However, Maggi said those successes were due to large sample sizes that allowed the company to break down the results into subregions. He said that wasn’t possible in the Yukon, because the sample size in any given region would be too small.

As for what will happen in the Yukon, Larsen agreed with Maggi that it’s far too soon to draw any conclusions about the election, which must happen by October 2016 at the latest.

She also argued that the Liberals are getting a boost from the federal Liberal win last October. “They’re definitely riding the wave of the federal election right now.”

Beyond its focus on voter preferences, her poll also asked respondents to choose the single largest issue facing the Yukon right now, from a range of options. The largest number of respondents, 16 per cent, chose “poor government” – but Larsen said that’s no different from previous polls.

What is striking, she said, is that 35 per cent of respondents chose either the economy, unemployment or lack of industry. That’s up from a total of 12 per cent from the last poll in 2013.

In answer to another question, 48 per cent of respondents said the economy is in serious or critical condition, up from 26 per cent in 2013.

“People are definitely feeling worse about the economy,” Larsen said.

Both she and Maggi said they will conduct more polls as the election approaches.

NDP spokesperson Mike Fancie said the Mainstreet poll shows “the vast majority of Yukoners are still making up their minds about who they’re going to vote for this fall.”

But he said the party “is hearing again and again that Yukoners want change.”

Liberal Party and cabinet spokespeople said they don’t comment on election polls.

Ottawa ordered to negotiate Taku River Tlingit land claim Ashley Joannou News Reporter

A

Yukon Supreme Court judge has ordered the federal government start negotiating with the Taku River Tlingit First Nation over its transboundary land claim in the Yukon.

The First Nation has 92 per cent of its land in B.C., and is based in Atlin. The remaining eight per cent is in Yukon.

Lawyers for both sides agree that Canada has a constitutional duty to negotiate land claims agreements, honourably and in good faith.

Canada officially agreed to begin negotiation of a transboundary agreement in Yukon in a letter dated Oct. 3, 1991 from the chief federal negotiator in Yukon.

The federal government’s argument boils down to “wait your turn.” Lawyers argued that negotiations around land in B.C. are happening honourably and in good faith and are going to be done first, followed by the Yukon land.

The First Nation disagrees, claiming Canada has not acting honourably when it comes to dealing with the Yukon land.

The Taku River Tlingit filed this lawsuit in 2014, after the Yukon government announced plans to build a campground on the First Nation’s land on the east shore of Atlin Lake, just north of the border with British Columbia.

In the face of the Yukon government’s pending development, Canada still wasn’t willing to negotiate a claim.

“Whether it is ‘not now’ or ‘not

until a final agreement is negotiated with British Columbia,’ it fundamentally ignores the earlier promises of Canada to negotiate without any reservation.”

Veale does not buy the federal government’s argument that it would simply be too complicated to try and negotiate over land

that stretches across two jurisdictions.

“The fundamental objection I have to Canada’s submissions is that Canada created the boundary line that it now says is an impediment to negotiation, despite the fact that there are no real impediments to negotiat-

ing the Taku River Tlingit Yukon transboundary claim,” he said.

Veale points to an agreement following devolution dated Oct. 29, 2001, that says that the negotiation of the Taku River Transboundary Agreement remained “the highest priority.”

“I conclude that it is not honourable for Canada to agree to make negotiations ‘the highest priority’ in the face of a mandate that resulted in the transboundary negotiations being contingent on British Columbia reaching agreement,” Veale said.

“In my view, Canada is not negotiating honourably when it creates a mandate that completely negates its policies and express commitments.”

Veale does not provide specific instructions on what negotiations have to look like.

Plans for the disputed campground have been halted, at least for now. The campground is also the subject of another court case, between the Taku River Tlingit and the Yukon government, to be heard in court later this month.

The First Nation is claiming, in part, that the Yukon government didn’t consult enough on its plans for the campground. It also asks the court to grant the same considerations given to the Ross River Dena Council by the Yukon Court of Appeal.

That decision found that the government must consult and accommodate the First Nation before mining claims are staked and before exploration activities take place on its traditional territory.

Supreme court hearing underway over jail’s treatment of Michael Nehass Ashley Joannou News Reporter

W

hen Michael Nehass was brought naked to a video court appearance in January 2014 it made national news.

For the first time yesterday, the 32-year-old had a chance to talk about what happened from his perspective.

He described being picked up by his leg shackles and handcuffs and brought through the segregation unit, onto an elevator, down multiple halls and into the room where he appeared on video.

Nehass took the stand as part of his hearing on whether the jail violated his rights by treating him this way and by keeping him segregated from general population for years.

Nehass testified that he was

already naked in his cell when guards came and told him he had to go to court.

He was being punished, he said. Guards had taken away his clothes after he had destroyed his cell a few days earlier.

Nehass said he asked for clothes but the guards refused, offering him a blanket instead.

Nehass told the court he asked to speak to a superior and the guards left and came back with their shields.

After carrying him to the room with the video feed, one of the guards held his face down with a knee, Nehass said.

The hearing is expected to continue today and tomorrow and then resume for a second week at the end of February. Multiple people, including staff from the jail, are expected to testify.

Correctional Centre an “enforced disappearance.”

He insists his detention is part of a vast conspiracy by highranking officials across the Yukon intent on keeping him from revealing what he knows about human trafficking, missing and murdered aboriginal women and government corruption.

He is adamant that any efforts to make him seem mentally ill are meant to silence him.

In May 2014 a Yukon judge found Nehass unfit to stand trial.

That decision was later reversed by the Yukon Review Board.

Nehass was arrested in December 2011. Documents filed in a different case suggest he has not been part of the jail’s general population since May 2013, instead bouncing between segregation and the jail’s secure living unit.

The two cells are basically

the same thing, Nehass told the judge. He is completely isolated from anyone else. He has no meal time or yard time with other inmates. SLU cells usually have TVs, but he hasn’t had one for eight months, he said.

The jail has “yard boxes,” he said – small rooms with mesh as ceilings so inmates can get fresh air.

Nehass said he has gone “years” without getting yard time.

It has gotten better, he said. But even now he only gets fresh air about once a week in the summer and three times a week in the winter, he said.

Nehass is adamant that he was sterilized in custody. He testified that he has the scars to prove it.

He said he believes the staff there have poisoned him on multiple occasions.

He testified he was so desperate to get a doctor to look at him

that he swallowed fake razor blades so that he could go to the hospital.

He told the court that in November and December of last year, after going to the hospital for medical tests, he started feeling unwell. He believes doctors had sewn a cloth full of carcinogens into his stomach to try and kill him in custody, he said.

Because of that, he stopped eating, he said. He only consumed Boost, a liquid meal supplement.

Nehass testified he used aluminium off the Boost containers to create something that looked like blades and swallowed them in front of a guard.

After being taken to the hospital and examined with a scope he feels better, he said.

Expert questions Health Canada’s drug-testing abilities Ashley Joannou News Reporter

A

defence expert called in the case of an ex-jail guard accused of smuggling drugs says the methods that identified a pill as Ritalin are not scientifically valid.

Suzanne Perry did not offer an alternative for what the 59 small pills might have been. But she said the conclusions reached by the prosecution’s expert should not be relied on.

The case of former guard Michael Gaber has become about the differing opinions of two chemistry experts.

Gaber is charged with possession of drugs for the purpose of trafficking.

For most of the three-day trial, Yukon Supreme Court focused on what was in the pills that were found on him on Boxing Day 2013.

An expert working in the Health Canada lab in B.C. testified that the one pill she tested was methylphenidate, better known as Ritalin.

Perry, who runs her own consulting company, used to manage a handful of labs at the University of British Columbia used to test substances.

Perry’s major complaint about the work done at the Health Canada lab in B.C. is about the stage of the process where the chemical make-up of the mystery drug is tested against a known sample of the drug that is suspected.

Tests on both of the drugs result in charts with a series of peaks.

Based on the report completed by the Health Canada expert, Perry said it appeared the two charts were only compared visually, not using any sort of computer database.

Identifying a drug based on a visual comparison is not something she would ever teach students, Perry said. It is “not unbiased,” she told the court.

The Health Canada expert, Sarita Jaswal, has denied that she relied only on a visual comparison. She testified that she did use a computer database to come up with her results, but isn’t required by the lab’s policies to include that in her report.

Aside from the comparison method, Perry said she also had problems with the drug the lab uses as its “known sample” to

compare the unknown drug with.

In this case, the Ritalin used as the known sample in the comparison was bought by the lab in 2004, though it is verified every two years, the court heard.

If she were doing the test, Perry testified she would have used a “certified” sample which she describes as a higher standard than the one used by the Health Canada lab.

Perry also raised a concern that the pills may have been contaminated by the RCMP officer who packaged the drugs to be tested.

The court has already heard that the table where the drugs were placed prior to being shipped had not been wiped down. Any type of contaminant can affect the final results when the unknown drug is tested, Perry said.

During cross examination, prosecutor Eric Marcoux accused Perry of disagreeing with the lab’s procedures, not the work done in this specific case.

He pointed out that the lab is internationally accredited as a result of its policies and procedures.

If the lab followed procedures that were enough for international accreditation, how is that not enough, he asked.

She said the standard operating procedures in the lab leave some leeway to use different methods for testing. Poor decisions were made in this case, she said.

Both sides will be back in court in March to make final arguments before the judge gives his verdict.

Crown prosecutors requested the ban on the man’s name in order to restrict any information that could potentially lead to identifying the victims, based on section 486 of Canada’s criminal code.

The ban also extends to comments made on social media networks such as Facebook and Twitter, RCMP Superintendent Brian Jones told reporters on Friday afternoon.

“That’s a very broad scope and people will guide their actions accordingly,” he said.

“But in an abundance of respect for that section we felt it prudent in advance of that for everyone to be aware of those provisions and guide their actions accordingly.”

The man is scheduled to appear in court on Feb. 24.

Transit Consulting Network reviewed the City’s transit services over a five-year period, from 2010

to 2014.

They found that ridership in Whitehorse grew 72 per cent during that time (to 546,496 in 2014 from 318,456 in 2010). That’s compared to a 10 per cent drop in ridership in communities of a similar size elsewhere in Canada.

It’s estimated that transit ridership will grow another 15 per cent from 2014 levels to approximately 630,000 this year.

At Monday’s meeting, city transit manager Cheri Malo said the increase was due to several factors, including the revamp and expansion of the transit system’s routes and schedules.

The report found that transit service hours increased by 86 per cent from 2010 to 2014.

The addition of group transit passes, handing out transit passes to high school students and introducing evening service also contributed, she added.

But the increase in ridership comes at a cost. It cost taxpayers more than $2.4 million to keep the system going in 2014, a net cost per capita of $85.85 per year. That’s significantly higher than in 2010 when it only cost taxpayers $51.62.

Pat Ross, manager of planning and building services with the City of Whitehorse, said the numbers don’t tell the whole story.

The previous three quarters for 2015 were each better than in 2014, he said.

“What really helped pump the figures up (in late 2014) were the various projects that were underway in the city,” he said.

“That includes construction at the new F.H. Collins (Secondary School), the 20 residential units on Aksala Drive in Whistle Bend and the 48-unit seniors complex on Front Street.”

(Myles Dolphin) City awards contract for carpooling program The City of Whitehorse’s new carpooling initiative is one step closer to reality.

The contract to design a website that will allow commuters to connect with each other based on where they live and want to go has been awarded to RideShark.

The Ottawa-based company has also set up carpooling websites for the cities of Edmonton and Ottawa.

The new initiative is part of Whitehorse’s transportation demand management plan, which the City adopted in 2014.

One of the goals is to reduce the number of people who drive themselves to work from the current 75 per cent to 50 per cent in the next 25 years.

The program, which should begin by the end of the spring, will be available to all Yukoners.

But de Queiroz said the two oldest boys, aged 19 and 21, are very anxious to finish high school. One of them wants to become a pharmacist, she said.

And as for the family’s first thoughts about Whitehorse: “They commented on how long the night was,” de Queiroz joked, adding that the volunteers will have to teach the children how to build snowmen.

She said the family has also

been asking how to thank the community for its generosity.

Aside from helping with basic needs, Yukon Cares also plans to take the family out for activities, to help them get to know the community.

“Our translator, Ehab (Alhag Hissen), is also very active in the soccer community,” de Queiroz said, so he may get the children involved as well.

Yukon Cares is still collecting donations, as the group hopes to bring a second Syrian family to Whitehorse. In fact, Hussein Aarafat has a brother still in Lebanon, and Yukon Cares may try and reunite the extended family.

Meanwhile, a second volunteer group at the Riverdale Baptist Church hopes to bring a third refugee family to Whitehorse within the next few months.

At the high end, he found, cable Internet users in the Yukon will pay $190 a month for 400 gigabytes, or 47.5 cents per gigabyte. In contrast, Shaw’s premium customers will pay $123 for 800 gigabytes, or 15 cents per gigabyte.

At the low end, Northwestel charges cable customers $42 a month for 10 gigabytes, which Robulack said is “bonkers crazy.”

“The majority of them are low-income earners... and they’re getting fleeced for their data.”

He pointed out that it would technically be cheaper for those customers to buy no data and simply pay overage fees for their

full usage, if that were possible.

Shaw’s most basic plan offers 65 gigabytes for $35 a month, less than one-seventh the cost of the cheapest Northwestel package.

Robulack also pointed out that Shaw doesn’t generally charge overage fees at all.

Instead, employees will contact customers that are going over and encourage them to upgrade to a larger package.

Robulack said that approach might not be possible in the North, but he’d like to see Northwestel drop its overage fees even further. He suggested the fees could fall to as little as 47 cents per gigabyte, since that’s what the company is currently charging for its premium

package.

Still, he said he’s happy that Internet access will be getting a little cheaper for some northerners.

“Every reduction is great and is welcome, of course,” he said.

“Nobody’s going to sneeze at a cut in costs.”

The CRTC has also ruled that Northwestel is not allowed to raise its residential Internet rates before the end of 2017.

read your Jan. 22 editorial regarding waste management and in particular the need for a new city program for curbside pick-up and processing of recyclable products. You make some valid points.

However, there are some points that need critical thinking. First, your premise that if we don’t do what you consider correct, i.e. initiate a universal city curbside recycling program, we will go back to the cave-man days of dumping our garbage over the river bank. All this bafflegab was unnecessary, and what appears to be a fear-mongering attempt to get your point across!

Second, you did not appear to first gather information about each of the recyclers.

Some serious questions should have been inquired by a journalist: How much subsidization/grants has each of the recyclers received in the past to shore up their infrastructure?

How much diversion credits does each of the recyclers receive yearly? Are each of the recyclers efficient in the management of their business/organization operations? For example, the not-for-profit has a management staff, including an education coordinator, as well as several other professionals. The city has an environmental and a sustainability arm which also each have education as part of their mandate. Just how many education experts do we need?

Therefore, how much management costs are paid off the top for each processor? How much does it cost each recycler to divert a tonne of waste from the dump?

Are the processors using the cheapest empty trucks going southbound to ship recyclables or do they have their own buddy system? Why is the Yukon government taking so long to adopt better measures for waste management in the Yukon?

The Utilities Consumers’ Group submits that all these organizations/businesses are needed to do an adequate job, but fairness and a level playing field are also required.

Turnover is a huge expense for business. More than a few employers have lamented to me that no sooner have they invested a substantial amount of time and resources in training a new employee that they leave for the greener pastures of the government. Maybe the employee is of child-bearing age and the possibility of many months of fully paid maternity leave is too irresistible to turn down. Or the employee is near age retirement and wants to build up some hours towards a defined benefit pension where the employer kicks in half the cost.

Or maybe the government just offers more salary. There was a time when employment with the government was a trade-off of less salary for more security and benefits. But if one takes a look at the compensation offered for many positions on the government job board even that isn’t true anymore. It is not clear to me how the salaries of some positions with government are determined, but it certainly isn’t the “market rate.” All in all, employment with the Yukon government is a real plum gig.

The issue of public sector compensation has been a frequent subject of debate around the dinner table with my family and friends. Whenever it arises I am told (once we move past the

usual spiel about the important historical role of unions) that strong middle class wages are a positive thing, that the public sector “leads by example” and we should be focusing our efforts on extending them to others rather than knocking down what someone else has fought for won.

If only things were that simple. Under existing economic structures it is simply not possible for many businesses to offer salary and benefits to match an entity that receives nearly a billion in federal transfers every year.

Contrary to leftist caricatures, not every business owner is a money-gorging sweatshop operator. Many business owners in our small community earn a relatively modest living and in more and more cases – particularly in the professions – could themselves earn more money by abandoning their business endeavour altogether and joining the civil service. Forcing businesses to compete for employees (using their own tax dollars no less), I would argue, is patently unfair. Unlike government, private business cannot create money out of thin air and must offer services at competitive rates or die a painful and bloody death.

The problem is even more acute for non-profits, which often have even tighter fiscal

restraints than private business. Hire a new employee, train them, they leave for government, repeat.

There is also the matter of cost for territorial coffers. These are tough financial times for the territory. We’ve been hit with the one-two punch of declining tax revenues and slowing transfer payments. A substantial cost of living increase combined with expensive new entitlements that accrue only to government employees could drain the treasury and even put us in a deficit position leaving little for all those Yukoner’s who don’t work for the territorial government.

The Yukon Employee’s Union is pretty blunt in its list of demands to the government (which are available on their website for anyone who is curious): “The Union will not engage in concessionary bargaining” – meaning it will not agree to give up anything it already has. And reviewing the list of demands the union has put forth (admittedly without the benefit of a full costing) some would seem to come with a pretty hefty price tag.

I would say that now is not the time. But our leaders probably need to hear if from Yukoners or we’ll wake up one day and it’ll be a done deal.

Pre-trial accounts of alleged offences – as is the case with one of the complainants in the Ghomeshi trial who alleged the broadcaster choked her to the

point where she couldn’t breath – are also open to scrutiny.

And even with plenty of testimony, sexual assault cases can often still fall short of convictions due to a lack of definitive evidence to show a crime occurred, Mathen said.

“You can have the complainants be sexually assaulted in the sense that she has experienced a violation, and yet the accused

is found not guilty because he didn’t appreciate that fact,” she said.

It’s not that Canadian sexual assault laws are lacking, said one law professor, noting that on paper, they are among the best in the world.

“There are two problems with Canadian sexual assault law – one is proof beyond a reasonable doubt and that’s not going to change,” said University of Manitoba law professor Karen Busby.

“The other problem is continuing reluctance of some judges to resist the law reform efforts made in the 90s.”

Those reform efforts included changing the definition of consent in sexual assault cases so that consent has to be “contemporaneous and continuous,” as well as changes on the use of personal records and past sexual history in such cases, said Busby.

Some judges, however, still fall back on sexual stereotypes, said Busby, citing the recent case of an Alberta judge who suggested to a complainant that she ought to have kept her knees together, prompting a formal complaint.

“As long as judges are willing to disbelieve women and continue to rely on sexual stereotypes, cases that in my view should be open-and-shut cases, won’t be.”

Why we shouldn’t be afraid of ISIS Maura Forrest News Reporter

D

on’t panic. The terrorists are not coming to get us.

That’s the simple message at the heart of Gwynne Dyer’s latest book, Don’t Panic: ISIS, Terror and Today’s Middle East.

But for some, it may not be an easy pill to swallow.

After the Paris attacks last November, U.S. President Barack Obama called the bombings and mass shootings “an attack on all of humanity and the universal values that we share.”

It’s an oft-repeated refrain.

In a speech last December, for instance, Yukon Senator Dan Lang claimed that “radical Islamists have declared war on our democratic values.”

But that’s just not true, according to Dyer, who will be speaking at the Yukon Arts Centre on Thursday. Dyer is a columnist and military historian who has followed events in the Middle East for about 50 years.

He argues that occasional terrorist attacks are simply “part of the cost of doing business in the 21st century.”

And when they happen, he says, we should do as little as possible in response.

“Don’t allow yourself to believe that this is the most important thing happening in the world today,” he told the News. “It’s not even the tenth most important thing happening. It gets pumped up into a phenomenon much larger than it really is.”

And he believes the last thing we should do is send troops to fight ISIS on the ground.

Dyer’s book focuses on the last 15 years of conflict in the Middle East, starting with the 9/11 attacks. At the time, he argues, Osama bin Laden wanted America to invade the Middle East, figuring that would attract some Arab Muslims to Islamist groups like al-Qaeda. After the U.S. invasion of Iraq in 2003, he got exactly what he wanted.

Dyer then traces links between the Iraqi insurgency, the Syrian civil war and the establishment of ISIS in early 2013.

ISIS, he claims, is a monster the West helped to create. But there’s not much we can do to make it go away.

“I don’t want to abandon the Arabs to a fate worse than death, so to speak,” he said, “but it’s not really our fight.

And although we bear a large responsibility for what went wrong, we can’t put it right by going in with lots of troops now.”

And for us in the West, ISIS is not the existential threat so many political leaders make it

Attacks like the one in Paris are largely a means of attracting more volunteers to ISIS and away from rival organizations like al-Qaeda, he said.

Still, Dyer isn’t exactly saying we should do nothing to stop ISIS – just that we shouldn’t put boots on the ground to fight.

He does believe air strikes may help prevent Islamic State from expanding, though he’s not sure of it. But since the West helped create this situation, he said, this is one thing we can do to try and fix it.

As for Prime Minister Justin Trudeau’s plan to withdraw Canada’s fighter jets from the fight against ISIS this year, Dyer basically shrugs his shoulders, suggesting Canada’s contribution isn’t big enough to make a difference. “They’re not going to notice when we bring the planes home, frankly.”

Of course, this leaves us with an important question: if we do nothing, or very little, then what becomes of ISIS? Dyer believes it’s possible ISIS could take over Syria, if the regime of Bashar al-Assad fails, though he says a ceasefire is also possible.

Regardless, he doesn’t foresee Islamic State extending much beyond that.

“I don’t think that they’re going to sweep through the Arab world and we’ll be facing 300 million people and a vast Islamic State stretching from the Atlantic to the Indian Ocean,” he said. “Don’t think so.”

Truth is, Dyer doesn’t give us a very flattering mirror to hold up to ourselves. His assumption is that we’re only panicking about ISIS because of the threat to ourselves, not out of any altruistic concern for people in the Middle East.

Witness to migrant disaster that killed 37 describes screams Mehmet Guzel Associated Press

AYVACIK, TURKEY witness to the drowning of 37 people including babies and other young children off Turkey’s coast described the horror and screams in the moments after the boat carrying the migrants slammed into rocks, saying it was like “somebody was being murdered.”

Gulcan Durdu, who lives on the beach in the Aegean resort of Ayvacik, cried Sunday while recounting for The Associated Press the tragedy that happened at dawn the previous day.

She described being awakened by screaming and wailing after the boat struck rocks and capsized.

“I thought somebody was being murdered,” Durdu told the AP. Durdu said that she and her husband rushed to try to help survivors and brought a boy to their home to try to warm him up.

“We wrapped him up (in blankets),” she said. “I brought the hair dryer to ‘warm.’ The boy became limp in my arms” before losing consciousness.

The boy was still alive when she handed him over to paramedics who had arrived, Durdu said, adding that she would be haunted by the tragedy forever.

“I will never stop hearing those cries for the rest of my life,” Durdu said. “I will never forget. It was terrible. They died screaming. It was dark.

The migrants were trying to make the short journey from Turkey to Greece. Europe has endured a huge influx of migrants, most of whom undertake a dangerous journey in search of a better life.

Images of dead children on a beach on Saturday were another soul-searing reminder that Europe’s migrant crisis keeps destroying lives and families by the day. The body of one boy was lying on large rocks on the beach, his face covered by a cloth, while the faces of other bodies scattered nearby were covered with lifejackets.

the world, prompting many to finally grapple with the magnitude of the suffering caused by the war in the Middle East and the treacherous journeys many risk seeking shelter in Europe.

European countries have been strained by the influx of migrants, leading to disagreements over what to do with the large number of new arrivals and how to share the burden.

In Germany, the vice chancellor called for a nationalist party to be put under observation by the government agency that tracks extremists after its leader suggested that police should be allowed to shoot refugees trying to enter the country.

Vice Chancellor Sigmar Gabriel told Bild newspaper that “there is massive doubt that (the Alternative for Germany party) stand by the free democratic order of the republic.”

Frauke Petry, the head of the party also known by its German initials AfD, told the Mannheimer Morgen daily on Saturday that a border police officer “must stop illegal border crossings, and also make use of his firearm if necessary.”

Pushed by the newspaper for more, she continued that “no policeman wants to fire on a refugee and I don’t want that either. But the last resort in-

cludes the use of armed force.”

Germany saw nearly 1.1 million asylum-seekers enter the country last year and the AfD has been gaining in support as more people question whether the government will be able to deal with the influx.

Joerg Radek, vice chairman of the GdP police union, slammed Petry’s suggestion, saying no German police officer would shoot at a refugee.

“Whoever proposes such a radical approach apparently wants to overturn the rule of law and exploit the police,” he said in a statement.

Chancellor Angela Merkel, meanwhile, received support from an unlikely source for her handling of Germany’s refugee crisis.

Baden-Wuerttemberg governor Winfried Kretschmann, a member of the Greens party that is in opposition at the federal level, told Berlin’s Tagesspiegel newspaper the chancellor’s insistence on “working step by step” on a European solution to the refugee crisis was the correct path.

“Which of her counterparts in the EU will hold Europe together if she fails?” he asked.

“Far and wide there’s nobody in sight. Therefore I pray every day that the chancellor remains healthy.”

WASHINGTON conservative firebrand survived weeks of flamethrowing over his Calgary birth to make history Monday as the Canadian-born winner of a major United States presidential nomination contest.

A dual citizen until recently, Alberta-born Ted Cruz won the first-in-the-country nomination contest, taking the Iowa Republican caucuses despite being bombarded with questions about his eligibility by Donald Trump.

The billionaire’s birtherist broadsides failed against Barack Obama four years ago and they didn’t work in Iowa, either: thanks to a superior organization-and-turnout effort, Cruz exceeded pollsters’ expectations and won by about four percentage points.

It was a humbling night for Trump. He almost fell into third place, behind a delighted Sen. Marco Rubio. As for the habitually boastful Trump, he was gracious in defeat: “I’m just honoured. I’m really honoured, and I want to congratulate Ted… Iowa, we love you… I think I might come back here and buy a farm.”

Trump expressed optimism he’ll go on to win the nomination. He made sure to mention his bigger lead in polls in New Hampshire – which votes next week, and which has a very different political makeup from Iowa with far fewer religious voters.

Cruz staked his campaign on the midwestern state’s social conservatives. He launched his bid last year at an evangelical Christian university, and religious voters appeared to reward him Monday.

He spoke to them by quoting scripture in his victory speech Monday.

“The next president of the United States will not be chosen by the media. Will not be chosen by the Washington establishment. Will not be chosen by the lobbyists,” Cruz said.

Styling himself as the staunchest right-winger among the Republican frontrunners, the first-term Texas lawmaker has gone out of his way to draw attention to his prickly relationship with his Senate colleagues – none of whom have endorsed him.

He has parried Trump’s attacks over his unpopularity with colleagues by branding himself as an outsider in tune with the insurrectionist spirit rippling through the party.

That anti-establishment mood was potent enough Monday to relegate the fat-walleted campaign of the presumed frontrunner entering the race, Jeb Bush, to an embarrassing sixth-place finish.

On the Democratic side, meanwhile, the establishment favourite was sweating. Hillary Clinton clung to a nailbiting lead of less than a percentage point over the underdog challenging her from the left – Sen. Bernie Sanders.

Among Republicans, Cruz

took about 28 per cent. Trump under-performed his poll numbers to finish with 24 per cent.

And Rubio finished a strong third with 23 per cent, making him an early contender for the support of the more moderate mainstream as the race shifts to New Hampshire next week, then to southern states.

On paper, Iowa results mean little.

The state has a dismal track record of predicting the Republican nominee: in contested years, it’s only picked the eventual winner two of the last seven times.

Of the more than 1,200 delegates required to win the nomination at this summer’s Republican convention, Iowa confers only confers 30, to be split among the frontrunners.

But the results have mattered in other ways. Every big-party nominee of the modern era has won one of the first two contests, and Iowa has divided the field into contenders and no-hopers.

Mike Huckabee, a former Iowa winner, immediately suspended

his campaign Monday.

For his part, Rubio emerged as a first-tier player, which will cause nervousness among Democrats: he is perhaps the only candidate in his party to consistently beat Clinton in hypothetical head-to-head polling matchups.

The state has a far better record of picking the Democratic winner.

Clinton was seeking to cement her frontrunner status within that party. With votes still being counted early Tuesday, she was on the verge of snapping a family jinx.

She clung to a paper-thin lead of less than a percentage point, in a state that produced heartbreak for her in 2008 and dealt her husband a withering fourthplace defeat in 1992.

Both she and Sanders claimed moral victory. Neither conceded defeat. In fact, their virtual tie means they’ll actually split the state’s delegates. But it deprived Sanders of the kind of early win that propelled Obama’s 2008

A burst out of the gates helped Obama erase a huge deficit in later-voting, lessliberal southern states like South Carolina. This time, polls show Clinton with a 40-per-cent lead in South Carolina.

Sanders, who remains the favourite in New Hampshire, can now hope at best for a split in the first two states before the race moves to tougher terrain.

An enthusiastic crowd cheered Sanders as he referred to the come-from-behind quality of a campaign that has energized young liberals, with its call for a drastic shifting of national priorities toward tougher rules on corporations and a bigger social safety net.

Clinton expressed peace of mind.

“I stand here tonight breathing a big sigh of relief,” Clinton said, suggesting she’d won without explicitly declaring victory.

“I will keep standing for you. I will keep fighting for you.”

Good news from Kluane Lake

eidi Swanson is delighted with the early results of contaminant testing on Kluane Lake fish. The lake trout and whitefish have extremely low levels of mercury, a common contaminant in northern lakes.

“It’s a good-news story,” the University of Waterloo biologist said in a December interview. “I mean, you could have knocked me over with a feather when I saw the results!”

Swanson and her students are studying levels of contaminants in Kluane Lake food fish species as part of the Kluane First Nation’s food security strategy. With traditional terrestrial food sources, such as moose, declining, the First Nation is looking to the lake for future food security, she said.

The first test results are based on 115 samples from fish caught in the Kluane Lake Trout Derby last July. Successful fishers donated samples of flesh from their fish, as well as a small bone called an otolith that can provide information about the fish’s age. The results came back just before a couple of major northern science meetings in Vancouver, and the researchers scrambled to put together a poster summarizing them.

“We were not expecting at all the results we got,” said Swanson. “The Kluane Lake fish are really low in mercury – both the whitefish and the lake trout.

Almost all of the fish are below the subsistence consumption guidelines, which is amazing.”

Mercury is a common contaminant in most northern lakes, she said. It mainly comes from thousands of kilometres away, drifting high in the atmosphere and settling out over northern land and waters.

Small fish consume it with their food, and it accumulates in their bodies. Large fish eat the smaller fish, and more mercury collects in the larger fish. If people then eat the larger fish, the mercury accumulates in their bodies too and can cause serious health problems.

“The lakes are cold and not productive, and the fish grow really slowly, and when fish grow slowly they tend to accumulate more mercury,” Swanson said. In many northern lakes, large predatory fish like lake trout carry substantial amounts of mercury, which limits how many fish people can safely eat.

But not in Kluane Lake.

All the fish tested were well below the levels specified for commercial sale, and all but a couple were below the mercury levels set out for safe subsis-

She’s not sure why the Kluane Lake fish should have such low levels of mercury.

Analysis of sediment cores taken last year from the lake bottom might provide some clues. That analysis will happen this spring. But Swanson thinks what the researchers found in the stomachs of the fish might be an even better clue.

“Almost all of them were completely full of snails, which is unusual for lake trout.” If that’s one of their dominant prey items, she said, it would explain why they have low mercury. Snails graze on vegetation and algae in the lake, so they don’t accumulate mercury to the degree that carnivorous fish do. If the lake trout are eating snails rather than smaller fish, they’re picking up far less mercury in their food.

Swanson said her group still has plenty to learn about the feeding habits of the lake trout and whitefish in Kluane Lake before they can fully understand the results. But overall, the picture is good.

“Basically, it’s a good-news story. The lake has much lower mercury than I ever would have predicted after 15 years of work in the Canadian North on mercury.”

The project is not finished.

The samples are being tested for other contaminants, such as pesticides and PCBs. And Environment Yukon has contributed more samples, archived from previous years.

In addition, the Kluane First Nation is collecting samples from their traditional winter fishery for burbot.

In the meantime, Swanson said, people shouldn’t worry about eating Kluane Lake fish, and the First Nation’s future food supply looks promising.

“Really, I’ve never seen such safe fish to eat in the North. I’m flabbergasted, in a good way.”

The Kluane Lake fish research is a co-operative effort by the Kluane First Nation, the Arctic Institute of Communitybased Research, and the University of Waterloo researchers.

The study found three basins covering 10 to 15 miles along Dangerous Passage, a fjord. Each basin was progressively deeper.

The basins are bound by steep sides and were carved by glaciers when sea level was lower.

Brothers said Monday the basins are like a series of bowls setting on shelves at different heights. As glaciers retreated, sediment from rivers filled the underwater basins with unstable sediment washed from land. The earthquake spilled the second bowl.

“The intermediate basin filled up with sediment, setting the stage for this instability, and the

trigger that occurred when this earthquake struck,” Brothers said.

The huge delta of unstable sediment descended down a steep escarpment into the third basin in a giant underwater landslide, Brothers said. The “avalanche of sediment” created the wave that struck Chenega.

The 1964 quake and the tsunamis played a role in the formation of the West Coast and Alaska Tsunami Warning Center, renamed the National Tsunami Warning Center, operated by the National Oceanic and Atmospheric Administration. The centre within minutes of a quake can put out alerts to warn West Coast and Hawaii communities that a big wave is headed their way.

Most Alaska communities vulnerable to local tsunamis have tsunami siren systems that can be activated by local emergency officials to warn residents to head for high ground.

The research has implications for other communities along deep-water fjords.

“There are other places where we could go and target with these tools and go back and reassess whether a submarine landslide was responsible for those waves that were observed but unattributed to a particular source,” Brothers said.

Yukon biathlete Moser cracks top-25 twice at worlds

W

hitehorse biathlete Nadia Moser has once again proven herself to be one of the best in the country.

This time in an international championship.

Competing at her first IBU Youth/Junior World Championships, Moser twice skied and shot into the top 25 for youth women last week in Cheile Gradistei, Romania.

“I am happy with how I did in my races. It is great just to be able to compete here,” said Moser in an email to the News.

“I didn’t really have expectations because I’ve never competed against these girls before.”

The 18-year-old led the Canadian team with a 19th place finish in the six-kilometre sprint on Friday. She reached the finish in 19:47.7, just 1:32 behind the winner, and was the top finisher from the Americas.

Moser shot nine out of 10 at the range. (Only three biathletes in the field of 91 cleaned.)

“The sprint is usually one of my better races. In this race everything just came together well for me,” said Moser. “The wax techs did a really great job on the skis and my skiing felt pretty good that day.”

Moser then placed 24th in the 7.5-kilometre pursuit on Sunday, finishing in 32:07.6 – 4:52.4 behind the gold medalist. She shot 12 out of 20 and was the second finisher on the Canadian team.

Moser finished the championship by helping the Canadian team to 10th out of 19 teams in the 3x6-kilometre relay on Monday.

“The relay was a pretty good experience. It was really fun just to race as a team with my other teammates,” said Moser.

The three-time Team Yukon biathlete began the championships with 47th – third out of four on her team – in the 10-kilometre Roy Strum/Biathlon Canada individual start race last Wednes- Whitehorse’s Nadia Moser races at the IBU Youth/Junior World Championships in Romania on Friday. day. Moser punched her ticket for the youth worlds by winning gold, silver and bronze over three races at the Calforex Cup #2/ world youth/junior trials races this past December in Canmore, Alta.

A year ago Moser won silver en route to placing fourth overall in the division at the 2015 youth world trials. But Biathlon Canada decided to send a larger team of juniors (19- and 20-year-olds) and Moser was denied a spot.

On the bright side, by not competing at last season’s youth worlds Moser could race for Yukon at the Canada Winter Games and would go on to make history.

Moser captured Yukon’s firstever medal in biathlon at the 2015 Games in Prince George, B.C., eventually leaving with a silver and two bronze. She was the only Yukon athlete to win three medals at the Games.

She pulled off a similar feat the previous year at the 2014 Arctic Winter Games in Fairbanks – coming away as the only athlete on the entire Yukon team to capture three gold.

She also won a gold, silver and bronze at the 2012 Arctic Winter Games in Whitehorse.

Following her performances in Prince George, Moser went on to win two silver at the 2015 Canadian Biathlon Championships and then moved to Canmore to train full-time at the Biathlon Alberta Training Centre.

Moser, who is originally from Atlin, B.C. and moved to Whitehorse for high school, was only the second Yukon biathlete to compete at the youth/junior worlds last week. Whitehorse’s Erin Oliver-Beebe became the first four years ago in Finland.

“I just enjoyed being here. It was a really great experience. It was so much fun to race as well as watch my teammates race,” said Moser.

“Thank you to everyone who supported me to help me get this far and thank you to Sport Yukon.”

Yukon rinks notch wins at junior nationals Tom Patrick News Reporter

N

either Yukon team at the Canadian Junior Curling Championship challenged for medals last week in Stratford, Ont., but neither left empty-handed.

Both rinks secured wins and valuable experience for next time – all eight Yukon curlers are eligible for at least one more go at the championships.

The Yukon women’s rink, Team Meger, finished with a 2-7 record and the Yukon men’s rink, Team Klassen, ended 1-8.

“It was really fun and I met a lot of new people, so that was good,” said women’s skip Alyssa Meger.

“There was a lot of nerves, but I think we played pretty well as a team.”

With their two wins, Team Meger – third Emily Matthews, second Peyton L’Henaff and lead Zaria Netro – placed fifth out of six in the seeding pool ahead of N.W.T. They posted their first win with 9-8 over Newfoundland on Jan. 26.

Yukon took a 9-1 lead by the end of the sixth and narrowly held on for the win.

“Yeah, that was a pretty scary game,” said Meger. “We lost focus a little bit and got down, but then got it back the last two ends.”

Yukon then topped N.W.T. 12-6 last Wednesday. Tied 6-6, Yukon scored four in the eighth and two in the ninth to take it.

“We were super confident that game,” said Meger.

Team Meger wrapped it up with an 11-3 loss to Nunavut on Thursday. Nunavut also defeated N.W.T. on Jan. 26 for the territory’s first-ever win at the championship, ending a 32-game losing streak.

At just 15, both Meger and L’Henaff are eligible for six more junior nationals while their teammates are eligible for four.

“I think we’re going to keep going with this team, keep practicing,” said Meger. “We’re going to see how different positions work with

After eight consecutive losses, Team Klassen claimed victory in their final game.

Skip Brayden Klassen, third Spencer Wallace, second Trygg Jensen and lead William Klassen capped their run with a decisive 11-1 win over Nunavut Thursday.

“It could have gone a lot better, that’s for sure,” said Brayden. “The past years we’ve won way more games – five-and-four the first year, three-and-six the next.

“But it was still pretty good. We gave a few teams a run – Northern Ontario, who ended up placing second. We almost beat Saskatchewan as well. We gave up a few big ends, which made the score look a lot more lopsided. Like Nova Scotia, we lost 12-6 but it was tied 6-6 go-

ing into the eighth.”

Yukon’s one win was good enough to place fourth out of six in the seeding pool, on top of Nunavut and N.W.T. (Nunavut defeated N.W.T. to end a 33-game losing streak.)

The two other territories finished with the same 1-8 record, but Yukon finished ahead by point differential.

Last week marked Brayden’s third junior nationals, but his first as a skip. He was also skip for Yukon at the 2015 Canada Winter Games with brother William and Jensen also on the team.

“It’s a bigger stage than at Canada Games. It was a lot of fun. I loved it,” said Brayden. “Hopefully we’ll do better next year. Take a good run at her. We proved we could take on

some of the better teams.”

Nova Scotia took gold, B.C. silver and New Brunswick bronze on the women’s side; Manitoba gold, Northern Ontario silver and B.C. bronze on the men’s.

As has become the custom over the last few years at junior nationals, curlers not on teams heading into the weekend’s playoffs get paired up for a mixed doubles tournament.

Team Meger’s coach, Chris Meger, helped coach Nova Scotia’s Nick Zachernuk and Manitoba’s Melissa Gordon to a silver medal in the event in which higher rated players are paired with lower rated players, “So it kind of evens things out a bit,” said Chris. “It’s lots of fun – lots of cheering.”

Table tennis, archery coaches to enter sports Hall of Fame Tom Patrick News Reporter

F

or the first time since 2004, the Sport Yukon Hall of Fame will have two inductees in the same year.

Yukon table tennis legend Kevin Murphy and archery coach/administrator Les Johns will formally be inducted at the Sport Yukon Award Night this week, it was announced Friday.

“I was pleased that there is this recognition,” said Murphy.

“Sometimes you feel like you toil in obscurity for a number of years and along comes something like this and puts a stamp of validation to all the hard work you put into your sport. It’s very gratifying to be recognized that way.”

“It was a surprise to me,” said Johns. “It’s an honour to be up there with all the other people who have been honoured in the sport Hall of Fame. I feel very humbled about it because I haven’t been doing it as long as some of the other ones.”

Murphy started playing table tennis in the early 1970s and captured his 20th men’s singles title at the Yukon Open Table Tennis Championships last April.

He also pocketed countless men’s

doubles, mixed doubles and team titles along the way.

However, his time as a coach goes back almost as far as his playing career.

Murphy has coached Yukon table tennis players at 11 Arctic Winter Games going back to 1974 and will attend his 12th next month in Greenland. He has also coached at seven Canada Winter Games spanning 40 years, beginning with the 1975 Games and his most recent last year.

Murphy has also attended 11 national table tennis championships as a player and/or coach. At the 1983 nationals in Montreal he returned with a record of six wins and six losses in team matches.

While he is being honoured for his time with Table Tennis Yukon, Murphy has also been a pillar in Yukon’s five-pin bowling community. Murphy has coached youth bowling teams at 13 national championships going back to 2001.

“Something I’ve always wanted to do is help people reach their potential in the two sports I’m involved in,” said Murphy. “It was gratifying to work with youth in both sports.”

my grandkid,” said Johns. “My grandson wanted to compete in archery and his parents were kind of busy, so I’d take him to different shoots in the Yukon and slowly got involved. Pretty soon I picked up the bow again and started shooting.”

Johns, who is a member of the Carcross/Tagish First Nation, has coached Yukon archers at six major Games.

He has coached at the last three Canada Winter Games and at three North American Indigenous Games since 2006.

In 2007 he received a coaching award from the national Aboriginal Sport Circle.

“I took on the role of president because there was no one else,” said Johns. “If we didn’t have an executive, we wouldn’t be able to get insurance through Archery Canada. Nobody wanted

to be president, so I became the president.”

The 40th annual Sport Yukon Award Night will take place this Thursday at the Yukon Convention Centre. There will be a reception at 6:30 followed by the ceremony at 7 p.m.

“I started playing in about 1971 when my dad brought a table home,” said Murphy following last year’s table tennis championships. “At the time I was in the Air Cadets, and 1972 rolls around and there were Arctic Winter Games in Whitehorse, and I’m in the colour guard for when the governor general of Canada opens up the table tennis event at Takhini school. And I see a young girl playing the governor general ... and I know the girl and I think, ‘I’m better than her.’

“I quit Air Cadets and joined table tennis that fall, and I haven’t stopped.”

The next DPSAY event will be the Babe Southwick/Rendezvous race on Feb. 21 at Armin and Mandy’s Yukon Horsepacking Adventures outfit at Fox Lake.

The main event will be a 1520 mile 10-dog race as well as a six-mile four-six dog event and a kids race.

“We don’t have a main purse sponsor yet – we’re still looking for one if anybody wants to help out in that regard,” said Armin.

“We’re also looking for sponsors for prizes for the kids race.

“If someone would step up and be a main-purse sponsor they could have their name in the title of the race for this year and future years as well.”

Gritty Mustangs fight back for bantam gold Tom Patrick News Reporter

T

he Peewee Mustangs showed mettle matters over the weekend.

The Yukon rep team overcame injuries, illness and a two-goal deficit in the final to win the Yukon Bantam Hockey Championships at Takhini Arena on Sunday.

“It was a real character game for them,” said Mustangs assistant coach Mike Cozens. “They didn’t let themselves get down.

They believed they could come back and they did. The kids work a lot at working as a unit, and they know if they do that, it’s going to pay off for them in the end.”

The Mustangs team, which plays up an age division, took gold with a 5-3 win over Castle Rock in the final.

They found themselves down 2-0 six minutes in before scoring five straight goals.

“The team just pulled together. We got that one goal and after that we just started going,” said Mustangs defenceman Connor Cozens. “We weren’t ready for those two goals right away.

We didn’t expect them to come out so strong like that. We pulled through after that.”

“We weren’t getting out of our zone fast enough,” said Mustangs centre Landon Marsh. “We all pitched in and our goaltender (Joshua Wallness) helped us out.”

Mustangs centre Errol Eckholm scored a hat trick in the final, including the game-winner.

Teammates Joshua Schenk and Joey Schultz also found the back of the net, while Connor Cozens and Ashton Underhill logged two assists each.

Eckholm was named his team’s MVP for the final.

“Errol is a dynamic forward.

He reminds me a little of the Tasmanian Devil a little bit,” said Mike, referring to the Looney Tunes character. “He’s a whirling dervish on the ice at times.

He covers both ends really well, is a good defensive player and a good offensive player, great shot.

“In the semifinal we had a few guys feeling pretty sick. They’d leave the bench for five to 10 minutes, then we’d be down short, and they’d show up and say, ‘We’re good for a few more shifts,’” said Mike. “It’s a really good group of kids. They have a lot of character, they work hard and it’s a lot of fun to coach them.”

Castle Rock’s goals in the final came from Colton Webb, Kyle Bierlmeier and Austin Shaw.

Jesse Goodman helped with two assists.

Shaw, who plays defence, was named his team’s MVP in the final.

“He’s got a lot of energy and he played consistently throughout the tournament,” said Castle Rock assistant coach Bill Waugh.

“We had a good tournament.

We went with five wins there and got to the gold medal game,” he added. “But that Peewee Mustangs team plays really well.

They’re structured and they’re hungry – they go for the puck. So we had to counter that and just ran out of steam.”

The Peewee Mustangs claimed silver at last year’s championship, losing to Alaska’s Juneau Capitals in overtime in the final.

“It’s pretty cool,” said Connor, a second-year player with the team. “It was definitely good to win it this year.”

THE CANDIDATE The ideal candidate will hold a degree in either Finance or Business Administration or a professional accounting designation with at least seven years relevant work experience at a senior management level. Substantial knowledge (both in depth and breadth) of accounting practices in both the public and private sectors is required as well as several years experience in a supervisory role. Strong interpersonal, mediation, analytical and written communication skills are a must.

It is with great sadness that we announce the sudden passing of Derek Ward on Friday, January 29, 2016 in Atlin, B.C. Derek was born on July 29, 1970 in Watson Lake, Yukon, the oldest son of Vera Boya (Kaska) and John D. Ward (Taku River Tlingit), and lived in Atlin since 1990.

Derek will be remembered for his big heart, generous nature, sense of humor and for being a very hard worker.

Derek was a kind, caring individual and was always willing to lend a hand. Derek is survived by his mother, Vera Boya, father, John D. Ward, siblings Denelle, David, Shawana and Kyle, as well as partner of sixteen years, Linda McGill.

Derek will be greatly missed by all who knew him. Funeral service will be in Atlin on Saturday February 6, 2016 at the Atlin Rec Centre at 2pm. A potlatch at the Rec Centre will immediately follow the burial. All are welcome to attend.
