he Ta’an Kwach’an Council is reporting that nine chinook salmon have returned to spawning grounds in Fox Creek this summer.

The creek is a tributary of Lake Laberge, about 50 kilometres north of Whitehorse. It used to have a healthy salmon run, but salmon stopped coming back to spawn in the 1950s, for reasons that remain unclear.

Since 2007, the First Nation has been releasing juvenile chinook salmon into the creek as part of a restoration program undertaken in partnership with Yukon College and Fisheries and Oceans Canada.

Each year, between 26,000 and 50,000 salmon fry have been released into the creek from eggs collected at the Whitehorse fish ladder. This year, about 38,000 fish were released.

The first of the stocked salmon returned to Fox Creek in 2013 – two males and a female that successfully laid eggs in the creek. This year, that number has grown to nine. “I’m delighted to announce that our program has shown success again and that TKC is contributing to not only preserving an important part of our heritage but the protection and enhancement of the chinook salmon,� said Ta’an Kwach’an Council Chief Kristina Kane in a news release.

Paul Sparling, a local fisheries technician, said the results from Fox Creek are exciting. He said the actual number of returning fish is less important than the impact of this success story on public morale. “It’s not necessarily going to produce a major impact on everything, but it’s something for people to look at,� he said. “The more people talking about it and looking at it,

Sparling said it’s always a good idea to try and reestablish fish populations, but cautioned that creek conditions can sometimes change naturally over time, which can make recovery efforts more challenging.

For instance, if water flow declines in a creek, beavers are more likely to move in and build dams, which can be a major barrier to migrating salmon. In fact, beavers have been listed as a possible contributor to the decline of spawning salmon in Fox Creek. Sparling added that forest fires can cause the level of water tables to decline, which is also bad for spawning salmon.

But he said the most impor-

tant consideration for the Ta’an Kwach’an Council now is whether to keep stocking the creek or to wait and see if the returning fish can establish a natural population on their own. He said stocked salmon tend to outcompete wild counterparts in the same watercourse. “I’m just suggesting that stocking is a contentious issue sometimes,� he said. “I like the idea of not stocking it again.�

This year’s chinook salmon run has met escapement goals, with more than 58,000 salmon crossing the Yukon border. But the total is still much lower than historic runs, which numbered around 150,000 fish.

Peel case hits Court of Appeal this week Ashley Joannou News Reporter

he two sides of the Peel watershed debate are gearing up for the next round in court over land management in the Yukon.

The Yukon government’s appeal of last year’s Peel decision will be heard by a panel of judges in Whitehorse on Thursday and Friday.

It’s already shaping up to be a similarly high-profile event to the four-day trial that came before it.

Last December, Yukon Supreme Court Justice Ron Veale struck down the Yukon government’s land use plan for the Peel, a 68,000 square-kilometre swath of northeast Yukon.

The government had overstepped, he ruled, when it came up with its own plan for the area too different from the recommendations from a planning commission process.

The commission recommended protecting 80 per cent of the watershed from development. But after years of planning talks, the government’s plan protected only 29 per cent from new mineral staking.

That chasm was enough for the First Nations of Nacho Nyak Dun and Tr’ondek Hwech’in as well as Yukon Conservation Society and the Canadian Parks and Wilderness Society Yukon to take the government to court.

The Vuntut Gwitchin have since been added on as a respondent in the appeal. The Gwich’in Tribal Council will also be there as an intervener.

The Yukon government has always insisted it followed the letter of the law, laid out in the Umbrella Final Agreement, that allows it to approve, reject or modify any recommended plan.

But Veale ruled that’s not enough, especially when agreements involve aboriginal rights.

“The plain reading interpretation endorsed by the government does not enhance the goal of reconciliation and is inconsistent with the honour and integrity of the Crown,” he wrote.

The judge threw out the government’s plan and ordered they consult Yukoners and First Nations again on the commission’s final recommended plan.

But Veale didn’t send everything back to square one. After consulting, he said, the government can only make modifications that were proposed in detail at an earlier stage in the process, not vague ones that were referenced later.

The judge specifically excludes the possibility that the

government revisit the questions of balance between protection and development, and options for building new roads or other surface access into the area.

Those were topics that were never discussed in detail ahead of time, he said.

He ruled the government can’t reject the whole thing at the end of the process.

Less than a month after Veale’s decision being released, the government said it planned to appeal.

At first, then-Resources Minister Scott Kent said the appeal would only focus on the remedy Veale had suggested to fix the government’s muck-up.

“We can accept the court’s interpretation that the process should have worked differently,” he said in January. “The appeal

won’t challenge that. It’s focused on the remedy that’s set out in the decision.”

But after getting new lawyers in March, the government decided to appeal the whole thing.

It was too important to get clarity around the Umbrella Final Agreement and “that the democratically elected government retains the authority to make final decisions on public lands,” Premier Darrell Pasloski said at the time.

Meanwhile, the other side of the table continues to be represented by famed aboriginal rights lawyer Thomas Berger.

Documents suggest that in the appeal government lawyers will argue Veale made a handful of errors in his original decision.

Like in the original trial, they continue to insist that the plan the government came up with

for the Peel is simply a “modification” of the commission’s recommended plan, not a new plan all together.

They say the judge made a mistake when he concluded that the government’s plan did not flow from early stages in the process.

They say he was wrong to suggest that the Umbrella Final Agreement required Yukon to do more to fulfill its consultation obligations.

Even after Veale concluded that the government did not follow the correct process, he made a mistake with the solution he suggested, the lawyers say.

He should not have held the parties at a late stage in the planning process where the Yukon could no longer propose or consult on the modifications it wanted, they say.

Just like they did the first time around, Yukon court officials are preparing for a crowd.

A video feed will be set up again to broadcast the goingson in the main courtroom into a second room for anyone who can’t get a seat.

Events are also being planned for outside the courtroom on day one of the appeal. On the Thursday a water ceremony starts at noon on the courthouse steps.

Throughout the summer people have been encouraging people to go to their favourite Yukon body of water and fill two-ounce vials, explained CPAWS’s Amber Church.

Elders will collect the water at noon, and at the end of the day – during a free barbecue at the Kwanlin Dun Cultural Centre – the water will poured in the Yukon River. The barbecue runs from 5 to 8 p.m.

Kluane First Nation crafting new home ownership program Myles Dolphin News Reporter

he Kluane First Nation is revising its rental policy to be able to one day introduce a brand new home ownership program to Burwash Landing residents.

Chief Math’ieya Alatini said community members are slowly warming up to the idea of having to pay for their homes.

As it stands, Kluane First Nation citizens don’t pay rent for the houses they live in. The First Nation covers the cost of the mortgage, as well as maintenance to the homes.

“It’s a bit of an anomaly,” Alatini said.

“And it’s definitely not real life.

To even start implementing the idea of rent is a huge step.

“People want home owner-

ship, but with that comes a lot of responsibility and costs.”

This week, the First Nation Market Housing Trust Board is having its annual general meeting in Burwash Landing.

The board oversees a national fund, created in 2007 to help First Nations across Canada develop and implement home ownership programs in their communities.

The Kluane First Nation has been working with the board for almost two years now to develop a new home ownership program, Alatini said.

Reaching an agreement would mean the First Nation could subsidize a homeowner’s rent up to 80 per cent.

“We could take those extra funds that we’re not putting into housing and put it into other programming,” Alatini said.

“And people would be able to say, ‘This is my house.’”

The agreement was supposed to be completed last November, but they’ve hit a few snags along the way, she said.

The First Nation has worked with seven others on developing its own land titles act and land registry, but the act has been stalled, Alatini said, because of a legal review that has to ensure the legislation works with all other Yukon legislations.

“The current land titles act references like five other legislations, so we have to make sure those references are actually applicable, and that’s just taking more time,” she said.

That means the First Nation currently cannot access the registry of properties, or actually register sales and leases, she added.

The First Nation’s current agreement with the board runs out at the end of October.

“We’re kind of on our own after that,” Alatini said.

The issue of home ownership in Burwash Landing was front and centre during a recent court case.

Both Derek Johnson and Wilfred Sheldon, former residents of the community, disputed an eviction notice they received from the First Nation in February.

The brothers argued the evictions were driven by a political vendetta.

They are both barred by a court order from living in the community after they were convicted of forcibly confining Colin Johnson in 2013, who later committed suicide.

At the end of the case, Justice Peter Chisholm concluded the residency dispute boiled down to whether the brothers were tenants or owners of their homes, and whether the First Nation had

grounds to terminate the tenancies.

Since the brothers failed to make any payments or pursue the completion of a sales agreement, Chisholm concluded either party could terminate the tenancy.

The brothers’ tenancies were terminated on June 1.

Moving forward, Alatini said the First Nation still has to build up its financial system so it can handle rent collection, and train residents to get ready for home ownership.

“We still want to make it cost effective for people to live in the community,” she said.

“The idea of rent isn’t palatable, people are asking why they should have to pay it. Others are realizing the free ride can’t go on forever.”

Mae Bachur sacks animal shelter manager Myles Dolphin News Reporter

etty Irwin has been fired from her position as manager at the Mae Bachur animal shelter, after a little more than a year on the job.

Brent Slobodin, board president of the Humane Society Yukon, dismissed the long-time city councillor last Thursday morning.

He said that although he couldn’t discuss the details of Irwin’s settlement or package, it was time for a fresh start.

“The board decided the new direction that we want to take didn’t have the right person in the job that we thought we needed,” he said yesterday.

“It was time to part ways with Betty. She did a good job for us but in terms of where we want to go, we felt it was time to move on.”

The board, which currently has seven members, is looking to put a new model in place this fall, he added.

That means reviewing the job description for the shelter manager position, as well as the current policies and practices in place.

“Because we’re all relatively new and there have been so many changes to the board the last few years, we feel we need to get back on track with strategic planning, fundraising and particularly look at corporate sponsorships.”

Irwin was hired for the position

After just over a year on the job, Betty Irwin was fired last Thursday from her position of manager at the Mae Bachur animal shelter. in July 2014, after volunteering at the shelter for many years.

At the time she said she was hoping to expand the facility within the next five years. She also spoke about issues with the building’s foundation and drainage.

In an email sent to the News this morning, Irwin said she enjoyed her time working at the shelter.

“I will miss it and all the beautiful animals that I will not to get to know and fall in love with,” she

said.

“As with all NGOs, money is always the issue and it was necessary to cut expenses, staff being the most expendable. I will still continue to volunteer where I can, because I do believe sincerely

that the shelter is necessary to the community.”

The financial situation at the animal shelter has been anything but stable over the years.

In May 2013, it was reported the society had a shortfall of $90,000, compared to just $8,500 at the end of the 2011-2012 financial year.

According to the minutes of an April 23 board meeting, the 2015-2016 budget breakdown anticipated $191,000 in wages, or approximately 50 per cent of the shelter’s total budget.

Other expenses included $82,000 in shelter operations and $66,000 in animal expenses.

Revenues included $100,000 from grants, $75,000 from bingo fundraisers and $62,500 from adoptions.

The latest financial report for the animal shelter isn’t yet available on the society’s website. It was presented at the society’s annual general meeting on July 28.

Slobodin said the board is in the midst of a financial review to determine what it can afford to pay a new shelter manager.

“It’s not good,” he said of the animal shelter’s current financial situation.

“But we all inherited this, so we’re not ascribing any blame to anyone.”

Linda Priestley is filling in the role as interim shelter manager for the time being.

MinQuest wants to put Yukon Zinc’s Wolverine mine back into production Maura Forrest News Reporter

A

ustralian mining company MinQuest says it will try to put the Wolverine mine back into production within six months if it’s given the chance to buy the mine from Yukon Zinc.

That means Yukon Zinc’s creditors now have to choose between getting a fraction of the money they’re owed right away, and the possibility of being employed

by Wolverine again in the near future.

MinQuest went public with its bid to buy Wolverine last month, at the time saying it didn’t have plans for the underground mine itself. Instead, it planned to use the mill and tailings facilities at Wolverine to fast-track the development of its Fyre Lake copper project, located 28 kilometres southwest of the Wolverine mine.

But now, managing director Jeremy Read says the company is interested in operating the Wolverine mine for two or three more years – the time it would take to get Fyre Lake into production.

“We have a vision and a plan that will hopefully extend over a 10-year period,” he said.

MinQuest is in a bit of a tight spot at the moment. It still has to secure financing before it can finalize a purchase agreement with Yukon Zinc – about $20 million upfront and another $6 or $8 million to put the mine back into production, Read said.

And it has to do that even though Yukon Zinc sees its bid as a back-up option in case creditors vote down a restructuring plan it proposed last week.

Read said he didn’t realize until Yukon Zinc’s court appearance last Friday that MinQuest’s offer was only a back-up.

“We were approaching it from the perspective that ours would be presented alongside the Yukon Zinc plan,” he said. “It makes it a little bit more difficult for us to conclude financing.”

But he said MinQuest is in “quite advanced discussions” with a number of potential investors.

This means Yukon Zinc’s creditors now have an interesting choice to make. Yukon Zinc’s restructuring plan would pay off the full debt to any creditor owed less than $5,000, and either $5,000 or up to 11.5 cents on the dollar to any creditor owed more. If the creditors refuse the plan, Yukon Zinc would likely be forced to sell to MinQuest, and the unsecured creditors would probably get nothing from the sale.

So creditors now have to choose – take the deal as it stands and see the mine remain closed at least until metal prices rebound, as Yukon Zinc is proposing, or refuse the deal and take a chance on a junior mining company that says it will try to get the mine running again right away.

And whatever they decide, they have to do it quickly. Creditors voting for the plan need to

respond to Yukon Zinc’s offer by Aug. 31 if they want to get the best deal available. The final vote on the plan will take place on Sept. 2.

David Green, owner of MacPherson Rentals in Whitehorse, said he’s already decided to take Yukon Zinc’s deal. Yukon Zinc owes his company about $63,000 for equipment rentals, so he plans to take 11.5 cents on the dollar, which would get him about $7,200.

Green said he’s had clients go bankrupt before, and this is the first time a client in financial difficulty has been able to pay anything back at all.

“The plan’s not unreasonable for what we would expect,” he said.

He also said he’s not convinced MinQuest will be able to deliver on its promises.

“I think that any development of the MinQuest project would be a number of years away… because of the current commodity cycle. They need to raise a lot of money,” he said. “I think that the probability of getting any money out of the MinQuest proposal in the foreseeable future is way lower than what the plan of arrangement is.”

But according to one lawyer involved in the case, Yukon Zinc’s plan is not really what creditor protection is supposed to achieve.

Jonathan Williams represents the three prospectors who discovered the Wolverine deposit, and whose royalty payments were recently threatened by Yukon Zinc.

The court has now ordered that those payments be maintained if the mine goes back into production. But Williams’ clients are still among the unsecured creditors, for outstanding royalty payments.

Williams said an ideal creditor protection scenario is one where a company needs to reduce its debt to keep operating. In that situation, a financier would step in to refinance the operation.

Creditors would get a fraction of the amount they’re owed, but that would allow the company to keep them employed.

But in this case, he said, all Yukon Zinc is doing is “reducing debt and putting this thing into mothballs.” “[Creditor protection] is legislation that is intended to provide a social benefit to creditors and the community by allowing a company to restructure,” he said.

“What bothers me about this socalled restructuring is that it’s not really a restructuring. There’s very little community benefit to what is going on here. That’s what I find somewhat distasteful.”

Currently, to file for creditor protection, companies have to have at least $5 million of debt, and they have to show that their liabilities outweigh their assets.

But Williams said they should also have to show what benefit creditor protection will provide to the community.

For his part, Green believes some money back is better than

He said he’d always believed JDC Canada, Yukon Zinc’s parent company, would support the mining company through financial difficulties. That was part of the reason he kept dealing with Yukon Zinc.

“I had made a calculated assumption that they would stand behind the company,” he said.

“I’m still surprised that they walked away from that.”

JDC Canada didn’t exactly walk away, however. Yukon Zinc owed its parent company over $600 million when it went into creditor protection in March. Now, JDC Canada has agreed to finance Yukon Zinc’s restructuring plan – a plan that will see it pay out roughly $24.5 million less than the total amount owed to unsecured

creditors.

Williams said that in creditor protection proceedings involving a wealthy parent company, it’s always difficult to know how far that parent is willing to go.

In this case, he said, it’s hard to know whether JDC Canada would have let Yukon Zinc go bankrupt if creditor protection had not been an option.

And now, he said, it’s hard to know if this deal is the best the creditors can get from JDC Canada.

“I wonder… whether JDC would be willing to put up more money to avoid a bankruptcy,” he said. “But unless the creditors got together and formed a committee and entered into negotiations with these guys, we won’t know that.”

hitehorse was always a beautiful city, but it has come a long way in the past decade. Although like all old-timers I’m a bit nostalgic for the “old days� when it felt less urban, I also think recent development projects like the Millennium Trail, Shipyards Park and the Canada Games Centre have been excellent additions.

Whitehorse’s slogan is the “The Wilderness City.� We’ve always had a beautiful wilderness, but such projects have gone a long way to upping our merits as a city. And I think we should promote our urban attributes just as we do our natural ones.

City council is responsible for our urban development. They recently announced a plan to tackle vacant lots, which I think is a great idea, but instead of one-off plans, I’d like to see council establish a broader vision for Whitehorse, and a strategy for its achievement.

Let’s start at the global level. Instead of reinventing the wheel, we have many examples of cities not only in Canada but from all over the world upon which to draw. People who live in Whitehorse are well-travelled and I assume have experienced many cities they would consider great.

So what makes a city great?

Encouraging creative architecture and expanding designated public green space are general ideas we should incorporate into our municipal vision for the future. One such green space could be a pedestrian zone in downtown Whitehorse.

In many ways, architecture sets the tone of a city. Buildings should be inspiring, designed by architects that have a vision and create spaces that are not only functional but also pleasing to look at. I challenge our contractors to try follow Gaudi’s lead – a great Spanish architect around 1900 who designed remarkable buildings. Unfortunately, I find that several of our recently-built downtown buildings are no more than cubic blocks.

Next let’s consider our public green spaces.

It seems we are doing OK – Whitehorse is quite green and has a lovely waterfront. However, within the inner city core there’s not a lot of green space. We allow condo and office buildings to be built without any set backs and no room for trees.

I hope we can change this soon.

But there is one specific idea that would remarkably improve the city: the creation of a pedestrian zone. Such zones are great attributes in any city not only because of their convenience but because of the social, interactive culture they promote. I suspect many other Yukoners have

travelled to Europe and enjoyed strolling these areas filled with shoppers, street cafes , markets and street performers.

I have written letters in the past to suggest change; my Porter Creek Secondary School Grade 8 students interviewed people on the streets one year to see if they could envision Main Street becoming a pedestrian zone. Many responded favourably, so I contacted previous mayors to discuss this idea, but there was a general lack of interest.

Perhaps at the time – a decade ago – we weren’t quite ready. But I think an outdoor, urban culture has organically grown in the Whitehorse core already. Just about every downtown cafe boasts a patio, and I always see people enjoying the sun at Rotary and Lepage parks at lunch time.

Unfortunately we still experience Main Street primarily as a glorified parking lane. People will drive three times around the block until they find a parking spot right in front of the bank or bookstore.

I propose that we close Main Street from Fourth Avenue all the way to Front Street, keeping Second Avenue a throughway for traffic. I suggest that we should build a bridge as a walkway across Second Avenue to accommodate pedestrians and also improve the flow of traffic on Second Avenue.

Eliminating traffic lights also have another beneficial effect because cars would no longer idle and thus the air quality would improve.

Just imagine: a fountain standing in the middle of Main between Front and Second; patios or open seating from surrounding restaurants and cafes would extend further into the street, almost like a mini-piazza, with kids running around; down the street, boutique stores would open their

doors to passers-by, lining racks along the street so you could check out their wares as you went by.

Wouldn’t strolling a pedestrian Main Street be a lovely way to spend an afternoon?

In conjunction with this – since we’d lose the glorified parking lane – the city could assign one of the many vacant lots to a parkade. It might be especially useful for business people and workers in the city core, as well as for shoppers who need to keep their vehicles warm during the winter months.

Not only would investing in Whitehorse’s downtown core make the city more enjoyable for its residents; it would improve our draw to tourists. We call ourselves “The Wilderness City� largely as a tourism gimmick, but in reality, the tourism we are selling lies outside city limits.

I’d love to see us introduce tourists to Whitehorse itself: its people, its culture, its recreational facilities, its shops, its restaurants. I’d love to see us surprise some unknowing visitors, showing them that we’re not just base camp for their Teslin canoe trip. We’re a vibrant, modern and liveable city, and they should have a blast exploring for five days.

We could develop Whitehorse into an exceptional city. And I think that a great first step towards this goal would be the creation of a pedestrian zone on Main Street and more emphasis on forcing contractors to come up with more creative building designs. I’d like to see a Whitehorse that lures tourists and future residents with its own attributes, not just those in its surrounding. All we need is some vision and some political will.

Liberals’ family cash a boon, provided you don’t benefit from income splitting

T

his federal election is largely being fought over the support of families with young children.

It started last fall, when the NDP and Conservatives each released competing child care plans for Canadians. The Conservatives promised – and subsequently introduced – the “enhanced” Universal Child Care Benefit (UCCB) and income splitting. The NDP, meanwhile promised a universal daycare program which they claim would cost parents just $15 a day.

Not to be outdone, the Liberals released a plan for what they call the Canada Child Benefit in the spring. At its core, this is much more like the Conservative plan than the NDP’s. It involves direct cash payments to parents who would continue to purchase child care services privately, and, unlike the NDP, does not establish a large new government program.

But that is where the similarities between the Liberal and Conservative plans end.

The Canada Child Benefit

purports to provide parents with a tax-free benefit of up to $6,400 for each child under six and $5,400 for each child between the ages of six and 17. Families with household incomes up to $30,000 will receive the full amount of the benefit. If a family’s income is above that, the benefit is gradually clawed back until it is gone completely.

After a previous column in which I critiqued the enhanced Universal Child Care Benefit several readers suggested that ignoring the original $100 UCCB in my analysis was misleading. If anything is misleading it is the practice of trumpeting money that was introduced years ago. Parents don’t want to hear about what they are already receiving. They want to hear about what is new.

So it is important to note that, much like the changes introduced by the Conservatives this spring, the Liberals are planning to take some things away. To help pay for their plan, the Liberals would eliminate income splitting and the UCCB – not just the $60 enhancement but the entire $160 monthly benefit. And they would not restore the Child Tax Credit that the Conservatives eliminated this past spring.

Most importantly, the plan rolls in the existing means-tested Canada Child Tax Benefit and the National Child Benefit Supplement.

So ultimately more than half of the total benefit for a low-income fam-

ily is renamed old money.

But that doesn’t mean that there aren’t important differences between what the Conservatives have done and what the Liberals propose to do.

The way the money is divided up is quite different, and determining which is better for a particular family depends primarily on whether that family benefits from income splitting.

Under the Conservatives’ plan, families may save up to $2,000 on their taxes by shifting their incomes between spouses. Income splitting is a boon for single income, two parent households, and two-parent households with wide disparities between spousal income, while providing nothing to single-income households and two-parent families where the parents had similar incomes. Income splitting is defended on the basis that it is not right that we tax single-income, two-parent families more than their two-income counterparts when the household income is the same.

To illustrate how important income splitting is, let’s look at a hypothetical family making $95,000 a year (a roughly median family income in the Yukon).

Under the Liberal plan, even after factoring in the loss of the existing benefits including the UCCB, but ignoring the effects of income splitting, that family will net somewhere around $1,600 regardless of who earned the income.

But under the Conservative plan, who earned that income makes all the difference. If each parent brought in an equal amount, that family will receive the paltry after-tax benefit of the enhancement to the UCCB – about $158 per year (ignoring changes in territorial credits). A single-parent household does slightly worse, because they would pay more tax on the UCCB. However, if one parent in a two-parent household earned that $95,000 that family would have received about $2,000 off their 2014 taxes because of income splitting and therefore actually stands to lose a few hundred bucks under the Liberal plan compared to last year.

The same applies at lower income levels, although the benefits of income splitting decline (not to mention the likelihood that you’ll have the luxury of having one stay at home spouse). In short, the Liberal plan is significantly better for families who don’t benefit from income splitting.

It is also noteworthy that the Liberal plan is less generous to high-income families. The proposed Child Care Benefit is clawed back as family income rises. Families with income over $185,000 and one child would receive nothing under the Liberal plan and will lose the full $160 monthly Universal Child Care Benefit – not just the enhancement I panned several week ago.

The Liberal plan is also more

generous for larger families, since you get the benefit for each child, while you only get to split your income once. But it is much more expensive, and its critics question whether the Liberals actually have a plan to pay for this new benefit, particularly at a time when our economy seems to be sputtering.

Ultimately the benefit of the Liberal plan is spread much more widely among low and middle income families, while the main beneficiaries of the Conservative plan are a much smaller subset of the public – two-parent families with single or widely disparate incomes, regardless of their wealth.

For this reason I think the Liberal Child Care Benefit is an improvement on what the Conservatives have done. Spending billions to correct an arguable unfairness in the taxation of single-income families and handing over millions to the wealthy in the process is simply not what Canada needs right now.

A means-tested benefit is a more appropriate approach.

Of course, supporters of the NDP plan would point out that it is questionable whether throwing more cash into the child care marketplace will actually create new child care spaces, or will simply lead to inflation of prices. But I am out of words for today.

And in another email, Rogers writes. “The Senator will call back once we have Deloitte locked in.”

But Wright has disagreed emphatically with the characterization that he meddled or wanted to meddle in Deloitte’s audit of Duffy’s expenses.

Wright said he simply wanted the Senate committee to change the terms of the Deloitte audit to remove Duffy, since he says Duffy’s repayment of expenses would render the study moot.

He says when he couldn’t ascertain whether Tkachuk was making the plan happen, he dispatched Gerstein to approach his Deloitte contacts to see if the firm and Tkachuk were indeed talking.

As Wright put it, he wanted Gerstein to “close the loop between the contractor and the client here.”

A subsequent PMO email lists information that Gerstein has apparently gleaned from his contact at Deloitte.

“Just heard from Gerstein,” Rogers writes. “Here’s the latest and most useful information yet from Deloitte. Any repayments will not change Deloitte’s conclusions because they were asked to opine on residency. However, they can’t reach a conclusion on residency because Duffy’s lawyer has not provided them anything.”

“Sir, your career is in business, there are agreements that are negotiated, contracts that are negotiated,” Bayne put to Wright. “If discussions are strictly confidential, they’re not to be leaked. As a lawyer, you know what strictly confidential means. You know what the words mean.”

“I know what their common sense meaning is, yes,” Wright responded.

After receiving the information about Deloitte through Gerstein,

Duffy is counselled to no longer co-operate with the audit.

An auditor from Deloitte who appeared before the internal economy committee in 2013 denied anyone close to the audit divulged any information.

“He wanted to know if Sen. Duffy were to repay (his expenses), how much would it amount to,” Gary Timm said of Runia.

“I said I couldn’t tell him, I couldn’t disclose any confidential information to him – that was the gist of the conversation.”

The Canadian Press asked Gerstein this past June to explain his role in the Deloitte matter, but the senator did not respond to the question. He told the RCMP in 2013 that he had indeed contacted Runia, and that Runia told him that the Duffy audit would continue despite Duffy’s repayment.

Runia echoed Gerstein’s version in his own discussion with police. either the party was prepared to repay the senator’s expenses, or that Wright himself had ultimately paid.

Sen. Carolyn Stewart Olsen, former member of Senate’s internal economy committee: What she said: “I didn’t talk about what I was doing on that committee to anyone other than those directly involved, like our Senate leader, who would have to talk to me about what was going on and things like that. I couldn’t even talk to Duffy or any of the people who were involved because that would be not proper I don’t think.” (Interview with The Canadian Press, June 3, 2013.)

What came out later: Stewart Olsen was one of the senators taking direct orders from Wright and others in PMO on how to shape the committee’s final report on Duffy to make sure the language was softened. “Hi Nigel, just a quick note to say that I am always ready to do exactly what is asked…,” she wrote in an email on Mar.1, 2013.

A tiny Klondike rush

ixty years ago almost 21 million deeds went out into the world promising wannabe land barons their own piece of the Klondike.

A very, very tiny piece.

Starting in 1955, each box of Quaker Puffed Rice and Puffed Wheat cereal contained a document purporting to entitle the owner to one square inch of the Yukon Klondike.

About half-a-page in size, with a gold border, an official-looking seal, individual tract number, and full of legal jargon, the deeds were enough to capture the imagination of any young person eating their morning cereal.

It looks important enough to want to keep safe, and many people did just that, for a very long time.

What started out as a gimmick to get kids to ask for Quaker cereal still has life decades later.

There are still queries being made to Yukon government offices asking about the tracts of land. The promo has since been called one of the biggest cereal marketing campaigns in history.

Most recently, some of the

deeds have been turned into an art exhibit that opened last week in Dawson.

••• In 1955, the Quaker cereal company bought 19.11 acres of Yukon land about 12 miles north of Dawson City along the Yukon River. That’s pretty close to where the golf course sits today.

It cost the company about $1,000 and they raised title in the name of the Klondike Big Inch Company.

The land was divided up inch by inch and the mock deeds slipped into cereal boxes.

The promotion was a tie-in to Quaker’s sponsored television show Sergeant Preston of the Yukon, and meant to capitalize on society’s fascination with the North.

By 1965 the cereal had been eaten, the promotion was done.

The Klondike Big Inch Company dissolved like a rice puff left at the bottom of a bowl of milk.

Eventually the Yukon government took back the land for nonpayment of taxes. Quaker owed $37.20.

••• Sixty years later, the Yukon’s lands titles office still gets the

odd call or letter about the deeds found in the bottom of someone’s drawer or while cleaning out a relative’s house.

Registrar Denise Dollin says there are five stacks of file folders in the office dating back to the 1960s full of letters from people inquiring about their piece of the Klondike.

There’s one from someone offering to donate three square inches of land to a national park.

There’s one from a concerned citizen worried that they haven’t heard from the taxman and wondering how much they owe in back taxes.

“We’ve received string and four toothpicks and somebody wanted us to go out and stake their track of land for them,” she said.

The Yukon office has a form letter that they’ll send back to anyone who inquires explaining that it was all a gimmick to sell cereal.

Not everyone is surprised when they find out it’s a gag, she said. There’s at least one red flag.

Each deed has a spot where the owner is supposed to fill in his or her name.

Sometimes the name is scribbled in pencil.

••• Vancouver artist Kevin Murphy says it doesn’t matter that the fine print makes it clear the deeds aren’t real. The promotion was all about using kids’ imaginations and building on the fantasy of the Yukon.

As part of his artist in residence program at Dawson’s Klondike Institute of Art and Culture, Murphy found a new use for the deeds.

“Like all things that have no intrinsic worth, they become collectibles and they go to the land of eBay,” he said.

Some of the deeds he snapped up look brand new, while others have names scrawled across the front.

He cut up the deeds and made sculptures of “the kinds of things that I imagine these kids might have been imagining” when they pulled the papers out of their cereal.

He made models of mine shafts, cabins and storefronts, wall tents and prospectors’ camps.

After figuring out the formula Quaker used to divide up the land, Murphy brought the deeds home to their corresponding inch.

Some of the models ended up in the woods, similar to how things would have looked when Quaker first bought the land.

One is in a tire rut in the middle of the road and another ended up in a horse corral.

Nine photos of the models on the land they represent make up Murphy’s show, One Inch More Or Less, which is on display at Dawson’s ODD Gallery until Sept. 18.

The show is part of The Natural & The Manufactured, a project jointly organized by the gallery and the artist in residence program.

Quaker never intended for people to own the land, Murphy said. It was real but never really meant to exist anywhere except in people’s imaginations.

He said his work looks at the complicated relationship between a physical place and the human baggage or lenses that we see it through.

“It was this imaginary place.

They bought the land but they didn’t necessarily have any sort of tie to that land. It was more (that) they were selling the idea of the North, and it was all coded in these sort of romantic associations.”

Shell is eager to explore in a basin that company officials say could be a “game changer” for domestic production.

Obama, who is scheduled to visit Alaska later this month, says he is mindful of the dangers of offshore drilling, particularly given the 2010 Deepwater Horizon oil spill.

“When it can be done safely and appropriately, U.S. production of oil and natural gas is important,” he said at a news conference earlier this year. “I would rather us, with all the safeguards and standards that we have, be producing our oil and gas, rather than importing it, which is bad for our people, but is also potentially purchased from places that have much lower environmental

standards than we do.”

When asked whether the administration was sending contradictory messages, White House spokesman Frank Benenati said the administration has invested heavily in renewable energy so that the nation can transition off fossil fuels.

“But it’s also true that we cannot make that transition overnight, which is why we have taken steps to ensure safe and responsible development of our domestic energy resources that benefits our economy and enhances global energy security, with safety remaining paramount,” Benenati said.

Democratic presidential candidate Hillary Rodham Clinton made clear on her Twitter account Tuesday that she disagrees with Obama.

“The Arctic is a unique treasure.

Given what we know, it’s not worth the risk of drilling,” she wrote.

“It’s perplexing and depressing, quite frankly, to hear President Obama say he wants to fix climate change but then approve Arctic drilling. It’s like a doctor diagnosing a patient but then refusing to write a prescription,” said Rebecca Noblin, Alaska director for the Center for Biological Diversity.

Lawrence prefaced his criticism of the go-ahead to Shell by saying Obama has done more to fight climate change than “any other leader in world history.”

In his visit to Alaska, Obama is expected to stress the dangers of climate change. He says Alaskans are on the front lines of the problem.

Birds of the Yukon Sunbirds, snowbirds and other migratory RV dwellers

A

lthough this is only my second summer of being a retired RV enthusiast, already I’m learning many things that escaped my attention in the long, hard years of a working life spent wandering around north and western Canada trying to get rich quick.

For instance: “Snowbird” is not an exclusively Canadian expression, some say born of a long ago Anne Murray song, and there are many other birds in the northern RV sky, so many in fact I feel as if my retirement years have begun with a crash course in bird watching.

A snowbird, of course, is any Canadian from any part of this vast and varied country who flies south in a panic every autumn to avoid the painful slow death which comes from touching anything white which falls out of the sky, almost religiously beginning on Halloween. They are often

couples named Bob and Betty from Ontario who spent 25-40 years doing jobs they tolerated and raising children they loved so they could fulfill their long cherished dreams of becoming certified snowbirds and live like their heroes, migrating Canadian geese.

The eastern ones go to Florida or Myrtle Beach, the central to Biloxi, New Orleans or Texas and the western to the low desert of Arizona, California or the Mexican Baja which is pronounced “bah hah hah hah,” a combination of sadness about leaving Canada and joy about spending the winter in a place where it doesn’t snow.

In my aging naivete, I figured that was about as complex as the RV bird thing got when I joined the flock in the spring of 2014, but, boy, was I wrong.

Canadian snowbirds are only half the story... no, make that 10 per cent, like every other Canadian/American statistic.

There is a virtual air force of migratory international birds,

mostly American but not exclusively, who reverse the flow every spring and attack B.C., the Yukon and Alaska with their money, minds and mayhem.

The first two who alerted me to this invasion were Bob and Betty, from Phoenix via Peoria who called themselves:

Sunbirds I was in Haines Junction hiding from my grandchildren attending the 2015 Kluane Mountain Bluegrass Festival with a major red wine buzz when Bob approached my r-pod and asked if I would like the last of their tomatoes because they were recrossing the Alaska border in the morning and knew they would be confiscated and destroyed.

I had just been in Dyea RVing on the tidal flats earlier that week and said, “eggs too” and told him how I had to give up my eggs because of some avian chicken flu down near Vancouver somewhere. So I pre-con-

fiscated most of their perishable groceries and learned they were sunbirds from Phoenix escaping the insufferable heat of the Arizona low desert until “the leaves in Alaska change colours.”

That was their annual signal to start drifting south and go home. This was their tenth year of driving around Alaska with no known specific destination, and I was eating Spanish omelettes for a week in their honour after they left. Betty even tried to give me all the leftovers in their fridge, but I had other birds to fry. Such as:

counted 840 swans performing mating rituals in early April while waiting for the snow to melt and lakes and rivers to flow.

Accordingly, the first RVs every spring are called swans, although most aren’t tourists at all but Alaskan snowbirds returning home early to prepare their summer tourist businesses, before the arrival of the true touring swans a couple weeks later. And selecting a new mate doesn’t appear to be their primary motivation on their way through the Yukon, but you never know.

Geese get all the honking ink, but the first birds to show up in the Yukon and Alaska every year, the true romantic harbingers of spring, are the snowy white tundra or trumpeter swans. There is a place just south of Whitehorse on Marsh Lake called Swan Haven where the local schoolchildren

I realize Americans call them Canadian geese, but that’s not fair to Canada because they spend at least half the year eating in America, Mexico and Central America. Their big “V” formations in the spring and their persistent honkings bring joy to the hearts and ears of most Canadians just as their

Tourists who honk their horns in downtown Whitehorse or complain about anything at all, especially our bearrepellant outhouses, are called geese and most are named Bob and Betty from Kankakee.

Quacking ducks Did you hear about the old drink bartenders are again serving in the Yukon? It’s a glass of Baby Duck with a shot of tequila, called a tight quack.

In reality, tourist ducks are noisy visitors who set up right outside the bedroom window where you lay your head to sleep in sweet slumber.

Recently at Takhini Hot Pool I suffered the worst kind of quackery while attempting to start this piece, Germans.

Yukon beer affected them like laughing gas and I couldn’t understand a word of their hilarity. They were playing picnic table poker using rocks for chips, which appeared to be the most fun they ever had.

That morning I lambasted them with my only available editorial diatribe in German: “GUTEN MORGEN! DANKE

UND AUF WIEDERSEHEN!!!”

That means, “Good morning. Thank you and goodbye.”

Canadians are always polite to visitors even when we don’t want to be.

As my hero, Sam Clemens, put it: “It’s awful undermining to the intellect, German is; you want to take it in small doses, or first you know your brains all run together, and you feel them flapping around in your head same as so much drawn butter.”

Uh oh. I just noticed they left their chairs, drying towels and poker chips here. There goes the Spell of the Yukon.

Great American bald eagle As an ex-USMC Vietnam veteran (Chu Lai mostly, 196667), I’ve never understood America’s patriotic devotion to this lazy scavenger which is really nothing more than a vulture in dress blues. It was also the predominant symbol of Nazi Germany, the Roman Empire, the Mongols led by Genghis Khan and who knows how many other conquering nations and Chinese warlords.

It classifies as a predator, a bird of prey, and is a suitable

symbol for violent empires but it’s mostly fiction because it “preys” on small, injured mammals and helpless fish.

The Chilkat River, near Haines, Alaska attracts thousands of them when the salmon are running, but the eagles mostly sit in the trees watching the grizzly bears do all the work, then swoop down for the leftovers.

We get lots of eagles coming up the Alaska Highway in the summer. You can tell them by either the olive drab, camo or red, white and blue vehicles, some painted like the American flag with stars and stripes and a sound system playing God Bless America.

As a veteran I always salute them, old habits die hard, but most Yukon kids just wave their street hockey sticks at them and carry on with more important matters, like trying to figure out how to beat a goalie with a low wrist shot.

It’s their grandparents who sometimes mutter about the construction of the highway by the U.S. Army corps of engineers in 1942. They killed and ate so many moose and caribou while they were here,

it took 10 years after the end of the war for the stocks to recover and feed Yukoners again.

And everybody knows there weren’t any mosquitos in the Yukon until the U.S. Army built all those airfields, because there wasn’t anywhere for them to land.

But thanks for the road.

Couldn’t have built it without you.

Whiskey jacks The real Whiskey jacks are actually called western jays or “camp robbers” and make good company around campfires. The tourist whiskey jacks are the same, friendly visitors from around the globe named Bob and Betty who tell funny stories, ask good questions and increase your knowledge with a tidbit or two of intelligence you never knew before. You are always sorry to see them go, until you notice your fresh loaf of rustic French bread is missing.

Ravens The common raven is a sacred bird in the Yukon, the official bird of the territory and is treated with the same

respect bald eagles receive in Alaska. Like eagles, they are also scavengers whose main duty is cleaning up the mess others leave behind. They are Yukon ubiquitous, which means everywhere, much like summer tourists.

Visitors should be aware that biggest compliment you may hear is when a Yukoner calls you a raven. It’s no different than being called an eagle in America, so leave your guns and grenades in the truck if somebody calls you one. If they truly wanted to insult you, they would have called you a “yellow-bellied sapsucker.”

Them’s fightin’ words, even in Canada, the world’s most peaceful large nation, where the only thing worth fighting for is possession a four-inch hard rubber black disk in the late spring during the annual tribute to Lord Stanley’s drinking mug when bird watching season is in full swing.

building,â&#x20AC;? says Tompkins. â&#x20AC;&#x153;But over there we had five rooms; here, we have eight. Each dentist here has two rooms to work out of to help keep on top of appointments a lot easier. â&#x20AC;&#x153;When they finish one patient, the next is ready to go in the next room.â&#x20AC;?

Tompkins says it is important for patients and dentists, both, to have appointments started and finished on time.

But Tompkins relies on the current staff to vet the candidates as well. The other member of the team is Dr. Harpreet Atwal, from Toronto. She owned two practices there, but she just wanted

to get out of Toronto, says Tompkins. She moved here a year ago.

Pine Dental Clinic was located in the log cabin at the corner of Main and Fifth for many years. That is where Tompkins first worked as an assistant to Dr. Tucker 22 years ago.

She has since purchased the business from Marika Biro and, 10 years ago, bought the current space at the corner of Second and Black that features wheelchair access and much better parking. â&#x20AC;&#x153;Some patients miss the little old log

building,â&#x20AC;? says Tompkins. â&#x20AC;&#x153;But over there we had five rooms; here, we have eight. Each dentist here has two rooms to work out of to help keep on top of appointments a lot easier. â&#x20AC;&#x153;When they finish one patient, the next is ready to go in the next room.â&#x20AC;?

Tompkins says it is important for patients and dentists, both, to have appointments started and finished on time.

Free use of beach house merits more than perfunctory thanks

DEAR MISS MANNERS: My wife and I have the good fortune to be co-owners of a house near the beach. When we can’t use it, we often offer it to friends for the weekend or the week. This is a community where many of the houses are rented during the summer at rather high rates.

I am surprised that while our friends have thanked us (usually

just an email), there has been no offer of any reciprocity beyond that, and often the thank-you seems rather perfunctory.

In particular, one close friend has stayed there five times. After her last stay, I wrote her an email suggesting that she might want to buy a small item that we could use at the house. I never received a response to that email, and I thought that perhaps the email had gone astray (it happens).

But the last time I saw her, she mentioned that it was still “at the top of her mind.” Now a half-year later, we had already made that purchase, and I told her so.

I know that she, her husband, children, mother, father and aunt enjoy their time at the beach, and when we can’t use the house it seems silly to have it go unoccupied. But at the same time, I feel like I have been very generous without any sign of reciprocity.

Suggestions? Or should one just realize that generosity is its own reward, and if that is not enough, stop offering?

But she generally hears it from youngsters who are indignant that their selfish grandmothers expect them to say they received presents she sent. Instead of troubling them, why not just look to see if the checks are being cashed?

This is not an argument that charms Miss Manners, even when it is bolstered by recitals of how many other demands there are on teenagers’ valuable time.

She does not have far to go to find greater examples of selfishness than that of hoping to hear that one’s attempts to please have been successful.

In your case, you can presume that these people like the beach house, because they keep coming back. What is lacking is any sign that they actually like you for providing it. Surely if they did, they would invite you to visit them, or otherwise exhibit gratitude (in more than a five-second email) for this enormous annual favor.

Personally, Miss Manners would be thinking warmly about strangers who pay those rather high rents. Call her selfish, but she thinks of it as saving those friends from the selfishness into which they have sunk.

Frotten rockets to second bronze at Parapans

ithin a couple days of winning two medals at the Parapan Am Games in Toronto, Whitehorse’s Jessica Frotten was already back on the track training.

Her successes in Toronto could land her a spot on the Canada’s team heading to worlds and she’s not about to slow down.

“That team will be named in a couple weeks and I think I have a pretty good shot of being on it,” said Frotten. “So I’m just going back into training … I’d love to have a little bit of time off, but there’s just no time.”

The 27-year-old para wheelchair racer isn’t ready to slow down, she’s only getting faster.

Frotten captured her second Parapans bronze medal in the 400-metre on Friday, notching a personal best time of 1:01.13 in the final.

“I’m totally on a high right now,” said Frotten, who races in the T53 category. “It was an

incredible experience just to go out on the track and have so many people cheering for you – the stands weren’t full by any means, but there were a lot of Canadian fans.”

“The 400 was my best race for sure,” she added. “Everything just came together and winning a bronze there was so awesome.”

Frotten took first in her 100-metre semi last Wednesday and went on to win

McClammer.

“I’ve been chasing (Dupont) around the track all season, so to get her in the 400 was pretty good,” said Frotten. “We were roommates the whole time out there, we spent a lot of time together, so we’re pretty tight.”

Frotten has come a long way in a very short amount of time. She pocketed her first track wins in the spring of 2013 at a meet in Victoria,

Frotten, who lives in Regina and races with the Saskatoon Cyclones, was selected for the Parapan Am Games following a stellar performance at the 2015 Canadian Track and Field Championships last month, winning two silver and three bronze.

race walk on Aug. 10 to become the first Yukoner ever to win a medal in athletics at a major Games. â&#x20AC;&#x153;I feel really proud,â&#x20AC;? said Smith. â&#x20AC;&#x153;I just started race walking this summer, so Iâ&#x20AC;&#x2122;ve been training all summer for it. I donâ&#x20AC;&#x2122;t really have any background in it, this is my first race in race walk.â&#x20AC;?

Whitehorseâ&#x20AC;&#x2122;s Max Clarke and Benjamin Grundmanis became the first Yukoners ever to compete in beach volleyball at a major Games.

The two Yukoners went winless in five round robin matches in the first three days of competition under a blazing sun. They finished with their closest match of all, losing 9-21, 2118, 15-11 to N.W.T. in the fifth/sixth place crossover match, finishing

sixth on Aug. 11. â&#x20AC;&#x153;Itâ&#x20AC;&#x2122;s been an awesome time.

Thereâ&#x20AC;&#x2122;s so much to learn still. There are some super strong teams to learn from, and theyâ&#x20AC;&#x2122;re all super nice and friendly and they help you out,â&#x20AC;? said Grundmanis. â&#x20AC;&#x153;The entire experience has been pretty great.â&#x20AC;?

The next Western Canada Summer Games will be hosted by Saskatchewan in 2019.

Ducklings given head start at wildlife preserve run

Before participants left the start line at the fourth annual Run Wild Event, they got to see an example of what they were running for at the Yukon Wildlife Preserve on Monday.

Two orphaned redhead ducklings were released into the preserve’s marsh habitat just

prior to the start of the run. The ducklings were brought to the preserve in July and have spent the last month in the preserve’s rehabilitation centre.

“They were very small and would not have been able to take care of themselves and at that point would have been easily preyed upon,” said Lindsay Caskenette, the preserve’s visitor services administrator. “So we’re

just giving them a second chance and giving them some time ...

We didn’t have to do any surgery or anything … They were just orphaned.”

A total of 36 runners and walkers took part in the event, raising $642 for wildlife rehabilitation.

Last year 122 took part, raising $2,288 to help build an enclosure for orphaned baby red fox.

One thing that wasn’t preserved was the record for the

five-kilometre and one metre course.

Whitehorse’s Jordon Lindoff, 34, shaved almost a minute of last year’s record time, reaching the finish in 20 minutes and nine seconds.

“It was awesome. There are animals everywhere, the people

are awesome and it’s just fun,” said Lindoff, who started racing triathlons a few years ago.

“Once or twice I visualized a muskoxen chasing me for a little extra boost. They’re terrifying.”

Lindoff finished with a lot of breathing room. Andrew Smyth came second at 26:29. Bobby

Prematunga was third for males at 27:18.

Whitehorse 10-year-old Lisa Freeman was the top female runner on the day with a time of 26:53.

Tara Grandy, who ran pushing a stroller with two small children in it, came in at 27:02. Sue Kem-

mett placed third for females at 27:18.

Womenâ&#x20AC;&#x2122;s Legal Advocate The Womenâ&#x20AC;&#x2122;s Legal Advocate develops and delivers support services to women involved in the legal/justice system including criminal justice, victim support, child protection, landlord and tenancy issues, wellness court, and family legal matters. In this capacity the Womenâ&#x20AC;&#x2122;s Legal Advocate provides: 1) advocacy & support services; 2) assists clients in identifying and reaching their goals; 3) links clients to services; and 4) provides training to clients and organizations on navigating the legal system. Developing and maintaining community partnerships and collaborative relationships are integral to the success of the position.

The breadth of advocacy required necessitates a strong familiarity with multiple legal streams. The Womenâ&#x20AC;&#x2122;s Legal Advocate provides non-judgmental services, and honors and respects cultures and the unique life story of each woman.
