hanges to the Yukon Nominee Program mean the public will know when a Yukon business has been banned for breaking the rules.

The territorial government announced yesterday names of employers banned from the program will be published on the Department of Education website.

The idea is to make the process more transparent, said Shawn Kitchen, the department’s assistant deputy minister of advanced education.

“Employers, knowing that they could potentially have their names listed and out there publicly, I think acts as a deterrent, which is absolutely critical to us as well.”

Starting Sept. 1, businesses that get banned from the program will have their business name and the length of their penalty put online.

But the type of infraction will only be listed as minor, moderate or serious.

High winds are likely to blame for a series of power outages on Tuesday.

The biggest occurred on yesterday morning, knocking out the power to 3,000 customers, according to Yukon Energy.

Things went dark just before 10 a.m. in Porter Creek, Crestview, Range Road and the Marwell Industrial area as well as parts of Hillcrest and downtown.

Everything was back up and running in about an hour.

“We suspect the outage was caused by a tree on one of our (Yukon Energy’s) lines, but won’t be able to confirm that until we can do an aerial patrol later this week,” Yukon Energy spokesperson Janet Patterson said in an email Tuesday.

“Winds are too high to safely do the patrol today.”

According to Environment Canada, wind at the Whitehorse airport at the time of the outage was gusting up to 53 km/hr.

Examples of serious violations would include paying inappropriate wages, giving an employee fewer than the minimum number of hours of work, or accepting payment to employ a worker, Kitchen said.

Moderate violations would include not making the required deductions from a nominee’s pay.

Minor charges could include not advertising for a job locally long enough.

Once a ban is over, an employer’s information will be taken off the website, he said.

The Yukon Nominee Program places prospective immigrants in Yukon businesses and gives them the opportunity to become permanent residents.

Since it started in 2007 only eight of the 240 businesses that have taken part in the program

have ever been banned, Kitchen said.

Having the information online will help potential foreign workers know which companies to avoid and it could impact other potential employees as well, Kitchen said.

“If Canadians see that these employers are banned from the program they might think twice about working for the employer as well.”

Aside from the new online information, the Yukon government has bumped the maximum penalty for breaking the rules from a three to a five year ban.

“It gives us more flexibility to deal with more serious infractions,” Kitchen said.

Rick Karp, president of the Whitehorse Chamber of Commerce, said the changes won’t affect the majority of Yukon businesses.

“If a business is following the rules and regulations there’s no impact, and for those who are not following the rules and regulations, they’re affecting the rest of us.”

On Tuesday evening another 1,800 residents near Whitehorse lost power from 6:30 p.m. until 7:45 p.m., according to ATCO Electric Yukon. Affected neighbourhoods included Whistle Bend, Lake Laberge, Kulan, Crestview and Mayo Road. A fallen tree is suspected to have knocked out a power line in this case, too.

In all, Yukon Electric responded to more than two dozen power outage calls on Tuesday night and Wednesday morning. Most outages only affected a handful of residents in rural neighbourhoods south of the city, according to the company.

Power had been restored to most areas by midnight, but technicians continued to work to work on repairing a fallen line at Gentain Lane this morning.

Old Crow is the territory’s only fly-in community and is also a “dry community.” Under the community’s liquor prohibition regulations the possession, consumption, production and importation of alcohol in any form is illegal.

According to an RCMP press release, after a tip from the public and help from the Dawson City RCMP, a 24-year-old man was stopped at the airport attempting to bring in six bottles of whiskey and four bottles of vodka.

In Old Crow the hard liquor has a value of approximately $6,000 or $10 per ounce., the RCMP says.

Police have not identified the man, who is now charged with possession of liquor anywhere in Old Crow and transporting liquor anywhere in Old Crow.

He is scheduled to make a court appearance in Old Crow on Nov. 24.

Federal candidates square off at CYFN forum Maura Forrest News Reporter

C

onservative Member of Parliament Ryan Leef spent time in the hot seat at a federal candidates’ forum hosted by the Council of Yukon First Nations on Tuesday evening, at one point inciting a chorus of loud boos from the audience.

Liberal candidate Larry Bagnell, NDP candidate Melissa Atkinson and Green candidate Frank de Jong joined Leef at the event. The forum was moderated

by Dave Joe, a lawyer who has worked as chief negotiator for the Council of Yukon First Nations.

The candidates responded to three questions about implementing treaty agreements, making government funding available to northern First Nations, and acting on Bill S-6, which made controversial amendments to the Yukon Environmental and Socio-economic Assessment Act. Atkinson said an NDP government would recognize First Nations’ inherent right to self-government and would work with the Land Claims Agreements Coalition to ensure treaties are respected.

Bagnell said the Liberal Party would commit $2.6 billion to First Nations education, $500 million to First Nations education infrastructure, and $50 million annually to support First Nations post-secondary education.

“All this, except what’s going to schools on reserve, is available to Yukon First Nations,” he said.

Conservative federal funding for First Nations education has largely been earmarked for on-reserve schools, and has therefore not made its way to the Yukon.

Bagnell, Atkinson and de Jong were all adamant in their opposition to Bill S-6, and said their parties would repeal the four controversial amendments.

De Jong called the bill a “cowardly betrayal by the federal government of the multi-stakeholder process that developed under the Umbrella Final Agreement.”

This, however, was not what got him booed. That came later in the evening, when the floor was opened to questions from the public and someone asked about the parties’ positions on electoral reform.

“It’s not perfect, but people at least understand the system we have right now,” Leef said. “And if you change that in haste... you run a very deep risk of confusing Canadians about what it actually means when they cast a ballot.”

The audience was largely unimpressed.

Bagnell said that under a Liberal government, the next election will not be first-pastthe-post. De Jong suggested a preferential ballot system, where

voters rank candidates, would be best for Canada. Atkinson said the NDP is committed to proportional representation.

Another question focused on the long-gun registry, an issue on which all four candidates seemed to agree. Leef, Atkinson, Bagnell, and de Jong all said they do not support the registry. Both the Liberal and NDP parties have said they will not reinstate the registry.

Leef, however, cast doubt on the Liberal and NDP commitments, reminding the audience that Bagnell voted to save the long-gun registry in 2010 after publicly criticizing it.

“It’s not credible and it’s not believable. If the Liberals come back, the long-gun registry comes back, and (Atkinson) would be put in a very difficult position because the NDP would do the exact same thing,” he said.

Leef also claimed the Conservatives are the only party that has

made concrete commitments specific to the Yukon, and accused the other parties of touting federal policies that Yukoners will pay for, but not benefit from.

As examples of his party’s targeted commitments, he listed the Conservative government’s recent announcements about a Canadian Armed Forces reserve unit for the Yukon and a new cadet facility in Whitehorse.

But Leef again found himself in the minority when asked about an inquiry for missing and murdered aboriginal women.

Bagnell and Atkinson both said their parties would stage an inquiry, with Atkinson pledging her party would launch an inquiry within 100 days of being elected.

Leef pointed out that he was the only Conservative MP to vote for an NDP motion to launch an inquiry, but said there’s no single solution to the problem of violence against indigenous women.

tions Grand Chief Ruth Massie, Kwanlin Dun Chief Doris Bill, and Ta’an Kwach’an Council Chief Kristina Kane all spoke at the forum, and their message was clear: get out and vote.

“This election... is very, very crucial for Yukon First Nations going forward,” said Massie. “And we, as First Nations, are making a lot of efforts in getting our citizens to the polls.”

Bill pointed out that 25 per cent of the Yukon’s population is indigenous, and First Nations people could sway the vote in the territory if they vote in large numbers.

“I ask every First Nations citizen in the territory to get out and vote,” she said. “Vote early if you can. And assist those who need to get to the polls – your elders, your families, and your neighbours.

City council pledges to act on TRC recommendations Myles Dolphin News Reporter

W

hitehorse Mayor Dan Curtis says he will do whatever he can to promote and implement the Truth and Reconciliation Commission’s recommendations.

Curtis spoke to a large crowd of politicians and First Nation representatives during a special city council meeting on Monday evening, held to formally acknowledge and recognize the report.

“This report has teeth but it doesn’t bite,” he said, holding it in the air.

“For all of you here, especially the elders who have suffered

for so many years, I’m sorry, I’m sorry, I’m sorry that it’s taken this long. This is a phenomenal piece of work that I think every Canadian should read.”

Released in June, the report makes 94 wide-ranging recommendations to repair the relationship between Canada’s indigenous and non-indigenous peoples.

Members of council unanimously passed a motion on Monday evening to direct city administration to “review and act on, where possible, the recommendations that have a potential role for municipal governments.”

While most of the calls to action are aimed at the federal government, Curtis singled out

a few of the recommendations that indicate a role for municipal governments.

No. 82, for example, calls for a publicly accessible, highly visible residential school monument in each capital city, to honour survivors and the children who were lost to their families and communities.

Curtis, who is travelling to Yellowknife, N.W.T. on Oct. 1 to promote Air North’s service between the capital cities, said he’d bring the idea up with mayor Mark Heyck. “(The motion passed) in terms of giving administration marching orders to see if we can make that happen, working with First Nations and seeing what they

think would be appropriate to have.”

No. 41 calls on the federal government to launch a public inquiry into missing and murdered aboriginal women and girls.

At a June meeting last year, Whitehorse city council threw its support behind the inquiry.

The federal government has consistently rejected appeals for an inquiry.

Curtis said the city has also been respecting No. 92, which calls on the corporate sector in Canada to commit to meaningful consultation with indigenous peoples before proceeding with economic development projects.

“We consult with them before any project that goes forward in

the City of Whitehorse,” he said.

Curtis said he had been “somewhat silent” about the final report and wanted to try to make up for it.

“I was trying to show our First Nations there are some things that are specific to municipal governments, and those are the ones I’ll take responsibility for,” he said.

Councillor John Streicker said the Association of Yukon Communities, which met last weekend, also passed a similar motion.

“It’s very timely,” he said, noting the annual Sisters in Spirit walk takes place this Sunday.

Fraser Institute blames courts for mining slow-down Maura Forrest News Reporter

C

ourt decisions around First Nations land claims and consultation are creating uncertainty and discouraging investment in the Yukon’s mining industry, according to a new report from the Fraser Institute.

The report, released last week, says court cases like the recent challenge of the Peel watershed land use plan show that Yukon courts are going beyond the terms of modern treaties and imposing “unforeseen obligations” on governments.

It includes data showing that more and more mining executives see uncertainty around land claims as a deterrent to investment in the Yukon. The data was taken from the institute’s annual survey of mining companies, which has seen the Yukon drop in the ranking for investment attractiveness over the last two years.

Malcolm Lavoie, a visiting assistant professor at the University of Alberta’s law faculty and a co-author of the report, said the increasing uncertainty is linked to the way the Yukon’s modern treaties have been interpreted.

Eleven of the territory’s 14

First Nations signed final agreements between 1990 and 2006, and are now self-governing.

Lavoie pointed to the Little Salmon/Carmacks First Nation court case settled in 2010, that found the duty to consult can extend beyond what is laid out in treaty agreements. He said that case established a precedent for courts requiring more from the government than what is specified in the treaties.

“There isn’t great cause to go beyond (the treaties),” he said.

“It isn’t like it’s necessary to go beyond the terms of a treaty like this to protect aboriginal rights.”

He also referred to the Peel watershed case, which he said might have had a different outcome if the court had adopted “a stricter mode of interpretation” of the treaties.

He refrained from saying whether or not he believes the government should have done more to consult with First Nations before introducing its land use plan, but said that’s not really the point.

“There’s a distinction between what a government should do and what it’s obligated to do,” he argued. “My sense of the decision is that what the government ultimately did was something it was entitled to do under the agreement.”

The report suggests that First Nations and the government should stick more closely to the terms laid out in the final agreements to keep future matters out of the courts and to increase investor confidence in the territory’s mining industry once again.

“If you take an approach that holds parties in strict terms... that allows the First Nations also to have certainty,” Lavoie said.

“Certainty benefits both parties.”

But Ken Coates, a professor of public policy at the University of Saskatchewan, said the Fraser Institute report takes a very “short-term view” of mining in the Yukon.

panies can work,” he said. “It’s a little bit of uncertainty in an environment where there was a lot more uncertainty before.”

He said treaties establish the minimum that governments must do to respect the rights of First Nations, and were not meant to address every eventuality. “If treaties are going to be narrowly interpreted to reflect the world as it was in 1993, we’ve got a problem.”

Coates said it’s to be expected that First Nations will do what they can to protect their rights, including testing them in court.

He argued that anyone else would do the same.

“I get kind of frustrated, because (the report) sort of has this impression that if First Nations would only back off... we’d have this mining nirvana in the Yukon.”

Yukon lawyer Stephen Walsh agreed that the court has an important role to play in clarifying rights and responsibilities under the final agreements.

Walsh represented the Ross River Dena Council in a 2012 decision when it won the right to early consultation before mineral claims are staked. That case was also listed in the Fraser Institute report as another example of increased uncertainty from a court decision.

But Walsh questioned the whole premise of the report, which he said has a “sky-is-falling quality to it.” He said he’s not sure that treaty obligations are discouraging investment at all.

“I don’t take everything that the Fraser Institute says as gospel,” he said. “(Mining companies) don’t seem to be scared away by having to consult with First Nations.”

Instead, he blamed declining commodity prices for the slowdown in investment.

Janet Lee-Sheriff, chief executive officer of Golden Predator Mining Corp., also dismissed the report’s conclusions.

“I don’t agree,” she said. “First Nation relations are not the reason for lack of investor confidence in the Yukon.”

She referred instead to a global decline in the mining sector, and said the Yukon was shielded from that decline for a few years because of the discovery of the White Gold deposit north of Dawson.

But now, she said, investors are very cautious with their money. “They want to see really good economics. And that, to me, is one of Yukon’s challenges: how to compete with jurisdictions that don’t have as much distance to market.

“It’s my strong belief that First Nations relations and First Nations issues are not a factor.”

About 15 minutes later a second call came in, this time about a crash in the Yukon Centre Mall parking lot outside of the liquor store, allegedly involving the same vehicle.

When police got there the driver had left, according to a news release.

Whitehorse RCMP later spotted the suspect vehicle travelling on Long Lake Road.

When officers tried to pull the vehicle over, the driver didn’t stop, the release says. Police followed him to his home where he was arrested.

Fifty-year-old Jeffrey Yip, who also goes by the name of Jeffrey Bone, is facing multiple charges, including impaired operation of a motor vehicle, failing or refusing to provide a breath sample, dangerous driving, driving while disqualified and flight from police.

he mayoral race in Whitehorse is getting an injection of youth for the second straight election.

Mandeep Sidhu, 30, is running for the top municipal spot once again.

Sidhu, who received 480 votes in the 2012 election, is up against Wilf Carter and incumbent Dan Curtis.

He said he doesn’t see his age or lack of experience on city council as a disadvantage. “My plan all along was to wait and see who the (mayoral) candidates were,� he said, “and I wasn’t going to submit my papers if I saw a strong candidate running. “For the past three years with Dan Curtis, I don’t know what he’s done. I don’t think he’s the best individual for inter-governmental relations.�

Sidhu said he has the right work ethic for the demanding position of mayor and is willing to be “more cordial� when developing relationships with other levels of government. “I put in hours that people can’t believe,� he said, adding that he manages the family’s laundromat on Fourth Avenue and helps out at his father’s business, Sidhu Trucking, with

Sidhu said he also wants the city to communicate better with its older residents, who may not have access to the Internet.

Without computers, they aren’t able to stay up-to-date with decisions made at city council, he added.

The solution to that would be to communicate the old-fashioned way – with flyers. “Or you could set up a special phone number where people could call and take a survey on an issue,� he said.

Sidhu graduated from the University of Victoria in 2010 with a double major in English and political science.

Shoeless prisoner who fled courthouse remains at large Ashley Joannou News Reporter

R

CMP are still looking for a man who escaped shoeless out the front door of the Whitehorse courthouse Saturday morning.

Police say Richard Linklater was appearing in court around 10:45 a.m. on charges including robbery and failing to comply with a probation order when he got away.

“Mr. Linklater was seated with his lawyer, and being addressed by the justice of the peace when he fled on foot,” Whitehorse RCMP spokesperson Const. Julia Fox said in an email.

Linklater was “last seen leaving on foot, through the front doors of the courthouse, on to Second Avenue,” according to a news release.

Extra officers and a police search dog were called in, but could not find him.

Police say the 33-year-old may pose a risk to safety, and the public should not approach him, but to call 911 immediately, if they see him.

He is 5’9”, and was last seen wearing a grey hoodie and dark pants.

Canadian law requires that after someone is arrested, they appear before a judge or justice of the peace within 24 hours before they can be ordered to jail.

Weekend court appearances in the Yukon are less busy than the kind you would experience on a weekday.

The building would likely have been mostly empty when Linklater got away. The court services office, law library and Family Law Information Centre are all closed on the weekends.

Court sheriffs don’t handle appearances on the weekend.

reasons we won’t be commenting on the specifics of the procedures that are used. Our main concern at this time however, is

getting Linklater back in to lawful custody.”

Linklater has a long criminal record. Most of his recent convictions have been for propertyrelated crimes like theft, and break and enter.

A 2008 Yukon Territorial Court decision says the then-26-yearold had already accumulated 50 charges on his criminal record.

In that decision the judge notes that the bulk of the charges were for property-related crimes until a 2001 robbery and in 2004 when he was convicted of attempted armed robbery, armed robbery and assaulting a peace officer.

Linklater has done penitentiary time on at least two occasions in the past, the judge from 2008 said.

Anyone with information on Linklater’s location is being asked to call RCMP at 667-5555.

Workers’ compensation board will give $10M back to employers Myles Dolphin News Reporter

he Yukon Workers’ Compensation Health and Safety Board is giving $10 million back to Yukon employers by the end of the year.

It’s part of the board’s plan to reduce its compensation fund’s excess reserves, which sat at $52 million as of last December.

The board is also lowering assessment rates by between two to 15.7 per cent next year.

The compensation fund has more money than it needs, said board members at a news conference last Thursday.

All Yukon employers pay into the fund. About 21,500 employees were covered last year.

The rate group comprised of employers who build, repair or demolish buildings, and those involved in concrete construction, including masonry and bricklaying, will benefit from the 15.7 per cent decrease in assessment rates, said WCB spokesperson Becky Striegler.

The total cost of caring for every Yukoner injured on the job to date was estimated at $138 million as of last year, according to the WCB’s website. The board aims for a funding target between $167 million to $178 million, a contingency that protects against “extraordinary

workplace calamities and stock market fluctuations.”

As it stands, the cost of running the compensation system is roughly $2.30 per $100 of payroll.

Next year, the average assessment rate will be $1.85 per $100.

The board plans on reducing the excess reserves over the next four years, so “employers gradually shoulder the true cost of the system each year.”

As of 2014, the board’s investments were valued at $215 million.

For the past several years, those investments have been doing remarkably well. They’ve had an average return of 9.3 per cent per year, which has largely contributed to the excess reserves, according to Striegler.

Another contributor was the

decrease in total claims expenses, from $26.3 million in 2013 to $17.7 million last year.

The board’s funding policy mandates it to return excess reserves to employers, or to charge them more when the fund drops below its target amount.

The board is examining ways it can re-invest some of its funds into injury prevention programs, according to its website.

Last year, five workers died in the territory, and another 435 were injured badly enough to require time off from work.

That’s up from 419 in 2013, according to the board’s 2014 annual report.

board of directors,” said board chair Mark Pike in a news release.

“It runs counter to the spirit of the compensation system, which rewards success in injury prevention.”

Whitehorse Chamber of Commerce President Rick Karp said the board’s decision to give some of the surplus back to the business community is in line with other jurisdictions across Canada.

A large portion of the $10 million will be going to the Yukon government, as the territory’s biggest employer. Karp said he hopes the money goes towards funding workplace safety programs.

The board is currently working on a way to distribute the $10 million by the end of December.

Francophone media a hot topic at French-language candidates’ forum Maura Forrest News Reporter

T

he future of Canada’s francophone media, including Whitehorse’s L’Aurore boreale, was a central issue at the French-language candidates’ forum held at the Coast High Country Inn in Whitehorse on Saturday.

Many francophone community newspapers have been tightening their belts in recent years, due in part to a decline in federal advertising. Increasingly, the government has chosen to advertise online and on television, instead of in community papers.

Conservative incumbent Ryan Leef, Liberal candidate Larry Bagnell, and NDP candidate Melissa Atkinson attended the forum, hosted by the Association franco-yukonnaise. Green Party candidate Frank de Jong did not attend.

Atkinson and Leef both made commitments to advertise in L’Aurore boreale if they were elected. “Once I become a member of parliament, I’ll make sure I advertise in there and make communications with the francophone community,� Atkinson said.

Leef said he has advertised in the paper and would continue to do so if re-elected. But he also said media is changing, and he’d like to work with the newspaper to further develop its online presence.

Bagnell didn’t make a firm commitment to advertise in the paper. But in response to a question from the audience about protecting French-language media more broadly, he said his party would increase annual funding for CBC/Radio-Canada by $150 million, and would also increase funding for Telefilm Canada and the National Film Board.

hen a Yukon mine is up and running it is often assumed to be extremely beneficial for local employment.

And let’s make no mistake, it often is. If a rural Yukon community has a population of 300, and if 30 people get jobs on a mine site, it’s a huge economic injection into the local community.

It must be noted that the jobs available in the mines can require quite specialized skills, and this can limit the number of local hires.

It is also the creation of jobs in regions that cry out for them. In communities outside of Whitehorse there tend to be fewer employment opportunities available. This is all well and good, but it takes more than 30 people to run a mine. So where do all the other employees come from?

According to a report done in 2013, back when there were three operational Yukon mines, 67 per cent of mine employees were not Yukon residents. That’s right, twothirds of the direct mine work force came from Outside. “Currently there are approximately 468 employees at the three operating mines and 156 identified contractors listed for the Wolverine mine. Of this combined amount of 624 identified positions, 417 or 67 per cent, are currently filled by labour based outside of Yukon,� states Ecofor’s report, Exploring Residency in Yukon, by J. Herkes, J. Mooney, and H. Smith.

Now this is not necessarily a bad thing, especially if you’re one of the workers with a job.

But this statistic must be taken in context of the amount of infrastructure costs that Yukon pumps into mine-related development, and the resulting tax dollars that are often used to clean up the mining mess that is commonly left behind.

Examples of infrastructure costs typically paid for by taxpayers and ratepayers are highway upgrades, power lines, and cheap electricity from the publicly owned energy utility.

Clean up costs are all around us, from Faro to Keno to Wolverine. The cleanup at Faro will cost a billion dollars of taxpayers money.

If one factors in the amount of taxpayer dollars spent on mines, and the fact that only one-third of the jobs go to Yukoners, one wonders if the taxpayer dollars are bet-

ter spent on more sustainable and environmentally friendly occupations.

Forestry, agriculture, tourism, arts, outfitting and housing construction are all worthy endeavours suitable for receiving those tax dollars currently being spent on mineral extraction.

They would all employ Yukoners and some of these occupations are not as dependent on the boom and bust cycle that characterizes mining. And most of them don’t leave the industrial-sized mess that mining can leave.

Of course it would mean that Outsiders would no longer be able to get jobs in Yukon mines, but why should Yukon taxpayer dollars and the Yukon environment be sacrificed for their benefit?

To build a sustainable economy in the Yukon means creating wealth that stays within the Yukon.

Mining can even have a negative impact on other occupations. Imagine if there was development within the Peel watershed.

It would eradicate wilderness tourism occupations, not to mention the ecological value of the region.

Now that is not to say all mining is bad. The Yukon gets a lot (and we’re talking about a billion here) from the federal government every year, and perhaps an argument could be made that this is the way the Yukon repays.

Resource extraction in the Yukon benefits the Canadian GDP as a whole, assuming one is into the “bigger is better� philosophy.

If two-thirds of the mine workers are from Outside, one assumes they are paying taxes in another Canadian province or territory.

That’s all very good and well, but it doesn’t exactly help the Yukon bank balance, even if it does enrich some other jurisdiction’s coffers.

It is important to remember that the Yukon government gets very little in the form of mining royalty income.

In 2013, Yukon received just under $18,000 in placer mining royalties. And in the same year the Selkirk First Nation got $215,773 in hard-rock mining royalties.

The Yukon government didn’t get any hard-rock mining royalties that year.

So it might be prudent to get some money from the Outside mine workers.

The Northwest Territories has found a way to address this issue, and that’s through a payroll tax.

Anyone who works there pays a two per cent tax of their paycheque to the government. At the end of the year, if they file their taxes in the Northwest Territories, they get some of it back.

However, if you work in the N.W.T. but don’t reside there, as is the case for a lot of the diamond mine employees, you don’t get it back.

In this way, the territorial government gets a bit of cash from non-resident workers. And it also rewards those who either are resident or choose to become resident in the N.W.T. A similar tax is applied in Nunavut.

Mining can bring benefits to local communities, but those who promise a job bonanza often fail to mention that most mining jobs go to Outsiders.

Factor in the fiscal cost of infrastructure, the potential for environmental damage, the abysmal royalty regime and the possibility that taxpayers will have to pay to close and remediate a mine site: these costs of mining call into question the value of those few local jobs.

Mining, when done right, can be a benefit. It just might not bring as many jobs with it as the promoters would want us to believe.

Misread political polls at your peril

W

e live in a world where anything potentially dangerous usually carries a warning label. So why are public opinion polls published by news organizations without any words of caution?

Readers should be warned, at a bare minimum, that “these poll results should be interpreted with caution. Users should understand how margin of error and random sampling operate prior to drawing any conclusions.”

Since pollsters can’t poll everyone they have to take a sample of the population. That means asking a number of people which candidate they plan to vote for or where they stand on a particular issue and then extrapolating those numbers to the entire population.

Polling actually works surprisingly well. It has been shown

that you don’t need that big of a sample size before you start getting results that are pretty close to the actual numbers. Even with just a thousand respondents in a country the size of Canada – a country of 33 million people – you can predict where the public stands to within about three percentage points (19 times out of 20 – I’ll come back to that).

That’s actually pretty impressive if you think about it.

Perhaps counterintuitively, polling smaller populations is more difficult than polling large ones. You need to poll a much greater percentage of the population to achieve the same margin of error for a small population than a large one.

For example, that Ekos poll released last week purporting to show a Liberal lead here in the Yukon had only 497 respondents – or about 1.5 per cent of the total population – yet had a pretty wide margin of error of plus or minus 4.4 per cent. The same firm’s national poll of about 2,343 respondents – or about 0.0071 per cent of the Canadian population – carries a margin of error of only two per cent.

And margin of error – particularly of the size we saw in that Ekos poll of the Yukon – can make a huge difference. You

have to keep in mind that that margin applies to each candidate. So not only might candidate A be several points lower than advertised, but candidate B might also be several points higher – making it either a much tighter race or a more comfortable lead than it might appear.

With that in mind, Yukoners should be cautious in interpreting the results. It is not that the poll results are meaningless – just that any candidate could be as much as 4.4 per cent higher or lower, which is a lot when the three main parties are separated by only 12 percentage points.

And that assumes that the poll wasn’t an “outlier.” Polling is based on the assumption that the sample was representative of the overall population. But that’s not always the case.

Countless factors can skew your poll, and most mainstream pollsters are pretty good at controlling for those factors. For example, using the phone book to select poll respondents is no longer a useful method because there are so many cellphone-only households that wouldn’t be selected. (Contrary to popular opinion, pollsters do now call cellphones.)

But even a perfectly designed poll can be an outlier. It turns

the exchange of ideas and policy positions that inform us, strengthen our civic IQ, and, hopefully, encourage us to get out and vote. Sure, perhaps a little “tempered” personal poke or two is OK, much like a good political cartoon, but hitting below the belt is not.

If Jim knew anything of me at all he would know that my heart is hot, not cold, for my family, my community, my country and my Lord. He would know that I care about people and that I don’t hate anyone.

He would know that my letters are born of genuine desire to contribute positively to issues of the day by presenting other perspectives.

He would know that I support the Conservative Party because I believe that at present it still remains the best choice for the governance of our country, even though like many, I do not agree with all of their policies and am not happy with some of their antics. And he would know that I am vulnerable and fallible too, even when I am trying my best to get things right and do good. He should also know the occasional “slip” does not indelibly define character.

But all that is of no account, because Jim put on his high hat and his six guns bent for character assassination. Best be careful, Jim, that you do not wind up becoming that person you so revile and “exposing” yourself instead of me.

Of course we are all human

and prone to quick judgements, errors and emotional outbursts, whether verbal or from the tip of our pens, but if followed by an apology that ought to end the matter.

Jim, although it was not my intent to offend anyone, it seems I have offended you, so I take this opportunity to apologize. Perhaps you might also feel inclined to apologize to me, but whether you do or not, I forgive you.

That’s what Jesus would do.

out that pollsters reserve for themselves the right to the occasional mulligan, which is what the whole “19 times out of 20” business is all about. Even the best pollsters will be off by more than advertised about five per cent of the time.

Last week the Toronto Star blared “Conservatives swing into lead, close in on majority, new poll suggests.” The poll the headline was referring to, also conducted by Ekos pegged, support for the Conservatives at 35.4 per cent with the Liberals and NDP far behind at 26.3 per cent and 24.5 per cent respectively.

It was good of the Toronto Star to attach the qualifier “new poll suggests.” But they could have done without the alarmist “closing in on a majority,” and they could have drawn attention to the fact that the result was way off what all the other polls were saying during the same period. That Ekos poll was very likely that one out of 20 – the infamous “outlier.”

This isn’t to be critical of Ekos or its methodology. Sometimes the pollster reaches into that sampling bucket of Canadians and pulls out a handful of respondents whose aren’t your “average Canadians.” It is just

the way sampling goes, and it can happen to any polling company.

The same is likely true of the Forum poll conducted September 9-10 showing the NDP at 36 per cent – results significantly at odd with every other poll from that time period and which have not been replicated since.

My point isn’t to ignore polls, only to know how to interpret them. This goes for the media as well.

In a close race the margin of error is the story, not an afterthought. If a poll has a margin of error of 2.5 per cent and one party is a percentage point or two above the other, the first party does not have a “lead” over the other, nor is the second party “trailing.” Also, if a party’s numbers changes from one poll to the next but the change is within the margin of error, their support is not “growing” of “falling.” The data is simply insufficient to draw those conclusions, and we should leave it at that.

I can only conclude, therefore, that Jim has a discerning nature that must come from a talent for divination or some other spiritual practice.

The debate, the fourth of five during the extraordinarily long, 78-day election campaign, was also remarkable for the capacity crowd of close to 3,000 paying – and occasionally partisan – patrons.

Despite rules against cheering, the large live audience helped animate the well-paced debate with applause and laughter and even a heckle or two.

A battle over federal stewardship of the economy was supposed to be this election’s defining issue, but emotive “values” questions have increasingly dominated the discourse.

Those values have been attached to the country’s place in the world: Canada’s handling of an international Syrian refugee crisis; the place of minority religious face coverings at citizenship ceremonies; and rescinding Canadian citizenship from convicted terrorists who hold dual citizenship.

On Syrian refugees, Trudeau drew applause when he named nearby Ireland Park in Toronto, where he said 38,000 Irish arrived in 1847 fleeing the potato famine.

Harper also ripped into his opponents over his government’s ongoing – and reportedly nearly complete – negotiations of the Trans-Pacific Partnership trade deal.

“You don’t get those deals by coming up with a million reasons why you’re against them before you even get to the table and why you should walk away once you’re there,” he said.

Mulcair had an opportunity for his own two-front offensive, blasting both Harper’s Conservatives and the Liberals who preceded them in office for not giving Canada a comprehensive policy to tackle greenhouse gas emissions.

Harper responded that his government has been consistent in stating any international protocol requires all countries to sign on and that he’s “very optimistic” the world will reach an historic accord in December when international negotiations take place in Paris.

Whitehorse fundraiser supports blood-cancer research

C

arol Deuling doesn’t have a bucket list. She’s never been the type of person to put things off, to wait until retirement to do what she wants.

She’s travelled a lot, and worked part-time for many years. She took every fifth year off work, and spent a while living as a ski bum.

“I’ve always tried to live life to the fullest,” she explained.

So when Deuling was diagnosed in 2010 with multiple myeloma, an incurable blood cancer, she was able to tell her nurse that she was OK. There wasn’t anything she still had a burning desire to do that she hadn’t already done.

Five years later, Deuling still goes hiking. She still attends fitness classes at the Canada Games Centre every week, though she can’t lift as much weight as she used to. She’s energetic, and looks younger than her 63 years.

And now, she’s busy going door-to-door to Whitehorse’s small businesses, asking them to donate prizes for a silent auction that will be part of a fundraiser on Thursday evening for the Leukemia and Lymphoma Society of Canada.

There are currently about 100,000 Canadians living with leukemia, lymphoma, or myeloma, the major types of blood cancers. Together, leukemia and lymphoma account for almost half of childhood cancers.

Multiple myeloma, the illness that Deuling is fighting, is a cancer of the plasma cells in the blood. Over time, abnormal plasma cells build up in the bone marrow, and often lead to infection, fragile bones, and kidney failure. Many patients don’t survive longer than five years with the disease.

Back in 2010, it was the pain in her bones that drove Deuling to seek out medical attention.

She was flown from Whitehorse to the Vancouver General Hospital, where she learned she had cancer, and that the disease had caused several fractures in her spine. She spent four months in Vancouver, where she underwent chemotherapy and had a stem-cell transplant to slow the illness’s progression.

When she came back to Whitehorse in April 2010, it took a while for her to get back on her feet. She was on heavy painkillers for several months, and had to get used to not going to work.

But by the next summer, she was hiking again.

“That’s what got me into shape,” she said. “I was bound and determined.”

She started going to classes at the Canada Games Centre, which helped her spend time with friends. And she hasn’t stopped since, even after learning in October 2011 that her cancer had returned.

Since late 2011, Deuling has been taking chemotherapy drugs from her home in Whitehorse. Six weeks ago, she was told the cancer was growing, and that she’d have to start taking a stronger medication.

The new medication makes her a little nauseated, but she’s still keeping up her daily routine.

“I’m living with cancer, but I don’t want it to be my focus,” she said. “I want to continue my life.”

The Yukon can be a difficult place to live with cancer. There are currently more than 130 new cancer diagnoses in the territory each year, and many

patients like Deuling will require costly trips to Vancouver or other cities for treatment.

The Yukon government subsidizes those costs – Deuling’s plane tickets have been paid for, and she’s entitled to a daily stipend when she’s away. But she said the stipend often wouldn’t be enough to pay for a hotel in Vancouver.

Deuling is lucky – she used to live in Vancouver, and she has friends there. But that’s not the case for everyone.

“If I would have gone to Vancouver and not known anyone, it would have been really lonely,” she said.

Those challenges are part of the reason the Yukon Hospital Foundation established the Yukoners Cancer Care Fund in 2013. The fund, which offers one-time gifts of $1,000 to individuals and families fighting cancer, is a way of ensuring that money donated by Yukoners goes to Yukoners.

“The cancer journey is difficult and expensive and stressful,” said Harmony Hunter, manager of partnership and engagement with the Yukon Hospital Foundation. “I think it’s just really important that the community gives back to each other.”

Since 2013, the fund has raised over $50,000 and has helped 34 families.

In other ways, though, Deuling believes Whitehorse is the perfect community for people in need of support.

“It’s an amazing community,” she said. “There’s a real sense of caring for everybody. You know everybody and you want to help them any way you can.”

She said she’s received support from all corners in Whitehorse, whether it’s from neighbours who go out walking with her, or from Air North employees, who give her a special seat on her flights to and from Vancouver.

She said it’s that same spirit of giving that motivated Debbie Gohl and Shari Worsfold to put on this Thursday’s event to raise money for the Leukemia and Lymphoma Society of Canada.

The money will go to cancer research, to help find a cure for illnesses like Deuling’s.

Gohl and Worsfold plan to run a half-marathon in San Francisco in support of the cause.

“We need to be grateful more often for what we have,” Gohl said. “I believe in people’s generosity.”

The prizes at the silent auction will include local pottery, quilting, photography, a stone massage, and various gift certificates.

The fundraiser will take place on Oct. 1 at the Association franco-yukonnaise at 302 Strickland, from 7 to 9 p.m.

Hopkins began writing songs in Grade 7. He also draws inspiration from the glam metal band Motley Crue, who made it big combining elements of punk rock and pop music with the aesthetic of 1970s glam rock.

“If you’re going to see a show, there has to be something to see, it has to be an experience,” Hopkins added.

Electric percussionist Isaac Pumphrey, who joined the band last year with guitarist Milan Lapres, said they don’t let anyone see them without their masks on the day of a show. It’s a big part of the allure, he said.

When Warrmauth played its first show with all five members at Epic Pizza last year, the band had to figure out how to eat without taking their masks off, Pumphrey said.

The band was nervous, Hopkins said. They’d been invited to open for local rockers Speed Control.

“No one knew us except our parents,” he said.

Created in late 2013, the early incarnation of Warrmauth was made up of Ragn “Cousin it” Royle and Hopkins, who knew each other from Vanier Catholic High School, and drummer Brandon Butler.

Both Royle and Butler had already been part of other bands, despite their young age. Royle was a member of Solid Fuel, while Butler played with the Butler Code in P.E.I. before moving to Whitehorse.

Early last year, the band decided it wanted to add new members and change its sound to something closer to nu metal, a genre that emerged in the late 1990s by combining heavy metal with hip hop, alternative rock, funk and grunge.

Pumphrey, who also plays the turntables, met Warrmauth through a rock band program at Vanier. Lapres, who has taught himself to play the guitar in the

past 18 months, is Royle’s best friend and joined soon after.

The group began rehearsing in Royle’s garage, which is covered in pentagrams and cave drawings.

The band’s name comes from a furnace in the garage that turns on from time to time and makes “these big rumbly noises.”

“We thought it sounded like a device Satan would use to communicate with us – his war machine,” Hopkins jokingly said.

Warrmauth has already released a three-song EP and its members are currently raising money to record a full-length album with local sound engineer Jim Holland, who runs Green Needle Records.

They recently played a show at Splintered Craft, the arts drop-in centre, and raised about $400.

The new album, titled Angry Christian Moms, will feature 12 or 13 of the band’s original songs.

“Then we hope to make it into a movie,” said Lapres.

Server’s name tag is not an invitation for friendship

MANNERS DEAR MISS MANNERS: Sometimes I see patrons in a store or restaurant peer at the service employee’s name tag and say something like, “Hello there ... Tiffany ... how are you today?� It always comes out with this forced conviviality, as if to say, “Look, everyone! I’m a good, egalitarian person treating the lowly server as a person.

Isn’t that great of me?�

I think it actually says, “You have such a menial job that you’re forced to wear a stupid name tag, so I know your name and feel free to use it even though I don’t know you — but you don’t know my name because I’m a higher-class

person and get to dress the way I want.�

I think name tags are just so you know whom to refer to if needed, as in, “I think Tiffany is our server. Could you ask her to bring the check?�

Am I right to see this as presumptuous behavior?

GENTLE READER: The presumption in the greeting you mention is not in using Tiffany’s name, but in asking the waitress how she is “doing,� a question about her mood or life that is not relevant to the business at hand.

Miss Manners has no objection to using a form of address that has been supplied by the addressee, even if, in this case, it may technically have been Tiffany’s boss who chose the form. She does wish the form supplied was more formal, as she agrees with you that first names in this context are an invitation to mistreatment.

I’m aware that people deal with loss in their own ways, and perhaps my father’s passing was hitting too close to home and she doesn’t know how to deal with it. But this really upset me.

I did not expect a card or flowers, not at all. I just did not expect my father’s life and death summed up on a generic yellow sticky note. Is this actually appropriate? I don’t know how to reply.

GENTLE READER: Fortunately, a sticky note does not require any response. Nor does callous behavior require the target to offer a psychological excuse.

DEAR MISS MANNERS: My fiance and I are having a cupcake tree instead of serving

sliced wedding cake at our wedding, which will be held at our church, with all of the church members and their families invited.

A couple hundred cupcakes are about as expensive as the typical wedding cake, and are ordered with the number of attenders in mind, but there is typically no server and guests can take one when they desire.

On a typical Sunday after church, there are snacks served after the service. We have a group of children who are often unmonitored at this time who think nothing of swarming the snack table the minute the dish of cookies, coffee cake, etc., is set out. They grab multiples of the snack — often as many as they can carry, and many times come back for more, regardless of whether everyone else has had a chance to have some.

This is usually accepted and nothing is expressed openly against it, although occasionally I will hear an adult mumble unhappily about there being nothing left for the adults by

If not, how should I handle this with grace?

GENTLE READER: It would have to be an impressive sign to separate even reasonably well-behaved children from unattended sweets, particularly when there is a contrary tradition.

Miss Manners advises a more active intervention, in this case a caterer or family member who is willing to slip out before the service is concluded to gently advise the children that this time, we will be waiting for the adults to go first. Or just place the tree on a high table, out of the children’s reach.

Disc golfers tee off in big fall tourney Tom Patrick News Reporter

D

iscs flew, a record fell, and a new champ was crowned over the week-

end.

Whitehorse’s best disc golfers (and a few newer ones) were on the move at the third annual Whitehorse Fall Classic.

The tournament was previously called the Two Course Tournament, but apparently 36 holes wasn’t enough for the Whitehorse Disc Golf Association.

The weekend’s was a threecourse tourney followed by a playoff.

“It’s definitely the largest format we’ve had in Whitehorse that I’m aware of,” said WDGA president Ryan Norquay. “It really takes some head-down concentration to be able to get through three rounds and potentially a final nine. It’s not a game of luck anymore, it’s a game of perseverance and skill.”

Disc golfers who dared to enter the advanced division made a weekend out of it. They played the par 56 Solstice DiscGolfPark and the par 63 Takhini North DGC on Saturday, and the par 54 Mount McIntyre DGC on Sunday.

The top five golfers after that then played nine playoff holes on the Mount Mac front nine to decide it.

Whitehorse’s Sheldon Casselman only expanded his lead in the final nine. The 33-year-old captured his first tournament title with a seven-stroke victory, carding a minus-14 after three and a half rounds.

“There are really good disc golfers out here … too many people to mention. It could have been anybody,” said Casselman.

“I was just playing consistent disc golf and that’s what you’ve got to do in order to even just make top five. You have to let the bad holes go and roll with the punches when you can.”

Casselman took the lead in the second round and didn’t let go. He moved into first with a spectacular round in Takhini North, setting a course record of minus-13 with 13 birdies and five pars.

“It was my best round ever.

My previous best was minus-12 here (at Mount McIntyre),” said Casselman.

“I was in the zone. That’s the beautiful thing about scorecards: when you’re not keeping your own score in your head, it’s a lot easier to just play. When we are taking turns keeping score, it’s a lot easier to just play.”

The pair are now training for the 2016 Skate Canada Challenge early December in Edmonton.

They are also first-alternates for the ISU Grand Prix final in Barcelona, Spain, at the same time. “We’re just going to train for Challenge and if someone gets injured we get to go to Barcelona,� said Hoffman.

“This is a fun river to paddle.

It’s quite narrow and quite winding,” said Mann. “You have to stay on your toes to make the tight turns.”

“We’re used to paddling on big bodies of water … Here there are a lot of very tight turns, so there’s some strategy,” said Paleczny. “You have to stay close to shore on the way

up so you get as little current as possible. On the way down you’re sticking to the middle where the water is deepest and fastest.”

The Autumn Classic is the final race on the calendar for the Yukon Canoe and Kayak Club.

he 2016 Autumn Classic canoe and kayak race didn’t have the largest field of paddlers in its history.

It’s possible some paddlers opened up their blinds Saturday morning to see big, wet snowflakes falling in a drizzle of freezing rain outside their windows and decided to sit this one out.

Turns out, it was quite pleasant on the river.

“It was unpromising to begin with, with the snow and the rain, but actually most of the time we were on the river it wasn’t raining. Or if it was raining, it was something you could ignore,” said organizer Peter Coates. “No wind, so it was beautiful paddling weather.

And my hands didn’t get cold, so that tells you it was all right.”

“It was snowing when we left town this morning and we got here and it was pouring rain, but as soon as we started it cleared right up,” added racer Jake Paleczny. “It was beautiful.

Perfect conditions.”

Coates and Tim Hodgson paddled to a first place finish in the 11-kilometre race, completing the 5.5-kilometre out-andback course in one hour, 11 minutes and 36 seconds.

Paleczny and Karen Mann came second at 1:16:14. Both teams were in tandem canoes.

“It was fun. I hadn’t raced tandem in a while, so I wanted to try C-2,” said Hodgson. “I wanted to beat the kids. I was racing solo canoe in the Chili and Bean Downriver Race and

(Palecny and Mann) beat me, so I figured I had to go tandem to beat them.”

Paleczny and Mann were in the winning boat – a sevenpaddler voyageur canoe – in last year’s race, with Hodgson hot on their heels in a solo canoe. They were also the first Yukon paddlers to reach the finish in the Yukon River Quest in June, placing first in the mixed tandem canoe division and seventh overall.
