remier Darrell Pasloski praised the federal government this week for renewing the mineral exploration tax credit in its 2016 budget.

Pasloski also seemed keen to take credit for the decision in a brief statement he issued on Wednesday. “I am pleased to see that the Government of Canada responded positively to my letter emphasizing the importance of the mineral exploration tax credit and have continued it for another year,� he said in the statement.

While it’s true that Pasloski did send a letter to Prime Minister Justin Trudeau urging him to renew the credit earlier this month, it’s unclear whether that letter had any bearing on the federal government’s decision.

Trudeau had offered praise for the credit before last year’s election, saying that his party supports “this important tax measure to encourage increased investment in the mining industry.�

Yukon MP Larry Bagnell also said he supported the credit during his election campaign.

Pasloski offered few thoughts on the rest of the budget. “The devil is in the details when assessing a budget,� he said, echoing a comment made by Yukon NDP Leader Liz Hanson earlier this week.

The premier said he will comment more fully on the federal budget when he tables the territorial budget this spring. That date still hasn’t been set.

The Yukon Chamber of Commerce, however, had more to say on the issue. “Most of the budget is, in our view, focused on good things,� said Peter Turner, the chamber’s president. “The concern I guess that we’ve got is that there are infrastructure needs here in the Yukon that don’t seem to be being addressed.�

The budget contained few specific references to the Yukon.

Turner pointed out that infrastructure projects that the Yukon government has been prioritizing, like the paving of Dawson City’s airport runway and the construction of new mining roads, were not mentioned in the budget.

But he acknowledged that those projects might be eligible for funding under the broader

Turner said the extension of employment insurance benefits by five weeks, or by up to 20 weeks for long-tenured workers, may also help Yukoners. “We are in a slow economy here at the moment, so it will certainly be impactful for people up here whose EI benefits are running out,� he said.

But he was less enthusiastic about the increase to the Northern Residents Deduction to a maximum of $22 a day, up from $16.50.

He said the cost of living in Whitehorse isn’t vastly higher than that of Vancouver or Edmonton. “I think that when you’re in a place like Old Crow ... those are welcome and significant benefits,� he said. “It’s nice to have, but does it markedly move the needle on the economy up here? I would say probably in Whitehorse and most of Yukon, no.�

Turner said he was also looking to see how federal money would be invested to meet the needs of First Nations. He noted that many of the First Nations funding commitments have been earmarked for use on reserve, which means Yukon First Nations won’t be eligible.

The federal budget includes $2.6 billion for First Nations education, $554 million for housing,

$270 million for health care and $2.24 billion for green infrastructure – all for needs on reserve.

However, the budget also allocates $40 million for the national inquiry into missing and murdered indigenous women and girls.

The Yukon recently held a regional roundtable and a family gathering for the families of missing and murdered indigenous women in the territory.

Kristina Craig, coordinator of the Yukon Anti-Poverty Coalition, said she was “very supportive� of the $8 million announced for affordable housing in the Yukon, though she hopes it’s “just a start.� “It’s been 25 years of not having much of a federal investment in housing,� she said. “It’s good news, but it’s certainly not going to solve it for us. It’s a good start, I guess.�

Hot springs residents still steamed over condo plans Myles Dolphin News Reporter

et another public meeting about development plans at the Takhini Hot Springs site descended into heated exchanges this week.

It was standing room only at the Hootalinqua Fire Hall for a meeting on Tuesday evening that topped two and a half hours.

Back in November, tempers flared during Brad Cathers’ constituency meeting at the same location and over the same issue.

But this time, the proponent of the development was around to field questions.

Garry Umbrich spent a good portion of the evening trying his best to address the accusations that flew from all corners of the room.

The purpose of the meeting was to give more information about Umbrich’s application for a zoning change at the Takhini Hot Springs site.

Umbrich and the group of lot owners at the site want to see regulation changes so that bare land condominium units are allowed. As it stands, only strata units are allowed.

Umbrich explained that strata units require three-dimensional surveys, which are expensive.

The units need to be built before a bank can provide financing, he said.

But with bare land condominiums, two-dimensional surveys are required, which means financing can be obtained ahead of time, before construction.

But on Tuesday evening, many residents weren’t interested in hearing about condo terminology.

Although bare land condominium units would be more profitable in the future, Umbrich said he would carry on with strata units if he had to.

The consensus among dissenting residents boiled down to concerns about development plans at the site.

Last month, Umbrich held an open house to present resort plans that have been in the works for over 15 years.

Umbrich and his wife, who own four of the 10 lots on the

site, want to transform the hot springs from their current incarnation as a concrete recreational pool to a more natural-looking design, like the Liard Hot Springs in British Columbia.

The new design will see the construction of three or four smaller pools with temperatures between 40 and 42 degrees. In comparison, the current pools are between 35 and 39 degrees.

Most of that parcel of land, about one hectare in size, will be enclosed in a fence that won’t be visible from any of the pools.

Six of the 10 lots on the site have been sold to numbered companies.

But some residents are concerned about seeing houses crop up next to their properties in the near future.

One point of contention has been whether Umbrich has the right to cluster a large number of residences on a single lot.

According to the Hot Springs Road local area plan, up to two residences are allowed on a single lot. But the zoning allows for the owners to transfer this al-

lowance to adjoining lots.

This is what Umbrich and other owners have done. One lot allows for the construction of three residences, while one allows for five and another allows for nine.

Jerome McIntyre, director of the land planning branch, said he’d never seen zoning quite like what exists at the Hot Springs site in his career.

“This special provision is terrifying to the public,” one woman said.

“We’re scared of the implications. What will this site look like in the future?”

The zoning at the site also stipulates that a commercial business must take up 51 per cent of a lot before a residence can be built.

One resident at the meeting wondered how big a business would be if it took up more space than nine houses on a single lot.

Umbrich said he was willing to sit down with concerned residents to hear them out, and talk about what those residences could look like.

He’s also mentioned in the past that the site may feature other amenities such as a bakery, a pub or laundromat. It might also include greenhouses and gardens on the site to grow food.

But his ultimate goal, he said at last month’s open house, is to one day build a five-diamond high-end destination spa, one that would “put Yukon on the world map.”

The zoning application still needs to be approved by cabinet.

The deadline to submit written comments is April 8.

wo Whitehorse city councillors who called for more fiscal responsibility during their election campaigns last year say they’re satisfied with the proposed operating budget set to be voted on next Tuesday.

Both Dan Boyd and Samson Hartland said they wanted to tackle tax increases and keep the City’s spending habits in check when they ran for a seat on city council.

In February, council unveiled the 2016 operating budget. It features a 1.7 per cent increase in property taxes for both residents and businesses, the same as in 2015.

Your typical Whitehorse homeowner will pay another $39 in property taxes this year, provided the city passes its budget at the end of the month. The average Whitehorse business would pay an extra $250.

The City is anticipating the

same increase next year and a 2.3 per cent increase in 2018.

Boyd said one of the reasons the budget was delayed this year is because council and administration worked so hard to get the tax increase as low as possible.

“And we did achieve a certain amount of success, as we’ve reduced costs by about $330,000,” he said.

“That’s equal to about a one per cent tax increase.”

But Boyd said he would have liked to see even more cuts. He had hoped to lower the tax increase to 1.5 per cent, he said.

After several meetings and an endless back and forth between members of council and administration, the 1.7 per cent increase represents what most people could agree on, he added.

“There was a feeling this was a spot where the majority of council could live with,” he said.

“I think we did reasonably well, all things considered, to achieve this.”

At Monday evening’s council

meeting, Valeria Braga, the city’s manager of financial services, talked about some difficult cuts that were made to the upcoming budget.

Departmental requests denied included increased patrols on the waterfront and trails, training for the fire department and additional building maintenance staff, among others.

Last year, Hartland said he planned on tackling the tax increase because of its impact on seniors and people with fixed incomes.

“You have builders of our community being pushed out of their homes because they can’t afford to pay the taxes anymore,” he said in August.

One challenge council and administration faced, he explained, was to try and keep property taxes to a minimum despite the increase in assessments this year.

Every other year, the Yukon government reviews and reassesses the value of over 22,000 properties and buildings in the

territory.

The assessment increased by about $6,000 per building this year, Braga told council on Monday.

The City uses the government’s assessment rate and multiplies it with its own mill rate to come up with the property tax increase.

“We actually dialed back the mill rate this year and that’s a sacrifice people don’t see,” Hartland said.

Rick Karp spoke to members of council last week and encouraged them to follow Yellowknife’s model, which was to freeze taxes for 2016.

One suggestion was to take funds from the City’s many reserves in order to achieve that.

Hartland said Karp made a lot of valid points during his presentation.

“You’re right, we could go into the reserves more than we ever have before to balance the budget,” he said.

“And that’s still an option. But is that sustainable?

“What we’re hearing from our own experts is they truly believe the budget in front of us is the best we can do.”

Boyd said the City transferred $9.7 million into its reserves last year, and anticipates a transfer of $10.5 million this year.

The reserves are being built up to fund large capital projects such as the construction of two new headquarters for the City’s staff, one at the top of the Two Mile Hill and one downtown.

Both Boyd and Hartland said they’re in favour of taking a much closer look at how the City can scale down those plans and save costs.

“I’ve brought it up many times,” Boyd said, “and the reality is we’re going at it slower than originally planned.”

“We have to keep it affordable and we have a commitment not to raise taxes because of it.”

Second and third reading of the operating budget will be held on March 29.

With credit for the time he has already served, Truesdale has two years and 10 months left in his sentence.

Truesdale was part of a group of men arrested in November 2013 following an RCMP investigation dubbed Project Monolith.

With the help of a former drug dealer turned police informant, Yukon RCMP said the investigation, which lasted more than six months, was one of the most significant organized crime investigations in the territory to date.

As part of that investigation Truesdale was seen giving the police agent nearly 1.75 kilograms of cocaine, prosecutor Eric Marcoux told the court.

In earlier hearings involving the Monolith case the wholesale value of cocaine has been pegged at $75,000 a kilogram.

Earlier this month Jesse Ritchie, also from B.C., was sentenced to five years and seven months in prison for his role in the trafficking ring.

Marcoux said Ritchie was higher up in the hierarchy of the organization than Truesdale.

a half years in prison earlier this year. In that case his fingerprints were found on a bag wrapped around a kilogram of cocaine.

A fourth man, Asif Aslam, was supposed to be sentenced yesterday as well but his hearing was pushed back to next month because his lawyer had a scheduling conflict.

Truesdale’s sentence was recommended to the court by both lawyers. Judge John Faulkner found that it was within the range for these types of crimes.

Marcoux pointed out that by pleading guilty Truesdale was saving the court from an expensive trial that was scheduled to last six weeks.

Truesdale’s lawyer, Doug Jevning, said his client plans to use his time in prison to complete the course he needs to finish his GED. Jevning gave several letters of support to the court written by Truesdale’s friends and his employer in B.C. He said Truesdale has left behind his former life and has been working on rehabilitating himself.

His is employed, will have work waiting for him when he is released from prison and has been telling friends and family how remorseful he is, Jevning said.

Faulkner said Truesdale had made more than “poor choices� to land himself where he is today.

The judge called the “corrosive effects of drug abuse� a serious problem that faces society.

Along with his prison sentence, Truesdale will be banned from owning a firearm for 10 years after his release.

Whitehorse gardeners push for urban beekeeping Myles Dolphin News Reporter

A

bout 40,000 bees could be buzzing around the corner of Seventh Avenue and Ray Street in Whitehorse if a group of gardeners have their way.

A zoning application is underway to allow for the construction of two beehives at that spot. And while the prospect of having thousands of honey bees flying around a residential neighbourhood may be concerning to some, there’s nothing to fear, according to the president of the Downtown Urban Gardeners Society. “It sounds like a lot of bees but these are different than the ones in cartoons,� said Randy Lamb. “If we’re talking about Africanized bees or yellow jackets that’s different. Honey bees are quite docile and very businessoriented.�

As Lamb explained it to members of city council at Monday evening’s meeting, there is a longstanding history of beekeeping in the territory.

According to his records, there have been apiaries here since the 1980s.

There are between 15 and 20 beehives in the city alone, he said.

The community garden is currently zoned PE-Environmental Protection. According to a report from administration, this zone allows for the cultivation or growing of plants on a conditional use.

Apiaries are permitted for “hobby agriculture,� a use cur-

rently allowed only in country residential zones.

The proposed amendment is to allow hobby agriculture in the society’s garden.

Cities across Canada have been amending their bylaws to make it possible for that to happen.

Lamb is organizing an information session at the Whitehorse Public Library in early April, with the goal of dispelling some of the myths about bees.

These aren’t the kind that will swarm and attack passersby, he said. “I can see most of these bees travelling the greenbelt around the clay cliffs, among the patches of fireweed and sweet clover,� he said. “The beehives are basically the airport and they’d be taking off and going to work. If it (their presence) wasn’t advertised chances are neighbours wouldn’t even see them in their yards.�

hitehorse residents who become riled at the thought of their municipal government continuing along its trajectory of incremental tax hikes may as well start practising their deep-breathing exercises now.

This coming Tuesday, Whitehorse city council is poised to pass its operating budget for the coming year, and it’s hard to imagine any outcome other than the spending plan being approved.

That means your average homeowner can expect to pay an additional $39 in taxes this year, for a total of $2,304. Your average business, meanwhile, would pay an additional $250, for a total of $14,830. This is the same 1.7 per cent increase budgeted last year. The city is planning a similar increase next year, too, followed by bump of 2.3 per cent for 2018.

These increases do little more than keep pace with inflation, and Whitehorse residents continue to pay taxes on par with comparable jurisdictions. But business leaders have a point when they note that a sluggish economy has required the private sector to make tough cuts – a reality that those within government are often insulated from. They’d like to see a tax freeze this year to help ease the pain felt by residents during these tough times. They’re unlikely to get it.

It’s hard to fault Mayor Dan Curtis for sticking with a course that he has long publicly defended. But it’s odd how little the public has heard on the matter until now from Samson Hartland and Dan Boyd, two city councillors elected on platforms of fiscal conservatism.

By now, the city’s shriller critics, whose thoughts tend to run a distinctly conspiratorial streak, may wonder whether these two have become absorbed, Borg-like, into the collective. But both simply insist they have been quietly putting downward pressure on spending initiatives during committee meetings, rather than creating a ruckus in front of reporters while council meetings are in session.

That’s probably pragmatic – after all, two votes by themselves are not enough to make a ripple in city policy. Still, it’s surprising that our current council has managed to avoid any vigorous public debate over how much money the city should spend.

The city’s capital budget quietly passed in December without any fuss. That’s despite the budget’s plans to plow ahead with building two spiffy new municipal buildings – an operations building at the top of Two Mill Hill, and a services building beside City Hall.

Clocking in at $56 million to be spent over the next three years, this is the City of Whitehorse’s biggest-ever infrastructure project.

City officials insist these new buildings won’t be built through tax increases. But, as our columnist Keith Halliday noted in a column late last year, there is reason to doubt whether this is true.

While the city does hope to secure a good chunk of federal cash for this building spree, the reality, as Halliday notes, is that part of the work will be funded with the city’s reserve

In fact, the $2 million that the city socked away in savings for 2014 was even bigger than Whitehorse’s increase in tax revenue. That means that the city could have frozen taxes and still balanced the budget that year, if so much money were not being diverted towards savings for such things as future infrastructure projects.

The mayor and city officials insist that the new municipal buildings should be viewed as long-term investments that will ultimately save taxpayers money by consolidating more workers under the same roof and through reduced heating bills. They also note that this construction work will help employ Yukoners.

Maybe this is all true. But the public was never treated to a serious public discussion about cheaper options, in light of the deteriorating economy. Boyd notes the construction schedule has been slowed to avoid costs spiralling out of control, which is commendable enough, but a far cry from a complete rethink.

After all, the Yukon government was able to scale back its grand designs for the new F.H. Collins school to something more modest.

Couldn’t the city have done something similar and made greater use of leasing downtown office space, of which there is currently a glut?

This is a question we’ve never heard anyone on city council ask.

Samson and Boyd have picked a public fight against one expansionary plan by the city, to roll-out a curbside blue bin program this year at a cost of about $15 per month to residents. Unfortunately, the duo haven’t presented a workable alternative. They’d like to leave the Blue Bin Society to chug away with its voluntary program, ignoring the fact that Raven Recycling, which processes the recyclables with the help of government funds, warns that the status quo is untenable and would eventually push the non-profit into bankruptcy.

City managers contend that the proposed operations budget already has a variety of small cuts included within it. They’ve said no to a bunch of departmental requests, and have made some actual reductions on administration. Overall, the city’s operations budget has grown by $312,000, or less than half a percentage point, to $70.6 million.

City officials say that $600,000 would have to be hacked from existing services in order to freeze taxes this year. It seems quite unlikely that any councillor will propose any cuts of this magnitude next week. But at the very least, perhaps someone could ask how much money from this year’s tax increase will be stuffed into the reserve funds that will help pay for the city administration’s new headquarters.

I was just vacationing in Bennett myself. After slogging in there on skis with a 40-pound pack, I can assure you I was in the market for a warm bed and a bacon-and-eggs breakfast. (I’ll pass on the frozen pack horse, ptarmigan and other Arctic Hotel services.)

To my surprise, Bennett was hopping. Perhaps not by the standards of the Arctic Hotel after dark, but at least compared with what you might expect from a frozen ghost town with no road access. A dozen skijoring enthusiasts zoomed past us near Bennett Station. Their dogs were pulling them too fast for me to conduct an interview for this column, but they seemed to be eco-tourists. Later in the day, as we bushwhacked towards Lindeman Lake we skied into a forest clearing only to find three contented-looking Germans having a wintery picnic.

Bennett is a magical place. It’s a ghost town with a thousand legends and its own picturesque railway, surrounded by mountains that make Switzerland look like a dump.

Unfortunately, we make it

so difficult to get there that almost no one visits. The only reasonable way to get there is by train, and that is expensive and seasonal. Getting there from Log Cabin involves bushwhacking since you can’t walk or bike on the train tracks. To get there by boat requires a 40-kilometre trip on the notoriously stormy Bennett Lake. In effect, we spend millions on ads luring tourists to our region, and millions maintaining historic sites, and then make it as hard as possible for the former to visit the latter.

Repurposing Donald Trump’s slogan, it is time to make Bennett great again.

I would suggest a mountain bike and hiking trail from Log Cabin to Bennett, roughly in parallel with the tracks but not so close your wilderness idyll is shattered by passing trains.

In the winter, skiers and snowmobilers could use it. Add a small hotel and restaurant with cabins or wall tents. Some day you could even have something like Lake Louise’s famed Skoki Lodge, hidden up in the mountains past the ski resort.

With access and a place to stay, you could have rafting on the Lindeman River and also lots of trails, day hikes and ski touring in the area. It would also encourage Chilkoot Trail hikers to

It turns out that the Carcross-Tagish First Nation in partnership with Parks Canada is working on these concepts and many more.

It is a great idea and they are to be commended for taking the initiative to make it happen. The critical thing will be improving accommodations, activities and access at the same time. A nice wilderness lodge will have a hard time surviving at Bennett unless access gets easier.

I look forward to being an early customer. I can’t wait to tell my wife that I’ve booked us a table and wall tent in Bennett.

I have just one piece of advice. Don’t build a 10,000foot runway. A future President Trump might land Air Force One there to see where his inheritance got started.

LETTERS Beware of ‘saving’ money we don’t got The CBC program The Consumer used to begin with Stompin’ Tom Connors belting out his song of the same name, one line of which went, “We’ll save a lot of money spending money we don’t got.”

Stompin’ Tom’s song referred to our tendency, whenever we see a 20 per cent off sign, to spend money we don’t got to save money on things we don’t need just because it will be regular price next week.

Now imagine our three levels of government in the role of the consumer spending money that we, the taxpayers, don’t got on things we either don’t need at all or exceed what is needed.

Whitehorse city council is raising our taxes again, only a little bit, but by the stealth of a “little bit at a time,” a lot! However, this year’s increment is less than staff suggested so they “saved” us money, eh. But do we need everything the City is spending our money on? Unlikely.

The Yukon government’s new Whistle Bend long-term care facility cost estimate is $147 million for 150 beds/units. That’s about $1 million a piece. Sure, we need it, but a fourbedroom house costs about half of that, so a million dollars per unit seems a bit steep, unless, of course, they come with high-end appliances. But, the original estimate was $158 million, so we “saved” $11

million dollars.

Whatever. I anticipate a long waiting list for those million-dollar units.

When it came to replacing F.H. Collins school our territorial government balked at spending $56 million, wrote off the money already spent, then built a more modest design that still met what we were told was a real need for a final cost of $34 million, so we “saved” $22 million dollars.

City council wants a new city hall and general administration/ facilities building estimated to cost $50 million. Seems pricey if we got a new school for $34 million. Are new facilities really needed? Is there a compelling reason to go for gold or would something more modest suffice? But hey, as I recall, part of the reason for the new digs is to save on the cost of heat, maintenance and other operating costs, so I suppose we taxpayers could be thankful that the City is “saving” us money while increasing our taxes to pay for it.

Federally, oddly enough, under the Conservatives the government’s take actually decreased by about $1,000 per person for a real saving of about $4,000 for a family of four, not counting their child benefit program. But “savings” should return to “normal” under our new Liberal administration, as it already seems they are unable to resist the lure of spending money we don’t got on stuff we don’t need.

Huskies secure playoff spot at Coy Cup Tom Patrick News Reporter

he Whitehorse Huskies took a loss Wednesday evening, but the team has nonetheless secured a spot in the playoffs at the Coy Cup in Terrace, B.C. With a 6-5 loss to the Huskies Tuesday and a 5-3 loss to the Fort St. John Flyers Wednesday, the Smithers Steelheads is the odd team out and have been eliminated from a spot in the playoffs that start Friday at the B.C. AA championship.

Even if Whitehorse loses and Smithers wins in the last round robin games today – putting the teams at two points each – the Huskies will advance to the semifinal with the tie broken by their head-to-head contest.

Best-case scenario for Whitehorse: the Huskies beat the Flyers and Smithers beats Terrace on Thursday. That would make Whitehorse the only team with two wins, giving them a bye to Saturday’s final.

The Huskies will definitely want to bounce back today against the Flyers – the defending Coy Cup champs. Not only do they need a win for a shot at the bye to the final, they wouldn’t mind a little payback.

“We’re excited to see them.

They knocked us out of the playoffs last year and we’ve been waiting a year to get another shot at them,” said Tuton.

“We have the roster we wanted to have last year but didn’t, so now it’s time to get her done.”

Meanwhile, dozens of women gathered outside the courthouse to protest the verdict – some chanting “Ghomeshi guilty” and holding placards.

Ghomeshi, 48, who didn’t testify, showed little emotion at his twoweek trial last month.

Horkins stressed the presumption of innocence in a criminal case is “not a favour or charity” and conviction requires “proof beyond reasonable doubt.”

At trial, the testimony of his three accusers and their crossexamination by Ghomeshi’s high-profile defence lawyer Marie Henein led to moments of drama.

The first complainant testified that Ghomeshi suddenly yanked on her hair when they were kissing in his car in late 2002. A few days later, she said he abruptly pulled her hair while they were kissing in his home and started punching her in the head.

The second complainant, actress Lucy DeCoutere, the only woman who can be identified in the case, testified Ghomeshi suddenly pushed her against a wall, started choking her and slapping her face when they had been kissing in his bedroom in the summer of 2003.

The third woman testified that she was kissing Ghomeshi on a park bench in 2003 when he suddenly bit her shoulder and started squeezing her neck.

Under cross-examination, however, the trial learned that the first women sent friendly emails and a bikini photo to Ghomeshi after the alleged assaults, asking him to contact her. She said she sent the emails as “bait,” so she could demand an explanation for the alleged assaults but also testified that she didn’t remember the emails when she spoke with police.

During DeCoutere’s cross-examination, Henein produced an email the actress sent Ghomeshi hours after the alleged assault in which she expressed a desire to have sex with him. She also produced a hand-written letter the actress sent him days later that ended with the words: “I love your hands.”

The third complainant acknowledged only under questioning from Henein that she had deliberately misled investigators by not initially telling them she had a sexual encounter with Ghomeshi days after the alleged assault. “(She) was clearly playing chicken with the justice system,” Horkins said. “She was prepared to tell half the truth for as long as she thought she could get away with it.”

Ghomeshi still faces a separate trial in June on one count of sexual assault.

He highlighted a boost to child care benefits and increases to post-secondary education grants as a means to that end. Morneau also reinforced the government’s pledge to end boil-water advisories that plague aboriginal communities throughout the country as part of the budget’s plan to give $8.4 billion to indigenous peoples over the next five years.

Treasury Board president Scott Brison, Economic Development Minister Navdeep Bains, Immigration Minister John McCallum and Transport Minister Marc Garneau were also to be deployed Wednesday to tout the budget across the country.

On Thursday, Small Business Minister Bardish Chagger, Natural Resources Minister Jim Carr and Infrastructure Minister Amarjeet Sohi will do the same.

Dozens of stakeholder groups gathered on Parliament Hill to provide budget reaction Tuesday offered an unusual consensus in lauding the Liberal efforts.

ne senator stayed overnight in Toronto to have breakfast with a reporter – seven times. Another repeatedly spent an extra day at a ritzy Fredericton hotel just in case constituents wanted to meet, but there’s no evidence they did.

A third flew himself and his wife to Ottawa for a staff Christmas party, then to Toronto for more family fun.

None of those expenses should have been charged to taxpayers, a former Supreme Court justice said this week even as he slashed the total amount owed by 10 senators whose claims were flagged last year by the auditor general.

Ian Binnie chalked the problem up to the senators’ own lack of knowledge about the rules governing their spending, and the belief within the Senate that outsiders lack the background necessary to fairly adjudicate their expense claims.

As a senator, Andre Pratte hopes to avoid the ‘trap’ of lying Melanie Marquis Canadian Press

OTTAWA uture senator Andre Pratte admits he’s always described lying as an inevitable part of the political system. But now that he’s joining the world of politics himself, he hopes his status as an independent parliamentarian will allow him to avoid falling into that trap.

Pratte, who worked in media for 37 years, notably as an editorial writer for Montreal’s La Presse newspaper, is one of seven new senators named by Prime Minister Justin Trudeau on Friday.

Pratte’s 1997 essay on lies in politics – whose title translates to “Pinocchio syndrome” – made waves in Quebec and earned the author a motion of censure in Quebec’s legislature.

“Politicians who don’t lie? Impossible,” he concluded in a book he wrote after a stint working as a Parliamentary correspondent – an institution he described as “the temple of lies” in the same book.

When asked if he feels the same about politicians now that he’s becoming one, he jokingly tried to duck the question.

“I’m not a politician yet, since I haven’t been sworn in as a senator yet,” he said. “Is that a clever way out?”

He answered his own question with a “no” and a laugh.

“I don’t know how I’ll get out of this one. Honestly, I don’t know,” he said. “The status of independent senator, I hope, will allow us to say the truth all the time. I hope. Honestly, I hope.

But maybe I’m very naive.”

the new appointees won’t have to follow party lines or respect cabinet decisions, which creates a “duty to lie” for those who are subject to it, the former journalist argued.

“As independent senators, in principle, we vote according to our conscience all the time,” he said. “That’s what appeals to me about the changes Mr. Trudeau has brought: there is no party line.”

He suggested the changes could lead to a “completely difference presence” in the legislative process.

Pratte said he decided to take the plunge into politics after some friends suggested he apply for a senate post. He said he had never considered the possibility before, but was attracted in part by the Liberal party’s attempts to turn the upper chamber into a more reputable, less-partisan body.

As a result, he found himself on a 25-person list created for the prime minister by a new arm’s-length advisory board. He learned last week that Trudeau would recommend his nomination to Governor General David Johnston.

Pratte is now looking to purchase property in Salaberry, the Quebec senatorial division he will represent. The Constitution requires him to acquire land or a building worth at least $4,000.

Following his swearing-in, Pratte will begin his second career, but not without some trepidation. Pratte says he worries about “not meeting the standards I imposed on others during my editorial career,” he said.

tearful, beloved cartoon adventurer, Tintin, quickly emerged as a symbol of solidarity in the chaotic aftermath of the Brussels bombings as social media users worldwide took to Facebook and other Web streams for check ins by loved ones potentially in harm’s way.

On Twitter, on Instagram and elsewhere around the internet, the red-haired reporter in his signature trench coat with his white dog Snowy – the creations of Belgian cartoonist Herge – were shared as shocked and saddened versions of their usually indomitable and irrepressible selves.

Some cartoonists drew “too soon” criticism for depicting the stars of the comic series The Adventures of Tintin – made into a movie in 2011 by Steven Spielberg – as bloodied and battered.

Others on social media borrowed from the January 2015 Charlie Hebdo tragedy, using the hashtag “JeSuisBruxelles,” or “I am Brussels,” just as those

Facebook, meanwhile, activated its “safety check” system yet again to help Tuesday within hours of the three deadly explosions at the Brussels airport and a metro station.

The system can provide an easy way for people to mark themselves as “safe” after a major disaster or crisis so that people searching for them will know they are unharmed. It has been used recently to help people communicate after major floods, earthquakes and other deadly attacks.

Facebook first deployed the service after the 2011 Fukushima tsunami and nuclear disaster in Japan. The company said it is still “working through” how and when it should be used. It was activated six times last year, providing notifications to more than 950 million people.

The Tintin cartoon books have been translated into 70-plus languages, from Chinese to Armenian, English to Spanish, just as social media users are lending their languages and voices of outrage, fear, defiance and concern to the cacophony following the blasts in Brussels.

A more popular version of the Tintin meme in response to the explosions has him shedding a single tear as he hovers over a newspaper with a headline about the explosions, pal Snowy shaking nearby. Tintin utters “Mon Dieu,” or “My God.” Accompanying Tintin in the flood of social media sentiment were altered images of Manneken Pis, a bronze statue of a naked boy urinating into a fountain’s basin not far from Brussels Town Hall.

One showed the boy as a simple red line drawing against a black background as he urinated from on high onto a machinegun. Another had him doing the same on taped-together sticks of dynamite with the words: “Pis and Love,” a peace sign drawn into the letter o.

The boy, dating to around 1619, was created by Brussels sculptor Hieronimus Duquesnoy the Elder. He’s the father of sculptor Francois Duquesnoy.

The statue has been repeatedly stolen and replaced. It is dressed in costumes on a regular weekly schedule, his wardrobe of several hundred outfits permanently housed in a museum.

Elsewhere around the Web, kind-hearted Belgians were tweeting offers of shelter to stranded travellers using the hashtag “PorteOuverte” or “OpenHouse” for non-French speakers. One in Antwerp threw in “food and Belgian beers for 1-3 people.”

Others taking to social media found comfort in sharing YouTube clips, photos and drawings of another famous figure in Belgium, singer-songwriter-actor Jacques Brel, who was known for his soothing ballads.

The straightforward hashtag “Brussels” continued with “JeSuisBruxelles” through the day on Twitter around the world, also accompanied by “PrayForBelgium.” Comment threads included “Tous Ensemble,” or “All Together,” but some social media users were more defiant.

Bill McKibben to tell Yukon to keep carbon in the ground

here’s a certain irony in the act of flying across the continent to give a speech about the perils of man-made climate change.

At what point, one wonders, is the benefit of raising awareness outweighed by the quantity of carbon burned in the process?

This is something Bill McKibben thinks about a lot.

“The last seven years, I’ve been in fairly constant motion,” he said. “And I’ve spewed a lot of carbon behind me in the process. And I hope that it’s been worth it.”

As leader of one of the world’s most recognizable climate change campaign groups, 350. org, McKibben is in very high demand. That means a lot of travelling, a lot of planes and yes, a lot of carbon.

But McKibben has also catalyzed an international movement. His organization operates in 188 countries and has organized thousands of rallies around the world. It has spawned a global fossilfuel divestment movement, and has helped popularize the “carbon bubble” concept. That refers to the idea that much of the world’s known fossil-fuel reserves will need to stay in the ground to achieve emission targets, creating a financial risk for the companies that own them.

So on April 2, McKibben will be in Whitehorse to speak about his work at the Yukon NDP’s Change 2016 conference, carbon footprint and all.

McKibben met Yukon NDP Leader Liz Hanson during the Paris climate talks last year. He accepted her invitation in part, he said, because he’d always wanted to see the Yukon.

But there were other factors, too.

“One of the reasons that it was so compelling was the description of the fact that the Yukon was still at an early stage in deciding how far down the fossil fuel production road to go,” he said. “And it seemed like it was a crucial discussion that was being had up there, and I thought I might be able to help a little bit.”

During his keynote speech at the conference, McKibben said, he’ll focus partly on Yukon’s oil and gas reserves, especially the unconventional shale gas in the Liard Basin.

“One of the points I’ll be trying to make, I think, is that it would be highly ironic if the Yukon signed up for large-scale fracking right at the moment that the fossil fuel age was lurching to an end,” McKibben said.

“Keep it in the ground” is something of a mantra for 350. org. The organization is named for the concentration of atmospheric carbon dioxide widely accepted as a safe target. The Earth’s record concentration has already exceeded 400 parts per million. McKibben believes 80 per cent of known fossilfuel reserves need to stay in the ground for the planet to avoid dangerous global warming. That doesn’t leave much room for a brand new oil and gas industry in the Yukon.

“The more remote one gets, the more foolish it is to be developing any of this stuff,” he said.

He believes the Yukon should work to develop more renewable energy instead. “I’m pretty sure that given the size and scale of the Yukon and the fact that there are 36,000 of you up there, I’m almost certain you’re capable of figuring out good ways of providing your energy needs.”

He also doesn’t buy the argument that liquefied natural gas is a cleaner replacement for diesel. That was one of Yukon Energy’s key justifications for its new LNG plant in Whitehorse.

“There was a school of thought that natural gas was a kind of cleaner bridge fuel that was a sort of halfway house between diesel and coal and renewable energy,” he said. “But we no longer think that.”

That’s because of methane leaks during the production and transportation of natural gas, McKibben explained. In fact, he published an article in The Nation magazine this week arguing that U.S. carbon emissions have

actually been increasing, not decreasing, thanks to methane leaks from natural gas development.

But when it comes to Canada, McKibben’s not all doom and gloom. He admires Canadian resistance to oil sands and pipeline development, and especially First Nations leadership on those issues.

And he seems optimistic about Canada’s recent change in government.

“Coming out of Paris, it’s clear that Canada’s no longer a rogue nation on this stuff, which it was before. It’s not in the way,” he said.

But his prescriptions for the country are fairly stark, and aren’t necessarily easy pills to swallow.

Oil sands expansion needs to stop, he said. And pipelines are just “enablers” for more extraction.

He also doesn’t think too highly of the Yukon govern-

ment’s opposition to a price on carbon, or of its argument that the Yukon only emits a tiny fraction of Canada’s total emissions.

“If everyone makes that argument, then nothing will ever happen, right? That doesn’t strike me as a good argument.”

Instead, there are two things the Yukon needs to do, he said.

“One is keeping carbon in the ground. Two is ... serving as witness for the rest of the world to the very rapid changes underway up there.”

McKibben, too, may bear witness while he’s here. Crosscountry skiing is his main vice, he said, and he’s bringing his skis with him. But at the rate things are going this winter, there may not be much left to ski on when he arrives.

This year’s Out North Film Festival takes a transgender focus

iona Griffin and Debbie Thomas never set out to beat any kind of drum when they organized the Yukon’s first queer film festival in 2012.

“We don’t have a political mandate or anything like that,” Thomas said.

“We’re all about screening excellent films that no one else is showing. We just have an appreciation for good filmmaking and good stories.”

This year marks the fifth anniversary for the Out North Film Festival, the only one of its kind North of 60.

And like they say on their website, who’d have guessed?

Sitting in a downtown cafe, both Griffin and Thomas are proudly wearing their festival Tshirts, adorned with a bright pink porcupine.

Every year the festival logo is a different northern animal. In the past it’s been a moose, a beaver, a wolf and a raven.

A few years ago the venue for

the festival moved to the Yukon Beringia Interpretive Centre, which has more seating capacity and a better sound system than its predecessor, the Old Fire Hall.

The organizers are hoping to attract a larger audience and a broader demographic this year, they say.

To do so, they’ve picked (albeit somewhat reluctantly) more mainstream films than they normally would.

That includes The Danish Girl, a film loosely based on the lives of two Danish painters, one of whom underwent one of the first

Among the Hollywood hits screening this year is Carol, starring Cate Blanchett and Rooney Mara, a film about a forbidden love affair between two women set in the 1950s.

“It’s unusual for us to have such high-profile films in our lineup,” Griffin said.

“We’re a bit edgy about moving towards more mainstream

Alicia Vikander received this year’s Academy Award for Best Supporting Actress for her performance in the film.

The New Girlfriend, a French film, “tackles transitioning from a two-sided perspective,” Thomas said.

“It has brilliant acting and cinematography, and it shows a

Others have been more expensive, they say.

But funding from the Royal Bank of Canada and the Government of Yukon Arts Fund has helped a lot, they added.

“We have a lot of community support from local businesses, non-profits and individuals,” Griffin said.

For the first time this year, the festival features a contest for youth.

Griffin and Thomas approached schools and youth groups around the territory to encourage students to put together a film of their own, using smartphones and tablets.

The only stipulation was that it had to be under five minutes in length and feature the Out North logo.

The winning film will be screened during the festival, with the winner receiving a brand new iPad and a $200 donation towards their school or youth group.

“We’ve had a lot of interest so far, so it’ll be interesting to see what we get,” Thomas said.

“When you correct for (that bias) it actually appears that the risks at all levels are higher than previously estimated,” Stockwell said.

“The takeaway message is, in fact, if anything, we are underestimating the health and safety risks from alcohol.”

The literature involved in Stockwell’s meta-analysis involved more than four million people, including the identification of 350,000 deaths and their causes.

His findings were published Tuesday in the Journal of Studies

on Alcohol and Drugs.

Stockwell emphasized that his research doesn’t prove that light drinking is bad, only that the public should be skeptical about the claim that having one or two drinks a day offers a net health gain.

“It may be very pleasurable and enjoyable, and at low levels probably does you very little harm or risk of harm, but I think we shouldn’t assume the widespread message is true, that it is actually good for you in moderation,” he said.

“I love a beer. I love a glass of chilled wine. But in moderation,” he said about his own drinking habits, adding that his own drinking has become more careful since his research began.

“I treat it with more respect.”

While additional research has come out in recent years supporting Stockwell’s conclusion, the study’s findings still go against the grain and threaten to upset the industry that benefits from collective support for the idea that moderate drinking is healthy.

“Those early studies boosted alcohol sales, especially red wine,” Stockwell said.

“It’s been a major boon to the alcohol industry: ‘Drink our product.”’

Stockwell said what lends his particular conclusion strength is that it systematically reviewed 87 other studies, using a refined approach to drill down into data already collected.

VectoBac 200G (PCP # 18158) contains the active ingredient Bacillus thuringiensis H-14, a naturally occurring soil bacterium. The larvicide is applied in a granular form and the bacterium is heat-killed, meaning it will not reproduce in the environment.

It is specifically for mosquitos and biting flies and has NO effect on non-target insects, fish, birds or mammals including humans, livestock or pets.

Ground-based (hand applied) VectoBac applications will be carried out as required from midApril through August to accessible, mosquito infested ponds, ditches and puddles. Aerial applications by helicopter are tentatively scheduled for the period of April 15 to May 31, 2016. In order to complete these applications, helicopters will be working at low levels over swamp and marsh areas adjacent to participating communities. Local community offices will be notified of the confirmed aerial application dates.

This recognition may be just emerging in international human rights law, but it’s nothing new to Indigenous people and many others who directly depend on nature for food and livelihood.

I heard this over and over again this past summer as I travelled with a team along Canada’s vast Pacific coast, visiting a dozen communities in the traditional territories of 12 First Nations. These people reside along 26,000 kilometres of British Columbia’s winding shoreline – home to trillions of plankton, billions of fish, millions of seabirds and thousands of whales, which live among forests of kelp and eelgrass, along underwater canyons and glass sponge reefs.

During the tour, we were welcomed with feasts that embodied the intersection of nature, food and culture, and we conducted more than 1,500 profoundly moving interviews with coastal residents.

They expressed fears about threats to their way of life, including industrial projects that will catastrophically affect the environment and their livelihoods being approved with little or no consultation. They spoke passionately about the connection between a healthy environment and economic, cultural and social rights – because they live it every day.

One Pacific coast resident said, “When the fish come home or pass by Campbell River this whole community comes alive. Without the fish, a large piece of our island culture goes with them.” Another observed, “When we think of human rights, we think of equality, freedom, democracy. But what good are any of those if we don’t have clean air, soil and water? It has to start with nature.”

Observations of the effects of climate change on their communities – including unpredictable and extreme weather, decreasing snow and ice, water shortages, wildfires and salmon spawning failures – mirror the findings of the Intergovernmental Panel on Climate Change.

This is a critical moment for Canadians as we face mounting pressure from climate change, ocean acidification and industrial development. With the longest coastline of any nation, our country holds a globally significant responsibility to protect its oceans, which are under threat from failures to address carbon emissions and ensure marine protection and management. Canada can start by acting on its commitment to protect 10 per cent of its marine environment by 2020, and by putting strict targets on greenhouse gas emissions.

We could also go a long way toward meeting our international human rights obligations by joining more than 110 nations in constitutionally recognizing the right to a healthy environment. Taking immediate steps to restore and enhance robust environmental protection, fully respect Indigenous rights to title and consultation, and protect ocean ecosystems from degradation and climate change is essential.

The growing international recognition of the disproportionate impacts on Indigenous and vulnerable people enhances the understanding that protecting the environment is as much about social justice as keeping ecosystems healthy.

This year marks the 50th anniversary of the International Covenant on Economic, Social and Cultural Rights. Canada has the opportunity to mark the milestone by legally protecting all Canadians’ environmental rights and by recognizing that healthy oceans are a necessary condition for human health and dignity.

Broken ice causes the worst spring breakup floods

F

or half the year, Alaska’s big rivers provide a somewhat flat surface, allowing travel by snowmachine, dog team, ski, bike, snowshoe and foot. For a few weeks during their spring transition to liquid water, those useful ribbons of ice become a threat to river communities.

Massive ice-jam floods happen every few years on Alaska rivers. Some of them are large enough to cause damage more than $80 million, when officials call for both state and federal disaster relief funds. Those large floods happened four times in the last nine years. The two most recent happened on the Yukon River. Spring floods caused by ice jams are hard to predict, agreed a number of scientists gathered in Fairbanks for the Arctic Science Summit Week. Winter snowfalls or thickness of river ice might seem to be good warning signs of

ice dams waiting to happen, but other factors are better forecasters.

“April and May temperatures are the most important climate drivers of breakup,” said Rick Thoman of the National Weather Service in Fairbanks.

If April and May are sunny and warm, river ice tends to dissolve peacefully in place until it disappears. Thoman described that as a thermal breakup.

The worst-case scenario for river communities: If April and May are cloudy and cold, ice remains strong and thick until the 70-degree days arrive. This increases the chance of what hydrologists call a dynamic breakup.

An example was May 2013.

That year featured a cold spring in Interior Alaska that resulted in the latest river breakup in the 99year record of the Tanana River

at Nenana. The tripod on the ice there did not move enough to trip the clock until the afternoon of May 20. The historical average breakup date is May 5.

A few hundred miles west, on May 27 a procession of brokenup ice rammed an intact ice sheet at Bishop Rock. All those pieces bunched up to clog the Yukon River. Water backed up, flooding the lowlands, including the village of Galena. An image taken by a NASA satellite shows the river swollen like a python that just swallowed a pig. After flooding most of Galena beneath about 10 feet of water, the ice jam broke two days after it formed. The Yukon dropped to normal levels.

Climate models are predicting a warmer than average April and May 2016 for Alaska, Thoman said. That favors a calm, thermal breakup of Alaska rivers this year. And while there are always surprises like 2013, easier river breakups may be in Alaska’s future.

“Springs are warmer than they used to be,” Thoman said.

Beatty nabs Whitehorse’s ninth Haywood medal W

ith two race days left, Yukon skiers have surpassed last year’s total at the 2016 Haywood Ski Nationals this week.

Dahria Beatty brought the hosting Whitehorse club’s total to nine with a gold in the senior women’s sprint races on Wednesday – Yukon’s only medal on the day.

The 22-year-old now has three medals with two gold; teammate Emily Nishikawa also has three

(one in the team sprint with Kendra Murray); junior female Natalie Hynes two; and senior men’s Knute Johnsgaard a bronze.

“One of the biggest advantages is having so many supporters, having that home-field feel with everyone cheering your name.

That support is here and I think that’s just as important as knowing the trails well,” said Beatty.

estern Canadaâ&#x20AC;&#x2122;s best young speedskaters got a taste of northern speed last weekend.

Members of the Whitehorse Rapids Speed Skating Club posted personal best times and won

hardware at the Canada West Short Track Championships in Edmonton, Alta. â&#x20AC;&#x153;I think it was a good competition for all three of them,â&#x20AC;? said Rapids head coach Phil Hoffman. â&#x20AC;&#x153;They got some good experience racing at a little bit of a higher level than theyâ&#x20AC;&#x2122;ve done before.â&#x20AC;?

Two members of the Yukon Freestyle Ski Team withdrew with injuries in the days leading up to the nationals, held last week in Kimberly, Ont., leaving only one to compete.

Then crummy weather forced the cancelation of the aerials and big air competitions.

With Yukon not entered in the mogul events, the territory was represented by just one skier in one event â&#x20AC;&#x201C; slopestyle. â&#x20AC;&#x153;The weather has not been cooperating â&#x20AC;Ś Itâ&#x20AC;&#x2122;s been raining, itâ&#x20AC;&#x2122;s been melting like crazy, the jumps have been deteriorating,â&#x20AC;? said Yukon coach Steven Harlow. â&#x20AC;&#x153;They couldnâ&#x20AC;&#x2122;t fix the jumps properly because they couldnâ&#x20AC;&#x2122;t bring the Cat on the jumps or on the landings to do it. They had to do it by hand.â&#x20AC;?

with a frontside 270 off the cannon rail.

The previous week he performed much bigger jumps â&#x20AC;&#x201C; a corked 900 with tail grab, switch bio 900 â&#x20AC;&#x201C; at a Canadian Open Tour event in Stoneham, Que., taking 36th out of over 60 competitors in the open division.

Last week marked the end of three straight junior nationals that saw one or more Yukon skiers on the podium. Last year the Yukon team collected three medals.

The cancelation of big air â&#x20AC;&#x201C; an event the Yukon team tends to excel in â&#x20AC;&#x201C; didnâ&#x20AC;&#x2122;t help. Allen won a silver in big air at last yearâ&#x20AC;&#x2122;s junior nationals. He also placed fourth in big air at the 2015 Canada Winter Games â&#x20AC;&#x201C; a record result for Yukon at the Games in freestyle skiing.

Yukonâ&#x20AC;&#x2122;s Milan Lapres and Evyn Dinn withdrew from the junior nationals with a wrist injury and rib injury, respectively. â&#x20AC;&#x153;That was the first day, so that was awesome,â&#x20AC;? said Harlow with obvious sarcasm. â&#x20AC;&#x153;We were there four days early and it wasnâ&#x20AC;&#x2122;t even official training.

David Muir

It is with great sadness that we announce the passing of our beloved brother, father, son, and friend, David Muir.

Pre-deceased by his mother Anna McCracken, he leaves behind his two sons David â&#x20AC;&#x2DC;Jakeâ&#x20AC;&#x2122; and Joshua Muir; his father James Muir (Barbara), his brothers; James Muir (Allison), John Muir (Carol), Francis Muir (Carol), Andrew Muir (Cheryl), and his sister Anna Banville (Richard).

David was born in Muirhead, Scotland on July 27th, 1961 and immigrated with his family to Canada in 1967 at the age of 6 years. He grew up in Hamilton, Ontario and in the late 80â&#x20AC;&#x2122;s, on a short visit, he fell in love with the Yukon.

David was a loyal and dedicated public servant for the City of Whitehorse for 27 years. He touched many lives with his open heart and his warm smile. He will be greatly missed by all who knew him.

There will be a funeral service on April 2nd, 2016 at 2pm at the Sacred Heart Cathedral followed by a gathering at Mount McIntyre Arena at 6pm for all to come and celebrate Davidâ&#x20AC;&#x2122;s life.

Approval of an Amendment Hotsprings Road Development Area (Zoning) Regulation The Yukon government has approved amendments to Hotsprings Road Area Development Area Regulation (O.I.C. 1996/136) and Hotsprings Road Local Area Plan.

Rural Residential - RR zone and Rural Residential Mixed Use - RRU zone • Reduce the minimum lot size from 3.0 ha to 2.0 ha; and • Allow a second dwelling as an accessory use on lots greater than 2.0 ha; and • Allow an existing lot that is less than 4.0 ha to be subdivided provided that one of the resulting lots is at least 2.0 ha and the other is at least 1.8 ha (10% less than the minimum required).

Commercial/Recreational - CR zone • Allow existing lots to be subdivided to create one new rural residential lot.

The resulting rural residential lot must be a minimum of 2.0 ha and would automatically be rezoned to Rural Residential (RR) upon registration of the survey plan.

•

Commercial Retail - CG zone • Reduce the minimum lot size from 3.0 ha to 1.0 ha.

Agriculture - AG zone • Allow an existing lot that is less than 12.0 ha to be subdivided in accordance with the Subdivision Act, provided that one of the resulting lots is at least 6.0 ha in area and the other is at least 5.4 ha (10% less than the minimum required) in area.
