to reflect on the most important reason why BMHBA members are gathering – The BSC Scholarship Fund.

The Annual Scholarship Picnic is our kick-off event to raise funds that will benefit Bismarck State College students pursuing careers in the building trades. BMHBA has given away $ 33,000 in scholarships since the fund’s inception in 2006. A decline in skilled workers has burdened the residential construction industry for years, and your support of students will help to provide our very own members with valued employees, allowing builders and contractors to grow their businesses.

The BSC Scholarship fund has already proven that its benefits will come full circle, with former recipient Grant Miller starting his own contracting business and becoming a valued member of the association.

“I received the BSC Scholarship while attending the carpentry program in 2009-2010. The scholarship helped me to continue my education, gaining knowledge and skills that have all been used since I’ve been in business,” shared Miller. “I have been working in the construction Industry since I was 16, and building homes was something I really wanted to do. After starting my business, I knew joining the BMHBA would be a great networking opportunity. Joining has been a valuable way to stay informed on the changing climate of the home building industry, and gain access to education seminars that wouldn’t otherwise be available,” he added.

NAHB Urges EPA to Reevaluate Cost-Benefit Analysis of RRP Rule Former NAHB Remodelers Chairman Bob Hanbury, CGR, a remodeler from Newington, Conn., asked the Environmental Protection Agency (EPA) to reconsider the costs of complying with the Lead Renovation, Repair and Painting (RRP) Rule. EPA’s hearing, where Hanbury testified on behalf of NAHB, is the first in a series of steps the agency is taking to reevaluate its regulations.

The RRP rule requires remodeling companies and other firms performing renovation, repair and painting projects that disturb lead-based paint in homes, childcare facilities and preschools built before 1978 to have their firm certified by EPA (or an EPA-authorized state program), use certified renovators trained by EPA-approved training providers, and follow lead-safe work practices.

When the rule was finalized in 2008, EPA assured the industry that an inexpensive, accurate test kit would be commercially available by September 2010 so that remodelers could save their clients the additional expenses associated with RRP compliance. The promised test kit is still not available.

EPA Head to Speak to NAHB June 15 NAHB will welcome Environmental Protection Agency Administrator Scott Pruitt to the Midyear Meetings in Washington, D.C. on June 15 to update board and committee members on progress the Trump administration has made toward cutting red tape from the regulatory process and transferring more authority from the federal government to the states.

“Regulatory reform is top of mind for our members,” said NAHB chairman Granger MacDonald. “We are spending too much time and money attempting to follow a tangle of rules and regulations that make housing less affordable without making our communities safer or cleaner.” NAHB Senior Officers paid a call on Pruitt two months ago to discuss three particularly thorny issues: the confusion and overreach of the Waters of the United States (WOTUS) definitions and stormwater regulations in the Clean Water Act and regulations regarding working in homes that may contain lead paint. MacDonald also attended the signing ceremony when the president signed the executive order to begin the WOTUS rule rollback process.

“We have a very consistent message: A healthy home building industry doesn’t just provide shelter for Americans, it is central to our economy. I invite all our members to listen to Administrator Pruitt’s presentation on June 15 – and take part in the other activities surrounding our Midyear Meeting, including the Legislative Conference and our committee and subcommittee meetings. This is our business, and our industry’s future,” MacDonald said.

“NAHB urges the EPA to conduct a revised cost-benefit analysis that acknowledges a compliant lead testing kit has not come to market,” Hanbury said. “In addition, the EPA should identify ways to appropriately limit the scope of the rule’s coverage, limiting it to specified buildings built before 1960, which have a greater likelihood of containing regulated levels of lead-based paint.” Because there is no test kit meeting EPA approval, remodelers working in pre-1978 homes must either assume lead-based paint is present or accept the findings of the currently available test kit, which is prone to produce false positive results.

HUD has found that 24% of homes built between 1960 and 1977 contain regulated levels of lead-based paint. This means when renovators assume that lead is present in these homes, it is likely that 76% of the time renovations are in a home never intended to be covered by the program.

The agency will also accept written comments through May 15.

House Passes GOP Health Care Bill The House approved legislation designed to repeal and replace the Affordable Care Act, also commonly known as Obamacare.

The Republican measure to revamp the nation’s health care system received no Democratic support and was narrowly approved by a vote of 217 to 213. The Senate is expected to make considerable changes to the House bill.

This legislation marks the first step in returning affordability to the health care system.

NAHB commended the House for passing H.R. 1628, the American Health Care Act of 2017. In an official statement, NAHB Chairman Granger MacDonald said:

“Our members are dominated by small businesses and more and more of their bottom line is being eaten up by rising health insurance premiums. This legislation marks the first step in returning affordability to the health care system. “We are hopeful that the Trump administration will take additional steps to curb costs, while the Congress pursues important legislation to allow small businesses to join together in insurance pools across state lines. Reps. Marsha Blackburn (R-Tenn.) and Kurt Schrader (D-Ore.) on May 4 introduced bipartisan legislation to encourage energy efficiency in buildings while ensuring that home builders and home owners are not burdened by unreasonable regulations.

H.R. 2361 is similar to legislation the lawmakers introduced in the 113th and 114th Congress to promote more transparency and encourage cost-effectiveness when developing residential energy codes. It requires that any code or proposal supported by the Department of Energy (DOE) has a simple payback of 10 years or less.

HUD TASK FORCE TO TACKLE EXCESSIVE REGULATION Following up on President Trump’s recent directives designed to ease the burden of onerous and conflicting federal regulations, HUD announced it is forming a task force to identify agency regulations that should repealed, replaced or modified – and get a better handle on the price tags, including record-keeping costs, associated with each one. HUD is taking this action in accordance with Executive Orders 13771, “Reducing Regulation and Controlling Regulatory Costs,” and 13777, “Enforcing the Regulatory Reform Agenda.” Of particular interest to the agency are rules that:

WHO ARE NAHB BUILDER MEMBERS? The 2016 annual member census conducted by NAHB reveals that 60% of our builder members are singlefamily builders, 23% are residential remodelers, 6% are commercial builders, 5% are multifamily builders and 4% are land developers. Commercial remodelers and manufacturers of modular/panelized/ log homes each comprise 1% of the builder members. Overall, 32% of NAHB’s members are builders who are directly involved in home building while the remaining 68% are associate members who work in support industries and professions such as trade contractors, manufacturers, retailers/ distributors, designers and architects.

As NAHB economist Carmel Ford explains in a recent Eye on Housing blog post, NAHB conducts the yearly census to better understand the composition and characteristics of the members who belong to our organization. Company Details

NAHB’s builder members reported that they had a median of five employees on payroll in 2016. A further breakdown of the number of workers on payroll is as follows: • No employees: 3%

BIG SAVINGS FROM BETTER CODES Practical building codes are critical to ensuring the safety and quality of every new home. But some proposals to change them are excessive, overreaching or seemingly created to benefit product manufactures significantly more than the home owners.

Last year, NAHB led countless efforts that successfully removed or excluded unnecessary measures from building c o d e s — provisions that would have greatly increased builder costs without a corresponding benefit and ultimately, impacted housing affordability.

Many of these mandates focus on products or techniques regarding fire safety, air quality and energy efficiency. The combined impact of just a select number of such provisions that NAHB helped exclude from building codes is equal to an approximate savings of $1,200 per housing start in 2017. June is home ownership month. Those of us involved in the home building industry know the benefits of owning a home, but it is important for us to remind ourselves and educate the public and our public officials about the benefits as well. In some of the communities we live in across the state, it seems other special interests are viewed as more important to the local economy, so I think it is important for us to discuss some of the benefits.

First of all, there are two major tax advantages of owning a home. The first and most widely talked about is the mortgage interest deduction. The other one is the real estate tax deduction. For those who itemize their deductions the mortgage interest and real estate tax deductions can reduce their tax liability. Eliminating the mortgage interest deduction is often brought up when the subject of tax reform is discussed. I can assure you, the National Association of Home Builders (NAHB) will do everything it can to keep this tax advantage in place for the housing industry. According to a special study in housingeconomics.com, there are several policy justifications to keeping the deduction for the mortgage interest in place. First of all, research indicates that homeowners are more likely to maintain their homes and be involved in local social and political organizations. Therefore, communities with a large percentage of homeowners tend to possess more public amenities and have a lower crime rate than those with less home ownership. I think most of us see this in our daily lives. People tend to take better care of things when they have an ownership stake. Another important benefit to home ownership is it provides a means for families to save and accumulate wealth. Housing is the major source of wealth for most US households. As of 2010, the primary residence accounted for 30% of all household assets. Housing is especially important for lower income households, many of whom have very few assets except for the equity in a house. As we all know, there are many other benefits of home ownership. It is our job to promote these benefits to the public and the public officials so they see the value in keeping prohousing policies in place. NAHB will do the same on our behalf to keep in place the tax advantages of home ownership on the national level. Eric

Adjournment sine die – The end of a legislative session “without day”. The 65th Legislative Assembly adjourned (sine die) on Thursday, April 27th. This means legislators have set the state budget, finalized decisions on all bills introduced, and will not meet again until January 2019. The next step in the process is for all bills that passed both chambers goes on to the desk of the Governor who signs Kim Schneider the bill or in some cases, vetoes all or part of the bill. Once the Governor signs a bill, it is then CEO filed with the Secretary of State’s office and the law is enacted on the agreed upon date noted in the bill. NDAB’s Government Affairs committee is made up of representatives from all six local associations lead by GA Chairman Jason Eid (Fargo) and Vice Chairman Eric Brendan (Bismarck). NDAB CEO, Kim Schneider, is the registered lobbyist representing NDAB at the Capitol. Our representatives look at bills brought forth that we feel impact our members and industry, discuss the pros and cons of the bill, gather feedback, and make an informed decision on the stance NDAB will hold on a bill. Kim tracks the bill and provides updates to Jason, Eric and the GA committee and if need be, the group reconvenes to discuss any changes and a possible change in the stance of our position. During the 65th Legislative session, NDAB tracked a total of 33 bills that covered areas such as radon, carbon monoxide, one-call, diversion, contractors, inspections, essential service workers home incentives, the housing incentive fund, and many other bills that impacted the home building industry in either a positive or negative way. NDAB is proud to share that we worked closely with House and Senate members and various lobbyists from across the state. Members from across the state traveled to Bismarck on several occasions to testify, show support and ensure their voice was heard through emails and phone calls. When we hosted an evening social, a Q & A lunch and a thank you lunch for the legislators, NDAB was well represented. Strength in numbers was proven this past session and we greatly appreciate the support given by all! Just because the final gavel has hit, our advocacy work does not end. With your legislators, back in their home towns, please make sure you are inviting them to your events and meetings. Keep the conversations and relationships going and thank them for their hard work. NDAB members will also be traveling to DC where we will be meeting with Senator Heitkamp, Senator Hoeven and Congressman Cramer discussing national issues and thanking them for their continued hard work.
