Tides Canada expanding its northern reach

ustin Ferbey has become the first northerner on the board of directors of Tides Canada, a national charity that funds social and environmental initiatives across Canada.

The appointment is part of the organization’s move to expand its presence in the North. Tides Canada launched its northern branch in 2013 with the opening of a new office in Yellowknife.

Ferbey said his previous work as chief executive officer of the Carcross Tagish Management Corporation has much in common with this new position, in that both appointments are focused on developing sustainable economies. “It seemed to me like a natural fit,� he said. “We’re looking for local solutions to local challenges.�

Tides Canada operates by attracting donations from philanthropists in Canada and abroad and funnelling them to specific projects that the donors are interested in supporting.

It’s one of the environmental groups targeted by the previous Harper government as a foreign-funded “radical� group opposed to oil sands and pipeline development. The Canada Revenue Agency began auditing Tides Canada in 2011. At the time, questions were raised about how much the organization was spending on political advocacy.

This year’s cap has been raised to $10,000, according to bylaw manager Dave Pruden.

An average of 540 parking tickets are issued that week, he said.

Cable said the government is reviewing its legislation with transgender rights in mind, but cautioned that it’s much harder

to change legislation than to tweak a policy.

“There are a lot of departments at play here, so a fairly significant amount of policy work has to be done,” he said.

Still, Yukon is now one of a minority of Canadian jurisdictions that have not removed or promised to remove the requirement for surgery to change gender on a birth certificate.

Jai said that B.C., Alberta, Manitoba and Ontario no longer require surgery, and the change will soon be in effect in Quebec, Nova Scotia and Newfoundland and Labrador.

She also said the legislation in New Brunswick and Nunavut never required sex reassignment surgery in the first place.

“This is a very live topic and it is being discussed by all of the jurisdictions,” she explained.

For his part, LaDue plans to keep raising awareness about this issue until the legislation is changed here at home.

“Part of it is education,” he said. “We need to make policies that are more inclusive in every organization in the Yukon.”

Yukon spent $3 million on French school court fight The Yukon government has spent more than $3 million to fund its legal battle against the territory’s French school board.

That’s according to documents tabled by Education Minister Doug Graham in the legislative assembly last week.

Opposition NDP leader Liz Hanson asked Graham whether he believed the government

could have accomplished more with the funds. “Yukoners know that this money could have been spent in better ways,” she said.

Graham said he tabled the expenses in the name of transparency, and that new attempts have been made to resolve the differences with the school board rather than going back to court.

“We believe that the best possible way of settling these differ-

Ken Coates, a professor of public policy at the University of Saskatchewan, said the results show that “the aspirations that a lot of northerners had (for the final agreements)... actually bore fruit.”

“One of the reasons for signing a treaty is to have greater economic opportunities,” he said.

But Coates cautioned that the positive results might be due in part to the recent resource boom that ended after 2011.

“In my experience, what happens is that aboriginal rights are not a barrier if the price is right and the demand is high,” he said. But he explained that when commodity prices are

low, as they are today, resource companies are less likely to offer deals that First Nations find acceptable. If the resource sector had been in a slump since the 1990s, the economic benefits of treaties would probably be less clear.

“We have to be careful about attributing everything to a treaty when there’s other factors going on,” Coates said.

This latest report stands in contrast with one released by the Fraser Institute in September, which was much more critical of the economic effects of modern treaties. That study blamed recent court decisions about First Nations land claims in the Yukon for creating uncertainty and hurting investor confidence in the territory’s mining industry.

It listed several recent court cases, including the Peel watershed case, as examples of disputes that could have stayed out of the courts if First Nations

and the government had stuck more closely to the terms laid out in final agreements.

But Coates said the two reports are not incompatible. He pointed out that the C. D. Howe study focused on the years up to 2012, while the Fraser Institute report focused on the last few years, after commodity prices started to slump.

“When the margins have all shrunk, then it’s much harder to reach a good deal with First Nations,” he said.

Still, he said, even while mineral prices rise and fall, this latest report shows that the treaties provide economic benefits.

It can just take time for those effects to be measured.

“A lot of people expect when these things are done... that the results are going to be really fast,” he said. “That’s not how life works.”

The school board and Yukon government have been mired in a court battle over the plans for a new school since 2009.

In early May, the government announced the school board had picked the Riverdale skate park as a potential site for a new French high school. At the time, Graham said no work would

Last week, Liberal Leader Sandy Silver asked Graham for details about potential sites.

Silver also requested to see conceptual drawings produced for the school. But since it was the end of the day, the House was adjourned before Graham could answer.

No new money for Shakwak roadwork Ashley Joannou News Reporter

F

or the third year in a row, the United States House of Representatives hasn’t earmarked any more cash for the Shakwak portion of the Alaska Highway.

A transportation bill, passed last week, made no mention of the project to improve Yukon highways that connect mainland Alaska to the panhandle.

The Shakwak Agreement was signed by the governments of Canada and United States in 1977.

It lays out responsibilities for 523 kilometres of road – the Canadian portion of the Haines Road from Haines, Alaska, to Haines Junction and the northern portion of the Alaska Highway from Haines Junction to the Alaska Border.

U.S. cash came in every year until 2012, when the American government pulled the project’s inclusion from the federal Highways Act funding.

In the Yukon legislative assembly on Monday, NDP MLA Lois Moorcroft asked what the Yukon government was doing

to try and get the money flowing again.

“Previous years’ budgets were $19.7 million and $26.7

million for Shakwak. This year’s budget allocated $9.9 million for road improvements through Shakwak, mainly to deal with

cleaning up damage from water that had leaked into the 25-yearold building.

The Yukon’s Department of Highways and Public Works hired a mould cleanup specialist and the worker’s compensation health and safety board ordered the wall resealed and the room closed.

By May 2014 the mould was

In the legislative assembly on Monday, Highways and Public Works Minister Scott Kent said the roof will be fixed this summer.

In the meantime, the department “has contracted for snow removal to ensure that snow and ice does not build up on the facility’s roof to reduce the potential for water infiltration until the repairs can be completed,” he said.

Highways Minister Scott Kent said the Yukon government will continue to lobby the Americans for Shakwak funding, as it has done since the money was halted.

He mentioned 85 to 90 per cent of travellers on that section of highway are Americans, either travelling from southeast Alaska into the interior or from the Lower 48 states to visit Alaska.

Kent said he has plans to speak with the new federal Minister of Transport, Marc Garneau, about Shakwak during an upcoming phone call.

Premier Darrell Pasloski said he will also be raising the issue with the minister of foreign affairs, Stephane Dion, and the prime minister.

Liberal party MPs punt vote on Reform Act provisions until after national convention Myles Dolphin News Reporter

ukon MP Larry Bagnell said there is no rush to vote on the provisions in the Reform Act, a bill that gives MPs a chance to take some of the iron-fisted control away from their party leaders.

Under the new law, party caucus members are supposed to decide, at their first meeting following an election, whether they wish to take advantage of the powers in the bill.

Those powers include removing the ability of party leaders to block candidates from running for their party and also giving MPs the power to trigger a leadership review vote to remove a party leader. It would also give them the power to select their caucus chairperson.

But last week, Liberal MPs unanimously decided to defer the decision until their upcoming national convention in May. Bagnell said it was a good idea, as it allows party members to weigh in on the issue.

“Democratically, a huge number of people in the party set the guidelines and it shouldn’t be up to a few MPs to make those decisions in isolation,” he said.

Chong heavily watered down the act in order to get support from all parties.

Bagnell noted parts of the bill don’t affect the party, as Liberal MPs have always elected interim leaders as well

as caucus chairs.

But he said he’s always had reservations about the vote that would trigger a leadership review.

The bill would allow a caucus to remove its chair or leader – or expel a member – if 20 per cent of the members call for a

review.

“In our last caucus eight people could have initiated the process,” Bagnell said.

If that threshold is reached, then there is a second vote – and if 50 per cent plus one of all caucus members vote to remove the leader or chair, that’s

The board’s lawyer, Jim Tucker, called the half-finished mess “an open wound in the condominium development.”

The bare piece of property is the last bit owned by developer Brian Little. Little and the board have been in court for nearly three years.

That’s when a judge ordered him to halt construction of the apartment. He ruled that Little didn’t have the authority to build it there in the first place.

After a trial, Little was permitted to proceed with smaller buildings. But those plans never happened and the half-built structure remained standing, exposed to the elements.

Now the board’s been told Little has lost his financing and won’t be able to do any more work

on the property. He did not show up to court on Thursday and did not file any sort of defence.

Tucker said now that the order has been made he’ll be asking Yukon sheriffs to seize anything that can be removed from the property.

As it stands, the party’s constitution allows for both MPs and senators to take part in the vote.

The closure will be in effect from November 1, 2015 to July 31, 2016 and includes the Dempster Highway from kilometre 77 (North Fork Pass) to kilometer 195 (Ogilvie River bridge).

This winter, most caribou seen along the south end of the Dempster Highway are Hart River caribou. The risk of overhunting the Hart River caribou in this area is very high. This emergency closure applies to Yukon resident and non-resident hunters.

For subsistence harvesters, caribou south of km 140 (Windy Pass) are not considered Porcupine caribou. Harvesting rights under the Porcupine Caribou Management Agreement do not extend south of km 140 and do not apply at this time.

e never hear much about making peace. Seems to always be about war, conflicts and national security. Would it be different if women ruled the world? Perhaps if men carried a growing fetus for nine months they would value life more? Or are we all warriors?

Recently I attended a meeting and conference of the National Association of Japanese Canadians and had an opportunity to hear Setsuko Thurlow, a dedicated peace activist, former social worker and Hiroshima survivor. I hope that I’m as feisty and committed to justice and peace as she is at the age of 83.

She is a hibakusha – a Hiroshima survivor, pacifist and “memory keeper.� She lives in Canada and continues her work to abolish nuclear weapons. In December 2014 she witnessed the signing by 113 nations of the Austrian Pledge, now renamed the Humanitarian Pledge, which called for all nuclear weapon states and those who support them to begin the process for nuclear disarmament by developing a legally binding framework to ban nuclear weapons. Canada and the U.S. were not signatures to that agreement. (See www. icanw.org/pledge.)

When I heard Setsuko Thurlow speak I was reminded of the time that my husband, our 17-year-old son and I were in Nagasaki, Japan with my relatives on the anniversary of the atomic bombing of August 9, 1945.

bomb exploded 500 meters above this spot. The black stone monolith marks the hypocenter. The fierce blast wind, heat rays reaching several thousand degrees and deadly radiation generated by the explosion crushed, burned and killed everything in sight and reduced this entire area to a barren field of rubble. About one-third of Nagasaki City was destroyed and 150,000 people killed or injured and it was said at the time that this area would be devoid of vegetation for 75 years. Now, the hypocenter remains as an international peace park and a symbol of the aspiration for world harmony.�

We saw a photo in the Nagasaki Museum of the silhouette of a person who was incinerated in front of a wall as they were walking down the street when the bomb went off. That image is imprinted on my mind and soul. As we moved throughout the museum exhibit there was only the shuffling of feet. When my family members and I left the museum, we sat in silence with our own reflections for many minutes before we could speak. There was nothing I needed to say to my son about the need to

There’s an inscription in Hiroshima, at the site of the other atomic bombing in Japan, that roughly translates as: “Rest in peace. Error will not be repeated.� I seem to recall a similar sentiment after World War I. The poppies are a reminder, “Lest We Forget,� to make peace, not war.

Unfortunately the seeds of violence continue to be planted, nurtured and grow. Many politicians and media outlets talk about national security, the threat of violence on our home soil, and create fertile ground for an atmosphere of xenophobia – the fear of strangers. Many of these “strangers� are new immigrants and refugees to Canada and are often seen as threats to our security.

This year on the 70th anniversary of the bombing of Hiroshima and Nagasaki, let us consider ways to root out the weeds of violence and cultivate a culture of peace and respect in Canada. Let us all work to be messengers of peace.

to lay out their arrangement in broad strokes, get the document signed and worry about the details later.

But ambiguity in legal drafting is a recipe for lawsuits. If a document is clear when a dispute arises one party gets to claim victory while the other resigns in defeat. Truly frivolous litigation when the law is clearly on one side certainly occurs, but it isn’t as common as one might assume.

But insert a little bit of ambiguity into a document and the stakes change dramatically. Suddenly both parties have something to hang their hat on, thus providing them with the incentive to take the matter to court or at least try to leverage some sort of compromise.

The word “modify” presents exactly that kind of ambiguity.

The Yukon government’s stance seems to be that “modify” means whatever the government says it means. Our ministers have repeatedly stated that “public government” needs to have the final say over land development in the territory. Want to turn a plan that calls for protection of 80 per cent of the Peel into a plan that protects only 29 per cent? Just “modify” it. At the end of the day it is our decision.

And while the government was slapped down for not proposing modifications early in the

process, the court did not rule on whether essentially introducing a whole new plan fell within the meaning of “modify.”

The position of others seems to be that “modify” must mean something much narrower. In a statement, Yukon Vuntut Gwitchin Chief Roger Kyikavichik says that “this is not finished until we’ve concluded a final land use plan that we can all agree to.”

That doesn’t sound like a plan that the government can “modify” to the point that it is unrecognizable to those who participated in developing it.

“Modify” – from this perspective – is a word that is limited in scope. In this view, control over development in the Yukon is seen as a true partnership, where decisions are made by consensus, not by one party with the final say.

Unfortunately, both are plausible interpretations of the word “modify,” and after all this kerfuffle we don’t have any clearer idea of which is correct.

And even when we do, the fun may not end immediately.

The difficulty with the narrower interpretation preferred by those who view land management as a true partnership is that it will likely lead to even more litigation.

The government’s position has the advantage of clarity. If

modify means anything and everything then there is no room for grey.

But if modify means something less than “whatever we say it means” then that means there is a line between a “modification” and something entirely different which will have to be sussed out.

It is unfathomable that after all the time, money and effort that went into negotiating final agreements and establishing a framework for development in the territory, we are left with such a fundamental disagreement about what was intended.

How did this happen? Was it poor drafting? Did no one point out to the parties that this word could present a problem?

Or did the politicians of the day deliberately elect to punt and leave a fundamental question that goes to the heart of development in the territory to another day? Were politicians at the time to eager to have a photo op and say that the job was done while important details were left to a later today?

These are questions that will probably go without answers, but the end result is litigation on the taxpayer dime that will continue into the foreseeable future.

New environment minister won’t set GHG target but calls Tory targets the ‘floor’ Bruce Cheadle Canadian Press

The new Liberal government has so far refused to set a carbon reduction target in advance of the COP21 international climate conference that begins at the end of the month, citing the need to consult with the provinces before putting in place a credible national plan.

But with environmental groups loudly complaining that Prime Minister Justin Trudeau will take Stephen Harper’s climate plan to the world, McKenna moved Monday to put some parameters around Canada’s position.

McKenna is in Paris attending ministerial meetings in advance of COP21, where the international community hopes to set in place a post-2020 framework for global action on climate change.

The Conservatives announced in May that Canada’s contribution to this year’s Paris talks would be a 30 per cent cut in greenhouse gas emissions below 2005 levels by the year 2030. Canada, however, is currently not on track to meet its existing 2020 cuts under the 2009 Copenhagen accord, and the Harper government did not provide any policies to meet the

you have to take concrete actions toward those targets.”

Canadian governments – Liberal and Conservative alike – have previously agreed to international carbon cuts, but failed to implement the policies needed to make those cuts a reality. The Conservatives famously failed to regulate the oil and gas sector despite promising to do so for the better part of a decade.

“That is why it is so important to sit down with the provinces and territories and look at how we can all do our part,” said McKenna. “Much of this is in the jurisdiction of the provinces.”

Provincial premiers have been invited to join Trudeau in Paris at the begining of December, but it remains unclear what specifically Canada brings to COP21.

McKenna, an international trade lawyer who worked with the United Nations in negotiating a peace agreement in East Timor, said she’s had bilateral meetings with France’s foreign and environment ministers and Mexico’s

environment minister and plans to meet with her U.S. counterpart before returning to Canada on Wednesday.

She’s joining climate negotiations that have been years in the making, with several major sticking points still remaining on the eve of the full conference. These include climate finance, mitigation and adaptation funding for developing countries, and getting more countries to the table in Paris.

McKenna specifically mentioned Canada’s leadership in la Francophonie, the international club of French-speaking countries that Canada helps heavily subsidize, and the Commonwealth.

“In some ways it’s a good time to come in” to the negotiations, she said. “This is what I’ve been told by my colleagues, because we bring new energy.”

Federal-provincial dialogue after a decade of division is a good thing, said Stephen Guilbault of Equiterre, but he reminded the Liberals that at some point they’ll have to make some tough decisions.

Citing Saskatchewan’s premier, Guilbault questioned whether “Brad Wall is going to have an epiphany and say, ‘Oh yeah, let’s go ahead, I’m full in.’ No, we have to be realistic about that. We won’t get everybody on board.”

McKenna, for instance, was unable to say how the Liberal promise of tougher environmental assessments might apply to existing pipeline applications already under review.

She said she’ll travel to Alberta next week to meet her counterpart in Rachel Notley’s NDP provincial government.

“We will have a great difficulty in getting our resources to market if we can’t show that we are taking credible action to tackle climate change,” said McKenna.

OTTAWA rime Minister Justin Trudeau has yet to reach out to top senators to let them know what’s next for the upper chamber, specifically whether there will a government leader there to oversee the Liberal legislative agenda.

That wouldn’t be an issue, except for a decision last year to kick senators out of the Liberal caucus as he tried to sever ties with the scandal-plagued Senate.

What Trudeau decides to do now with the upper chamber will have wider implications for the Senate and the Liberal legislative agenda.

Here are a few issues hanging on Trudeau’s decision:

Changing of the Speaker The prime minister has the power to name a Senate Speaker because the Senate Speaker is considered a representative of the government. That person does not answer questions on government policy from senators, but represents the government of the day through hosting foreign dignitaries and taking part in soft diplomacy abroad.

Senators widely expect Trudeau to name a new Speaker to replace Conservative Leo Housakos.

Leaving Housakos there would mean a Conservative is acting at times on behalf of a Liberal government. Replacing him would mean Trudeau is tying himself back to the upper chamber.

No government leader, no government help As it stands, Senate rules allow any senator to introduce legislation. Those same rules also allow enough leeway for senators to debate bills for months before they come to a final vote.

Without a Senate leader, the Liberals would lose access to the levers governments have in the Senate to push through legislation, either by pushing it higher up the list of business or limiting the amount of time bills can be debated.

Senate Liberal Jim Munson said the Trudeau government has some allies in the upper chamber that would introduce legislation, but no guarantees it will be approved: “It is an independent instruction and people have the right to say yes or no to legislation.” Passing any bill, then, would require help from Conservative senators.

penchant for picking fights – on everything from scientific advice to collective bargaining – appears to have pushed the normally reserved bureaucracy past the point of caring about partisan optics.

This week, Trudeau sent a letter to all heads of missions freeing up Canada’s diplomats to re-engage in public diplomacy after years of having to report every public engagement to Ottawa.

Some departments have also begun advising federal scientists that restrictions on discussing their work with the media and at conferences are being lifted, according to the Professional Institute of the Public Service of Canada.

The government confirmed that late Friday with a statement from Navdeep Bains, the minister of Innovation, Science and Economic Development.

Scientists will be treated with respect, Bains said in a brief statement.

“That is why government scientists and experts will be able to speak freely about their work to the media and the public,” he said.

“We are working to make government science fully available to the public and will ensure that scientific analyses are considered in decision making.”

Chartering some of the larger planes in Alkan’s fleet will set you back at least $1,000 an hour.

Alkan has three certified flight instructors on staff. Rosen said the demand for pilots is high in the Yukon.

“It’s sparse country and it’s beautiful country and a lot of people like to fly over it,” he said.

Getting a private pilot’s licence means a minimum of 45 hours flying a plane, usually more, Rosen said, and 40 hours of classroom training.

The whole thing will cost a minimum of $14,440 and take around three months to complete depending on weather and the availability of the plane.

For those who want to give it a whirl without committing that kind of cash, Alkan is also offering a $99 “discovery flight” with

an instructor.

“You get to jump in, you go flying for half an hour, you get to touch the controls,” Rosen said.

“Someone said within the first five minutes you’ll realize if it’s something you want to do or not.”

A private pilot’s licence is just for personal use. Down the road, Alkan will also be offering commercial pilot’s licence training for those who want to get in the business of flying.

After getting a private pilot’s licence, the commercial variety means a minimum of 200 hours of flight time and 80 hours of ground school.

The company also has visions of working with Yukon College to develop an aviation diploma, to go along with a licence, Rosen said. Exactly what that would look like hasn’t been decided yet, he said. The plans are still in their infancy.

“Outside, around the coun-

try, especially in bigger centres, there are college aviation programs and they work together to produce pilots that have that kind of university or college credits.”

Having that college link would be helpful to Yukoners, he said. Right now getting a pilot’s licence here would not be covered by the Department of Education’s grant program for Yukon graduates.

“So if we could somehow partner up with Yukon College and turn it into a program that a student could go to college for, there is a chance that students could start using that towards their licence.”

For those who like a challenge, looking out on the world from inside a cockpit could be exactly the kind of thing they’re looking for, Rosen said.

“What do you see? You see everything.”

How Stephen Harper’s old schoolmate helped kill the Keystone XL pipeline Alexander Panetta Canadian Press

WASHINGTON ne of the great ironies of the interminable saga of Keystone XL is that two of its principal antagonists were unaware that they went to grade school together.

In the midst of one of the biggest environmental fights in American politics, the bestknown activist on one side learned of his distant connection to the most powerful politician on the other: Stephen Harper.

So these old grade-school alumni duked it out from a distance as the pipeline escalated from a regional land dispute to international cause celebre, climate-change battle line, and irritant in Canada-U.S. relations.

Bill McKibben is amused to hear pro-pipeline politicians in Canada deride opponents like him as foreign radicals. McKibben quipped in an interview: “I had exactly the same upbringing as Stephen Harper.�

The Vermont environmentalist spent his elementary-school years in Toronto, during his father’s posting as a business journalist. He never got to know the future prime minister, who was a year ahead at Northlea Elementary.

This is the story of how they became rivals.

Like many others in the environmental movement in 2011, McKibben was dejected at the collapse of a cap-and-trade bill in the U.S. Congress and disillusioned with President Barack Obama for failing to make it a priority while his party still had control of Congress.

A eureka moment occurred that June.

It was triggered by a journal article from climatologist and former NASA scientist James Hansen, titled “Silence is Deadly.� It sounded the alarm on a

McKibben was a longstanding Hansen admirer.

His Rockefeller-funded climate-change group, 350.org, was even named after Hansen’s work, a reference to the make-or-break level for carbon in the atmosphere at 350 parts per million.

He spotted a political opening.

The pipeline needed a crossborder permit, which meant

it was a rare issue beyond the control of a hostile U.S. Congress, and could be determined by the one person with the power to approve or reject that international permit: the president.

McKibben contacted aboriginal activists in Canada.

He’d already heard allies describe oilsands impact on First Nations land. But he’d never made the connection between their issue and climate change – until he saw Hansen’s paper. He called Tom Goldtooth and Clayton Thomas Muller in Canada and asked if they would mind

him taking up the cause. ‘’They graciously did not say anything about our coming late to the battle and instead said, ‘Sure.�’ So McKibben wrote a letter inviting people to come to Washington and engage in civil disobedience. It was signed by a number of activists, including Canadians Naomi Klein and David Suzuki. “Far more people responded than we imagined would.�

More than 1,250 people were arrested outside the White House over a two-week period before Labour Day 2011, including McKibben. As political opposition grew, finger-pointing began.

Government types still grumble that the pipeline company had a tin political ear. Calgarybased TransCanada Corp. ignored local concerns in Nebraska, they say, and it took too long to get Montana and North Dakota onside by taking in some U.S. oil. However, people close to the company have blamed the Harper government for antagonizing environmentalists.

But the real pressure on Obama was domestic.

It came from within his own party, on multiple fronts. AntiKeystone editorials appeared in the New York Times. Young Democrats now frown at mentions of Canada’s “tar sands.�

Huge political donations poured in from California environmentalists, including former hedgefund manager Tom Steyer.

A symbolic encounter occurred at that first big Washington protest. That’s where McKibben first met Jane Kleeb.

If he helped lead the national fight, she’d been its earlier champion in Nebraska.

The Democratic party activist had moved to her husband’s home state and started the political group Bold Nebraska.

She’d been planning to work on immigration or education reform and initially considered environmentalism too granola of an issue to take up in conservative cowboy country.

position had nothing to do with climate change. The project’s first opponents were ranchers and they worried about water contamination.

An early press report mentions everything but greenhousegas emissions. The Norfolk Daily News piece in 2009 refers to sensitive species in the area: the piping plover, the river otter, and a list of other creatures.

Kleeb was invited to a townhall-type meeting. By the end, she’d decided to promote the ranchers’ cause: “(I) said, ‘We have got to organize on this issue.�’ She prepared colourful protests, arranged national media interviews, and introduced landowners to the lawyers who later delayed the project in state courts. It still faces legal obstacles in Nebraska.

Most landowners on the route eventually signed on. But a minority continued to hold out, even as cash offers from TransCanada multiplied five, six, seven times.

Amid lawsuits and re-routing, project costs skyrocketed. They increased by almost half to $8 billion – profiting lobbyists, lawyers, ad salesmen, pipe-storage yards, even landowners who got cash upfront but never had to lay a yard of pipe.

Obama gradually toughened his tone. He’d actually held a re-election-year event at a TransCanada facility in 2012.

But the politics shifted. He hired John Podesta. An anti-pipeline environmentalist who has been a top aide to both Bill and Hillary

ment’s analysis, would actually reduce emissions.

But does rejecting Keystone help – or harm – the climate?

Obama’s own State Department concluded that greenhouse gases would be up to 42 per cent higher if that same oil was shipped by rail. But the politics changed. Oil prices plunged.

U.S. production rose. Americans stopped worrying so much about

their energy supply. And the assumptions in that State Department review were derided as out-of-date.

But the Keystone fight, McKibben said, is really just a shortterm tactic. The broader goal is to block the construction of oil infrastructure, for a faster transition toward new energy sources.

Another other political development occurred Oct. 19.

Canadian voters silenced the pipeline’s loudest advocate.

And McKibben wasn’t showing much school spirit. “I understand Canadian politics just enough to know that petrocrat Stephen Harper is out of a job,� McKibben tweeted as the federal election results rolled in. “No one could deserve it more.�

T

he sound is optimistic and uplifting. African melodies are infused with western hip-hop beats to create a modern sound while still being rooted in tradition. Simple and catchy, the songs get feet shuffling and hips moving. This is bongo flava at its finest.

Originating on the streets of Dar Es Salaam in Tanzania, the infectious music will land in Whitehorse this Saturday featuring in the Yukon African Music Festival. Held at the Kwanlin Dun Cultural Centre, the one-day event will feature musicians from east and west Africa, as well as the Caribbean.

Now in its third year, the festival is the initiative of Leonard Boniface, a native Tanzanian who moved to Canada a decade ago and made his way north in 2010. Holding the festival is a great way to bring cultures together, Boniface says.

“One of the powerful tools in life is just sharing what you have to others,” he says, “because we learn from each

other.”

Forging understanding between cultures is important, says Boniface. By meeting together, sharing food, music, and culture, new connections are made and gaps between groups grow smaller. “We all need to understand so many cultures as people,” he says.

These lofty goals stem from Boniface’s previous experience at the Oxfam International Youth Parliament in 2004, a cohort of 300 young people from around the globe who were actively working for positive social change in their countries.

Part of the Tanzanian delegation, Boniface travelled to Australia to meet and share ideas with other like-minded youth from all corners of the map.

When he arrived in Whitehorse five years ago, he founded Teenage Life & Young Adults International, a group that encourages young people’s leadership skills. While officially organized by TELIYA, the music festival isn’t a fundraiser or awareness night – it’s just part of Boniface’s natural enthusiasm for getting different

cultures into the community spotlight.

The festival’s headliner this year is Ghanaian Brian Quaye, a talented musician and producer, adept with any instrument put before him. Currently residing in Calgary, Quaye plays traditional Ghanaian music with a modern flair.

Trinidadian-born Becky Law brings her smooth, soulful voice to the stage along with her husband Brent’s talent on guitar and keys. With music resting somewhere on the spectrum between smooth jazz and soulful gospel, the duo performs with an understated strength that is typical of traditional African spirituals. Local singer/songwriter Roxx Hunter will join the group, adding his wide range of musical talents to the mix.

In addition to organizing the event, Boniface is also performing in it alongside his occasional musical partner Ssasi Traore, who is originally from Mali. The two will team up to get the crowd moving to the sounds of bongo flava. With the music sung mostly in Swahili,

the artists will be sharing the messages of the songs. “There is a lot of meaning with our music. You may not understand the language… but we explain.”

Bongo flava, which has often been compared to American R&B or hip hop, has both meaning and rhythm.

“You can feel the beats,” says Boniface. “It’s easy to dance, easy to follow the music.”

And while music is front and centre, food will play a big part at the festival, with African dinner being served for an extra five dollars. Cuisines from across Africa as well as the Caribbean will feature in the feast. One dish, pilau, a fragrant rice casserole that appears on Kenyan and Tanzanian tables whenever a celebration comes around, is an East African favourite.

Boniface points out that a meal like this one only comes to the Yukon every so often, so rather than taking in a meal at a typical Whitehorse establishment, he recommends trying out something new.

“We’re going to make food which has a really fresh taste,”

Boniface says. “It’s different than the food that people eat every day.”

Hoping to boost numbers from the previous events, Boniface decided to move the venue to the Kwanlin Dun Cultural Centre from the 2-0-2 Motor Inn. Not only does the cultural centre have a larger area (more room to shimmy!), but it’s also more family-friendly which is a key switch, says Boniface.

The bigger hall will also hold a craft market with beadwork, ethnic jewelry, and other curios imported from Africa.

The cost of renting a flashier venue and flying in musicians takes its financial toll, but Boniface managed to secure government funding for the event from the City of Whitehorse and the Yukon Arts Fund.

Boniface thinks the cost will be worth it, and hopes to build on the moderate success of previous years.

“Always people enjoy the food, the music, the connection. That’s why we keep doing it.”

Retired NBA star Steve Nash developing basketball drama with CBC TV Cassandra Szklarski Canadian Press

TORONTO etired NBA star Steve Nash is teaming up with the CBC to develop a one-hour drama set at an elite basketball academy.

The B.C.-bred athlete says the proposed series would revolve around the teens, parents, coaches and administrators at a Toronto-area school, and the unique trials young athletes face as they seek superstardom.

“It’s a really incredible backdrop to create characters and create storylines that are really relevant, authentic and I think exciting for audiences,” said Nash in a recent call from Los Angeles.

It’s tentatively titled Hardwood, with Nash working behind-the-scenes as an executive producer.

The former point guard said he doesn’t expect to appear on camera, but he saw lots of opportunity to invite NBA pals to make cameos.

“I think it’d be great – we have so many Canadian NBA players now that it’d be a lot of fun to have them get involved, so that’ll be something that we definitely would be excited to do.”

Nash said the project is still in a very early stage of development with scripts currently being written.

Hardwood is being executive produced by Insight Production’s John Brunton and Barbara Bowlby, the Toronto-based team behind The Amazing Race Canada and Big Brother Canada.

Nash said he envisions stories could delve into the intense pressures young players face and the “shady” dealmaking that can emerge around them – something he has firsthand knowledge of.

Since leaving the game earlier this year, Nash has indulged his passion for film and television through his company, Meathawk Productions. He said his interest began 20 years ago when he became “a bit of a cinephile.”

“And then initially I made a short for Nike and I was kind of hooked,” said Nash, who codirected a documentary about Terry Fox for the ESPN series 30 for 30 in 2010.

“Eventually (I) made a bunch of digital content for brands, did a 30 for 30 for ESPN, another doc for ESPN, and actually also was involved in a couple of … web series, so it was a fairly natural

Nash said the basketball business has changed a lot since he was a teenager, noting that social media has made everything “so much more immediate and public.”

“They just put a clip on YouTube and text it back and forth to a coach or a recruiter, and the same goes for their behaviour – they get caught out doing something, the whole world knows about it right away instead of it being just some little secret. It’s just a heightened environment and very difficult,” said Nash, whose 19-year career with the Phoenix Suns, Dallas Mavericks and Los Angeles Lakers included eight all-star appearances, seven nominations to the all-NBA team and consecutive MVP awards.

He’s now the general manager of Canada’s men’s national team.

“It becomes very tricky for these kids to land on their feet and to get through all this stuff unscathed.”

Woman abandoned by date can make it home on her own

MANNERS DEAR MISS MANNERS: A fraternity formal dance that I attended ended with me cabbing home, alone, and without warning.

After a young man asked me to the dance, I was so looking forward to having a fun time with him and my three best friends, who were also attending with dates. At the dance, my date became so drunk that he retreated to the men’s bathroom with my friend’s date.

After he left to recover in the bathroom, I was still hoping to salvage part of the night with my three best friends. However, all they did was complain about the missing young man who was attending to my date in the bathroom. It was spoiling the night and making me even more uncomfortable, so I proceeded to just stand outside the men’s bathroom and demand that my date call a cab back to his apartment where he could be properly watched over by his friends.

After the missing young man returned to my friends, the crew, instead of showing compassion by including me in the conversation, ignored me and abruptly walked off to dance without me, leaving me sitting at our dinner table alone. I figured that my presence was unimportant to them, and called a cab for myself.

They didn’t realize I was gone for a half hour, and when we spoke briefly the next morning, they casually said that they would have accompanied me home had they known I was leaving.

Even though my date had the good sense to apologize profusely and take me on another date to make up for the lost time, my “best friends” didn’t have the courtesy to apologize for excluding me.

Was I expecting too much? Was I in the wrong to assume that people have a responsibility to include and be compassionate toward an abandoned date? Was I wrong to leave without warning? Miss Manners, I was so hurt by their actions that I have been giving them the cold shoulder ever since. Please tell me if I was wrong in any way.

GENTLE READER: That you easily forgave the person who got drunk and abandoned you, but hold a grudge against those who did not drop what was left of their evening’s enjoyment to attend to you, worries Miss Manners.

It smacks of the common attitude that females are responsible for poor behavior on the part of males — for example, when a lady forgives her husband for breaking his marriage vows while vilifying his partner, who was under no such obligation to her.

Your friends did recognize that your date was in possible danger from his drunkenness and took care of him. You were upset, but capable of taking care of yourself, as in fact you did.

Miss Manners agrees that it would have been nice of them to express sympathy. But she hardly thinks that they were obligated to give up their evening to see you home, when you were able to do that on your own. Please save your indignation for the person who actually did ruin your date.

You may certainly have a party to celebrate both occasions, but if you are not fishing for presents (and let us assume in good faith that you are not), do not advertise it as such. Simply have a party.

Presumably, your friends will know that this is a new house if they have not visited you in it before — and can bring presents if they like. And if you like, you may modestly toast your husband’s birthday at the party. But please do not solicit gifts for either occasion, let alone both.

DEAR MISS MANNERS: An employee my office just hired was nice enough to start with, but very quickly I began to notice that she was oversharing personal information about herself and her family.

I would just brush it off and change the subject, but then she began to include me in her problems. If she complained about her weight, she’d say I must feel the same way about myself. If she complained about her age, she’d say I must feel the same way, too.

If she wants to degrade herself, that’s her problem, but I do not want to be included. I’ve tried being cordial and keeping my distance, but today I found out that she’s complaining to others in the office that I’m not friendly to her. They tell me she’s been asking them what my problem is!

Help! I wouldn’t want my problems blabbed all over the workplace, but I don’t want her complaining about me, either. My life isn’t perfect, but I don’t put myself down. How can I get her to stop?

GENTLE READER: The way to prevent her from telling others about your problems is, as you correctly surmised, not to tell them to her. Perhaps looking sympathetic and saying, “No, not really,” when she turns to you, would help. This unsatisfactory but polite response should solve the problem of her oversharing.

That leaves only one problem for Miss Manners to solve: how to get her to stop complaining about you. The next time someone passes on one of her complaints, explain that she seems nice, but you hardly know her and don’t feel that you can deal adequately with her neediness.

DEAR MISS MANNERS: What is the proper response to someone who says, “It’s about time!” when told that a family member is expecting a baby?

GENTLE READER: “Why? What time is it?!”

DEAR MISS MANNERS: Is it tacky to have a combo themed party? My husband is turning 40, and we just bought our first house together last month. We would like to “kill two birds with one stone” if it’s proper etiquette. If it is allowable, which of the two is more important as far as the invitation is concerned?

GENTLE READER: Well, which one will get you more presents?

DEAR MISS MANNERS: After my summer birthday, I mailed my thank-you notes for all the gifts I received. And because I had purchased too many stamps for last year’s holiday cards, I have been using the surplus postage for the past few months so as to not be wasteful.

Imagine my chagrin when a few thank-you note recipients gently chided me for using poinsettia stamps in the summertime. Miss Manners, was it in poor taste for me to use “seasonally inappropriate” stamps for my personal correspondence?

wo schools gobbled up all the medals at the Yukon Schools Athletics Association’s Grade 8 Volleyball Championships at Porter Creek Secondary on Saturday.

The F.H. Collins Warriors and the Vanier Crusaders – which were each split into two teams in both the boys and girls divisions – played each other in the two gold medal matches and bronze medal matches.

The Warriors “black team”

defeated the Crusaders “blue team” 25-15, 25-18 in the girls final for gold.

“They were really focused.

They really pulled it together,” said Warriors head coach Barbara Hinton. “Every single thing we practiced, they did in the clutch moments.”

“The girls worked really hard to be together as a team,” she added. “We focused on positive attitude and leadership. It’s not just about volleyball, it’s about supporting each other and I think they came a long way doing that. Even in the hallways they’re friends and support

each other.”

The Warriors jumped out to an early 5-1 lead in the final with Zoe Sage logging three kills in the opening points.

They eventually reached set point on a crafty tip from Kiarra Fitzsimmons and took the set on an unreturned serve from Emily Nunez.

The Warriors had a tougher time pulling away from the Crusaders in the second but eventually established a sevenpoint lead at 19-12 on an ace from Sage.

Poleman, who then fired in the game-winning serve for the title.

Poleman went on to be named tournament MVP, which she really wasn’t expecting.

“I didn’t know there was such a thing as an MVP award,” she said. “It was surprising for me.

“It was a fun time. I can’t wait for next year.”

“We were looking at playing ability as well as leadership and through the tournament she had a really positive attitude as well as playing strong,” said Hinton. “The other coaches noticed it as well. There were a lot of strong players, so it was a tough decision.”

The Warriors black team almost went undefeated at the championships. Their only loss came against Vanier’s blue team on Friday.

“Yesterday we had a lot of games, I think we had four be-

fore, and we were really tired by the end,” said Poleman. “And I don’t think we were that positive yesterday. We were kind of feeling down. We brought up the energy today.”

The Warriors gold team took bronze with a 25-20, 15-25, 15-9 win over the Vanier white team.

“We had 30 girls come out to tryouts and we ended up with about 26 core girls,” said Hinton. “Halfway through the season we switched it, so they’ve been playing as a team for the second half the season.”

In the same match up in the boys final, things went the other way.

The Vanier blue team nabbed gold with a 26-24, 25-9 win over the Warriors white team.

“They lost two matches in the tournament, but that was at the beginning and they built on that and every game they

After a nail-biter first set that went into extra points, the Crusaders stormed away with the match in the second. Vanier’s blue squad won 10 straight points to go from 3-3 to 13-3 on a winning serve from Adam Hennings. They reached match point at 24-6 on a first-hit kill from Chris Farkas.

A few points later Andrew Reid put an ace down the line to seal the deal. Reid was named tournament MVP by his teammates.

“I was asked to give one and I said every player was an MVP

to me because they all contributed through the whole tournament,” said Stoker. “I had a hard time picking an MVP so the team came together and chose one of our newest players. At the beginning of the season he couldn’t serve, he had a hard time passing, and he was the one who serve the final ace to win the gold medal match.

“So the team picked him as the MVP and I couldn’t be more proud. They’re amazing.”

Vanier attained set point in the first on a kill from Thomas Janzen, but the Warriors caught up at 24-24 on a shrewd tip from Austin Shaw. The Crusaders earned another set point on

a serve from Farkas before the Warriors missed on an attack to end the first set.

“The boys put a lot of pressure on themselves and they lose focus of what’s important in the game,” said Warriors head coach Mattaeus Geisler.

“They seem to turn a switch and are dwelling on what’s going wrong instead of focusing on moving forward and what they need to do. That was the big difference between the first set and the second set.”

It was the rink’s fourth WTC event of the season, but the first in which they rink advanced past the round robin.

“We finally broke through this year,” said Scoffin, 21, the team’s skip. “We’ve struggled a little bit and we’ve obviously played against a lot of really high caliber teams. So this weekend we finally figured it out, got on a roll and it kind of worked out for us.”

Team Scoffin was denied their first WCT title with a 6-2 loss to Calgary’s Team Thomas, led by two-time junior world champion skip Charley Thomas.

Team Thomas scored three in the fourth and two in the fifth to secure the win in six ends.

“They played a really good game,” said Scoffin. “We played well as well, we just didn’t get our rocks in the right spots sometimes and they really capitalized on our mistakes. Charley, their skip, made an amazing shot for three in the fourth end that we didn’t even think was there.”

Team Scoffin, which includes third Evan Asmussen, second Jason Ginter and lead Andrew O’Dell, produced five straight wins to reach the final.

A couple were lopsided – 8-1 over Korea’s Team Kim to start and

7-1 over Alberta’s Team Lizmore in the semifinal – and two were close – 8-7 over Alberta’s Team MacAlpine in the round robin and 4-3 over Alberta’s Team Park in the quarterfinal. Scoffin also defeated Team Konschuh of Alberta 5-2 to finish the round robin.

“We did a good job at controlling the scoreboard and putting ourselves in a good position to win,” said Scoffin of the one-point

Ont., beginning Wednesday.

“It’s obviously good to perform well right before a big event,” said Scoffin. “I’m feeling good about how I’m throwing so hopefully I can carry that momentum through to this week.”

The Edmonton-based Bottcher rink is currently ranked eighth in the world. Skip Brendan Bottcher won the junior nationals and junior worlds in 2012.

Scoffin will fill in for Bottcher second Bradley Thiessen who has committed to playing in a different event. Two years ago Scoffin played as alternate for Bottcher at the CIS championships.

Scoffn and the rest of Team Bottcher will begin the Grand Slam (which has a $100,000 purse) against Switzerland’s Team Michel on Nov. 11, Alberta’s Team Simmons and Ontario’s Team Jacobs on Nov. 12, and Sweden’s Team Edin on Nov. 13.

The bonspiel will be broadcast on Rogers Sportsnet.

Scoffin is currently in his fourth year at University of Alberta where he curls for the school’s Golden Bears team. Last March Scoffin and the Golden Bears claimed the Canadian Interuniversity Sport men’s curling title.

“I’m feeling good about how I’m throwing so hopefully I can carry that momentum through to this week.” wins. “All I had to do was draw to the four-foot for the win in both.

Whenever I’m looking at an open draw to the four-foot I’m pretty happy.”

His performance over the weekend is no doubt a good confidence builder as Scoffin prepares to hit the sheets in the biggest event of his career this week.

Mustangs thrash Juneau high school teams Tom Patrick News Reporter

T

hough the last three games were much closer than the first three, the Yukon Mustangs were largely in control of things over the weekend in Whitehorse.

The Yukon rep hockey club went undefeated in a six-game series against Juneau Douglas High School’s Crimson Bears, outscoring the Alaskans 45-4 with shutouts in three games.

Still the Crimson Bears, who brought their varsity and junior varsity teams, were glad for the competition, said head coach Luke Adams.

“These are our first games for the kids because we don’t have any other competition in our town,” said Adams. “We’re really thankful because in the early part of our season we don’t know what we have because we don’t have anybody to test against. So some of the results were a little lopsided, but that’s good for us because now we know what we have and what we need to work on going forward before we start our in-state Alaska competition … This is nothing but positive for our kids.”

Three Mustangs teams hit the ice for the friendly series – one more than expected. After three one-sided games, organizers shuffled up the teams to try and find balanced match-ups, bringing in the U15 Bantam Mustangs for a game Saturday. There was also some movement of players between the Mustangs teams.

The U16 Mustangs beat the junior varsity team 17-0 and the U18 Midget Mustangs beat the varsity team 8-1 on Friday.

The U16 Mustangs then went 7-0 junior varsity team Saturday morning.

The Midget Mustangs then downed the varsity squad 4-2 in the closest of the six games.

“That one had some intensity to it, which was nice,” said Mustangs program head coach Derek Klassen. “All the hockey I watched this weekend we were

The series ended with the U15 Bantam Mustangs beating the junior varsity squad 4-1 and the U16 Mustangs going 5-0 over the varsity team.

All games were two 22-minute stop-time periods.

“It’s always good to have those guys in and create those relationships,” said Klassen. “It’s a matter of finding the match-ups, what works, going forward if we want to have a home series here and home series there. It makes sense

for both teams to be around the same caliber for both teams to get what they’re looking for.

“But it was a good weekend.

It’s always fun for the team to play at home, at Takhini Arena and Canada Games Centre. It was certainly a bonus weekend for us with Juneau calling us up and asking us if they can come play.”

U16 Mustangs forward Mackenzie Benn-Wipp led his team in scoring in their three games with four goals and six assists.

Teammates Anthony Louie, Brett Walchuk and Dion Fowler all had three goals and five assists. Kyron Crosby stacked up four goals and

two assists.

Johnny Elias notched one goal and five assists.

Caleb Marsh, Nick Dobush and Ryan Troke each produced three goals and two assists in the Midget Mustangs’ two games.

Josh Austin, Wyatt Peterson, Oscar Sawicki and Lailem Letto each scored in the Bantam Mustangs’ 4-1 win. Kaelen Troke helped with three assists.
