A Word from Our President: Call to Nominate Outstanding Members With over 360 members, the BMHBA has member companies spanning every inch of the building industry.

We want to recognize our outstanding members this year (and every year) with our three annual awards – Builder of the Year, Association of the Year and BEAM (Builders Engaging Associate Members) Award.

We, at the BMHBA, know Eric Brenden that there is no one better to Board President tell us who our outstanding members are than you, the ones working in the trenches with them every day.

That is why I’m writing to encourage you to nominate those outstanding members you work with for these awards.

The Builder and Associate of the Year are geared toward members who go above and beyond in their business, the community and HBA involvement. The nominated candidates will be judged on: business accomplishments, civic activity, member spirit/local association activity, and state and national activity.

The BEAM award is fairly new, and was designed by the National Association of Home Builders to recognize those builders who embody the motto, “it’s good business to do business with a member,” and foster great relationships with those members. Only builder members are eligible for this award. However, both builders and associate members can nominate.

The BEAM nominee should be a builder who strives to work with member subcontractors, builds strong relationships with those subcontractors, and uses ethical business practices.

Nomination forms for these awards will be sent out soon, but feel free to contact the BMHBA office at any time to make a nomination.

Also, we’re sending out a member survey in the next couple of weeks. The survey will ask you to verify your member information for the member directory (to be published Jan. 2014), as well as ask some questions regarding your membership preferences and demographic information. I highly encourage you to take a few minutes and fill out the survey when you receive it. Your responses can help us serve you, our members, better.

Again, please consider nominating some outstanding members for each award. It is a great way to recognize those who give of their time and talent to our association and our industry.

Committee Highlight: Government Affairs Committee What is Government Affairs?

In order to define government affairs, we must first define the overall term of advocacy. Advocacy is a broad programmatic “tool” used by citizens to influence public policy at all levels of government. Advocacy is all encompassing and may incorporate political action, legislative, regulatory, grassroots, legal, and media strategies – all for positive change in government.

One of the largest components, and arguably the most important aspect, of an advocacy program is government affairs, the act of being engaged in both legislative and regulatory governmental action. Legislative affairs refer to matters that come before legislative bodies such as a city council, state legislature or the U.S. Congress. Regulatory affairs refer to issues that go before rulemaking bodies, such as the Department of Housing and Urban Development (HUD), a city building department or perhaps a state environmental agency. To put it simply, legislative bodies make laws and policy, and regulatory bodies carry out that law or policy, often creating the rules of enforcement associated with the law/policy. Active engagement in both is crucial to an effective advocacy program.

What does the Government Affairs Committee do?

The BMHBA Government Affairs Committee is tasked with reviewing any industry-related ordinances or laws coming before the City and County commissions, as well as building strong relationships with local officials.

The committee is currently tasked with reviewing and forming an official HBA opinion (to be approved by the Board) on the littering/job site cleanliness ordinance (#5971) in the City of Bismarck. The ordinance was emailed to builder members for comment prior to the committee meeting. A summary can be found on pg. 10.

This process is typically started by sending out a questionnaire to all candidates asking for input. The committee then reviews the responses and determines if an in-person meeting with the candidate is necessary before a final decision can be made. Official letters of support/monetary donations are then sent to the candidates who are chosen.

Why is Government Affairs important?

Involvement in government affairs is the most important priority for local, state and national HBAs. We are your watchdogs for the industry, and it is our job to make it easier for you to do your jobs well. You, our members, are represented in local, state and federal government through your 3-in-1 membership.

Mark Your Calendars for Upcoming BMHBA Events!

Set Your Sights on the Sporting Clay Shoot Aug. 29 The 2013 Sporting Clay Shoot is set for August 29 at Capital City Sporting Clays. Join us for an afternoon out on the course. There will be prizes for the bud bird station, as well as door prizes and lots of fun. The day will conclude with a barbeque for all the participants.

The shooter fee is $75 per person. The registration includes target fees, shells, earplugs and the barbeque to follow.

Shooters can register as a member of a team or individually.

Registration forms have been sent out and online registration is now open at www.bmhba.com.

Builders Prepare for the Fall Parade of Homes

The Fall Parade of Homes is set for Thursday, September 26 through Sunday, September 29. This shorter Parade is a great way to showcase your home(s) without having to work the home for 2 weekends. Registration is still open for interested builders.

The cost to participate is $500 for the first home and $375 for each additional home. Only member builders are able to showcase their homes, and only member subcontractors/suppliers are allowed to advertise within the homes.

Contracts have been sent out to the builders who responded to the pre-commit. If you would like a contract and haven’t received one, contact the office or visit www.bmhba.com. The contracts with payment are due back on August 14. The home information will be due on August 28, including home photos, descriptions and directions.

Advertising opportunities in the Fall Parade of Homes magazine will be available to members, as well. To find out more information about ad prices and availability, contact Deb Seminary at The Printers (255-3422).

Competition Heated Up at the Annual PAC Golf Tournament We had a beautiful (but hot) day for the Annual PAC Golf Tournament again this year. Thank you to everyone who played, volunteered and sponsored. It is only with your help that we can pull off this great event each year.

We had 142 golfers out on Hawktree Golf Course the afternoon of July 16. They enjoyed ice cream, candy, shrimp, beer, margaritas and more great treats on the course. Congratulations to all our tournament winners!

City Beat: Unlawful Dumping and Littering by Contractors; Duty to Clean Bismarck Ordinance Proposed A city ordinance has been proposed in the City of Bismarck that could have a great impact on local contractors. Bismarck Building Official Ray Ziegler has submitted Ordinance No. 5971 Unlawful Dumping and Littering by Contractors; Duty to Clean to the BMHBA for industry comment before it is taken to the commission. The entire ordinance was emailed to member builders in late July, and the Government Affairs Committee met on July 31 to form an opinion from the HBA. Here is a summary of what the ordinance entails.

1. No contractor shall allow any vehicle to operate out of any construction site, regardless of whether it is operated by the contractor, his employees or subcontractors, in a manner as to release/dump any rubbish, stones, construction waste, mud or other offensive or noxious material on any street, alley or public place. The building official/health officer shall order any contractors to take precautions to prevent foreign material from being deposited in the street.

If a contractor fails to comply with the order of the building official/health officer, the official may order all construction stopped until compliance is obtained.

2. Before any vehicle enters the street, alley or public place, the contractor must first do these three things: 1) clean the tires and wheels so as not to litter or soil the street, 2) remove any material on the interior or exterior of the vehicle that may fall off or be deposited on the street from normal movement of the vehicle, 3) appropriately secure any load of construction materials, debris or solid waste contained in any truck, trailer, etc. so as to prevent any of it blowing or falling out of the truck.

3. All streets, alleys, sidewalks, public places or private property where construction materials/debris may have accumulated must be maintained in a clean and litter-free condition by the contractor at all times.

The contractor shall take any steps necessary to secure construction materials/debris to prevent migration by wind, water or general construction activities. The contractor is responsible to clean up any property that has received a migration of their materials.

4. If a street should become soiled or littered by any means outlined here, the building official/health officer may order the contractor to clean up or take precautions to secure the construction site however the officials deem necessary to prevent it from happening again.

5. The contractor is responsible for the

compliance of all those working on his site with this ordinance. If more than one contractor or any governmental unit is involved in work which contributes to the littering of these public areas, they will be held separately and jointly responsible for compliance.

6. Stop Work Order: The building official/health officer has the authority to issue a stop work order, ordering suspension of all work and activity at the site, upon finding that the contractor has failed to comply with the order of the building official/health officer to comply with the provisions of this ordinance. The building official/health officer may lift the stop order upon proof of compliance with the ordinance.

7. Whenever the building official/health officer issues a stop work order and declares the situation to be an emergency, the building official/health officer shall serve the notice and order on the person performing the work personally, or by registered and certified mail. The person performing the work or permittee has the right to an informal hearing before the building official/health officer by making an appointment with them. The informal hearing must be held within 5 days of receipt of the notice and order.

8. Notice and Order: Except for emergency orders as seen in section 7, whenever the building official/ health officer finds that any person has violated or is violating this ordinance, the building official/health officer shall serve that person with a written notice and order stating the nature of the violation. Within 15 days of the date of the notice, the correction must be completed to the satisfaction of the official.

9/10. Appeal and Hearing: All decisions of the building official/health official dealing with violations are subject to appeal. Appeals must be filed within 15 days. Upon receiving notice of the appeal, the City Commission will set a date for a hearing within 30 days.

{Continued} City Beat: Unlawful Dumping and Littering by Contractors Ordinance Proposed final and un-stayed order of the building official/ health officer or a decision of the City Commission after a hearing or who has failed to comply with any provision of this ordinance is guilty of an infraction and is subject to the provisions of Chapter 1-02 of the City Code (Penalties). Each day the violation continues constitutes a separate offense.

There is also a proposed amendment to hauling restrictions included in this ordinance. The amendment boils down to: “A person may not haul or transport garbage, rubbish or solid waste to the city’s disposal grounds except in a vehicle that does not permit any garbage, rubbish or solid waste to seep, spill, leak, blow, drop off or fall to the streets, roads or highways leading to such disposal grounds.”

Construction Site Crime Prevention Lunch-n-Learn to be Presented by Bismarck Police Department The BMHBA is hosting a lunch-n-learn on September 12 presented

by Officer Wanner at the Bismarck Police Department. The lunch-nlearn will cover strategies to prevent construction materials from getting stolen on the job site and how to prevent vandalism among other things.

This is a great chance for our members to learn strategies for how to prevent crime from those who truly know how the criminals operate.

OSHA Presents Multi-State Fall Protection Training Session

NDAB Safety Training Offers Free OSHA-10 in Bismarck

Falls are the leading cause of death in construction, accounting for one third of all work-related deaths in the industry.

To underscore the top priority we have of protecting workers, the OSHA regional office has partnered with HBAs and the Associated General Contractors across North Dakota to host a voluntary Stand Down for workers from industries with employees who work at heights.

A voluntary Stand Down can be very helpful in focusing all workers on the importance of safe work practices. The session will be broadcast as a webinar across multiple states and there will be host sites in Fargo and Bismarck. The Falls Stand Down session will be October 1 from 9 a.m. to 11 a.m.

Be on the lookout for more information as the date approaches.

The OSHA-10 is a 10-hour program intended to provide instruction on construction industry safety and health topics and OSHA standards to both employee and entry level supervisors. Using OSHA standards as a guide, special emphasis is placed upon most hazardous areas of a jobsite. Topics include Material Handling, Excavation, Fall Protection, Cranes, Electrical, OSHA Act, Hearing Conservation PPE and several other subjects covered.

The course will be offered in Bismarck Wednesday, October 16 (1 p.m. - 5 p.m.) and Thursday, October 17 (8 a.m. - 5 p.m.). This course is free to BMHBA members. A $75 fee per person is applicable for all non-members.

New Legislation Is Now In Effect

Many of the bills passed during the past legislative session went into effect on August 1st. Among those bills are these which affect our membership:  Property Sales Price Disclosures — Doreen Riedman Section 11-18-02.2 of the North Dakota Century Code has been amended to remove the section that provided for the secrecy of sales price disclosures on property transfers. This is a major change that will allow sales prices to now be public information.  Bank of North Dakota Residential Mortgage Loan Program — The changes expand the program of the Bank of North Dakota and removes the $200,000 per loan limit.  State Building Code Accessibility Standards — This bill requires all new buildings over 7,500 sf to include door openers if they fall in the assembly, business, educational, instructional, or mercantile classifications. If the building is a strip mall, only those spaces in excess of 7,500 sf must have the door openers.  Publication of Advertisements of Bids for Public Improvement Contracts — The first publication of the advertisement must be at least twenty-one days before the date of the opening of bids in the official newspaper of the political subdivision. The changes here allow for electronic plan service, builders exchange, or other industry-recognized method to be used in addition to the official newspaper.

Builder Confidence Up Six Points in July

Builder confidence in the market for newly built, singlefamily homes rose six points to 57 on the National Association of Home Builders/Wells Fargo Housing Market Index (HMI) for July. This is the index's third consecutive monthly gain and its strongest reading since January of 2006.

“Today's report is particularly encouraging in that it shows improvement in builder confidence across every region as well as solid gains in current sales conditions, traffic of prospective buyers and sales expectations for the next six months,” noted NAHB Chairman Rick Judson, a home builder from Charlotte, N.C. However, he cautioned that “This positive momentum could be disrupted by threats on the policy side, particularly with regard to the mortgage interest deduction and federal support for the housing finance system.”

“Builders are seeing more motivated buyers coming through their doors as the inventory of existing homes for

sale continues to tighten,” noted NAHB Chief Economist David Crowe. “Meanwhile, as the infrastructure that supplies home building returns, some previously skyrocketing building material costs have begun to soften.”

Derived from a monthly survey that NAHB has been conducting for 25 years, the NAHB/Wells Fargo Housing Market Index gauges builder perceptions of current single-family home sales and sales expectations for the next six months, and asks builders to rate traffic of prospective buyers.

All four regions also posted gains in their HMI scores' three-month moving averages. The Northeast showed a fourpoint gain to 40 while the Midwest reported an eight-point gain to 54, the South posted a five-point gain to 50 and the West measured a three-point gain to 51.
